INTRODUCTION Sydney Trains and NSW Trains provide vital infrastructure to facilitate the daily travel requirements of thousands of commuters. The Stations also provide commuters with quality retail offerings between their journeys through leasing opportunities to businesses. The purpose of this Fit out guide is to ensure all leased premises (Retail and Commercial) within and around Sydney Trains / NSW Trains stations aesthetically complement the surrounding Station environment and most importantly ensure the leased premises does not impact on the safety or operation of the Rail Network. The guide has been prepared to guide tenants, designers, and Fit out contractors in the refurbishment of existing Fit outs or the construction of a new Fit out throughout the Rail Network. It sets out the Lessor’s procedures and processes for obtaining approvals for design and construction, while allowing the flexibility to encourage new and creative designs to complement the aesthetics of the Stations. The Fit Out Guide must be read in conjunction with the: Lessor Disclosure Statement;

Lease Agreement; and

Relevant building and planning codes.

TENANT OBLIGATIONS The tenant and their designer are responsible to ensure the proposed use for the premises and all materials used in the construction of the Fit out, comply with all relevant Authorities and Codes. These include and are not limited to; Building Codes of Australia;

Environmental and Assessment Act;

Disability and Discrimination Act;

Heritage Act;

Local Council; and

Standard guidelines for Fire and Life

Safety in Underground Railway Stations.

COMMENCING THE FIT OUT PROCESS

– Once the tenant has formally accepted the commercial terms of the Lease Agreement, the Fit out process must commence.

VERIFYING SITE DIMENSIONS AND SERVICES

– The Tenant and their Designer are responsible for verifying all dimensions on the provided plan of the premises and onsite services when developing a design concept and working drawings.

ALL COSTS

– The tenant is responsible for all costs associated with the preparation, design, purchase of all materials, hoarding, altering of services, construction and certification for the Fit out, including engaging the Lessor’s Fit Out Coordinator.

WHO MAY BE INVOLVED IN THE FIT OUT PROCESS TENANT The tenant must ensure all requirements under the lease as outlined in this Fit Out guide are met. DESIGNERS The tenant should engage a qualified, professional designer or architect to:

• design the concepts, develop detailed drawings;

• organise site visits and monitor Fit out works; and

• Liaise with the Fit out Coordinator, Contractors and the tenant from conception to occupation to ensure the Fit out meets design standards.

SHOP FITTERS, BUILDERS, TRADES PEOPLE The tenant’s hop fitters, builders and trades people must:

• Where relevant, have demonstrated experience in working with heritage significant buildings, and understand traditional building techniques;

• Comply with standard site management protocol (parking, noise levels, etc.); and

• Obtain a copy of the approved plans and conditions of consent, to ensure they execute works in compliance with all statutory approvals.

PRINCIPAL CERTIFYING AUTHORITY The Statutory Authority or a Private Accredited Certifier may be appointed by the tenant as the PCA to take responsibility for all requirements under the Environmental Planning and Assessment Act (EP&A) and the issuing of a Construction Certificate.

TENANT FIT OUT COORDINATOR The Fit Out Coordinator is involved in all aspects of a fit out from the pre-DA meeting to your occupation certificate. The Fit Out Coordinator ensures the tenant receives and understands the relevant Lessor documentation pertaining to the fit out works (e.g. fit out guide, architectural drawings), and that the tenant is aware of general site information and program milestones. The Fit Out Coordinator is also responsible for liaising with the designer and Builder to ensure all design aspects are adhered to. The Fit Out Coordinator assists tenants through the process, including liaising with tenants and relevant Sydney Trains Property Managers. PROPERTY MANAGER Property Managers manage the customer relationship between Sydney Trains / NSW Trains and tenants to ensure compliance with all lease terms and conditions, arrange maintenance and correspondence on behalf of Sydney Trains Property Division. They are also the point of contact for initial leasing conditions and approvals. OTHER INTERESTED PARTIES The tenant and their contractors may also have dealings with other parties who have an interest in the property including but not limited to station representatives, Area Managers, Environmental Staff and other Sydney Trains property staff.

FIT OUT PROCESS OVERVIEW - KEY STEPS

STEP 1 Engaging a Designer (Page: 7) The Tenant must engage a professional designer (Subject to Lessor approval) to create a design package for the proposed Fit out. STEP 2 Engage the Lessor’s Fit Out Coordinator (Page: 8) The Tenant must engage the Lessor’s Fit Out Coordinator at the Tenant’s cost to manage the Fit out process. STEP 3 Initial Site Meeting - Establishing the Station Category (Page: 9) The Fit Out Coordinator will meet the Tenant and their Designer on site to confirm the Station Category and discuss the category requirements and proposed design in accordance with the Fit out Guide. STEP 4 Design Concept (Page: 10) The Tenant’s Designer will produce a design concept (Subject to Fit Out Coordinator approval) in line with the outcomes of the initial site meeting, the Fit out guide and the requirements of the station’s category. STEP 5 Working Drawings (Page: 20) The Tenant’s Designer will produce a detailed set of drawings (Subject to Fit Out Coordinator approval) in line with the approved design Concept, the Fit out guide and the requirements of the station’s category. STEP 6 Lodging Local Authority Approvals (Page: 21) The Tenant/Tenant’s Designer must lodge all Local Authority Applications (if applicable) to obtain the approvals

required prior to the construction of the Fit out. All required documents must also first be submitted to the Property Manager to obtain Owners Consent prior to lodgment with the local authority.

STEP 7 Awarding a Fit Out Contractor (Page: 22) A reputable shop Fitter or builder must be engaged to construct the Fit out in line with the approved working drawings. STEP 8 Pre-Construction Site Meeting (Page: 23) Once all Local Authority Approvals are received (if applicable), the Fit Out Coordinator will meet the Tenant and Fit Out Contractor onsite to discuss their obligations during the construction process. STEP 9 Site Induction (Page: 24) Once the Construction commencement is set, the Fit out Contractor and any sub-contractors will report to the Station Management office for induction prior to works commencing. STEP 10 Construction (Page: 25) During the construction process, weekly meetings will occur between the Fit Out Coordinator, the Fit out Contractor and designer to ensure the progress of construction is in line with the approved working drawings. STEP 11 Approval to Trade (Page: 26) Once the Fit Out Coordinator is satisfied the Fit out is free from any defects and completed in line with the approved working drawing, the Tenant is issued with a Certificate of Completion to commence trading.

STEP 1 AWARDING A DESIGNER THE LESSOR MUST APPROVE THE DESIGNER PRIOR TO THE TENANT FORMALLY ENGAGING THEIR SERVICES. Within 14 days

of the Tenant formally accepting the Commercial Terms for the Lease Agreement, the Tenant must submit to the Lessor’s Property Manager for review the proposed Designer’s credentials.

The approval is subject to the Designer having the following capabilities, experience and skills; Are an architect or reputable retail

designer;

Professional qualifications in Architecture, Interior Design or similar fields;

Sound experience in the design and

Fit out of a retail shop; Satisfactory knowledge of the

Building Code of Australia; Liaise with the Lessor's stakeholders

in relation to altering services to accommodate the Tenant's works;

Accommodate the Tenant's works;

and

Monitor the Tenant's works on site and ensure quality assurance and compliance with the approved plans

THE PROPOSED DESIGNER MUST SUBMIT TO THE LESSOR DOCUMENTATION HIGHLIGHTING THEIR CAPABILITIES, EXPERIENCE (PREVIOUS WORK) AND SKILLS. The Lessor will then assess their suitability in designing the Fit out. The role of the designer is to; Create a design concept;

Produce detailed working drawings;

Provide services information; and

Visit site during construction to

ensure works are in accordance with the approved drawings

If required, the Property Managers can provide you with details of designers previously approved to design retail Fit outs at Railway Stations.

