The Buffalo Bills are off to a 2-1 start this season, as of press time, ofcourse, so by the time you read this, the season may not be going as wellas it was in late September. But with the pending new ownership of theteam by the Buffalo Sabres owner and the promise to keep the teamwhere it is, the future appears bright for the team, the brightest since theJim Kelly-led days of the team. The AFC East is opening up some, withthe New England Patriots’ chokehold on the division loosening a littlemore as Tom Brady gets older. The Jets are well, the Jets, still, andMiami is getting better, yet nothing near the kind of team the Pats havebeen for more than a decade. The Bills have a chance in the next fewyears to be the power team in the east. If you attend the upcoming 20th annual N.Y.S. Highway & Public
Works Expo October 15 at the Americraft Center of Progress Buildingin the New York State Fairgrounds in Syracuse, N.Y., you’ll have thechance to see the Bills on us. For Brian (“Buster”) Hunt, it doesn’t get any better than this. He loveshis family. He loves the town where he has spent all of his 56 years. Heloves getting up every morning and doing his job as the public workscommissioner/highway superintendent for the town of Sand Lake and heloves building houses. Born and raised in this history-laden town, Brian graduated from
Averill Park High School in 1976.“After that I took every night course in accounting that Hudson Valley
Community College had to offer. I didn’t graduate. I didn’t matriculate.I was accredited but never put them all together. I didn’t get my degreebecause I was going to use it for my own business. I figured I’d take overfor my father. I thought I’d be an accountant.” That’s not how things played out. Instead he went to work for the
highway department and never looked back.Brian fondly remembers his first day. “December 4, 1976, was the first time I rode wing. The next summer
I started working part-time. I did that for two years without committingto it. I’d help my father before 7 o’clock. Then I’d work here until 3:30go back to work for him until around 7 at night before working on my
own stuff. We both kept that up until he sold out in 1984.“When I left here the first time, I went to work insulating houses with
my father. I did that for a year and half or so before going to work for aKevin Kronau, a local builder. The department hired me back in 1982when one of the old equipment operators retired. I officially came backin January 1983. My brother Joel was the public workscommissioner/highway superintendent. I became his foreman/deputy in1990. After that I served as Larry Browe’s deputy so by the time I got inthis seat I’d been deputy for about 18 years.”Taking over the helm as commissioner of public works and the high-
way superintendent was a natural progression for Brian. “I'd been deputy long enough. Now I’m trying to be here long enough
to give everybody who’s interested a shot at it. It’s an appointed position.My current two-year term ends in December 2015. I need to do aboutfour more years. If they don’t reappoint me, I’ll try and get back in theworkforce and just keep going for another four years. We kind of workedthat out but nothing’s carved in stone.”Brian and his wife, Diane, have three children between them. “My daughter, Kassandra, lives next door to us with her two children,
Griffin, 8, and Lilianna, 6. My son, Jeremy, just started with the villageof Nassau Highway Department. He has one son, 10-month-old Alex.

My wife has one daughter, Kristina.”Married for eight years, the couple shares a love of motorcycles and
ride whenever and wherever they can. Diane also gets an up close andpersonal look at her man and how he does his job. “My husband lives and breathes this kind of work. He grew up with
it. It’s in his blood. He also grew up in this town, so it holds a specialplace in his heart; a trait you don’t find with everyone. Do I enjoy thecalls in the middle of the night? No. Do I enjoy being left alone duringa crazy snowstorm? No. But that’s his job and he never complains aboutit.”In his spare time, Brian prides himself in being a recovering worka-
holic who has relapsed. “I own 40 acres of land and I’m in the process of building a house out
of insulated concrete forms. I bought a farmhouse in 1986 and remod-eled it and I helped my father build his house. This one might be mylast.”A member of the Rensselaer County Highway Association, Brian
hopes to raise animals again and add a barn to his new digs when hehangs up his superintendent’s hat.
The JobThe town of Sand Lake’s original highway garage dates back to 1933.
