TRAFFIC BYLAW

2008

1 Short Title

The short title of this bylaw shall be ‘the Taupo District Council Traffic Bylaw 2008’.

2 Commencement

This proposed bylaw shall come into force on the 4th day of August 2008.

3 Repeal

As from the day on which this bylaw shall come into force the Taupo District Council Traffic Bylaw 1999 shall be revoked.

4 Purpose

To regulate parking and the use of roads, public places and parking areas owned by or under the control of the Taupo District Council.

5 Definitions

In this bylaw, except where inconsistent with the context or except where otherwise specifically defined in this clause 5, words expressed or implied shall have the same meanings as in the Transport Act 1962 and the Traffic Regulations 1976 or Traffic Control Devices Rules 2004, Rule 54002. The specific definitions are: Angle Parking- means the parking of a motor vehicle at an angle to the direction of the road, and ‘to angle park’ has a corresponding meaning. Chief Executive - means the chief executive of the council and includes any person for the time being appointed by the council to perform the duties or a particular duty of the chief executive. Council - means the Taupo District Council constituted under the Local Government Act 2002. Footpath - means that portion of any road between the legal boundary of the road and the commencement of the roadway and includes the edging, kerbing and channeling of the roadway and grassed areas within the legal boundaries of the road. Goods vehicle – means a motor vehicle that is:

(a) designed exclusively or principally for the carriage of goods; or (b) used for the collection or delivery of goods in the course of trade.

Parking Warden – means a parking warden appointed under section 7 of the Transport Act 1962.

Public Place - includes and applies within the Taupo district to: a) every road, footpath, court, alley, pedestrian mall, lane, access way, and

thoroughfare of a public nature, owned by or under the control of the council and open to or used by the public as of right;

b) every park, reserve, beach, or place of public resort or place to which the public have access as of right and owned by or under the control of the council;

c) every piece of vacant land owned by or under the control of the council and set aside or established by the council as a parking area.

Residential Zoned Land - means land within the residential environment of the Taupo District Plan or any replacement document or legislation enacted in substitution for that plan. Road - means a road as defined in section 2 of the Transport Act 1962 owned by or under the control of the Council and located within the area of jurisdiction of the council, and includes any roadway, kerb and channeling and footpath, within the legal boundaries of the road. Roadway - means that portion of any road defined by edging, kerbing and channeling used or reasonably usable for the time being for vehicles in general; and for the purposes of part viii of the Traffic Regulations 1976.

6 Interpretation In this bylaw, except where inconsistent with the context: a) words importing the masculine gender include the feminine, words importing

the singular include the plural, and vice versa in both cases; b) words applying to any person or individual shall include, unless a contrary

intention appears, a body of persons whether incorporated or unincorporated.

7 Parking of Vehicles

7.1 Without the prior permission of the Council, no person being the driver or the person in charge of any vehicle shall park that vehicle on that portion of road between the legal boundary of the road and the commencement of the roadway and includes the edging, kerbing and channeling of the roadway and grassed areas within the legal boundaries of the road unless on a Council approved car park created specifically for that purpose.

7.2 No person shall angle park on any road unless:

a) on a park where angle parking is authorised by signs or markings; and b) the front of the vehicle faces in towards the kerb or footpath.

7.3 No person being the driver or the person in charge of any vehicle shall park that vehicle in or on any part of a road or public place contrary to the prohibitions, limitations, and restrictions imposed from time to time by resolutions of the Council in relation to such road, public place or parts thereof and, where appropriate, evidenced by signs prescribed by regulations under the Transport Act 1962 and its amendments erected by the Council at the places affected provided that except where otherwise specified, the said prohibitions, limitations, and restrictions shall apply during the hours between 8am and 6pm on days other than public holidays. The term ‘holiday’ in this clause includes New Years Day, The Day After New Years Day, Good Friday, Easter Monday, Anzac Day, Queens Birthday, Labour Day, Christmas Day, Boxing Day, Waitangi Day, Anniversary Day, and any other specified day declared by any Act to be a holiday or as per section 44(1) of the Holidays Act 2003.

7.4 Any resolution of the council made pursuant to clause 7.3 hereof may:

a) apply to any specified road[s] or public place[s] or any part thereof;

b) prescribe the number and location of designated parking areas and the number and location of parking spaces therein;

c) limit and direct the times, places, manner, and conditions for parking on any particular road or public place;

d) limit and direct the classes of vehicles that shall be permitted to park on any particular road or public place;

e) fix the fees payable for parking on any particular road or public place; f) authorise persons to have the sole and exclusive right, on conditions fixed

by the council [including fees payable], to park in spaces allocated by the council for that purpose.

7.5 No person shall stop, stand or park a heavy motor vehicle for a period of more

than one hour in any part of a road that adjoins land zoned residential whether on one or both sides provided however, that it shall not be an offence to stop, stand or park a heavy motor vehicle on any such road for such a period as is reasonably required for the purpose of loading or unloading that vehicle on a legitimate delivery or the said road is a state highway.’

