    CUSTOMS (TRADE IN GOODS FOR THE AGREEMENT ESTABLISHING THE ASEAN-AUSTRALIA-NEW ZEALAND FREE TRADE AREA) ORDER, 2010

    In exercise of the power conferred by section 9(1) of the Customs Order, 2006, the Minister of Finance, with the approval of His Majesty the Sultan and Yang Di-Pertuan, hereby makes the following Order —

    Citation and commencement.

    1. This Order may be cited as the Customs (Trade in Goods for the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area) Order, 2010 and shall be deemed to have commenced on 1st. January, 2010.

    Prescribed countries.

    2. For the purpose of section 9(2) of the Customs Order, 2006 (S 39/06), countries which are parties to the Trade in Goods for the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area are hereby specified as prescribed countries.

    Preferential rates of customs duties.

    3. Notwithstanding anything contained in the Customs Import Duties Order, 2007 (S 45/07), there shall be levied in respect of the imported goods specified in the Schedule which are shown to the satisfaction of the Controller to have originated from and to have been consigned direct from a prescribed country customs duties at the rates and in respect of the years specified in the Schedule.

    Deemed country of origin of goods.

    4. For the purpose of paragraph 3, goods shall be deemed to have originated from and to have been consigned direct from such a prescribed country where they conform to the Rules of Origin under Chapter 3 of the Trade in Goods for the Agreement Establishing the ASEAN-Australia-New Zealand Free Trade Area.
