Tamil Nadu Real Estate Regulatory Authority (General) Regulations, 2018.

(Letter No. TNRERA/827/2017.)

No. SRO c-13/2018.—In exercise of the powers conferred on it under sub-section (1) and clause (i) of sub-section (2)of Section 85 of the Real Estate (Regulation and Development) Act, 2016 (Central Act, 16 of 2016) and of all otherpowers enabling it in that behalf, the Tamil Nadu Real Estate Regulatory Authority hereby makes the following Regulations:-

CHAPTER I

PRELIMINARy

1. Short Title, Commencement:

(a)TheseRegulationsmaybecalledtheTamilNaduRealEstateRegulatoryAuthority(General)Regulations,2018

(b)TheseRegulationsshallcomeintoforceonthedateoftheirpublication.

CHAPTER II

2. Definitions:-Intheseregulations,unlessthereisanythingrepugnanttothesubjectorcontext:

(i)“Act”and“Rules”shallmeantheRealEstate(RegulationandDevelopment)Act,2016andtheTamilNaduRealEstate(Regulation and Development) Rules, 2017, as amended from time to time;

(ii) “Address for Service” shallmean the address furnished by a party or his/her authorized agent, or his/her legal practitioner,charteredaccountant,companysecretary,costaccountantatwhichserviceofsummons,noticesorotherprocessesmaybeeffected;

(iii)“Adjudication”meanstheprocessofarrivingatdecisionsoncomplaintsreceivedbytheAuthorityortheAdjudicatingOfficerunderSection31oftheActandunderSections12,14,18and19oftheAct;

(iv)“AdjudicatingOfficer”meanstheAdjudicatingOfficerappointedundersub-section(1)ofSection71;

(v)“Application”meansthefull,correctandcompleteapplicationmadeunderSection4orunderSection9,asthecasemaybe,submittedonlineandalsoinhardcopytotheAuthoritywithallthedetailsandallthedocumentsrequiredtobesubmittedalongwiththeprescribedchargesandfeesincomplianceoftheprovisionsoftheAct,RulesandRegulationsmadethereunder;

(vi)“Authorizedperson”meansapersonauthorizedbythecomplainantorrespondentorapplicanttorepresenthim/herbeforetheAuthorityortheAdjudicatingOfficerandwhichtermincludesthepersonsasexplainedintheSection56oftheAct;

(vii)“Authority”meanstheTamilNaduRealEstateRegulatoryAuthority;

(viii)“Chairperson”meanstheChairpersonoftheAuthority;

(ix)“Complaint”meansawrittenstatementmadeunderSection31oftheAct;

(x) “Complainant”meansaperson,whohasfiledcomplaintunderSection31of theActbefore theAuthorityor the AdjudicatingOfficer,asthecasemaybe;

(xi)“Code”meanstheCodeofCivilProcedure,1908,asamendedfromtimetotime;

(xii)“Member”meansamemberoftheAuthority;

(xiii) “Proceedings” meansand includeproceedingsofall nature that theAuthority /Adjudicatormayconduct in the dischargeofitsfunctionsundertheActandtherulesandregulations;

(xiv)“Officer”meansanofficeroftheAuthority;

(xv)“Rule”meanstherulesmadeundertheAct;

(xvi)“Regulations”meanstheTamilNaduRealEstateRegulatoryAuthority(General)Regulations,2018asamendedfrom time to time;

WordsandexpressionsnotdefinedinthisRegulationsshallhavethesamemeaningasassignedintheActandtheRules.

3. Area of Jurisdiction:

Tamil Nadu Real Estate Regulatory Authority Regulations (General), 2018, is applicable to theState ofTamilNadu coveringbothplanningareaandnonplanningareaandalsoapplicabletotheUnionTerritoryofAndaman&NicobarIslands.

CHAPTER III

4. Submission of application and fee for Registration:

(a) EveryapplicationunderSection4andSection9oftheActshallbesubmittedonlineaswellasinhardcopywithallthedetailsanddocumentstotheAuthorityalongwiththeprescribedcharges&fees.

(b) ThehardcopyoftheapplicationalongwithallthedetailsanddocumentsshouldbesubmittedtoAuthorityatleastwithinaperiodof7daysfromthedateofonlinesubmissionoftheapplication.

(c) TheAuthorityshallscrutinizethoseapplicationsfiledforregistrationforprojectsoragents,asthecasemaybe,andifitisfoundinorder,registrationcertificatewillbeissuedintheformatprescribedwithin30daysfromthedateofsubmissionforregistrationofprojectoragent,asthecasemaybe,assetoutinSubRule(1)ofRule6and Sub-Rule1underRule12respectively.

(d) If theapplication is incomplete,a letter /mailwill besent to thepromoteror theAgent to furnish the required particularswithinsuchtimeastheAuthorityprescribes.

Explanation: 30 days period shall exclude the period granted to the registrants for compliance, if any, in such incomplete applications as returned by the Authority.

(e) TheAuthorityinexercisingthepowersundersub-section(1)ofSection7andsub-section(7)ofSection9oftheActreadwiththeRule8and14respectivelytorevoketheregistrationgrantedtoaprojectoranagent,asthecasemaybe,anoticeshallbecausedtotheregistrantgiving10daystimetofurnishhisexplanationandcallinghimforenquiryandbygrantingapersonalhearingbeforetheAuthorityonthedayasspecifiedinthenotice.

