AccessSMSF Establishment

Superannuation Fund (Self-Managed Super Funds)

• Arrange for the production of self managed superannuation trust deed

• If Appropriate; arrange for the replacement of the existing trust deed for

the SMSF with Superannuation Property Self manage superannuation trust

deed

• Open accounts for the SMSF with the bank and stockbroker nominated in

the Client’s Application

• Apply for the ABN and TFN as required on behalf of the Trustee

Trust deeds prepared by Gadens Brisbane are current for the purposes of

superannuation law and are prepared by solicitors who are available to liaise

with customers to address all queries regarding fund compliance and the

obligations of a fund trustee once a fund has been established.

Corporate Trustee

We will attend to the requirements set out in the Corporations Act 2001

including acting as the company’s registered agent with the Australian

Securities and Investments Commission, acting as the company’s registered

office, ensuring the company’s register is kept up to date, attending to the

company’s annual statement from the Australian Securities and Investments

Commission, attending to preparation of relevant solvency minutes and

general correspondence as required from time to time.

While we can arrange for your fund’s audit as part of the Access

Superannuation Property service, you can also choose for the audit to remain

Bare Trust - Limited recourse borrowing arrangement (LRBA)

Borrowing in a super fund is tricky business. Super funds need to satisfy the

legislative, tax office and lender requirements, as well as meet the stamp duty

exemptions for your local state revenue office. Plus you have to ensure you

don’t get caught out with CGT on the transfer of the property.

We provide peace of mind when it comes to borrowing to invest with your

super. Our team can carefully review each borrowing transaction, ensuring the

documentation you receive is compliant, not only with the S67A legislation, but

with the ATO and lender requirements.

Bare trust documents prepared by Gadens Brisbane are suitable for use by all

major financiers and include all necessary documents for the fund to evidence

compliance with the superannuation law in bare trust arrangements, while the

solicitors in the Gadens superannuation team are able to take calls from the

fund’s conveyancing solicitor to facilitate a smooth transaction for the fund.
