Prohibitions - The following conduct is inconsistent with a professional

working environment and is proh ibited. Any employee who engages in such conduct

will be subject to disciplinary action, up to and including terminat ion.

(1) The use of profanity or abusive language;

(2) The possession of unauthorized firearms or other weapons while on

Unified School District No. 500 property;

(3) Insubordination or the refusal by a Unified School District No. 500

employee to following the instructions of his/her superior concerning a

job-related matter;

(4) The pushing, shoving, hit t ing, kicking or slapping or offensive touching

of a Unified School District No. 500 employee;

(5) Threatening or intimidating co -workers, security guards, campus

officers or the guests or invites of Unified School District No. 500; and,

(6) Exhibit ing (a) personal conduct detrimental to Unified School District

No. 500 personnel, students, guests or invites, which could cause undue

disruption of work or endanger the safety of persons or property of

others or (b) exhibit ing conduct which may be characterized as

workplace violence, as defined above.

Employee Expectations/Requirements - Unified School Distric t No. 500

employees are expected at al l t imes to conduct themselves in a posit ive manner so as

to promote a professional working environment. Toward this end, Unified School

District No. 500 employees must , at a minimum, adhere to the fol lowing:

(1) Comply with all Unif ied School Dist rict No. 500 safety and security

policies;

(2) Treat al l students, visi tors, staff , and co -workers in a courteous manner;

(3) Refrain from behavior or conduct which may be characterized as school

violence as defined above;

(4) Immediately report to Unified School Distr ict No. 500 supervisors and

administrative officials, including but not l imited to appropriate state

and local law enforcement, building principals, the Chief of Human

Resources, the Director of Student Services , or the Director of Human

Resources all information supporting the individuals = belief that an

incident of school violence has been committed or will be commit ted at

school, on school property, or at a supervised school activity.

The report , when appropriate, must also state that the ac t involved or

will involve a direct or immediate threat to the safety or security of

human life, the possession, use, or disposal of explosives, f irearms, or

other weapons, or the commission of an inherently dangerous act . The

supervisor and/or administra tive official receiving such a report shall

ensure i ts immediate communication to the appropriate state or local or

law enforcement agency.

If they so desire, school employees may also make such reports directly

to the appropriate state or local or law enf orcement agency.

(5) Cooperate with Unif ied School District No. 500 in investigations

pertaining to school violence.

School Safety - Any administrative, professional or parap rofessional

employees who comes into possession of information about potentially dangerous

students shall inform the Superintendent of Schools or the Director of Student

Services of such belief and the reasons supporting the belief. Potentially dangerous

students includes, but is not l imited to the following:

(1) Students who have been expelled for conduct which endangers the

safety of others;

(2) Students who have been expelled for commission of criminal offenses;

(3) Students who have been expelled for possession of weapons;

(4) Students who has been adjudged to be a juvenile offender and whose

offense, if committed by an adult , would consti tute a felony, except

theft involving no d irect threat to human life; and

(5) Students who has been tried and convict ed as an adult of any felony,

except theft involving no direct threat to human life.

School Violence Complaint Procedure - Any person who believes he or she

has been subjected to school violence or the threat of violence should follow these

procedures:

(1) Immediately terminate all contact and communication with the

threatening or offending person;

(2) Contact the offending person's supervisor, your supervisor, your

principal , the Chief of Human Resources , the Director of Student

Services, or the Director of Human Resources ;

(3) Upon receipt of such information, the above -designated individuals

shall immediately report to the appropriate state or local law

enforcement agency, by or on behalf of any school employee who knows

or has reason to believe that an act of workplace violence has been

committed or will be committed, the information required and/or

reported under board policy;

(4) Anyone subjected to school violence by anyon e with supervisory

authority should report such ac tivity to the Central Office. e mployees

are further encouraged to fi le police complaints/reports as they deem

necessary; and

(5) Anyone who observes the failure of a supervisor to take immediate

action on a complaint of school violence should report such activity to

his/her supervisor or building principal, Chief of Human Resources , the

Director of Student Services , or the Director of Human Resources .

Workplace Violence - Investigation and Resolution of Complaints

Allegations of school violence or the threat of violence shall be investigated

and, if substantiated, corrected or disciplinary action taken. Conduct evidencing

school violence by an employee may consti tute grounds for termination.

Regardless of the means selected for resolving the problem, the init iat ion of

a complaint under this policy, or the cooperation by any employee in an investigation

init iated as a result of this policy, or an employee 's cooperation with a law

enforcement agency relating to any criminal act that the employee knows has been

committed or reasonably will be committed at school, on scho ol property, or at a

school supervised activity, will not cause any negative reflection on the employee nor

will i t adversely affect his/her employment, compensation or work assignments.

To participate in the Early Separation Program, the employee must meet al l

of the following eligibil i ty cri teria:

1) The individual must be an employee of the district .

2) The individual must be at least f if ty -five (55) and no more than sixty -five

(65) years old.

3) The individual must have completed twenty -five (25) years of experience

as an employee of a school district and at least ten (10) consecutive years

in USD 500 with the ten consecutive years in USD 500 having been the

individual’s f inal years before early separation.

4) The individual must submit to the Personnel Office a complet ed Early

Separation Application on or before April 30 of the year in which

separation is to begin.

5) This Early Separation Program does not apply to any employee who is

el igible for the Board’s Early Separation Program under Board policy

GBRH.

A year of experience is full -t ime employment for at least 160 days of a

calendar year between July 1 - June 30. Previous experience l isted as part -t ime shall

be evaluated by the Superintendent or his/her designated representative to determine

how much, if any, of the t ime will be credited as experience to meet the requirements

of Early Separation policy.

Employees approved for early separation shall be provided a single HMO

medical insurance policy from a carrier selected by the Board.

If the employee locates in an area where the selected carrier does not provide

coverage, the Board will be under no obligation to provide alternative medical

insurance coverage and no such coverage will be provided.

Employees approved for the early separation benefit shall begin receiving the

benefit in July of the year separation begins, and the benefit shall end on the earl ier

of: (a) the first day of the month immediately following the month in which the

employee dies, (b) the first day of the month following the seventh anniversary of the

date of the employee’s separation, or (c) the first day of the month the employee

becomes sixty-five (65) years old.