8 Stopping, standing and parking restrictions

The Council may prohibit, limit or restrict the parking of any vehicle on any road or part of a road. (see attached register of No Stopping At All Times (NSAAT) areas)

9 Special Stands and Stopping Places

Without limiting the generality of clause 7: 9.1 The Council may by resolution from time to time appoint, provide, reserve, and

mark out on any particular road or public place special stands or stopping places or loading zones for: a) goods service vehicles; b) passenger service vehicles; c) taxicabs; d) mobility parking; e) such other classes of vehicles as the council decides; and such resolution

may also prescribe; f) the number and classes of vehicles for each stand or stopping place or

loading zone; g) the rental or fee to be paid for use of such stands or stopping places or

loading zone; h) in the case of a taxi stand, the taxi cabs which may stand at a particular stand; i) the times, manner, and conditions of use of such stands or stopping places

or loading zones. 9.2 The Council may by resolution from time to time:

a) abolish any special stand or stopping place or loading zone previously appointed or enlarge or diminish the limits of the same;

b) vary the number or classes of vehicles which may use a particular stand stopping place or loading zone;

c) vary the rental or fees payable for the use of a particular stand or stopping place or loading zone.

9.3 Except in the case of an emergency or when directed by a Parking Warden or a Police Officer to the contrary or when actually under hire, or off duty no driver or person in charge of a taxi cab or passenger service vehicle shall park or permit such taxi cab or passenger service vehicle to park on any road or public place other than at the place(s) appointed as a stand for taxi cabs or passenger service vehicles and no driver or any other person in charge of a motor vehicle, other than a taxi cab or passenger service vehicle, shall except as aforesaid, park or permit such motor vehicle to park at any such place(s) appointed as a stand for taxi cabs or passenger service vehicles.

9.4 The Council may by resolution from time to time appoint, provide, reserve,

mark out, enlarge, diminish or abolish on any particular road or public place, safety zones for pedestrians.

10 Miscellaneous

10.1 No person shall willfully or negligently obstruct any road or public place in any manner which causes a nuisance to other users of that road or public place or which appreciably interferes with the right of any person to use that road or public place at any time for its principal purpose and in case any bicycle is left unattended in any road or public place so as to cause such a nuisance or obstruction and the owner thereof, or the person entitled to possession of the same cannot be found after reasonable enquiry in the vicinity, any Parking Warden may remove such bicycle or cause the same to be moved to some other position including any appropriate premises of the Council or the Police.

10.2 Without the prior permission of the Council, no person shall:

a) park or leave in or on any road or public place any boat, machinery, implements,

or structure of any kind that is not attached or connected to a vehicle or so park or leave any vehicle which is disabled or any vehicle lacking effective motive power [except trailers) or which is in such a state that it cannot be safely driven. the council, in addition to any other powers it has under this bylaw, may if it thinks fit by its servants, agents or contractors remove such vehicles, boats, machinery, implements, or structures from the road or public place and recover from the owner or from the person in charge of the same all costs and expenses incurred by the council in that behalf including storage charges.

b) park in or on any road or public place any vehicle displaying a ‘for sale’ notice or any vehicle having on it anything displaying a ‘for sale’ notice unless that vehicle is being used for bona fide purposes of travel and stoppage incidental thereto.

c) park in or on any road or public place any vehicle for a continuous period exceeding seven days

10.3 No person shall alter, add to, or repair any vehicle on any road or public place

except where such alterations, additions, or repairs are necessary to enable such vehicle to be removed from the road or public place but only then for such period is as reasonably necessary to enable the vehicle to be moved. in any prosecution for breach of this clause, the onus of proving that such alterations, additions or repairs were necessary to enable the vehicle to be removed from the road or public place or the reasonableness of the time taken shall be upon the defendant

10.4 No person shall move, deface or overturn or otherwise interfere with any notice board, sign, or disk located or placed by authority of the council on any road or public place

10.5 The Council may by resolution from time to time and subject to the erection of

prescribed signs: a) fix the maximum speed of vehicles or of specified classes of vehicles on

any specified road or any part thereof; b) prohibit on any specified road or public place the turning to the left or to

the right of any vehicles or any specified classes of vehicles; c) direct that vehicles on any specified road or public place or any part

thereof shall travel in one specified direction only; d) prohibit or restrict absolutely or conditionally any specified class of motor

vehicle from operating on or using any specified road or public place.

10.6 No person being the driver or person in charge of any vehicle shall operate that vehicle on any road or public place contrary to the prohibitions, limitations and restrictions imposed from time to time by resolutions of the council pursuant to clause 9.4 of this bylaw.

11 Defences

11.1 It shall be a defence for any person charged with a breach of the prohibitions,

limitations, or restrictions imposed by this bylaw that the act complained of was done or permitted or occurred in a traffic emergency or in compliance with a direction of a Parking Warden or a Police Officer or in compliance with a traffic control signal or a traffic sign or by reason of mechanical failure, provided that in the case of mechanical failure, the breach is not continued for longer than 24 hours.

12 Breaches 12.1 Any person commits a breach of this bylaw who does or causes or permits to

be done anything contrary to or other than is provided by this bylaw or any resolution of the council made hereunder

13 Penalties

13.1 Every person who commits a breach of this bylaw commits an offence and is liable to a fine as follows: a) a fine not exceeding the amount fixed by the Transport Act 1962 for any

breach for which an infringement fee is fixed by that act; b) a fine not exceeding $500.00 in any other case and where the breach is a

continuing one, to a further fine not exceeding $50.00 for every day on which the breach has continued.