The 60-by-60 building that houses the department today was built in themid-1960s, early 1970s by Brian’s father. “They built the salt shed in 1989. It holds about 400 tons of salt and
probably 400 tons of mix (three parts sand to one part salt). Then in 1996they added a mechanic’s bay (50 by 80) and a storage area. Total for theshed was about 230 feet long by 80 feet wide. That’s where we store ourtandems and equipment; just about anything you can think of. There arefive doors in the open area so you can pull in different angles. We tookthe walls out and combined all the offices into one. It’s starting to showits age and what salt and equipment does to it.”

The town also has a transfer station at the old landfill. For an annualcost of $25, residents can dispose of everything from waste oil and elec-tronics to scrap metal, paint, brush and grass clippings.As highway superintendent Brian is responsible for maintaining the
town’s 85.16 miles of road or 151 center lane miles. All but one mile ofthose is hardtop. Three small roads still have not have asphalt applieddue to their size and lack of thru traffic. “The remaining roads are all hardtop. Ninety percent of them are a
combination of Cationic Asphalt and sand mix blended at the town mine.It’s laid down with a paver or grader and then we apply a chip seal as atop wear surface. The remaining 10 percent are blacktop, which we nor-mally apply to the smaller dead-end streets.All that translates into seven plowing routes that take about four and
a half hours to complete. “This winter was one of the most constant. It was always here. The
guys were talking about only having two weekends off from Octoberuntil Christmas. It just didn’t stop.”This past winter also took a toll on the roads. “The state and county roads were breaking up like crazy, but our
CHIPS seal held up well.” Together, Brian and 12 full-time and two part-time employees serve
the town’s 8,900 residents. His staff includes Deputy CommissionerHighways Bill Rohl; Deputy Commissioner Sewer Ray Hernick;Dispatch/Foreman Joel Hunt; MEOH (Highway) Mike Steinburg;MEOH (Sewer) Gary Meissner; Mechanic (Highway) Bruce Wicks;MEOL (Highway) Kevin Rifenburgh, Mark Petrone, Josh Bucci, BillFrench and Jason Grignon; and MEOL (Sewer) Don Corellis. Part-timers are Bob Martin (first public works commissioner) and DylanDensmore (college student).When it comes to his crew, “There’s not a better group of people.
When I say something needs to be done, they do it. They get going anddo it. Not everyone agrees all the time. I tell them they can each havetheir own individual quirk as long as they don’t all develop the sameone.”This time of year the men are busy preparing the town’s roads. “First we determine which ones are the worst. Then we cut the ditch-
es and make sure the pipes are okay. We let them settle in before we gothrough and mix our own shim material. We’ll screen sand then have oneof the locals, like Gorman or Peckham, mix it with asphalt. The guys willgo out with a paver or grader and skim it or level it up. Now the roadsare all fine patched and we can lay down the oil and stone.”Under Brian’s guidance, the Sand Lake highway department runs on
a total operating budget of $1,586,000 that includes salaries and benefitsfor employees and an annual CHIPS allocation of $166,000.To perform its duties, the town uses a convoy of equipment that

responsible for basic maintenance. You have a plow truck. If somethinghappens to it and you can’t fix it, you go to Bruce. It doesn’t really playout that way in the summer because we’re doing so many differentthings.”
Brian admits that while today’s technology-driven equipment is moreconvenient and luxurious, when it breaks down it’s not an easy fix.
“Now electronics are involved so if the hydraulics don’t work it does-n’t mean the pump’s bad. It might mean a celluloid is bad. Before youhad a control you could feel and do something with. Now you push but-tons.”
On the upside, “They’re more comfortable [thanks to] cushioned airseats, better ergonomics and air conditioning. They’re also more user-friendly and don’t punish your body.”
With increasingly higher price tags, how does Brian budget for newequipment?
“Usually I cry to the town board,” he chuckled. “We put it in ourbudget and they usually take it out. We have old equipment. There aresome things we buy used, but we try and buy our trucks new becausethey’re needed. The department has 35 pieces so you can’t always havenew. There’s always a need for equipment. We could use a screen forscreening our salt sand. We had an opportunity 10 years ago to buy onefor $32,000, but the town board said no. We had rented that samemachine every year. It would have been paid for and then some. Wedon’t even have an excavator. In this day and age that’s unheard of. Anyhome improvement contractor has one. Here we are saying wouldn’t itbe nice but you can’t plow a street with an excavator.”
