The facility is a Type I municipal solid waste landfill with separate Type I and
Type IV units. The facility will accept residential and commercial municipal
solid waste from residents and businesses in Ector and surrounding counties.
The waste stream will be typical of what is generated by minicipalities. A
Recycling Center (MSW#100494) is located on the west side of the property
within the permit boundary, owned and operated by Diamond Back Recycling
and Sanitary Landfill, LP. As authorized, the Recycling Center will only collect
and process non-putrescible source separated recyclable material. Any
materials that cannot be recycled will be disposed at the Municipal Solid Waste
Facility at the site.

Permit Application Dear Mr. Windham,
In response to the letter dated June 10, 2020, Parkhill, Smith & Cooper (PSC) offers the following to address your comments. PSC proposes a new driveway for the facility. The proposed driveway will be constructed to meet the current Access Management Standards of TxDOT and uses guidance from the Odessa District IAC Technical Memorandum concerning access management. The new driveway will be constructed of concrete and will include a 34-ft wide throat and 60-ft radii. A traversable apron with 70-ft radii will be constructed of caliche base. This design will allow trucks to enter the drive even while a vehicle is waiting to exit, without having to slow excessively on FM 866. Additionally, the shoulder will be widened 10 feet from the white edge line 250 feet either side of the driveway. This will allow traffic to use the shoulder to either slow as it approaches the drive or accelerate as it exits the drive with less impact on FM 866 through traffic. The proposed plan view of the driveway can be seen in Attachment 1. An application for a new driveway permit will be submitted upon issuance of the municipal solid waste permit. The driveway permit will be submitted prior to, but within 6 months of driveway construction. An updated traffic analysis will be available upon a formal request from TxDOT after facility is fully operational. Updates to the driveway for additional turn lanes or similar features shall be constructed if evaluation indicates sufficient disparity. We request TxDOT concur with our recommendation. June 10, 2020 Mr. Todd Stiggins Parkhill Smith & Cooper (PSC) 4222 85th Street Lubbock, Texas 79423 RE: Diamond Back Solid Waste Facility & Recycling Center Dear Mr. Stiggins, TxDOT Odessa District has reviewed the traffic analysis that was performed for the above-mentioned site located on FM 866 approximately 2 miles north of IH 20 in Ector County and we offer the following comments.
• TxDOT has concerns about the traffic modeling methodology and projections utilized in the analysis and their applicability to the site conditions. However, we understand the difficulty in obtaining accurate traffic projections utilizing currently available information and standard procedures.
• Because the modeling should use nonstandard procedures, , TxDOT may request a re-evaluation of the traffic analysis and projections against actual traffic volumes and patterns once the site is made fully operational. We reserve the right to require additional turn lanes or similar features if the comparative evaluation indicates sufficient disparity.
• What are the details and location of the new driveway into the facility? This will require application for and issuance of a new driveway permit. TxDOT will need to evaluate and determine if the driveway can be accommodated with the additional development that has occurred near this site.
• Speed reductions would require an engineering study and would need to look at the entire FM 866 corridor. Speed reductions for a specific access or development are not usually recommended.
• The existing driveway was approved in 2017 and was submitted as a temporary or Phase 1 access based on 1 or 2 vehicles per hour. The driveway permit called for a 30’ throat width with 75’ radii, but the current driveway was not constructed in accordance with this permit. It must be reconstructed to meet current Access Management Standards. We do not recommend placement of 2 exit lanes as these movements will conflict with each other, increase conflict points, and potentially cause safety concerns.
• As the traffic analysis shows there is added safety value in the inclusion of turn bays on FM 866, but as discussed above, additional and accurate traffic data will be needed. The driveway should be designed to accommodate the turning movements for the anticipated vehicle usage along with a shoulder widening 250’ each side of the driveway to obtain a minimum 10’ shoulder. The shoulder widening is required to mitigate the edge drop-off issues that are typically seen with truck traffic entering and exiting the facility. Attached is our current standards for commercial and industrial driveways.

Water Balance Final Cover construction shall be subjected to an approval of a permit
modification from TCEQ to include complete design of the final cover. Pre-construction testing
will be conducted on the borrow soil material. Thickness of Water Balance Final Cover will be
determined from hydraulic conductivity of the borrow soil. Tests will be conducted during
construction, to verify that final cover geometric mean hydraulic conductivity is not greater than
the borrow soil test results.
As provided for in TCEQ RG-494, no vegetation is required for the water balance final cover to
function as designed. Vegetation will be established within the erosion layer to provide for
additional protection from erosion. Native grasses will be established immediately following
construction of the water balance final cover. Refer to Appendix III.H.2 - Final Cover Quality

The final cover system will be maintained consistent with Part III, Attachment I – Post-Closure
Plan. Following facility closure, final cover will be maintained as described in Attachment I -
Post-Closure Plan. Final cover soil layer will be constructed in accordance with construction
details shown in Part III, Appendix III.H3 –Final Cover Figures and Details, Figure III.H2.
Testing 5 feet of compacted clay-rich cover soil for coefficient of permeability will occur no less
than one test per acre of final cover.
Revised Universal Soil Loss Equation (RUSLE) calculations predict rate of soil loss for final
cover to be within TCEQ guidelines. RUSLE calculations are included in Appendix III.C.3.