An employee who applies for and receives the early separation benefit

forfeits the right to return to full -t ime employment in any capacity with USD 500.

However , i t is permissible for the employee to be hired as a substi tute in the district

in accordance with KPERS guidelines .

Disability Leave

Disabil i ty leave may be used for absences from duty caused by personal

sickness or injury of the employee or the emp loyee =s dependent children. A

child shall be deemed a dependent child of the employee seeking leave if the

child is under the age of 23, and the employee claimed the child as a dependent

on his/her tax return for the calendar year immediately preceding the year for

which leave is sought . An employee may be required to submit proof of such

dependency upon the submission of a leave request .

An employee may also use disabil i ty leave for a child not claimed on

the employee =s income-tax return for the calendar year immediately preceding the

term of the leave request if the child is a relative of the employee, under the age

of 19. For use of this disabil i ty leave provision, the term relative means (1) the

employee =s birth child, stepchild, adopted child; o r (2) a child who l ived in the

employee =s home as a family member if placed by an authorized placement

agency for legal adopt ion; or (3) a foster child, any child for whom the employee

has legal guardianship.

An employee who has been employed for the previ ous 12 months may

also use disabil i ty leave because of the serious health condition of the

employee =s spouse or employee =s parent. A serious health condition means an

i l lness, injury, impairment, or physical or mental condition that involves

inpatient care in the hospital , hospice, or residential care facil i ty or which

requires continuing treatment by a health care provider.

Absence for one-half (1/2) day or less shall be charged against available

leave as one-half (1/2) day. Absences for less than a day but more than one-half

(1/2) shall be charged against available leave as (1) day. Absence due to

sickness or injury of an employee =s dependent children or the serious health

condition of an employee =s spouse or parent shall be l imited to a total of seven

(7) days annually. The term "days" as used herein is defined as days on which

the employee drawing disabil i ty leave would normally have reported for duty.

Disabil i ty leave benefits are extended to all employees whose

employment provides for at least 30 hours per week, except as otherwise noted

in the policies of the Board.

Persons employed prior to June 1, 1982, as aides under Tit le I of the

Elementary and Secondary Education Act or i ts success or and whose work

assignment has been reduced to less than full t ime, shall continue to receive

all benefits of the provisions of policy 4.1.20.1.0 et seq. , except that both

accumulation of days under paragraph .20.1.5 and the deduction of any days

of absence under paragraph .20.1.1 shall be on a full - day basis so long as

either the regularly assigned t ime of duty shall be four hours or more. No

disabil i ty leave benefi ts shall be granted to aides employed under Tit le I a fter

June 1, 1982 who are employed for less than full t ime.

Annual Allowance

Employees whose work year does not exceed 205 days shall be allowed

annual disabil i ty leave at the rate of 10 days per school year; employees 206

to 239 days shall be al lowed 12 days per school year; employees 240 days or

over shall be allowed 14 days per school year. In the event an employee resigns

during the work year, f inal salary payment shall be reduced for dis abil i ty leave

taken in excess of any disabil i ty leave accrued plus that which is credited

during the year of resignation at the rate of one day per complete month of

service.

Initial Employment

Upon commencing service at the beginning of the fir st full year of

school service, an employee shall be provis ionally credited with 10, 12 or 14

days of disabil i ty leave in accord with provision of .1.3. In the event of

termination of services during the f irst year of employment, adjustment in final

salary payment shall be such as to provide for the allowance of a total number

of disabil i ty leave days not in excess of one day per complete month of

service. Employees commencing service during the school year shall be

provisionally credited with 10, 12 or 14 days less one day for each preceding

whole or major portion of a month not worked, beginning with September.

Annual Accumulation

All prior unused disabil i ty leave shall be allowed to accumulate

without l imit .

Current Days Use After Five Days' Service

Current days of disabi l i ty leave are credited on July 1, with eligibil i ty

commencing at beginning of work year but they may not be used unti l after the

employee has been on duty for f ive consecutive days in th e current year. This

restrict ion does not apply to accumulated days. On the first duty day of any

given year, al l unused accumulated disabil i ty leave shall be available for use.

Physician Statement May be Required

Any employee absent due to i l lness or disabil i ty may be requested to

present a l icensed physician 's statement indicating the nature of the i l lness or

disabil i ty and the readiness of the employee to resume his/her duties. Such

cert if ication shall be secured at the employee 's expense.

Any employee absent more than five consecutive days due to i l lness or

disabil i ty shall present a statement from a physician l icensed to practice

medicine, indicating the nature of the i l lness or disabil i ty and ver ifying that the

readiness of the employee to resume his/her duties. Such cert if ication shall be

secured at the employee =s expense.

Any request for disabil i ty leave benefits for any absence in excess of

twenty (20) working days for the same disa bil i ty shall be accompanied by a

comprehensive statement by a l icensed physician st ipulating the nature of the

i l lness or disabil i ty necessitat ing the extended absence. Such s tatement shall

be presented to the Superintendent on or before the 20 th day of absence.

Further review and examination by a committee of three l icensed physicians

employed by the Board may be required for al lowance of t ime in excess of

twenty (20) working days.

Superintendent Review

Final decision on cases not directly covered by these regulations

shall be left to the discretion of the Superintendent.

Loss or Preservation of Disability Leave Upon Termination

Termination of employment shall automati cally void all accumulated

days of disabil i ty leave.

An employee who resigns in good standing from the district and then

is reemployed may retain accumulated disabil i ty leave if he/she returns to work

or is given a contract to return to work within twenty-four (24) months after

termination of former employment.

Abuse or Misuse of Leave

No salary shall be paid for any day's absence for which disabil i ty is

falsely reported as the cause for absence. Discipline for such violations shall

be in accord with general discipline regulations.

Credit Upon Retirement or Death

Upon retirement or death, an employee, or in the event of death the

employee 's estate, shall be eligible to receive a lump sum payment for

accumulated unused disabil i ty leave based on the following formula:

Total accumulated unused disabil i ty leave (not to exceed the

maximum accumulation of disabil i ty leave al lowed) x .75 x the base daily

salary rate for the salary schedule class in which the employee is class ified

at the t ime of ret irement or death.