(f) TheAuthorityinexercisingthepowersunderSub-Clause(b)Sub-Section(1)ofSection5andSub-Clause(b)ofsub-section(3)ofSection9oftheActtorejectanapplicationforregistration,shallissueanoticetotheregistranttofurnishsuchexplanationand/orcalluponhim/hertoappearinpersonorthrougharepresentativeforsuchenquirybeforetheAuthorityonthedayspecifiedintheNotice.

(g) Ifafterthepersonalhearing,theAuthorityisstillnotsatisfiedwiththeinformationprovidedintheapplication,itshallrejectsuchapplication(or)ifafterduenoticeforpersonalhearinghasbeengivenandifthepartydoesnotappearforthesehearingsconsecutivelyfortwohearingsonthedatespecifiedinthenotice,theAuthorityshallrejecttheapplicationindefault.

(h) Ifthepromoter/agentcontinuouslyfailstotakestepstoregistertheproject/agentascontemplatedunderSection3&9oftheAct,evenafterrejectionofapplicationforregistrationofproject/agenteitherindefaultoronmerits,theAuthorityshalltakeactionagainstthepromoter/agentasprovidedunderSection59&62oftheAct.

(i) WhenregistrationismandatedbytheActinrespectofprojectsoragent,theAuthorityisempoweredtoissueashowcausenoticecallinguponthepromoter/agenttocomplythesame.Suchshowcausenoticetothepromoter/agentshallbeissuedbytheAuthoritybyRegisteredPost/Courierservicetothelastknownaddressofthepromoter/

agent.Ifthenoticeisnotservedforwantofspecificaddressoranyotherparticulars,ifitisreturnedun-served,theAuthoritymayissueforasecondtimeandagainthenoticeisnotserved,theAuthorityshallorderforapublicationinonevernaculardailyintheregioninwhichheisresidingorhisofficeissituatedforappearanceonaparticulardateandevenafterthepublication,ifthepartydoesnotappearonthatdatebeforetheAuthority,thentheAuthoritymaypassordersonmeritsofthecasetreatinghimasex-parte.

5. Registration Charges:

ThepromoteroragentshallberequiredtopaytheAuthorityregistrationchargesattherateasdeterminedbygeneralorspecialorderoftheAuthoritywhichispublishedonthe website of the Authority from time to time for the following:

(i) Registration fee:

fee Structure (for Tamil Nadu)

1. Layouts-Rs/5/-persq.m.ofplottableareaexcludingEWS,RoadsandOSR

2. Residential buildings –

a) Rs.10/-persq.m.ofFSIareaforresidentialprojectinwhichdwellingunitsizeislessthan60squaremeter;

b) Rs.20/-persq.m.ofFSIareaforotherresidentialprojects;

3. Commercialbuildings-Rs.50/-persquaremeterofFSIarea;

4. Anyotherprojects-Rs.25/-persquaremeterofFSIarea;

Fee Structure (for Andaman & Nicobar Islands)

1. Incaseofgrouphousingproject-Rs.5/-sq.m.forprojectswheretheareaoflandproposedtobedevelopeddoesnotexceed1000sq.m.orRs.10/-persq.m.forprojectswheretheareaoflandproposedtobedevelopedexceeds1000sq.m.butshallnotbemorethanRs.5lakhs;

2. Incaseofmixeddevelopment(residentialandcommercial)project–Rs.10/-persq.m.forprojectswheretheareaoflandproposedtobedevelopeddoesnotexceed1000sq.m.;orRs.15/-persq.m.forprojectswheretheareaoflandproposedtobedevelopedexceeds1000sq.m.,butshallnotbemorethanRs.7lakhs;

3. Incaseofcommercialprojects–Rs.20/-persq.m.forprojectswheretheareaoflandproposedtobedevelopeddoesnotexceed1000sq.m.;orRs.25/-persq.m.forprojectswheretheareaoflandproposedtobedevelopedexceeds1000sq.m.,butshallnotbemorethanRs.10lakhs;

4. Incaseofplotteddevelopmentprojects–Rs.5/-persquaremeter,butshallnotbemorethanRs.2lakhs;

(ii) Processingfeeof10%oftheoriginalregistrationfeeforRenewal/Extension.

(iii) Feeformakinganychangesafterregistration,onapplication.

(iv) FeeforothermattersasmaybedecidedbytheAuthoritybyorderfromtimetotime.

(v) Deduction of processing fee of 10%on the registration fee or full registration feewhichever ismore forwithdrawaloftheapplicationbytheapplicantorreturnoftheapplicationforproject/realestateagentbytheauthorityduetoinsufficientparticularssubmittedbytheapplicant/promoter.Therewillbenorefundofanyamount for withdrawal after registration.

6. Publication of Advertisements:

Promotershallnotpublishanyadvertisementsforprojectsinanymedia(includingpress,electronicmedia,pamphlets,banners,postersorpublicity inany form) forbookingofsaleofunitsor for receiptofanyadvancesum from theallottee,unless the registrationcertificatehasbeenissuedbytheAuthorityinthisregard.