2.0 FINAL COVER SYSTEM
2.1 FINAL COVER
2.1.1 Prescriptive Final Cover
The prescriptive final cover system will consist of an infiltration layer, a flexible
geomembrane, drainage geocomposite and erosion control layer on top. The infiltration
layer will 18 inches of compacted soil with a coefficient of permeability less than or equal
to 1x10-5 cm/sec. The flexible geomembrane will be a 40 mil LLLDPE geomembrane
placed over the infiltration layer. The drainage layer will be double sided geocomposite
and the erosion layer will be 6 inches of soil. Erosion layer will be placed over the drainage
layer and be capable of sustaining native plant growth. The final cover will be seeded with
native grasses and plants immediately following soil placement to minimize erosion. Final
cover system will be maintained consistent with those defined in Part III, Attachment C -
Facility Surface Water Drainage Report.
2.1.2 Alternative/Water Balance Final Cover
In accordance with 30 TAC $330.457(d), Diamond Back Solid Waste Facility & Recycling
Center will install an alternate final cover over both Type I and Type IV disposal areas.
The alternate final cover will consist of a water balance final cover designed in accordance
with TCEQ Regulatory Guidance RG-494 Guidance for Requesting a Water Balance (WB)
Final Cover for a Municipal Solid Waste Landfill. TCEQ RG-494 is included in
Appendix III.H.1. TCEQ RG-494 provides for four options for water balance final cover.
Diamond Back Solid Waste Facility & Recycling Center will utilize Option 1 - Statewide
Design Table for construction water balance final covers at the facility.
In accordance with TCEQ RG-494, the water balance cover will consist of a minimum
18-inch-thick storage layer overlain by a minimum 6-inch thick erosion layer. The
thickness of each final cover layer may vary depending upon the hydraulic conductivity of
the borrow soil material. Water Balance Final Cover construction shall be subjected to an
approval of a permit modification from TCEQ to include a complete design of the final
cover.
As provided for in TCEQ RG-494, no vegetation is required for the water balance final
cover to function as designed. Vegetation will be established within the erosion layer to
provide for additional protection from erosion. Native grasses will be established
immediately following construction of the water balance final cover.
The Final Cover System will be constructed from onsite soil and seeded with native grasses
and plants immediately following soil placement to minimize erosion. Final cover system
will be maintained consistent with those defined in Part III, Attachment C - Facility Surface
Water Drainage Report. Following facility closure, the final cover will be maintained as
described in Part III, Attachment I – Post-Closure Plan.

The final cover system will be constructed in accordance with construction details shown
in Appendix III.H.3 - Final Cover Figures and Details and specifications provided herein.
2.2 CONSTRUCTION MONITORING
Continuous on-site monitoring is necessary to assure components of final cover system
are constructed in accordance with this FCQCP. CQA monitor shall provide continuous
on-site observation during the following activities:
• Infiltration/Storage layer placement, processing, compaction, and testing;
• Flexible membrane layer deployment, trial welds, seaming, testing, and repairing (for
prescriptive cover only);
• Drainage layer deployment and seaming (for prescriptive cover only);
• Erosion layer placement; and
• Any work that could damage installed components of final cover system.
GP or POR will document and certify the final cover system was constructed in accordance
with this FCQCP. GP or POR shall make sufficient site visits to observe critical
construction activities and verify construction and QA activities are performed in
accordance with this FCQCP.
3.0 INTERMEDIATE COVER AND GRADING
3.1 GENERAL
Landfill completion plan provides for the landfill cover to slope to the perimeter 4H:1V
side slopes. Final lift of waste will be covered by intermediate cover placed in accordance
with the Part IV - Site Operating Plan.
3.2 MATERIALS
Intermediate cover will consist of general fill that has not previously come into contact
with waste.
3.3 SLOPES
Slope stability analyses are provided in Attachment D5 – Geotechnical Design,
Appendix D5.B, and are only valid for conditions that were analyzed. Any changes to final

