Agenda No.1

1.1 Status of abolition of interviews.

The Prime Minister in his address to the nation on the Independence Day has stressed

the need to discontinue holding interviews for recruitment for such junior level posts

where personality assessment is not an absolutely necessary requirement.

He has called upon the Government Organizations' to end this practice at the earliest

as it will help in curbing corruption, more objective selection in transparent manner

substantially easing the problems of poor people.

He has emphasized that the recruitment should be made on merit basis through

transparent, online processes leading to less Government and more Governance.

The Department of Personnel and Training on the basis of recommendations made by

the Committee of Secretaries has already taken a decision to discontinue interviews at

the junior level posts at Group 'B' (Non-Gazetted), Group 'C' ,Group 'D' (which are now

reclassified as Group 'C') and all equivalent posts.

All the advertisement for future vacancies will be without the Interview as part of the

recruitment process. From 1 st January 2016 there will be no recruitment with interview

at the junior level posts, in Government of India Ministries/ Departments/attached

Office/Subordinate Office/Autonomous Bodies/Public Sector Undertakings.

The interviews will be done away even in cases where the selections were made

purely on basis of performance in the interview. The

Ministries/Departments/Organizations' will consider revising the scheme for selection or

such cases.

As the Skill Test or Physical Test is different from Interview they may continue.

However these tests will only be of qualifying nature. Assessment will not be done on

the basis of marks for such tests.

The decision to discontinue interview for the junior level posts across the country will

be major step towards achieving the objectives of citizen centric transparent governance.

The matter has also been taken up with the State Governments/UTs to undertake

similar exercise, from time to time. In this regard letters from Secretary (Personnel) to

the State Chief Secretaries have been issued on 4th September 2015 and letters from MoS(PP) to the State Chief Ministers have been issued on 29 th September 2015 and 1 st January, 2016.

To facilitate the implementation of the directions of the Hon'ble Prime Minister further

by the various Organizations/Ministries/Departments/Governments a one day workshop was also organized by the DOPT on 16 th November 2015.

Some of the State Government have shared the status in this regard with the DOPT. The Summary of the State Responses on the Discontinuation of Interview is as follows:

Daman & Diu, Dadra and Nagar Haveli

No interviews in Group B (non gazetted), C and D posts. They have issued a recruitment pattern.

Gujarat Government of Gujarat has informed that the State Government had implemented the policy of cancellation of interview in the direct recruitment, on the lower level posts.

Haryana No interviews at Group 'D' level

Himachal Pradesh

There is a proposal to discontinue interview for Group C and Group B Posts

Jharkhand No interview in 'D', 'C', and 'B' (non-gazetted)

Karnataka Government of Karnataka has informed that the State Government has discontinued the procedure of conducting interview for selection to Technical and Non-Technical Posts in Group-C category, in the Government.

Kerala At present no interview are there for group 'C' and 'D' posts and even for some of the gazetted posts.

Maharashtra Interviews for the recruitment of the clerks have been discontinued. For Class 2 non-Gazetted, Class 3 and 4 posts, interviews have been done away. The State Government has taken a decision and issued directions to the effect that the direction of discontinuation of Interview will also be applicable to all State Government undertakings and local bodies.

About 61% of the recruitment is done without interview.

Manipur It was informed that the State Government had undertaken the recruitment of Graduate Teachers under the Rashtriya Madhyamik Sikhsha Abhiyaan (RMSA) without conducting interview. This measure was successfully undertaken and was completely transparent and corruption free. It was informed that the second pilot measure in this regard is being undertaken by the Health Department.

Puducherry Notification for discontinuation of interviews for Group C, D, and non-gazetted Group B has been issued.

Punjab Some of the Departments have already implemented the decision and that there has been no problem with completely doing away with interviews for the posts of SDO in Irrigation Department, Senior Assistant in Secretariat and for a few lower level posts in Agro Industry Department.

Rajasthan The representative from Rajasthan informed that interviews have been discontinued in some posts and retained in some of them. For Class 3/Ministerial staff and Group D/Class 4 level recruitment, there have been no interview. Similarly for Constable, there have been only written test and physical test. The interviews have been dispensed away for all the posts under the Rajasthan Education Service Rules, 1970.

Sikkim For Group D/Class 4 level posts there are no interviews. At Group C/III level, for 90% of posts there are no interviews.

