Four Arrows has imposed Conditions & House Rules relating to the occupantsof the Premises which are aimed at maintaining the premises’ habitabilityand protecting the use and enjoyment of the Premises for all of theoccupants.

The Lessee hereby agrees to be bound by the Conditions & house Rulesrelating to the Building and to ensure that the Lessee and his/her guests orinvitees, obey the Conditions & house Rules, as set out herein, at all times.

Failure to comply with the Conditions & House Rules will constitute abreach of this lease. Should Four Arrows cancel this lease due to theLessee's breach of the Conditions & House Rules, the Lessee will forfeit anyrental paid for the month in which the breach was committed, the depositpaid and interest thereon, and shall be subject to certain penalties as setout in the clause relating to breach of the agreement.

The PeRiOd ANd RiGhT TO LeASe

The lease shall commence on the Lease Start date and terminate on LeaseEnds date as set out above. The lease is for a fixed term period.

ReNTAL PAyABLe

The rental payable for the period of the lease is the monthly rental permonth as stated in the Lease Terms above. Rental shall be payable monthlyin advance on the first day of each and every month of this lease and anyextension thereof without deduction, or set-off whatsoever. The rental ispayable directly into Four Arrows's bank account as set out above or suchother bank account as the Four Arrows may from time to time direct. Four Arrows reserves the right to charge a penalty fee of not less than R300(three hundred rand) should the Lessee not make payment by the 7th dayof every month.

UPFRONT ReGiSTRATiON Fee, dePOSiT ANd FiRST MONThSReNTAL

The Lessee shall on signature of this agreement pay:

1. A non-refundable registration fee to Four Arrows as set out herein, onsignature hereof;

2. A refundable deposit equal to one month’s rental. The deposit shall, atthe discretion of Four Arrows be applied to any damages or repairs to thePremises, occasioned by the Lessee, and only thereafter to arrearrentals; and

3. The first month’s rental

The Lessee shall not be granted access to the Premises until such time as allof these amounts are paid.

Four Arrows shall deposit the refundable deposit into an interest bearingaccount under and in accordance with Section 3(d) of the Rental HousingAct No 50 of 1999 am amended (“RH Act”).

• Four Arrows shall, within 21 (twenty one) days of the Lease End Date,refund the deposit and the interest thereon to the Lessee afterdeducting the costs for any and all damages relating to the LesseesAllocated Room and/or Premises or arrear rentals or equipment hire(e.g. heaters).

• In the even that there are no damages or need for repairs to the LesseesAllocated Room and /or Premises and no arrear rentals or equipmenthire cost outstanding, then and in that event, Four Arrows shall refundthe deposit and the interest thereon to the Lessee within 7 (seven) daysof the Lease End Date.

USe OF PReMiSeS

The Premises shall be used for residential purposes only. The Lessee shallnot cause or permit any disorderly conduct of whatsoever nature upon thePremises, nor do or permit to be done any act, matter or thing about thePremises which shall constitute a nuisance or any inconvenience to theneighbours or any other person or persons. The Conditions & house Rulesform an essential part of this agreement and need to be adhered to by theLessee at all times. A breach of the Conditions & house Rules willconstitute a breach under the Lease Agreement.

CeSSiON ANd ASSiGNMeNT

The Lessee shall not cede or assign this lease, either in whole or in part, norsublet the Premises and or his/her Allocated Room or any portion thereof,nor permit or allow any other person or persons to occupy the Premises orto reside thereon or to obtain possession thereof, with or withoutremuneration.

eLeCTRiCiTy ANd WATeR CONSUMPTiON

Included in the rental is the charge for the use and consumption by theLessee of all electricity and water consumed upon the Premises. This amounts to R_____________ per Lessee, per month. Four Arrowsreserves the right to increase the rental should the amount of electricity andwater consumed be greater than this. Four Arrows shall apply the rule ofcollective consumption at its discretion.