cover system or landfill completion plan will necessitate slope stability analyses be revised
to reflect actual conditions. Further, slope stability analyses represent end-of-construction
conditions and may not represent temporary conditions during construction. Temporary
construction slopes shall not be steeper than final slopes and concentrated loadings, such
as heavy equipment and soil stockpiles, and not placed near the crest of slopes unless
additional slope stability analyses are performed.
3.4 TESTING AND VERIFICATION
Intermediate cover placement and grading will be observed and documented by landfill
staff in accordance with the Site Operating Plan.
4.0 INFILTRATION/STORAGE LAYER
4.1. GENERAL
The infiltration/storage layer will consist of compacted, relatively homogeneous material.
Infiltration layer shall consist of soil that is free from debris, foreign objects and organic
material. The soil properties for the infiltration layer shall meet the following: plasticity
index (ASTM D 4318) 15 or greater; liquid limit (ASTM D 4318) 30 or greater; percent
passing 200 sieve (ASTM D 1140) 30 or greater; and coefficient of permeability (ASTM
D 5084 or COE EM 1110-2-1906 Appendix VII) 1x10-5 cm/sec or less.
The minimum required thickness of the storage layer is derived from Option 1 - Statewide
Design Table of TCEQ Regulatory Guidance RG-494 Guidance for Requesting a Water
Balance (WB) Final Cover for a Municipal Solid Waste Landfill. TCEQ RG-494 is
included in Appendix III.H.1. CQA monitor shall provide continuous on-site observation
during storage layer placement, processing, compaction, and testing. GP shall make
sufficient site visits during storage layer construction to document construction activities,
testing, and thickness verification in the Final Cover FCER Report, in accordance with
Section 6.0.
Through normal operation, soils will be stored in stockpiles and borrow areas and shall be
used in preconstruction testing for use in the development of the water balance final cover.
Preconstruction testing procedures and frequencies for storage layer materials are listed in
Section 4.7.1 Table 2.

4.2 SUBGRADE PREPARATION
Before placing infiltration/storage layer material, subgrade should be proof rolled with
heavy, rubber-tired construction equipment to detect soft areas. POR or CQA monitor must
observe proof-rolling operation. Soft areas should be compacted then proof rolled again.
Subgrade elevations shall be verified in accordance with requirements of Section 4.7.3
before placing storage layer.
4.3 PLACEMENT AND PROCESSING
The infiltration layer/storage layer subgrade and surface of each lift should be scarified to
a 6-inch minimum depth before placing next lift of storage layer. Storage layer material
should be placed in 8-inch maximum loose lifts to produce a compacted lift thickness of
approximately 6 inches. Material should be processed to a maximum particle size of 1 inch
or less before water is added. Rocks and clods less than 1 inch in diameter should not total
more than about 10 percent by weight. Surface of top lift shall contain no material larger
than 3/8 inch.
If additional water is necessary to adjust moisture content, apply after initial processing but
before compaction. Water should be applied evenly across the lift and worked in the
material. Waste or any objectionable material must not contaminate compaction water.
In accordance with TCEQ RG-494, the minimum thickness of the storage layer is 18
inches. The required thickness of the storage layer shall be determined before constructing
the final cover. During preconstruction, on-site soils from stockpiles or borrow areas will
be assessed for hydraulic conductivity to thickness values in Table 1. To maintain
permitted final cover grades, the final top of waste heights will be adjusted based on storage
layer thickness requirements. Table 1 is excerpted from Table 3 in Section 10 of TCEQ
RG-494, which shows the relationship of hydraulic conductivity to storage layer thickness.

4.4 COMPACTION
Infiltration/Storage layer shall be compacted with a pad/tamping-foot or prong-foot roller.
A footed roller is necessary to bond lifts, distribute water, and blend soil matrix through
kneading action. Storage layer shall not be compacted with bulldozer, rubber-tired or flat-
wheeled roller, scrapers, or any track equipment unless used to pull a footed roller.
Compactor should weight at least 40,000 pounds. Lift thickness shall be controlled to
achieve total penetration in the top of the previously-compacted lift; therefore, lift thickness
must not be greater than pad or prong length. Cleaning devices on the roller must be in
place and maintained to prevent prongs or pad feet from becoming clogged to the point
they cannot achieve full penetration.
Compactor shall make at least four passes across area being compacted. A pass is defined
as the front and rear drums of the compactor making one pass. Material should be
compacted to a minimum 95-percent of the maximum dry density determined by Standard
Proctor (ASTM D698) at a moisture content dry of optimum moisture. Areas with failing
tests shall be reworked, recompacted, then retested with passing tests before another lift is
added.
4.5 PROTECTION
Completed infiltration/storage layer must be protected from desiccation, rutting, erosion,
and ponded water until erosion layer is placed. Areas that undergo excessive desiccation
or damage shall be reworked, recompacted, and retested as directed by GP or POR.
4.6 TIE IN TO EXISTING COVERS
Edge of existing storage layers shall be cut back on either a slope or step to prevent
formation of a vertical joint.
4.7 TESTING AND VERIFICATION
4.7.1 Preconstruction Testing
Table 2 lists minimum testing required for material proposed for use as
infiltration/storage layer.

Field moisture contents of constructed soil cover should be in the dry of optimum
region.
After the moisture density relationship is determined for a material type, a soil
sample should be remolded to about 95-percent maximum dry density at the
optimum moisture content. The preconstruction testing of borrow soils will be used
to determine hydraulic conductivity and minimum storage layer thickness of final
cover by using Table 1, in accordance with TCEQ Regulatory Guidance RG-494
Guidance for Requesting a Water Balance Final Cover for a Municipal Solid Waste
Landfill.
Undisturbed constructed soil cover samples should be collected in 3-inch or greater
diameter thin-wall tubes at a frequency of at least one test per 2.5 acres per lift and
tested in the laboratory for moisture content, dry unit weight, and saturated
hydraulic conductivity. Water balance construction methods must ensure as-built
soil density is adequate for sufficient vegetation growth, maintaining design values
for unsaturated hydraulic conductivity, and minimizing developments of cracks,
macro features, and differential settlement.