STEP 2 ENGAGING THE LESSOR’S FIT OUT COORDINATOR Within 14 days

of the Lessor approving the Designer, the Tenant must engage the Lessor’s Fit Out Coordinator to manage the Fit out process, complete all necessary engagement documents and settle the Fit Out Coordinator’s fee in full.

The Fit Out Coordinator will not commence

the Fit out process until the above requirements are satisfied.

The Lessor has two (2) Fit Out Coordinators available to manage the Fit out process whose schedule of fees are comparable.

THE FIT OUT COORDINATOR’S ROLE IS TO; Manage the Fit out process in its

entirety and ensure the design concept, working drawings and construction comply with the Fit out guide;

Initially meet the tenant and their designer on site to discuss a design concept and provide a brief of the station category requirements and discuss a design concept in line with the Fit out guide;

Provide the Tenant and their designer a plan of the premises that highlights the lease line, area of the premises and possible structural columns;

Review working drawings in

accordance with the Fit out guide;

Assist the tenant and their designer in ensuring the design and construction of the Fit out complies with local authority requirements and approvals;

Meet the tenant’s Fit out contractor

onsite prior to construction to discuss their obligations and the constraints

within the station environment during the construction process;

Meet weekly with the tenant’s Fit out

contractor to ensure construction progress is in accordance with the approved working drawings and Fit out guide;

Inspect the Fit out on completion of

works, identify any defects and ensure all construction is in line with the approved working drawings;

Issue the tenant with a certificate of

completion to commence trading (subject to any defects being rectified or statutory requirements); and

The Fit Out Coordinator is to

complete the attached forms 1 through 5 at the required intervals and return to the property manager.

If more than the minimum number of meetings is required due to a Tenant not providing timely, correct and sufficient designs or detailed supporting information, an additional hourly fee may be charged at the Fit Out Coordinator’s discretion.

STEP 3 INITIAL SITE MEETING & STATION CATEGORY REQUIREMENTS Within 5 business days

of the Tenant satisfying all requirements for the Fit Out Coordinator’s engagement, the Fit Out Coordinator will meet with the tenant and their designer onsite to;

Confirm the station category and discuss its requirements in accordance with the Fit Out Guide; (Refer Annexure: A)

Discuss a design concept and any requirements relating to local authority approvals;

Provide an overview (if applicable) of the requirements for food and beverage Fit outs in

accordance with the Fit out guide; and

Make preliminary enquiries with local authorities (Council/Sydney Water) to determine if the proposed use is in line with the local authorities’ development controls.

STEP 4 DESIGN CONCEPT Within 14 business days

of the initial site meeting, the Tenant and their Designer must submit to the Lessor and Fit Out Coordinator, a Design Concept for review and approval.

The Design Concept must be in line with the outcomes of the initial site meeting, the Station’s Category requirements and the Fit out guide. The Design Concept must include;

Conceptual coloured sketches;

Photographs;

A perspective sketch and elevations of the shop;

Indicative samples of materials and

finishes;

A coloured shop front elevation or perspective (1:20 Scale in A3 format);

A floor plan, a reflected ceiling plan,

and a section through the shopfront (1: 50 scale in A3 format); and

Graphics and signage Designs

Once the Lessor and Fit Out Coordinator have reviewed the Design Concept they will meet with the Tenant and their Designer to discuss any required amendments or seek clarification on particular design aspects. The objective of the Design Concept is to give the Lessor and Fit Out Coordinator comfort with the overall design direction of the Fit out and approve the Designer in proceeding to a working drawing stage. Below are general standards, requirements and restrictions the Designer must consider when developing the Design Concept.

FIRE CATEGORY Railway Stations are classified as a 9(b) building under the Building Code of Australia. PROHIBITED ELEMENTS Particular elements are not permitted in the design or construction of the Fit out for all Sydney Trains / NSW Trains owned premises and apply to all station categories (Refer Annexure A).

SHOP FRONTS Shop fronts are an integral component of the style and imagery of your Fit out and the local precinct. It is imperative that the shop front is attractive and complements the aesthetics of the station or local area. If the Lessor provides a shop front, it must be repaired, cleaned and maintained by the Tenant unless the Tenant proposes to replace it as part of their design concept. Shop front requirements for all station categories are outlined in Annexure A of this document. DOORS The Tenant is responsible to change all locks on a shop front provided by the Lessor (if required) and all doors and locks must be operable in the event of an emergency and comply with the requirements of all Authorities. SIGNAGE All signage must be professionally designed by a reputable graphic designer. The Fit Out Coordinator will confirm if there is a station specific signage requirement. The Tenant is responsible to ensure all necessary local authority approvals are obtained prior to designing and installing signage. General requirements for shop front signage; Illuminated flat box signs are

permitted (pending Landlord approval);

Horizontal or vertical signage is

permitted; The signage must be limited to the

business logo, crest or trading name; Exposed neon is not permitted;

Flashing,& painted signs are not

permitted;

Advertising place cards, banners, or

signs are not permitted except previously approved by the Lessor;

All wiring, clips, transformers, lamps, holders, labels, plates and attachment devices must be concealed from view;

The installation of vinyl signage is

only permitted on the inside of windows;

Screw caps or pop rivets areas not

permitted; Painted, vinyl clad, polystyrene signs,

and vacuum formed light box signs are not permitted;

Price boards, list of services, supplier

branding and specials are not permitted to be directly; and

Applied to the external face of the

shop front (These items are to be integrated into the Fit out located within the leased area).

Structural Certification is to be provided to certify signage is adequately supported and is independent of bulkheads (if applicable);

INTERIOR The interior of the Fit out is on display to customers at all times and must be of a high standard with relation to design and finish. Interiors and shop fronts must be compatible in design and theme. The interior layout, finishes, fixtures and lighting shall combine to provide an attractive background for merchandise display. WALLS Block work walls shall be rendered or plasterboard sheeted, unless the tenant chooses to leave an exposed brink surface as part of the design. Plasterboard walls must be finished with paint, tiles or wallpaper. Autoclave masonry walls between shops are not permitted. In standard plasterboard lined walls, the Tenant shall install security mesh under the plasterboard and over the studs, equal to F51, to maintain security. Any wall openings to back of house areas must be concealed with a solid door with an automatic closer. Plastic flap doors or beaded curtains are not permitted CEILINGS The use of creative ceiling systems is encouraged, subject to ceiling space and services limitations. Ceilings must comply with Current National Construction Code requirements. Food premises shall have flush sheet plasterboard or villa board ceiling and comply with “Food Premises Code” requirements and local Authorities. All ceilings must be suspended from purlins, joists, beams, decking, and/or other structural elements. Supporting the ceiling or shopfront from bulkheads, ductwork or services pipe work is not permitted.

Access panels must be provided at points nominated by the Lessor for access to gas, water, fire sprinklers and air conditioning services. Access panels must be Trafalgar APC/WW or equal, flush fitting with ceiling plane, provided with concealed hinges and Allen key locks. If alternatives are to be used, a sample must be submitted for approval prior to installation. An open ceiling may be considered based on the merits of the concept design. No loose cabling is permitted and cable trays must to be boxed to the underside. All visible services must be neatly set out. FLOORS Finishes

– All floor finishes must be of high commercial quality, durable, contemporary, easy to clean, maintain and comply with slip resistance requirements.

Cover strips, rubber infill or unfinished edges are not permitted. A stainless steel flat bar insert or junction strip approved by the Lessor must be utilised. Compliance

– Generally all shops have a set-down to the top of the structural floor, relative to the concourse or external surface.

