SUNDAY, MAY 21, 2017 (PAGE 12) DAILY EXCELSIOR, JAMMU Govt is bound to ensure fair competition: CJI NEW DELHI, May 20: The Government is bound to ensure fundamental principle of fair competition is followed and its benefits are extended to all, Chief Justice of India (CJI) J S Khehar today said. The CJI, who was delivering Vth Competition Commission of India (CCI) Annual Day lecture here, said the colonial British rule “wiped out” fair trade com- petition and the state of Indian textile industry then was an example of unfair practice. “Every Government is bound to ensure full fundamen- tal principles of competition. The extension of its benefits to all as per constitutional princi- ple. It is the duty of the govern- ing political party. “This has to be done without infringing basic fundamental and constitutional benefits,” Justice Khehar said. Referring to various Supreme Court judgements in cases like SEBI-Sahara, BCCI, Unitech and T N Godavarman which dealt with investors’ money, functions of cricket body, home buyers’ rights and illegal mining respectively he said, “they show that constitu- tional remedies are available”. Speaking about the evolution of law on fair competition and monopoly in trade practise in the country, the CJI said, the 2002 Competition Act gives wider power to the CCI to ensure fair trade competition and freedom of trade. Referring to the provisions governing the CCI, the CJI said that it has “extra-territorial juris- diction” and can be termed as “global watchdog of internation- al transactions” as it has wide power to regulate such deals if they violate the law. He then dealt with signifi- cant judgement of the Supreme Court in a case that held that “prima facie” view of the CCI cannot be challenged in appel- late courts. The man, identified as Khalid Hussain (45) son of Mohmed Yousaf of Jakhed Latti, was on way to home when a wild bear suddenly attacked him. The man was seriously injured by bear. Man jumps before train, dies Excelsior Correspondent KATHUA, May 20: A man allegedly committed suicide by jumping before a train in Hatli area, a police official said here today. The deceased has been iden- tified as Som Dutt, son of Billa Ram, a resident of Ward Number 9, Kathua. The body of the deceased was shifted to District Hospital Kathua, where after conducting postmortem, it was handed over to family members for last rites. Railway Police Kathua has stated investigation in this regard. Girl injured in cooker blast Excelsior Correspondent SAMBA, May 20: A girl received injuries in cooker blast at Dansala Mandi area of the district, a police official said. The victim has been identi- fied as Teena (18), daughter of Parmodh Chand, a resident of Dansala Mandi, Samba. She was shifted to District Hospital Samba and later referred to GMC Jammu for advanced treatment. Bodies of both the deceased have been shifted to District Hospital Samba and after com- pleting legal formalities, hand- ed over to family members for last rites. Court denies bail in Bakra murder case Excelsior Correspondent JAMMU, May 20: In the much publicized murder case of Sanjay Kumar alias Bakra, Principal Sessions Judge Jammu Sanjay Gupta has reject- ed the bail application of main accused Rajesh Dogra alias Mohan Singh. After hearing Advocate Summit Nayyar for the accused whereas Special Public Prosecutor RK Kotwal for the State, the court observed, "alle- gations are very serious. The punishment for offense under Section 302 RPC is death or life imprisonment", adding "life imprisonment is rule and sen- tence of death is an exception". With these observations, court dismissed the bail applica- tion. Driver dies as Tipper falls in gorge Excelsior Correspondent REASI, May 20: Driver of a Tipper was killed when the vehicle rolled down in a deep gorge at Khouri, here today. The Tipper, bearing registra- tion number JK14A- 6492 fell into deep gorge when it lost balance while unloading some construction material . The driv- er of the tipper, namely Jyoti Kumar (40), son of Fakir Chand of Kanthan, tehsil Arnas, died on the spot. Akbar to Pak NEW DELHI, May 20: In a veiled expression of weariness with Pakistan for making constant call for dia- logue without addressing the core issue of cross-border ter- rorism, Minister of State for External Affairs MJ Akbar has said asking for peace talks could be an excuse for avoiding real peace and reflect a position that may be hypocritical. “When anyone asks for peace talks, it does not neces- sarily mean that that country is asking for peace. And one has to measure that difference very carefully,’’Akbar said here last evening launching a new jour- nal on international affairs, titled ‘’India and World’’. “Do you want peace or do you want peace talks as an excuse for a position that may be hypocritical? And our reac- tion will