General Contract Provisions

1 Business Travel Insurance This insurance contract also applies to what is stated in the general contract provisions.

1.1 Validity and scope of the insurance

1.1.1 Who is covered by the insurance applies

The policyholder, as the employer, has signed this insurance contract for all his employees, as the insured, unless otherwise specified in the insurance policy. The policy holder is also insured in 1.7.5 Luggage Protection in respect of the property that he owns rents or borrows and takes on the business trip as an employee. If indicated in the insurance policy, the insurance also includes a co-traveller who is not employed. The policyholder has the exclusive right to enter into an agreement with Trygg-Hansa to amend or terminate the insurance and to receive the cancellation of the insurance. Trygg-Hansa has the right to negotiate only with the insured regarding insurance claims and to provide insurance compensation. Note An employed person also refers to the CEO, contracted intern, board member, voluntary workers and officials when they are working on behalf of the policyholder. An insured person must be a permanent resident in the Nordic countries (home country) and insured in a general insurance institution in the home country. Exclusions The insurance does not cover

A person who is habitually resident in a country outside the Nordic region

Travel to and from a residence/temporary residence and the regular workplace in the home country

A person who mainly has his or her place of work on ships, trains or aircraft, unless otherwise agreed

Sspecific professions where the insured has no fixed place of work and regularly performs his/her daily work in different places, such as construction and civil engineering workers, repairers, fitters, drivers and staff from Employment agencies. The insurance does not apply during the trips included in the normal tasks. However, this exception may be lifted by extending the insurance policy to those professions.

1.2 When the insurance applies The insurance applies – unless otherwise agreed – for Business travel during the insurance period if the insurance has been in force from when the insured leaves the dwelling or the ordinary place of work and terminates upon return to one of these sites, however at most for a continuous period of 210 days, unless otherwise stated in the insurance policy. If the business trip is cancelled for a return trip to Sweden, the return trip is calculated as the same trip and not as a new journey.

Private Trips In connection with business travel abroad, the insurance also applies to private travel. This applies provided that the journey is made in direct connection with and after the end of the business trip, before the return to the place of business or residence occurs. The journey or stay is valid for a maximum of 7 days after the business trip or service has ended. Note Business travel refers to work travel/assignment carried out by the policyholder. The destination of the journey shall be outside the insured's ordinary place of Business. The place of business refers here to an area whose external border is situated at a distance of 50 km (the nearest route) from the place of work of the insured or from his residence. Travel between the insured's place of work and his/her home is not to be regarded as a business trip.

However, the insurance can be extended to the so-called närresor, if this is specifically stated in the insurance policy. Note "Närresor" means the journey within the 50 km limit specified above. This journey/assignment shall also be carried out on behalf of the policyholder.

1.3 Where the insurance applies The insurance is valid throughout the world except for those countries/areas to which the Ministry of Foreign Affairs (UD) wholly or partly advises against travelling.

Exclusions If a work trip to a country/area mission is conducted, despite the travel advice issued of the Ministry of Foreign Affairs (UD), the insurance shall not apply in the current country/area. Note The above refers to the conditions that apply at the commencement of the business trip. For information about the countries/areas to which the Foreign Ministry advises against travelling, see www.regeringen.se This exclusion can be waived in cases where the damage is wholly unrelated to the Foreign Ministry's advice. Note What is said about Sweden in these conditions also applies to each of the other countries in the Nordic region, if the insured person resides there.

General Contract Provisions

1. 7.2 Disability and death compensation in case of accidental injury If the insured suffers from Accidental injury and this leads to permanent disability or death, compensation will be granted for

medical or economic disability

death

Insurance Amount The insurance amounts – lump sums – for disability and death are specified in the insurance policy.

Limitation Disability compensation can never be provided for both medical and economic disability. If the health of the insured has deteriorated due to a bodily defect (disease, morbid change, lyte and marking) that either already existed when the accidental injury took place or which came about later unrelated to the accidental injury, no compensation is provided for the disability caused by the aggravation. Note The insured must have sought medical advice from the doctor who issued a medical certificate during the business trip, or otherwise be able to prove that the accidental injury occurred during the journey.

The concept of disability Disability means that the accident injury has entailed, for the future, permanent reductions in the body function. Or that he insured person future work capacity has been reduced by at least 50% as a result of the injury. The assessment of the degree of disability distinguishes between medical and economic disability.