Telangana Teachers — no interviews

Tamil Nadu The recruitment is done by the following four recruitment boards and the status vis-à-vis conducting the interview is as follows:-

1) Uniform Services Board- No interview 2) Medical Services Board- No interview 3) Teachers Recruitment Board- No interview 4) Tamil Nadu Public Service Commission (TNPSC) — has

assorted posts in which there is some degree of posts with interviews.

In the State 85% of the total posts do not have interview as a part of recruitment process.

Uttarakhand The state Government has abolished interviews in the group 'C' and 'B' (non gazetted). There has been no interview in Class 3/4 levels of posts.

Uttar Pradesh No more interview for teachers.

Meeting in UPSC regarding promotion of officials from State Civil Service to IAS.

6 As on date, the Central Government has already confirmed vacancies available

for recruitment by promotion / selection to Indian Administrative Services of almost all

the State IAS Cadres during 2015. However it is observed that as on date, Selection

Committee Meetings (SCM) of only 1 state has been convened by the UPSC. This is

well below the target and not only defeats the objective of ensuring speedy recruitment

but also puts unnecessary pressure upon UPSC to hold all SCMs at the end of the year

and upon the Central Government in redressing the overall issue regarding shortage of

AIS officers. The State Governments are, therefore, requested to ensure that complete

proposals are sent to the UPSC expeditiously so that all the SCMs are convened by July, 2015. The State wise position is at Annexure —I.

Agenda No. 3

Review of service records of AIS officers under rule 16 (3) of All India Services (Death-cum-Retirement Benifits) Rules, 1958.

The object of the Rule is to weed out the deadwood in order to maintain a high

standard of efficiency and initiative in the State Services. It is not necessary that a good

officer may continue to be efficient for all times to come. There may be some officers

who may possess a better initiative and higher standard of efficiency and if given

chance the work of the Government might show marked improvement. The rule merely

seeks to strike a just balance between maintenance of efficacy in the diverse activities

of State administration and cessation of the completed career of an officer whose

integrity is doubtful and his services are no longer useful to the administration and

public. However, the order of premature retirement can be passed only after having

due regard to the entire service record of the officer. The order of premature retirement

is not to be treated as a punishment coming under Article 311 of the Constitution. It may

be kept in mind that the order of compulsory retirement shall not be passed as a short

cut to avoid departmental enquiry when such course is more desirable. If the officer

was given a promotion despite adverse entries made in the confidential record, that is a

fact in favour of the officer.

2. As you are aware that the Government of India had amended rule 16(3) of AIS

(DCRB) Rules, 1958 vide notification No.25013/02/2005-AIS-11 dated 31.01.2012 and

also issued relevant guidelines for intensive review of service records of AIS officers

vide O.M. No.25013/02/2005-AIS-11 dated 28.06.2012. The intensive Review is

proposed at two Stages while assessing the fitness of the officer on promotion to the

STS/ equivalent levels and again for promotion to ASTS/ equivalent levels. Further, if an

officer is not found fit for promotion to these levels on successive two occasions, he/

she may be recommended for premature retirement.

a Time and again, the State Governments have been requested to carry out

intensive review of service records of AIS officers who have completed 15/25 years of

qualifying service or on attaining the age of 50 years as the case may be and

submission of reports to this Department. The States who have carried out the 15/25

review but not submitted the report are requested to submit the same to this

Department at the earliest. Details of intensive reviews carried out by States as on date

is placed at Annexure-II & III.

Agenda No. 4:

Pending cases of training of promoted IAS officers

Department of Personnel and Training has organized Special Induction Training

programmes for promotee IAS Officers in the year 2015 and 2016 to clear backlog.

As on date there are 196 promotee IAS officers, who have to still undergo Induction

Training, Programme. Out of 196, 65 officers ( Annexure-IV) have been nominated for

induction training programme scheduled to be held during 24.04.2016 to 06.05.2016 at

IMG, Kerala. Remaining 131 officers (Annexure-V) will be nominated in June / July at

LBSNAA, Mussoorie / ATI West Bengal.

As DOPT has made this arrangement to remove the backlog with special efforts the

concerned State Governments are requested to nominate the officers for the training

programme. It needs to be stated that this training programme is mandatory and have

an impact on confirmation in the careers of the Officers. The State Governments may

also furnish reasons for not sending these officers for the programme for which they

have been nominated.