The maximum number of accumulated unused disabil i ty leave days for

which payment may be made in accord with the above formula shall be l imited

as follows:

185 - 205 days employment, 120 days allowed;

206 - 239 days employment, 132 days allowed;

240 or more days employment, 144 days allowed.

Employees who resign from the dis trict after completing thirty (30)

years of service in the district or twenty (20) years of service in the district

and are 55 years of age shall also be eligible to receive a lump sum payment

for accumulated unused disabil i ty leave based on the above stated formula.

For any employee not paid on the basis of a salary schedule

classification, the base rate for payment of accumulated leave t ime under this

provision shall be calculated at 66% of the individual 's salary rate at the t ime of

retirement or death. Any payment under this provision to an employee 's

estate shall be made to the court appointed f iduciary (executor, administrator,

or other designee) of the decedent 's estate.

Any individual init ially employed by the district after July 31, 1996,

shall not be eligible for the payment as descr ibed in this provision .

Injury When on Duty

General Rule:

Work-related injury. Except as provided in the circumstances below,

absence due to injury incurred while an employee is on duty shall not be charged

against the employee =s disabil i ty leave days if the employee is r eceiving

temporary total or temporary partial workers = compensation benefits.

Exceptions to the General Rule:

Restraint/Assault work re -related injuries . An employee who is injured

while physically restraining a student or who is injured as the victim of an

assault while on duty shall receive, for the length of the disabil i ty or unti l June

30 of the current fiscal year, whichever is shorter, Differential Pay in an amount

equal to the difference between the employee =s regular wage and the amount of

worker =s compensation temporary total disabil i ty payments ( ADifferential Pay@) .

In this si tuation, Differential Pay shall not be charged against the employee =s

disabil i ty leave.

Employee Request . Upon writ ten request , an employee shall receive

Differential Pay for the length of the absence from work result ing from a

temporary disabil i ty or unti l the end of the fiscal year (July 1 - June 30),

whichever is shorter, provided that the employee has unused disabil i ty leave days

and the employee =s disabil i ty leave is charged at not less than 0.5 day increments

for each day that Differential Pay is received.

Extension period. If a t the end of the fiscal year, the employee remains

absent from work as a result of a temporary disabi l i ty and if the employee has

unused disabil i ty leave days, the employee may make a writ ten request to extend

the payment of the period of Differential Pay under the preceding section.

Additionally, employees who are on leave under the Restraint/Assault wo rk-

related injuries section of this policy may seek an extension of such benefits by

making a writ ten request to Human Resources at least 10 days prior to the

Statement of Accumulated Leave

A statement of accumulated disabil i ty leave will be provided ea ch

employee on each payroll warrant. Such statement is informational only, and

not made or given as a warranty of the number of days stated. Each employee

shall be solely responsible for determining the accuracy of the statement . The

Board shall not be l iable for errors, mistakes or failure to provide the statement

unless due to intentional or willful fault on the part of the Board.

Superintendent May Require Examination

In the event of apparent physical or mental i l lness or disabil i ty of

any employee, the Superintendent may require an examination by a

competent practi t ioner specified by the Superintendent. In such cases, the

cost of the examination shall be paid by the Board.

Continued Employment Under Disability Leave

Any employee who is absent from duty because of i llness or injury

and is el igible to receive benefits of the disabil i ty leave policy (4.1.20.0 et

seq.) shall be retained on the active payroll as an em ployee for such period of

t ime as annual and accumulated disabili ty leave days are available. If the

return to work, in accord with Board policy , is prior to the expiration of

current and accumulated disabil i ty leave t ime, the employee shal l be returned

to active employment in the same or similar duty assignment.

Expiration of Disability Leave Benefits

Employment of any employee shall terminate upon the expiration of

current and accumulated disabil i ty leave t ime except that the r ights of

continued employment may be extended under terms of u npaid health leave .

Terms of such leave shall be in writ ing as authorized by the Superintendent.

Termination of Disability Leave Payments

All payments of wages under terms of t he disabil i ty leave policy

shall terminate if the employee is gainfully employed b y any employer other

than USD No. 500 or is engaged in gainful self -employment .

Health Leave

Any employee who is unable to perform the duties of his assigned

posit ion because of personal i l lness or physical disabil i ty and who has

exhausted al l available current and accumulated disabil i ty leave shall be granted

upon request a leave of absence without pay for an addit ional 20 working days.

Health leave may, upon recommendation of the Superintendent and approval

of the Board, be extended beyond 20 days but any such extension shall be for a

specific number of addit ional days and a return to active employment sha ll be

in accord with the terms of Board policy . Failure or inabil i ty of the employee

to return to work upon expiration of the heal th leave shall terminate employment.

Professional Leave

An employee may be granted professional leave with pay to atte nd

seminars, conferences, meetings, and workshops directly related to the

employee 's job with the district . Professional leave shall not be granted for the

purpose of at tending classes for completing degrees or cert if ication requirements.

Application for professional leave shal l be made in writ ing to the

Superintendent or his designated representat ive at least f ive (5) working days in

advance of the absence.

J u ry Lea ve

Whenever an employee is required to perform services as a juror, said

employee shall be paid full salary for the period of such services provided that:

The Board is notified at least three (3) days in advance of the absence

that a jury summons has been received.

The Employee shall submit reimbursement for court per diem, along with

proof of the court payment amount, to the Business Office within 60 days

of the date of jury service .

The employee presents to the Board within 60 days the endorsed

(uncashed) check issued by the court for the number of days of such

service.

The proceeds of the court payment shall be retained by the Board.

Emergency Leave

Five-day Maximum - Advance Approval

A maximum of five days ' absence without deduction in pay during

any work year may be allowed for reasons of emergency as defined in paragraph

2. Whenever possible, requests for approval of an absence under emergency

leave shall be made in writ ing on a district leave request form to the Personnel

Office prior to the absence. If the nature of the emergency does not al low for a

writ ten request prior to the absence, the employee shall f i le the proper form

within three (3) work days of returning to work after the absence. In all cases

where a prior writ ten request is not made, th e employee shall notify his/her

immediate supervisor of the absence on or before the fist day of the absence.

Emergency leave shall be approved by the Assistant Superintendent for Personnel

or his/her designated representative.