1.7.2.1 Right to disability allowance The right to disability compensation occurs if accidental injury has entailed a lasting loss of the insured's body function and the condition is static and not life threatening. Static means that the condition is not changing for the better or worse. The condition for entitlement to a disability allowance is, first, that the accidental injury occurred during the period when the insurance was in force and, second, that medical disability occurred within 3 years from the insurance was last in effect. In case of medical disability, the right to a disability allowance is only valid earliest 12 months after the accidental injury occurred. However, the disability assessment may be postponed as long as this is necessary, according to medical experience or in the light of the existing rehabilitation opportunities. If the insurance is no longer in force when the definitive degree of disability is to be assessed, only direct consequences of the accident will be taken into account that occurred when the insurance was in force. If when the disability arise, the definitive degree of medical disability is not yet assessed, the insured if possible will get an advance. This should respond to the medical disability that can be ensured. In case of final disability assessment, amounts are paid equal to the percentage increase in the replacement rate. Index at payment is applied. Compensation is paid to the insured. If the right to a disability allowance occurs, the disability allowance is not paid. If disability allowance is legitimate, the amount corresponding to the definitive medical disability covered by the death shall be paid.

Right to review If the accidental injury entails a significant deterioration of the body function of the insured person after Trygg-Hansa has taken a final position on the insured person's right to compensation in the event of

Page 10: Terms and conditions - Business travel insurance · for travel delays, after 4 hours the insurance amount is SEK 3,000 for travel commencement protection, the insurance amount is

General Contract Provisions accidental injury, the insured has the right to have the degree of disability reconsidered due to the new circumstances. The reconsideration shall be admissible if the insured person, no later than 10 years from when the accidental injury occurred, submits in writing his request for reconsideration to Trygg-Hansa, while at the same time, providing information on the circumstances that may entail the right to reconsideration.

Disability Aids In addition to the compensation for disability determined after the disability rate, compensation is provided for aids and rehabilitation aids which are deemed by doctors to be necessary to alleviate a disability condition and which are not, by law or by specific statutes, to be compensated from other sources, such as municipalities, county councils or other insurance.

Maximum compensation A total of SEK 50,000 will be paid if Trygg-Hansa has approved the cost in advance. Compensation is granted for a maximum of 5 years from when the accident injury occurred. Provided that the measures are taken in the time when the insurance is in force.

Compensation for disfiguring scars in case of accidental injury The insurance compensates scars or other disfiguration as a result of accidental injury that required medical treatment. Compensation can only be provided if the injury is so serious that medical treatment is required. It is not enough for if a doctor only looked at the damage without providing treatment. For example, treatment refers to wounds that need to be sewn or taped. Compensation is provided according to one of Trygg-Hansa set tables regarding the payment. The right to compensation will only occur after the treatment is completed and after the scars or disfiguration has been deemed residual for the future, but not earlier than one year from the day the damage occoured.

Exclusions The insurance does not cover:

damage not requiring medical treatment

scars or other disfiguration caused by accidental injury that occurred before the commencement of the insurance.

1.7.2.2 Right to death grants The right to a death grant exists if the insured person, as a result of the accidental injury, dies within 3 years.

Insurer For death insurance, Holmia Livförsäkring AB (516401-6510) Box 50, 106 26 Stockholm is the insurer.

Amount of compensation The death amount is stated in the insurance policy.

Beneficiaries The compensation is paid to the estate of the insured, unless a special beneficiary's mandate has been notified to Trygg-Hansa. A special Beneficiary's form can be ordered from Trygg-Hansa.

1.7.2.3 Exclusions The following exclusion (1.7.3.1 – 1.7.3.4) applies jointly to 1.7.1.1 (medical costs), 1.7.1.2 (travel expenses) and 1.7.2 (Accident disability and death benefits).

1.7.2.4 State of health/care needs Compensation is not paid

for medical costs, travel costs or other expenses if the need for care already existed when the insured started the business trip. However, compensation may be provided if the health status of the insured acutely worsened during the business trip, and this was not predictable. Compensation is then provided for the additional cost that the aggravation entails

for healthcare travel or other costs associated with sickness or accidents that were predictable before departure from Sweden

for costs that can be reimbursed by the general insurance fund

additional costs due to pathological or normal old age changes

for health travel or other expenses caused by childbirth or pregnancy at a later stage than the 28th week.

for cost of home travel or other transport caused by the insured's fear of infection

1. 7.3 Security regulations The insurance applies with the following safety regulation and penalty (reduced compensation) if the requirements are not followed.