4.7.2 Construction Testing
Table 3 lists minimum testing required for material used for use as the storage layer:
Atterberg limits of in-place infiltration/storage layer must be continually compared
to Atterberg limits of the Proctor curve sample to assure Proctor curve accurately
represents in-place material. Any variance of more than 10 points between liquid
limit or plasticity index of in-place soil and those of the Proctor curve sample, will
require a new Proctor curve be developed.
4.7.3 Thickness Verification
As-built thickness of infiltration/storage layer shall be determined by standard
survey methods. Before placing infiltration/storage layer material, subgrade
elevations will be determined at a minimum rate of one survey point per 5,000
square feet of lined area. After infiltration/storage layer is completed, top of

infiltration/storage layer elevations will be determined at same locations as
subgrade elevations.
During construction, storage layer soil samples will be assessed for as-built
hydraulic conductivity to verify minimum storage thickness determined from
preconstruction. Areas with hydraulic conductivity higher than determined during
preconstruction will be further compacted and retested. The thickness of the storage
layer may be adjusted based on the results of construction testing of hydraulic
conductivity and comparison to Table 1, in accordance with TCEQ Regulatory
Guidance RG-494 Guidance for Requesting a Water Balance Final Cover for a
Municipal Solid Waste Landfill. To maintain permitted final cover grades, the final
top of waste heights will be adjusted based on storage layer thickness requirements.
5.0 FLEXIBLE MEMBRANE LAYER
5.1. GENERAL
The flexible membrane layer component of the final cover system consists of a 40 mil thick
linear low density polyethylene (LLDPE) placed over the infiltration layer. The CQA
monitor shall provide continuous on-site observation during geomembrane deployment,
trial welds, seaming, testing and repairing. The POR shall make sufficient site visits during
the geomembrane installation to document the installation and testing in the final cover
evaluation report.
5.2. MATERIALS
5.2.1 Properties
Flexible membrane layer shall consist of textured LLDPE produced from virgin
raw materials. Recycled materials are not acceptable. Manufacturer quality control
testing procedures and frequencies for geomembrane are listed in Section 5.5. Third
party conformance testing procedures and frequencies are listed in Section 5.5.2.
5.2.2 Delivery and Storage
Geomembrane shall be shipped in rolls labeled with the manufacturer's name, roll
number, and lot or batch number. The CQA monitor shall inspect the rolls for
shipping damage and complete a receipt log for all materials delivered to the site.
Damaged rolls shall be rejected.
Geomembrane shall be unloaded and handled with equipment that does not damage
the rolls. Rolls should not be pushed or dragged to the storage location. The
geomembrane shall not be stored on a stable subgrade. Geomembrane must not be
stacked more than five rolls high to avoid crushing the roll cores. The stored
geomembrane must be protected from puncture, grease, dirt, excessive heat, or any
other damage.

5.3. PREPARATION
Prior to installation of the geomembrane the infiltration layer shall be tested and verified.
The CQA or POR shall monitor geomembrane installation and shall inspect the surface of
the infiltration layer to verify that:
• The infiltration layer surface has been smooth drum rolled;
• The infiltration layer surface is free from irregularities, soft areas, or loose soil; and
• The infiltration layer surface is free of stones, or other objects that could damage the
geomembrane.
The geomembrane installer must accept the condition of the infiltration layer and sign a
subgrade acceptance form prior to installation of the geomembrane layer.
5.4. INSTALLATION
5.4.1 Deployment and Placement
Geomembrane installer shall submit a drawing showing the proposed panel layout.
Geomembrane shall be deployed by equipment that will unroll the geomembrane
without damaging the infiltration layer or the geomembrane. Geomembrane shall
not be deployed on frozen subgrade or during rain or high winds. The installer must
deploy the amount of geomembrane that can be seamed on the same day.
The CQA monitor must:
• Provide full time observation;
• A minimum of five thickness verification tests for each panel. A minimum of
one thickness verification test shall be performed per 5 feet along the edge of
the panel. No measurement may be less than 90 percent of the nominal panel
thickness;
• Record panel numbers, dimensions, and roll numbers on the panel layout
drawing;
• Record weather conditions;
• Note any deficiencies on subgrade that shall be repaired and approved by CQA
monitor. Note any defects of the geomembrane. All defects must be repaired in
accordance with Section 5.4.4.;