Equipment isn’t the only thing that technology has impacted. It’schanged the way the highway department does its job.
“Now you have e-mail, fax machines, computers, cell phones, instantweather reports at your fingertips. It’s all tied together. There’s no waythat sooner or later someone can’t reach you. Good or bad.”
Brian and his men also are responsible for the town’s park and beach,three cemeteries and seven bridges.
“The town of Nassau just put a sewer extension off of ours so now wetake care of about 140 of their sewers’ pumping stations. We flush linesand maintain seven pumping stations. We keep busy. There’s never adull moment.”
Reflecting back on his time as highway superintendent thus far, oneday stands out: December 12, 2013. Brian emotionally recalled the dayhis neighbor’s horse barn caught fire.
“I was at Stewart’s when they told me Keith Meissner’s barn was onfire. I got past my house and I’m about 1,200 feet away and I could seethe whole side was transparent. Being winter, I knew the fire departmentwas going to need sanders and stuff so I called in two guys. It wasn’t ahalf-hour later when Gary, who works for us, called and said his broth-er was lost in the fire. I had to go over there with a backhoe and try andfind him. That was the worst. Not just because I knew him but his broth-er works with us. It was like family.”

Brian believes that emergencies, such as the fire, are the most impor-tant part of the job. “You’re there for the storms. You’re there for the floods and the fires.
You’re there when people need you. A lot of times when I know it’s start-ing to get bad I’ll come in and make sure no one’s called. It’s trying tokeep a little bit ahead. If I can do that, I’m good.”As he looks to the future, Brian is focusing on moving ahead. “You have to make sure you get enough support behind you from
your town board to get the equipment or money or budget you need tokeep moving forward. You can’t get complacent. You have to keepthinking about the next step. That’s pretty much what I’m doing here.”When it’s all said and done Brian wants to be remembered as “the guy
with a smile on his face. I don’t have big aspirations. At the end of theday, no matter what it is, you did what you could to help somebody.”What more could the townspeople ask for?
How the Town BeganThe town of Sand Lake has a rich history behind its humble begin-
nings of development and growth. In early 1994, a working committeebegan a research study into its early development and growth. The aimwas to trace the division of the Manor of Rensselaerwyck as it was divid-ed into the many towns of today's Rensselaer County.
Development of the Town of Sand Lake
The boundaries of the town of Sand Lake, as known today, are theresult of many divisions and subdivisions over the years. When HenryHudson sailed up the river that would bear his name, the land was awilderness, occupied by a few Indians.The Manor of Rensselaerwyck was established in 1629, when Kiliaen
Van Rensselaer, a wealthy director of the Dutch West India Company,received a land grant from the West India Co., to establish a colony. Thisgrant, which was establishing a colony in the new world, included landon both sides of the Hudson River, between Berrent Island on the south
and Cohoes on the north. The territory was 24 miles long and 48 mileswide, contained about 700,000 acres and constituted a patroonship. The colony was under Dutch control until 1664, when the English
took possession, only to lose control in 1672. In 1674, the English againregained control and was the ruling government until the RevolutionaryWar. Under the English, the area was known as the Province of NewYork and was a colony of England.
The Town
By an act of the legislature on March 21, 1812, the towns ofGreenbush and Berlin were divided to form three towns: Greenbush, thenew town of Sand Lake and Berlin. This division took effect on March1, 1813, so that is the town of Sand Lake’s true birthday. The first townmeeting was held at the dwelling house of Thomas Thompson, the

Thompson; Town Clerk, David E. Gregory; Assessors, Lawrence VanAlstyne, John Clint and Ezra Newton; Commissioners of Highways,John Stevens, John North and Jacob Boyce; Overseers of the Poor,Stephen Gregory, Lewis Bullock; Collectors, Jonathan Ford and HenryLord and School Commissioners Aretus Lyman, Joel Bristol and EllisForster. What happened along the border of Greenbush and Sand Lake is not
certain but in 1843, a very short Act of Legislature simply stated: “Allthat part of the Town of Sand Lake in the County of Rensselaer, onwhich the dwelling house of Andrew L. Weatherwax now stands, shallbe annexed to, and form a part of, the Town of Greenbush.”On March 2, 1848, the town of Sand Lake was divided into Sand
Lake and Poestenkill. This final division created the town of Sand Lake’sboundaries as we know them today. On Monday proceeding the firstTuesday in April 1848, the first meeting of the newly-formed Town washeld at the house of Calvin Sliter.