be based on the larger assessment of what you mean,’’ said the Minister, without nam- ing Pakistan. The Minister’s remarks acquire an added significance in view of the speculation about a meeting between the Prime Ministers of India and Pakistan on the sidelines of the SCO Summit in Astana in June, and they come a day after an international court stayed the execution of Kulbhushan Jadhav, a former Indian Navy officer accused of spying. Describing terrorism as the single most important threat to the world, the Minister stressed that India will continue to fight and defeat terrorism and terror- ists’ designs “to split pluralistic societies that have achieved internal cohesion and peace through suspicion and fear.” Dwelling on the theme of “Indian Diplomacy@2020: Power of India,” Akbar provid- ed a big-picture view of India’s foreign policy priorities and underlined that the diplomatic drive under Prime Minister Narendra Modi has been geared towards placing “India and Indians First” in the coun- try’s multi-faceted diplomatic outreach. “When we discuss Indian diplomacy, Indians come first and diplomacy comes later. It is India First and it is Indians First and therefore what serves the national interest takes pri- ority,’’ Akbar said before an audience of diplomats, aca- demics, experts and journalists. Akbar said the search for economic growth and the search for India’s place at the high table of the 21st century would be the predominant urge of the people of India. ‘’And this is the century when India will find itself again after the past gets blurred before the challenges of the present and the future.’’ In his address, the Minister underscored the rising global profile of India and the chang- ing narrative about India on the global stage by stressing that the world now needs an India- centric and India-specific poli- cy. “India has always had a world foreign policy. Now, large parts of the world have an India policy. And that India policy can’s be confined to a South Asia policy, or Southeast Asia policy or an Asia policy. Now you have to find a way of engaging with India which is India-centric and India-specif- ic,’’ the MoS said. Ahead of the third anniver- sary of the NDA Government, the Minister struck an upbeat note saying that in the past three years, with the impetus given by Prime Minister Modi, India had expanded the horizon of its engagement very vastly with the world and those parts of the world which were off the radar, have been brought in. ‘’India’s expanding engagement with the world had not attracted an adverse reac- tion because India’s engage- ment is benign, and not malign, based on treating every nation as a sovereign and equal part- ner,’’ he said. A defence spokesman said the medical team comprising specialist doctors from Army and Civil including a lady doc- tor provided treatment to the patients along with free medi- cines and cases requiring pro- longed treatment were referred for specialist treatment at Sher- e-Kashmir Institute of Medical Sciences (SKIMS) Soura here. "The medical camp wit- nessed a footfall of over 500 people that included men, women and children of all ages and reasserted the bonding between Army and people," he added. Expressing concern over delay in restoration works of the damaged infrastructure due to incessant rains and flash floods, National Conference district president, Ramban, Sajjad Shaheen said that insensitive approach of the PDP-BJP dis- pensation has accumulated peo- ples’ problems during the past over two and half years. Interacting with mourners at the residence of Bashir Ahmed, a driver at village Hingni, who washed away in flash floods caused due to heavy cloud burst, and whose body is yet to be recovered, the NC district presi- dent urged the local administra- tion, especially the police to expedite efforts in recovering the body. Shaheen sought immediate ex-gratia relief for the bereaved family and compensation to the damages caused due to cloud burst. He hoped that the authori- ties would do the needful under Natural Disaster Relief Fund earnestly. Shaheen seeks ex gratia for family of man killed in flash floods Retd non-gazetted police personnel highlight demands Excelsior Correspondent SAMBA, May 20: Non- Gazetted Police Pensioners’ Welfare Forum today highlight- ed their demands during a meet- ing held here at Vijaypur Block office under the chairmanship of Forum chairman, Ajit Singh. Addressing the meeting, Ajit Singh said that Government is giving the effect of its Order No 229-F of 2014 dated 7-10-2014 regarding pay anomaly, from the date of order though the effect should be given from the year 1996 when fifth Pay Commission was implemented throughout the State leaving only police department. He criticized the Government and the Police Department for ignoring the just and