• Observe that people working on the geomembrane do not smoke, wear shoes
that could damage the geomembrane; and
• Observe that there are no horizontal seams on side slopes.
5.4.2 Seaming
Only welding apparatus and operators that have completed approved trial welds
shall be allowed to weld panel seams. Each seam shall be assigned a unique
number, which is preferably consistent with panel numbering system. Side slope
seams shall be oriented downslope. Prior to welding, the proper panel overlap shall
be provided. Dirt, grease and free moisture shall be cleaned from the panel contact
area. Seaming operations shall not be allowed when the ambient temperature is
below 40 deg F or above 104 deg F unless trial welds have been demonstrated that
adequate welds can be achieved outside these limits.
5.4.3 Anchor Trenches
Anchor trenches shall be left open until the seaming is completed. Expansion and
contraction of the geomembrane shall be accounted for during deployment. The
bottom of the anchor trenches shall be backfilled with compacted general fill that
is free of particles larger than 1-inch diameter. Anchor trenches shall be backfilled
in a way that does not damage or induce stress to the geomembrane.
5.4.4 Repairs
Defects in geomembrane, defects in seam, failing destructive tests, failing non-
destructive tests, holes from non-destructive tests, and destructive test sample
locations shall be repaired by one of the following repair techniques.
• Patching - used to repair large holes, tears, large defects and destructive test
locations.
• Extrusion - used to repair small defects, cuts, holes from non-destructive tests
and seam defects less than 1/2 inch long.
• Capping - used to repair failed seams or seams where non-destructive tests
cannot be performed.
• Removal - used to replace areas with large defects where other repair techniques
are not appropriate.

5.5. TESTING AND VERIFICATION
5.5.1 Manufacturer’s Quality Control Testing and Conformance Testing
The manufacturer shall test the geomembrane and raw materials in accordance with
GRI standard GM17 to assure the quality of geomembrane. Samples shall be cut
across the full width of selected rolls or may be taken at the manufacturing plant or
at the project site and will be forwarded to a third-party testing laboratory.
5.5.2 Trial Welds
Each operator and welding apparatus must be tested to verify that seam welds
meeting the specifications can be achieved under the site conditions. Trial welds
must be performed at the beginning and midpoint of each day for each operator and
apparatus used that day. If welding continues past 6:00 pm, additional trial welds
may be required.
The CQA monitor must observe the trial welding operations and document the
operator’s initials, apparatus number, time, date, air temperature and peel and shear
test results.
5.5.2 Construction Testing
Non-destructive seam tests include vacuum pressure tests and air pressure tests.
Vacuum testing shall be used to test extrusion welded seams and fusion welded
seams that cannot be tested by air pressure methods. During the non-destructive
testing the CQA monitor must:
• Observe that equipment and operators perform the tests properly;
• Observe that the entire length of each seam is tested and recorded;

• Identify failed seams and inform the installer of any required repairs; and
• Record all completed and tested for repairs.
Destructive testing shall be performed at a frequency of one stratified test location
per 500 linear feet of seam. During destructive seam testing, the CQA monitor
must:
• Select sample locations and observe sample cutting;
• Assign sample numbers and label samples;
• Observe installer performed tests; and
• Record sample locations, sample number, sample purpose, and field test results.
6.0 DRAINAGE LAYER
6.1 GENERAL
The drainage layer on sideslopes consists of a double sided geocomposite. The POR shall
make sufficient site visits during the geocomposite installation to document the installation
for the final cover evaluation report.

6.2 MATERIALS
The double sided geocomposite will have nonwoven geotextile bonded to the top and
bottom of geonet. Geocomposite shall have the minimum properties as listed in Table 6.

6.3 DELIVERY AND STORAGE
Geocomposite shall be shipped in rolls labeled with the manufacturer’s name, roll number,
and lot or batch number. The CQA monitor shall inspect the rolls for shipping damage and
complete a receipt log for all the materials delivered to the site. Damaged rolls shall be
rejected.
The material shall remain undamaged during unloading and handling. Rolls should not be
pushed or dragged to the storage locations. Geocomposite shall not be stored on a stable
subgrade. Geocomposite must not be stacked more than five rolls high to avoid crushing
the roll cores. The stored materials must be protected from puncture, grease, dirt, excessive
heat and other damage.
6.4 INSTALLATION
Prior to installation, geomembrane shall be tested and verified. The CQA monitor shall
observe that the surface to receive the geocomposite is free of debris, stones and dirt, and
verify that the conformance documentation was submitted and approved.
Geocomposite shall be deployed by equipment that will unroll the material without
damaging the underlying layers. All panels must be anchored to prevent uplift from wind.
Smoking and wearing shoes that may damage the materials or underlying geomembrane
shall not be permitted and only low ground pressure supporting equipment shall be allowed
on materials. Adjacent rolls of geocomposite shall be securely tied with plastic fasteners.
The CQA monitor must:
• Provide full time observation;
• Record weather conditions;

• Observe the condition of the geocomposite and note any defects. All defects must be

• Observe that people working on the geocomposite do not smoke or wear shoes that
could damage the materials or underlying geomembrane;
• Observe that the deployment method minimizes wrinkles in the materials or underlying
geomembrane; and
• Observe that the geocomposite panels have been properly tied.
6.5 TESTING AND VERIFICATION
The manufacturer shall test the geocomposite to assure the quality of the drainage
materials. Table 7 provides manufacturer testing lists and frequency. Manufacturer's testing
shall be performed at a minimum frequency of one test per 100,000 sf.

