WelcometoCitizensLeadershipAcademy!Communityisacornerstoneofourschool,andaninformedcommunityiskeytothesuccessofourstudents.

The2018-2019CitizensLeadershipAcademyStudentandFamilyHandbookisaguidetothemostimportantpoliciesandproceduresoftheschool.Manyofthemostcriticalaspectsofthehandbookwillbereviewedwithparentsduringmandatoryparentorientationandwithstudentsduringtheirfirstweekofschool.However,parentsshouldreadthehandbookinitsentiretyanddiscussitwiththeirscholar(s).

Weencourageyoutoaskquestionsthroughouttheyearifanysectionsofthehandbookareunclear.Everypolicyandprocedurewascraftedwiththebestinterestofourstudentsandtheirfamiliesinmind.ThefollowinglistofpolicieshavebeenprovidedinCLA’sstudentandfamilyhandbookforquickreference.CLA’scomprehensivestudentpolicyhandbookcanberequestedduringofficehoursinthemainoffice.Welookforwardtopartneringwithyourfamilyforasuccessfulschoolyear!

Mission Statement and School Culture

MISSION:CitizensLeadershipAcademypreparesitsmiddleschoolstudentstoleadinacademics,service,andcivicengagementinhighschool,college,andbeyond.

Highexpectationsforscholarshipandbehaviorwithinanachievement-orientedschoolcultureensuresallstudentswillbeequippedwiththefoundationalskillstoenterinto,excelin,andgraduatefromthemostselectivehighschoolsandcolleges.

CLAstudentsareexpectedtocometoschoolontime,inuniform,andpreparedtolearn,andtotreatthemselvesandotherswithrespectatalltimes.Weteachstudentsthattheirbehavioristheirchoiceandthatallchoiceshaveconsequences.Positivechoicesearnpositiveconsequences,andnegativechoicesearnnegativeconsequences.Wegiveconsequencesinanurturingmannertoteacheachstudentthatwewanthimorhertosucceedandarewillingtodowhateverittakestoensurethatheorshedoessucceed.OurgoalisthatallCLAscholarstakeownershipovertheiracademics,theircharacter,andultimatelytheirschool.

CLApromotesa“noexcuses”cultureamongourstudents,withtheexpectationofahighstandardofachievementandcivility.Studentshaveprovedtheycanthrivepersonallyandexcelacademicallyinthischallengingandsupportiveenvironmentthatemphasizescriticalthinking,activeleadership,andsocialresponsibility.

Ourschoolhasarigorouscurriculumthatpromotesahighlevelofstudentengagementthroughlearningexpeditions,long-term,in-depthstudiesthatmakecontentcomealiveforstudents.Theyofferreal-worldconnectionsthatinspirestudentstowardhigherlevelsofacademicachievement.Learningexpeditionsinvolvestudentsinoriginalresearch,criticalthinking,andproblemsolving,andtheybuildcharacteralongwithacademicscholarship.

General Information Drop-off, pick-up, and office hours

Morning drop-off Anadministratorwillbewaitingforstudentsfrom7:15to7:45a.m.eachmorning,andwillgreeteachscholarwithaCLAhandshake!Inordertohaveasmoothdrop-off,pleasedonotstoponLamontAve.Ifyoumuststoptospeakwithanadministrator,pleaseparkintheCLAparkinglot.

StudentsshouldonlyenterthroughthemaindoorsbytheCLAmainoffice.Studentsdroppedoffpriorto7:15willnotbemonitoredbyaCLAstaffmember.Weencourageourfamiliestoholdtheirchildrenintheircaruntilthefrontdoorisunlockedat7:15.Duringinclementweather,CLAmayopenthedoorearlyforchildrentowaitintheoffice.Thisincludesextremecold,blizzardconditions,orheavyrains.However,thisisdoneonaday-by-daybasisbytheadministratoronsite.

Dismissal and pick-up

Parentsandotherswhoarepickingupstudentsat3:30p.m.shouldwaitinthecarpoolline,andafacultymemberwillannounceeachfamilyasthecarapproaches.Pleasebesuretostayinyourcarsothatthecarpoollinemovesquickly,andyoudonotholduptheline.IfstudentsaretakingtheRTAhome,afacultymemberwillwalkthegroupofstudentstothecornerofourblocktowatchthemcrossby101stontheirwaytothebus.Studentswhostayforschoolactivitiesshouldbepickedupatthedesignateddismissaltime.StudentswillbedismissedbyfacultyattheCLAmainentrance,andparentsshouldfollowthedrop-offandpick-upprotocols.

Theschooldayendsat3:30p.m.andstudentsareexpectedtobepickedupontimeonadailybasis.Onarareoccasion,weunderstandthatlatepickupisnecessary.Onthoseoccasions,pleasenotifytheofficeinadvance.Anystudentwhoisnotenrolledinafter-schoolprogrammingmustbepickedupby3:45p.m.Studentswhoarehabituallypickeduplatewillbereportedtotheprincipalordeanofstudents.Thethirdtimeastudentispickedupafter3:45p.m.,familieswillreceiveaphonecallfromCLAadministrationregardingouralternativeafter-schooloptions.StudentswhoarehabituallypickeduplatewillbeescortedtheMartinLutherKing,Jr.BranchoftheClevelandPublicLibraryuntiltheirfamiliescanfindanacceptableafter-schoolalternative.

School hours and phoning the school

Theschoolofficehoursare7:15a.m.until4:30p.m.MondaysthroughThursdays,and7:15a.m.through3p.m.onFridays,and8:45a.m.through12p.m.onSaturdayswhenSaturdayAcademyisinsession.Anofficestaffmemberand/oradministratorwillbereachablebyphoneatthesetimes.Ourgeneralschoolphonenumberis(216)229-8185.

AttendanceExcellentattendanceisnecessaryforacademicsuccess.CLA’srigorous,project-basedcurriculumrequiresstudentstobeinattendanceeveryday;studentswhomissevenonedayofschooloftenfindthattheyare“behind”whentheyreturn.Ourschoolgoalis100percentstudentattendanceeachday.

Reporting absences

Parentsareaskedtocallschoolby8:30a.m.iftheirchildmustbeabsentthatday.Ifachildisabsentandtheschoolisnotnotifiedinadvance,theCLAofficestaffcallstheparentatthephonenumberprovidedbytheparentorguardian.EachCLAparent/guardianisresponsibleforprovidingtheofficewithacurrentaddressandphonenumber,andforinformingtheofficeofanychanges.Arecordshallbekeptofallcallsattemptedbytheoffice.Ifweareunabletoreachtheparent/guardianbyphonetoconfirmabsences,theparent/guardianisnotifiedbyletter.Excused and unexcused absences Allabsences,whether“excused”or“unexcused,”arestillconsideredabsences.Theschoolwillconsideranabsence“excused”forthefollowingfivereasonswithdocumentation:1. Personalphysicalillnesssevereenoughtopreventattendanceatschool.Absencesforillnesslongerthantwodaysmustbeverifiedinwritingbyadoctor.

2. Illnessordeathinthefamily3. Observanceofreligiousholidays4. Courtsubpoena5. Anemergencyorsetofcircumstances,tobedecidedonanextremelylimitedcase-by-basebasis,thatconstitutesagoodandsufficientcauseforabsence

Thedeanofstudentsreservestherighttoverifysuchstatementsandtoinvestigatethecauseofeachindividualabsence.Repeatedabsencesbecauseofweather,transportationissues,parentillness,and/orfamilyvacationwillcountasunexcusedabsences.

Makeup work due to absence

Studentswithabsences(excusedorunexcused)areexpectedtocompleteworkmissed.Ifpossible,studentsshouldrequestthisworkinadvance;otherwise,thestudentisresponsibleforaskingteachersformakeupworkimmediatelyuponreturntoschool.

Absences due to documented medical condition

Ofcourse,anystudentwho,duetoamedicallydocumentedphysicalormentalimpairment,isabsentforanextendedperiodwillnotbedisciplined.Suchstudentsmaybeentitledtoreceiveaneducationtailoredtotheirindividualneedsorabilitiesasprovidedforunderfederaland/orstatelaw.

Suspensions as absences

Suspensionsareconsideredabsences.Ifstudentsareabsentfromschoolbecauseofsuspension,thesedayswillbetreatedthesameasunexcusedabsences.Asaresult,ifastudentissuspendedseveraltimes,heorshecouldbeindangerofrepeatinghisorhergradelevelbecauseofthenumberofdaysmissed.

Procedures for Habitual Absences and Attendance Intervention Policy

Astudentisconsideredexcessivelyabsentorhabituallytruantifthestudentisabsentwithoutalegitimateexcusefor:

ExcessiveAbsences:

• Absent38ormorehoursinoneschoolmonthwithorwithoutalegitimateexcuse;or• Absent65ormorehoursinoneschoolyearwithorwithoutalegitimateexcuse.

HabitualTruant:

• Absent30ormoreconsecutivehourswithoutalegitimateexcuse;• Absent42ormorehoursinoneschoolmonthwithoutalegitimateexcuse;• Absent72ormorehoursinoneschoolyearwithoutalegitimateexcuse.

Ifthestudentishabituallytruantandthestudent’sparentshavefailedtocausethestudent’sattendance,theSchoolwillinvitethestudentandfamilyintomeetandcreateanattendanceinterventionplan(“AIP”)afterastudentmisses65hoursofschoolandwillcontinuetomeetaftereachhourasstatedaboveissurpassed.ThePrincipalordesigneeselectstheAIPmembers,whoshallincludearepresentativeoftheSchoolwhoknowsthechildandthechild’sparent,guardian,custodian,guardianadlitem,ortemporarycustodian.Membersmayalsoincludeaschoolpsychologist,counselor,socialworker,orrepresentativeofapublicornonprofitagencydesignedtoassiststudentsandtheirfamiliesinreducingabsences.

