LinfieldCollegeoperatesundertheassumptionthatallstudentsarehonestandethicalinthewaytheyconducttheirpersonalandscholasticlives.Academicworkisevaluatedontheassumptionthattheworkpresentedisthestudent’sown,unlessdesignatedotherwise.Anythinglessisunacceptableandisconsideredaviolationofacademicintegrity.Furthermore,abreachofacademicintegritywillhaveconcreteconsequencesthatmayincludefailingaparticularcourseorevendismissalfromthecollege.
Violationsofacademicintegrityincludebutarenotlimitedtothefollowing:
• Cheating:Usingorattemptingtouseunauthorizedsources,materials,information,orstudyaidsinanysubmittedacademicwork.
• Plagiarism:Submissionofacademicworkthatincludesmaterialcopiedorparaphrasedfrompublishedorunpublishedsourceswithoutproperdocumentation.Thisincludesself-plagiarism,thesubmissionofworkcreatedbythestudentforanotherclassunlessheorshereceivesconsentfrombothinstructors.
• Fabrication:Deliberatefalsificationorinventionofanyinformation,data,orcitationinacademicwork.FacilitatingAcademicDishonesty:Knowinglyhelpingorattemptingtohelpanothertoviolatethecollege’spolicyonacademicintegrity.
Facultyrecognizetheirresponsibilitytohelpstudentsunderstandacademicintegrityandhowtoconductthemselveswithintegrityintheclassroom.Tothisend,facultyshallincludeaclearacademicintegritypolicywithintheirsyllabus.
Indealingwithbreachesofacademicintegrity,theinstructorshallhavediscretionastowhatpenaltytoimposeregardingthecoursegrade.Withintendaysofthediscoveryofanoffense,theinstructormustsubmitinwritingadescriptionoftheoffensetoboththestudentandtheDeanofStudentsordesignee.Thisdescriptionshouldincludethecourseconsequencesforviolationsofacademicintegrityandthepenaltygiveninthespecificcase.Ifthestudentdisagreeswiththeaccusationofabreachofacademicintegrity,thestudentwillusetheAcademicGrievanceprocessasoutlinedinthesectionentitledAcademicGrievances.Inaddition,itisrecommendedthatfacultyissueanacademicalertforanyviolationoftheacademicintegritypolicy.
TheDeanofStudents,ordesignee,willmaintainaconfidentiallistofstudentswhoarereportedforviolationsofacademicintegrityinordertotrackrepeatoffenses.ThedeanwillhavediscretiontoreferafirsttimeoffendertotheCollegeConductBoard;however,anysubsequentviolationsbythesamestudentwillautomaticallybereferredtotheConductBoard.Thisdecisiononreferralwillbecommunicatedinwritingtothestudentandtotheinstructor(s),whohas(have)alegitimateeducationalinterest.
TheConductBoardmayimposecollege-levelpenaltiesupontheoffendingstudent.Fundamentalfairnessshallbeinforceforallacademicintegrityproceedings,asoutlinedinthePoliciesandProceduresoftheCollegeConductBoard. SEXUALMISCONDUCT Inkeepingwithitsmission,Linfieldcommitsitselftoprovidinganenvironmentwhichissafeandwhichfostersexcellenceinlearningforitsstudentsandinworkperformanceforitsemployees.Linfield’sexpectationsofcivilityamongcommunitymembersexceedthoseappliedtothepublicatlarge.ItisthepolicyofLinfieldCollegethatnomemberoftheCollegecommunityshallengageinsexualmisconductorrelationshipviolenceagainstanothermemberoftheCollegeorlargercommunityandthat,shouldthisoccur,theCollegewill,totheextentitisable,supportthereportingpartyandpursuesanctionsagainsttherespondingparty.Tothisend,theCollegeshallannuallyappriseitsstudents,faculty,administratorsandstaffofthispolicy,andinformthemaboutthemeaningandeffectsofsexualmisconductandrelationshipviolence.Fortheprotectionofthecommunity,theCollegemaytakeactionagainstthosewhocommitsuchmisconduct.Intakingaction,thecollegewillmakeeveryattempttoprovideasmuchanonymityforthereportingparty(s)andtherespondingparty(s)aspossible.Infulfillingthispolicyanditsprocedures,theCollegeshallseektoavoidcreatingaclimateortakingactionsthatcould,inthemselves,havetheeffectoffurtherharmingareportingparty.TheLinfieldCollegeSexualMisconductandRelationshipViolencePolicy,whileprohibitingoffensesforbiddenbyOregonlaw,alsoprohibitsconductthatmaynotbeacrimeunderOregonlaw.Asaresult,LinfieldrequiresahigherstandardofconductformembersoftheLinfieldcommunitythanthoseappliedtothepublicatlarge.LawenforcementagenciescontactedaboutsexualmisconductorrelationshipviolenceatLinfieldwillfollowOregonlaw,notLinfieldCollege’sSexualMisconductPolicy.