In order to maintain the amount charged we request that you:

1. Use only the minimal amount of electricity and water required;

2. Switch off all lights and electrical appliances while not in use or when theLessee leaves his/her Allocated Room;

3. Bar heaters are strictly forbidden;

4. Water should be used sparingly. Please report any leaks to thesecurity/building manager as soon as they are noticed;

5. Discard rubbish (including uneaten or stale food) in the dust binsprovided;

6. Keep the bathrooms and kitchens in a clean state as the Lessee wouldlike to find them;

7. Ensure that all stove plates and ovens are turned off when not in use.

iNSPeCTiON OF The ALLOCATed ROOM ANd The LeSSee'SMAiNTeNANCe OF ALLOCATed ROOM

Prior to the Lessee moving into his/her allocated room, Four Arrows and theLessee shall jointly inspect the Allocated Room so as to identify any damagesand/or defects. The Lessee is required to bring any damages and or defectsto Four Arrows’s attention in writing within 5 (five) days of taking occupationof his/her allocated Room. Failure by the Lessee to draw any defects/damages to Four Arrowss attention within the time period allocated shallresult in the Lessee automatically acknowledging that at the Lease Start datethe Premises and the furniture in the allocated room are in good order andcondition and that all keys, locks, glass windows, electrical installations andother accessories are likewise in good order and condition.

The Lessee hereby agrees and undertakes to keep and maintain the Premisesand the furniture situate therein in good order and condition and in a clean,sanitary condition during the currency of this lease and any renewal thereofand undertakes that at the termination of this lease it will return andredeliver the Premises and the furniture to Four Arrows in good order,condition, fair wear and tear excepted.

Should the Lessee fail to comply with the aforegoing conditions, Four Arrowsmay, on behalf of the Lessee, expend any sum necessary for the maintenanceetc. as referred to in this paragraph, and any amounts so spent shall bepayable by the Lessee to Four Arrows on demand.

On expiry of the Lease Four Arrows and the Lessee must arrange a jointinspection of the Lessee’s Allocated Room, no less than 3 (three) days priorto the end date of the lease, so as to ascertain whether there has been anydamage caused to the Allocated Room.

Should the lessee fail to respond to Four Arrows’s request for an inspection,then Four Arrows may inspect the Lessee’s allocated room, within 7 (seven)day of the expiry of the lease.

KeyS

On the Lease Start date the Lessee shall be handed a full set of keys allowingaccess to the Premises and his/her allocated Room. The Lessee undertakesto return the full set of keys upon termination of this lease to Four Arrows.In the event of the Lessee misplacing the full set of keys, new keys will beprovided by Four Arrows, at the Lessee's expense.

SeCURiTy MeASUReS

Four Arrows, as its sole discretion, shall be entitled to install such securitymeasures, in particular relating to access to the Premises, as it deemsnecessary. The Lessee shall be obliged to comply with any procedures orrules relating to such security measures. Any infringement of the securitymeasures, such as, but not limited to, allowing any person or persons accessto the Premises without prior approval by Four Arrows will be considered abreach of the agreement.

• It is the Lessees responsibility to keep his/her room locked at all timesand to ensure that all windows are closed and secured when the Lesseeis not present in his/her room.

• The Lessee should refrain from giving the keys for the Premises andhis/her Allocated Room to any third party.

• It is the Lessees responsibility to ensure that there are no key tags thatcould identify the Premises and Lessees Allocated Room to a third party,in the event that the Lessee mislays his/her keys. It is vital that the Lesseetake good care to ensure that he/she never leaves his/her keys in a placethat same could be stolen or lost.

• in the event that the Lessee loses his/her keys the Lessee will be heldliable for the cost of replacing and issuing new keys (a cost of no lessthat R 120.00), together with an administration costs and locksmithfees (if required).

• Tampering with any security or firefighting equipment is a seriousoffence and is strictly forbidden. Should the Lessee tamper with the fireequipment in any way, Four Arrows reserves the right not only to havethe Lease terminated but to lay criminal charges against the Lessee.The cost of restoring such equipment will be for the Lessee’s account(minimum charge of R500)

• The use of candles, oil lamps, incense or anything that produces a nakedflame is a potential fire hazard and is strictly forbidden to be used in theLessee’s Allocated Room or on the premises.