3. thestudenthasrefusedtoparticipateinorfailedtomakesatisfactoryprogressontheplan,asdeterminedbytheabsenceinterventionteam,oranyofferedinterventionstrategiesoralternativestoadjudication.

Whenachildisabsentfor105consecutivehours,itisCLA’sobligationtowithdrawthatstudentfromtheschool.

WithdrawalAdditionally,perODE,astudentwhomisses/failstoparticipatein105consecutivehoursor14consecutivedaysofschoolwillbeautomaticallywithdrawnfromCLA,unlessthestudent’sabsenceisexcused.Otherwise,aparentmaywithdrawastudentvoluntarilybysigningavoluntarywithdrawalformwiththemodeleducationleaderorhis/herdesignee.

Types of grades at CLA: A reflection of skills needed to succeed in higher education and in the global arena AtCLAwepreparestudentsforhighereducationandfortheworldbeyondtheireducation.Tocompeteinhighschool,college,andintheglobalarena,studentsneedtomasterskillsandconcepts,andtheyalsoneedtodemonstrategoodhabitsofleadership:promptness,thoroughness,thoughtfulness,etc.Forexample,inthejobmarket,ascientistwhomastersquantumphysicsbutcannotorganizehisorherdataandcannotworkwellwithotherscientistswillhaveahardertimefindingajobandeffectivelycontributingtosociety.

TheCLAfacultycreatesstandards-basedstudentlearningtargetsforeachtrimesterineachsubjectarea.TheselearningtargetsarebasedontheCommonCoreStateStandardsandtheOhioAcademicContentStandards.Bothassessmentsandprojectsareanchoredinstandards-basedstudentlearningtargets,andtherefore,progressreportsandreportcardsreflectstudentprogressinmasteryofthesetargets.Studentsearnalettergradeforeachcoresubject:English,math,science,socialstudies,andanygrade-specificskillscourse,suchasresearchandpresentation,andalsoforspecialsclasses:arts,physicaleducation,andoutdoorleadership.Studentsalsoearnahabitsofleadershipgradeincrew.Crewandoutdoorleadershipgradesarenotincludedinastudent’s overallGPA.Students’trimestergradesineachsubjectaveragetoayearlonggrade.Theseyearlonggradesareaveragedtocalculateastudents’GPA/classrank.

Wepreparestudentstofocusonbothmasteryandalsohabitsofleadershipbecausebothcontributetosuccessinacademicsandbeyond.Thus,therearetwotypesofgradesatCLA,masterygradesandhabitsofleadershipgrades,thatcombineinstudents’overallgrades.

Masterygradesreflectmasteryofstandards-basedstudentlearningtargets;howwellthestudentknowsthematerial.Masterygradesincludegradesonlong-termassignments,projects,andtestsandquizzes.Forexample,aunittestontherockcyclewouldbeamasterygradebecausestudentsareexpectedtohavemasteredthelearningtargetafterin-depthstudyandpractice.Studentsmayalsoearnmasterygradesforclasspresentations,short-termassignmentsthatareassessmentsofmastery,andhomeworkthatisassessmentofcontentandskillmastery.Habitsofleadershipgradesreflecthowstudentsconductthemselvesduringclass,thethoroughnessandtimelinessoftheirhomeworkandclasswork,andhowwellstudentsfollowdirections.Studentshavelearningtargetsforhabitsofleadership,also.Mosthomeworkearnshabitsofleadershipgradesbecausemosthomeworkispracticeandreinforcement.Forexample,amathpracticeassignmentonthedistributivepropertywouldbeahabitsofleadershipgradebecausestudentsarenewtothematerialandarenotyetexpectedtohavemasteredtheskill.

Homework policyHomeworkisanimportantcomponentoftheacademicprogramatCLA.Thepurposeofhomeworkisseveral-fold.Homeworkreinforcesconceptsandskillsintroducedduringclass.Itextendstheunderstandingofandexpertisewiththoseconceptsandskills.Itprovidesextrapractice,anditprovidesdesignatedtimetosynthesizeconceptsandskillsinpreparationforanassessment.Homeworkprovidesdesignatedtimetoconductresearchandcompleteprojects.

Althoughhomeworkisanimportantacademiccomponent,itisnotmeanttobeoverwhelming.Homeworkforeachmiddle-schoolstudentshouldtakenolongerthananaverageof20minutesperclass(atotalof80minutesperday)ingradesix,30minutesperclass(atotalof120minutesperday)ingradeseven,and40minutesperclass(atotalof200minutes)ingrade8.Theprogressioninamountandcomplexityofhomeworkreflectsaprogressioninpreparationforcollege-prephighschools.

AtCLA,werecommendthatstudentsusea“homeworkfolder”toorganizehomeworkassignments;homeworkassignmentsshouldbetakenhomeinahomeworkfolderandcompletedworkisbroughtbacktoschoolinthesamefolder.Oftentimes,homeworkwillbeaccessedthroughgoogleclassroomonthestudent’siPad.Parents/guardiansshouldcheckhomeworkpriortotheduedatesothatiftheassignmentiseitherincompleteornotthorough,changescanbemade.Parents/guardiansandstudentsshouldalsodevelopasystemtoputthehomeworkbackintothehomeworkfolder,andputthefolderintothestudent’sbackpackeacheveningsoastoavoidrushingtogetreadyforschoolthenextmorning.Whenhomeworkiscompletedonline,parentsshouldensurethestudentsubmitstheassignmentbytheduedateandtime.Wealsorecommendthatstudentsuseaplanner(eitherphysicalorvirtual)asthisparallelsadultuseofplanners,onlinecalendars,and“todo”lists.Therationaleisthatifstudentsgetinthehabitofusingthesetoolsinmiddleschoolbecausetheyarerequiredtodoso,theywillusethemindependentlyinhighschool,college,andintheiradultlives.

Promptnessisimportantinhighschool,incollege,andintheprofessionalworkplace.Studentsshouldstrivetoturninallassignmentspromptly.CLA’sschoollate-workpolicyallowsstudentstoturninhabitsassignmentsuptooneweeklate.Forexample,ahabitsofleadershipassignmentassignedonMondayanddueonTuesdaywouldbeacceptedthroughthefollowingTuesday.Masteryassignmentswillbeaccepteduptotwoweekslate.Forexample,amasteryassignmentassignedonWednesday,September6,anddueonFriday,September8,wouldbeacceptedthroughFriday,September15.

CLA’s Response to Intervention (RtI) for low-performing students: Daily re-teaching, enrichment, and support, and Saturday Academy CLA’sResponsetoIntervention(RtI)programfocusesonbringingallstudentstograde-levelincoreacademicsubjects,andtomeetingthespecificneedsofalllearnersinourcommunity.OurdirectorofspecialeducationcoordinatessupportforanyincomingstudentwithanIEPora504Plan.ThatpersonalsoworkswiththegeneraleducationfacultyandcoordinatesSaturdayAcademy.ThespecialeducationprotocolsaredescribedindetailintheIDEAPlanprovidedunderseparatecovertoallincomingfamilies.

StudentsonIEPsforacademicconcernswillhaveaspecificplanforremedial/interventioninstruction.StudentswhoarenotonIEPsforacademicconcerns,butwhoarebelowgrade-level,willalsobeassignedtoaspecificsupplementaryinstructionalplan.

Studentswhoareatgrade-levelorabovemaybeeligibleforenrichmentactivities.Although,asacommunityschool,CLAdoesnothaveaformalgiftedprogram,westronglybelievethatstudentswhoareacademically,socially,andemotionallyreadyforadditionalintellectualchallengeshouldbepresentedwithvariousopportunitiesthroughdifferentiationduringclass.Enrichmentmaybeprovidedinanycoreacademicareainadditiontotechnology.

AstudentwhoisbelowgradelevelontheMAPassessmentmayberecommendedtoattendSaturdayAcademyuntilheorshemeetsgrade-levelbenchmarksontheMAPassessmentsand/orearnsa“C-”oraboveinallcoreacademicclasses.SaturdayAcademyisamandatoryacademicsupport,andstudentswhoareassignedtoSaturdayAcademyareexpectedtobepunctualandattendeverysession.

Promotion and Retention Webelievethatstudentsshouldbepromotedonlywhentheyhavedemonstratedmasteryofacademicstandards.CLAisfoundedontheunderstandingthatpromotingstudentstothenextgradebecauseoftheirage,nottheirreadinesstodothework,isnotbeneficialtostudents.Thus,oneofthemostcriticalanddistinctiveaspectsofCLA’sacademicprogramisitspromotionpolicy.Tobuildacultureoflearningandachievement,andtoensurestudentsdemonstratereadinessforthenextgradelevel,weuseastrictandsimplepromotionpolicy.

Studentsmustearna67%orhigheroverallmasterygradeattheendoftheschoolyear(averageofallthreetrimesters)inordertopasstheirclasses.Sixth-orseventh-gradestudentswhoarefailingtwoorthreecoreclasses(English/languagearts,math,science,andsocialstudies)inmid-Maywillberequiredtoattendsummerschool.Atsummerschool,studentsmustdemonstratereadinessbyearningan80%orhigherinhabitsofworkanda70%orhigherinmastery,thiswillincludeanendofcourseassessmentthatisheavilyweightedinthemasterygrade.Studentswhofailoneormoresummerschoolclassmayberetainedintheirrespectivegrade.Studentswhofailallfourcoreclassesthroughoutthedurationoftheschoolyearwillberetainedandwillnotattendsummerschool.

Ineighthgrade,studentswithanoverallfailinggradeinfourorallfivecoreclasseswillberetained.Studentsfailingtwoorthreeclassesmayberetainedonacase-by-casebasispendingtheoutcomeofaparentmeetingandstudentsmayberequiredtocompleteanoutofschoolstudypriortobeingpromotedtohighschool.