CHAPTER IV

DISCLOSURES

7. formats of Certificates of Architect, Engineer and Chartered Accountant:

a) Thecertificatestobeissuedbytheprojectarchitect,projectengineerandcharteredaccountantinpracticeforwithdrawalofmoney from the separate accountmaintained underSection 4(2) (1) (D) of theAct shall be in form 1, 2 and 3respectively.

b) The certificate required to be issued by the ProjectArchitect/Project Engineer on completion of each of the building/blockoftherealestateprojectshallbeinform 4 and in form 5 for Layout and Sub-division.

c) ThepromotershallfurnishaCertificatefromtheBankontheirletterheadaspertheprescribedformatform 6 under Section4(2)(1)(D).

d) Theannualreportonstatementofaccountsinform 7,issuedinaccordancewiththeProviso(D)toSection4(2)(1)oftheAct(i.e.,)shallbecertifiedandsignedbytheStatutoryAuditorofthepromoter’senterprise.

e) Thepromoter shall designate anarchitect, anengineer, a charteredaccountantwho issues certificates for theprojecttoenablewithdrawalofamountsfromtheseparateaccountopenedincomplianceoftheprovisionsunderSection4 (2) (1) (D)of theAct for theworkcompletedandsuchdesignatedarchitect, engineerandchartered accountantshallnotbechangedwithoutpriorconcurrenceoftheAuthority.

Explanation1: TheCharteredAccountant certifying theprogressof the registered realestateproject for thepurposeofwithdrawalofamountsfromtheseparateaccountshouldbea“differententity”thantheCharteredAccountantwhoisthestatutoryauditorofthepromoter’senterprise.

Explanation 2: If theForm7 issuedby the statutoryauditor reveals thatanycertificate issuedby theprojectarchitect, engineerorthecharteredaccountanthasfalseorincorrectinformation,theamountcollectedforaparticularprojecthavenotbeenutilizedfortheprojectandthewithdrawalhasnotbeencompliedwithdevelopmentoftheproject,theAuthorityshall,apartfromtakingactionagainstthepromoterundertheActandRules,alsobringthemattertotheconcernedrespectiveregulatorybodyofthesaidarchitect,engineerorcharteredaccountant,fornecessarypenalactionagainstthem.

8. Additional disclosures by promoters on the website after registration:

(1) AfterregistrationoftheprojectbeforetheAuthority,allthedetailsoftheproposedReal EstateProject,shallbeuploadedby the promoter within 7 days from the date of registration, on the allotted webpage on the website of the Authority with further mandatoryupdateonceinevery3monthsasrequiredundersub-section(1)ofSection11oftheActandRule17(vi)(c)(d)oftheTamil Nadu Real Estate (Regulation and Development) Rules, 2017.

(2) Thepromotershallprominentlydisplayattheprojectsitethesanctionedplans,layoutplans,alongwithspecifications,approved by the competent Authority and RERA registration details.

(3) In all advertisement and publicity related to the projects in any print, electronic on social media (including press, electronicmedia,pamphlets,banners,postersorpublicityinanyform),shallbeartheregistrationdetailsoftheprojectwiththe RERA,andiftheprojectdoesnotfallwithintheambitofRERAasperSection3(2) thatshouldalsobeindicated.

CHAPTER V

Standard operating procedure

9. Procedure for dealing with complaints :

(1)AnyaggrievedpersonmayfileacomplaintwiththeAuthority,underSection31oftheActreadwithRule37 save for any violationundertheActortheRulesandRegulationsmadethereunderasthoseprovidedtobeadjudicatedbytheAdjudicatingOfficer,inFormMofRule37(1) whichshallbeaccompaniedbyafeeofRs.1,000/-remittedonline.

(2) TheaggrievedpersonorpersonsshallsubmitthreesetsofcomplaintsorsufficientcopiesrequiredtobesenttotherespondentsalongwithsupportingdocumentstotheAuthoritybyregisteredpostorinpersoninofficewithin7daysfromthedateoffilingon-line,incaseofTamilNaduand10daysincaseofAndaman&NicobarIslands.

(3)ThecomplaintshallbepresentedeitherinpersonbytheapplicanthimselforthroughanadvocateascontemplatedunderSection56oftheAct,andifthroughanadvocate,necessaryvakalatdulyattestedwithenrollmentnumberandwithaffixtureofcourtfeestampofRs.10/-aswellasAdvocateWelfareFundstampofRs.30/-asprescribedinthecivilcourtprocedure,asthecasemaybe,shallbefiled.

(4) Anauthorizedrepresentativeotherthanadvocateshallfurnishanauthorization in fORM – 8andsuchauthorizationshallcontaintheaddressoftherepresentativewithparticularsofenrolmentnumberorRegistrationNumber,e-mailaddressormobilenumberforpropercommunication.

(5) When a number of complaints are made to theAuthority based on similar facts and seeking the same or similar reliefagainstthesamepromoterinthesameproject,theAuthorityshallordinarilycluballsuch complaintsanddisposethem in commonproceedings.

(6)ThedesignatedofficeroftheAuthoritymayatanytimecalluponthepartytoproducesuchfurthermaterialsasandwhenheisdirectedbytheAuthorityinthisregard.

(7)ThecomplainantshallalsopaytheAuthorityasumofRs.600/-throughonlinetowardspostagecharges:

CHAPTER VI

10. Complaints before the Adjudicating Officer:

(1)Whereas,theRule38ofTamilNaduRealEstate(Regulation&Development)Rules,2017readwithSection31ofRealEstate (Regulation&Development)Act,2016,prescribes themannerof filingcomplaints, foradjudgingcompensationunder Section12,14,18and19oftheAct,beforetheAdjudicatingOfficerandthemannerofholdinganenquiry.

Providedthatthosecomplaintswhicharenumerousandbasedonsimilarfactsandprayingforsamereliefsoughtagainstthesinglepromoter,allthosecomplaintsshallbeclubbedanddisposedincommonproceedings.

