SUPE RI OR C OURT FOR THE DI STRICT OF COLUMBIA CRI MINAL DIVISION UN IT ED S TATES vs LAMAR D HI CKS Oct. 12, 2019 On October 11, 2019, at about 1523 hours, Shotspotter technology alerted to the sound of a gunshot in the area of 1506 Good Hope Road SE, Washington, DC . At about 1526 hours, members of the Seventh District were di spatched to th e 1900 Blk 16th Street SE for a shooting. Members arr i ved on the scene and located the decedent suffering from a gunshot wound to the le ft side of his neck. The decedent was found slumped in a seated position in the door jam of a burgundy 4 door Chevy vehicle bearing DC tags FZ 9386. DCFD Medic 30 responded to the scene and transported the decedent to George Washington University Hosp ita l for advanced life-saving measures. Despite al l efforts, the decedent s ucc umbed to his injury and was pronounced dead at 1559 hours by Dr. Susan Kar tiko . The decedent's remains will be transported to the DC Office of the Chief Medical Examiner for a post - mortem examination. The decedent was identified as Johnathan L. On October 11, 2019, at about 1523 hours, Shotspotter technology alerted to the sound of a gunshot in the area of 1506 Good Hope Road SE, Washington, DC . At about 1526 hours, members of the Seventh District were d i spatched to the 1900 Blk 16th Street SE for a shooting. Members arri ved on the scene and located the decedent suffering from a gunshot wound to the left side of his neck. The decedent was found slumped in a seated position in the door jam of a burgundy 4 door Chevy vehicle bearing DC tags FZ 9386. DCFD Medic 30 responded to the scene and transported the decedent to George Washington University Hospital for advanced life-saving measures. Despite al l efforts, the decedent s uccumbed to his injury and was pronounced dead at 1559 hours by Dr. Susan Kartiko .

The decedent's remains will be transported to the DC Office of the Chief Medical Examiner for a post - mortem examination.

The decedent was identified as Johnathan L. Jones B/M (DOB 3/7/1989) of Cheltenham, Maryland. A WALES check confirmed the decedent is the sole owner of the burgundy 4 door Chevy vehicl e bearing DC tags FZ 9386.

Members of the Homicide Branch and a technician with the Department of Forensic Sciences (DFS) responded to the scene t o assume investigative responsibi l ity, recover evidence and document the scene . The technician photographed t he decedent's vehicle, seized the decedent's clothing and a ballistics fragment found in the 1900 block of 16th Street SE. The decedent's vehicle was towed to the garage at DFS for the processing of additional evidence .

A witness, hereinafter referred to as Witness One, called 911 for Police and medical assistance. Witness One provided the location of 1941 16th Street SE and advised the dispatcher that "someone shot in the head. " Witness One also provided a lookout for the suspect as a "B/M 6' 1 white t-shirt ... black sweat pants, long beard, carrying a black hand gun."

A second witness, hereinafter referred to as Witness Two, reported IT was on 16th

Street SE when IT observed a black 2 door sedan and the decedent's vehicl e stopped in front of Witness Two's vehicle. Wi tness Two could see that the driver ' s side door of the decedent's vehicl e was open a nd the decedent was out of the vehicle talki ng to the suspect . Wi tness Two could not hear what was being said but could tell that the decedent and the suspect were arguing based on their body language. The suspect seemed "upset . " Witness Two stated that IT obser ved the suspect holding a black semi -automatic handgun with an extended clip in his hand.

Witness Two further reported the suspect fired the handgun at the decedent. Witness Two described the injury as "when a water balloon explodes . " Witness Two called 911 and hung up when IT r ealized the suspect was looking right at IT as if to say "I see you ." Witness Two allowed det ectives to review ITs call history and a 911 call was made from Wi tness Two's cellphone at 1523 hours . The suspect fled towards t he laundromat parking lot and stopped to look in the d i rection of the decedent, as if to make sure that he (the decedent) was dead. The suspect t hen just wal ked away.