Attendance and punctuality

Thestudent’sattendancepatterns(excusedandunexcusedabsences,tardiness,andearlydismissals)andtheireffectonstudentprogresswillbetakenintoaccountwhenevaluatingretentionforastudent.Asoutlinedearlierinthishandbook,studentswhomiss11daysofschoolormorethroughouttheyear,whetherexcusedorunexcused,areat-riskforretention.

Students with disabilities

Promotionandretentionofpreviouslyidentifieddisabledstudentsmaybesubjecttothefactorsandpolicyabove,butshallalsoconsiderthecontentsofthestudent’sindividualizededucationalplan(IEP),inaccordancewithR.C.3301.0711(E)and(M).

A final word on the promotion policy

Retentionand/orplacementdecisionswillbemadeonlyaftertheschoolhasnotifiedandconferredwithparents/guardiansthroughouttheyear(progressreports,reportcardsandparentconferences,etc.)astothestudent’sprogressorlackthereof.Promotionofastudentfromonegradetothenextshallbebasedsolelyonthatindividualstudent’shavingmetapplicablepromotioncriteriaasdescribedabove.However,thefinaldecisiontopromoteastudentshallrestsolelywiththemodeleducationleaderandprincipal,withappropriateinputfromthestudent’steachersandtheprofessionalstaff.

Restorative Practice Rationale

CitizensLeadershiphasusedaprogressivedisciplinesystemsinceitsfounding;however,withinthissystem,wehavealwayspairedconsequenceswithreflectionandconversation.Buildingcommunityandself-disciplinehavebeencornerstonesofourschool.Duringthe2017-2018schoolyear,webeganpilotingrestorativepracticesasacomplementtoourprogressivedisciplinesystem,andbecausewehaveseenpositiveresultsintermsofstudentownershipandpositiveculture,wearenowtransitioningtoarestorativedisciplineprocessbeginningwiththe2018-2019schoolyear.

• Allparentswhomakeappointmentstovisittheirscholar’sclassroomwillbeescortedtoandfromtheclassroom.CLAreservestherighttoremoveparentsfromaclassroomiftheirvisitisunsafeorunhealthytotheclassroomculture.

• Intheunlikelyeventthataparentorguardiandemonstratesverbalorphysicalaggressiontowardateacher,staffmember,orstudentatCLA,ouradministrationwillbecontactedonthespottode-escalatethesituation;awrittenwarningthatassertsifsimilaraggressionoccursasecondtime,thefamilywillberequiredtobeescortedbyadministrationatalltimeswhentheyarehere.Ifthereisathirdinstanceofphysicalorverbalaggression,thefamilymemberwillbeservedwithanofficial“notrespass”letterthatbansthemfromtheschoolexceptbyappointmenttomeetinthefrontofficeareawithfacultyandadministrationasappropriate.

Public conduct on school property EveryoneatCLAneedstofeelsafe,physicallyandemotionally.Forthatreason,weneedtotakeswiftandclearmeasurestoprotectstudents,faculty,staff,andfamiliesfrominappropriatepublicconductonschoolproperty.

Ofcourse,nopersonshallassault,strike,threaten,ormenaceanychild/adultorinterferewithanyactivityconductedinorontheschoolpremises,orunlawfullyassault,strike,threaten,menace,follow,pursue,orlayhandsuponastudentorotherpersoninoronCLApremises,oronthewaytoorfromschoolorschool-sponsoredactivity.Westriveformutualrespectandpartnership,butintherareinstancethatabusivebehavioroccurs,schoolofficialshavetheauthoritytocallalawenforcementofficerifanyindividualviolatesthispolicyorotherpostedregulations,ordoesnotleaveschoolpropertywhenrequestedtodoso.Repeatedoffenseswillresultinthatpersonreceivingwrittennotificationthattheymaynotreturntocampusunsupervisedorlawenforcementwillbecalledimmediately.ThispolicyexistsforthesafetyofeveryoneatCLA,andweknowyouwantustotakeeverymeasuretokeepyourchildsafe.

Incident reports

Allstudentinjurieswillbereportedtoparents/guardiansonawrittenincidentreport.Acallwillbemadetotheparent/guardianinthecaseofastudentinjuryonthedaythattheinjuryoccurs.EachincidentreportwillbecarefullyreviewedbyCLAadministration.

School safety plan

CLAhasaSafetyandSecurityPlandevelopedincooperationwithlocallawenforcementagencies.Theplandefinestheappropriateproceduresfortheprotectionandsafetyofourstudents,staff,andvisitors.Theschoolsafetyplanislocatedinthemainoffice.

Throughouttheschoolyear,studentswillbegivensafetyinstructions,includingthoseforfire,tornado,andlock-downdrills.Theproceduresforeachdrillarepostedintheclassroomsandpracticedregularly.Studentsmustremainsilentandorderlysotheycanrespondtothedirectionsgivenbytheirteachers.Studentswhodonotfollowtheserequirementswillreceiveaconsequence.Thedrillsarescheduled,conducted,anddocumentedaccordingtostateandlocalmandates.

Playground use

CLAutilizestheplaygroundadjacenttothebuildingduringandafterschoolhours.Studentswhoareunsupervisedontheplaygroundbefore,during,orafterschoolmustfollowCLApoliciesand

willstillreceiveconsequencesfortheiractions.Familiesmaynotallowtheirscholarstobepickedupfromtheplaygroundunsupervised.ThosestudentswillbeescortedintothebuildingandCLAdismissalprocedureswillcontinuetobefollowed.

Asayoungadolescent,yourmiddle-schoolchildmayencounternewsituationswithfriendsandpeersthatcouldbeuncomfortableandunsafe.Therearewaystobeproactivetoprotectandsupportyourchildinthesesituations:• Beforeyouallowyourchildtovisitanotherchild’shometostudytogether,workona

Bullying/Harassment Allstudentshavetherighttoaneducationalatmospherethatisfreefromverbaland/orphysicalabuse.Bullyingisdefinedasphysicalorverbalmistreatmentofapersonwhereanimbalanceofphysicalorpsychologicalpoweriscreatedwiththebullybeingstronger(orperceivedtobestronger)thanthevictimandwhichcausesadisruptiontothelearningenvironment.Aggressivebehaviororbullyingisanybehaviorthatmaysubjectastudenttoinsults,taunts,orchallengeswhetherverbalorphysicalinnature(eitherisolatedorrepeatedbehavior),whicharelikelytointimidateand/orprovokeaviolentordisorderlyresponsefromthestudentbeingtreatedinthismatter.Thisalsoincludestheencouragementorproddingofotherstudentstoengageinthesetypesofaggressivebehaviors.

Health and medical concerns Ahealthychildismorelikelytobeacademicallysuccessful.Parents/guardiansareaskedtoensurethattheirchildgetsenoughsleep,nutritiousmeals,andregularexercise.Parentsshouldscheduleregularvisitstothedoctoranddentist.Wealsoaskparents/guardianstoencouragetheirchildrentouseprotectiveequipmenttopreventaccidentalinjury(i.e.,seatbelts,helmets,andothersafetyequipmentforbikeriding,rollerblading,andskateboarding).

Wearenotpermittedtokeepillchildrenatschool.Ifachild’sillnessissuchthathe/sheneedstoreturnhome,parents/guardianswillbecontactedaccordingtotheinformationcontainedontheEmergencyMedicalForm.Therefore,itisextremelyimportantthattheschoolofficebeinformedofanychangesofhomeorworkphonenumbersthroughouttheschoolyear.

Required immunizations

StudentsenrolledintheSchoolarerequiredtohave,atthetimeofinitialentryintoSchoolandatthebeginningofeachSchoolyearthereafter,writtenevidenceonfilethattheyhavebeenimmunizedagainstdiphtheria,tetanus,pertussis,poliomyelitis,measles(rubella),mumps,chickenpox,rubella,hepatitisB,andmeningococcaldisease,asrequiredbyOhiolawandapplicableOhioDepartmentofHealthregulationsandguidelines(collectively“Laws”).Adequatewrittenevidenceofsuchrequiredimmunizationsshallconsistof:(1)asignedphysician’sstatementindicatingthattheStudenthasreceivedtherequiredimmunizations,includingtheimmunizationsreceivedandthedateofreceipt;or(2)asignedstatementbytheParentindicatingthattheStudenthasreceivedtherequiredimmunizations,includingthe

immunizationsreceivedandthedateofreceipt.InthecaseofaParent’sstatement,thePrincipal,inhis/hersolediscretion,mayrequireanyotherevidenceass/hebelievesisneededtodeterminecompliancewiththispolicyincluding,butnotlimitedto,aphysician’sstatement.

NostudentmayremaininSchoolformorethanfourteen(14)daysafterinitialadmissionor,forastudentnotbeinginitiallyadmitted,morethanfourteen(14)daysafterthebeginningoftheschoolyearunless:(1)thestudenthasreceivedtherequiredimmunizationsorthestudentis“intheprocess”ofreceivingtherequiredimmunizations,asdefinedinLawsand(2)theStudent’sParenthassubmittedadequatewrittenevidenceoftherequiredimmunizationsassetforthinthispolicy.StudentswhodonotcomplywiththispolicyandanyotherimmunizationrequirementsofLawsshallbeexcludedfromSchoolnolaterthanthefifteenthdayafteradmissionor,forstudentsnotbeinginitiallyadmitted,nolaterthanthefifteenthdayafterthebeginningoftheschoolyear.

Accidents or medical emergency

Ifamedicalemergencyoccurstoastudentatschool,firstaidwillbeadministeredandtheparent(s)/guardian(s)ofthatstudentwillbecontactedimmediately.Ifparent(s)/guardian(s)cannotbereached,apersonlistedonthestudent’shealthform(oremergencycontactcard)orthefamilyphysicianwillbecontacted.Ifthesituationwarrants,theschoolwillcallEmergencyMedicalServices(911).