SexualHarassment:Sexualharassmentisunwantedsexualadvances,requestsforsexualfavors,orvisual,verbal,orphysicalconductofasexualnaturewhen:(1)submissiontosuchconductismadeatermorconditionofemploymentortheeducationalrelationship;(2)submissiontoorrejectionofsuchconductisusedasabasisforemploymentoreducationdecisionsaffectingtheindividual;or(3)suchconducthastheeffectofunreasonablyinterferingwithastudent’soremployee’sworkperformanceorcreatinganintimidating,hostile,oroffensiveworking,educational,orlivingenvironment.Whilesexualharassmentencompassesawiderangeofconduct,someexamplesofspecificallyprohibitedconductinclude:
i. Promising,directlyorindirectly,astudentoremployeeareward,ifthestudentoremployeecomplieswithasexuallyorientedrequest.
ii. Threatening,directlyorindirectly,retaliationagainstastudentoranemployee,ifthestudentoremployeerefusestocomplywithasexuallyorientedrequest.
iii. Denying,directlyorindirectly,astudentoremployeeanemploymentoreducationrelatedopportunity,ifthestudentoremployeerefusestocomplywithasexuallyorientedrequest.Engaginginsexuallysuggestiveconversationorphysicalcontactortouchinganotherstudentoremployee.

4. Bothreportingpartyandrespondingpartyshallbeentitledtoanexpeditioushearingofthecase.
5. Thehearingshallbeofaninformalnatureandneednotadheretoformalrulesofprocedureortechnicalrulesofevidencefollowedbycourtsoflaw.

AnystudenthavingbeenaccusedofsexualmisconductorrelationshipviolenceandhavinghadahearingbeforetheCollegeConductBoardmayappealthedecision.Thereportingpartymayalsoappealthedecision.AnystudentwishingtoappealmustlodgeastatementinwritingtotheDeanofStudents.Suchanappealmustbelodgedwithinsevendaysofnotificationoftheoriginaldecision.Thewrittenappealshouldpresentspecificinformationastothereasonfortheappeal.Appealsmaybesubmittedundertwoconditions.
1. TheconductproceduresoutlinedintheStudentHandbookwerenotfollowedduringthestudent’soriginalhearing,or
2. Newandsignificantevidenceisavailablewhichwasunknownandcouldnothavebeenknownatthetimeofthehearing.
Theseverityofsanctionisnotconsideredalegitimategroundforanappeal.Onlyoneappealisallowedperstudentinvolved.TheDeanofStudentswillreviewthewrittenappealandotherpertinentinformationandwillnotifythestudentinwritingoftheDean’sdecision.
GUIDELINESFORTHESEXUALMISCONDUCTANDRELATIONSHIPVIOLENCEHEARINGS:
Inordertoprovideequityandefficiencyintheadministrationofconductreviewprocedures,thefollowingguidelineshavebeencreated.Theseguidelinesshouldbeinterpretedinlightofthephilosophyandproceduresstatedabove.Ifthereismorethanonereportingpartyormorethanonerespondingpartyforaspecificincident,thecasesmaybeconsideredseparately.
Thehearingshallbeconductedinaccordancewiththefollowinggeneralformat.
1. Thechairpersonshallinformallpartiesinvolvedoftheproceduretobefollowedatthehearing.
2. Thechairpersonshallthenreadthechargesagainsttherespondentandshallaskthatindividualiftheyunderstandthechargesandwhetherornottheyconcurwiththem.Iftherespondingpartyconcurs,theCollegeConductBoardshallthenconsiderthechargesasaccurateandhearanyinformationthattherespondentmaypresentinmitigationorexplanation.