genuine demand of the poor police pensioners, stating that since the Forum launched their struggle to get their rights, Government is constituting committee after committee but doing nothing to redress the issue. Singh said that first pay anomaly committee was formed in the year 2009, another was constituted on September 2011 and the third one was formed on April 2016. He said that the Forum wants that like previous two committees, the third one should not be time killing. “As such we want to know the time frame because the issue is lin- gering on from last 20 years”, he added. Elderly man killed in road mishap Excelsior Correspondent JAMMU, May 20: An old man was killed today in a road mishap here in Parade area of city. According to a police spokesman, the man identified as Darshan Bajaj (78) son of late Daulat Ram, House No 535, Sector No 3, Karnal Colony (Bohri), sustained serious injuries this afternoon when a scooty number JK02AU-8456 on which he was travelling, was hit by a CRPF vehicle (Swaraj Mazda) bearing registration number HR68-2044 near main gate of Parade Ground. In a pool of blood, the injured man was immediately rushed to Government Medical College and Hospital, Jammu, where he was declared as brought dead by the doctors. After completing all medico- legal formalities, the body of the deceased was handed over to his legal heirs for last rites. In this connection, a case FIR No 63/2017 under Section 279/337 was registered at police station Pacca Danga and the accused driver arrested. The CRPF vehicle involved in the mishap was also seized. 3 injured in road accidents Excelsior Correspondent SAMBA, May 20: Three persons were injured in road accidents, here today. As per police sources, Ashok Kumar, son of Sansar Chand of Ward Number 13 was injured when his motorcycle was hit by a Maruti car at Sidco Chowk here, while Sohan Lal, son of Amar Nath of Ghagwal received injuries, when the motorcycle he was driving slipped near Chichi Mata tem- ple. In another incident, Naresh Massi, son of Payra Massi of Christian Colony Jammu got injured when an unknown vehicle hit him here. All the injured persons were shifted to District Hospital Samba, from where they were later referred to GMC Jammu for advanced treatment. Concerned police has taken cognizance in this regard. HC acquits two men accused of cop’s murder Excelsior Correspondent SRINAGAR, May 20: High Court while suspending the life sentence awarded by the trial court to two accused in murder of a constable directed the authorities to release them as prosecution has failed to reach out to the real culprit. Observing that the commit- ment to reach to the actual criminal was missing in the instant case, court directed Director General of Police to look into the matter and issue appropriate directions to all concerned police officers that the investigation of the case, when it pertains to a killing of a human being, is entrusted to a senior most skilled officer so as to reach to the actual criminal otherwise faith of the people in the system is getting eroded. Giving the benefit of doubt on the assumption of contradic- tory statement of witnesses the Division Bench of Justice Mohammad Yaqoob Mir and Justice D S Thakur allowed the appeal challenging order of conviction and acquitted both accused from the charges of murder. Three gunmen namely namely Shabir Ahmad Bhat S/o Mohammad Abdullah Bhat R/o Marathgam, Mushtaq Ahmad Malla alias Furqan S/o Ghulam Ahmad R/o Shatgund and Mushtaq Ahmad Ganai S/o Ghulam Hassan Ganai R/o Manchanpora Panzla entered into the house of deceased Abdul Gaffar Mir working in the Police Department at Srinagar as Senior Grade Constable and fired upon from the illegal weapons resulting into his death. On the basis of material col- lected, accused were estab- lished to have committed the offences under Section 302 RPC and 7/27 Arms Act. During investigation accused Shabir Ahmad Bhat was arrest- ed, accused Mushtaq Ahmad Malla alias Furqan had been detained under Public Safety Ac, who is also involved in case FIR No.27/2008 P/S Handwara for commission of offences punishable under Section 307 RPC, 7/25 Arms Act, 20 UL Act and 2/3 E&IMCO whereas other accused namely Mushtaq Ahmad Ganai is absconding. The detained accused per- sons have been held guilty and convicted for commission of offence punishable under Section 302 RPC by the trial court and have been sentenced to imprisonment for life. On failure of prosecution to reach to the culprit, court said, every Investigating Officer has played his own role in his own way least realizing that they have failed to arrive at the real culprit. "The Investigating Officers are the architects of the case. They should have dis- charged their duties with com- mitment which they have not", court observed. Court on acquittal of two accused