Thank you for your interest in purchasing Tax Resale Properties in Hidalgo County. This letter contains information about the auction, an explanation of the columns on the property list and instructions to help you obtain additional information. You must also complete an auction Registration Form.

THE AUCTION

THE AUCTION WILL BE HELD AT 9:00 A.M. ON SATURDAY, JUNE 22, 2013 INSIDE THE AUDITORIUM LOCATED ON THE FIRST FLOOR OF THE HIDALGO COUNTY COURTHOUSE. All persons wanting to purchase property must be registered to bid. Registration of bidders will be held on the day of the sale between 8:00 a.m. and 8:45 a.m.

Successful purchasers must present payment by 2:00 p.m. on Monday, JUNE 24, 2013. Only money orders and cashier’s checks will be accepted. We cannot accept personal checks, cash or credit cards. Money Orders or Cashier’s Checks should be made payable to Linebarger Goggan Blair & Sampson, LLP located at 205 S. Pin Oak Drive, Edinburg, Texas 78539.

THE REGISTRATION FORM

The Registration Form must be filled out and signed by every person desiring to purchase property prior to making a bid.

PROOF OF NO DELINQUENT TAXES OWED

Section 34.015, of the Texas Property Tax Code now requires that before the entities can execute and deliver a tax resale deed, the purchaser must furnish the officer a written statement issued by the Tax Assessor-Collector for the County in which the sale takes place. The written statement must state that the purchaser has no known delinquent taxes owed to the county or to any school district, city or irrigation district that has territory in the county. This would include unpaid taxes on property that you may have formerly owned if the taxes were incurred during your time of ownership. A successful bidder must present this written statement at Registration on June 22, 2013.

AUTHORIZATION TO BID

If a person intends to bid on property and not have his/her name on the deed, then some documentation of the bidder’s authority to act on behalf of the other person or entity should be provided to the officer conducting the sale. For example, if a person is bidding as an agent for another individual, the bidder will need to have a power of attorney from that other individual showing that the bidder is authorized to purchase property in the other person’s name, and the statement of no taxes owed from the county Tax Assessor-Collector must be for the name of the person who takes title, rather than in the name of the person/agent actually bidding. Similarly, if a person is bidding and purchasing property for a corporation, then a corporate resolution or similar document showing the authority of that person to act for the corporation should be furnished to the office conducting the sale and, in that instance, the county Tax Assessor-Collector’s written statement concerning delinquent taxes must be issued in the name of the corporation. Proof of authority to bid must be presented prior to the sale.

CONDITIONS OF SALE

This property is being sold for taxes, and all sales are made subject to a right to redeem within the time and manner provided by law. Purchasers have a legal right to possession of the property during the redemption period. Purchasers will receive a Tax Resale Deed, which is without warranty. It is the

THE PROPERTY LIST

The Property List will tell you the properties for sale, where they are located, the minimum acceptable bid and the estimated value of the property per the Hidalgo County Appraisal District.

TRACT NUMBER – This is a number assigned to each tax resale property. Use this number to identify the property in any conversation or correspondence with our office. This will allow us to respond to you more quickly.

SUIT NUMBER – The District Court file number of the lawsuit leading to the original tax sale.

LEGAL DESCRIPTION – The location of the property based on Surveyor Maps, Metes and Bounds, or Subdivision, Lot, and Block Numbers.

DEED FILED – The date that the Sheriff ’s Tax Deed was filed after the original tax sale. This date is important in determining the redemption period.

CURRENT PROPERTY VALUE – The value obtained from tax records of this property or similar properties on the tax roll. No warranties are made as to the accuracy of this number.

OPENING BID – The amount of taxes due including costs.

ACCOUNT NUMBER – The property’s tax account number on the Hidalgo County Delinquent Tax Roll.

TYPE OF PROPERTY – A general description of the property based on our site inspection.

LOCATION – A general location of the property. Purchasers should use the legal description to verify the actual location of the property.

RECORDING OF DEED

No Deeds will be released for recording until all entities who are required to execute the deed have done so. Please allow approximately eight (8) months or more for the deed to be filed.

REDEMPTION PERIOD

All sales are made subject to a right to redeem within the time and manner required by the Texas State Property Tax Code Section 34.21. The redemption period begins to run on the date the Sheriff or Constable deed was filed at the office of the county clerk – you will find that date on the list of properties, if available. The law firm makes no representation as to the redemption period on any particular piece of property. Purchasers must make their own determination.