3. Iftherespondingpartydoesnotconcur,theCollegeConductBoardshallthenheartheevidenceinsupportofthecharges.ThereportingpartymaypresenttheseormayaskanAdvisortodosointheirbehalf.Afterpresentationoftheevidenceinsupportofthechargestherespondingpartyshallhavetheopportunityto:
a. presentevidenceinrefutationofanyorallthecharges,
b. presentanyotherrelevantinformation,
c. questionwitnessestestifyinginsupportofthecharges.
4. Boththereportingparty(ortheirproxy)andtherespondingpartymayaskquestionsoftheCollegeConductBoardmembers.Membersmayaskquestionsofthestudentchargedaswellasofanywitnesstestifyingatthehearing.Off-campusadvisorsmaynotenterintodiscussion,askquestionsormakecommentsduringthehearing.
5. Thestudentsandallothernon-membersoftheCollegeConductBoardwillbeexcused,excepttheDeanofStudentsordesigneewhoistobeconsultedconcerningpenalty.
6. TheCollegeConductBoardwilldeliberateandformulateitsfindingsandrecommendations.
FINDINGSANDRECOMMENDATIONS:
Thestandardofproofrequiredinstudentdisciplinecasesisbasedonthepreponderanceoftheevidence.Afterhearingacase,theCollegeConductBoardmaydecideasfollows:
1. Notresponsibleforaviolation:Noviolationofaregulationhasbeenproved.
2. Responsibleforaviolation:Aviolationofaregulationhasbeenproved.Inthiscase,theBoardmayimposeanumberofsanctions,individuallyorinacombination,including:
a. warning:anofficialreprimandinwriting,deliveredtotheaccusedstudentandplacedinthestudent’sfile;
b. probation:aconditionthatstipulatesthatanyfurtherviolationsofregulationsmayresultinasuspension.Lengthofprobationwillbespecified;
c. probationwithterms:aconditionthataddstoregularprobationstipulationsthatmaydenytheaccusedstudentcertainprivilegesorrequirescertainactionofthestudent;
d. recommendationforsuspension:separationfromtheCollegeforadefiniteorindefiniteperiodoftime;
e. recommendationfordismissal:permanentseparationfromtheCollege;and/or
f. otheractionthatmayseemappropriateforanygivencase.Sanctionsagainstgroupsincludethoselistedaboveina-f,andalsodeactivation,lossofallprivileges,includingcollegerecognition,eithertemporarilyorpermanently.
RESPONSIBILITIESOFTHECHAIRPERSON:
ThechairpersonoftheCollegeConductBoardortheDeanofStudents’designeehasthefollowingresponsibilities:
1. TonotifyboththereportingpartyandtherespondingpartyofchargesbroughtandtoprovideeachpartywithacopyoftheCollege’sSexualMisconductandRelationshipViolencePolicyandProcedures;
2. Tomakeallarrangementsforthehearing,includingtime,place,notificationofpersonsinvolved,andarecordofthehearings(SecretarialsupportwillbeprovidedbytheexecutiveassistanttotheDeanofStudents);
3. Todecideallproceduralmattersduringthehearinginaccordancewithestablishedwrittenguidelinesandnormaldueprocess;
4. Tocontroltheconductofthehearingwithauthoritytoexcludeanypersonwhorefusestocomplywiththerulesordeterminationsofthechairperson;

LinfieldCollegeispartoftheMcMinnvilleCommunity.Allstudentshaveanobligationtobehaveinamannerthatcreatesgoodrelationshipswithourneighbors.Behavioroncampusandoffissubjecttocollegepolicyandtothesamerules,regulationsandlawsasapplyelsewhereinthecity,andlocalpolicehavejurisdictionbothonandoffthecampus.Anyoneapproachedbycampusorlocalauthorities:
–shouldbecourteous,–shouldshowidentificationuponrequest,–shouldbetruthful,and–shouldcomplywithrequestsmadebythoseactingwithintheirscopeoftheirauthoritywhiledoingtheirduty.
Everyfacultymemberandstudenthavetherighttoconditionsfavorabletoteachingandlearningbothinandoutoftheclassroom.Tofosterandmaintainsuchconditions,studentshavetheresponsibilitytoconductthemselves,individuallyandingroups,inamannerwhichpromotesanatmosphereconducivetoteaching,studying,andlearning.Studentsareexpectedtoupholdacademicandpersonalintegrity,torespecttherightsofothers,andtorefrainfromdisruptive,threatening,intimidating,orharassingbehavior,orbehaviorwhichisharmfultothemselves,otherpersons,orproperty.Facultyhavetherightandresponsibilitytofosteranenvironmentconducivetoteachingandlearning,andshouldthisbethreatenedbystudentbehavior,facultyareauthorizedandencouragedtoinitiatethefollowingsteps:
1. Aprivatediscussionwiththestudentduringwhichthefacultymemberdescribestheunwantedbehavior,explainswhyitisinappropriate,andspecifiesexpectationsforfuturestudentbehavior.
2. Initiationofaformalmeetingwiththestudent,thestudent’sacademicadvisor,and/ortheDeanofStudentsorthedean’sdesignee.
3. Request,throughtheDeanofStudents,thatthestudentbewithdrawnfromtheclass.
4. Initiationofotherdisciplinaryaction,incoordinationwiththeDeanofStudents,bymeansoftheappropriatejudicialprocesses.