Emergency Leave Defined

Emergency leave shall be granted for reasons of cri t ical i l lness in the

immediate family or for absences which are not a consequence of the choice or

actions of the employee. Emergency leave shall terminate when the event giving

rise to the leave no longer exists. The following circumstances are examples of

events which DO NOT qualify as emergency leave:

Recreational activit ies

Accompanying spouse on business or vacation

Routine medical or dental matters

Working for another person or business

Interviews for employment

Examinations by a col lege or university

To attend to legal matters

Personal i l lness

Problems associated with transportation to work

Availabil i ty for Duty Required - Emergency leave will be granted only

to those employees who are available for duty in the Kansas City, Kansas area at

the t ime of the emergency.

No Accumulation - Emergency leave t ime shall not accumulate.

Immediate Family Defined - As used herein, "immediate family" shall

designate the employee 's spouse, children, parents, brothers, and sisters,

grandparents, grandchildren, and spouse 's parents.

Deducted from Disabi l i ty Leave Time - Any day taken as emergency

leave shall be deducted from current or accumulated disabil i ty le ave t ime.

Crit ical Il lness Defined - Crit ical i l lness as used herein shall not be

understood to include normal care for family members, but includes such

i l lness or injury as to produce a l ife threatening condition and is so verified

by medical report of the attending physician.

Unauthorized Absence

An unauthorized absence is defined as any absence by an employee

for reasons not authorized in the policies of the Board and without approval of

the employee 's immediate supervisor or other administrative staff responsible

for approval of leaves.

Any employee who has two (2) consecutive days of unauthorized

absence or five (5) days of unauthorized absence in any f iscal year may be

terminated due to conduct demonstrating cause defined under Board policy or

non-performance of duties. Employees terminated due to unauthorized

absence shall not be enti t led to terminal pay as provided in Board policy.

Bereavement Leave Three-day Maximum Per Occurrence - A maximum of three days

absence per occurrence (or five (5) days if the distance is more than 400 miles ,

one way) without deduction in pay during any year may be allowed for reasons

of death in the immediate family as defined herein.

Immediate Family Defined - As used herein, "immediate family"

shall designate the employee 's spouse, children, parents, brothers, sisters,

grandparents, grandchildren, and spouse 's parents, grandparents, grandchildren,

brothers and sisters by blood or marriage.

No Accumulation - Bereavement leave t ime shall not accumulate.

Writ ten Request and Approval - Any request for bereavement leave

shall be in writ ing. Approval shall be granted by the Superintendent or h is

designated representative.

Vacations

Paid vacation shall be provided for al l employees who are employed in

a full -t ime posit ion requiring service 12 months per year in the specific posit ion.

Such vacation shall be scheduled at the convenience of the Board.

Ten days of vacation t ime shall be al lowed per year for

full -t ime non-certif ied employees for each of the first f ive years of

employment. Upon commencing service, any non -certif ied employee

eligible for vacation t ime shall commence accumulation of vacation t ime at

the rate of 5/6 of a day for each whole or major portion of a month to be

worked, prior to the next July 1.

One addit ional vacation day shall be al lowed per year for

non-certif ied employees for each year beyond f ive years of

employment up to a maximum of twenty vacation days per year after f if teen

years of employment.

Accumulation of addit ional vacation days sh all commence July 1 of

the sixth year of employment at the rate of one-half day for each six months

of service. No addit ional vacation t ime shall be granted for less than six

months of service.

In the event of reclassification of an employee from a posit ion of less

than 12 months to a full -t ime posit ion as described above, addit ion of

vacation days beyond the ten-day minimum shall be granted only for years

in which the individual is employed on a twelve -month basis.

No vacation t ime shall be drawn prior to six months of

continuous employment and no vacation t ime shall be allowed prior to i ts

accumulation.

Vacation days of one contract year (July 1 -June 30) may not be extended

beyond the end of the next contract year. Any exception must be approved by

the Superintendent or his designated representative.

The Board has provided vacation leave for 12 month employees to allow

for relaxation and rejuvenation from the demands of the job. The Board strongly

encourages employees to use their yearly allotment of vacation days within the year

in which they are earned.

Personal Leave

A two (2) day absence without deduction in pay during any year may be

allowed for personal leave for persons who work 30 or more hours per week.

To be classified as personal leave, authorization must be secured prior

to the day leave is taken except for instance of emergency. Employees des iring to

use personal leave shall submit their requests in writ ing at least f ive (5) working

days in advance of the anticipated absence. In cases of an emergency not covered,

such leave must be made to the principal or immediate supervisor on or before the

day of leave by the normal absence reporting procedures , and a writ ten request

shall be submitted within three (3) days of the absence. All requests for personal

leave must be submitted to the office of the Superintendent or his de signated

representative.

Personal leave shall not be used for seeking other employment,

rendering services, nor working with or without remuneration for themselves, nor

for anyone else, for hunting, for f ishing, nor other recreational activit ies, nor

because of severe weather when school is in session. Such leave shall not be

granted for the f irst eight ( 8) nor the last f ive (5) duty days of the employee 's

work year, nor on the first duty day preceding or following a holiday or

non-working day; nor on any in-service days.

Personal leave t ime shall not accumulate.

The district reserves the r ight to refuse requests on any given day due to

the number of other absences or the demands of the employee 's job. Approval will

be granted in the order of application except for clear emergency si tuations.

salary shall be the figure shown as annual salary on the primary contract . If the

teacher holds only a part -t ime contract , the total annual sala ry shall be the

average of the teacher 's salary for the last three years .

If the teacher also holds an extended contract , the total annual salary

shall be the amount shown as "Total Primary and Extended Contract" on the

extended contract . Pay for extra-curricular duties is expressly excluded from the

total annual salary.

To participate in the Early Separation Program, the teacher must meet

al l of the following eligibil i ty cri teria:

The teacher must have been under contract to the Kansas City, Kansas

Public Schools (USD #500) on or before August 1, 1996.

The teacher must be at least f if ty -five and no more than sixty -one years

old.

The teacher must have completed twenty -five years of contract teaching

experience, with at least seventeen years in USD 500.

The teacher must submit to Human Resources a completed Early

Separation Application on or before April 30 in the year in which

separation is to begin.

Normally, a teacher will not be allowed to begin early separation pr ior to the

end of the contract year. Any exceptions must be approved by the

Superintendent and/or designee .