Agenda No. 5

CBI related issues

Point 1:- Settinq up of Additional Special CBI Courts

Hon'ble Supreme Court in Crl App. No.88-93 of 2003 in CBI vs. SaurinRasiklal Shah vide order dated 10/12/2013 has interalia directed that the concerned State Governments will provide necessary assistance to the Govt. of India to make the additional Special Courts functional within a maximum period of four months from today else the Central Government may take action under Article 247 of the Constitution. The period of four months has expired on 10/4/2014.

2. This Department has requested various state Governments several times to make operational remaining additional special courts in compliance of above direction of Hon'ble Supreme Court. So far 18 Additional Special Courts have become functional. Out of 22, additional special courts in following states have not become operational yet:

It is requested that in the next meeting of the Principal Secretaries, GAD the concerned states may be requested for expediting the process of operationalization of the courts.

Point 2:- Acute shortage of manpower in Central Bureau of Investigation (CBI).

CBI is facing acute shortage of manpower in the rank of Constable, Head Constable, Inspector and Superintendent of Police. To fill up these vacancies, CBI has requested all State Governments several times to send the names of willing officials/officers to join CBI on deputation basis to ensure effective investigation of cases. The problem is especially acute in the wake of the Hon'ble Supreme Court and High Court handing over a large number of sensitive cases to the CBI for investigation without any additional manpower. Recently the government has also sanctioned 598 new posts for CBI for investigation into Vyapam scam cases and Chit fund/ Ponzi scam cases. However, these posts have not been filled up so far. Further, Hon'ble Supreme Court in SubrataChattoraj vs. U01 has also directed that steps be taken to fill up the existing vacancies expeditiously. The matter was also raised by CBI before the members in the last state GAD Secretaries meeting.

2. It is once again requested that all State Governments may kindly send the names of willing officials/officers at the earliest to CBI to fill their vacant posts on deputation basis in the rank of Constable, Head Constable, Inspector and Superintendent of Police.

As per existing procedure, cadre-wise vacancies are distributed by giving 50%

weightage to number of districts in the States / Cadre in proportion to number of

Districts in the country and 50% weightage to deficit in IAS in that State / Cadre vis-a-vis

total deficit in the country. However, DOPT is proposing the following two changes in

the policy for distribution of vacancies in IAS (Direct Recruit):

(i) Only Cadre deficit weight will be considered for determining vacancy distribution.

(ii) No Cadre will get vacancies more than the requisition made.

The State Governments are requested to furnish their comments on the above

proposal.

Agenda No. 7

Simplification of caste certificates

DoPT prescribes the forms concerning only the proformaes of caste certificates for

SCs/STs and OBCs. The proforma of SC/ST Caste Certificate (Annexure VI) is

already a simple one containing 2 pages requiring/seeking only the necessary details

of the applicant.

2. The OBC caste certificate proforma (Annexure VII) was last revised on

30.5.2014 and is of 1 page only. Further proposal for revision of OBC caste certificate

was received from NCBC, along with a new format for OBC non-creamy layer

certificate, since a number of candidates were facing the problem of requirement to

obtain multiple non-creamy layer OBC certificates for appearing in various

examinations conducted by recruiting agencies such as SSC, UPSC, PSBs etc. DoPT

had proposed a revised procedure in order to address the issue and the same has

been placed on department's website on 31.3.2016. Comments regarding the

aforesaid procedure as well as the format of OBC certificate proposed by NCBC have

been sought from various stakeholders.

3. Draft guidelines were placed on DoPT's website for seeking

comments/suggestions from stake-holders in the matter of institutionalization of the

process of issue of domicile/caste certificates to SC/ST students at school level when

they are in Class VIII. The procedure proposed to be adopted in this regard is at

Annexure VIII.

Agenda No. 8

State Reorganisation related issues.

Uttar Pradesh & Uttarakhand

I. Relieving of PCS officers allocated to Uttarakhand

Consequent upon dismissal of SLPs 24079-24083 & 24085 of 2003 and linked SLPs by the Hon'ble Supreme Court vide judgment dated 12.02.2015, Government of India had issued Final Allocation orders on 09.06.2015 and 02.09.2015 allocating the concerned PCS officers to Uttarakhand, who could not be allocated earlier due to stay orders granted by the Hon'ble High Court(s)/Supreme Court. The State Government has been requested to furnish a status report in respect of the implementation of the Final Allocation orders. However, requisite information is still awaited in the matter.