ViSiTORS TO The PReMiSeS • Visitors are welcome provided that they observe the Conditions & House

Rules contained in the lease.

• The Lessee may not have more than 2 (TWO) visitors at any given time.

• All visitors are required to report to security and are not permitted to beentertained in the Lessee’s Allocated Room.

• Visitors will be required to leave some form of identification (studentcard/drivers licence/Identity Document) with security prior to beingallowed access to the Premises;

• The Lessee will be required to fetch and identify all visitors at theentrance of the Premises. No visitors are allowed to remain on thePremises if not in the company of the Lessee. Should the Lessee leavethe Premises, its visitors must do the same.

• The Lessee will be wholly responsible and financially liable for anydamages caused by its visitors.

• Visitors may have access to the Premises from 9h00 to 22h00.

• No visitor is permitted to stay overnight. Should Four Arrows find thatthe Lessee has allowed a visitor to sleepover, it reserves the right tocancel the lease immediately.

• Four Arrows reserves the right to place further restrictions on the accessof visitors in the event that inter alia utility consumption increasesdramatically, visitors' behaviour is inappropriate or there are too manypeople on the Premises which may compromise the safety of those onthe Premises.

• Four Arrows and/or its appointed security personal and/ormanagement staff reserve the right to search the bags of the Lesseeand or its visitors at any time and will confiscate any weapons, alcohol,illegal drugs or any other illegal substance/items. Should the Lessee orany of its visitors be found in possession of any of the aforesaid itemsthe Four Arrows reserves the right to immediately cancel the lease andrequired the Lessee to vacate the Premises forthwith.

FOUR ARROWS'S MAiNTeNANCe

Four Arrows is under a duty in terms of the RH Act to provide to the Lesseea dwelling which is safe and suitable for living therein and such dwelling musthave adequate space, provide the lessee with protection from the elements,prove physical safety to the lessee and his/her visitors and such dwellingmust be structurally sound.

In order to provide a dwelling which is habitable under and in accordancewith the Act:

• Four Arrows shall be responsible for maintaining the main walls, roofand other structural aspects of the Premises, in good order and repair.

• Four Arrows is mindful of the Lessees right to privacy. Accordingly FourArrows or its agent shall be entitled at all reasonable times to enter thePremises and the Lessee’s Allocated Room, on Notice of at least 1 (one)month to inspect the condition thereof.

• Four Arrows and its appointed employees and or agents, shall executeany repairs to the Premises and or Allocated Room, both external andinternal, as required in order to maintain the premises and Allocatedroom in good order and condition.

• Maintaining of the Premises in good order and condition shall bedeemed to include, inter alia, maintenance and repairs where necessaryto all furniture, doors, windows, electric bulbs and connectors, taps,drains, sewerage and the keeping of all sewerage free from blockage. Itis in the Lessee’s best interests to work with Four Arrows in order toensure that all facilities on the premises are in good working order. TheLessee should report all problems to Four Arrows as soon as possible.

• Four Arrows shall not be responsible for any loss or damage sustain bythe Lessee as a result of the main walls, roof or other structures aspectsof the Premises being or becoming defective through any act or omissionon the part of Four Arrows or its employees/Agents.

eLeCTRiCAL iNSTALLATiONS

The Lessee hereby undertakes to refrain from interfering with the presentelectrical installations on the Premises and shall not affix or connect anyelectric lamps, motors, fans or heaters other than those designed for use forthe electric current supplied to the Premises. Damage done to such electricalinstallations by "short circuits" shall be made good by the Lessee. FourArrows reserves the right to make good such damage at the Lessee’sexpense.

CARe OF The PReMiSeS, COMMON AReAS ANd ROOMS

• The Lessee must keep his/her room clean and tidy at all times.

• Bed linen should be changed and washed at least once a week.

• The furniture provided in the Lessee’s Allocated Room may not beremoved from the Allocated Room, or the Premises. The full cost ofrepairing any item of furniture or electrical appliance provided by FourArrows will be charged to the Lessee together with an administrationcharge of not less than R100.