LINFIELDDRUG&ALCOHOLPOLICY
Inkeepingwiththemissionofthecollege,Linfieldiscommittedtoprovidinganenvironmentthatissafeandfostersexcellenceinlearningforitsstudentsandinworkperformanceforallofitsemployees.Therefore,themisuseandillegaluse,possession,transportation,distribution,manufacture,orsaleofalcoholandotherdrugsisnotpermittedonpropertyownedorcontrolledbytheCollege,orwhilerepresentingtheCollegeonbusinessorinothercollegesponsoredactivity.TheuseofalcoholoncollegeownedorcontrolledpropertyorateventsassociatedwithLinfieldprogramsisrestrictedtothoseoflegaldrinkingageinthatlocale.
• Thoseunder21yearsofagemaynotconsumealcohol(exceptinforeignlocationswithpermissionfromtheon-sitedirectorandwithinthelawsofthatlocation).
• Providingalcoholtominorsorprovidingalocationwhereminorscanconsumealcoholisprohibitedandisaviolationofthealcoholpolicy.
• Those21andovermayconsumealcoholoncampusonlyintheprivateroomsorapartmentsofthose21andoverwiththedoorclosed.Allotherareasofthecollege,indoorandoutareconsideredpublicareas.
• AlcoholisnotpermittedinpublicunlesssuchuseisspecificallyauthorizedinwritingbythePresidentorthePresident’sdesignee.

• PublicconsumptionofalcoholorpublicPossessionofanopencontainerofalcoholanywhereoncampusisaviolationofLinfieldpolicyandMcMinnvilleCityOrdinanceregardlessofastudent’sage.Collegeapartmentbalconiesareconsideredpublicareas.
• Kegs,beerbongsandotherlargecontainersofalcoholarenotpermittedincollegeownedoraffiliatedpropertiesandwillbeconfiscatedandwillnotbereturned.
• Ifminorsarepresentwherealcoholisbeingconsumed,allpersonstheremaybeheldinviolationofthecollegealcoholpolicyunlesstheminorscandemonstratethattheyconsumednoalcohol.Thiscanonlybedonebyvolunteeringforabreathalyzer,administeredbyCollegePublicSafety.Itiseachstudent’srightandresponsibilitytorequestabreathalyzerbycontactingCPS.Becausealcoholmisuseisaverycommonhindrancetosuccessincollege,thecollegewilltreatanyverifiableviolationofanystateorlocalalcohollawsonoroffcampusbystudentsasaviolationofthecollegealcoholpolicy.
Forstudents,minimumresponsestoalcoholpolicyviolationsareasfollows:
o FirstviolationsresultinameetingwitharepresentativefromtheDeanofStudents’Officeandarequirementtocompleteaneducationprogram,whichmaybeatthestudent’sexpense.
o SecondviolationsresultinameetingwitharepresentativefromtheDeanofStudentsOfficetodeterminetheneedforaneducationalresponseand/orreferraltoaCertifiedAlcoholandDrugCounselor(bothatthestudent’sexpense).

DRUGS
LinfieldCollegeisadrug-freeworkplace.TheseregulationsarepartoftheFederalDrug-FreeSchoolsandCommunitiesAct.Theregulationsrequirethat,asaconditionforreceivingfederalfinancialassistance,aninstitutionofhighereducationmustcertifythatithasadoptedandimplementedaprogramtopreventtheunlawfulpossession,use,ordistributionofillicitdrugsandalcoholbyitsstudentsandemployeesonschoolpremisesoraspartofanyofitsactivities.AnymemberoftheCollegecommunitywhouses,isundertheinfluenceof,manufactures,possesses,hasunderhis/hercontrol,sells,furnishes,orfacilitatestheuseofanarcoticordangerousdrugordrugparaphernaliaormisusesprescriptionmedication,issubjecttodisciplinaryactionuptoandpossiblyincludingseparationfromtheCollege.Thisincludesthepossessionoruseofmarijuana,marijuanaoil,foodproducts,etc.
Becausedruguseisahindrancetosuccessincollege,thecollegewilltreatanyviolationofanycollegepolicy,stateorlocaldruglawsonoroffcampusbystudentsasaviolationofthecollegedrugpolicy.McMinnvillePoliceDepartmentmaybecontactedattheCollege’sdiscretion.

