3. General Eligibility Criteria: ♦ Firms should have proper established design office and have well qualified, relevant

technical personnel on their rolls. ♦ For category ‘C’ & ‘D’ :-List of building works (indicating the type) designed, executed

during the past ten years for Government /semi government departments shall be provided. For category ‘A’ (i.e. A-1, A-2, A-3, A-4) & ’B’ work experience for building works should be minimum for last three years.

♦ Facilities in respect of computer aided design and draughting available shall be provided by the firms.

♦ For category C & D:-A credible turnover minimum Rs. 8 lacs consultancy fee per annum is compulsory. For category A (i.e. A-1, A-2, A-3, A-4) & B minimum turnover Rs. 2 lacs per annum is compulsory.

4.0 Specific Eligibility Criteria: ♦ For category A (i.e. A-1, A-2, A-3, A-4) and B’ Principal of the firm to be min.

B.Arch.degree/Diploma in Arch Assistantship, with minimum experience of 3 years. ♦ For category ‘C’ Principal consultant should be minimum B.Tech/equivalent in Civil

engineering with minimum experience of 10 years in the structural design of building works. Post graduate in structural Engineering shall be value added.

♦ For category ‘D’ Principal consultant should be a minimum B.Tech/equivalent in Civil engineering with minimum experience of 10 years in the PHE design of building works. Post graduate in Public Health Engineering/ Environmental Engineering shall be value added.

5. RITES reserves the right to accept/reject any or all of the bids without assigning any

reason whatsoever. 6. Conditional bids are liable to be rejected. 7. The validity of the bid shall be 120 days from the date of its submission. 8. The application Performa can be obtained on all working days from 15.11.07 to

5.12.07 on payment of Rs. 500/- each category (Non-refundable) by DD/Pay order in favour of RITES Ltd. Gurgaon/Delhi from JGM(Civil)/RITES Arch. & Plann. Division, Vth Floor, rightwing, RITES Bhawan , Plot No. 1, sector-29, Gurgaon-122001. The application Performa can also be down loaded from RITES’s website www.rites.com w.e.f. 15.11.07. In such case payment of Rs.500/- each category shall also be enclosed in the form of DD/payorder in favour of RITES Ltd. while submitting the bid. Application shall not be sent through post by RITES.

9. Filled forms (along with the prescribed fee in case downloaded from website)

should be submitted by 6.12.07 at 3.00pm (or next working day same time in case 6.12.07 is a gazetted holiday. RITES shall not be responsible for documents delayed/lost/misplaced through postal transit.

CATEGORY ‘D’ CATEGORY ‘D’:- Quotation for Public health Engineering design and drawings, detailed analysis and calculation for building projects/works including preparation of bill of quantities, cost estimation, specifications, tender documents in accordance with latest relevant codes on square meter basis. This includes both internal and external development works Applicants are requested to provide details as per Annexure 1,2,3 and 4 giving full details of general eligibility conditions as spelt out at item 3 of the advertisement/specific eligibility as spelt out at item 4D. Firms wishing empanel with RITES Ltd. after submitting their quotations may therefore submit their credentials by giving their company details/brochure as well as the specific details as asked in the advertisement. Annexure’1’ (eligibility), Annexure’2’ (computer/office facilities), Annexure’3’ (project experience) and Annexure’4’ (registration with other departments) should be filled. Filled up application forms should be submitted by 6.12.07 to the JGM/Civil or designated officer on or before 3.00PM at RITES Ltd. offices. Please note that all the papers submitted to RITES Ltd. as part of application material including those of company profile, covering latter and filled up application forms etc, all must be page numbered from first page to last page and each page bearing company stamp and signature of the principal/company authorized signatory. In case of authorized signatory, power of attorney duly notarized shall be submitted along with the application. Applications those are incomplete / not on prescribed format or not bearing the above stipulations of application or conditional application forms will be rejected.

1.1.8 Design of Rain Water Harvesting Scheme i) Design of Rain water harvesting scheme. ii) Preparation of tender drawings and detailed working drawings

including all working details necessary for successful completion of work.

iii) Preparation of Bill of Quantities and Estimates based on drawings, CPWD SOR, other relevant SOR & Analysis of rates along with Market rates quotations from three reputed firms.

iv) Preparation of tender document/detailed specifications based on CPWD/relevant Norms for Schedule items and non schedule items (as applicable) with rate analysis along with list of recommended make of materials.

v) Approval of Scheme from Local civic Authority (if required).