The set-down enables the installation of a level entry into the premises. At the Tenant’s cost, a ramp or step into the premises must be constructed when a step-down is not available Ramps and steps must be constructed within the lease line and in accordance with the Current National Construction Code requirements. When a shop front, as part of the design concept, is set back from the lease line the flooring between the lease line and the shopfront must be finished with the concourse floor finish. The shop floor is to finish on the inside face of the shop entrance doors or closure system. Under no

circumstances is the shop floor finish to be visible when the shop entrance is closed. Where floors for food preparation areas require washing down a waterproof membrane must be installed between the concrete floor slab and the finished floor. The membrane shall return a minimum 300 mm up the wall faces. Penetration

- Penetrating the floor slab such as chases or saw cuts are not permitted unless approved by the Lessor and a Structural Engineer.

All penetrations must be sealed and treated with a waterproof membrane. The membrane must be to the Lessor’s specification and a 10 year written warranty for material and workmanship must be provided. FIXTURES & EQUIPMENT All fixtures and Fitting are to complement the overall design concept and create an open and inviting entry to the shop. Fixtures and Fittings are not permitted outside of the lease line or clutter the entry zone. The service counters must be designed in accordance with the Current National Construction Code (NCC). Trestle tables, fabric covered tables and spinners displaying company logos are not permitted. All spinners, and off the shelf items such as dispenser racks, display cases and fridges must be built into the Fit out joinery and design. TV screens must be integrated into the design concept. Exposed extension cords connected to fixtures and Fittings are not permitted. All power must be fed from the floor and cable managed through joinery or floor boxes.

LIGHTING It is recommended a Lighting Consultant is engaged or seek expert advice when selecting lighting Fittings to ensure compliance with the Current National Construction Code. A mixture of ambient general lighting and task lighting should be utilised in the form of recessed light and designer Fittings is encouraged. External shop fronts should have consideration for timer night solutions in accordance with Local Authority requirements. COLOURS All colours directly visible from the lease line must conform to the Lessor’s standard colour scheme. Both internal and external paint colours must be sympathetic to the remainder of the station precinct or local street scape.

Additional Requirements for Food Tenancies The following additional issues must be addressed when developing a design concept for food premises: The design concept must effectively

showcase the merchandised food as the main focus;

Food design concepts must meet the

following requirements; Materials must durable for food

retailing and meet the relevant food preparation and health Codes;

Use of colour backed glass, high gloss

2 pak polyurethane and similar durable materials is strongly encouraged;

Floor finishes are to be high quality

with the appropriate Current NCC slip rating for food retail and finished to meet the food preparation code;

All walls including kitchen, prep

rooms and storeroom or staff areas must be full height;

Openings to back of house areas are

to be concealed where possible and should not be visible from the public space;

Where the openings cannot be

concealed, back of house is to be designed so that it presents in an appropriate manner;

Stainless steel used in the Fit out

construction must be commercial grade;

Walls in food preparation areas must

be completely tiled; All exhaust hoods are to be

constructed from stainless steel; All exhaust hoods and cooking

facilities must be commercial grade, and clad in stainless steel or equivalent finishes. Exposed galvanised hoods will not be approved;

Displays above bench height are to be frameless glass, square edged profile with recessed glazing channels and be 1350 mm total in height including bench;

All display lighting is to be concealed;

All product and cabinet lighting

should be concealed and well detailed and provide accent lighting over all product and merchandising display;

Counters are to be custom made and

specific to the use and type of product. Off the shelf counters will be permitted if over-clad and built in to appear integral with the design;

A professional graphic designer must

be engaged for all graphics, signage, ticketing and menu boards;

All graphics including menu boards

require Lessor approval; Third party branded (e.g.“Coke” and

“Pepsi”) menu boards are not permitted;

Supplier menu boards may be

approved at the discretion of the Lessor, provided that they complement the design of the tenancy, the food product is dominant and discrete supplier branding is in the background;

Installation of exhaust ventilation in

required for all onsite cooking; Exhaust hoods, grease filters, make-

up air Fittings, balancing dampers, and ductwork must be installed up to the Lessor's ductwork in the ceiling;

The final connection and balancing of

the exhaust and make-up air systems will be carried out by the Lessor's nominated contractor at the Tenant's cost;

ADDITIONAL REQUIREMENTS FOR FOOD TENANCIES CONTINUED…

Access panels must are required in the ceiling every 3 metres of horizontal length of exhaust ductwork, from the exhaust hood in accordance with Australian Standards;

Adequate access to hoods for balancing and future maintenance is required;

The Tenant must extend the Lessor's

make-up air duct to the tenancy ceiling, at a location determined by the Lessor, and install ceiling diffuser;

The Tenant must ensure that any

exhaust system complies with the relevant codes, standards and authorities; and

Packaging and crockery locations

should be designed into the tenancy to avoid situations where this ends up being located on counter tops.

SERVICES The Tenant is responsible for all costs associated with regard to alterations to existing services in order to meet the requirements of the Fit out, including all penetrations and service outages. Sufficient lead times are required when accessing Operational Areas to alter services. ELECTRICAL When required, the Tenant must use the Electrical Service Provider as nominated by Sydney Trains Property Division. At the time of being advised of lease conditions, Sydney Trains Property Division or the Leasing Manager will advise who the Electrical Service Provider is to be. Works such as installing lights, light Fittings, switchgear, power points & general electrical wiring etc, must be carried out by the Tenant’s electrical contractor at the Tenant’s expense and in accordance with the requirements of the service provider, the approved drawings and specifications. In some locations Sydney Trains / NSW Trains is the Supply Authority. In these circumstances all electrical installations connected to the Sydney Trains / NSW Trains supply and any electrical work on these electrical installations must comply with Sydney Trains / NSW Trains Service and Installation Rules for supply of electricity.

Tenants must complete an “Application and Agreement for the supply of electricity” form and lodge it with the Sydney Trains Electrical Engineer to be nominated by Sydney Trains Property Division. If Sydney Trains / NSW Trains are the Supply Authority, the Tenant shall complete the Supply Agreement at Annexure C.

In view of possible supply capacity limitations, there is a need to contact the Electrical Service Provider to check that suitable supply can be made available for both new work and alterations/additions that may increase the electrical loading. Metering of all tenancies will be required and meters will be installed in a central Electrical Distribution Board. If the Retail outlet is unmetered, a meter will be supplied by the Electrical Service Provider and installed at the Tenant’s cost. Depending on the size of the proposed electrical load and the proximity to a suitable capacity supply system, lead times can range from 2-4 weeks for a readily available supply to 18 months if high voltage reticulation and a new supply substation are required. The Tenant is responsible for confirming that adequate supply is available, and allowing for lead-time for that supply. If the retail premises are in an underground station the Tenant will comply with the Category A station requirements.

MECHANICAL All mechanical installations are to comply with CURRENT National Construction Code. The Tenant must, prior to submitting final drawings, advise the Fit Out Coordinator of any requirements for ventilation and/or Air Conditioning. The Fit Out Coordinator will negotiate with Sydney Trains/NSW Trains Officers and reply to the Tenant with a list of conditions. The Tenant must ensure that the design and installation of the complete exhaust system fully complies with the Current National Construction Code and the current relevant Local Health Codes. Mechanical exhaust systems shall comprise, but shall not be limited to: Exhaust fan ductwork, hoods, grease filters where required and balanced dampers. An exhaust fan sized to the total exhaust air requirements of the system with a positive vertical discharge. The exhaust equipment shall be wired to the Tenant’s metered electrical supply. The Tenant must make provision and pay all costs for the installation of the exhaust system, fire protection, wet sprinkler pipe work and/or powder dump systems and heads within or around equipment, hoods and canopies in accordance with SAA Code Australian Standards, Current National Construction Code, Australian Insurance Council requirements and where applicable Fire and Life Safety in the Construction of Underground Railway Facilities Guidelines (SGFLS). The Tenant is to provide a schedule of items that require regular maintenance to maintain the effectiveness of the equipment. The Tenant is to enter into a maintenance contract with a suitable contractor and provide annual certificates to the lessor confirming that the equipment is being regularly maintained.