Teachers approved for the early separation benefit will be paid not more than

eighty-four monthly payments with payments beginning on July 1 of the year separation

begins and ending on the last day of the month in which the teacher dies or becomes

sixty-two years old, whichever occurs first .

The monthly benefit shall be one twelfth (1/12) of the product of the teacher 's

experience factor and the teacher 's f inal total annual salary. The experience factor is

based on the teacher 's years of experience both in and out of the district .

The teacher electing early separation, if otherwise eligible, has the right to

remain a member of the Board 's health insurance program of his or her choice unti l age

sixty-five (65) at the teacher 's expense.

The early separation benefits specified in this plan are independent of any

other retirement for which the teacher may be eligible from sources other than the school

district .

A teacher who applies for and receives pay from the Early Separation Program

forfeits the right to return to full -t ime employment in any capacity in USD 500. It is

permissible for the teacher to be hired as a substi tute in the district .

Determine the number of years of experience in USD 500. Locate the

horizontal row headed by that number. If i t i s less than seventeen, i t does not

qualify. If i t is greater than thirty -five, use the "35" row.

Determine the number of years of experience in districts other than USD

500. Credit will be given for no more than eight years outside the district . The

maximum total credit shall be thirty -five years.

The intersection of the "USD 500" row and the "other" column is t he

experience factor.

Multiply the experience factor t imes the total annual salary. Divide the

product by twelve to f ind the month benefit . (See Experience Factor Table on

next page.)

Disability Leave

Disabil i ty leave is defined as days of absence from duty because of

personal sickness or injury of the teacher or depend ent children under 18 years of

age residing in the same house and for which no deduction is made in regular

monthly or annual compensation of the teacher.

A teacher who has been employed for the previous 12 months may also

use disabil i ty leave because of the serious medical condition of a parent. A

serious medical condi tion means an i l lness, injury, impairment, or physical or

mental condition that involves inpatient care in the hospital , hospice, or

residential care facil i ty or which requires continuing treatment by a health care

provider.

Absences for one-half (1/2) day or less shall be charged as one -half

(1/2) day. Absences for less than a day but more than one - half (1/2) shall be

charged as one (1) day.

Absences due to sickness or injury of dependent children or serious

medical condition of a parent shall be l imited to seven (7) days annually. The

term "days" as used herein is defined as days on which the teacher drawing

disabil i ty leave would normally have reported for duty.

Coverage

Disabil i ty leave benefits are extended to all teachers for whom

deductions are made for ei ther the Kansas City, Kansas, or Kansas State School

Retirement Plans.

Annual Allowance

Except during the init ial year of employmen t , teachers ' annual disabil i ty

leave shall be allowed at the following rates: Teachers whose primary and

extended contract year is 181 days to 205 days, 10 days allowance; 206 to 239

days, 12 days allowance; 240 days or over, 14 days allowance. In the eve nt a

teacher resigns during the contract year, f inal salary payment shall be reduced

for disabil i ty leave taken in excess of any disabil i ty leave accrued plus that

which is credited during the year of resignation at the rate of one day per

complete month of service.

Initial Employment

Upon commencing service at the beginning of the first full year of

school service, a teacher shall be provisional ly credited with 10, 12 or 14 days of

disabil i ty leave in accord with provision of .1.3. In the event of separ ation of

services during the first year of employment , adjustment in final salary payment

shall be such as to provide for the allowance of a total number of disabil i ty leave

days not in excess of one day per complete month of service. Teachers

commencing service during the school year shall be provisionally credited with

10, 12 or 14 days less one day for each preceding whole or major portion of a

month not worked, beginning with September.

Accumulation of Unused Disability Leave

Unused disabil i ty leave shall be allowed to accumulate to a maximum of

185 days. Nothing in this provision shall operate so as to annul or modify any

teacher 's number of accumulated disabil i ty leave days exist ing on July 31, 1991,

.

in excess of 185 days except that such teacher will not accumulate addit ional

unused disabil i ty leave beyond the number of such days accumulated as of July

31, 1991.

Nothing herein shall preclude the Board from granting in i ts discretion

requests for addit ional di sabil i ty leave to any teacher , regardless of length of

service, in cases of personal emergency. In considering requests for such

addit ional leave, the Board shall give special at tention to teachers who at some

time in their career have foregone disabil i ty leave accumulation by virtue of

being at the maximum level of accumulation for one or more years.

Current Day Use After Five Days Service

Current days of disabil i ty leave are credited on September 1, but they

may not be used unti l after the teacher has b een on duty at least f ive consecutive

days in the current year. This restrict ion does not apply to accumulated days. On

the first duty day of any given year, al l unused accumulated disabil i ty leave shall

be available for use.

Physician Statement May be Required

Any teacher absent due to i l lness or disabil i ty may be requested to

present a l icensed physician 's statement indicating the nature of the i l lness or

disabil i ty and the readiness of the teacher to resume his/her duties. Such

cert if ication shall be secured at the teacher 's expense.

Any teacher absent more than five consecutive days due to i l lness or

disabil i ty shall present a statement from a physician l icensed to practice

.

medicine, indicating the nature of the i l lness or disabil i ty and ver ifying that the

absentee is in good health and able to resume teaching and related duties.

Any request for disabil i ty leave benefits for any absence in excess of

twenty (20) working days for the same disabil i ty shall be accompanied by a

comprehensive statement by a l icensed physician st ipulating the nature of the

i l lness or disabil i ty necessitat ing the extended absence. Such statement shall be

presented to the Superintendent on or before the 20th day of absence. Further

review and examination by a committee of three l icensed physicians employed by

the Board may be required for al lowance of t ime in excess of twenty (20)

working days.

Superintendent Review

Final decision on cases not directly covered by these regulations shall

be left to the discretion of the Superintendent.

Loss or Preservation of Disability Leave Upon Termination

Resignation not related to Early Separation, non -renewal, or termination

of employment shall automatically void all accumulated days of disab il i ty leave.

A teacher who resigns in good standing from the district and then is

reemployed may retain accumulated disabil i ty leave if he/she returns to work or

is given a contract to return to work within twenty -four (24) months of the

effective date of the teacher 's resignation.

Abuse or Misuse of Leave

No salary shall be paid for any day's absence for which a disabil i ty is

falsely reported as the cause for absence.