• Insects and rodents are a health hazard - all food kept in the Lessee’sroom must be stored in suitable containers or wrapped tightly, thisprevents insects or rodents from accessing it.

• Stale, un-used, wasted or spoilt food must immediately be thrown in thedustbins provided in the kitchens.

• All rooms are inspected regularly. Any damage found to the room oninspection will be billed directly to the Lessee on a monthly basis.

• Should Four Arrows find that the state of the Lessee’s room is such thatthere may be a potential health hazard; the Lessee will be formallyrequested to clean his/her room.

• Should the Lessee consistently keep his/her room in a unsanitary stateFour Arrows shall arrange for the room to be cleaned and all costsassociated therewith shall be for the Lessee’s account.

• The Lessee will ensure that prior to vacating the room, for weekends,vacations or otherwise, that his/her room is cleaned and that any fooditems and/or drink is stored away or thrown out and that pots, pans,cups and plates are cleaned. Four Arrows reserves the right to clean theLessee’s room in his/her absence and to hold the Lessee liable for thecosts incurred (which will not be less than R100). Four Arrows will not beheld liable for any losses or damages incurred by the Lessee in thecleaning process.

• The Lessee is forbidden to cook food in his/her Allocated Room.

• The Lessee may not remove any microwave ovens or hot-plates suppliedby Four Arrows from the communal kitchen.

• Clothes or other items may not be hung from the windows of thePremises.

• No posters or other items may be permanently affixed to the walls,windows or furniture of the Lessee’s room or any other part of thebuilding.

• It is in the Lessee’s best interests to keep the building in a clean state.Please do not soil, mark, litter or damage the common areas of thebuilding.

• Toilets must not be used for the disposal of any foreign objects; onlydomestic toilet paper may be flushed down the toilet.

CONSideRATiON FOR OTheRS• Disorderly behaviour that results in the disturbance of others may lead

to immediate termination of the lease agreement. In such case theLessee shall be liable for an amount under and in accordance with theBreach clause set out herein.

• Playing of music or other sound generating instruments/equipment at anunreasonable volume and/or at unreasonable hours is strictly forbidden.

• Four Arrows reserves the right to confiscate any music/soundequipment/instruments in the event that the Lessee does not adhere tothis rule. Such sound or musical equipment/instrument will be returnedto the Lessee at the end of each university semester.

• Shouting, calling or talking in a raised voice is not acceptable.

• Running in corridors or in any other areas of the building is notpermitted.

SMOKiNG, dRUGS, ALCOhOL ANd WeAPONS

• The Premises are a smoke free zone.

• The Lessee and or his visitors are forbidden from bringing weapons ontothe Premises including but not limited to firearms, knives, clubs, Batonsand traditional weapons.

• Smoking, the consumption of alcohol and or the taking of illegal drugsand or substances on the Premises is strictly prohibited.

• There shall be no storage of alcohol, illegal drugs and or substances andor weapons on the Premises.

• The Lessee shall not sell ANY dugs and or prohibited substancesincluding prescription and or over the counter medication.

• Should alcohol, any form of illegal drugs and or substances, and orweapons be found on the person of the Lessee or in his/her AllocatedRoom, then and in that event Four Arrows reserves the right toimmediately terminate the lease and take whatever legal action that itmay deem appropriate as against the Lessee.

MediCAL CONdiTiONS ANd diSABiLiTieS

• Should the Lessee suffer from any medical illness or disability, FourArrows requires that the Lessee notify it, in advance so that it may takesthe appropriate steps in the event of a medical emergency.

• The Premises is not wheel chair friendly.

MiSCeLLANeOUS

• There shall be no group meetings or demonstrations permitted on thePremises.

• Pamphlets of any nature may not be placed or handed out on thePremises without Four Arrows‘s prior written consent.

• Failure to observe the Conditions & house Rules will constitute abreach of the Lease Agreement and may lead to termination of theLease.

dAMAGe TO The PReMiSeS

The Lessee shall not drive nor permit to be driven any nails or screws into thewalls or ceilings of the Premises or any portion of the Premises. The Lesseeshall not make or permit any alterations, additions or improvements to thePremises without obtaining the prior written approval of Four Arrows.