Stepsusedbystaffwhenrespondingtopossiblepolicyviolationsmayinclude(Dependingonthespecificcircumstances,theorderofthesestepsortheentireprocessmaychangeasthesituationwarrants):
• Staffwillknockonthedoorandannouncewhotheyare.Thoseresidentspresentneedtorespondandanswerthedoor.FailuretorespondinatimelymannerwillresultinanadditionalknockandanannouncementthatResLifewillbeenteringtheroomorapartment.
• StudentsthatliveintheroomorapartmentwillbeaskedtoturndownthemusicandtospeakwithaResidenceLifeorCPSstaffmember.Itwillbeexplainedtothemthatthereisaconcernthattheremaybeapossibleviolationofpolicy.
• Studentswillbeinformedthattheyareresponsibleforallindividualsintheirroomorapartment(includingthebalcony)andthatALLcollegepolicies(includingalcohol)mustbefollowed.
• Ifalcoholand/ordrugsarepresentorstaffbelievethatotherpoliciesmaybeinviolationtheroomorapartmentmaybesearchedatthistime.IndrugcasesstudentscanworkwiththeCollegeorthepolice.
• ThepolicewillbecalledintohelpsearcharoomifstudentsarenotcooperativeoriftheCollegefeelsadditionalassistanceisneeded.

• Astudent’sentireroomorapartment(allrooms)willbesearchedduringtheIDcheckprocesstomakesurethatallstudentsareproperlycheckedforID.
• Ifallpresentareoflegaldrinkingage,studentswillbeinformedthatthestaffwillbereturningtocheckontheapartment/roomandifatthattimenoiseisstillaproblemthestaffwillaskthatallnon-residentsleavetheroomorapartment.
• Ifanyillegalsubstancesarepresent,staffwillcollectallnamesofpeoplepresentandtheillegalsubstanceswillbeconfiscatedandturnedovertothepolice.
• IFMINORSAREPRESENT…Staffwillcollectallnamesofpeoplepresent.IfminorswishtovolunteerforabreathalyzerCPSwillbecalledandthestudentswillbeaskedtowaittosubmittothetest.IFYOUAREAMINOR:YOUMUSTREQUESTABREATHALYZERORYOUWILLBEASSUMEDINVIOLATION.

• Ifanyminordoesnottakethebreathalyzerorifanyminordoesnotpassthebreathalyzerthenallnon-residentsoftheroomorapartmentwillbeaskedtoleaveandoneofthetwofollowingactionswilloccur:
o Ifallresidentsoftheroomorapartmentareoflegaldrinkingage(21)thenallopencontainerswillbedumpedandanyunopenedcontainersofalcoholwillbeallowedtoremainintheapartmentorroom.
o Ifanyresidentoftheroomorapartmentisunderthelegaldrinkingage(under21)thenallcontainersofalcoholwillbeconfiscatedanddumpeddownthemostconvenientdrain.Allalcoholbottleswillberecycledwhenpossible.
• Ifanallegedpolicyviolationhasoccurredallstudents’nameswillbesenttotheAssociateDeanofStudentsfordeterminationoftheappropriateconductreviewprocess.StudentscanfindacopyoftheConductReviewProcessintheStudentHandbook.
DRUG-FREESCHOOLANDCOMMUNITYACT
LinfieldCollegeisrequiredbyfederallaw(theDrug-FreeSchoolandCommunityAct)topublishthefollowing:DrivingUndertheInfluenceofIntoxicants(DUII)ItisillegaltodriveinOregonwithaBloodAlcoholCount(BAC)of.08%ormore,orundertheinfluenceofintoxicants(alcoholandotherdrugs).DUIIisaClassAmisdemeanorthatcancarryamaximumfineofupto$5,000.Youmaybefound guilty at a lower BAC reading - or even without a breath test if you show visible signs of physical or mental impairment. OTHERDRUGSANDDRIVING
Oregon’sDUIIlawstatesthatitisillegaltodriveundertheinfluenceofeitherintoxicatingliquororacontrolledsubstance(over-the-counter,prescriptionorillicitdrugs),oracombinationofboth.
OPENCONTAINERLAW
InOregon,it’sagainstthelawtodrinkanyalcoholicbeverageinacaronapublichighway,andit’sillegalforthedriverorpassengertohaveanopencontainerinthecaronahighway,movingornot.
IMPLIEDCONSENTLAW
Thislawprovidesthatanyone(whetherlicensedinthisstate,someotherstateorunlicensed)isdeemedtohavegivenconsenttoabloodalcoholcount(BAC)testwhenarrestedfordrivingundertheinfluence(DUIDonapublichighwayorpremisesopentothepublic.