Credit Upon Retirement or Death

Upon retirement a teacher, or in the event of death, the teacher 's estate

shall be eligible to receive a lump sum payment for accumulated unused

disabil i ty leave based on the following formula:

Total accumulated unused disabil i ty leave (not to exceed the maximum

accumulation of disabil i ty leave allowed) x .75 x the base daily salary rate for

the salary schedule class in which the teacher is classified at the t ime of

retirement or death.

The maximum number of accumulated unused disabil i ty leave days for

which payment may be made in accord with the above formula shall be l imited as

follows:

185 - 205 days of employment, 120 days allowed.

206 - 239 days of employment, 132 days allowed.

240 or more days of employment, 144 days allowed.

Teachers who resign f rom the district after completing thirty (30) years

of service in the district or twenty (20) years of service in the dist rict and are 55

years of age shall also be eligible to receive a lump sum payment for

accumulated unused disabil i ty leave based on the above-stated formula. Any

payment under this provision to a teacher 's estate shall be made to the court -

appointed fiduciary (executor, administrator, or other designee) of the decedent 's

estate.

Any individual in it ial ly employed by the district as a teacher after July

31, 1996, shall not be eligible for the payment as described in this provision.

Injury When on Duty

Absence due to injury incurred while a teacher is on duty in the school

or any other place a teacher is required to perform professional duties shall not

be charged against the teacher 's disabil i ty leave days if the teacher is receiving

temporary total or temporary partial workers ' compensation benefits.

Upon writ ten request , such teacher shall conti nue to receive salary

payment less workers ' compensation temporary total disabil i ty payment over the

length of his/her disabil i ty to work or unti l the end of the contractual period

whichever is shorter with his/her disabil i ty leave being charged at not les s than

0.5-day increments. Permanent partial payments, ei ther body as a whole or

scheduled, shall not be deducted from salary if the teacher has returned to work

following temporary total disabil i ty.

The Board shall pay salary less workers ' compensation t otal disabil i ty

payment for the length of a disabil i ty or unti l the end of the contractual period,

whichever is shorter, to a teacher who is injured while physically restraining a

student or who is the victim of an assault while on duty and is injured ther eby.

Statement of Accumulated Leave

A statement of accumulated disabil i ty leave will be provided each

teacher on each payroll warrant. Such statement is informational only, and not

made or given as a warranty of the number of days stated. Each teacher sh all be

solely responsible for determining the accuracy of the statement . The Board shall

not be l iable for errors, mistakes or failure to provide the statement unless due to

intentional or willful fault on the part of the Board.

Superintendent May Require Examination

In the event of apparent physical or mental i l lness or disabil i ty of any

employee, the Superintendent may require an examination by a competent

practi t ioner specified by the Superintendent. In such cas es, the cost of the

examination shall be paid by the Board.

Health Leave

A teacher who is unable to teach because of personal i l lness or physical

disabil i ty and who has exhausted all disabil i ty leave available shall be granted

upon request a leave of absence without pay for the duration of such i l lness or

disabil i ty, provided, however, any such leave shall not extend beyond the current

school year. This leave, at the Board 's option, may be renewed for the subsequent

school year upon writ ten request of the teacher. The teacher may return to active

employment during the year in which he/she becomes sick or disabled as soon as

a physician cert if ies the teacher is capable of performing all tasks required under

his/her contract .

Short Term Professional Leave

A teacher may be granted professional leave with pay when such leave

is considered by the Superintendent as being in the best interest of the district .

Application for professional leave shall be made in writ ing at least f ive

(5) working days in advance of the absence.

Professional leave shall be subject to the approval of the Superintendent

and/or designee.

Long Term Professional Leave

A leave of absence of up to two (2) years may be granted to any teacher,

upon application, for the purpose of part icipating in exchange teaching programs

in other states, terri tories or countries; foreign or mili tary teaching programs; the

Peace Corps, Teacher 's Corps or Job Corps as a full -t ime participant in such

program; or a cultural travel or work program related to his/her professional

responsibil i t ies.

Upon return from such leave and upon furnishing satisfactory evidence of

successful completion of the work for which the leave was granted, advancement

in steps on the salary schedule for such leave t ime shall be granted.

A long term professional leave of absence up to two (2) years for

approved college or university study may be granted except that salary schedule

advancement based on academic study shall be in advancement t o appropriate

scheduled classes earned and shall not be ref lected in longevity steps.

Whenever an employee is required to perform services as a juror, said

employee shall be paid full salary for the period of such services provided that :

The Board is notified at least three (3) days in advance of the absence that

a jury summons has been received.

The Employee shall submit reimbursement for court per diem, along with

proof of the court payment amount, to the Business Office within 60 days

of the date of jury service .

The employee presents to the Board within 60 days the endorsed

(uncashed) check issued by the court for the number of days of such

service.

The proceeds of the court payment shall be retained by the Board.

Leave will be granted in order to meet the requirements of a court

summons as a witness when the teacher is not a l i tigant. Such absence

will not be deducted from accumulated disabi l i ty.

Emergency Leave

A maximum of five days ' absence without deduction in pay during any

work year may be allowed for reasons of emergency as defined in section .6.2.

Whenever possible, requests for approval of an absence under emergency leave

shall be made in writ ing on a district leave request form to the Personnel Office

prior to the absence. If the nature of the emergency does not al low for a writ ten

request prior to the absence, the teacher shall f i le the proper form within three

(3) work days of returning to work after the absence. In all cases where a prior

writ ten request is not made, the teacher shal l notify his/her immediate supervisor

of the absence on or before the first day of the absence. Emergency leave shall

be approved by the Assistant Superintendent for Personnel or his/her designated

representative.

Emergency leave shal l be granted for reasons of cri t ical i l lness in the

immediate family or for absences which are not a consequence of the choice or

actions of the teacher. Examples of instances which will not qualify for

emergency leave are:

Recreational activit ies

Accompanying spouse on business or vacation

Routine medical or dental matters

Working for another person or business

Interviews for employment

Examinations by a col lege or university

To attend to legal matters

Personal i l lness

Problems related to personal or family vehicle

Emergency leave t ime shall not accumulate.