1.2 INTERNAL WORKS : 1.2.1 Design of internal water supply scheme including water tanks :

ii) Design and layout of rain water disposal system. iii) Preparation of tender drawings and detailed working drawings containing

all relevant details required to complete the work satisfactorily. iv) Preparation of Bill of Quantities and Estimates based on drawings, CPWD

SOR, other relevant SOR & Analysis of rates along with Market rates quotations from three reputed firms.

v) Preparation of tender document/detailed specifications based on CPWD Norms for Schedule items and non schedule items (as applicable) with rate analysis along with list of recommended make of materials.

1.2.4 Design of Fire Fighting System

2.0 STAGES OF WORK 2.1 Preliminary Stage:

♦ Conceptualization of System in close co-ordination with architects and/or Engineers.

♦ Working out preliminary sizes of various components of all the elements based on design analysis as per codes.

♦ Preparation of preliminary cost estimates.

2.2 Tender Stage : ♦ Preparation of preliminary PHE and fire fighting drawings (Tender

drawings) adequate for the purpose of tendering. ♦ Preparation of detailed estimates and BOQ based on tender drawings. ♦ Finalization of detailed specifications based on CPWD norms/relevant

norms for all schedule and non schedule items along with rate analysis and list of recommended make of materials.

♦ Preparation of Tender documents for subject works. 2.3 Working drawing stage

♦ Preparation of detailed PHE & fire fighting Drawings and construction details based on and in co-ordination with Architectural working drawings and details.

2.4 Construction Stage ♦ Release drawings as required proper execution of work. ♦ Conduct necessary periodic supervision to verify that works are generally

being executed in accordance with drawings.

3 RESPONSIBILITY OF THE SUB-CONSULTANT 3.1 Sub-Consultant shall prepare all designs and drawings, specs, estimates, BOQ

and tender documents in close co-ordination with RITES Ltd. 3.2 Sub-Consultant shall in association with RITES Ltd. obtain approval of the above

and do any subsequent changes from the client. 3.3 Sub-Consultant shall carry out modifications desired by the RITES Ltd./client. 3.4 Sub-Consultant shall be responsible for the performance of the system designed

by them and sub-consultant shall issue a certificate mentioning that work is designed as per latest relevant Indian codes and norms according the Local civic authority or concern authority.

3.5 Sub-Consultant shall supply detailed computations and back-up sheets to RITES Ltd. on hard and soft copy to RITES Ltd.

3.6 Sub-Consultant shall prepare all drawings and data on AutoCAD and/or relevant/prevalent Computer programs.

3.7 Sub-Consultant shall collect the basic Architectural drawings from this office and hold discussions with RITES Ltd. before planning, design and estimates, as required. The sub-consultant shall also responsible for getting the approval of designs, estimates and drawings from Local civic/client.

3.8 Analysis and design shall conform to relevant BIS/other codes/standards with all amendments up to date.

3.9 Sub-consultant shall adhere to the time schedule provided by RITES official to ensure timely completion of work.

4.0 DATA TO BE PROVIDED BY RITES: Relevant architectural drawings for carrying

out the work and survey plan.

5.0 SCHEDULE OF PAYMENT:

5.1 Security deposit equal to 5% of payable amount will be recovered from every bill

and will be returned to the Sub-Consultant after satisfactory completion of the project, but not exceeding a period of eighteen months from the date of award of work, unless the work is delayed by the Client.

5.2 Above stages of payment are applicable for each item in scope of work. 5.3 Rates are inclusive of all taxes except service tax as applicable. 6.0 TIME SCHEDULE: This time schedule is indicative and would be specific for each

project.

: 2-4 weeks (depending upon quantum of work and as per project requirement) from award of work and receipt of data from RITES Ltd..

b) Completion of Tender Stage 2.2

: Within 2-4 weeks (depending upon quantum of work and as per project requirement) from receipt of approval of above.

c) Completion of working drawings stage as per 2.3

: Within 4-8 weeks (depending upon quantum of work and as per project requirement) from completion of above.