HYDRAULIC A plan of the proposed drainage (trade and sanitary) is to be submitted with drawings required for Design Review Meeting No 3 for approval. Whether or not the water supply to the premises is currently being charged via a meter, a water meter is to be installed to the source pipe so that water usage to the premises may be monitored. Where the Retail premises is located over or below or adjacent to running tracks, penetrations through the floor, walls or roof may expose high voltage electrical cables, or other services/ structures. NOTE – Be aware that delays may occur in obtaining access to operational areas. Penetrations will not

be permitted without the prior written approval of Sydney Trains.

Where penetrations are proposed, detail of the location of the cores shall be submitted to the FIT OUT COORDINATOR for referral to Sydney Trains to assess whether permission to core the floor/wall etc is possible. For new premises the Lessor will provide a sink and cabinet connected to the cold water outlet. The sink requires a provision for hot water

TELEPHONES/DATA SERVICES It is the Tenant’s responsibility to arrange for telephone and/or data cable installation. The Tenant is advised to make an early application to the suitable Telco for the installation of services in a timely manner. The Fit Out Coordinator will advise if a telephone MDF board is located close to the retail outlet. SECURITY Any security system to be installed must be compliant with Environmental Protection Agency (EPA) guidelines and the position of alarms; lights and equipment are to be subject to review and approval by the Fit Out Coordinator. Any alarm must be connected back to base. Sydney Trains will not be responsible for attending any alarm activation. The Tenant should not rely upon any security system or CCTV system installed by Sydney Trains as a means of protecting their tenancy. The Tenant will not be entitled to access and CCTV recording belonging to Sydney Trains. Loud alarms will not be permitted. Tenant contact numbers are to be provided to the Station Manager for after hour’s contact.

FIRE PROTECTION, DETECTION & PORTABLE FIRE EQUIPMENT The Tenant must provide Fire Protection and/or Detection Systems and Portable Fire Equipment appropriate to the inherent risk within the premises and in accordance with:

• Insurance Council of Australia; • N.S.W. Fire Brigade; and • National Construction Code.

The systems and equipment provided or installed by the Tenant must comply with the appropriate Australian Standards both for installation and maintenance. Prior to the commencement of any lease or licence for the premises, the Tenants’ Designer shall provide documented evidence of compliance with the appropriate level of maintenance as required by Australian Standards, and the Consent Authority. If there is an existing Fire/Smoke Detection and Suppression System installed at the Station, only Sydney Trains approved Contractors shall be permitted to alter, amend or extend the system. These Contractors are available through the Tenant Coordinator. If existing sprinkler heads need to be extended to suit ceilings, this is to be done only

by approved Contractors at the expense of the Tenant.

The Tenant must pay all costs, associated with design and installation and any amendments to the systems.

RUBBISH AND WASTE REMOVAL The Tenant should make allowance within their tenancy to store either a 120lt or 240lt mobile garbage bin. The Tenant is responsible for the transfer of their trading rubbish to the Sydney Trains Commercial waste bins provided – where applicable. If Sydney Trains waste bins are not available, the Tenant must make their own arrangements for rubbish removal. Mobile garbage bins are not permitted to be stored externally (applicable to Underground and Platform areas)

HOARDINGS The Fit Out Coordinator will confirm if a Hoarding is required based on the Station and location of the Fit out.

STEP 5 WORKING DRAWINGS Within 14 days

of the Lessor and Fit out Coordinator approving the Design Concept, the Tenant's designer must submit to the Fit Out Coordinator a set of working drawings for review and approval.

The Working Drawings must be in line with the outcomes of the approved Design Concept, the Station’s Category requirements and the Fit out guide. Further to review, the Fit Out Coordinator will formally notify whether the Working Drawings are: Approved; Conditionally approved subject to

changes, or Not approved.

Final approval will consist of a letter from the Fit Out Coordinator and the Working Drawings stamped “Approved”. The Working Drawings must include;

A 1:50 or larger in A3 format;

One (1) soft copy of and two (2) hard

colour copies;

Location plan (diagrammatic) locating the shop in relation to other facilities;

A Floor plan indicating the lease line, gridlines, all floor penetrations, floor chasing (where acceptable) locations and dimensions, abnormal floor loadings dimensioned off gridlines for clarification, all partitions heights and doors;

Overall sections and interior

elevations; Reflected ceiling plan including ceiling

heights, lighting layout, preferred location of A/C diffusers and sprinklers;

Details and specifications of all electrical equipment intended for use

in the premises together with the total electrical load and heat output;

Furniture and equipment plan – All

fixtures and equipment (both permanent and movable) are to be indicated;

Shop front elevation, section and

details; Construction details, including shop

front and common area connection, shop front and common area ceiling connection, inter-tenancy wall detail and structural support method;

structural support method for glazing

(glazing panel break-up and fin location to be indicated), security grille / roller shutter location (specification and details of the method of Structural Support), shutter housing and guides, materials and finishes noted;

Internal joinery and fixture drawings

and details; Electrical Plan (Inc data outlets) and

details; Signage, branding, graphic details

including menu board designs; Finishes schedule and materials

sample boards; Coloured scaled samples of graphics

to be provided, with all graphic locations to be indicated on the drawings; and

Services drawings - showing

plumbing fixtures, floor wastes, penetrations, gas requirements, refrigeration, food prep areas, exhaust requirements and hood details, hot and cold water points, electrical switchboard location, telephone outlet location and essential services positions nominated.

STEP 6 LOCAL AUTHORITY APPROVALS The Tenant and their Designer must make enquiries with all Local Authorities (Council/ Sydney Water) to establish approvals required prior to the construction of the Fit out and commencement of trade. Following this, the Tenant must submit all documents to Sydney Trains Property Managers, for Owners Consent and

drawings approved by the Fit Out Coordinator including FORM 3 from this guide signed by the Fit Out Coordinator.

It is the Tenant’s responsibility to pay all necessary fees, submit plans and specifications and obtain Development and Construction Approval from the Local Authority.

Other approvals by Statutory Authorities may also be necessary for a particular type of business depending on the condition of the retail outlet, any previous approvals and the locality in which the operation will be carried out. The obtaining of such approvals is the Tenant’s responsibility. Copies of all the above approvals must be forwarded to the Property Manager through the Fit Out Coordinator before

commencing any work at the site.

STEP 7

AWARDING A FIT OUT CONTRACTOR Within 7 days

of the Working Drawings being approved, the Tenant must submit to the Fit Out Coordinator the credentials of the proposed Fit out contractor for approval.

The Fit out Contractor is responsible to manage and construct the Fit out in line with the approved working drawings and all Local Authority Requirements. The Tenant is not permitted to perform any Fit out works that require the expertise of licensed contractors. The Fit out Contractor must; Be a reputable and licensed shop

Fitter, builder or project manager;

Hold professional qualifications and relevant insurances;

Have recent experience in the

construction of a retail or commercial Fit out;

Satisfactory knowledge of the

Building Code of Australia; Have the ability to liaise with the

Lessor's stakeholders in relation to altering services to accommodate the Tenant's works; and

Monitor the works on site and ensure quality assurance and compliance with the approved plans.