Witness Two described the suspect as a dark complexioned black male, dreads below his shoulder line wearing a whi t e t-shirt , black pants and a b l ack satche l wi t h gold chain links in the strap across his abdomen. Witness Two s t ated that IT has seen the suspect about three times in the area and, at least, 50 t i mes over the last two years while IT was in the a r ea of 16th Street, SE. Witness Two is regularly in the area of 16th Street, SE . Witness Two believes the suspect may sell narcotics because he regularly hangs out in the open-air drug market on t hat street. Witness Two stated that if IT was able to review photos that IT would be able to pick out the suspect as IT knows the suspect by his face.

A thir d witness, hereinaf ter referred t o as Witness Three , reported that the decedent drove up the road near the Anacostia Library and went down near the l aundr omat and liquor stor e. Wi t ness Three believed t hat t he decedent was i n a hurry because of the way that he was driving . Witness Three didn't believe that

he was driving recklessly, but the decedent had struck a curb and that could be considered reckless. Witness Three stated that the decedent, after hitting the curb, kept driving as if he was in a hurry . Witness Three observed the decedent stop the car because he was about to hit the suspect (who was in the street at the time) and then the decedent got out to look at his tire.

Witness Three reported that IT observed the suspect standing in front of the decedent's car and the suspect got in the decedent's face and said that he (the decedent) had almost hit him (the suspect). Witness Three stated that IT heard the decedent tel l the suspect that it was an accident. The suspect pulled out a handgun and shot the decedent in the neck. Witness Three further reported that after the s uspect shot the decedent, the suspect t ook off towards the laundry mat. Witness Three explained that IT tried to get a description of the suspect but that the suspect left the area and it was hard for IT to see because of where IT was in the vehicle. Witness Three stated that IT really couldn't get a description of the suspect because IT stayed where it was for fear of being shot by the suspect . Wi t ness Three described the suspect as a black male, dark skin , skinny, and around 25 years of age . Wi t ness Three stated that the suspect had a pointed beard and IT believed that he had a short haircut. Witness Three stated that i t did not see any distinctive markings on the suspect. Witness Three stated that IT believes t hat the suspect had a white tank top on. Witness Three stated that IT thought the suspect had a black automatic handgun but that it also didn't know much about guns.

A fourth wi tness, hereinafter referred to as Witness Four, reported that IT observed a black Dodge Charger pull up to the decedent's vehicle. A subject inside the black Dodge vehicle, shot the decedent.

This writer reports the Unity Laundromat located at 1603 Good Hope Road SE is a known area to purchase and use illegal narcotics, despite the efforts to quell t he activity by multipl e owners and l aw enforcement .

While canvassing the scene, detectives observed multiple surveillance cameras affixed to Union Liquors located 1537 Good Hope Road, SE and Tobacco Light Convenience Store located at 1517 Good Hope Road, SE. Detectives responded to the locations and reviewed the footage from 1519 hours until 1524 hours. The following is a descri ption of the events :

Camera One: 10 - 11 - 2019 Fri 15:20 :11 - a dark complexioned black male with shoulder length dreads wearing a white shi rt, black pants with a white stripe, and black and white shoes with a black bag across his chest is walking eastbound in the 1500 blk Good Hope Rd SE;

Camera Five: 10 - 11- 2019 Fri 15 :20 :15 - a dark complexi oned black male with shoulder length dreads wearing a white shirt, b l ack pants with a white stripe , and b l ack and white shoes with a black bag across his chest walks across 16th Street SE;

Camera Seven: 10 - 11 - 2019 Fri 15:20 : 37 - a dark complexioned black male with shoulder length dreads wearing a whi te shi rt, black pants with a whi te stripe, and black and white shoes with a black bag across his chest walks to the Unity Laundromat and walks around in the parking lot;

The decedent is standing at or near the driver side door. In this footage, the face of the dark complexioned black male with shoulder length dreads wearing a white shirt, black pants with a white stripe , and black and white shoes with a black bag across his chest is captured.

