Subject: Variance Request- Ascent Resources - Utica, LLC Harr E MTP JF 7H, Jefferson County, Mt. Pleasant Township

Pursuant to Section 1501 :9-1-04 (E)(2) of the OAC, I hereby grant the variance request to the spacing requirements of Sections 1501:9-1-04 (C)(4)(c) of the OAC to Ascent Resources - Utica, LLC. Approval of this variance reduces the setback distance at the heel from 500 feet to no less than 375 feet to the unit boundary and the toe from 500 feet to no less than 150 feet to the unit boundary.

Approval of this variance also reduces the spacing between wells from 1000 feet to no less than 940 feet.

In the attached documents, the applicant has demonstrated that the approval of the variance will protect correlative rights and promote conservation by permitting oil and gas to be produced that could not otherwise be produced.

An "as drilled" survey plat showing the location of the perforations at the heel and toe sections of the well shall be submitted within 60 days of perforating the well.

HORIZONTAL DRILLING PERMIT CONDITIONS

Within sixty (60) days after the completion of drilling operations, the fo ll.owing items must be submitted to the Division of Oil and Gas Resources Management:

• A copy of the bore hole deviation survey.

• A post drilling map (revised surveyor' s plat) showing all of the fo llowing:

1. Surface location of the well ; 2. Actua l track of well bore; 3. Actual location of the first perforation; 4. Actual location of the last perforation; 5. Actual ending point of the bore hole in the target fo rmation; 6. X, Y coordinates of items 1, 3, 4 & 5 above.

• A fifty-do llar($ 50.00) fee for the post drilling map (revised surveyor' s plat) required by the conditions of the permit.

MINE STRING - BASKET

(For wells with mine voids less than 300 feet deep)

These condition must be displayed in a conspicuous place at the well ite in acco rdance

with Section 1509.05 of the Ohio R evised Code

At this location, the Division has identifi ed an underground mine void at approximately 229 feet.

Adm in. Code 150 l :9-1-08 (M)(2)( c) of the Well Construction Rules states that a mine string

shall not serve as the only water protection string. This well shall then be cased and cemented as

fo llows to protect al l underground sources of drinking water:

A 30" conductor casing shall be set to approximately 100 feet with cement circulated to surface;

While drilling below the conductor casing, a vacuum should be created on the surge line to divert any stray gas from the mine void away from the rig floor;

An 18 5/8" string of casing with a guide shoe shall be set between thirty and fifty feet below the mine void and cemented. Cementing shall be accomplished by the pump and plug method from TD to the mine void. Above the mine void, a cement basket shall be set on the first casing j oint

and the annular space shall be grouted from surface to protect any fresh water zone that may be

below the conductor casing. In the event that cement cannot be returned to surface, a cement bond log shal I be run to verify the placement and condition of cement in the bore hole;

Prior to dri lling the intermediate bore ho le, a casing shoe test sha ll be run for thirty minutes on

the 18 5/8" mine casing to verify the integrity of cement in the bore hole.

Below the 18 5/8' casing string a surface string of casing shall be set and cement shall be

circulated to surface.

Ascent Resources - Utica, LLC has simultaneously submitted the Applications for Permit to drill the Harr E MTP JF SH and 7H wellbores in Mt. Pleasant Township, Jefferson County, Ohio.

Pursuant to the Chiefs authority granted in Ohio Administrative Code (OAC) § 1 S01 :9- 1-04(E)(2), Ascent Resources - Utica, LLC requests an exception from the requirement of OAC § 1 S01 :9-1-04(C)(4)(b). For the proposed wells, the minimum distance from horizontal wellbore to horizontal wellbore will be as indicated below:

Ascent Resources - Utica, LLC will be drilling these wells to be spaced as near as possible to 976' between well laterals, as depicted on the surveyor plats. To allow for deviation while drilling, we are requesting the 940' variance, as stated above.

The proposed Rector MTP JF 2H and 6H horizontal wells will meet the minimum setback distance as required by OAC § § 1S01 :9-1-04(C)(4)(c); and, thus, will be at least SOO feet from any drilling unit boundary.

The requested distance between horizontal wellbores will promote conservation and recovery of oil and natural gas within the permitted drilling unit and allow the recovery of reserves that might otherwise not be produced. Because this request will promote conservation and prevent waste, it is in the best interest of the public welfare of the State of Ohio.