Approval of your Fit Out Contractor is subject to the Fit Out Coordinator receiving the following documentation for review; Relevant Licenses;

All relevant Insurance policies; and

Safe Work Method Statements.

STEP 8

PRE CONSTRUCTION SITE MEETING This meeting will occur within 7 days

of the Fit Out Coordinator approving the Fit out Contractor, the Fit Out Coordinator, Station Management, the Tenant and Fit out Contractor will meet to discuss the Fit out Contractor’s obligations during the construction process and familiarise them with the site and surrounding station environment.

The Fit out Coordinator will not facilitate this meeting until they are satisfied they have received all approvals from the Tenant relating to the plans and construction of the Fit Out. These may include but are not limited to: Consent Authority approval; Sydney Trains Property Division

approval; Any necessary Statutory Authorities

approval; Site Safety documents prepared and

approved by Sydney Trains; Insurance documentation provided to

Fit Out Coordinator; Form 4 completed indicating Fit Out

Coordinator and SM approval; A program schedule outlining all

trades (and the dates those trades will be at the premises); and

Payment of any Construction Bond required by the Lessor.

The meeting will discuss; Connection to Services – If no

water supply within the leased premises is available, Station Management will nominate water outlets for temporary use during construction. All power must be sourced from the Distribution Board within the leased premises, the supply is provided directly by the Lessor or by a Third Party Energy supplier. The Fit Out Coordinator will confirm how the power is supplied to the site, if power is supplied by a Third Party supplier it is the Tenant’s responsibility to set up an account prior to construction.

Storage – No area outside of the leased premises will be available to store materials and equipment during construction, any materials left outside of this area will be removed at the Tenant’s expense.

Deliveries – Station Management

will nominate permitted entry points for deliveries during construction (including time periods). All trolleys and wheelbarrows must have pneumatic rubber tyres to avoid damage to the Station concourse. The Tenant will be responsible for any damage caused to the Station floor outside of the leased premises.

Working Hours – Station

Management will nominate construction hours in line with Station Operations. Works creating excessive noise and vibration will only be permitted at night.

Building Waste/Rubbish facilities

– The Station’s rubbish facilities will not be available for disposal of building materials during construction.

Fire System Isolations – The Fit

Out contractor must provide the Fit Out Coordinator with the Fire Isolation Request form for the system to be isolated within the leased area for the duration of construction.

Construction Commencement

Date – The Fit Out Contractor will provide the Fit Out Coordinator with their intended date of commencement (minimum of 5 days notice) and Station Management will provide a brief on the Formal Site Induction process conducted by their office required on the commencement date of construction.

STEP 9 SITE INDUCTION On the date construction is to commence the Fit Out Coordinator and any Sub Contractors must report to the Station Management office for a site induction. Station Management will not commence the induction process unless the Fit out Contractor and any Sub Contractors provide the Station Management with the following documentation; All relevant licenses; Safe Work Method Statement; Works compensation Insurance; and Public Liability Insurance.

INSURANCE DURING CONSTRUCTION The Fit Out Contractor and Tenant are responsible for all insurances including those of any Contractor/Subcontractor for design and construction of the Fit-out to include, but not limited to; Workers Compensation for all

employees, contractors, sub-contractors and any other persons engaged by the Tenant.

Public Risk for injuries to persons and damage to the property of others, to the value as prescribed by law.

Contractors Insurance for all Risk for damages to fixtures, Fittings, plant and equipment installed or being used during installation.

STEP 10 CONSTRUCTION Under no circumstances will the Fit out Contractor and their Sub Contractors be permitted to commence construction until they have been formally inducted to site by Station Management. During construction the Fit Out Contractor must be in possession of a set of approved working drawings at all times and ensure a copy is clearly displayed on site during construction. The Fit out Contractor must comply with all applicable laws relating to safety, environmental and health matters, statutes, regulations, by-laws and all applicable codes of practice, standards and the recommendations or instructions of relevant manufacturers/suppliers. The Fit Out Contractor must ensure all personnel involved in the construction process do not undertake work activities which might be detrimental to the Station environment or create a risk to the health, safety or welfare of themselves or others. IMPORTANT - Any changes made to the approved working drawings without the approval of the Fit Out Coordinator may result in the demolition or removal of the unapproved elements. During construction the Fit Out Coordinator may at any time inspect the Fit out works to monitor progress and compliance.

The Fit Out Contractor and their Sub Contractors must conduct themselves at all times to ensure minimum disruption is caused to Station Operations, other Tenants, Customers and Commuters, and comply with the requirements of Annexure B. It is recommended all contractors and sub-contractor sign Annexure B

, as recognition of their understanding of the document.

Any damage caused by the Fit Out Contractor or Sub Contractors to areas outside the leased premises will result in the Lessor carrying out repairs at the Tenant’s cost. The Lessor will hold a construction bond to pay for such repairs with a refund or charge being made for the difference between the bond and the actual cost. The Lessor and Fit Out Coordinator reserve the right to stop construction of the Fit out if necessary to amend any detail relative to construction, design variation or where the Tenant and/or the Fit Out Contractors fail to comply with the Fit out guide requirements. Station Management may stop works or remove contractors from site, if works are not undertaken in accordance with any specific instructions from Station Management, which places staff, commuters or other Tenants at risk or discomfort.

STEP 11 APPROVAL TO TRADE Once the Tenant and Fit out Contractor consider construction is near completion, the Tenant must, with five (5) days

notice, notify the Fit Out Coordinator to carry out a pre-trade site inspection and issue a Preliminary Defects Inspection Notice (if applicable)

All significant defects will be noted and must be rectified prior to Approval to Trade being granted by the Fit Out Coordinator. The Fit Out Coordinator will only issue an Approval to Trade Certificate once they are satisfied;

All defects are rectified and the Fit out structure is constructed in accordance with the approved plans and designs and Lessor’s Fit out process;

Form 5 is completed confirming actual construction is as per the original approved design;

The Tenant has correctly executed the Lease or Licence and met all requirements of the lease or Licence document.

Notwithstanding the above, exceptions may be considered where the design is deemed to be of exceptional quality.

CATEGORY ‘A’ STATION REQUIREMENTS These Stations include Underground and Major Interchange

stations.

SHOP FRONTS

Shop fronts must have fully glazed frameless shop front glass with the emphasis on the merchandise in display windows and not the shopfront itself is strongly encouraged, when the shop is closed. Roller doors on shop fronts are not permitted. The use of frameless detailing provides a more contemporary look and provides less of an obstruction to the merchandising displayed. • All counters (eg. Take away cafes) and displays fixtures must be set back

900mm from the lease line to ensure customers are not served outside the leased area on Sydney Trains floor area.

• Shop fronts may have collapsible or sliding frameless glass doors when the premises are closed.

• A ‘Walk In” shop (eg Hairdresser or Pharmacy) must have frameless shop fronts and frameless hinged or sliding doors.

SIGNS Only Decals or Translucent Films displaying the business name are permitted to be installed the inside face of glass shop fronts. The signs must not obscure more than 10 per cent of the total shop front area. Neon, rotating, moving or scrolling signs are not permitted. Any signs, displays or stands (‘A’ frames, flags, banners, pendants etc) must not be located outside the lease line. Signage must be three dimensional with individual internally illuminated letters as a minimum requirement

JUNCTIONS BETWEEN TENANCIES A metal mullion must be installed to each side of the premises at the Tenant cost and aligned to the ease line in accordance with the following diagram.