(2)AnyaggrievedpersonmayfileacomplaintintheprescribedfORM–NwithadequatecopiestobeserveduponeachrespondentwiththeAdjudicatingOfficerforcompensationunderSection12,14,18and19oftheActreadwiththeRule38andRegulationsmadethereunder,saveasthoseprovidedtobeadjudicatedbytheAuthority,whichshallbeaccompaniedbyafeeofRs.5,000/-remittedthroughonline.Theaggrievedpersonhastosubmithisapplicationalongwithsupportingdocumentsbyregisteredpostorinpersoninofficewithin10daysfromthedateoffilingon-line,incaseofTamilNaduand15daysincaseofAndaman&NicobarIslands.

(3)TheapplicationshallbepresentedeitherinpersonbytheapplicanthimselforthroughanauthorizedrepresentativeascontemplatedunderSection56oftheAct.NecessaryvakalatorMemoofauthorizationdulyattestedwithaffixtureofapplicable

(4)TheapplicantshallalsopaytheAuthorityasumofRs.600/-throughonlinetowardspostagecharges:

CHAPTER VII

11. Procedures before the Authority and Adjudicator:

In respectofallcomplaintsbefore theAuthorityand theAdjudicatingOfficer, theproceduresmentionedbelow in this RegulationsNo.12to17uptochapterXshallbefollowedandadhered.

CHAPTER VIII

12. Presentation, Scrutiny and Numbering:

(a)PaginationofthecomplaintfiledbeforetheAuthority/AdjudicatingOfficershallbeincontinuousmannerbeginningfromthecomplaintalongwithannexures.

(b) Initialing alteration:Every interlineations, eraser or correction or deletion in any complaint or document shall be initialedbythepartyorhisauthorizedrepresentative.

(c) Everycomplainant isrequiredtoaffixhisorhersignatureshallstatehisorhernameincapitalsnearhisorher signatureandinitialorsignatthebottomoftheeachpage.

13. Endorsement and Scrutiny:

(a)Theperson,inchargeofthereceiptofthecomplaintoranyotherdocuments,wheneveranycomplaintisfiledoranyotherdocumentsisreceived,wouldimmediatelyaffixthesealoftheauthoritywithdate.Atthetimeofreceiptofcomplaint,itisthedutyoftheconcernedclerktoverifywhethertherequisitenumberofcopiesalongwithnecessaryindexandonsuchreceipt,theconcernedclerkwillsignonthefirstpageinthemainsheetaswellasinthecopiesandassignCurrentNo.foreverycomplaintandpassitforscrutinytotheofficerconcerned.

(b)ThescrutinyofficeroftheAuthorityshall,onreceiptofthecomplaintfromtheReceivingbranch,scrutinizethesameasexpeditiouslyaspossiblebutnotbeyond7workingdaysfromthedateofreceipt.

Providedif,foranyreason,thescrutinyisnotcompletedwithintheaboveperiod,thesameshallbeimmediatelyreportedtothedesignatedofficer,whoshalltakepromptstepstocompletethescrutinyandorextendthetime.

(c)Onscrutinyofthecomplaint,ifitisfoundtobedefectiveorincorrectinconformitywiththeprovisionsoftheActorRuleorRegulationsthereunder,theAuthoritywillreturnthepaperforcomplianceintheproperformgranting15daystimeforthecomplaintsmadeinTamilNaduand20 daysforthecomplaintsmadeinAndaman&NicobarIslandsorsuchtimeastheAuthorityprescribes.Ifthecomplaintisnotdulyrepresentedwithallcompliancewithinthetimegranted,itmaybetreatedasacomplaintnotinconformityandshallbepostedbeforetheAuthorityortheAdjudicatingOfficerasthecasemaybefordismissalfordefault.Insuchevent,thecomplaintfeeshallbeforfeited.Thereshallbe nobarforthecomplainantforfilingafreshoneaftercomplyingtherequirementsonlywithinaperiodof90daysfromthedateofsuchdismissal.

(b)EverycomplaintfiledunderSection31oftheActreadwithSection12,14,18and19oftheActandunderRule38aftercheckingandscrutinyshallbenumberedasCompensationClaimPetitionNo.(CCP.No.)andregisteredintheappropriateregister maintained in that behalf.

(c) InterlocutoryApplication filed along with the Complaint instituted or thereafter shall be numbered separately as I.A.No.

CHAPTER IX

15. Notice and Service:

(a) TheAuthority/theAdjudicatingOfficershall issueNotice inform – 9 to therespondentalongwithonecopyof thecomplaintbygiving15 days time incaseofTamilNaduand20days incaseofAndaman&Nicobar Islandsorsuch timeastheAuthority/theAdjudicatingOfficerprescribesforproperexplanationunderintimationtothecomplainantwhichservesasan acknowledgement.OnreceiptoftheNotice,therespondentshouldfilethereplyonorbeforetheprescribedtimelimitwithacopydeliveredtothecomplainant.Onreceiptoftheproperexplanationfromtherespondent,theAuthority/theAdjudicatingOfficerwilltakeupthehearingwhereinboththecomplainantandtherespondentwillbe calledfor.TheAuthority/theAdjudicatingofficerwillalsotakeintoconsiderationthepleaofcontestornotinthathearingandaccordinglydecidethemattergrantingtimeforenquiry.

If the matter is settled amicably between the parties, the complainant and the respondent shall file a joint memo of settlementwithclearterms,onthebasisofsuchtermstheAuthority/theAdjudicatingOfficershallrecordthesameanddisposethe complaint.Infailureofarrivingcompromisebetweentheparties,enquiryshallbeproceededaspertheprovisionsoftheAct,Rules and Regulations.