Ifthereisaseriousaccidentatschool,parent(s)/guardian(s)oftheaffectedstudentswillbenotifiedimmediatelyandfirstaidwillbeadministrated.Intheeventthattheparent(s)/guardian(s)cannotbereached,thefamilyphysicianorpersonsindicatedonhealthwillbecontacted.

Medication Policy

Toprotectyourchild’ssafety,schooladministratorsadheretothefollowingmedicationpolicy.BeginninginAugust1996,itisrequiredthatbothaparent’s/guardian’sandphysician’ssignatureareonfilebeforeanyprescriptionornon-prescriptionmedicationisadministered.Thisincludesallmedicationsincludingsuchover-the-counterproductsasTylenol,Advil,Dimetapp,etc.

Althoughthismaycausesomeinconvenience,wefeelthatthispolicyisbestforthecontinuedprotectionofyourchild,andmustbefollowed.Ifwedonothaveyourwrittenpermissionandthewrittenpermissionofyourphysician,themedicationwillnotbegiven.Permissionformscanbeobtainedbycontactingthemainoffice.

Inorderforyourchildtoreceiveanymedicationatschool:

• Awrittenrequestmustbeobtainedfromthedoctorandtheparent/guardian.Thisrequestmustincludethenameofthemedication,dosage,timeitisgivenduringschoolhours,andduration.

• Themedicationmustbeinitsoriginalcontainerandhaveafixedlabelthatindicatesthestudent’sname,nameofmedication,dosage,methodofadministration,andtimeofadministration.

• Whentheemptyprescriptionbottleisreturnedtoyou,pleasesendtherefilltoschoolpromptly.

• Themedicationandthesignedpermissionformsmustbebroughttotheschoolbytheparentorguardian.

• Whereverpossible,pleaseincludeaphotoofyourchildwiththepermissionform.• Newpermissionformsmustbere-submittedeachschoolyear,andarenecessaryforanychangesinmedicationorders.

• Ifyourchildistakenoffmedicationorwillnolongerreceiveitatschool,pleaseputyourrequestinadated,writtennoteassoonaspossible.Ifthemedicationisnotpickedupfromtheschoolofficewithin10days,itwillbeproperlydisposed.

Child Abuse Policy

AsmandatedbyOhiolaw,employeesofCLAwho,intheirofficialcapacity,becomeawareorsuspectthatachildhassuffered,orfacesathreatofsufferinganyphysicalormentalwound,injury,disability,orconditionofanaturethatreasonablyindicatesabuseorneglectshallimmediatelynotifytheCuyahogaCountyDepartmentofHumanServices(696-KIDS)andpossiblytheClevelandPoliceDepartmentincaseswherechildabuseissuspected.AllCLAstaffwillreceivein-servicetraininginchildabusepreventionandintervention.

“Harassment,intimidation,orbullying”meanseitherofthefollowing:1)anyintentional,written,verbal,graphic,orphysicalactthatastudentorgroupofstudentshasexhibitedtowardanotherparticularstudentmorethanonceandthebehaviorbothcausesmentalorphysicalharmtotheotherstudent;andissufficientlysevere,persistentorpervasivethatitcreatesanintimidating,threateningorabusiveeducationalenvironmentfortheotherstudent;or2)violencewithinadatingrelationship.Thedefinitionof“harassment,intimidationorbullying”alsoincludestheabove-describedactsthatareelectronicallygenerated,storedortransmitted.

Sexualharassmentincludesallunwelcomesexualadvances,requestsforsexualfavors,andverbalorphysicalcontactsofasexualnature.Otherprohibitedconductincludesthatwhichhasthepurposeoreffectofcreatinganintimidating,hostile,discriminatory,oroffensivelearningenvironmentonthebasesofgender,religion,race,color,ethnicity,disabilityand/orotherlegallyprotectedcategory.CLApoliciesprotectstudentsfrombullying,harassment,violenceanddiscriminationwithregardtoactualorperceivedsexualorientationandactualorperceivedgenderidentity(updatedin2018perCLA’sstudentsocialjusticeclub).

TheSchoolreservestherighttodisciplinestudents’offcampusbehaviorthatsubstantiallydisruptstheSchool’seducationalprocessormission,orthreatensthesafetyorwellbeingofaStudentorStaffmember.Factorswhichmaybeconsideredindeterminingwhetherthebehaviorwarrantsdisciplineinclude,butarenotlimitedto,thefollowing:(1)whetherthebehaviorcreatedmaterialandsubstantialdisruptiontotheeducationalprocessortheSchool’smissionduetothestressontheindividual(s)victimizedorthetimeinvestedbyStaffindealingwiththebehaviororitsconsequences;(2)whetheranexustoon-campusactivitiesexists;(3)whetherthebehaviorcreatesasubstantialinterferencewithaStudent’sorStaffmember’ssecurityorrighttoeducateandreceiveeducation;(4)whetherthebehavior

invadestheprivacyofothers;or(5)whetheranythreatisdeemedtobeatruethreatbytheadministrationorBoard,usingfactorsandguidelinessetoutbythecourtsorbycommonsense,reasonablepersonstandards.

Someactsofharassment,intimidation,bullyingandcyber-bullyingmaybeisolatedincidentsrequiringthattheschoolrespondappropriatelytotheindividualscommittingtheacts.Otheractsmaybesoseriousorpartofalargerpatternofharassment,intimidation,bullyingorcyber-bullyingthattheyrequirearesponseeitherintheclassroom,Schoolbuilding,orbylawenforcementofficials.Consequencesandappropriateremedialactionsforstudentswhocommitanactofharassment,intimidation,bullyingorcyber-bullyingrangefrompositivebehavioralinterventionsuptoandincludingsuspensionorexpulsion.Dueprocessproceduresforsuspensionandexpulsionwillbefollowed,asprovidedforunderR.C.3313.66.ThedisciplinaryproceduresandcodeofconductoftheSchoolshallbefollowedandshallnotinfringeonanystudent’sFirstAmendmentrightsundertheUnitedStatesConstitution.

Allschoolpersonnel,volunteersandstudentsarerequiredtoreportprohibitedincidentsofwhichtheyareawaretotheModelEducationLeaderorhis/herdesignee.AllotherpersonsmayreportprohibitedincidentsofwhichtheyareawaretotheModelEducationLeaderorhis/herdesignee.Anonymouscommunications,ifnecessary,maybemadebytelephone,electronicmail,orinwriting.TheModelEducationLeaderorhis/herdesigneeisthenresponsiblefordeterminingwhetheranallegedincidentconstitutesaviolationofthispolicy.Insodoing,theModelEducationLeaderorhis/herdesigneeshallconductapromptandthoroughinvestigationofthereportedincident,andprepareareportdocumentingtheprohibitedincidentthatisreported.Onceaninvestigationiscompleted,ifthereportedincidenthasbeensubstantiated,theParentofanyStudentinvolvedintheprohibitedincidentshallbenotified.TotheextentpermittedbyR.C.§3319.321andtheFamilyEducationalRightsandPrivacyActof1974(20U.S.C.1232g),Parentshaveaccesstoanywrittenreportspertainingtotheprohibitedincident,and,iftheSchoolhasawebsite,theSchoolshallpostthissummaryofreportedincidentsontheSchoolwebsite.Semiannually,theModelEducationLeaderwillprovidetheBoardChairwithawrittensummaryofallreportedincidents.AllSchoolpersonnel,volunteersandStudentsshallbeindividuallyimmunefromliabilityinacivilactionfordamagesarisingfromreportinganincidentinaccordancewiththispolicy.

TheSchoolprohibitsreprisalorretaliationagainstanyvictimorpersonwhoreportsanactofharassment,intimidation,bullying,orcyber-bullying.TheconsequenceandappropriateremedialactionforapersonwhoengagesinreprisalorretaliationshallbedeterminedbytheModelEducationLeaderorhis/herdesigneeafterconsiderationofthenatureandcircumstancesoftheact,inaccordancewithSchoolpoliciesandprocedures.TheSchoolshallimplementthefollowingstrategyforprotectingvictims:superviseanddisciplineoffendingstudentsfairlyandconsistently;provideadultsupervisionduringrecess,lunchtime,bathroombreaksandinthehallwaysduringtimesoftransition;maintaincontactwithparentsandguardiansofallinvolvedparties;providecounselingforthevictimifassessedthatitisneeded;informSchoolpersonneloftheincidentandinstructthemtomonitorthevictimandtheoffendingpartyfortheindicationsofharassing,intimidating,bullying,andcyber-bullyingbehavior.Personnelaretointervenewhenprohibitedbehaviorsarewitnessed;checkwiththevictimdailytoinsurethattherehasbeennoincidentsofharassment/intimidation/bullying/cyber-bullingorretaliationfromtheoffenderorotherparties.

Harassment,intimidation,bullying,andcyber-bullyingbehaviorcantakemanyformsandcanvarydramaticallyinseriousnessandimpactonthetargetedindividualandotherstudents.Accordingly,thereisnooneprescribedresponsetoverifiedactsofharassment,intimidationandbullying.Whileconductthatrisestothelevelof“harassment,intimidation,bullying,orcyber-bullying”willwarrantdisciplinaryactionwhetherandtowhatextenttoimposedisciplinaryaction(i.e.,detention,in-andout-of-schoolsuspension,orexpulsion)isamatterleftintheprofessionaldiscretionoftheModelEducationLeader.

ThefollowingproceduresetsforthpossibleinterventionsfortheModelEducationLeadertoenforcetheprohibitionagainstharassment,intimidation,bullying,orcyber-bullying.Anonymouscomplaintsthatarenototherwiseverified,however,shallnotbethebasisfordisciplinaryaction.