This metal mullion shall extend from the finished floor level to the underside of the bulkhead or ceiling of the concourse with no visible fixings to the external faces. The mullions may be used to support a bulkhead, door mechanisms or shop front. BULKHEADS The Tenant is responsible to construct a bulkhead or wall over the shop front to the underside of the existing or provided ceiling/ structure immediately outside of the lease line.

The underside of the bulkhead constructed by the Tenant must be 2300mm above finished floor level of the areas outside of the retail outlet.

All bulkheads must be constructed in accordance with the following diagram. At the direction of the Fit Out Coordinator, certain Stations may require a particular bulkhead profile. In this instance the bulkhead design must conform to these requirements (eg: shape, finish and materials). SHOP INTERIORS Timber panelled or fabric-covered walls are not permitted in underground stations. These items do not comply with Fire and Life Safety Guidelines. Also Vinyl or rubber flooring are not permitted in underground stations due to SGFLS requirements The construction of all Fit outs falling into Category ‘A’ located in Underground Stations

must comply with Sydney Train’s Standard Guidelines for Fire & Life Safety (SGFLS) and as amended or superseded in addition to “Step Four – Design Concept” of this Guide.

GENERAL REQUIREMENTS – UNDERGROUND STATIONS ONLY

All materials used in the construction of the Fit out must have a composition where they emit low levels of smoke and toxicity, halogen free and flame retardant. The use of PVC, unless an inherent part of a proprietary item (e.g. light Fittings BUT excluding the diffuser, if any) is strictly forbidden anywhere. Oil and acrylic-based paints are not permitted unless applied to a pre-painted proprietary item. Materials proposed should be selected to ensure that toxic fumes are not given off when the material is involved in fire. Any materials that are likely to emit toxic fumes in fire or under any other circumstances shall not be used. Where there is no alternative to the use of material that gives off toxic fumes, its use shall be specifically approved by Sydney Trains. Materials used in temporary works shall comply with the same requirements and levels of fire resistance and early fire hazard as are required for permanent works (eg hoarding and safety screens during construction). Gas (piped, bottled or supplied by any other means) is not permitted.

APPROVALS, CERTIFICATES AND SAMPLES It is the Tenants responsibility to provide to Sydney Trains all test certificates for the testing of materials as nominated in AS1540, part 3. No ordering or manufacture shall commence until the Tenant has obtained written approval from Sydney Trains for the use of any such material. With test certificates, the Tenant is to provide to Sydney Trains a sample of all soft furnishing material and flooring material that is intended to be used. Sample size shall be 300 mm x 300 mm and affixed to board, other material or the like.

DISPENSATION In some circumstances the Fire Safety Approval Panel (FSAP) of Sydney Trains may offer dispensation for the use of certain products which do not conform strictly to the SGFLS. Such products may include proprietary items such as the following: Toilet seats and flaps; Light switches (not multiple gangs over eight units); Power points (not multiple gangs over double units); Taps and faucets; Cooking equipment (not deep fryers or other units with large reservoirs); Fire sprinklers and smoke detectors; and Fire extinguishers.

Tenants are advised that they must make written application to Sydney Trains for dispensation. Such application does not automatically infer that dispensation will be granted. USE AND PROTECTION OF DEEP FRYERS Deep fryers are specifically excluded from use in underground railway facilities under the SGFLS unless they are located within 20.00m of an opening, which leads directly to a roadway. This rule has been relaxed to the extent that the size of fryers is limited to a double chip basket size and protection must be afforded to the fryer and exhaust hood in the form of wet chemical protection of the hood, fryer, hot plates, griddle, or the like coupled with “Fire-Check” or equivalent filters in the hood construction. AIR SUPPLY SYSTEMS All retail areas for lease should be capable of connection to a filtered outside air supply as prescribed in the Current National Construction Code. A condenser or a chilled water system (operational for 12 hours per day) may be provided to each tenancy in the form of capped isolation valves. Each tenant shall extend the system to water cooled air handling plant as required. Balancing valves from Sydney Trains approved manufacturers shall be used in the tenant’s system to automatically balance the water flows. Electrical heating of each system is the responsibility of each tenant. Generally the above services are located immediately within the boundary of the lease space. Note that in certain areas, access will be required by maintenance staff to access panels located in the ductwork. The condenser water system is not designed for refrigeration use.

KITCHEN/DISHWASHER EXHAUSTS SYSTEMS At various stations where there is a Central Mechanical Plant Room/s, a system that permits the separate air supply and exhaust may be installed as a separate and stand-alone system for use by Tenants. Should a Tenant choose to use an available system, then the Tenants Designer shall confer with the Fit out Coordinator as to the capacity (if any) that is available for the particular installation. Should the Tenants calculated capacity exceed that available then Sydney Trains is under no obligation, monetary or otherwise, to extend the existing central system to suit an individual Tenant’s needs nor shall Sydney Trains install or contribute towards separate Supply/Exhaust Systems for individual Tenants. Where no central system is installed, a tenant may choose to install their own supply/exhaust system subject to the prior approval of Sydney Trains. All supply/exhaust systems shall comply in every respect with the relevant codes and Australian Standards that apply at the time to the works. ELECTRICAL Should the Tenant require additional power then it is the Tenant's responsibility to provide additional power at the Tenant's own cost. All and any additional power shall be fed from the Retail Switchboard to the Tenants DB in halogen free fire rated cabling, at the Tenant’s cost. All electrical wiring within any retail space shall be in halogen free fire rated cabling. All data and communications cabling shall be in halogen free fire rated cabling. Note: Olex does not supply a purple earth wire in accordance with Telstra requirements.

Tenants to use green with yellow trace and label cable “Earth”.

No PVC conduits are permitted – use HFT or steel. DIFFUSERS Light Fittings shall have metal, glass or polycarbonate diffusers. Acrylic diffusers are not permitted. Light Fittings are to be hard wired

CATEGORY ‘B’, ‘C’ ‘D’ AND ‘E’ STATION REQUIREMENTS SHOP FRONTS The shop front:

May be constructed in accordance with shop front requirements for Category

‘A’ Stations.

Must have a minimum of 70% of the shop front transparent to the public space when the shop is trading.

Must have all counters setback 900 mm from the lease line.

May fully or partially open to the public space when the shop is trading. Where the premise fall May contain aluminium framed sliding or hinged doors.

i. Hinged doors: Must open inwards into the shop space.

ii. Sliding doors: When open, must be unobtrusive and appear as part of the shop front.

May be constructed from frameless glass or framed aluminium sections and glass. All aluminium sections shall be either anodised or powder coated. Colours must be approved by the Fit Out Coordinator.

Must have unobtrusive fixings that blend with and into the final article.

Must not contain hand painted surfaces or materials. Must not have unfinished surface such as block work, common brickwork,

cement render, off form concrete.

May incorporate roller shutters or grilles constructed from durable and high quality materials as follows.

ROLLER DOOR AND GRILLES Manufactured from steel slats and contain at least 50% of the exposed surface area with perforations or plastic infill to the slats. All steel slatted roller shutters, guides; removable mullions must be manufactured and assembled from pre-finished materials.

All aluminium slatted roller shutters, guides, removable mullions must be manufactured and assembled from pre-finished (either anodised or powder-coated) materials.

Roller grilles manufactured from pre-finished steel or aluminium materials including guides, removable mullions and the like. Solid steel slat roller shutters (painted or unpainted) are NOT permitted. Advertising or artwork is NOT permitted on the roller shutters or grilles.