Government
The counties were governed by a board of supervisors. Each townwould elect a supervisor to represent its citizens on the county board.This board had the power to collect taxes and distribute monies to thetowns.Initially, the towns had little power. In 1901, town government in the
state assumed more definitive form. The state legislature established ajudiciary system. Provision was made for assessing and collecting taxes.The settlement and relief of the poor; the regulation of highways; estab-lishing the power of town meetings; and defining the duties of town offi-cers. Town meetings were held in private homes and inns. It wasn’t until1972 when the former Presbyterian Church was obtained and trans-formed into the town hall, that a regular meeting hall became available.County government was the primary form of local control. Each town
elected a supervisor to represent the town at the meetings of the countyboard supervisors. The board was the legislative body for making the
county’s laws and ordinances and raising money to cover the cost ofoperation. These monies were distributed to each town in accordance toneeds.In 1964, the state legislature enacted the Municipal Home Rule Law,
greatly extending the powers of each town. As a result, in 1968Rensselaer County revised its form of government. The board of super-visors was dissolved. In its place, a county executive and a county leg-islature was formed.Until this time, the town of Sand Lake was governed by a supervisor,
four justices of the peace with voting rights and a town clerk. With thechange, the town legislature was made up of a supervisor and four coun-cilmen as voting members. A town clerk and two justices were also elec-tive positions. The office of justice of the peace was changed to town jus-tice.As of the 2010 census there were 10,135 people, 3,009 households
and 2,229 families residing in the town. The population density was226.9 people per square mile and 3,277 housing units at an average den-sity of 93.1 per square mile. P

Diesel Particulate filters (DPF’s) are designed to remove particulate matter in dieselexhaust. In a correctly operating vehicle, soot captured in the DPF is periodicallyburned during normal operation. Buying heavy equipment and trucks in New York State through astatewide contract system became a giant headache for local jurisdic-tions in 2011 after the state comptroller objected to the bidding process.Almost every party involved in the equipment transactions regretted —and still regrets — the decision.“It wasn’t broken before. That’s how we see it,” said Martin Roberts,
highway superintendent of the town of Reading, and president of theNew York State Association of Town Superintendents of Highways. Hebrings to the conversation 37 years of highway department experience,15 of them as superintendent, and like many others disagreed with thecomptroller. “If you needed a truck, you found the truck you wanted, added
options, and sent a purchase order,” he recalled. “Every aspect of theorder was bid. But then we were told, ‘Wait, you’re not getting the bestprice.’ Well, I think that if something works, you don’t try to fix it.”The town superintendents association has been deeply involved in
trying to rectify the situation, which still is discussed regularly in boardmeetings, according to Roberts. Association representatives sit on thesteering committee of the Office of General Services, which oversees theprocurement process, but Roberts said the organization has gleaned noextra insight as a consequence. “I can tell you right now we don’t know any more now than we did
three years ago,” Roberts said. “People who sit in the meetings have toldus not to plan on a new system, not to wait on it, because you’ll run outof equipment before you ever get this done.”To say the state’s heavy equipment procurement system is in turmoil
doesn’t overstate the matter. Equipment and truck vendors, officials inlocal jurisdictions, and even staffers in the Office of General Services(OGS) are either mystified by what is going on or are unable to clearlysay how and when it might be resolved.When the office of Comptroller Thomas DiNapoli concluded that the
old contract system — which had been used for at least 20 years — wasinconsistent in awarding contracts, the OGS dutifully responded andbegan posting contracts that addressed the comptroller’s concerns.Terms of the new contracts essentially were simpler — and less usefulto public entity buyers scattered around the state. In the case of trucks, tossed out was the old way of offering optional
features and fittings — such as a manual or automatic transmission.Options were eliminated in favor of offering one vendor and one modeloutfitted one way that was deemed suitable for everyone. That was con-sidered more cost-effective and fair to taxpayers who ultimately pay forthe trucks.However, this approach made it difficult for a local government buyer