1. Non-disciplinaryInterventions:Whenverifiedactsofharassment,intimidation,bullying,orcyber-bullyingareidentifiedearlyand/orwhensuchverifiedactsdonotreasonablyrequireadisciplinaryresponse,studentsmaybecounseledastothedefinitionofharassment,intimidation,bullying,orcyber-bullying,itsprohibitionandtheirdutytoavoidanyconductthatcouldbeconsideredharassing,intimidating,bullying,orcyber-bullying.Ifacomplaintarisesoutofconflictbetweenstudentsorgroupsofstudents,peermediationmaybeconsidered.Specialcare,however,iswarrantedinreferringsuchcasestopeermediation.Apowerimbalancemaymaketheprocessintimidatingforthevictimandthereforeinappropriate.Thevictim’scommunicationandassertivenessskillsmaybelowandcouldbefurthererodedbyfearresultingfrompastintimidationandfearoffutureintimidation.Insuchcases,thevictimshouldbegivenadditionalsupport.PeermediationmaybedeemedinappropriatetoaddresstheconcernatthediscretionoftheSchooladministration.

2. DisciplinaryInterventions:Whenactsofharassment,intimidation,bullying,andcyber-bullyingareverifiedandadisciplinaryresponseiswarranted,studentsaresubjecttothefullrangeofdisciplinaryconsequences.Inandout-of-schoolsuspensionmaybeimposedonlyafterinformingtheaccusedperpetratorofthereasonsfortheproposedsuspensionandgivinghim/heranopportunitytoexplainthesituation.ExpulsionmaybeimposedonlyafterahearingbeforetheBoardofDirectors,acommitteeoftheboardoranimpartialhearingofficerdesignatedbytheBoardofDirectorsinaccordancewithBoardpolicy.Thisconsequenceshallbereservedforseriousincidentsofharassment,intimidation,bullying,orcyber-bullyingand/orsituationswherepastinterventionshavenotbeensuccessfulineliminatingprohibitedbehaviors.

NothinginthispolicyprohibitsavictimfromseekingredressunderanyprovisionofOhiolawthatmayapply.

TheSchoolmayformapreventiontaskforceand/orprogramstoeducatestudentsaboutthispolicy,suchasholdinganassemblyonharassment,intimidation,bullying,andcyber-bullyingforParentsandStudents,toraisethelevelofawarenessandhelppreventtheprohibitedconduct.TheSchoolmayalsoprovidetraining,workshops,orcoursesonthispolicytoStaffandvolunteerswhohavedirectcontractwithstudents.

Threats toward CLA staff

CLAwillnottolerateanythreatsmadetoanystafforfacultymemberoftheCLAcommunity.CLAwillnevertoleratesuchactsfromeitherstudentsorparents/guardians.Theseactsincludeallformsofharassment.Ifsuchactsaremadebyeitherstudentsorparents/guardians,CLAreservestherighttotakesevereaction.

Corporal punishment and student restraint Allteachers,administrators,non-licensedSchoolemployeesandSchoolbusdriversareprohibitedfrominflictingorcausingtobeinflictedcorporalpunishmentasameansofdisciplineuponastudentattendingtheSchool.However,theymay,withinthescopeoftheiremployment,useandapplysuchamountofforceandrestraintasisreasonableandnecessarytoquelladisturbancethreateningphysicalinjurytoothers,

toobtainpossessionofweaponsorotherdangerousobjectsuponthepersonorwithinthecontrolofthepupil,forthepurposeofself-defenseorfortheprotectionofpersonsorproperty.

Discipline for students with special needs Disruptivebehavior,asdefinedbyschoolpolicy,byastudentwithdisabilitieswillbemanagedinaccordancewiththestudent’sindividualeducationplan(IEP)andstateandfederallaw.Astudentwithdisabilitieswillbesubjecttorecommendationforexpulsionasahabituallydisruptivestudentonlyiftheappropriatespecialeducationteamhasdeterminedthatthedisruptivebehaviorisnotamanifestationofthestudent’sdisability.

Suspension and expulsion policiesTheDeanofStudentsorPrincipalmaysuspendastudentforuptoten(10)schooldays.TheModelEducationLeadermayexpelastudentforuptoeighty(80)schooldays,andinsomeinstancesone(1)year.Intheeventthat,intheopinionoftheDeanofStudentsorPrincipal,astudent'spresenceattheSchoolcreatesahealthrisk,presentsadangertootherpersonsorpropertyorseriouslydisruptsthefunctionsoftheSchool,thestudentmayberemovedfromthepremiseswithoutformalsuspensionorexpulsionprocedures,withnoticeandprocedurestofollowtheremovalinaccordancewithR.C.§3313.66.Astudentshallbeexpelledforone(1)yearforbringingafirearmtotheSchoolorontoSchoolProperty(anyPropertyowned,usedorleasedbytheSchoolforSchool,SchoolextracurricularorSchool-relatedevents).Astudentmayalsobeexpelledforaperiodnottoexceedone(1)yearfor:1. bringingafirearmtoaninterscholasticcompetition,anextracurricularevent,oranyotherSchoolprogramoractivitythatislocatedataSchooloronSchoolProperty;2. bringingaknifetotheSchool,ontoSchoolPropertyortoaninterscholasticcompetition,anextracurriculareventoranyotherprogramoractivitysponsoredbytheSchoolorwhichtheSchoolisaparticipant;3. possessingafirearmorknifeatSchool,onSchoolProperty,orataninterscholasticcompetition,anextracurricularevent,oranyotherSchoolprogramoractivitywhichfirearmorknifewasinitiallybroughtontoSchoolPropertybyanotherperson;4. committinganactthatisacriminaloffensewhencommittedbyanadultthatresultsinseriousphysicalharmtopersonsorseriousphysicalharmtoproperty;5. makingabombthreattoaSchoolbuildingortoanypremisesatwhichaSchoolactivityisoccurringatthetimeofthethreat.Afirearmisdefinedasanyweapon,includingastartergun,whichwillorisdesignedtoormayreadilybeconvertedtoexpelaprojectilebytheactionofanexplosive,theframeorreceiverofanysuchweapon,anyfirearmmufflerorsilencer,oranydestructivedevice.Adestructivedevice,includesbutisnotlimitedto,anyexplosive,incendiary,orpoisongas,bomb,grenade,rockethavingapropellantchargeofmorethanfour(4)ounces,missilehavinganexplosiveorincendiarychargeofmorethanonequarterounce,mine,orothersimilardevice.Aknifeisdefinedasanycuttinginstrumentconsistingofatleastonesharpblade.ThespecificcircumstancesunderwhichtheModelEducationLeadermaymodifyaone(1)yearexpulsioncouldinclude:

1. arecommendationfromthegroupofpersonsknowledgeableofthestudent'seducationalneedsinaccordancewithTheIndividualwithDisabilitiesEducationAct;2. thestudentwasunawarethats/hewaspossessingafirearmorknife;3. thestudentdidnotunderstandthattheitems/hepossessedwasconsideredafirearmorknife;4. thestudentbroughttheitemtoSchoolaspartofaneducationalactivityanddidnotrealizeitwouldbeconsideredafirearmorknife;and5. thestudentmaybeeligibleforparticipationinanalternativeprogram.Astudentmaybeexpelledforuptoeighty(80)daysforseriousmisconductorrulesviolations,orforotherjustcause.Duringtheperiodofsuspension,removal,orexpulsionthestudentmaynotattendorparticipateinanySchoolfunctionswithoutpermissionfromtheDeanofStudentsorPrincipal.ThestudentmayenterSchoolfacilitiesonlywhengivenpermissionbythePrincipalorDeanofStudentsorwhengivenpermissiontobeaccompaniedbyaparentorguardianwhoacceptsresponsibilityforthestudent'sactionsand/orbehavioratthefacility.

Whileservinganout-of-schoolsuspensionorexpulsion,theBoardcanauthorizeScholarstoreceiveinstructionalservicesfromtheSchool.IfstudentsareauthorizedtoreceiveinstructionalservicesfromtheSchool,thensuchinstructionalservicesmayincludethefollowing:homeworkassignments,research,writingorotherprojects,essay(s),internetassignments,conferencecalls,oroff-premisemeetings

TheBoardalsoauthorizestheDeanofStudentsorPrincipaltosuspendastudentfromanyorallco-curricularorextracurricularactivitiesformisconductorrulesviolations.ThelengthofsuspensionshallbedeterminedbytheDeanofStudentsorPrincipalcommensuratewiththeseriousnessofthestudent'smisconductorrulesviolationsinaccordancewiththeCodeofConduct.Participationinextra-curricularactivitiesisaprivilegeandnotaright.Accordingly,studentsprohibitedfromparticipatinginallorpartofanyextra-curricularactivity,arenotentitledtonotice,hearingorappealrights.IftheDeanofStudentsorPrincipaldeterminesthatastudent'sbehavioronaSchoolvehicleviolatesSchoolrules,s/hemaysuspendthestudentfromSchoolbusridingprivilegesforthelengthoftimedeemedappropriatefortheviolationandremediationofthebehavior.TheBoardauthorizestheDeanofStudentsorPrincipaltheoptiontorequireastudenttoperformcommunityserviceinconjunctionwith,orinplaceofasuspensionorexpulsion,exceptwhenanexpulsionisimposedforbringingafirearmtoSchoolorontoSchoolProperty.TheBoarddesignatestheDeanofStudentsorPrincipalasitsrepresentativeatallhearingsregardingtheappealofasuspension.DeanofStudentsorPrincipal,theBoard’sdesignee,willheartheappealofanexpulsion.ThePrincipalshallberesponsibleforimplementingthispolicyandensuringcompliancewithapplicablelaws.AcopyofthisPolicyistobepostedincommonareasoftheSchoolandmadeavailabletostudentsandparentsuponrequest.