Pursuant to 1501 :9-1-04 (C)(4)(c) of the O.A.C., Ascent Resources - Utica, LLC (ARU) respectfully requests a variance to the well spacing requirements of 1501 :9-1-04 (2) of the O.A.C. for the Harr E MTP JF 7H wells located in Mt. Pleasant Township, Jefferson County. In the interest of protecting correlative rights while promoting the conservation of oil and gas, ARU requests a reduced spacing of 150' between the first take point of the well and the unit's boundaries. ARU also requests a reduced spacing of 375' between the last take point of the well and the unit's boundaries. This reduced spacing, as demonstrated by the attached and previously submitted microseismic data to the Chief, encourages the most efficient recovery of Ohio's natural resources without impacting offset units. Without such reduced setbacks, ARU firmly believes that recoverable minerals will be effectively stranded.

Enclosed you will find Hess's presentation to the ODNR's Technical Advisory Council on November 12, 2013 that discusses reduced well spacing. The presentation contains microseismic studies obtained in three Ohio counties which yielded fracture orientation and maximum event distance information. You will also find a map enclosed that depicts ARU's proposed Unit in proximity to Hess's submitted microseismic studies.

Based on the submitted information, ARU agrees with Hess on the following conclusions that support ARU's request of reduced spacing between both the first and last take points of the well and the unit's boundaries:

• The Maximum principle stress direction (SH_max) is similar in all 3 wells at N60°E. • Given the uniformity for the regional stress field, induced fracture orientations seen from

microseismic data are uniformly constrained in the direction the wells are drilled (N60°E). • Hess has concluded that setback can be reduced to 150' at the toe and heel of laterals without

impacting offset units. This reduction would enable longer laterals and up to 12% additional recovery across the play.

Hess proposes to reduce the set back regulation at the toe and heel of laterals from the current 500' to 150' based on microseismic data. Hess does not, at this time, propose to reduce the setback on the unit 'long side~

• Hess has acquired microseismic at 3 Utica well sites in Jefferson, Belmont & Guernsey counties. This data has yielded fracture orientation and maximum event distance information.

• The Maximum principle stress direction (SH-max) is similar in all 3 counties at N60°E.

• Given the uniformity of the regional stress field, induced fracture orientations seen from microseismic data are uniformly constrained in the direction the wells are drilled.

• Hess has concluded that setbacks can be reduced to 150' at the toe and heel of laterals without impacting offset units. This reduction would enable longer laterals and up to 12% additional recovery across the play.

• At this time Hess does not support reducing setbacks on the lateral 'long side'.

• Microseismic event distance along SH-max (fracture half-length) is useful to constra in fracture modeling, which in turn can be used to determine 'effective' fracture half length and drainage areas. Hess is currently working to better understand this dimension through reservoir simulation which integrates production, tracer, and microseismic data.

• North Dakota's setback regulations in the Bakken Shale Play are currently 200 feet in the heel and toe direction and

500 feet in the long axis direction.

• Hess has collected microseismic data on Utica Shale wells in Jefferson, Belmont and Guernsey counties.

• In ten toe and heel stages, the average distance from take point to the farthest microseismic event is 118' in the direction the wells are drilled.

• Uniform orientation of principal stresses across the play ensures fractures are confined in the Sh-min direction.

• Reducing current setback at the toe and heel of laterals from 500' to 150' would result in adding as much as 12% additional recovery to the Utica Shale Play without impacting neighboring leases.

Summary: Hess does not support changing setback rules

in the Shmax or "long axis" direction

The actual stimulated portion of induced fractures is often less than half of the apparent /roe length as marked by microseismicity.

Production history matching and reservoir simulation suggest a range of fracture propped lengths less than or equal to the current 500 ft setback on the "long axis 11 side of drilling units.

Hess is continuing to work to constrain SH-max fracture dimensions to determine 'effective' fracture half length and drainage areas, integrating production, tracer, and microseismic data.

ODNR mapping shows surface mining activity at this location. The #11 coal was surface mined below the proposed well pad location with base of coal at approx. 1130 msl. Cut slopes or toe keys may encounter remnant coal or groundwater associated with the #11 coal.

The #BA, #9 and #10 coals, if present, are unmined below the proposed well pad.

Deep mine Bt-185 is located below the proposed well pad . The Y & 0 Coal Company deep mined the No. 8 coal at approximately 876 msl (base of coal) using room and pillar methods and abandoned the mine in 1960's. Based on the mine map, there is solid coal below the well pad . (See deep mine map)

There is approximately 250 feet of insitu sedimentary bedrock above the abandoned deep mine Bt-185 with unmined coal (barrier pillar) below the proposed well pad that provides stability to the overburden.

Risk of surface damage due to mine subsidence is negligible. There are no active or pending mining permits at this location.

**Based on the available deep mine map, there is a solid coal below the proposed well locations. The well pad and well locations have been adjusted to try and take advantage of the barrier pillar. Consideration should be given to well bore and casing program sizing until the presence or absence of solid coal is proven.