to buy and equip a truck comparable to trucks in its existing fleet. Havingcommon features in a fleet is a practical consideration when employeesare apt to be assigned to operate any of the trucks on a given day.Furthermore, this one-size-fits-all approach glossed over the fact thatsnow accumulations, traffic volume, and other usage factors are muchdifferent on, say, Long Island than in the Finger Lakes region of the state.More disconcerting yet was that heavy equipment and truck contracts
appeared only irregularly on the OGS site. While trucks apparently faredbetter in this respect, heavy equipment contracts were posted intermit-tently — and the contracts sometimes were allowed to expire with noth-ing posted in their place. This is significant because municipalities con-stitute a sizeable share of the heavy equipment market in New York;wheel loaders, for example, are heavily employed in moving both aggre-gate materials and snow. The underlying problem for local jurisdictions — that is, townships,
school districts, fire departments and the like — is that without access toa single statewide general contract negotiated on behalf of a broad baseof buyers, local buyers are placed at a disadvantage. A single buyer sim-ply lacks the competitive clout to win discounts from a vendor. Bulkbuying is where the deals are. A town that goes it alone almost assured-ly pays more for, say, a heavy truck than it would if it bought the truckin a package deal with other towns.In addition, the bidding process itself is time-consuming and a burden
for small public entities, which generally lack a staff member with pro-curement credentials. “First, you have to put a spec together, and that ischallenging in itself,” said Timothy Hens, superintendent of theGenessee County highway department and president of the New YorkState County Highway Superintendents Association. “There is a lot of complexity involved, and you have to be fairly
astute just to write the specs,” he said. “Then you have to advertise it ina certain way, receive and open bids, take it to the board — there are 20or 30 hours involved at least, often more. And usually there is not a qual-ified staff person to do the work so the superintendent is left to do italone.”Hens said he has “seen a substantial change in OGS over the last 16
years. It used to carry bids for just about everything and counties andtowns could rely on getting top-notch pricing based on the OGS vol-umes. Now OGS awards very little that benefits towns and counties, andmany counties are left fending for themselves in securing vehicle andequipment bids. I can tell you that not having OGS-based contracts forheavy equipment impacts counties and towns in many ways.”Vendors — the people on the selling side of state contracts — were
no more pleased than buyers with the contract changes. Dave Pyfrom,commercial account manager at Beam Mack Sales & Service, said heand his peers didn’t understand why the system needed altering. “We didn’t want the old OGS contract system to end. It worked for
everyone. As customer and vendor, it worked great. Everyone waspleased. It changed everything and I don’t know if it’s working betternow,” Pyfrom said. “Even the state people at DOT I work with on a dailybasis, they don’t know what’s going on. The OGS is keeping it underwraps, for whatever reason.”The Office of General Services indeed is close-mouthed. The
agency’s public affairs office was not willing to have anyone be inter-viewed for this article, but PA officer Heather Groll agreed to e-mailresponses to submitted questions. Groll said state contracts exist to “pro-vide the best value for taxpayers” and the old contracting method fellshort in that criterion.In respect to trucks, the public affairs office said past contracts in the
heavy-duty truck area “were structured so purchasers could buy a basemodel from a number of companies and manufacturers and, under thecontract, add customizations/up-fits they felt they needed. While therewere benefits to this procurement method, it also presented challengesfrom a competitive bidding standpoint when some contractors offeredconfigured trucks that were available at a lower price from companiesnot awarded.”The conclusion was that “this model was no longer sustainable, and
necessitated consultation with contract users. This consultation resultedin some recommendations scheduled to be implemented in the nextphase of our Auto Marketplace. While the timing of this solicitation isnot as we had hoped, we have communicated this through our everydaydiscussions with municipalities so they could utilize other available pur-chasing options.”OGS concedes there was a “minimal contract lapse” of about a month

heavy equipment contracts, and two additional contracts will be signedin the next couple of weeks, with more to follow as the solicitationpaperwork is approved.” Interestingly, OGS said these contracts will feature multiple manufac-
turers and “all available models and many different options to satisfy theneeds of multiple jurisdictions.” That sounds a lot like the framework of the old contracts, which might
leave some to wonder why the old system was scrapped.