II. Providing information in respect of the employees who are party to the WPs linked to WP No.3636/2005 (JN Doharey vs State of UP & Ors)

The Hon'ble High Court of Allahabad vide order dated 22.05.2015 disposed of about 350 WPs, approving the revised guidelines issued by the Government of India on 27.03.2015 in respect of Class III and Class IV employees allowing them to be reallocated to UP. Till now, Government of India has issued reallocation orders in respect of about 1700 employees who were party of these WPs. The reallocation of some more employees, who were involved in the cases linked with the WP No.3636/2005 is pending for want of details of employees from the concerned departments of the State Government of UP alongwith the option /consent for

reallocation and its verification. The matter has been raised with the UP Re- organisation Coordination Department /concerned Administrative Departments from time to time. However, detail / information in respect of the petitioners in as many as 95 WPs is still awaited.

Ill. Monitoring of Court cases filed in relation to the allocation of employees under the UP Re-organisation Act, 2000

As per records 166 / 18 cases are pending in the Benches of High Court of Allahabad & Lucknow / High Court of Nainital. 74 cases pertaining to the period from 2002-2008 appear to be pending for final disposal. Communication dated 18.02.2015 requesting the State Governments for the status of these Court cases have not been responded to.

Madhya Pradesh & Chhaftisciarh

I. Grievances of employees of erstwhile State of Madhya Pradesh relating to their allocation:

Although bifurcation of the erstwhile State of Madhya Pradesh took place 15 years ago under MP State Re-organisation Act, 2000 and final allocation was made 13 years ago yet representations are still being preferred by the employees on various grounds resulting it an open ended issue. Both the State Governments i.e. M.P. and Chhattisgarh have been requested to submit concrete proposal with regard to:

(i) Deadline for receipt of any representation relating to allocation i.e. 31.3.2016.

(ii) Non-relieving of employees retiring within two years w.e.f. 1.4.2016. Response from the State Govts. is awaited.

II. Pending Court Cases:

143 Court cases are pending in the High Courts of Madhya Pradesh and Chhattisgarh. Counter Affidavits could not be filed in 36 cases for want of comments of the concerned Administrative Departments. of the State Govts. It has also been requested to instruct their Advocate General/empanelled Advocates to seek urgent hearing of all those cases in which counter replies have been filed for expediting disposal of the cases. Chief Secretaries of M.P. and Chhattisgarh have been requested to expedite it vide D.O. letters No. 14/3/2006-SR(S) dated 23.12.2015. (Annexure - X)

Bihar & Jharkhand

I. Pending allocation:

Although bifurcation of the erstwhile State of Bihar took place 15 years ago under Bihar State Re-organisation Act, 2000 and final allocation has almost been completed. However, allocation of 59 employees in 9 Departments is yet to be finalized. The State Govts. of Bihar and Jharkhand have been reminded to submit the proposal of pending final allocation by 31.3.2016. Response from the State Govts. is awaited.

Concerned Principal Secretaries/Secretaries of both the State Govts. have been requested to expedite it vide D.O. letters No. 28/18/2011-SR(S)-Vol.-II dated 15.3.2016. (Annexure - XI)

II. Pending Court Cases:

26 Court cases are pending in the High Courts of Bihar and Jharkhand. State Govts. of Bihar and Jharkhand have been requested to apprise the updated status. 3.1 Any person who claims b belong to a Scheduled Caste or a Scheduled Tribe or Other

8.4 The Appointing Authorities should, in the offer of appointment to the candidates claiming

belong to Scheduled Castes/Scheduled Tribes/Other Backward Classes include a clause as follows:

"The appointment is provisional and is subject to the Ca terfribe/Community

certificate being verified through the proper channels and if the -verification reveals that

the claim to belong to Scheduled Caste or Scheduled Tribe or Other Backward Class,

as the case may be, is false, the services will be terminated forthwith without assigning

any further reasons and without prejudice to such further action as may be taken under

the provisions of the Indian. Penal Code for production of false certificates." (OM No.

36033/4197-Estt (Res) dated .25.07.2003 and Ne.36011/3/2005-Estt(Res.) dated

019/09/2005.