7.0 EROSION LAYER
7.1. GENERAL
Erosion layer consists of 6 inches of soil capable of sustaining native plant growth. Erosion
layer shall be minimum 12 inches thick if storage layer is comprised of high-plasticity clay.
CQA monitor shall provide continuous on-site observation during erosion layer placement
to assure erosion layer placement does not damage underlying storage layer. GP or POR
shall make sufficient site visits during erosion layer placement to document construction
activities and thickness verification in the Final Cover Evaluation Report.
7.2. MATERIALS
Erosion layer materials shall consist of soil free from debris, rubbish, frozen materials,
foreign objects, and organic material. The erosion layer shall consist of on-site soils capable
of sustaining native plant growth.
7.3. PREPARATION
Before placing erosion layer material, storage layer elevations shall be verified in
accordance with requirements of Section 4.7.3.
7.4. PLACEMENT
Erosion layer shall be dumped from the haul road and spread by low ground pressure
equipment. On side slopes, erosion layer shall be placed from bottom to top, not across or
down.
As provided in TCEQ RG-494, no vegetation is required for the water balance final cover
to function as designed. Vegetation will be established within the erosion layer to provide
for additional protection from erosion. Native grasses will be established immediately
following construction of the water balance final cover.
7.5. TESTING AND VERIFICATION
As-built thickness of erosion layer shall be determined by standard survey methods. Before
placing erosion layer, top of storage layer elevations will be determined at a minimum rate
of one survey point per 5,000 square feet of lined area. Top of storage layer will be
considered as bottom of erosion layer.
7.6. Erosion Protection
As required by §330.457(d)(2), water balance final cover must provide equivalent
protection from wind and water. Water balance final cover has identical erosion controls
as prescriptive cover, structural and non-structural. Attachment III.C shows maximum final
cover soil erosion is 2.77 tons per acre-year, less than standard 3 tons per acre-year.

7.7. Vegetation
Water balance final cover for the facility is designed without reliance on vegetation for
moisture transportation. Native grasses will be established immediately after construction
of final cover by seeding or sodding to provide additional protection from erosion. A
semi-annual vegetation establishment report will be submitted until vegetation is
established. The report shall include type and quantity of vegetation established.
8.0 DOCUMENTATION
After construction of final cover system, POR will submit a Final Cover Evaluation Report to
TCEQ on behalf of Owner. The purpose of the Final Cover Evaluation Report is to document
construction methods and test procedures are consistent with this FCQCP. At minimum, the Final
Cover Evaluation Report will contain:
• Summary of all construction activities.
• Summary of all laboratory and field test results.
• Description of significant construction problems and resolution of the problems.
• Record Drawings.
• Statement of compliance with FCQCP.
• Completed report forms required by TCEQ.
• Drawings showing sample and test locations.
• Instructions to limit equipment weight and traffic on the cover and procedures for
identifying and correcting out-of-specification compaction and other situations or
damage.
• Vegetation details for erosion control purposes, plants proposed for erosion control, and
target percent coverage.
• Seal and signature of POR in accordance with the Texas Engineering Practice Act.

D. Final Cover Vegetation or Other Ground Cover Material
The final cover will be seeded and/or sodded with native plants immediately following
the application of the final cover in order to minimize erosion. Other materials, including NA, may be incorporated over the final cover soil surface to ensure sufficient
coverage of the ground surface to minimize erosion. The estimated percent ground cover to minimize soil loss and maintain long-term erosional stability of the final cover top and side slopes is: 60%. The minimum material specifications for other ground
cover materials are summarized in the table below.
For a landfill with water balance final cover design, the percentage vegetation cover
(excluding other ground cover types) will not be less than that assumed in the water balance final cover model.

C. Final Cover Quality Control Plan
A final cover quality control plan (FCQCP), Attachment III.H2, is attached. The FCQCP describes the final cover system design, construction, and evaluation protocol and processes, including the personnel, materials, methods, sampling and testing
standards, procedures, and practices to be used in procuring, handling, installing, and evaluating all elements of the final cover system. It establishes the material
requirements; personnel qualifications and roles; installation requirements; quality control and quality assurance monitoring, testing, documentation, and reporting programs to be used during construction of each component of the final cover system
to assure and to verify that the final cover system is constructed as designed and in accordance with applicable rules and technical standards.
D. Documentation and Reporting of Final Cover System Construction and Testing
The professional of record will document all aspects and stages of the final cover
installation, including materials used, equipment and construction methods, and the type and rate of sampling and quality control testing performed. Following completion of construction of the final cover, the site operator/permittee will submit to the TCEQ
executive director, a Final Cover System Evaluation Report (FCSER) for each landfill unit.
Closure Activities and Completion Schedules for Each Landfill Unit and for the Final Facility Closure
A. Closure of a Landfill Unit
The following activities will be conducted to satisfy the closure criteria for a landfill
unit:
Closure Notification to the TCEQ Executive Director:
The site operator will inform the executive director of the TCEQ, in writing, of the intent to close the unit no later than 45 days prior to the initiation of closure activities and place this notice of intent in the operating record.
Stoppage of Waste Acceptance and Commencement of Other Closure Activities for the Unit:
The site operator will stop accepting waste upon receiving the known final receipt of waste. The site operator will ensure that the permitted top elevations of the in-place waste, as depicted in/derived from the unit’s final contour map