(b)Ifanypersonfails,neglectsorrefusestoappearinpersonorthroughhisauthorizedrepresentativeasdirectedbytheAuthority/theAdjudicatingOfficer,theAuthority/theAdjudicatingOfficershallhavethepowertoproceedwiththeenquiryintheabsenceofsuchpersonorpersonsafterrecordingthereasonsfordoingsoandappropriatedecisionwillbetakenbytheAuthorityonthebasisofavailabledocumentsandevidenceonrecord.

16. Service of Process:

(1) Issue of notice:When a notice of complaint or interlocutory application issued by theAuthority/theAdjudicating Officer,copiesof thesameandothersupportingdocumentsfiledtherewith, ifany,shallbeservedontheothersideandwithacknowledgement.

(2)Whenevernoticeisorderedbyprivateservice,thecomplainantunlessalreadyservedontheothersideinadvance,shallarrangetoservethecopyofcomplaintandotherdocumentsbyregisteredpostorcourierserviceandfileaffidavitofservicewithitsproofofacknowledgementbeforethedatefixedforhearing.

(3)Steps for issue freshnotice: Ifanynotice is returnedunserved in thecircumstancesnotspecified in theRuleor Regulations,thatfactandthereasonthereofshallbenotifiedimmediatelyonthenoticeboardoftheAuthorityandalsointhewebsiteoftheAuthority.Thecomplainantorhisauthorizedrepresentativeshallwithinsevendaysfromthedateofsuchnotificationtakestepstoservethenoticeafresh.

(4)Consequenceoffailuretotakestepsforissueoffreshnotice:Where,afteranoticehasbeenissuedtotheotherside,andreturnedunserved,andthecomplainantfailstotakenecessarystepswithinaperiodasorderedbytheAuthority/the AdjudicatingOfficer fromthedateofreturnof thenoticeontherespondent(s), thecaseshallbepostedfordismissal fornonprosecution.

(5)TheAuthority/theAdjudicatingOfficershalltakestepstoservenoticetorespondentsbypostaspertheaddressgiveninthecomplaintonpaymentmadebythecomplainant.IfthenoticesentbytheAuthority/theAdjudicatorisnotservedforanydefectintheaddressoranyotherreasonformorethantwooccasions,thenthecomplainantshallbedirectedbytheAuthority/theAdjudicatortotakesubstitutedservicewhilemakingapublicationinavernaculardailyintheplaceofaddressoftherespondentofthesiteorregisteredofficeorresidenceathiscost.

(6)Appearanceofparties:ThepartywhohasengagedalegalpractitioneroranyotherauthorizedrepresentativetoappearforhimbeforetheAuthority/theAdjudicatingOfficershallnotbeentitledtobeheardinpersonunlesspermittedbytheAuthority.

(7) Parties appearing before the Authority shall be properly dressed; and in case of Advocates with collar and AdvocateCoat.

CHAPTER X

17. Examination of Witness and Issue of Commissions:

(1)TheAuthority/theAdjudicatingOfficermaypermitexaminationofwitnessesonlywhenitisdeemedfitbytheAuthority/theAdjudicatingOfficerandthesummaryprocedureasprovidedintheCivilProcedureCodeshallbefollowed.

(2)NumberingofWitnesses:ThewitnesscalledbythecomplainantshallbenumberedconsecutivelyasCWsandthosebythe respondent as Rws.

(3)Markingofdocuments:Thedocumentswhenproducedshallbemarkedasfollows:

(i)ifrelieduponbythecomplainant’sside,theyshallbenumberedas“A”series;

(ii)ifrelieduponbytherespondent’sside,theyshallbenumberedas“B”series;

(iii) any documents produced by the third party on summon by theAuthority or any expert evidence or documents producedattherequestoftheAuthorityoranyGovernmentdocuments/commissiondocumentsshallbemarked“X”series;

(4)Forthepurposeofcommissionofexaminationofwitnesses,anydocumentsrequiredfromtheAuthority,acopyofsuchdocumentsshallbeprovidedtothecommissionbytheAuthority.

CHAPTER XI

18. Authority’s Office, office hours and sittings and Language:

(a)TheOfficeoftheAuthorityshallbesituatedatChennaiorsuchplacesastheAuthoritymaydecidefromtimetotime.TheAuthoritymay,byorder,establishbenchesanditsofficesatotherplaceswithinitsjurisdictionasdefinedinRegulation3.

(b) The Authority shall follow the office timings and holidays as notified by the State Government in the TamilNaduGovernmentGazette.

(c)TheAuthoritymayconductitsproceedingsattheheadofficeoratanyotherplacewithinitsjurisdictionasdefinedinRegulation3onanyworkingdaysandtimeasdirectedbytheChairperson.

19. Language of the Authority:

(a)TheproceedingsoftheAuthorityshallbeconductedinEnglish,providedtheAuthorityshallalsoallowanypersontopleadorrepresenthiscaseinTamil(inTamilNadu)orinHindi(inAndaman&NicobarIslands).

(b)TheAuthority at its own discretion,may accept complaint or petitionmade inTamil (inTamil Nadu) or inHindi (inAndaman&NicobarIslands).

(c)TheAuthority,atitssolediscretion,mayacceptcomplaintorpetitionsmadeinanylanguageotherthaninTamilorEnglish,providedthesameistobeaccompaniedbyatranslationthereofinEnglishattestedbyaNotary.

(d)AnyTranslationwhich isagreedto,bythepartiesto theproceedingsorwhichanyof theparties furnish,maybe acceptedbytheAuthorityasatruetranslation.