8.5 An appointing authority may, if it considers necessary for any reason. verify the claim of

candidate through the District Magistrate of the place where the candidate and/or his fami:

ordinarily resides_ If after appointment in any particular case, the verification reveals that d

candidate's claim was false his services may be terminated in accordance with the relevai

rules/orders (OM No. 360111312005-Estr.(R.es) dated 09.09.200).

8.6 As no person professing a religion different from the Hinduism or Sikhism or Budhism ce

be deemed to be a member of Scheduled Castes, the appointing authorities should stipulate in tt

letter of appointment issued to Scheduled Caste candidates that they should inform about tt

change, if any. of their religion to their appointing/administrative authority immediately after such

Madarn/Sir,

The Government of India had issued snstructions on 8 th September, 1993 vide DoPT O.M. No. 36012122/93-Estt.(SCT) providing for reservation to Other Backward Classes in the services and posts under the Government of India. The format of the Caste Certificate was

prescribed vide Annexure A of the O.M. No. 36012122/93-Estt.(SCD dated l5 November 1993. In the said format, the then Ministry of Welfare's Resolution No. 12011/68/93-BCC(C) dated 10Th September 1993 was mentioned, which contained the list of castes and

communities treated as OBCs till that time. Since then., a large number of castes and communities have been added to the Central List of OK's through various resolutions of the Ministry of Social Justice and Empowerment. The details oldie resolutions subsequent to the Resolution dated 10th September 1993 do not find mention in the existing format. The said format also prescribes that the certificate issuing authority should certify that the candidate does not belong to the personsfscctions (Creamy Layer) mentioned in Column 3 of the

Schedule to the aforesaid Q.M. dated 8.9.1991.

2. Representations have been received in this Department wherein candidates belonging to PBC Communities have reportedly faced difficulty in getting the benefits of reservation. This is because of the fact that in the caste certificate issued by the concerned district authorities, although the name of the caste/community is mentioned in the certificate, the specific resolution by which the said caste/community has been included in the Central List of OBCs is not indicated.

3. Keeping in view such problems faced by the candidates, this issue was examined in consultation with the National Commission for Backward Classes and it has been decided to revise the existing format of OBC Caste Certificate. A copy of the revised format is enclosed (Annexure). All the certificate issuing authorities are requested to invariably mention the details of the Resolution (Number and Date) by which the caste/community of the candidate has been included in the Central List of OBCs and also to ensure that he/she does not belong to the persons/sections (Creamy Layer) mentioned in Column 3 of the Schedule to the aforesaid O.M. dated 8.9.1993 as amended from time to time.

Annexure - VIII

FACILITATING DOMICILE AND CASTE CERTIFICATES TO STUDENTS OF SCHEDULED CASTES / SCHEDULED TRIBES

1. The Scheduled Caste/ Scheduled Tribe students generally face difficulties in

obtaining caste certificates.

2. The Domicile/Residence Certificate is issued by the concerned authority in the State Government! Union Territory to certify that the person bearing the certificate is a domicile/ resident of the said State/ Union Territory which has issued the certificate. The students have to also visit the revenue office(s) to obtain the domicile/ residence certificate,

3. In order to mitigate the problems being faced by the students in getting the

domicile/ residence certificate and by the SC/ST students in getting the caste certificates, it is proposed that these certificates be issued when these students are in the standard V/ VIII in school.

4. For this purpose, the Principal/ Headmaster of the school will get the essential

documents/ forms of the students filled up.

5. Principal of the School will collect the required documents for obtaining domicile and caste certificates from the students and forward the same to the concerned designated State Government/ Revenue authority.

6 A window period of two months may be allowed for completion of this

process

7. The designated State GovernmenV Revenue authority will scrutinise the documents and issue the certificate within 30 to 60 days.

B After the issue of the certificate, the school administration will hand over the certificates to the students who will keep them in their custody so that they can avail the facilities/ benefits admissible to the category to which they belong.

9. The school/ revenue authority will also try to make these certificates Aadhaar enabled .

10. All the certificates, as -far as possible ., will be maintained by the school( revenue authority in a digitised form in the 'e-Locker.

11, The above proposal was placed on tne website of the Department of Personnel & Training on 20.11.2015 for inviting comments and suggestions. Only one response was received, which supported the proposal. The Department of School education & Literacy have also supported the proposal.