7.0 COMPENSATION FOR DELAY/LIQUIDITY DAMAGES Time is the essence of the contract. The entire work as per the scope of work

shall be completed by the Sub-Consultant within the stipulated time. For any delay in completion of the job due to reasons attributable to the Sub-Consultant, RITES shall be free to charge compensation @ 2% per week of delay or part thereof for the entire work subject to a maximum of 10% of the contract amount.

8.0 OTHER CONDITIONS: 8.1 No deviation in the scope of work, terms and conditions shall be accepted. 8.2 In the case of premature termination of this contract no extra compensation will be

payable. Payment of remuneration in that case will be made by RITES Ltd. on pro - rata basis for the scope of services actually rendered to that time, subject to the intermediate targets being adhered to as per the work schedule mutually agreed to.

8.3 All the documents and drawings created out of the assigned work will become the sole property of RITES Ltd.

8.4 Sub-Consultant will exercise all reasonable skill, care and diligence in the performance of the services under the Agreement, and shall carry out all the responsibilities in accordance with recognized professional standards.

9.0 TERMINATION That this agreement may be terminated at any time giving seven days notice to

the sub-consultant incase the work is not satisfactory according to terms of the offer and in the event of such termination RITES shall be free to get the balance work completed at the risk and cost of the sub-consultant and RITES may make full use of all or any of the drawings prepared by the sub-consultant.

10.0 NUMBER OF DRAWINGS SETS ETC.: All estimates, BOQ, detailed calculations and design report (duly signed and

stamped) shall be supplied in triplicate. All drawings shall be prepared in Auto CAD. All drawings shall be in 3 sets including one set of Good for Construction (GFC) drawings on tracing paper and soft copies on CD etc. Two sets of check prints on A-2 or A-3 size (or as per requirement of RITES) with soft copy and final drawing as per format of RITES Ltd. will be provided. Any revisions shall be reissued without any extra charges.

11.0 GUARANTEE

The Sub-Consultant shall agree to re-design at his cost any portion of Engineering and design work, which due to his failure to use a reasonable degree of design skill shall be found defective during the period of construction. RITES may make good the loss by recovery from Sub- Consultant in case of failure to comply with the above clause subject maximum of security deposit deducted as per clause 5.1 above.

12.0 GENERAL CONDITIONS

12.1 Adequacy of Design

The services to be rendered by Sub-consultant shall be based on relevant applicable codes and sound engineering practices. Major decision and specification shall be reviewed by RITES Ltd. to the extent desired. Approval of any design / drawing by RITES Ltd. shall however not relieve the sub-consultant in discharging his responsibilities regarding the adequacy of design and proper functioning of the works. The sub-consultant shall be fully responsible for the adequacy, accuracy and quality of entire services performed under this contract and shall guarantee that the services performed by him shall be in accordance with accepted standards of safety, environment protection and public health. RITES LTD have right to get the design approved/checked by reputed independent agency. In that case it will be the responsibility of the Sub-Consultant to depute their executive and furnish necessary clarification/ calculations/assistance for the approval of the drawings/design calculations and no extra payment shall be payable on this account. Sub-Consultant should be conversant with latest Department of Public Enterprises (DPE) norms and should also be conversant with CPWD norms.

12.2 Addition and Alterations RITES Ltd. shall have the right to request in writing changes, additions,

modifications or deletions in the design and drawing of any part of the work and to request in writing additional work in connection therewith and the Sub-Consultant shall comply with such request. If RITES Ltd. deviates substantially from the original scheme which involves for its proper execution, extra services, expenses and extra labour on the part of the Sub-Consultant for making changes and additions to the drawings, specifications or other documents due to rendering major part or the whole of his work infructuous and the Sub-Consultant may then be compensated for such extra services and expenses on quantum merit basis at percentage applicable under this agreement and to be determined mutually unless such changes, alterations are due to Sub-Consultants own ommission and/or discrepancies and due to changes required by Sub-Consultants of all internal, external utilities and services. The decision of RITES shall be final on whether the deviations and additions are substantial as requiring any compensation to be paid to the Sub-Consultant. However, for the minor modification or alteration which does not affect the entire design planning etc., no amount will be payable.