WhentheModelEducationLeaderexpelsastudentformorethantwentydaysorforanyperiodoftimeextendingintothenextsemesterorschoolyear,theSchoolshallprovide,alongwiththisnotice,thestudentandhisparent,guardianorcustodianwithinformationaboutservicesorprogramsofferedbypublicandprivateagenciesthatworktowardimprovingthoseaspectsofthestudent’sattitudesandbehaviorsthatcontributedtotheincidentgivingrisetotheexpulsion.Theinformationmustincludenames,addresses,andphonenumbersortheappropriatepublicandprivateagencies.Duringtheperiodofexpulsion,theSchoolmay,butisnotrequiredto,continueeducationalservicesinanalternativesetting.TheModelEducationLeaderisrequiredtofollowthroughonexpellableoffensesevenifthestudentinquestionwithdrawsfromtheSchoolpriortothehearingortheModelEducationLeader’sdecision.TheModelEducationLeadermayapplyanyremainingpartoralloftheperiodofexpulsionintothefollowingyear.

Suspension and expulsion policy for gang activities Theschoolbelievesgangsorgangactivitycreateanatmospherethatseriouslydisruptstheeducationalprocess.Studentsareprohibitedfromengagingingangactivitieswhileatschool,onschoolproperty,oratschool-sponsoredevents.

AtCLA,theterm“gang”meansanyongoingorganization,association,orgroupofthreeormorepersons,whetherformalorinformal,havingasoneofitsprimaryactivitiesthecommissionofoneormorecriminalacts,whichhasanidentifiablenameoridentifyingsignorsymbol,andwhosemembersindividuallyorcollectivelyengageinorhaveengagedinapatternofcriminalgangactivity.Theterm“gangactivity”shallmeananyconductengagedinbyastudent1)onbehalfofanygang;2)toperpetuatetheexistenceofanygang;3)toeffectthecommonpurposeanddesignofanygang;or4)torepresentagangaffiliation,loyaltyormembershipinanywaywhileonschoolgroundsorwhileattendingaschoolfunction.Theseactivitiesincluderecruitingstudentsformembershipinanygangandthreateningorintimidatingotherstudentsoremployeestocommitactsoromissionsagainsthis/herwillinfurtheranceofthecommonpurposeanddesignofanygang.AviolationofthispolicyisgroundsforsuspensionorexpulsionfromSchool.

Asrespectisoneofourthreeschoolnorms,CLArecognizesthattheprivacyofstudentsmaynotbeviolatedbyunreasonablesearchandseizure.Infact,theCLABoardspecificallydirectsthatnostudentbesearchedwithoutreasonorinanunreasonablemanner.

Withregardtorespectofstudentprivacy,CLAacknowledgestheneedforin-schoolstorageofstudentpossessionsandweprovidestorageplacesforthatpurpose.Ontheotherhand,theschoolhastherighttosearchallpropertyandstorageareasusedbystudents.TheCLABoardmayrequiretheModelEducationLeaderorhis/herdesigneetoconductaregularsearchatleastannuallyofallsuchstorageplaces.

StudentshavenoexpectationofprivacywithrespecttotheuseoftheInternet,intranetore-mail.Routinemaintenanceandmonitoringoftheschoolnetworksystemmayleadtothediscoverythatastudenthasorisviolatingschoolprotocolsorthelaw,andsuchviolationsmayresultinseverepenalties,uptoandincludingexpulsion.

AsCLAteachersandadministratorsarechargedwiththeresponsibilityofsafeguardingthesafetyandwell-beingofthestudentsintheircare,theymaysearchthepersonorpropertyofastudent,withorwithoutthestudent'sconsent,whenevertheyreasonablysuspectthatthesearchisrequiredtodiscoverevidenceofaviolationoflaworofschoolprotocols.

5. Astudentshallhavetheopportunitytobepresentduringthesearchofhisorherlocker,desk,orotherpropertyunlessthestudentisabsentfromSchoolorthesafetyorwelfareoftheSchooloranindividualnecessitatesasearchduringthestudent'sabsence.

Thesearchofastudent'spersonorintimatepersonalbelongingsshallbeconductedbytheModelEducationLeaderorhis/herdesignee.Thispersonshouldbeofthestudent'sgenderandconductthesearchinthepresenceofanotherstaffmemberofthesamegender.However,nostripsearchesmaybeconductedbyschoolpersonnel.ThisauthorizationtosearchshallalsoapplytoallsituationsinwhichthestudentisunderthejurisdictionoftheSchool.

Administratorsareauthorizedtoarrangefortheuseofabreath-testinstrumentforthepurposeofdeterminingifastudenthasconsumedanalcoholicbeverage.Itisnotnecessaryforthetesttodetermineblood-alcohollevel,sincetheschoolhasestablishedazerotoleranceforalcoholuse.

Theschoolalsoauthorizestheuseofcanines,trainedindetectingthepresenceofdrugs,whentheModelEducationLeaderorhis/herdesigneehasreasonablesuspicionthatillegaldrugsmaybepresentintheSchool.Thismeansofdetectionshallbeusedonlytodeterminethepresenceofdrugsinlockerareasandotherplacesonschoolpropertywheresuchsubstancescouldbeconcealed.Caninedetectionmustbe

Complaints about student discipline TheschooladministrationandtheBoardofDirectorsworkinconjunctiontohearandresolveanycomplaints.Intheeventofacomplaintregardingstudentdiscipline,boththeschooladministrationandtheBoardencouragethecomplainanttoaddresstheproblemdirectlywiththestaffmemberinvolved.Ifthecomplainantisdissatisfiedwiththeresolutionproposedbythestaffmemberinvolved,orifsuchresolutionisnotpracticalunderthecircumstances,heorsheshouldscheduleameetingwiththePrincipalorDeanofStudents.Ifanindividualbelievesthattheschoolhasviolatedanyapplicablelawsorregulations,orifheorsheisunsatisfiedwiththeresultsoftheaboveprocess,heorshemayfileaformal,writtencomplaintwiththeBoardofDirectors.Afterreceivingthecomplaint,theBoardwillrespondinwritingtotheindividualwithin30days.

Unacceptableusesoftechnology/Internetincludebutarenotlimitedto:1. ViolatingtheconditionsoffederalandOhiolawdealingwithstudentsandemployees’rightsto

privacy.Trespassinginothers'folders,work,orfiles;copyingotherpeople’sworkorattemptingtointrudeontootherpeople’sfiles;usingotherusers'e-mailaddressesandpasswords.

2. Usingprofanity,obscenityorotherlanguagewhichmaybeoffensivetoanotheruser;sendingmessageswithderogatoryorinflammatoryremarksaboutanindividual’srace,sex,age,disability,

religion,nationaloriginorphysicalattributesviatheInternetortechnology;bullying,insulting,intimidating,orattackingothers;transmittinganymaterialinviolationoffederalorstatelaw.

3. Accessingprofanity,obscenity,abusive,pornographic,and/orimpolitelanguageormaterials,accessingmaterialsinviolationoftheStudentCodeofConduct.Agoodruletofollowistoneverview,sendoraccessmaterialsthatyouwouldnotwantyourinstructorsandparentstosee.Shouldastudentencounteranyinappropriatematerialsbyaccident,he/sheshouldreportittotheirinstructorsimmediately.

4. Violatingcopyrightlawsbyillegallydownloadingorinstallingmusic,anycommercialsoftware,shareware,orfreeware.Youarerequiredtostrictlycomplywithalllicensingagreementsrelatingtoanysoftware.Allcopyrightlawsmustberespected.

5. PlagiarizingworksthroughtheInternetorothertechnology.Plagiarismistakingideasofothersandpresentingthemasiftheywereoriginaltotheuser.

6. DamagingTechnologydevices,computers,computersystemsorcomputernetworks(forexample,thecreation,introductionorspreadingofcomputerviruses,physicallyabusinghardware,alteringsourcecodesorsoftwaresettings,etc.).

7. UsingtheTechnologyortheInternetforcommercialpurposesoractivities,whichisdefinedasofferingorprovidinggoodsorservicesorpurchasinggoodsofservicesforpersonaluse,andincludes,butisnotlimitedto,thefollowing:

a. anyactivitythatrequiresanexchangeofmoneyand/orcreditcardnumbers;b. anyactivitythatrequiresentryintoanareaofserviceforwhichtheSchoolwillbechargedafee;c. anypurchaseorsaleofanykind;andd. anyuseforproductadvertisementorpoliticallobbying.8. NeithertheInternetnoranyothertechnologymaybeusedforanypurposethatisillegaloragainst

theSchool’spoliciesorcontrarytotheSchool’smissionorbestinterests.

4. Studentsshallcomplywithanyadditionalrulesdevelopedbytheschoolconcerningappropriateuseofelectroniccommunicationdevices.

5. StudentsshallnotutilizeanelectroniccommunicationdeviceinamannerthatwouldviolatetheSchool’sTechnologyandInternetAcceptableUsePolicyoritsstudentcodeofconduct.

Food service CLAprovidesbreakfastandlunchserviceforitsstudents.TheschoolparticipatesintheNationalSchoolLunchProgram,whichprovidesfreeorreducedpricebreakfastsandlunchesaswellasfreemilktoeligiblestudents.Tablesdescribingeligibilityandapplicationstoparticipateintheprogramwillbeprovidedatthemandatoryparentorientation.Breakfastisservedfrom7:15-7:35a.m.andisoptionalforallstudents.Studentsmustarriveatschoolby7:30a.m.toeatbreakfast.Birthday celebrations CLAsupportsstudents’emotionalgrowthbycelebratingtheirachievements.Mostofthesecelebrationstaketheformofschool-wideeventsthatcelebratestudentacademicachievementandcharactergrowth.Tomaintainthestructureandconsistencyoftheschooldayandtopreservesacredlearningtime,CLAallowsforthecelebrationofbirthdaysonlyduringcreworlunch.Familiescansendinasmallbirthdaytreatthatispre-dividedintoindividualservings.Examplesofappropriatebirthdaytreatsincludecupcakes,cookies,ordonuts.