Operating mechanisms for shutters or grilles must be within the shop lease area and preferably concealed from view during trading hours. All drums, support brackets and fixings must be located within the shop lease area. Any mullions between the shutters or grilles must be removed during trading hours and stored out of sight. When in the open position all shutters and grilles must be concealed from view to form an integral part of the shop front. The fixings of any shutter or grille guides and/or mullions must be concealed from view (public and/or shop customer) by building into the walls or fabric of the shop fixing brackets including all associated bolts, screws and the like. Locking of shutters and grilles must be by an integrated and concealed locking system or by padlocks securing the normal bolt action lock Fitted externally to most shutters and grilles. The use of chain and padlock is not permitted. SIGNS Adhesive signs installed to the inside of the glass shop front depicting the shop name and corporate image are permitted. Corporate illuminated signs installed to the inside of the shop front are permitted in corporate colours and must be static. Neon, rotating, moving or scrolling signs are not permitted. Bulkhead signs are permitted and may slightly project beyond the lease line in accordance with the Fit Out Coordinator’s direction. Any signs, displays or stands (‘A’ frames, flags, banners, pendants etc) must not be located outside the lease line. JUNCTIONS BETWEEN TENANCIES A metal mullion must be installed to each side of the premises at the Tenant cost and aligned to the ease line in accordance with the following diagram. Where single tenancies occur a finishing strip must be constructed to complete, and where necessary to properly trim the shop front up to the adjacent wall finishes. Gaps of raw wall finishes cannot be visible. Finishing strips shall be compatible with the shop front or where directed by the Fit Out Coordinator shall conform to the adjacent wall finish.

This metal mullion shall extend from the finished floor level to the underside of the bulkhead or ceiling with no visible fixings to the external faces. The mullions may be used to support a bulkhead, door mechanisms or shop front.

BULKHEADS Where no bulkhead exists or where it may be necessary, a bulkhead or wall over the top of the shop front must be constructed to the underside of any existing or provided ceiling structure immediately above the lease line. The underside of the bulkhead must be constructed and compatible with the ceiling height of the tenancy (minimum 2100 mm above floor) or in harmony with other existing tenancies in accordance with any reconstruction program or details pertinent at the time. Where the premises falls under Category ‘D’ & ‘E’ and is free standing or isolated from other buildings a bulkhead may not be mandatory. Such exclusion of a bulkhead shall be at the discretion of the Fit Out Coordinator and the Tenant shall be instructed in writing of any exclusion. All bulkheads must be vertical in alignment and must be constructed from preferably metal grounds with gap jointed sheet materials that are compatible with those that exist. Where new bulkheads are required, they must be constructed from pre-finished sheet compressed fibrous cement neatly gap detailed and must be flush with the tenancy division mullions to their external face. All bulkhead sheeting materials shall have pre-finished edges. INTERIORS Refer to Step Four of the Fit out guide.

CATEGORY ‘HERITAGE’ REQUIREMENTS These Design Controls are related to the significance of each station rather than universal guidelines.

At stations which have “State Significance”, no work must be undertaken without approval from the Heritage Council of NSW. This approval shall be applied for by submission of a Section 60 application to the Heritage Office, prior to application to the Local Consent Authority.

There can be no structural change or alteration to any

heritage station, without the prior written approval of Sydney Trains / NSW Train’s Heritage Adviser, through the tenant coordinator.

SHOP FRONTS

All shop fronts are to be designed sympathetically to the station in which the retail outlet fits. Original features are to be retained wherever possible.

In Category A stations only glass shop fronts will be permitted. Framing to the glass will be in appropriate timber or steel mouldings to suit the age and style of the building. In underground stations, where use of timber is prohibited, alterations shall be submitted for approval to Sydney Trains / NSW Train’s Heritage Adviser, through the Tenant Coordinator.

SIGNS

Must be designed to be sympathetic to the stylistic features of the station. Doors are to be framed, hinged, glazed or collapsible glass shop fronts. Framing is permitted if it is designed to be sympathetic to the station style.

INTERIORS

As interiors are visible through the shop front, the designs shall be conservative and sympathetic. Colours used internally shall be sympathetic to colours used externally.

If original features exist internally they shall be retained and incorporated into the new design.

No work at a station of State significance to be done without the prior approval of Heritage Council of NSW. No structural changes to any heritage station are to be done without the prior written approval of Sydney Trains / NSW Train’s Heritage Adviser. No exposed conduit: sympathetic flooring. COLOURS All colours directly visible from the lease line must conform to the Lessor’s standard colour scheme as per Heritage Guidelines. All Heritage colour requirements can be obtained from the Heritage Council of NSW.

CATEGORY ‘PLATFORM’ REQUIREMENTS This section applies to retail areas on Platforms or within the Paid Area, including those that are enclosed retail outlets, small kiosks or mobile, temporary counters or stands. As these outlets are trading in areas where trains would be operating, further controls will be necessary. Specific Controls for these locations will include: No structure (temporary, fixed or moving) is allowed to be within 2.6 metres

of the platform edge.

All trades persons and staff must be in possession of a RISI Card, or they will be banned from the site.

Deliveries of all materials and the removal of spoil and refuse shall be

undertaken only at times approved by the Station Manager and under the control of station staff.

No metal or metal reinforced ladders are permitted on site.

ANNEXURE B SAFETY REQUIREMENTS FOR ALL CONTRACTORS AND SUB-CONTRACTORS ON SYDNEY TRAINS / NSW TRAINS SITES The following Clauses and Conditions must be included in your Specification/Contract to build the shop Fit-out. These Clauses and Conditions are critical to maintain safety at stations for the Tenant, Sydney Trains / NSW Trains Staff and the Public. The Tenant shall sign to confirm that they will ensure that the following will be undertaken.

SITE SAFETY

These Safety Instructions describe the requirements for construction works on Railway sites, and are to be followed by all personnel involved in the Fit out.

A. RAILWAY LINES are DANGEROUS. However, there are rules and regulations that, if observed, make them SAFE.

B. RAILWAY SITE SUPERVISORS/SYDNEY TRAINS / NSW TRAINS FLAGMEN are required on site whenever people or equipment are working adjacent to, or may come into the area between the yellow safety line and the edge of the platform coping, or if the work procedure is of a hazardous nature to the public. They have been trained to ensure that no rules or regulations are breached and that work is done safely and efficiently. They are empowered, if they deem it necessary, to order the stopping of work and remove a person or persons off railway property.

C. STATION MANAGERS have similar powers and in the absence of a Site Supervisor will use them.

D. ALCOHOL / DRUGS must not be consumed on the work site and any employee affected by alcohol or drugs whilst on duty and cannot fulfil his specified duties shall be sent home and dealt with accordingly.

E. VESTS or, as the law describes them, High Visibility Clothing, must be worn at all times and must be orange in colour. Failure to wear one can lead to a fine for both the employee and the employer.

F. CLOTHING RESTRICTIONS. No person working on or near railway lines may wear red, green or yellow clothing. These colours may

H. WORK TIME RESTRICTIONS shall be imposed on operations in certain areas. This need not prevent work in other areas, but must be strictly adhered to.

I. METAL LADDERS AND SCAFFOLDING (ALUMINIUM ETC) MUST NOT BE USED.

J. METAL SURVEY STAFFS MUST NOT BE USED.

K. TRAIN OVERHEAD POWER LINES carry a current of 1500 volts DC. No objects are to be allowed near them at any time. No person is allowed within 3 metres of them.

L. CROSSING RAIL LINES is strictly prohibited, except by public pedestrian routes, or unless under the direct supervision of an accredited railway employee/Sydney Trains / NSW Trains Flagman. To cross lines with a mechanically powered machine (trucks etc) is strictly prohibited unless under the supervision of accredited railway employees.

