History Background

The U.S Navy began the first

random drug testing as a result of 

its discovery of widespread drug

use following an accident on

the USS Nimitz in 1982.

In 1986 President Reagan issued

Executive Order 12564 requiring all

federal agencies to develop a

“drug-free workplace” by

establishing a program to test for

the use of illegal drugs employees

in sensitive positions

Behavior of Drug - Abusing Employees 

• Imposes costs: lost productivity, higher insurance

premiums, excessive absentee and sick leave rate, the

loss of trained workers who are fired or die, the

administrative cost of anti-drug programs, extra plant

security, property damage, declines in employee

morale, lawsuits, and thefts of property.

Drug addicted employees tend to exhibit one or both of two

pernicious effects (distortion of time and lack of 

motivation). Example are:

•Frequent tardiness and absences from work

• Poor concentration, forgetfulness, missed deadlines

• Mood changes

• Risk taking and frequently accidents

Companies must choose whatkind of testing to use. There are

variety of drug-testing methods,

including the following:

• Employee searches

• Surveillance

• Written drug tests

• Polygraph or lie detector

• Fitness-for duty exams

(performance test)

• Blood tests

• Saliva test

• Hair analysis test

• Urinalysis

Why Corporation Favor Drug Testing

• It is needed to comply with certain laws and contract laws

requirements. Most cities and some cities have laws

concerning drug testing.

• Drug testing has beneficial results

• Corporate drug testers argue that urinalysis is a practicalmethod of testing for drug use

• There is a social responsibility argument for drug testing.

Many companies refer employees who test positive to

assistance programs for treatment rather than terminate

them

• Competitors have drug-testing programs

Why Some Employees Oppose Drug Testing

• Urine testing is intrusive and an invasion of privacy

• Urine testing is inherently demeaning whether a

sample is taken with visual or passive supervision

The tests are unjust because they violate ethicalstandards of fair treatment

• Urine tests are imperfect

• Drug tests can be misleading and cannot meet

reasonable evidentiary standards

• Drug testing is not cost-effective

Drug Testing and The Law

• Legal precedent on drug testing is relativity new and

still developing

• The fourth amendment guarantees protection to

public employees against “unreasonable searchesand seizure” 

• The fifth amendment guarantees due process of law

and protects of law and protects against self -

inscrimination

Approve New Drug Testing Rules

• In January 2005 the owners and players approved a new drug testing

program for major league baseball

• The new program covered a wide range of banned substance and

imposed harsher penalties for their use by player

• The main focus of the agreement was to ban muscle-building drugs