Penalty:Themandatoryminimumfineforafirstoffenseis$350.Themaximumwhichcouldbeimposedisafineupto$2,500,oneyearinjail,orboth.
IDENTIFICATION
Ifyouare21orolderandattempttopurchasealcoholicbeveragesorenteranestablishmentwhereliquorisserved,youmustbeabletoproduceadriver’slicense,or,ifthelicensedoesn’thaveyourphotograph,anidentificationcardissuedtheMotorVehiclesDivision.
Itisagainstthelawforyouto:
• LoanyourlicenseorIDcardtosomeoneelse. • AttempttouseacardbelongingtosomeoneelseorattempttouseafalsifiedIDcard. • Makeawrittenstatementofagethatisfalseinwholeorinpart,orproduceanyevidencethatwouldfalselyindicateyourage,

LinfieldCollegeisstronglycommittedtothehealth,safety,andwellbeingofallitsstudents.Studentsareencouragedtolookoutnotonlyfortheirownhealthandwellbeing,butalsoforthatoftheirpeers.Whensomeone’shealthorsafetyisthreatenedorappearstobeatrisk,studentsshouldtakeimmediateactiontopreventinjury,illness,ordanger.MedicalClemencyisapolicythatallowsstudentstoseekhelpforthemselvesorothers,involvedinadrugoralcoholrelatedemergency,withoutbeingreferredtotheformalconductprocess.
LinfieldCollegeisdeeplyconcernedthat,inamedicalemergencyinvolvingalcoholorotherdrugs,somestudentsmayconsiderrefrainingfromcallingforhelpbecauseoffearthatdoingsomightsubjectthemtodisciplinaryaction.Toaddressthisconcern,thefollowingprotocolwillbeusedforaddressingpossibledisciplinaryconsequenceswhenmedicalemergenciesresultfromtheuseofalcoholorotherdrugs.AstudentmayonlyclaimMedicalClemencypriortoanyreportordiscoveryofanalcoholordrugviolationbyResidenceLifeorCPSstaff.
• Anyindividualwhoseekscampusormedicalassistanceonbehalfofanotherstudentduringanalcoholorotherdrug-relatedemergencywillmeetwiththeappropriatecollegeofficial(s)todiscusstheincident,butwillnotbesubjectedtodisciplinaryproceedingsthroughLinfieldCollege’sconductreviewprocessforpossessionorconsumptionofalcoholorotherdrugs.
• TherecipientofmedicalclemencywillnotberequiredtoresolvethematterthroughLinfieldCollege’sconductreviewprocessifshe/heagrees(1)toparticipateinareferraltoanappropriatecampusorcommunityresource,and(2)tocomplywithanypossiblerecommendationssetforthbythatresource.Iftherecipientofmedicalattentiondoesnotcomplywithprovisionsoneandtwothenheorshewillbesentthroughthenormalconductreviewprocess.(3)Becausethesafetyandwellbeingofourstudentsissuchaconcern,studentswithmultipleMedicalClemenciesmaybeaskedtoseekaprofessionalevaluationregardingtheiralcoholand/ordruguse.
• Ifanindividualorrepresentativeofanorganizationhostinganeventcallsformedicalassistance,thisactofresponsibilitywillalleviateanyconductreviewsanctionsagainsttheindividualororganizationthatmightarisefromthepossessionorconsumptionofalcoholorotherdrugs.ThisconditionwillapplyinisolatedincidentsonlyandwillnotexcuseorprotectthoseindividualsororganizationsthatflagrantlyorrepeatedlyviolatetheLinfieldCollegeAlcoholandDrugPolicies.Similarly,failuretocallforcampusormedicalassistanceinanalcoholordrugrelatedemergencywillbeconsideredan“aggravatingcircumstance”andmayaffecttheconductreviewresolutionagainsttheindividualororganization,ifviolationsoftheLinfield’sStudentCodeofConducthaveoccurred.Thisprotocolrefersonlytoincidentsoccurringatcollegeandfraternityhousing.

State-licensedcounselorsandthecollegechaplainbystateorderareimmunefrombeingcompelledtodivulgeconfidences.Anycommunicationwithastate-licensedcounselororthecollegechaplainisnotacomplaint.
REPORTINGACOMPLAINT:

INVESTIGATIONPROCEDURES:
1. TheDeanofStudentsordesigneeisresponsiblefordocumentingthecomplaintanddetermining,withconsultationasheorshedeemsappropriate,whowillconducttheinvestigation.
2. TheDeanofStudentsorotherdesignatedinvestigatorwillprovidebothpartiestheopportunitytopresenttheirsideoftheincident.Theinvestigationwillincludeseparateinterviewswiththecomplainant,theaccused,andanyotherrelevantwitnessesasappropriateunderthecircumstances.

StudentsareexpectedtoconductthemselvesinaccordancewiththerulesandregulationsoftheCollege.Students,likeallmembersoftheCollege–trustees,faculty,administration,andstaffmembers–assumetheresponsibilitytoconductthemselvesincompliancewiththeobjectivesandstandardsofconductestablishedbytheCollege.Thesestandardsapplybothoncampusandonline.
ByenrollingintheCollege,studentsaccepttheresponsibilitytobecomefullyacquaintedwiththeCollege’spoliciesandstudentcodeofconductandtocomplywiththeCollege’sauthority.TheCollegeexpectsstudentstomaintainstandardsofpersonalintegritythatareinharmonywiththeeducationalgoalsoftheinstitution;torespecttherights,privileges,andpropertyofothers;andtoobservenational,state,andlocallawsandCollegepolicies.