Admissions policy The School is open to any individual entitled to attend school in Ohio pursuant to R.C. 3313.64 or3313.65,exceptthatadmissionmaybelimitedtothegeographicareaandgradeoragelevelsspecifiedintheCommunitySchoolContract.

Stepthree:Parentintentform,mandatoryparentandstudentorientationOncefamilieshavebeennotifiedthattheirchildhasaspotintheclass,parentsmustreturnaformindicatingtheirintenttoenrolltheirchildinCLA.Thisformmustbereturnedwithintwoweeksofnotification.Parentswillalsobenotifiedofdatesforthemandatoryparentorientationsessions(severalsessionsthroughoutJulyandAugust)andthestudentorientationweek.ThesesessionsaremandatoryandaredesignedtoallowforasmoothtransitiontoCLAforbothstudentsandfamilies.

Failuretocompleteallofthesestepswithinthespecifiedtimeframecouldresultinthetransferofyourchild’sspacetothenextchildonthewaitinglist.

Vacancies Tofillanyvacancies,separatewaitinglistsaremaintainedforeachgradelevel.Therandomlotteryusedforstudentadmissionalsoservestoplacestudentsinpreferentialorderonthesewaitinglists.CLAreservestherighttofillavacancywhenunexpectedattritionoccurs.Iftheschoolchoosestofillavacancy,theschoolcontactstheparentorguardianofthestudentnextontheappropriatewaitinglist.Reasonableattemptsaremadetocontactthefamilyofthefirststudentonthewaitinglisttodeterminewhetherthestudentremainsinterestedinenrollingattheschoolbeforeproceedingtothenextnameonthelist.Ifattemptstocontactthestudent’sparents/guardiansareunsuccessful,theschoolmayremovethatstudentfromthewaitinglist.Documentationofattemptsmadetocontacttheparents/guardiansofanystudentremovedfromthewaitinglistaremaintainedbytheschool.

Withdrawal from the schoolCLAisaschoolofchoice.Assuch,circumstancesmayariseinwhichaparentorguardianwishestotransfertheirchildtoadifferentschool.Whenparentswithdrawtheirchildfromtheschooltheyshouldscheduleameetingwiththeprincipaltofilloutthewithdrawalform.Studentswhomiss105consecutivehoursofschoolwithoutnotifyingtheschoolaresubjecttobeingun-enrolled.Astudentwhoattendsanotherschoolissubjecttobeingun-enrolledfromCLA.Theschoolensuresthetimelytransferofanynecessaryschoolrecordstothestudent’snewschool.

Notice to home schoolers (ORC. 3314.041 & 3321.04)

CitizensLeadershipAcademyisacommunityschoolestablishedunderChapter3314oftheRevisedCode.Theschoolisapublicschool,andstudentsenrolledinandattendingtheschoolarerequiredtotakestateachievementtestsandotherexaminationsprescribedbylaw.Inaddition,theremaybeotherrequirementsforstudentsattheschoolthatareprescribedbylaw.StudentswhohavebeenexcusedfromthecompulsoryattendancelawforpurposeofhomeeducationasdefinedbytheAdministrativeCodeshallnolongerbeexcusedforthatpurposeupontheirenrollmentinacommunityschool.IfaparentchoosestohomeschoolafterenrollmentatCLA,theymustofficiallywithdrawthechildandreporttheirintentionstotheirlocalschoolforapproval.Inaddition,parentsneedtoprovidedocumentationfromtheirlocalschoolexecutivedirectortoCLAsothatproperproceduresforrecordingexcusedabsencesfromschoolmaybefollowed.Formoreinformationaboutthismatter,contacttheOhioDepartmentofEducation.

Child Find policy SchoolsacrossthestateofOhioareparticipatinginanefforttoidentify,locate,andevaluateallchildrenbirththrough21yearsofagewhomayhavedisabilities.Disability,inthisinstance,meanssuchconditionsashearingimpairments,visualimpairments,speech,orlanguageimpairments,specificlearningdisabilities,emotionallydisturbed,multipledisabilities,mentalretardation,otherhealthimpairments,physicalimpairments,andtraumaticbraininjury.Publicschoolshaverespondedvigorouslytofederalandstatemandatesrequiringtheprovisionofafreeappropriatepubliceducationregardlessofachild’sdisability.Butbeforeschoolscanservechildren,theymustidentifythedisability.Parentsmaynotbeawaretheirchildhasadisabilityorthatthereareprogramsandservicesavailable.

Homeless Children and Youth and the McKinney Vento Homeless Assistance Act

DefinitionA. HomelessChildrenandYouth.Homelesschildrenandyoutharedefinedaschildrenandyouthwho

lackafixed,regular,andadequatenighttimeresidence.Thistermincludeschildrenandyouthwhoare:• sharing the housing of other persons due to loss of housing, economic hardship, or a similarreason(sometimesreferredtoasdoubled-up);

• living inmotels, hotels, trailer parks, or camping grounds due to lack of alternative adequateaccommodations;

• livinginemergencyortransitionalshelters;• abandonedinhospitals;• awaitingfostercareplacement,untilDecember10,2016;• childrenandyouthwhohaveaprimarynighttimeresidencethatisapublicorprivateplacenotdesignedfor,orordinarilyusedas,aregularsleepingaccommodationforhumanbeings;

• childrenandyouthwhoarelivingincars,parks,publicspaces,abandonedbuildings,substandardhousing,busortrainstations,orsimilarsettings;

• migratorychildrenwhoqualifyashomelessbecause theyare livingincircumstancesdescribedabove;or

• childrendisplaced from theirhousingduringnaturally occurringdisasters.When children andtheir familiesaredisplaced fromtheirhousingasaresultofanaturaldisaster, there isoftenaperiodofinstabilityinwhichvariousprivateorganizationsandlocal,State,andFederalagenciesprovide assistance.The School shoulddetermine such children’s eligibility forMcKinney-Ventoservices on a case-by-case basis. In making this determination, they should take intoconsiderationtheservicesthatareavailablethroughtheseothersources.When determining if the setting in which the family, child, or youth is lives is “substandardhousing,” the School may consider whether the setting is substandard due to a lack offundamental utilities such aswater, electricity, orheat; infestationwithvermin,pests ormold;lackof basic functionalparts of ahome, such as aworkingkitchen,working toilet, orworkingshower;or,thepresenceofunreasonabledangerstoadults,children,orpersonswithdisabilities.Ifachildoryouth’slivingsituationdoesnotclearlyfall intothesituationsdescribedabove,theSchool should consider the relative permanence of the living arrangements. Determinations ofhomelessness should be made on a case-by-case basis. Incarcerated children and youth andchildrenandyouthinfostercarearenotconsideredhomeless.

B. UnaccompaniedYouth.Theterm“unaccompaniedyouth”includesahomelesschildoryouthnotinthephysicalcustodyofaparentorguardian.Thiswouldincludeyouth living inrunawayshelters,abandonedbuildings,cars,onthestreets,orinotherinadequatehousing,childrenandyouthdeniedhousingby their families,andschool-ageunwedmothers living inhomes forunwedmotherswhohavenootherhousingavailable.

C. School of Origin. The school of origin is the school that the child or youth attended whenpermanently housed, or, the school in which the child or youth was last enrolled, including apreschool.Whenachildoryouthcompletesthefinalgradelevelservedbytheschooloforigin,theterm “school of origin”will include thedesignated receiving school at thenext grade level for allfeederschools.

II. SchoolLiaisonsforHomelessChildren.The School liaison serves as oneof theprimary contactsbetweenhomeless families andStaff, shelterworkers,andotherserviceproviders.Theliaisoncoordinatesservicestoensurethathomelesschildrenandyouthenrollinschoolandhavetheopportunitytosucceedacademically.Schoolliaisonshelptoensurethat:• Homeless children and youth are identified by school personnel and through outreach andcoordinationactivitieswithotherentitiesandagencies;

• Homelessstudentsareenrolledin,andhaveafullandequalopportunitytosucceedin,theSchool;• Homelesschildren,youth,andtheirfamilieshaveaccesstoandreceiveeducationalservicesforwhichthey are eligible, including services throughHeadStart, programs, early intervention servicesunderPartCoftheIndividualswithDisabilitiesEducationAct(IDEA),andpreschoolprogramsadministeredbytheSchool;

• Homeless children, youth, andtheir families receive referrals tohealth,mental health and substanceabuse,dental,housing,andotherappropriateservices;

• Parents or guardians of homeless children and youth are informed of educational and relatedopportunitiesavailabletotheirchildrenandareprovidedwithmeaningfulopportunitiestoparticipateintheeducationoftheirchildren;

• Parentsorguardiansofhomelesschildrenandyouth,andunaccompaniedyouth,arefullyinformedofalltransportationservices,includingtransportationtoandfromtheschooloforigin,andareassistedinaccessingtransportationservices;

• Enrollment disputes are mediated in accordance with the requirements of this policy and theMcKinney-VentoAct;

• Publicnoticeoftheeducationalrightsofhomelessstudentsisdisseminatedtolocationsfrequentedbyparents or guardians of homeless children and youth, and unaccompanied youth, including schools,shelters,publiclibraries,andsoupkitchens,inamannerandformunderstandabletothem;

• Immunizationsormedicalrecordsareobtained;• Staff is trained on the requirements regarding immediate enrollment and receive professionaldevelopmentandothersupport;

• Unaccompaniedyouth are enrolled inschool, haveopportunities tomeet the same challenging Stateacademicstandardsasareestablishedforotherchildrenandyouth,includingthroughimplementationof this Policy, and are informed of their status as independent students and that they may obtainassistancefromtheliaisontoreceiveverificationofthatstatusforpurposesoftheFreeApplicationforFederalStudentAid(FAFSA);