A Substitute SystemThe Office of General Services in New York State, which has
presided over a meltdown in state contracting for heavy equipment andheavy trucks, was declared in 2006 to be a national role model in pro-curement. The OGS was awarded the NY Citizens Budget Commission “Prize
for Public Service Innovation.” The award was for the agency’s formingof a state task force to help first-responder organizations in the state winsteep procurement discounts for Homeland Security items. That was then. Today, no prizes are expected to be awarded the
agency for its reworking of the state’s central contract system for heavyequipment. “As far as I am concerned, the new system has failed miserably,” said
Richard Walters, former superintendent of highways for the town ofOnondaga and former president of the town highway superintendentsassociation. “For the procurement of heavy equipment and heavy trucks,things are getting worse. I hear the people at OGS who were in chargeof procurement of heavy equipment in the state have been moved outand new people brought in.”Such a shuffling of OGS personnel was not confirmed, but then a lot
of the behind-the-scenes activity cannot be nailed down. Certainly OGSitself is not operating with notable transparency. One of the biggest frus-trations expressed by local government officials is not being able to getstraight answers about why the state system was changed, what the newsystem will look like, and when it will be in place.This much is clear: The old system ran afoul of the state comptroller’s
office — which is a busy office. In Fiscal Year 2013-14, the officereviewed some 24,700 transactions totaling $84 billion. Comptrollerstaffers know the ins and outs of contracts and have developed a set ofcriteria that determine if a contract passes muster. Three years ago, anOGS contract for heavy equipment didn’t pass.It was rejected for being inconsistent in its evaluation process. In other
words, the contract’s selection of vendors and products was consideredto be unfair and not in the best interests of taxpayers. An official in thecomptroller’s office, who agreed to talk about the situation on back-ground, said the objection was significant because a comptroller’s cen-tral purpose in any contract review is determining if bidding is fair andimpartial.Then, one year after the comptroller’s formal objection to the con-
tract, the legislature enacted a statutory change that freed GeneralServices from comptroller oversight in some specialty contracts, includ-ing heavy equipment. The structural change was said to be part of Gov.Andrew Cuomo’s effort to speed up the contract approval process and todevelop a central procurement entity in OGS. So in essence, OGS was told that it was contracting heavy equipment
in an unacceptable way — and then was given free rein to fix the situa-tion. When the comptroller’s office gets calls now about the state heavyequipment contract, it refers callers to the newly empowered OGS. Thebuck clearly stops with the Office of General Services, and its perform-ance to date has been widely panned. “They [OGS officials] are not standing in our shoes and have no idea
what we are doing,” said Martin Roberts, highway superintendent of thetown of Reading, and president of the New York State Association ofTown Superintendents of Highways. “We are open to new ideas, but youhave to have a new idea to present before doing away with the old one.We were told to quit doing it [contracting] the way we were doing it andwe asked, well, how do we do it? Well, they said, we don’t know yet, butquit doing it that way.”Roberts said his “frustration” with the situation has largely dissipated
because the association simply went around the OGS. It lobbied the leg-islature “long and hard” and finally got a piggyback contracting systemin place. “We simply circumvented the OGS because it didn’t work.”Essentially, the piggyback system decentralizes bidding for heavy
equipment and trucks. Towns and other local jurisdictional units areallowed to buy using approved county contracts and thereby receive vol-ume cost benefits similar to what they used to receive from state con-tracts. The statute subsequently was broadened to let local units collab-orate on any approved county contract, not just that of their home coun-ty.“The good news is there are a number of county purchasing depart-
ments that have gone to the expense and labor to bid the items that weas municipalities use on a daily basis,” Roberts says. “In the piggyback-ing legislation that we and the county superintendents fought for sovehemently, first being approved and then extended, we now haveanother avenue for procurement.”It works for most everyone. Sean Roche handles municipal sales at