20. Seal of the Authority:

AnydocumentrequiringauthenticationbytheAuthorityshallbeissuedunderthesealoftheAuthority,andshallbesignedbytheOfficerauthorizedbytheChairpersoninthisbehalf.

CHAPTER XII

21. Meetings of the Authority:

(1)Chairpersonshallpresideoverthemeetingsandconductthebusiness.

(2)IftheChairpersonforanyreasonisunabletoattendameetingoftheAuthority,anyothermemberchosenbytheMembers present amongst themselves at the meeting, shall preside over the meeting.

(3) Allquestionswhichcomeupbeforeanymeetingof theAuthorityshallbedecidedbyamajorityofvotesby the Memberspresentandvoting,andintheeventofanequalityofvotes,theChairpersonorinhisabsence,thepersonpresidingshallhaveasecondorcastingvote.

Explanation:AsfarasthecomplaintsfiledunderSection31oftheActareconcerned,thesameshallbeproceededwiththeprovision of Rule 37 and 38 read with regulations thereunder.

(4) WiththepermissionoftheChairpersonorotherMemberpresidingoverthemeeting,asthecasemaybe,urgent questionsmaybeaddedtotheagendaatanytimebeforetheconclusionof themeeting,orany itemontheagendamaybe deletedorcarriedovertoasubsequentmeeting.

(5)ThemeetinghoursshallnormallybewithintheofficehoursoftheAuthorityunlesstheChairpersondecidestoextendthesameinaparticularcase,ongroundsofurgency.

(6) TheChairpersonforthemeetingoftheAuthoritymay,ifheconsiderednecessary,alsoinviteanyexpert,qualifiedinthemattertobediscussedatanymeeting,toattendanymeetingoftheAuthority,withaviewtofacilitatemeaningfuldiscussionandsuchexpertmayparticipateanyproceedingsofthemeeting;butshallhavenorighttovote.EveryexpertinvitedtoattendanymeetingoftheAuthorityotherthantheMembers,OfficersoremployeesoftheAuthority,shallbeentitledtoapaymentforeachmeetingoftheAuthorityattendedbyhimasprescribedbytheAuthorityfromtimetotime.

(7) (a)Anymember,whohasadirector indirectpecuniaryorother interest inanymatter including those relating to immediatefamily,comingupforconsiderationinmeetingoftheAuthorityandhe/sheshallnottakeanypartinanydeliberationordecisionoftheAuthority,withrespectofthatmatter.

(b)Forthepurposeofthisregulation, immediatefamilyshall includewifeorhusbandorsonordaughter(whetherbiologicaloradopted),parents,brothersorsistersoranypersonrelatedtoanyofthembybloodormarriage,whethertheyaredependentonthesuchmemberornot.

(8) Anymemberwhoisfoundinviolationtotheprincipleslaidoutinsub-regulation(7)shallbeliabletonecessaryactionaspertheprovisionsoftheActandRulesmadethereunder.

(9) Theauthoritymayfromtimetotimeappointsuchcommitteesorsub-committeesconsistingofsuchmembersandotheremployeesorofficersoroutsideexpert in thatfieldas itdeemsfit, toadvise theauthorityonsuchmattersasmaybe prescribedorspecifiedandsubjecttosuchdirectionsastheauthoritymaygive.

(10) Ifanydoubtarisesastotheinterpretationoftheseregulation,thedecisionoftheAuthorityshallbefinalandbindingonallconcerned.

(11) (a)AnOfficeroftheAuthoritydesignatedbytheChairperson,shallrecordtheminutesofthemeetingsandmaintainaregisterwhichwill,amongstotherthings,containthenamesanddesignationofMembersandinviteespresentinthemeeting.

(b)ThedecisiontakeninameetingoftheAuthorityshallberecordedintheminutesbookinaclearandconcise manner,alongwithreasons. Incase,theminutesrecordanystatement/submissionmadebyaninvitee,acopyoftheminutesshallbesenttosuchinvitee.

(c)TherecordedminutesofthemeetingwillbedulysignedbyalltheMemberspresent.

22. Orders of the Authority:

(1)ThedecisionarrivedattheAuthorityMeetingshallbedulysignedbyallthememberspresentandcopyofthesameshallbemadeavailabletotheapplicant.

(2)AllordersanddecisionsshallbecertifiedbyanOfficerempoweredinthisbehalfbytheChairpersonandshallbeartheofficialsealoftheAuthorityandbecommunicatedasexpeditiouslyaspossiblefromthedateofpassingthereoftoallpartiesintheproceeding.

(3)TheAuthoritymaypasssuchad-interimorinterimorders,astheAuthoritymayconsiderappropriateatanystageofanyproceedings,havingregardtothefactsandcircumstancesofthecase.

(4)TheAuthoritymay,atany time,directanyoneormoreOfficersoranyotherpersonas theAuthorityconsiders appropriatetostudy,investigateorfurnishinformationwithrespecttoanymatterwithinthejurisdictionoftheAuthorityundertheActandtheRules.

23. Collection of Information:

(a)TheAuthoritymayissuesuchdirections,forthepurposeofcollectionofanyinformation,particularsordocumentsthattheAuthorityconsidersnecessaryinconnectionwiththedischargeofitsfunctionsundertheActandtheRule.

(b)IfanysuchreportorinformationobtainedappearstotheAuthority tobeinsufficientorinadequate,theAuthorityoranOfficerauthorisedforthepurposemaygivedirectionsforfurtherinquiry,reportandfurnishingofinformation.

(c)TheAuthoritymaydirectsuchincidental,consequentialandsupplementalmatterstobeattendedtowhichmaybeconsideredrelevantinconnectionwiththeabove.