The Lessee shall be liable for any damages caused by him/her to thePremises or AllocatedRoom or any part thereof.

deSTRUCTiON OF The PReMiSeS

Should the Premises be destroyed by fire or through any other cause duringthe period of this lease, to such an extent so as to render the Premisesuninhabitable, then this lease shall be terminated. In the event that thePremises is only partially damaged/destroyed by fire or through any othercause, but remains habitable then this lease shall not be terminated and theLessee shall continue to pay the monthly rental.

iNSURANCe ANd iNSURANCe PReMiUMS

Four Arrows shall insure and keep insured to the full value thereof thePremises against risk of damage by fire and other risks as Four Arrows mayrequire.

The Lessee is encourages to take out an insurance policy to insure the valueof his/her personal possessions in the event of loss or damage to same whilston the Premises. Four Arrows, its employees, contractors or agents shallnot be responsible for any loss, damage or personal injury suffered by theLessee or his/her visitors or invitees, whilst at the Premises.

The Lessee shall not bring, nor permit to be brought, upon the Premises anygoods, furniture or effects which may by their nature increase the rate ofinsurance premiums payable by Four Arrows or violate the fire insurancepolicy held by Four Arrows or which may be impregnated by any wood borer,termite, or any other wood destroying insect of any kind.

Bye-LAWS

The Lessee shall strictly observe all Government, Provincial and MunicipalLaws, and Regulations applicable to the Premises and the conditions of titleof the Property.

dUe diLiGeNCe

Four Arrows reserves the right to carry out any due diligence investigationsregarding the Lessee and the Payee/Surety as it deems necessary. The Lesseeand Payee/Surety on signature hereof agree that Four Arrows my performsuch due diligence investigations. Four Arrows reserves the right to blacklistany Lessee and/or Payee/Surety for delinquent behaviour by the Lessee andor Payee/Surety under and in accordance with the terms of this Lease.

BReACh

Notwithstanding any rules/regulations, terms and condition set out herein,should the Lessee inter alia:

• Fail to pay the monthly rental or any sum (s) which the Lessee is liablefor under and in accordance with this lease, on due date; and/or

• Contravene alternatively fails to observe one or more of the provisioncontained in this lease which incorporates the Conditions & House Rulesof the Premises;

then such contravention and or failure (as the case may be) on the part of thelessee, shall constitute a breach of the lease agreement.

Notwithstanding any prior waiver of Four Arrows rights, and withoutprejudice to any and all rights to institute proceedings against the Lessee,Four Arrows shall be entitled to cancel this lease, reclaim possession of thePremise and the Lessees Allocated Room, and (if needs be) eject the Lesseeand any and all of his/her occupants/invitees, should the lessee breach theagreement.

Four Arrows's rights in terms of this clause shall be without prejudice to anyclaim it may have for rental already due and for such further damages asFour Arrows may sustain by reason of the Lessee's breach of this lease.

CANCeLLATiON OF The LeASe By FOUR ARROWS

1. On cancellation of the lease by Four Arrows in writing, for any reason:

1.1. The Lessee shall vacate the Premises within 12 hours of receipt of suchwritten notice; and

1.2. Four Arrows shall be entitled to retain the deposit and all interestaccrued thereon.

1.3. The Lessee shall forfeit the rental paid for the month in which thecancellation is received;

1.4. The Lessee shall be obliged to pay to Four Arrows a penalty rentalequal to TWO (2) additional months rental

TeRMiNATiON OF The LeASe By The LeSSee

2. In the event that the Lessee terminates the Lease prior to the leaseend date, then and in that event:

2.1. The lessee shall terminate the lease in writing, by letter, delivered toFour Arrows.

2.2. On deliver of a letter of cancellation, the Lessee shall be obliged to payto Four Arrows a penalty rental equal to TWO (2) months rental; andwill forfeit the deposit and interest accrued thereon to Four Arrows;and

2.3. The Lessee shall have 24 hours in which to vacate the Premises upondelivery of the letter of cancellation, unless an alternative arrangementis made between Four Arrows and the Lessee.