the Arkel Motors Navistar International truck dealership in NewWindsor. He believes three quarters of municipalities in New York nowuse the piggyback system to acquire new trucks. “It almost totallyreplaced the old system. People just got sick and tired of waiting for thestate and went around it.“The one issue we have run into,” he added, “is that some towns have
bylaws that don’t allow piggybacking at all, not outside the county inwhich they’re domiciled. One municipality bought on a contract andthen realized it had a bylaw saying it couldn’t.”Roche said in his opinion the state contract worked very well before
OGS started changing it. “But what we are doing now is working verywell, too.” The piggyback statute is locked in until 2019, though someofficials express concern that it will go by the boards when GeneralServices finally settles on a system.The downside of piggybacking is that a single county contract is not
apt to have the pricing-discount impact of a contract that encompassesan entire state. For several reasons, Timothy Hens, president of the NewYork State County Highway Superintendents Association, said, “decen-tralized bidding doesn’t make sense.”“Many small towns and even some rural counties don’t have the staff
in place to deal with specification writing and setting bid requirements.In addition, rural areas have limited options in terms of vendors.Statewide bidding by OGS used to eliminate these concerns.”What has developed in the absence of a functioning state contract for
heavy equipment, according to Hens, is a competition among countypurchasing departments to build more volume into their negotiated con-tracts. “So many counties have begun writing specifications that encour-age or allow piggybacking from municipalities, hoping to assemble an‘understood’ volume for vendors that will bring down the pricing.”In other cases, counties and towns have turned to national procure-
ment cooperatives — Hens mentioned the National Joint PowersAlliance and the U.S. Communities cooperative — “in the hopes ofavoiding altogether the administrative headache of bidding locally.” Infact, several national cooperatives offer competitive heavy equipment

contracts accessible by local jurisdictions in New York State. Allapproved cooperatives operate with the blessing of state officials.The state comptroller official who agreed to talk about the matter said
he doesn’t believe the office opened a can of worms when it spoke outagainst the contract. Rather, he said, the office did what it was supposedto do and now it is up to OGS to decide how to move forward.So how will General Services move forward, setting in place a new
system that works consistently for local governments? It has options.
Searching for SolutionsIn New York State, vendors of heavy equipment and trucks and local
government buyers are unhappy with the backed-up, stopgap system ofcontracts issued by the Office of General Services. Yet the tenor of com-ments coming from OGS suggests a level of contentment with theprocess.“The OGS procurement Web site is an ongoing work in progress and
was redesigned to make it easier for buyers, sellers and potential vendorsto understand the NYS procurement process” is how the public affairsoffice dismisses years of disruption in contract bidding. It might be dif-ficult to find a vendor or local government buyer who describes the newOGS system as “easier” and sees it as evidence of “progress.” But no one disputes that there has been change since the long-stand-
ing state contract essentially was shelved, and more change is coming.One new wrinkle that General Services is pleating into its system sort ofreverses state contracting and lets individual buyers solicit bids on light-duty vehicles. “The New York Auto Marketplace details a mini-bid process allow-
ing purchasers to put their specifications for purchase online and forapproved vendors to place a bid on that specific request,” an OGSspokesperson said. “We are currently considering expanding this con-tracting method to other vehicle categories, with the heavy duty truckcategory being the first scheduled for exploration.”Yet unless a gaggle of local buyers is allowed to collaborate and float
a common solicitation, this “mini-bid process” seems to hold less prom-ise of discounted pricing than is offered by a typical volume solicitation.In any event, the OGS is only exploring the matter and history suggeststhat could go on for years.In the meantime and absent definitive communication from OGS
itself, opinion and speculation about the state contract system hold sway.Some of the comment is foreboding, as in the concern expressed byDave Pyfrom that state contracts may become single-vendor.“I don’t know what will happen, but if one vendor gets a bid, you are