(d)IfthereportorinformationobtainedinaccordancewithRegulationaboveoranypartthereofisproposedtoberelieduponbytheAuthorityforformingitsopinionorviewinanyproceedings,thepartiestotheproceedingsshallbegivenareasonableopportunityforfilingobjectionsandmakingsubmissionsonsuchreportorinformation.

24. Confidentiality:

(a)TheAuthorityshallappraiseanddeterminewhetheranydocumentsorevidenceprovidedtoitbyanypartyandclaimedbythatpartytobeofaconfidentialnaturemeritsbeingwithheldfromdisclosuretootherpartiesasbeingconfidentialandshallprovidebriefreasonsinwritingforarrivingatitsconclusion.

(b) If theAuthority is of the view that the claim for confidentiality is justified theAuthoritymay direct that the same benotprovidedtosuchpartiesastheAuthoritymaydeemfit.However,thepartyclaimingtheconfidentialityshallprovideabrief non-confidentialsummaryofthesubstanceofthedocumentsfoundtobeconfidentialandtheimportofthesame.

(c) Notwithstandingtheabove,itshallbeopentotheAuthoritytotakeintoconsiderationthecontentsofthedocumentsfoundtobeconfidentialinarrivingatitsdecision.

(d)TheAuthoritymaydirectanypersoneithertoappeartogiveevidenceortoproduceanydocumentsorbooksofaccountsandsuchdocumentsorevidencesproducedmaybeordered tobekept in thesafecustodyofanyoneof theofficersof the Authority.

CHAPTER XIII

25. Maintenance of Registers:

ThefollowingRegistersshallbemaintainedandpostedonadaytodaybasisbytheofficerauthorisedmay,subjecttoanyorderoftheChairperson,direct:

(a)RegisterofComplaint:AcomplaintRegistershallbekeptbyanofficerauthorizedanditshallbewrittenlegibly.The register in themain file shall containa concisehistory of the complaint, the substanceof theorderspassed thereonand in executionproceedingsanditshallcontainacompleterecordofallproceedingsinexecutionoforderordirectionorruleandshallbecheckedbytheSectionOfficerandinitialedonceinafortnight;

CHAPTER XV

27. Inspection of Record:

(1)InspectionoftheRecords:(a)Thepartiestoanycomplaintortheirlegalrepresentativemaybeallowedtoinspecttherecordofthecasebymakinganapplicationinform-10inwritingtothedesignatedofficerandafeeprescribedthereinandtheapplicationshallbepresentedbetween10.30A.M.and3.00P.M.onanyworkingdayandtwodaysbeforethedateonwhichinspectionissought,unlessandotherwisepermittedbythedesignatedofficer.

(2)SubjecttosuchtermsandconditionsasmaybeprescribedbytheChairpersonbyageneralorspecialorder,apersonwhoisnotapartytotheproceeding,mayalsobeallowedtoinspecttheproceedingsafterobtainingpermissioninwriting.

ProvidedthattheinspectionofrecordsofapendingordecidedcasebeforetheAuthorityshallbeallowedonlyontheorderof the Authority.

(3)Inspectionofrecordsofapendingcaseshallnotordinarilybepermittedonthedatefixedforhearingofthecaseorontheproceedingday.

(4)ThefeeprescribedshallbepayablethroughonlinetotheTamilNaduRealEstateRegulatoryAuthorityatChennai.

(5)Ongrantofpermission for inspectionof records, theSectionOfficeroranyotherofficerauthorizedshall arrange to procuretherecordsofthecaseandallowinspectionofsuchrecordsonthedateandtimefixedbythedesignatedofficerbetween10.30A.M.and12.30P.M.andbetween2.30P.Mand4.30P.M.inthepresenceofhimoranyofficerauthorized.

(6)Thepersoninspectingtherecordsshallnotinanymannercausedislocation,mutilation,tamperingtotherecordsinthecourseofinspection.

(7)Thepersoninspectingtherecordsshallnotmakeanymarkingonanyrecordorpapersoinspectedandtakingnotes,ifany,ofthedocumentsorrecords.Noelectronicgadgetsareallowedinsidetherecordroom.InthecourthallorinanyhearingbeforetheAuthorityortheAdjudicatingOfficer,nocellphoneoranyotherelectronicgadgetcanbeusedoroperated.

(8)Thepersonsupervisingtheinspection,mayatanytimeprohibitfurtherinspection,ifinhisopinion,anyoftherecordsarelikelytobedamagedintheprocessofinspectionorthepersoninspectingtherecordshasviolatedorattemptedtoviolatetheprovisionsoftheseregulationsandshallimmediatelymakeareportaboutthemattertothedesignatedofficerandseekfurtherordersfromthedesignatedofficerandsuchnotesshallbemadeinrelevantcolumnoftheInspectionRegister.

(9)Thedesignatedofficershall cause tomaintainaRegisterofRecords for thepurposeof inspectionofdocumentsor recordsandshallobtainthereinthesignatureofthepersonmakingsuchinspectionontheRegisteraswellasontheapplicationontheconclusionofinspection.

(10)TheAuthority shall endeavour tomake information involving public interest accessible and available to the public, including,interalia,throughitswebsite.

28. Discovery, Production and Return of Documents:

(1)Summoning,discoveryandproductionofdocumentsshallberegulatedbySectionof35(2)oftheActandproviso(a)and(b)ofsubrule(1)ofRule25ofTamilNaduRealEstateRegulatoryAuthority(Regulation&Development)Rules,2017readwithRule64ofCivilRulesofPracticeasamendedfromtimetotime.