said, that it is a funda- mental principle of criminal jurisprudence that an 'accused is presumed to be innocent' and therefore the burden lies on the prosecution to prove the guilt of the accused beyond reasonable doubt, adding with when identi- ty of the terrorists who killed the deceased has absolutely become doubtful, how convic- tion could be recorded against the accused persons. After accident body abandoned in hospital Excelsior Correspondent MENDHAR, May 20: The dead body of an unclaimed male accident victim, is lying in the mortuary of Sub District Hospital, Mendhar. Official sources said that two persons in a Maruti Van came to SDH Mendhar in the afternoon and they kept quietly the dead body of a middle aged man in the Emergency unit and escaped. The Medical staff later came to know about the matter and informed BMO Mendhar. Then they called police. There was a Police Post in the Hospital complex but the cops there also remained unaware of the matter. The police later registered a case and started investigation. The SDPO Mendhar Riaz Tantray has taken serious note of the issue and directed the SHO to investigate the matter and identify the people involved in accident. The deceased seems to be non-local. His body was lying in the mortuary of the SDH Mendhar. People protest, block road Excelsior Correspondent MENDHAR, May 20: The people held protest demonstra- tion and blocked Mendhar- Jammu road for about two hours demanding closure of local bar here today. A large number of people from the area led by head priest of Ari mosque, came out on the road and started protest demon- stration at main chowk in Mendhar town at around 2 pm. They blocked the road and raised slogans against District Administration and Excise Department. The protesters demanded that local bar be closed. Later, SDPO Mendhar and SHO reached the spot and assured the people that action will be taken in this regard. The agitating people then lifted dharna after two hours. Fares of Tejas train 20 per cent more than Shatabdi NEW DELHI, May 20: Fares of Tejas Express train will be 20 per cent more than that of the Shatabdi Express. Equipped with modern facil- ities such as CCTV cameras and smoke-and-fire detection sys- tem, Tejas Express will be flagged off from Mumbai for Goa on May 22 by Railway Minister Suresh Prabhu. Unlike the Shatabdi Express, passengers will have the option to opt for onboard food. If a pas- senger opts for food while buy- ing ticket, the catering charge will be included in the fare. There is an increase of more than 20 per cent in the base fare for Tejas as against the Shatabdi, said a railway ministry official. The superfast surcharge, reservation fee and catering charges will be levied separate- ly. The Executive Class fare in Tejas has been fixed at Rs 2,540 without food and Rs 2,940 with food. The Chair Car fare Rs 1,850 with food and Rs 1,220 without food. The Shatabdi fares are Rs 2,390 and Rs 1,185 in EC and CC respectively which include food also. Since the train is equipped with better facilities, the fare will also be slightly higher as compared to normal mail/express service, Prabhu had said while inspecting the new Tejas coaches on Friday here. Equipped with CCTV cam- eras besides smoke and fire detection system, the 19-coach Tejas train will have bio- vacu- um toilets and GPS-based pas- senger information display sys- tem. There will be comfortable seating arrangements and each seat will have LED TV with touch control system and call bell facilities. Manufactured at the Rail Coach Factory in Kapurthala, the coaches will have automatic entrance door, a first in non- suburban train in the Indian Railways. Promised in the budget, Tejas Express will also be pressed into service in Delhi- Chandigarh and Delhi-Lucknow sectors soon. The appeals were made by the representatives of ADCSF including Ravi Singh Bhau (president), Sukhbir Singh (gen- eral secretary), Ravi Sharma, Nazir Bhatt, Umar Jan and Yash Pal Sharma, during their visits to various office complexes includ- ing Industries Complex Panama Chowk, PWD, Sheep and Wool, PDD, Deputy Commissioner's Office and Irrigation Complex, where they held meetings with clerical cadre. While addressing the meet- ings, Ravi Singh Bhau con- demned the anti-employees poli- cies of the State Government which vide various agreements carried out between the repre- sentatives of Association and the State Government authorities have failed to implement the agreements regarding removal of pay anomaly of clerical cadre. Bahu appealed Chief Minister Mehbooba Mufti to intervene into the matter so that the order for removal of pay anomalies of the cadre issued. Bodies of both the deceasedhave been shifted to DistrictHospital Samba and after com-pleting legal formalities, hand-ed over to family members forlast rites.