approved by the TCEQ executive director, are not exceeded at any section or part of the landfill unit. The site operator will begin closure activities for the unit
no later than:
● Thirty days after the date on which the unit receives the known final receipt
of wastes; or
● One year after the most recent receipt of wastes if the unit has remaining capacity and there is a reasonable likelihood that the unit will receive
additional wastes.
Request for Extension Beyond the 1-Year Deadline for Commencing
Closure Activities for a Unit:
The site operator may submit a written request to the executive director of the TCEQ for review and approval for an extension beyond the one-year deadline for
the initiation of closure. The request will include the following:
(a) All applicable documentation necessary to demonstrate that the unit has
the capacity to receive additional waste; and
(b) All documentation necessary to demonstrate that the site operator has taken and will continue to take all steps necessary to prevent threats to
human health and the environment from the MSW landfill unit.
Construction of Final Cover:
The site operator will construct the permitted final cover over the waste mass utilizing methods, procedures, and specifications described in the FCQCP. The final constructed contours, elevations, and slopes of the installed final cover will
match the permitted final cover contours, elevations, and slopes shown in
closure drawings contained in this closure plan.
Construction of Drainage Features:
The site operator will construct the drainage structures shown in drawings
referenced or contained in this closure plan or in the facility surface water drainage report.
Completion of Outstanding or Replacement of Damaged Groundwater or
Landfill Gas Monitoring Components:
The site operator will complete installation of any outstanding or replacement of
any damaged groundwater or landfill gas monitoring system components and landfill gas control systems as needed to maintain current and effective groundwater or landfill gas monitoring and control systems.
Submittal of Final Cover System Evaluation Report (FCSER) to the TCEQ Executive Director:
Following completion of construction of the final cover for the subject landfill unit, the site operator will submit to the TCEQ executive director for review and acceptance, a FCSER for the unit.

Completion of Closure Activities for the Landfill Unit:
The site operator will complete closure activities for the unit within 180 days
following the start of closure activities, unless the executive director of the TCEQ grants an extension as described in Item V.A.8(a) below.
The site operator may submit a written request for an extension for the
completion of closure activities to the TCEQ for review and approval. The extension request will include:
● All applicable documentation necessary to demonstrate that closure will, of necessity, take longer than 180 days; and
● All applicable documentation necessary to document that all steps have been taken and will continue to be taken to prevent threats to
human health and the environment from the unclosed MSW landfill
unit.
Submittal of Engineer’s Certification of Closure to the TCEQ Executive Director and Request of Closure Inspection to TCEQ Regional Office:
Following completion of all closure activities for the landfill unit, the site operator
will submit:
A written request to the local TCEQ regional office for a closure inspection of the unit.
A certification, signed by an independent licensed professional engineer, to the executive director of the TCEQ for review and approval verifying
that closure has been completed in accordance with this closure plan. The site operator will submit the certification via registered mail, and the submittal will contain all applicable documentation necessary for
certification of closure of the unit, including:
● A final cover system evaluation report (FCSER) documenting the
installation of the final cover. The FCSER may be submitted as a separate document for review and approval following the completion of the final cover installation. In that case, the certification of closure will
be submitted subsequently;
● A final contour map as described under Section III.E that includes the
relevant unit; and
● Copy of the letter to the TCEQ regional office requesting a closure inspection of the relevant unit.

TCEQ’s Acknowledgement of Termination of Operation and Closure of a Unit:
Upon receipt, the TCEQ executive director will review the closure documents for completeness and accuracy; and following receipt of the closure inspection
report from the agency’s regional office verifying proper closure of the MSW landfill unit according to this closure plan, the executive director will, in writing, acknowledge the termination of operation and closure of the unit and deem it
properly closed. Thereafter, the site operator will comply with the post-closure care requirements described in the post-closure care plan for the unit.
Deed Recordation for Disposed Regulated Asbestos Containing Materials (RACM):
Upon closure of the unit that accepted RACM, the site operator will place a
specific notation that the unit accepted RACM in the deed records for the facility with a diagram identifying the RACM disposal areas. Concurrently, the site
operator will submit to the TCEQ executive director, a notice of the deed recordation and a copy of the diagram identifying the asbestos disposal areas.
Placement of all Closure Documentation in the Site Operating Record:
Once approved, the closure certification and all other documentation of closure will be placed in the site operating record.
Closure Schedule for the Landfill Unit:
A closure schedule is included in Part III Attachment H. The schedule shows all the closure activities listed within Section V.A and the timelines for commencing
and completing each activity. Also, the schedule shows that closure activities for the landfill unit will be completed within 180 days following the initiation of
closure activities as required, unless an extension is granted by the TCEQ executive director.