As used herein, "immediate family" shall designate the teacher 's spouse,

children, parents, brothers, and sisters, grandparents, grandchildren, and spouse 's

parents.

Any day taken as emergency leave shall be deducted from current or

accumulated disabil i ty leave t ime.

Crit ical i l lness as used herein shall not be understood to include normal

care for family members, but includes such i l lness or injury as to produce a l ife

threatening condition and is so verified by medical report of the attending

physician.

Extended Maternity Leave

Professionally cert if ied women teachers having three or more years of

service in the district whose performance of duty is interrupted by reason of

pregnancy may apply for, and on application shall be extended the benefits of a

maternity leave provided that the applicant has not been notified in writ ing prior

to application that her work is unsatisfactory. The following provisions must be

met.

Application for maternity leave shall be made within three (3) months

following beginning of pregna ncy and shall be accompanied by a physician 's

statement indicating anticipated date of confinement.

Actual performance of duties will terminate at a t ime mutually agreed

upon by the teacher and the Board.

A physician 's statement indicating that the teacher is physically able to

resume full teaching duties shall be presented prior to reassignment.

In accord with the provisions contained herein, reinstatement of a

teacher on maternity leave shall be made at the ear l iest date practicable but only

when a suitable opening is available. A teacher returning from extended

maternity leave shall have an opportunity to discuss and express her preference

for reassignment with the Superintendent or his designated representativ e if she

so requests. Rejection of the assignment when offered shall void the leave

protection and shall automatically be treated as a voluntary resignation.

Teachers on maternity leave who desire reinstatement at the beginning of

the next school year shal l notify the Superintendent of their availabil i ty for

assignment. Teachers shall give notice prior to May 10 if they expect to return to

full t ime employment at the beginning of the school year next following. Upon

approval of the Superintendent, the leave may be extended one school year

beyond the year in which confinement occurs .

Notification of availabil i ty for assignment shall be given within nine (9)

months following confinement. Failure to provide such notification shall

consti tute an act of resignation.

Nothing herein shall be interpreted to assure a teacher of a posit ion or

building assignment identical to that previously held except that i t shall be in a

posit ion for which the individual has fulfi l led the requirements for cert if ication.

Teachers requesting and being granted maternity leave shal l retain

employment rights and benefits relating to tenure, posit ion on the salary

schedule, accumulated disabil i ty leave and coverage under the retirement system

of the district .

No payment of salary under terms of the disabil i ty leave policy shall be

made to any teacher for disabil i ty during the period of t ime for which extended

maternity leave is granted.

Parental and Adoptive Leave

A teacher with three (3) or more years of service in the district may be

granted a leave of absence without pay for the purpose of parental or child care

or for the purpose of child adoption provided that any such leave granted will be

subject to the following:

Such leave shall not extend beyond the current school year. Termination

of performance of duty shall be at such t ime as mutually agreed upon by the

teacher and the Board.

No teacher under contract during the contract year in which the

returning teacher applies for reinstatement following such leave will be

terminated in order to provide a posit ion for the teacher making an application

for reinstatement.

The teacher planning to apply for leave for the purpose of child

adoption shall notify the principal in writ ing of such intenti on at the same time

that the teacher 's application for adoption is submitted to any agency or authority

No teacher will be granted parental or adoptive leave following

disabil i ty leave when the reason for the request for parental leave is based upon

the same factual si tuation for which the prior disabil i ty leave was granted;

provided that the decision of the Board shall be final .

The reinstatement of a teacher on parental or adoptive leave shall be

contingent upon the teacher being cert if ied and qualified in those activit ies and

disciplines for any exist ing vacancy, and provided further, the rejection of an

assignment when offered shall void the leave p rotection and shal l automatically

be treated as a voluntary resignation.

Teachers on parental or adoptive leave who wish to return to the district

shall notify the Personnel Office in writ ing on or before May 10 of the year in

which the leave was granted. Failure to provide such notification shall consti tute

an act of resignation.

For the purposes of this subsection, "child care," "parental care," "child

leave," or "parental leave" shall mean that care or leave necessitated by the

physical or mental i l lness or disabil i ty of the child or parent of the applicant.

Authorized Absence

A teacher may be granted five (5) days of authorized absence for personal

reasons without pay during any school year for activit ies which cannot

reasonably be performed outside of regular duty hours or on a nonschool day.

Such authorization shall not be granted on any day preceding or following

a holiday, holiday weekend, or any vacation period including the opening and

closing days of the school year.

Application for authorized absence shall be made in writ ing at least two

(2) days in advance of the absence and stat ing the reasons which necessitate the

leave.

Extension of authorized absence beyond five (5) days may be granted

without pay when such extension is considered by the Superintendent as in the

best interest of the school district .

Authorized absence days shall be noncumulative .

Approval of authorized absence shall be by the Superintendent or his

designated representative.

Bereavement Leave

A maximum of three (3) days absence per occurrence or five (5) days if

the distance is more than 400 miles, one way) without deduction in pay during

any year may be allowed for reasons of death in the immediate family as defined

herein.

As used herein, "immediate family" shall designate the teacher 's spouse,

children, parents, brothers, sisters, grandparents, grandchildren, and spouse 's

parents, grandparents, grandchildren, brothers and sisters by blood or marriage.

Bereavement leave t ime shal l not accumulate.

Any request for bereavement leave shall be in writ ing. Approval shall

be granted by the Superintendent or his designated representative.

Personal Leave

A two (2) day absence without deduction in pay during any year may be

allowed for personal leave.

To be classified as personal leave, authorization must be secured prior

to the day leave is taken except for instance of emergency. Teachers desiring to

use personal leave shall submit their request in writ ing at least f ive (5) working

days in advance of the anticipated absence. In cases of an emergency not covered

by emergency leave , the notification for such leave must be made to the principal

or immediate supervisor on or before the day of leave b y the normal absence

reporting procedures , and a writ ten request shall be submitted within three (3)

days of the absence. All requests for personal leave must be submitted to the

office of the Superintendent or his designated representative.

Sabbatical Leave

A sabbatical leave may be granted to a full -t ime teacher to provide

opportunity to engage in professional experiences having a major force on self -

improvement and which also will have posit ive consequences for the teacher 's

students and/or co-workers.