15. Hazingorinitiationritesinvolvingphysicalabuseormentalanguish.
16. Illegalactivitiesinvolvingcontrolledsubstances.
17. ViolationoftheCollegepolicyonalcoholandotherdrugs.
18. Possession,useorthreateneduseoffirearms,ammunition,explosives(includingfireworks),dangerouschemicals,oranyotherobjectsusedasweaponsonCollegepropertyoratCollege-sponsoredorsupervisedactivities.
19. Tamperingwithfire-fightingequipmentoralarms,turninginafalsealarmorengaginginotherbehaviorthatconstitutesasignificantfirehazard.

Anystudentaccusedofviolatingaregulationshallappearbeforeoneormoredulyconstitutedconductpersons(theDeanofStudents,AssociateDeanofStudentsoracollegeconductofficer)orboards.However,theCollegereservestherighttorespondimmediatelyinsituationsinwhichtheCollegeoritsrepresentativesbelievethatbecauseofastudent’sbehavior,thereexistsathreatofimminentdangertothestudentorothers,significantdisruptionoftheabilityofotherstudentstostudyorsleep,orsignificantdamagetoCollegeproperty.Suchresponsemayincludeatemporaryremovalofthestudentfromhisorherlivingsituationoncampusorfromthecampusasawhole.ReturntocampuswillbebasedonadecisionbytheDeanofStudentsthatthestudentisabletofunctionsafelyasamemberoftheacademiccommunity.
Otherwise,hearingsshalladheretothebasicfundamentalsoffairnessasstatedbelow:
1. Thestudentshallbenotifiedinpersonorviacampuse-mailbyanappropriateofficialoftheCollegethathe/sheisaccusedofviolatingaregulation.
2. Thestudentshallbenotifiedthathe/shemayelectoneofthreecoursesofaction:(a)Thestudentmayadmittheallegedviolationandrequest,thattheDeanofStudentsorotherappropriatecollegeofficialtakewhateveractionseemsappropriate;(b)Thestudentmayadmittheallegedviolation,andrequestahearingbeforetheappropriateconductboard;(c)Thestudentmaydenytheallegedviolation,inwhichcaseahearingwillbeheldbytheappropriateconductboard.
3. Thestudentshallbeentitledtoanexpeditioushearingofthecase.
4. Thehearingshallbeofaninformalnatureandneednotadheretoformalrulesofprocedureortechnicalrulesofevidencefollowedbycourtsoflaw.
5. Followingduenotificationofthehearingthestudentshallbeentitledtothefollowing:(a)Notificationofthetimeandplaceofthehearing;(b)Statementofthechargesofsufficientspecificitytoenablethestudenttopreparehis/herdefense;(c)Acopyoftheproceduresasoutlinedhere.
6. Thestudentshallbeentitledtoappearinpersonandtopresenthis/herdefensetotheconductboard,andmaycallwitnessesinhis/herbehalf.Thestudentmayalsoelectnottoappearbeforetheconductboardiftheyhavenotifiedtheappropriateboard.Shouldhe/sheelectnottoappear,thehearingshallbeheldinhis/herabsence.
7. ThestudentshallbeentitledtoassistancefromanymemberoftheCollegecommunity:faculty,staff,orstudent.Ifalawyeristobeconsulted,suchapersonmaygiveanyadviceshe/hebelievespertinent,butshe/hemaynotenterintotheproceedingoftheconductboardorattendthehearing.
8. Thestudentshallbeentitledtoaskquestionsoftheconductboardoranywitness,subjecttoanyotherpolicies.
9. Thestudentshallbeentitledtorefusetoanswerquestions.
10. ArecordoftheCollegeConductBoardhearingsshallbemade;asummaryofPeerConductBoardhearingshallbemade.
11. Thestudentandallothernon-membersoftheconductboardshallbeexcusedwhenthecouncildeliberatesonitsdecision.ThatdecisionwillbepresentedinwritingtotheDeanofStudents,whowillinturnnotifythestudentoftheconductdecision.DecisionsmadebythePeerConductBoardwillbesenttostudentsviae-mail.