3. In the event that the Lessee vacates the Premises before the Expirationdate and without Notice to Four Arrows, then and in that event:

3.1. The lease shall be deemed to have expired on the date that FourArrows establishes that the lessee has vacated the leased premises;

3.2. the Lessee shall be obliged to pay to Four Arrows a penalty rentalequal to THREE (3) months rental; and will forfeit the deposit andinterest accrued thereon to Four Arrows.

dOMiCiLe & NOTiCeS

• Any notice required to be given under this lease shall be sent in writingto Four Arrows at its Premises or such other address as Four Arrows maystipulate in writing from time to time.

• The Lessee choses his/her “domicilium citandi et executandi" to behis/her Allocated Room at the Premises, whilst the lease is in full forceand effect.

• Any notice required to be given in terms of the lease whilst it is in effectshall be delivered to the Lessees Allocated Room and sent via electronicmail to the Lessee and Payee/Surety’s electronic mail addresses providedherein or such other electronic mail address as the Lessee and orPayee/Suerty may stipulate in writing.

• For the purposes of any legal proceedings that Four Arrows may instituteagainst the Lessee and or Payee/Surety after the termination of thelease, the Lessee and or Payee/Surety chose their home or work addressrecorded herein, to be their respective “domicilium citandi etexecutandi".

• Any Notices required to be given shall be of no force or effect unlessaccompanied by proof of deliver and/or receipt which may include interalia, registered mail, telefax transmission slips, hand delivery with proofof deliver and electronic mail delivery and or read reports.

eXTeNSiON

Any agreement for the extension of this Lease Agreement shall be by mutualagreement between Four Arrows and the Lessee and reduced to writing.

eNTiRe AGReeMeNT

It is hereby specifically agreed that this lease agreement contains all theterms and conditions of the agreement of lease entered into by the Lessee,Payee/Surety and Four Arrows and the Lessee and or Payee/Suretyacknowledges and agrees that any representations, which may have beenmade by any person/entity and not reduces to writing and signed by allparties concerned, shall not be binding or enforceable as against FourArrows.

iNVALid CLAUSe

In the event that any clause in this Lease is held to be invalid, void orunenforceable for any reason, it is agreed between the parties to this Leasethat such clause shall be severed from the remaining clauses of the Lease,which Lease shall be deemed to be valid and enforceable.

iNdeMNiTy

• Neither Four Arrows, it's agents , employees, invitees or contractorsshall be liable for any damages, injury, loss of possessions or loss of lifecaused to the Lessee, the Lessee's Property or the Lessee's invitees, forany reason whatsoever.

• Four Arrows may suffer in consequence of any acts or omissions by theLessee, the Lessee's guests, visitors, invitees on or about the Premises;and against any loss or damage that Four Arrows may suffer as a resultof the non-compliance by the Lessee and or his/her guests, visitors,invitees with any provision of this Lease or the Conditions & HouseRules.

• In the event that the Lessee leaves any items in his/her Allocated Roomafter the End Date of the Lease, then and in that event Four Arrows shallnot be responsible for any loss and or damage to such items.

SUCCeSSORS iN TiTLe

The Lease is entered into by Four Arrows and its Successors in Title and/orassignees (as the case may be). The Lessee agrees that Four Arrows shall beentitled to dispose of the Premises during the term of the Lease. The sale ofthe Premises by Four Arrows during the period of this Lease shall not affectthe terms of the Lease in any way whatsoever nor entitle the Lessee toresign from the Lease or to claim damages as a result thereof.

1. Linen and bedding (sheets, duvets, blankets and pillows) - Four Arrowsprovides the bed and mattress.

4. If the Lessee requires a Fridge – the maximum capacity allowed 130 L(bar fridge). An additional fee will we charged for large fridges.

5 Pots, pans, plates, bowls and cutlery.

6. No HOT PLATES, BAR HEATERS,GAS HEATERS are allowed to be used inthe rooms. You may use a kettle, oil heater and microwave oven forheating food only these items must be supplies by the lessee withpermission from the office. We reserve the right to retract permissionfor the use of such items