B. Closure of the Waste Storage or Processing Units or Operations
Closure of the waste storage or processing units or operations authorized under this
permit will include removal of all waste, waste residues, and any recovered materials. The facility units and operations will either be dismantled and removed off-site or
decontaminated. The site operator will dispose at the landfill or evacuate all materials (including feedstock, in process, and processed) to an authorized facility and disinfect all leachate handling units, tipping areas, processing areas, and post-processing areas.
If there is evidence of a release from a unit or operation, the site operator will conduct an investigation, as approved by the TCEQ executive director, into the nature and
extent of the release and an assessment of measures necessary to correct an impact to groundwater.
C. Final Closure of the Facility
In addition to the closure activities listed in Section V.A above for closing a landfill unit, the site operator will conduct the following activities for the closure of the entire
facility:
Publish Final Closure Notice and Place the closure Plan in a Public Place:
No later than 90 days prior to the initiation of the final facility closure, the site
operator will:
The site operator will publish notice in the newspaper(s) of largest circulation in the vicinity of the facility to inform the public of the final closure of the facility. This notice will include:
● The name of the facility;
● The address, and physical location of the facility;
● The facility’s permit number; and
● The last date of intended receipt of waste.
The site operator will also make available an adequate number of copies of the approved final closure and post-closure plans for public access and
review at the Ector County Public Library (state public place within the area, including address, where the plan will be available for public access and review).
Submit Written Notice of “Intent to Close the Facility” to the TCEQ Executive Director:
The site operator will provide written notification to the TCEQ executive director of the intent to close the facility. This notice will be provided to the executive
director no later than 90 days prior to the initiation of the final facility closure, and thereafter be placed in the site operating record.

Post Signs and Install Barriers:
Upon notifying the executive director of the intent to close the facility and no
later than 90 days prior to the initiation of final facility closure, the site operator will:
The site operator will post a minimum of one sign at the main entrance and all other frequently used points of access for the facility notifying all
persons who may utilize the facility of the date of closing for the entire facility and the prohibition against further receipt of waste materials after
the stated date.
Also, the site/operator will install suitable barriers at all gates or access
points to adequately prevent the unauthorized dumping of solid waste at the closed facility.
Filling of “Affidavit to the Public” and Performance of the Final Deed Recording:
Upon closure of all the landfill units or upon final closure of the facility, the site
operator will:
File with the county deed records an "Affidavit to the Public" in a form provided by the TCEQ executive director that includes an updated metes and bounds description of the extent of the disposal areas at the facility
and the restrictions to future use of the land in accordance with applicable provisions under 30 TAC Chapter 330, Subchapter T.
Record a certified notation on the deed to the facility property, or on some other instrument that is normally examined during title search, that
will in perpetuity notify any potential purchaser of the property that the land has been used as a landfill facility and use of the land is restricted
according to the provisions under 30 TAC Chapter 330, Subchapter T.
Place a copy of the “Affidavit to the Public” and a copy of the modified
deed in the site operating record.

Within ten days after completion of final closure activities of the facility, the site operator will submit the following to the TCEQ executive director by registered
mail:
(a) A certified copy of the "Affidavit to the Public";
(b) A certified copy of the modified deed to the facility property; and
(c) A certification, signed by an independent licensed professional engineer, verifying that final facility closure has been completed in accordance with
the approved closure plan. The submittal will contain all applicable documentation necessary for certification of final facility closure, including:
● Final Cover System Evaluation Report (FCSER) documenting the installation of the final cover. The FCSER may be submitted earlier as
a separate document for review and approval following the completion of the final cover installation. In that case, the certification of closure will be submitted subsequently;
● A final contour map as described under Item III.G above;
● Copy of a letter to the TCEQ regional office requesting a final closure
inspection of the facility; and
● Copies of documents verifying newspaper publication of the notice of the final facility closure.

Following the TCEQ executive director’s receipt and completion of the review of the professional engineer’s certification of the completion of facility closure and
the final closure documents, and receipt of the inspection report from the agency’s regional office verifying proper closure of the facility according to this closure plan, the executive director will, in writing, accept the termination of
operation and closure of the facility and deem it properly closed. Thereafter, the site operator will comply with the post closure care requirements described in
the post closure plan for the facility.
Final Closure Schedule for the Facility:
Attachment H, Final Closure Schedule, provides the closure schedule for the final
facility closure. It incorporates the schedule for closure of a unit as discussed in Section V.A and also shows the commencement and completion timelines for the
final closure activities listed within this Section.