12.3 Foreclosure of Contract

RITES Ltd. reserves the right to foreclosure of contract without assigning any reason whatsoever. The payments in the event of foreclosure of contract shall be restricted to the amount defined / stated for each stages independently and in the event of such termination the Sub-consultant shall be entitled to all such fee for the services rendered and liable to refund the excess payment if any made to him over and above what is due in terms of this agreement on the date of termination and the Employer may make full use of all or any of the drawings prepared by the Sub-consultant.

In the case of premature termination of this contract no extra compensation will be payable. Payment of remuneration in that case will be made by RITES Ltd.on pro-rata basis for the scope of services actually rendered to that time, subject to the intermediate targets being adhered to as per the work schedule mutually agreed to.

12.4 Rescinding of Contract

In the event of failure on the part of the sub-consultant to complete work in time or to the complete satisfaction of RITES Ltd. or in the event of committing breach of any one or more of terms and conditions of the Agreement, RITES LTD. shall be entitled to rescind this contract without prejudice to its rights to claim damages or remedies under the law. The period of notice to be given to rescind the contract will be 7 days and in the event of such termination sub-consultant shall be liable to refund the excess payment if any made to him over and above due to him on the date of termination and RITES LTD. will be entitled to make full use of all or any of the drawings / documents prepared by sub-consultant. In such case RITES LTD. shall have power to engage another sub-consultant to carry out the balance work debiting the sub-consultant the excess amount if any so spent subject to a maximum of 10% of the total fee which would have been paid. Sub-consultant shall pay to RITES LTD. on demand of such excess expenditure within 30 days of issue of notice failing which sub-consultant shall be debarred from consultancy jobs of RITES LTD. in future besides taking other course of action under law to recover such expenses.

12.5 Dispute Redressal / Arbitration If at any time, any question, dispute or differences whatsoever shall arise

between RITES Ltd and Sub-consultant with regard to or in relation to or in connection with the terms and conditions, whether during the progress of work or after its completion, such disputes or differences shall be mutually discussed and settled by the GGM (Arch.) , RITES Ltd.. In case no settlement is arrived at, the decision of the Executive Director, RITES Ltd., shall be final and binding on the parties to the dispute.

12.6 Non Submission / Submission of Deficient Documents

The Sub-consultant/ bidder shall ensure submission of all documents required/ requested for in the tender document. RITES Ltd. shall not revert back for seeking deficient documents and shall not be responsible for the same.

12.7 Force Majeure

a) If the Sub-consultant should either totally or temporarily be unable to perform his obligation in the fulfillment of the Agreement due to unforeseeable causes beyond his control and not due to his fault or negligence including but not limited to acts of nature or public enemy, acts of the Government in its sovereign capacity, fire, flood, epidemic, quarantine restrictions, strike other than those carried out by the sub-consultant's staff, unusually severe weather conditions or delays due to such causes, the sub-consultant shall notify RITES Ltd. in writing within fifteen (15) days of such Force Majeure, with complete details.

b) In the event that RITES Ltd. encounters an act of Majeure as specified above, RITES Ltd. shall notify the sub-consultant in writing of the said event within fifteen (15) days.

c) Neither of the parties shall be responsible for delays by Force Majeure. If the Force Majeure persists more than ninety days, the terms of agreement shall be renegotiated for any period necessary for the services not completed due to suspension.

12.8 Copyright / Proprietary right

a) The sub-consultant hereby agree that the fee to be paid as provided in this

agreement will be in full discharge of function to be performed by him and no claim whatsoever shall be made against RITES Ltd. in respect of any part relating to the plans, drawings and other documents submitted by sub-consultant.

b) The drawings, design, plans, related details prepared and acquired by the sub-consultant for the work entrusted to him under this agreement will become the property of RITES Ltd. The drawings, design, plans, related details can not be issued to any other person, firm or authority or used by the sub-consultant for any other project without prior permission of RITES Ltd. However the drawings and design can be utilized by RITES Ltd. for other works and sub-consultant shall not have any objection whatsoever.

12.9 Validity of Rate Contract

The rate contract shall be valid for a period of 24 months. This will be reckoned from the date of issue of letter of empanelment & approved rates.