M. WORKING NEAR LINES may require the presence of a railway Site Supervisor. When the work program is arranged, a railway Site Supervisor walks the job with the foreman to determine what protection is required.

N. DRAINS open and piped must not be blocked or fouled. If drains are fouled and need to be cleared the contractor will bear the direct and indirect costs. BALLAST (the crushed stone the sleepers are laid on) has to be clean to work properly. Every care must be taken to prevent other material from falling on it and making the ballast unusable. Any costs incurred in cleaning the ballast will be borne by the contractor.

O. PASSENGER SAFETY. We have an obligation to ensure the safety of the public and their property at all times. When considering this, it must be remembered that passengers include the aged and infirm. To ensure passenger safety, the requirements of items P to W must be complied with.

P. OPEN HOLES AND TRENCHES must be protected with suitable barriers unless they prevent people boarding or alighting from trains, in which case they must be suitably filled in or covered to the satisfaction of Sydney Trains / NSW Trains.

Q. GATES must be kept locked when not actually in use.

R. WELDING is subject to prior written Sydney Trains / NSW Trains approval. If approved by Sydney Trains / NSW Trains the welding operation must be shielded to protect passengers and other employees.

S. FALLING OBJECTS including cutting slag and grinder sparks must not hit passengers, track overhead wiring or trains. They must either be contained or, in the case of public areas, that area must be kept vacant.

T. THE PLATFORM SURFACE must be kept even and ‘trip hazards’ must be removed, barricaded or battered with road base and consolidated.

U. PLATFORM LIGHTING must be fully functional or equivalent temporary lighting must be set up by sunset every night.

V. MATERIAL STOCKS/ STOCKPILES must be protected by barriers at all times to comply with Work Cover, EPA and other statutory requirements.

W. CLEANLINESS. The site must be kept as clean as possible. At the end of each workday it must be cleaned fully and made safe.

GENERAL SITE SAFETY

1. This site shall comply with the requirements of the Occupational Health and Safety Act, Construction Safety Act and Work Cover Regulations.

2. It is the responsibility of each person on site to look out for the health and safety of all on site, which includes that person, his workmates and others.

3. Every employee shall co-operate with site management to ensure compliance with the requirements of the Occupational Health and Safety Act, Construction Safety Act and Work Cover regulations.

4. Safe working procedures are to be submitted in writing by the main contractor for work in the vicinity of the edge of the platform, track, public or overhead wires or as may be requested from time to time by the Superintendent and / or the main Contractor.

Procedures are to:

a) Analyse the risks to both employees and the public.

b) Plan to eliminate the risks.

c) Ensure the safety and wellbeing of both employees and the public.

5. Mobile scaffolds of any size are to be supplied complete with kickboards and ladders. Decks are to extend at one level for the full width of scaffold.

Non-compliant scaffolds will not be allowed on site.

6. Procedures for working from scaffolds in the vicinity of the overhead wires, i.e. within 6.0 metres of same, are to be discussed and agreed with the contractor’s site representative and Sydney Trains / NSW Trains site supervisor prior to implementation.

7. Safety helmets shall be worn as instructed by the Station Manager or Tenant Fit Out Coordinator by persons entering or working on the construction site.

8. Steel capped and/or other suitable footwear must be worn whilst working on site.

9. Alcohol and drug consumption is prohibited on site.

10. Glass containers are prohibited on site.

11. It is your employer’s responsibility to provide safety equipment to its employees. Safety equipment is to be worn to protect eyes, hands, skin, etc, if required.

12. All accidents on site shall be reported immediately to the Builder’s site representative in charge.

13. All injuries or persons requiring first aid treatment are to report to the person in charge of the First Aid facilities. All details of the incident and treatment are to be recorded in the Site Accident Register.

14. An appropriate fire extinguisher must be on hand for each welding set or Oxy acetylene set on site.

15. Work areas must be kept clean and tidy, with rubbish and other hazards cleaned up promptly.

16. All electrical installations and associated plant and gear shall comply with the requirements of the Work Cover Code of Practice “ELECTRICAL REQUIREMENT FOR CONSTRUCTION WORK”.

a) All leads and power tools are to be tested for faults and certified faultless prior to use on site and at monthly intervals after first certification.

b) No lead will be longer than 32 metres.

c) All leads are to be kept off the ground, except within 4 metres of the work area.

d) All plugs on leads and power tools shall be either clear re-wireable or moulded type.

e) No piggy-backs or multi-point power boards allowed.

f) All power shall be obtained from the same floor as work area.

17. Adequate lighting must be provided by the main contractor and/ or the sub-contractor and must not produce unsafe glare.

18. Dropping or throwing down of materials or gear from a height is prohibited except where suitable means has been installed to catch, control and hold such items.

19. Formwork shall be stripped in a safe manner. Drop stripping is prohibited.

20. Where there is a danger of a person falling more than 1.5 metres, including openings in floors, stairs, lift shafts, excavations, trenches and edges of suspended floor slabs, preventative measures shall be installed in the form of handrails, fencing, safety harnesses to prevent persons falling.

21. All such handrails and fencing shall not be removed unless approved by Site Management and will be replaced immediately on completion of work in the area.

22. Ladders shall be used in accordance with current regulations and shall:

a) Be set on a firm, even base and be fixed so that they cannot be moved from the top or bottom points of rest,

b) Extend at least one (1) metre above landings,

c) Not be painted,

d) Not support scaffold planks.

23. Explosive powered tools shall be operated by a qualified and licensed person only and:

a) Only low velocity piston type tools shall be used on site,

b) Charges are to be kept in a locked metal box,

c) A warning sign must be displayed at the place where the tool is being used.

24. All vehicles on site shall be operated at a safe speed and in a safe manner.

25. Eye protection shall be provided by employers for persons carrying out welding or similar processes and screens provided to protect the eyes of others.

26. All work places shall be adequately ventilated so as to render harmless all fumes and dust that may be injurious to health.

27. Unsafe acts or conditions are required to be reported to the Site Manager without delay.

28. Persons who breach these rules shall be removed from site at the discretion of the site management without prior warning.

ROLES AND DEFINITIONS There are a number of roles and tasks listed in this Guide. They include: Area or Sector Manager The Manager above the local Station representative, responsible for a number of Stations. Fit Out Coordinator (FOC) The person who will check or arrange to check drawings and designs submitted for Sydney Trains Property Division’s approval. Nominated by Sydney Trains Property Division but paid by the Tenant. Sydney Trains / NSW Train’s Manager may undertake this function. Lease The legal document, which sets out the conditions

between Lessor and Lessee on the leasing of the shop. Sydney Trains Property Division’s Solicitor prepares this lease.

Lessor or Landlord The owner of the building in which the retail space for lease is located – Rail Corporation New South Wales. (Sydney Trains as Agent for RailCorp)

Lessee or Tenant The person or company who signs the lease.

Property Manager Station Representative

The person or company engaged by Sydney Trains Property Division to act on their behalf in the leasing of RailCorp property. The manager on duty for the station (including Retail) and employed by Sydney Trains / NSW Trains with responsibility of the day to day running of the station and site safety.

Tenant’s Designer A skilled shop designer employed by the Tenant to design the shop.

This is an approval process only. Project Engineers are responsible for arranging

connection of the temporary supply on receipt of approval from the Electrical

Distribution Unit Installation Inspector.

The Project Engineer is responsible for ensuring that the temporary supply is

disconnected and all wiring removed when no longer required.

Applications will not be accepted where the connection period exceeds the current

financial year. Where the period of supply is to extend for more than one year a new

application is required prior to June of that year.

Any temporary supplies found connected without approval will be disconnected until

an application is submitted and approved.