The applicant must have been employed in the district for at least f ive

(5) consecutive years beyond the applicant 's statutory probationary period.

Absences from service for a period of more than one (1) year under a leave of

absence with or without pay shall be deemed a break in continuity of service. The

applicant must not have been granted a sabbatical leave from the district during

the seven (7) consecutive years of service immediately preceding the current

application.

Applications shall be fi led with the office of the Superintendent by

March 1 for leave for the next school year . Applicants requesting sabbatical

leave shall be notified by April 1 as to the s tatus of their application. Applicants

shall include an outl ined plan for the year requested. The plan shal l include:

The activity or activit ies to be undertaken during the leave;

The benefit of the leave for the teacher;

The benefits to be realized by students and/or other staff as a result

of the leave.

The plan shall be indicated on the application form or as an attached statement.

A sabbatical leave shall be compensated at 50% of full contracted

salary and 100% of benefits provided a full -t ime teacher for the year of the

leave. Upon return from sabba tical leave, the teacher shall be placed at the

posit ion on the salary schedule he/she would have attained had he/she taught in

the district during such period.

Upon completion of sabbatical leave, the teacher shall be reassigned in

a posit ion which is comparable to the one held when assuming sabbatical leave

status, exclusive of supplemental assignments. The teacher shall retain all

accumulated disabil i ty leave days but no such days shall accumulate during the

period of the sabbatical leave.

Selection of teachers for sabbatical leave shall be made by the

Superintendent or his designated representat ive(s). The following factors shall be

considered when making the selection:

1. Merit of the applicant 's proposed program;

2. Applicant 's length of service in the district ;

3. Applicant 's quali ty of service as determined by evaluators ' and

administrators ' recommendations;

4. Distribution from the areas of elementary, middle, high scho ols, special

education;

5. Availabil i ty of qualified replacements.

Annually, no more than three (3) el igible teachers shall be granted

sabbatical leave for the following school year.

As a condition for the granting of sabbatical leave, the teacher shall

sign an agreement to return to the district for at least two (2) years of service

immediately following the sabbatical leave. Upon failure by the teacher to

perform the required service, he/she shall repay the district the amount paid to

the teacher by the district during the sabbati cal leave. Such payment shall be due

within ten (10) days of the teacher 's fai lure to commence or continue his/her

assigned duties.

The teacher shall not deviate from the approved program before i ts

completion without writ ten permission of the Superintend ent. Failure to receive

writ ten permission shall result in the district immediately stopping all payments

to the teacher.

Personal leave shall not be used for seeking other employment,

rendering services, nor working either with or without remuneration for

themselves, nor for anyone else, for hunting, for f ishing, nor other recreational

activit ies, nor because of severe weather when school is in session. Absent the

existence of extenuating circumstances, which shall be determined solely by the

.

Superintendent and/or designee, and which such determination shall not be

subject to further review or appeal, such personal leave shall not be granted for

the first eight (8) nor the last f ive (5) duty days; nor on the fir st duty day

preceding or following a holiday or non - working day; nor on any in-service

days.

Unused personal leave days may not accumulate; however, any days of

unused personal leave shall be credited as days of disabil i ty leave unless the

teacher has accumulated the maximum allotment of 185 disabil i ty leave days.

The district reserves the right to refuse requests when the number of

requests made on any given day is such as to exceed the available supply of

substi tutes. Approval will be granted in the or der of application except for clear

emergency si tuations.

Disability Leave Bank

USD No. 500 shall establish a disabil i ty leave bank for teachers who

choose to participate. The day-to-day administration of the bank shall be the

responsibil i ty of the Dist rict . This bank shall be governed by the following

regulations.

Those who choose to participate shall contribute one (1) day of their

accumulated temporary disabil i ty leave to the bank at the beginning of their

period of participation.

An employee who meets the eligibil i ty requirements and who suffers a

serious health condition shall be enti t led to annual use of the disabil i ty leave

bank consistent with the following table:

2 nd year in the district no more than 60 calendar days

3 r d year in the district no more than 90 calendar days

4 or more years in dist rict no more than 180 calendar days

These years of employment must be consecut ive.

Only participating teachers would be eligible to draw from the bank.

The periods for which participating teachers are eligible to use days

from the bank shall begin on the fourth (4th) consecutive contract day of an

absence for which the teacher had no accumulated temporary dis abil i ty leave

days . Eligibil i ty shall continue unti l (1) the teacher is able to return to duty, or

(2) unti l the date which reflects the maximum number of benefit days after the

date of the commencement of the disabil i ty for which use of the disabil i ty le ave

bank is sought, whichever occurs first . However , in no event shall a person,

within a twelve-month period be eligible for use of the disabil i ty leave bank in

an amount which exceeds the l imitations set forth in the table above.

In no case shall addit ional days be granted that would extend beyond

the teacher’s current contract year.

Should the total number of days in the leave bank drop below 250,

al l part icipants who have a personal accumulation of one (1) or more temporary

leave days shall contribu te one (1) addit ional leave day to the bank.

Teachers may enroll in the temporary disabil i ty leave bank at the

beginning of each contract year but must submit the appropriate form by October

after October 1 must wait unti l the following year. Teachers hired after the

beginning of the contract year who desire to enroll must do so within thirty (30)

calendar days after their f irst day a t work or by October 1 of the current contract

year, whichever is later.

Once enrolled, part icipation remains in effect unti l the teacher notifies

the District that the teacher desires to withdraw from participation in the bank.

The period during which wi thdrawal is al lowed coincides with the enrollment

period. Any request for withdrawal from participation which is submitted during

the enrollment period takes effect immediately. Any request for withdrawal from

participation which is not submitted during th e enrollment period takes effect at

the beginning of the next enrollment period. No days previously contributed may

be restored to the teacher 's personal accumulation.

Leave days from the bank may be used only due to disabil i ty on the part

of the participating employee. No such days may be used due to the disabil i ty of

any other person.

Teachers whose contracts are terminated or nonrenewed in accordance

with Kansas law shall not be allowed to use temporary disabil i ty leave bank days

to otherwise extend their employment.

Teachers shall not be allowed to withdraw days from the disabil i ty leave

bank for any days for which workers ' compensation benefits are received.

Use of the Disabil i ty Leave Bank for a period in access of two

consecutive years is prohibit ed.