Thepunishment for offense underSection 302 RPC is death or lifeimprisonment", adding "lifeimprisonment is rule and sen-tence of death is an exception".

With these observations,court dismissed the bail applica-tion.

In a veiled expression ofweariness with Pakistan formaking constant call for dia-logue without addressing thecore issue of cross-border ter-rorism, Minister of State forExternal Affairs MJ Akbar hassaid asking for peace talkscould be an excuse for avoidingreal peace and reflect a positionthat may be hypocritical.

“When anyone asks forpeace talks, it does not neces-sarily mean that that country isasking for peace. And one hasto measure that difference verycarefully,’’ Akbar said here lastevening launching a new jour-nal on international affairs,titled ‘’India and World’’.

“Do you want peace or doyou want peace talks as anexcuse for a position that maybe hypocritical? And our reac-tion will be based on the largerassessment of what you mean,’’said the Minister, without nam-ing Pakistan.

The Minister’s remarksacquire an added significancein view of the speculationabout a meeting between thePrime Ministers of India andPakistan on the sidelines of theSCO Summit in Astana in June,and they come a day after an

international court stayed theexecution of KulbhushanJadhav, a former Indian Navyofficer accused of spying.

Describing terrorism as thesingle most important threat tothe world, the Minister stressedthat India will continue to fightand defeat terrorism and terror-ists’ designs “to split pluralisticsocieties that have achievedinternal cohesion and peacethrough suspicion and fear.”

Dwelling on the theme of“Indian Diplomacy@2020:Power of India,” Akbar provid-ed a big-picture view of India’sforeign policy priorities andunderlined that the diplomaticdrive under Prime MinisterNarendra Modi has beengeared towards placing “Indiaand Indians First” in the coun-try’s multi-faceted diplomaticoutreach.

“When we discuss Indiandiplomacy, Indians come firstand diplomacy comes later. It isIndia First and it is IndiansFirst and therefore what servesthe national interest takes pri-ority,’’ Akbar said before anaudience of diplomats, aca-demics, experts and journalists.

Akbar said the search foreconomic growth and thesearch for India’s place at thehigh table of the 21st centurywould be the predominant urgeof the people of India. ‘’Andthis is the century when Indiawill find itself again after thepast gets blurred before thechallenges of the present andthe future.’’

In his address, the Ministerunderscored the rising globalprofile of India and the chang-ing narrative about India on theglobal stage by stressing thatthe world now needs an India-centric and India-specific poli-cy.

“India has always had aworld foreign policy. Now,large parts of the world have anIndia policy. And that Indiapolicy can’s be confined to aSouth Asia policy, or SoutheastAsia policy or an Asia policy.Now you have to find a way ofengaging with India which is

India-centric and India-specif-ic,’’ the MoS said.

Ahead of the third anniver-sary of the NDA Government,the Minister struck an upbeatnote saying that in the pastthree years, with the impetusgiven by Prime Minister Modi,India had expanded the horizonof its engagement very vastlywith the world and those partsof the world which were off theradar, have been brought in.

‘’India’s expandingengagement with the world hadnot attracted an adverse reac-tion because India’s engage-ment is benign, and not malign,based on treating every nationas a sovereign and equal part-ner,’’ he said.

Elderly man killed in road mishap

According to a policespokesman, the man identifiedas Darshan Bajaj (78) son of lateDaulat Ram, House No 535,Sector No 3, Karnal Colony(Bohri), sustained seriousinjuries this afternoon when ascooty number JK02AU-8456on which he was travelling, washit by a CRPF vehicle (SwarajMazda) bearing registrationnumber HR68-2044 near maingate of Parade Ground.

In a pool of blood, theinjured man was immediatelyrushed to Government MedicalCollege and Hospital, Jammu,where he was declared asbrought dead by the doctors.After completing all medico-legal formalities, the body of thedeceased was handed over to hislegal heirs for last rites.