(2)Suomotusummoningofdocuments:Notwithstandinganythingcontainedintheserules,theAuthoritymay,suomotu,issuesummons/noticesforproductionofdocumentsorotherdocumentsinthecustodyofanycourtorpublicofficeroranyotherparty.

(3)Returnofdocuments:(a)Anapplicationforreturnofthedocumentsproducedshallbenumbered.Suchapplicationshallbefiledwithanoticetothepartieswhoproducedthedocuments.Nosuchapplicationshallbeentertainedafterthedestructionoftherecords.

(4)TheAuthoritymay,atanytime,directreturnofdocumentsproducedsubjecttosuchconditionsasitdeemsfit.

CHAPTER XVII

29. Certified Copies of Order:

(1)Theauthorityshall,onsuchtermsandconditionsastheAuthorityconsidersappropriate,provideforsupplyofcertifiedcopiesofdocumentsandpapersavailablewiththeAuthoritytoanyperson,applyinginprescribedForm(fORM-10), by making cashpaymentoffeeofRs.100/-percopyoftheordercontaininguptoamaximumof10pages.Ifthepagesexceedten,thenforeveryextrapagepercopy,asumofRs.2/-shallbepaid.PaymentshallbemadeatthecashcounterofTNRERA.

(2)ThepartiestotheproceedingsareentitledtogetonefreecopyoftheorderfromtheAuthority/AdjudicatingOfficereitherbypostorperson.Additionalcopiesifrequiredbythepartiestotheproceedingsshallbeprovidedonpaymentoffeeasstipulatedsupra.

(3)TheAuthorityshalldesignateanOfficerforensuringtimelyresponsetorequestsreceivedforsupplyofcertifiedcopiesofdocumentswhoshallendeavourtodispatchthecertifiedcopiesofdocumentsrequestedforasexpeditiouslyaspossiblewithinaperiodof30workingdaysfromthedateofreceiptofrequest.

CHAPTER XVIII

30. General Power to Amend / Rectify:

TheAuthoritymay,atanytimeandonsuchtermsastocostsorotherwise,asitmaythinkfit,removeanydefectorer-rorapparentonthefactsoftherecordinanyproceedingsbeforeit(includinganyclericalorarithmeticalerrorinanyorderpassedbytheAuthority),onlyonanapplicationfiledbyanyoneoftheaggrievedpartywithin60daysfromthedateoftheorder.The Authorityshallnotpassanyorderonthesaidapplicationifentertainedwithoutgivingnoticetoothers.

CHAPTER XIX

31. Power to Remove Difficulties:

IfanydifficultyarisesingivingeffecttoanyoftheprovisionsoftheRegulations,theAuthoritymay,bygeneralorspecialorder,doanythingnotbeinginconsistentwiththeprovisionsoftheActorRulesmadethereunder,whichappearstobenecessaryorexpedientforthepurposeofremovingthedifficulties.

CHAPTER XX

32. Saving of Inherent Power of the Authority:

1. NothingintheRegulationsshallbedeemedtolimitorotherwiseaffecttheinherentpoweroftheAuthoritytomakesuchordersasmaybenecessary formeeting theendsof justiceor toprevent theabuseof theprocessof the Authority.

NothingintheseRegulationsshallbartheAuthorityfromadoptinginconformitywiththeprovisionsoftheActorRules,aprocedure,whichisatvariancewithanyoftheprovisionsoftheseRegulationsincludingsummaryprocedures,iftheAuthority,inviewofthespecialcircumstanceofamatterorclassofmattersandforreasonstoberecordedinwriting,deemsitnecessaryorexpedientforsodealingwithsuchamatterorclassofmatters.

3. NothingintheRegulationsshallbartheAuthoritytodealwithanymatterorexerciseanypowerundertheActorRulesforwhichnoregulationshavebeenframed,andtheAuthoritymaydealwithsuchmatters,powersandfunctionsinamanneritthinksfit.

33. Continuance of Proceedings after Death, etc.,

a) Whereinaproceeding,anyoftheparties totheproceedingdies,theproceedingshallbecontinuedandadjudicatedwithotherpartnersorsuccessors-in-interestincaseofindividual,asinthecaseofaninsolvent,theofficialreceiverorassignee,asinthecaseofacompanyunderliquidation/windingup,theproceedingshallcontinuewith,theexecutor,administrator,liquidatororotherlegalrepresentativeofthepartyconcerned,asthecasemaybe.

b) Incaseofdeathofanypartiestotheproceedings,theapplicationforbringingupthesuccessors-in–interestshallbefiledwithin45daysifnotfiledwithin45days,theapplicationshallbetreatedasabated.

34. Extension or Abridgement of time prescribed:

ThetimeprescribedbytheRegulationsorbyorderoftheAuthorityfordoinganyactmaybeextended(whetherithasalreadyexpiredornot)orabridgedforsufficientreasonbyanorderoftheAuthoritysubjecttotheprovisionsoftheActortheRules.

35. Costs:

SubjecttosuchconditionandlimitationasmaybedirectedbytheAuthority,thecostsofandincidentalto,allproceedingsshallbeawardedatthediscretionoftheAuthority.

36. Administrative Charges and Standard fees:

TheAuthoritymay,byorder,fixstandard fees,tobeleviedonthepromotersorrealestateagentsorallotteesforinspectionofdocuments,certifiedcopiesofdocuments,theupdatingofwebsite,databasemanagementandmaintenanceofthewebsite.