CONDUCTOFTHECOLLEGECONDUCTBOARDHEARING
Inordertoprovideequityandefficiencyintheadministrationofconductprocedures,thefollowingguidelinesfortheoperationoftheCouncilhavebeencreated.Theseguidelinesshouldbeinterpretedinthelightofthephilosophyandproceduresstatedabove.
Thehearingshallbeconductedinaccordancewiththefollowinggeneralformat:
1. ThechairoftheCollegeConductBoardshallinformthestudentoftheproceduretobefollowedatthehearing.
2. Thechairshallthenreadthechargesagainstthestudentandshallaskthestudentifhe/sheunderstandsthechargesandwhetherornothe/sheconcurswiththem.Ifthestudentconcurs,theCouncilshallthenconsiderthechargesasaccurateandhearanyinformationwhichthestudentmaypresentinmitigationorexplanation.
3. Ifthestudentdoesnotconcur,theBoardshallthenheartheevidenceinsupportofthecharges.Afterpresentationoftheevidenceinsupportofthechargesthestudentshallhavetheopportunityto:(a)presentevidenceinrefutationofanyorallthecharges;(b)presentanyotherrelevantinformation;(c)questionwitnessestestifyinginsupportofthecharges.
4. ThestudentmayaskquestionsoftheConductBoardmembers.Membersmayaskquestionsofthestudentchargedaswellasofanywitnesstestifyingatthehearing.
5. The student and all other non-members of the council will be excused, except the Dean of Students who is to be consulted concerning penalty.
6. The Board will deliberate and formulate its findings and recommendations based on a preponderance of the evidence standard.
POSTHEARING
ThefindingsandrecommendationsoftheBoardwillbepresentedinwritingtotheDeanofStudentswithin48hours.StudentsareobligatedtopickupresultsofthehearingfromtheDeanofStudentsoffice,Melrose110,within48hoursofhearing.Ifthestudentdoesnotmeetthisobligation,theresultswillbeemailedtothestudent.

FINDINGSANDRECOMMENDATIONS
Afterhearingacase,theBoardmaydecideasfollows:
1. Notresponsibleforaviolation:Noviolationofaregulationhasbeenproved.
2. Responsibleforaviolation:Aviolationofaregulationhasbeenproved.Inthiscase,theCouncilmayimposeanumberofsanctions,individuallyorinacombination,including:
a. warning:anofficialreprimandinwriting,deliveredtothestudentandplacedinthestudent’sfile.
b. probation:aconditionwhichstipulatesthatanyfurtherviolationsofregulationsmayresultinasuspension.Lengthofprobationwillbespecified.
c. probationwithterms:aconditionwhichaddstoregularprobationstipulationsthatmaydenythestudentcertainprivilegesorrequirescertainactionofhim/her.
d. restitutionorreimbursement:fordamagesormisappropriationofproperty.
e. fines:monetarypenaltiesbilledtothestudent’saccountorotherwisespecified.
f. assignedwork:educationalexercisesorphysicallabor.
g. recommendationforsuspension:separationfromtheCollegeforadefiniteorindefiniteperiodoftime.
h. recommendationforexpulsion:permanentseparationfromtheCollege.
i. otheractionthatmayseemappropriateforanygivencase.
Sanctionsagainstgroupsincludethoselistedaboveina-f,i,andalsodeactivation:lossofallprivileges,includingcollegerecognition,eithertemporarilyorpermanently.
RESPONSIBILITIESOFTHECHAIR
ThechairpersonoftheCollegeConductBoardhasthefollowingresponsibilities:
1. Todecideallproceduralmattersduringthehearinginaccordancewithestablishedwrittenguidelinesandnormaldueprocess.
2. Tocontroltheconductofthehearingwithauthoritytoexcludeanypersonwhorefusestocomplywiththerulesordeterminationsofthechairperson.
3. ToprepareorcausetobepreparedinwritingthefindingsandrecommendationsoftheBoard,andtodeliverthemtotheDeanofStudentswithin48hoursofthehearing.
CONFIDENTIALITY
Exceptasspecificallyauthorizedunderapplicablelaw,boththecontentandtheoutcomeofahearingshallbeconsideredconfidentialandnomemberoftheBoardshalldiscussastudent’sroleinanincidentexceptwithothermembersoftheBoard.
TherightoftheCollegecommunitytoknowledgeoftheworkoftheBoardshallbemetthroughthereleasesofsummaryoutcomesofcaseswhichdonotmentionthenamesofindividuals.
Incertaincases,thepublicnatureoftheviolationofregulationsorthestudent’sownpublicadmissionofresponsibilitymaybringattentiontoacase,butthisdoesnotaltertheconfidentialityoftheconductproceedings.
PRESIDENTIALPREROGATIVE
AsthefinaladministrativeauthorityfortheCollege,thePresidenthasandmusthavetheauthoritytoactwithoutconsultationwithanyotherpersonorconductboard.ThePresidenthastheauthoritytosuspendorexpelanystudentwhoisactinginamannerwhichthePresidentfeelsiscontraryto–andofadangerouscharacterto–theCollegeasaninstitution,ortopersonsbelongingto,orassociatedwith,theCollegeCommunity.