In this connection, a caseFIR No 63/2017 under Section279/337 was registered at policestation Pacca Danga and theaccused driver arrested. TheCRPF vehicle involved in themishap was also seized.

As per police sources,Ashok Kumar, son of SansarChand of Ward Number 13 wasinjured when his motorcyclewas hit by a Maruti car at SidcoChowk here, while Sohan Lal,son of Amar Nath of Ghagwalreceived injuries, when themotorcycle he was drivingslipped near Chichi Mata tem-ple.

In another incident, NareshMassi, son of Payra Massi ofChristian Colony Jammu gotinjured when an unknownvehicle hit him here.

All the injured personswere shifted to DistrictHospital Samba, from wherethey were later referred toGMC Jammu for advancedtreatment.

HC acquits two menaccused of cop’s murder

The detained accused per-sons have been held guilty andconvicted for commission ofoffence punishable underSection 302 RPC by the trialcourt and have been sentencedto imprisonment for life.

On failure of prosecution toreach to the culprit, court said,every Investigating Officer hasplayed his own role in his ownway least realizing that theyhave failed to arrive at the realculprit. "The InvestigatingOfficers are the architects of thecase. They should have dis-charged their duties with com-mitment which they have not",court observed.

Court on acquittal of twoaccused said, that it is a funda-mental principle of criminaljurisprudence that an 'accusedis presumed to be innocent' andtherefore the burden lies on theprosecution to prove the guilt ofthe accused beyond reasonabledoubt, adding with when identi-ty of the terrorists who killedthe deceased has absolutelybecome doubtful, how convic-tion could be recorded againstthe accused persons.

Official sources said thattwo persons in a Maruti Vancame to SDH Mendhar in theafternoon and they kept quietlythe dead body of a middle agedman in the Emergency unit andescaped. The Medical staff latercame to know about the matterand informed BMO Mendhar.Then they called police. Therewas a Police Post in the Hospitalcomplex but the cops there alsoremained unaware of the matter.The police later registered a caseand started investigation.

People protest, block road

A large number of peoplefrom the area led by head priestof Ari mosque, came out on theroad and started protest demon-stration at main chowk inMendhar town at around 2 pm.They blocked the road andraised slogans against DistrictAdministration and ExciseDepartment. Fares of Tejas train 20 percent more than ShatabdiNEW DELHI, May 20:

Fares of Tejas Express trainwill be 20 per cent more thanthat of the Shatabdi Express.

Equipped with modern facil-ities such as CCTV cameras andsmoke-and-fire detection sys-tem, Tejas Express will beflagged off from Mumbai forGoa on May 22 by RailwayMinister Suresh Prabhu.

Unlike the Shatabdi Express,passengers will have the optionto opt for onboard food. If a pas-senger opts for food while buy-ing ticket, the catering chargewill be included in the fare.

There is an increase of morethan 20 per cent in the base farefor Tejas as against the Shatabdi,said a railway ministry official.

The superfast surcharge,reservation fee and cateringcharges will be levied separate-ly.

The Executive Class fare inTejas has been fixed at Rs 2,540without food and Rs 2,940 withfood.

The Chair Car fare Rs 1,850with food and Rs 1,220 withoutfood.

The Shatabdi fares are Rs

2,390 and Rs 1,185 in EC andCC respectively which includefood also.

Since the train is equippedwith better facilities, the farewill also be slightly higher ascompared to normalmail/express service, Prabhuhad said while inspecting thenew Tejas coaches on Fridayhere.

Equipped with CCTV cam-eras besides smoke and firedetection system, the 19-coachTejas train will have bio- vacu-um toilets and GPS-based pas-senger information display sys-tem.

There will be comfortableseating arrangements and eachseat will have LED TV withtouch control system and callbell facilities.

Manufactured at the RailCoach Factory in Kapurthala,the coaches will have automaticentrance door, a first in non-suburban train in the IndianRailways.

Promised in the budget,Tejas Express will also bepressed into service in Delhi-Chandigarh and Delhi-Lucknowsectors soon. (PTI)