After r eviewing the footage, det ectives retained a footage clip of the video of the shooting, and obtained screenshots of the suspect and met with members of the Seventh District to attempt to obtain a tentative i dentification . A member of t he Seventh District viewed the footage and viewed t he scr eenshots o f the suspect and reported that the suspect f requented the 1400 Blk Good Hope Road SE. The

In regards to the statement provided by Witness Four about an occupant of the black Dodge vehicl e t hat was stopped behind the decedent's vehicle shooting the decedent , detectives further reviewed the surveillance video. This writer reports the black 4 door Dodge vehicle captured in surveillance footage from the Union Liquor s d r ove a r ound the decedent 's vehicl e after the suspect fled the scene. The black 4 door Dodge vehicl e did not pause or stop as it went around the decedent's vehicle . From this review of the footage, it appears that the decedent had alr eady been shot by t he time the black 4 door Dodge vehicle drove around the decedent's vehicle.

A member of the Homicide Branch created a nine (9) person photo array that consisted of Lamar Darius Hicks and eight (8) other qualifiers. A member of t he Homici de Br anch that was not i nvolved in t he i nvestigation and who had no knowledge of the suspect conducted the Photo Array procedure with Witness Two .

While at the Homicide Branch, Witness Two was shown the nine (9) person color photo array. Witness Two viewed the array, and chose the photograph in position number 4 as the suspect. When asked t o express a s tatement of confidence in ITs selection, Wi tness Two had stated that IT was "very confident."

observed Lamar Darius Hicks exiting a Metr obus at 14th & Good Hope Rd, SE. The member noted that the suspect was wearing the same clothing as IT had observed in survei llance footage earl i er, particul arly noting the same pants and shoes. Lamar Darius Hicks was s t opped inside of 1406 Good Hope Road SE and advised that detectives wanted to speak with him. Lamar Darius Hicks consented to being transported back to the Homicide Branch for an interview.

After Lamar Darius Hicks was stopped inside of 1406 Good Hope Road SE but before arriving at the Homicide Branch, Witness Two i denti fied Hicks' photograph as the suspect. When Lamar Darius Hicks arrived at the Homicide Branch, he was placed under arrest and told that he would be charged in the death of the decedent . Lamar Darius Hicks (hereinafter referred to as the defendant) was p l aced in an interview room and shackled at the ankle.

This writer interviewed t he defendant in regards t o the invest igation. The defendant was advised of his Miranda Rights and waived at 2223 hours. The defendant stated that he was in the area of 16th & Good Hope Road SE at the time of t he shooting but was not involved in the altercation or in the death of the decedent. The defendant stated that he came to the area to purchase cigarettes from an unknown male in a house behind the liquor store. The defendant stated that he was standing at t he front door o f that house when he heard a single gunshot. The unknown male told him to come inside for safety . A f ew seconds later he, the defendant, left the home o f the unknown male and walked back across the street towards the laundromat. The defendant stated he observed the decedent "slumped in the door of the car." The defendant stated that after he left 16th Street SE he walked back down Good Hope Road SE and hung out at 14th & Good Hope

The defendant stated that he returned to the area several hours later. The defendant got off a bus a t 14th & Good Hope Road SE and was stopped by t he Police.

This wr iter asked the defendant if he had on the same clothes all day and he stated yes. The defendant also provided the fact the he had been wearing a black bag across his chest earlier i n the day.

This writer reports that the defendant remained calm throughout the interview until it was pointed out to him that he was "freakishly calm" for someone that was being charged with murder. Shortly thereafter, the defendant became animated and began to adamantly deny that he ever possessed a firearm or killed anyone. The defendant was advised that the incident had been captured on surveillance video and was shown an image of him in t he area a t the time of the shooting. The defendant viewed the image and stated that it was him in the image . The defendant then demanded to view the footage. This writer determined that the defendant would not be shown the footage to protect the identity of the witnesses .

The defendant stated that he had nothing further t o say to detectives and that he didn't need a lawyer because he didn 't do anything. The defendant was charged with Second Degree Murder while Armed. While cataloguing the defendant's property, MPD members found a silver folding knife in his belongings.
