Dea.X'Mr. ]l:[nes:... ,\ At the hearing this morning Judge Hoffman set the
trial of our case over until May 16. Just prior to that he hada hearing on the antitrust case that precedes us and the trialof which he reset for May 15 advising counsel that it might notbe X'eached on that date oX' for some time thereafter.
This antitrust case is the one I refeX'red to previously.TheX'e is no hope of settlement. If it goes on trial it willtake somewhere between a week and five weeks, and we will maintainour place behind it. It is therefore most unlikely that we willget on tX'ial before June even if the antitrust case does starton the 15th.
Additionally, there are criminal cases on JudgeHoffman's docket which will take precedence over the antitrustcase as it is a civil suit and there is therefore the possibilitythat our case won't go to trial until fall.
All we can do is keep in touch with the cases aheadof us and from time to time will let you know what the situationis.

I didn't find anything particularly startling inthe Foundation's or JFD's trial briefs. There are a coupleof places where JFD gets a little sloppy and refers to thedevelopment of the log periodic'principle~bythe University.
With regard to the Blonder patent. JFD is placinga great deal of reliance on technical report TR 52. Do youhave a c,opy of this? We do not. I am sure I can get acopy from Pete Mann if they have an extra or at least borrow one so that it can be duplicated. Do you have copiesof the other pUblications listed in the notices from JFD?If you would like me to get them. let me lcn.ow.

Pete Mann called with regard to their possible use01' Bon Grant as a witness at the trial. The sole purpose 01'his testimony will be to identity some documentary records01' pertormance tests 01' Blonder-Tongue antennas. Grantsupervised the tests which were made at the JFB lab inChampaign. SOmeone else. probably Mayes. will testify regarding the meaning 01' the results. Pete wonders it youwill accept the test results without Grant IS testimony. Hesays that Mayes can testify with regard to the eqUipment andprocedures which were used. but that he did not direct thesespecific tests.
r am picking up today the depositions and trialtestimony of Lawler and Marjorie Johnson and possibly acopy of a Collins technical report. Bo you want me to sendyou copies of' all of' it or should I merely hold it until weget together?

Further, the conductors forming an impedance matching transformer bring the transmissionline connecting terminals toa point remote from "said one

Pete Mann has asked whether you will stipulatethat certain of the Blonder-Tongue antennas are representative of the entire line. He suggests that the Ranger 10and the Golden Dart be used for the purpose of discussionduring trial; and that the question of infringement of allthe antennas be determined on the basis of these two models.
We also discussed the possibility of a stipulation that the length and spacing of the Blonder-Tongueantenna elements conforms with the log periodic formula.It is my understanding that this is true and that thequestion of infringement turns on the meaning of "co-planar".Please call me on this as soon as possible.

Robert Heslin has advised me that a portion of the testimonygiven by him on February 14, 1967 was in error. More particularly,he advised me that the equation in Exhibit J-57 is incorrect and sentme a letter dated March 13, 1967 (copy enclosed) containing the correctequation.
For the sake of having an accurate record, I feel that thiserror should be indicated, and I propose that this be done by stipulation to the effect that the enclosed affidavit (after execution byRobert Heslin) be admissible as evidence at the trial of this Actionwith the same force and effect as the transcript of Mr. Heslin'sdeposition.
I look forward to receiving an early reply from you concerning the above, as well as a reply concerning the Stipulation of Factssent to you on February 28, 1967.

I have talked with Marjorie Johnson. She will bequite willing to testify in the Blonder-Tongue suit if youwish, either by way of deposition ahead of time or at thetrial. Apparently her time is reasonably free so that shecould come to Chicago whenever the case actually goes totrial. In the Winegard suit she received her expenses plus$10.00 an hour for the time she spent conferring with attorneys and on the witness stand. He is not sure hecan work out stipulation language regarding the Isbell invention which will satisfy both you and him. I suggested thathe call you directly to discuss it. He did not go intodetail but indicated that they take the position Isbell'scontribution was the application of the log periodic principalto an antenna with dipole elements.
He is more interested in learning which antennamodels can be considered as representative. He intends tohave some charts and diagrams made and would like to turnthe material over to his draftsman. Please call Jack orme (r will be out of town Tuesday) when you have checked thiswith Ike.

Dear Dick:
Continued search for materials which you requested haslocated blueprints of JFD antennas and parts therefor whichare proposed to be used in attacking validity of the B-Tpatent in suit. With respect to the enclosed JFD drawings52720, 52730 and 50451, I am advised that the drawings weremade after each of the mechanical components illustrated hadbeen designed and the tools built. Obviously, this would belong after the research and development work was done withrespect to the components. I am advised that these assemblydrawings would have been made sometime between nine months toone year after the original development of the project.
Per our agreement, dimensions of the antenna elementshave been removed.
With respect to the enclosed JFD drawings 11881-0101 and01201140, there is shown a strain relief member used since themiddle of 1962 and is still in use on JFD antenna model lOY1013Gillustrated.

Enclosed herewith is a slightly revised version ofour Motion for Sunnnary Judgment compared to the advance copysent to you earlier. Also enclosed herewith (not entirelyin final form) is a copy of our memorandum in support ofour Motion for Sunnnary Judgment, together with a copy ofthe more important exhibits referred to which I assumed youmight not have in your files. I have not yet prepared anypart.of the table of contents that will include a list ofthe exhibits, among other things.
I wish to call your attention particularly to thestipulation, PX-C. This stipulation has been approved byPete Mann and is presently being circulated for execution byall of the parties~ In view of hhe attitude taken heretofore by Faber regarding the patent aspects of the suit, Iexpect no problem in securing execution of that stipulationby him, as well as by Mann.
The reason for my use of capital letters to identifysome exhibits and numerals to identify others is the likelihood that the exhibits identified by capital letters may never

be used as exhibits at the trial or will be introduced asexhibits by the opposition, whereas those identified bynumerals would seem most likely to be introduced by us asexhibits at the trial (if there is one), and those throughPX~27 have already been identified by their exhibit numbersin our depcsLtdons . .
If you can look over the enclosed material quicklyand give me your comments by telephone, I may be able toprofit from those comments in finally revising the memorandumand still get the motion and memorandum filed by the end ofthis week. In any event, and whether or not you decide tomove for a separate trial of the issue of Itunclean hands lt Iwould hope that the enclosed material might be of someassistance to you in the handling of your own case.
I shall, of course, be intensely interested inwhatever develops regarding a trial date for your case andwhat issues will be tried.