• PoliciesarereviewedtoensurethattheycomplywiththisPolicy;• Affidavitsof residenceorother formsreplace typicalproofof residencywithoutcreatingbarriersordelayingenrollment;

• School-basedimmunizationorotheropportunitiesforon-siteimmunizationsarearranged;• Community-basedorpublicagenciesarecontactedwhomayprovideschooluniforms;• Schoolrecordsareaccepteddirectlyfromfamiliesandyouth;

• Previousschoolsarecontactedforrecordsandassistancewithplacementdecisions;• Short-term educational assessments place students immediately while awaiting complete academicrecords;

• Familiesandyoutharecommunicatedwithinalanguagetheyunderstandorinanaccessibleformat,asappropriate,oftheirrighttoattendeithertheirschooloforiginorlocalschool;

• Staffplaceshomelesschildrenandyouthand identifiesandservedisabilities inaccordancewith theIDEA;

• TheSchoolworkswithStateCoordinatorsfortheDepartmentofEducationconcerningtheprovisionofeducation and related support services to homeless children and youth, including collecting andprovidingreliable,valid,andcomprehensivedata;

• Understandableformsarewrittenandaccessibleexplainingdecisionsandrightstoappeal;and• Follow-upistimelyconcerningspecialeducation,languageassistance,referrals,andservices.School liaisons may be able to identify preschool-aged homeless children by working closely withshelters and social service agencies in their area. In addition, the liaison should work with schoolpersonnel, who can inquire, at the time they are enrolling homeless children and youth in school,whetherthefamilyhaspreschool-agedchildren.III. SchoolPlacementandEnrollment.The School shall make school placement determinations on the basis of the “best interest” of thehomelesschildoryouthandshall:•Continuethechild’soryouth’seducationintheschooloforiginforthedurationofhomelessnesswhenafamilybecomeshomelessbetweenacademicyearsorduringanacademicyear;andfortheremainderoftheacademicyearifthechildoryouthbecomespermanentlyhousedduringanacademicyear;or•Enroll thechildoryouth inanypublicschool thatnon-homelessstudentswho live intheattendanceareainwhichthechildoryouthisactuallylivingareeligibletoattend.•Indeterminingachild’soryouth’sbestinterest,theSchoolmustpresumethatkeepingahomelesschildoryouthinthe“schooloforigin”isinthechild’soryouth’sbestinterest,unlessdoingsoiscontrarytotherequest of the youth’s parent or guardian, or the unaccompanied youth. The School must considerstudent-centered factors related to the child’s or youth’sbest interest, including factors related to theimpactofmobilityonachievement,education,health,andsafetyofhomelesschildrenandyouth,givingpriority to the request of theparent or guardianor theunaccompaniedyouth.The School should alsoconsidertheplacementofsiblingswhendeterminingthebestinterestofthechild.•Inthecaseofanunaccompaniedyouth,theSchoolmustensurethattheschoolhomelessliaisonassistsinplacementorenrollmentdecisions,givesprioritytotheviewsoftheyouth,andprovidesnoticetotheyouthoftherighttoappealtheplacementdecision.•IftheSchooldeterminesthatitisnotinthechild’soryouth’sbestinteresttoattendtheschooloforiginor a school requested by the parent, guardian, or unaccompanied youth, the School must provide awritten explanation of the reasons for its determination to the parent, guardian, or unaccompaniedyouth,togetherwithinformationregardingtherighttoappealtheplacementdecision.If a School is selected on the basis of a “best interest determination,” it must immediately enroll thehomelesschildoryouth,evenifthechildoryouthisunabletoproducetherecordsnormallyrequiredforenrollment (such as previous academic records, records of immunization and other required healthrecords, proof of residency, birth certificates, or other documentation),has missed application orenrollmentdeadlinesduringanyperiodof homelessness, or is subject to outstanding feesor fines, orexcessiveabsences.TheSchoolmustimmediatelycontacttheschoollastattendedbythechildoryouthtoobtainrelevantacademicorotherrecords.Ifachildoryouthneedstoobtainimmunizationsorotherrequired health records, the School must immediately refer the parent or guardian, or theunaccompaniedyouth, to theschoolhomeless liaison,whomustassist inobtaining the immunizations,screenings, or records. The recordsmust bemaintained so that they are available in a timely fashionwhenthechildentersanewschoolorschooldistrict.

IV. PlacementDisputesbetweenaSchoolandaParent.Ifadisputearisesovereligibility,orschoolselectionorenrollment,theSchoolmustimmediatelyenrollthe homeless student in the school inwhich enrollment is sought by the parent or guardian, pendingresolution of the dispute, including all available appeals. Similar provisions apply to placement ofunaccompaniedyouth.TheSchoolmustprovidetheparent,guardian,orunaccompaniedyouthwithawrittenexplanationofanydecisions related to school selection or enrollment made by the school or the Ohio Department ofEducationandtheappealrights.TheSchoolmustrefertheunaccompaniedyouth,parent,orguardiantotheschoolhomelessliaison,whomustexpeditiouslycarryoutthedisputeresolutionprocess.TheSchoolshouldconsiderthefollowingstrategiesforeffectivelyresolvingschoolenrollmentdisputes:1. Disputesshouldberesolvedattheadministrative,ifpossible;2. If other Schools are involved, representatives from all involved schools and the State should be

presenttoresolvethedispute;3. A State-level appeal process, involving the State coordinator, should be available for appeals and

resolutionofinter-districtdisputes;4. The dispute resolution process should be as informal and accessible as possible, and allow for

impartialandcompletereview;5. Parents, guardians, and unaccompanied youth should be able to initiate the dispute resolution

processdirectlyattheschooltheychoose,aswellaswiththehomelessliaison’soffice;6. Parents,guardians,andunaccompaniedyouthshouldbe informedthat theycanprovidewrittenor

oraldocumentationtosupporttheirposition;7. Studentsshouldbeprovidedwithallservicesforwhichtheyareeligiblewhiledisputesareresolved;8. Writtennoticeshouldbecomplete,asbriefaspossible,simplystated,andprovidedinalanguagethe

parent,guardian,orunaccompaniedyouthcanunderstand.Thenoticeshouldinclude:a. ContactinformationfortheSchoolhomelessliaisonandStatecoordinator,withabriefdescriptionof

theirroles;b. Asimple,detachableformthatparents,guardians,orunaccompaniedyouthcancompleteandturnin

totheschooltoinitiatethedisputeprocess.(TheSchoolshouldcopytheformandreturnthecopytotheparent,guardianoryouthfortheirrecordswhenitissubmitted);

c. Astep-by-stepdescriptionofhowtodisputetheSchool’sdecision;d. Noticeoftherighttoenrollimmediatelyintheschoolofchoicependingresolutionofthedispute;e. Noticethat“immediateenrollment”includesfullparticipationinallschoolactivities;f. NoticeoftherighttoappealtotheStateiftheSchool-levelresolutionisnotsatisfactory;andg. TimelinesforresolvingSchool-andState-levelappeals.V. ProhibitionagainstSegregation.Homelessness is not sufficient reason to separate students from themainstream school environment.ServicesprovidedwithMcKinney-VentoAct fundsmustnotreplace theregularacademicprogramandmustbedesignedtoexpanduponorimproveservicesprovidedaspartoftheSchool'sregularacademicprogram.•IfaStatereceivesfundsundertheMcKinney-Ventoprogram,everydistrictinthatState–whetherornot it receives a McKinney-Vento subgrant from the State – is prohibited from segregating homelessstudents in separate schools or in separate programswithin schools, based on the child’s or youth’sstatusashomeless.• Schools may not provide services with McKinney-Vento funds on school grounds in settings thatsegregate homeless children and youth from other children and youth [except as necessary for shortperiodsoftimeforhealthandsafetyemergenciesortoprovidetemporary,special,andsupplementaryservicestomeettheuniqueneedsofhomelesschildrenandyouth].

VI. Transportation.At the request of the parent or guardian (or, in the case of an unaccompanied youth, the liaison),transportation shall be provided to or from the “school of origin” in accordance with the followingrequirements:•Ifthehomelesschildoryouthcontinuestoliveintheareainwhichtheschooloforiginislocated,thatSchoolmustprovideorarrangeforthechild’soryouth’stransportationtoorfromtheschooloforigin.•Ifthehomelesschildoryouthcontinueshisorhereducationintheschooloforiginbutbeginslivinginanareaservedbyanother localeducationalagency(LEA), theLEAof originandtheLEA inwhich thehomelesschildoryouthislivingmustagreeuponamethodtoapportiontheresponsibilityandcostsforprovidingthechildwithtransportationtoandfromtheschooloforigin.IftheLEAscannotagreeuponamethod,theresponsibilityandcostsfortransportationaretobesharedequally.VII. ComparableandCoordinatedServices.TheSchoolmustprovideservicestoeachhomelesschildandyouththatiscomparabletoservicesofferedtoother students in the School.Homeless childrenare also entitled toparticipate in the regularafter-schoolprogramprovidedbytheSchool,andtheSchoolmustaddressbarrierstotheirfullparticipationintheseprograms.Ifnoafter-schoolprogramsareprovidedbytheschoolortheprogramsprovideddonotmeet theneedsof homeless children,McKinney-Vento fundsmaybeused forafter-school services forhomelesschildren,andfornon-homelesschildrenwhoareatriskoffailingin,ordroppingoutof,school.TheSchoolmustprovidecomparableservicestoahomelessstudentwhodoesnotattendaTitleIschool.SchoolmustreservefundsforhomelesschildrenwhodonotattendparticipatingTitleIschoolsandmay,for instance, provide support services to children in shelters and other locations where homelesschildren live. Services shouldbeprovided to assist homeless students to effectively take advantageofeducationalopportunities.VIII. Privacy.Informationaboutahomelesschild’soryouth’s livingsituationshallbe treatedasastudenteducationrecord,andshallnotbedeemedtobedirectoryinformation.