going to see a lot of bidding through individual accounts,” said the com-mercial account manager at Beam Mack Truck Sales & Service. “Andindividual bidding is a pain in the neck for the bidder and the biddingprocess. It saves so much work to do it through a state contract. I don’tknow why the state is doing what it’s doing.”Chuck Miller, construction division manager of Monroe Tractor Case
Construction in Rochester, said it probably isn’t fruitful to be talkingabout the situation at this point. But Miller goes on to voice concernabout the longevity of piggybacking. “A lot of municipalities are afraidof it because the state [OGS] has not formally approved it.”Be that as it may, he believes the future of contracting is in national
procurement cooperatives. “I think a cooperative will be the solution thatwill work.”National cooperatives definitely are part of the New York State con-
versation today. Whether one cooperative will be tapped as a preferredone is another matter. The president of the New York State Associationof Town Superintendents of Highways, Martin Roberts, said the associ-
ation has received word that the National Joint Powers Alliance willbecome part of the contracting system for the state. “If a town board canpiggyback off NJPA pricing, they can order off NJPA.”However, others have been assured that a rival cooperative, the
National Cooperative Purchasing Alliance, is the organization that OGSofficials are leaning toward as a solution to their problem. Neither theNCPA nor NJPA responded to inquiries about the possibility of a newworking relationship with New York State.Timothy Hens, president of the New York State County Highway
Superintendents Association, said he isn’t even aware of the speculationabout a preferred national cooperative. What he would like to see is“some kind of hybrid system. I like the flexibility to piggyback on fed-eral, state, or county contracts. It is awesome. Keep the piggyback asthey have it and have the state return to where they bid everything,including trucks and wheel loaders.”Hens recalled when the state system was more liberal in offering
options to local buyers. In fact, he says, sometimes there seemed to betoo many choices. “In the mid-2000s, you could choose from among 15different wheel loaders, and that was probably a little too free-wheeling.”What New York State has today is a competitive contract bidding
environment — if a thoroughly disordered one. Municipalities and otherlocal jurisdictions can piggyback on county, state or federal contracts,sort through offerings of national procurement cooperatives, and/or seekindependent bids. It is almost too much of a good thing.Things are simpler across the border in the Commonwealth of
Pennsylvania. There, procurement officials have taken another tack inaddressing the contract needs of local public entities. The PA state con-tract system is working smoothly, says Bruce Beardsley, marketing man-ager of the Pennsylvania Department of General Services. As proof, henoted that even though local jurisdictions and other public entities canpiggyback off any public contract that meets the state standard for com-petitive bids, most don’t.“Piggybacking rarely if ever happens here because in most cases they
are going to get what they want off the state contract, where they can geta better price,” Beardsley said. “Piggybacking by local units is rare.”A major reason that Pennsylvania state contracts meet local needs is
because the local units have two choices when they are shopping for, say,heavy-duty trucks: They can order from the general, competitive-bidstate contract, or they can work from a state contract that is the exclusiveuse of local governments and entities. The latter program is calledCOSTARS.COSTARS was legislated in 2005 after the state began to aggregate
procurement contracts for easier administration. Consequently, largercompanies and suppliers began to dominate the contracts. Smaller busi-nesses that got locked out of the bidding process lobbied for access tothe bidding process and COSTARS was the result. The program allowsvendors of any size to bid for business from local units (governments,school districts, fire departments, community colleges, nonprofits, etc.).“It is enormously popular,” Beardsley said. “It is a multiple vendor
contract awarded to all responsible suppliers, plus ancillary services ofcustomization so a local unit can negotiate and customize without limit.A local government can check and see who is on the contract and whatthey offer, pull up five or six suppliers, and negotiate the best deal. A ven-dor can’t charge any more than a stipulated ceiling price, but a lowerprice can be negotiated.”Beardsley said COSTARS is “pretty unique. Other states do call up
periodically and see if they can participate or learn how to develop a sim-ilar plan.” Back in New York State, all that can be said for certain is that the OGS
