The Slate ofAlaska and the United States (the "Gnvemments") jointly provide
notice of the expenditure of$6, 127,674 in settlement funds. specifically $5,907,674 from the
Research Sub-Account of the EXXON VALDEZ Oil Spillinvestrnent Fund ("[nvestment
Fund") and $220.000 in lapsed funds and accrued interest on settlement monics previously
disbursed from the investment Fund that arc within the State ofAlaska's General Funds and
Other Non-Segregated Investments Account. The Governments' natural resource trustee

agencies will use these funds for purposes consistent with the Memorandum of Agreement
and Consent Decree entered by this Court in United States v. State afAlaska, No. A91-081
CIV (D. Alaska) on August 28, 1991 ("MOA").
This amended Thirty-Second Joint Notice ofExpenditure from the Investment
Fund and From Monies Previously Disbursed ("Amended Notice") differs from the original
'lbirty-Second Joint Notice of Expenditure from the Investment Fund and From Monies
Previously Disbursed ("Original Notice") (together "Notices") in that Rcsolution 08-20,
which appears as part of Anachmcnt A in both Notices, has been revised to correct the
allocation of funding for the Vollenwcider project and to correct typographical errors, and it
has been re-signed by the Trustee Council. Specifically, the funding for the Vollenweider
project (# 090806) will be divided between two fedcral agencies, the ational Oceanic and
Atmospheric Administration and the United States Geological Survey. In addition, the title
of the Bishop project (# 090814) has been correctly identified in the Table ofResolution 08
20 as Seabird Predation on Juvenile Herring in Prince William Sound. Finally, the Linley
project is now correctly identified throughout Resolution 08-20 as project # 090821. See
Attachment A, pp. 25-33. This Amended Notice supersedes the Original Noticc that was
filed on October 2, 2008 (Clerk's Docket # 291), and this Amended Notice also incorporates
the changes made in the Amended Attachment A filed on October 2, 2008 (Clerk's Docket
#292),
On September 25, 1991 the State of Alaska and the United States settled their
claims against the Exxon Corporation, Exxon Shipping Company, Exxon Pipeline Company,

and the TN EXXON VALDEZ arising trom the EXXON VALDEZ oil spill ("'EVOS'"). All
funds resulting from these settlements were subsequently ordered by this Court to be placed
in an interest-bearing account in lhc Court Registry Investment System ("CRIS")
administered through the United States District Court for the Southern District of Texas.
On June 7, 2000 this Coun entered its Third Amended Order for Deposit and
Transfer of Settlement Proceeds ("Third Amended Order"). The Third Amended Order
allows the Governments the option of investing the money in an account outside the United
States Treasu!)'. On September 29,2000, upon application by the Governments, the Coun
entered an Order Re: Transfer of Funds from the Exxon Valdez Liquidity Account and the
Reserve Fund to an Investment Fund Within the Alaska DepanmentofRevenue, Division of
Treasury, authorizing transfer of settlement proceeds to an account within the State. On
October S, 2000 all funds and securities were transferred from the CRJS to the Investment
Fund. The Third Amended Order funber allows the Governments to establish separate sub-
accounts within the primary account "as the Trustee Council determines appropriate." On
October I, 2002 three sub-accounts were created in the Investment Fund, to wit: the Research
Investment Sub·Account, the Habitat Investment Sub-Account, and the Koniag Investment
Sub-Account. These sub-accounts were established to carry out the Trustee Council's
decision in its Resolution of March I, 1999 to separately manage the remaining assets ofthe
Joint Trust Funds for the specific purposes of funding a long lcnn research. monitoring and
restoration program. the acquisition oflands along the Karluk River and the establishment of
a fund to purchase small parcels of land that may become available in the future.

Paragraph 27 of the Third Amended Order provides that ··funds in an
Investment Fund shall remain on deposit in that Fund until such time as the EVOS Trustees
unanimously resolve to expend all or pan of the funds.'· The funds may then be expended,
for purposes consistent with the MOA, upon the joint notification ofthe Governments to the
Investment Fund and the Court. 1 The notification is to inform the Court of the proposed uses
of the funds in the same manner and 10 the same extent as was the Governments' practice
when the funds were in the registry of the Court.
The Govenuncnts provide notice of this Amended thirty-second expenditure
from the Investment Fund and from funds previously disbursed: (I) to fund the FY 09
portion of the FY 07 Multi-year projeets previously approved in Resolution 07-06 and those
approved in Resolution 08-20 for necessary natural resource damage assessment and
restoration aetivities during federal fiseal year 2009; and (2) to fund the FY 09 Annual
Program Development and Implementation Budget for necessary natural resource damage
assessment and restoration activities during federal fiscal year 2009' Ofthe $6,127,674 that

Appended to this Notice at Attachment A. p. 4 - 33, is Trustee Council Resolutions 08-19 and 08-20. Resolution 08- I9 documents the Council's unanimous agreement. at its September 29.2008 meeting, to authorize the expenditure of$2.477.722 to fund the FY 2009 Workplan and FY 2009 Annual Program Development and Implementation Budget, as detailed in the Resolution. Resolution 08-20 documents the Council's unanimous agreement. at its Sept. 29, 2008 meeting. to authorize the expenditure of$3.649,952 in funding for the FY 2009 of Multi-Year projects, as detailed in the Resolution.