1.7.3.1 Penalty when the safety regulation/prudential requirements have not been followed

In order not to reduce the compensation as described above, the following safety regulation/prudential requirements must be met:

1.7.4 Luggage Protection (multi risk)

1.7.4.1 What the insurance applies to The insurance applies to damage to luggage during a business trip caused by a sudden and unforeseen event. Damage also means loss. Note The suddenness means that the event that triggered the damage had a relatively rapid course of action. The unforeseen occurrence of the event means that it has occurred unexpectedly and that it has not normally been anticipated and thereby prevented. 1.9 Damage compensation rules Compensation amount in case of disability and the amount of damage in case of damage to property is determined according to the following rules (1.9.1 resp. 1.9.2).

1.9.1 Amount of disability allowance

The disability allowance is an equivalent to the degree of disability corresponding to the insurance amount of the disability at the age of the insured person at the accident. The disability allowance is determined on the basis of the economic disability, if available, otherwise on the basis of the medical disability. However, the determination shall take place on the basis of the medical disability if this would lead to a higher disability benefit. For insured persons who have reached the age of 55, only medical disability compensation is paid. If function can be improved with a prosthesis, the degree of disability is determined by the prosthesis function. The determination is made irrespective of the degree to which the insured person's ability to work is impaired.

Compensation for financial disability When accidental injury entails a permanent reduction in the insured's working capacity by at least 50 per cent, according to the insurer's assessment, the disability allowance shall be paid. A precondition, however, is that the accidental injury resulted in such loss of work ability within five years from the day of the damage . For insured persons aged 18 or over, the financial disability shall be incurred within 10 years from the injury of the accident.

Page 19: Terms and conditions - Business travel insurance · for travel delays, after 4 hours the insurance amount is SEK 3,000 for travel commencement protection, the insurance amount is

General Contract Provisions The accidental injury must have occurred during the period when the insurance is in force and before the 55-year anniversary, and brought about financial disability before the 60th anniversary. The basis for determining the economic disability rate is only current in the case of accidental injury induced symptoms and disabilities that can be objectively determined by Trygg-Hansa. Account shall only be taken of the reduction of such ability to work that was used immediately before the accident injury and which would likely have been exploited if ability to work had not been lost. The determination is made with respect to the insured's ability to perform his habitual work or other work corresponding to his abilities and skills, despite accidental injury, and can reasonably be claimed by him in light of age, previous training and activities, retraining or similar measures and residence conditions. Work ability is considered to be permanent impairment when all opportunities for work in another profession are examined. All rehabilitation opportunities should also be investigated. The determination of the degree of disability is determined by the loss of work ability that The accidental injury caused. In addition, the accidental injury must, before the onset of the economic disability and within 3 years from the date of the damage, have entailed medical disability.

Medical disability compensation When accidental injury entailed a permanent reduction of the insured's body function and the condition is stationary, the disability compensation shall be paid. A prerequisite for the right to compensation is that the accidental injury within 3 years resulted in a measurable disability. However, final assessment shall be made only when the degree of disability is definitively fixed and no later than 3 years from the day of the injury. The degree of medical disability is determined by each instalment of industry common tables. If accidental injury caused damage to several parts of the body, so that the total degree of disability exceeds 100 per cent, the compensation is maximised 100% of the insurance amount.

OTHER VALUATION RULES The valuation of an injury is made on the basis of the price situation at the time when the insured person can determine his claim for compensation, although at the earliest two months from the day of the injury. Valuable documents are valued at the loss you make at injury. If damaged property is repaired, the damage is valued at the reasonable repair cost. The repair cost may never exceed the amount of compensation the insured party may receive according to previously stated rules.

1.10 Compensation rules Damage is assessed according to 1.9 (Claim assessment rules) and is compensated in accordance with the following rules. It is the direct financial loss that is compensated. Among other things, the following are not regarded as direct financial losses:

sentimental loss

loss of capacity for work in connection with property damage

travel to and from the site where damage occurred

inconveniences or difficulties that may arise

the value of your own work that you have put into photographs, films, sound recordings, computer programs, models and similar.

reconstruction of digitally-stored information

losses that may arise as a result of an account or subscription being used without authorisation

tort/non-material damage

costs for verifying, supporting and producing claims

modernity

usability. How we compensate the insured:

Page 22: Terms and conditions - Business travel insurance · for travel delays, after 4 hours the insurance amount is SEK 3,000 for travel commencement protection, the insurance amount is

General Contract Provisions Depending on the circumstances, compensation may take the form of repair in order to restore function, cash compensation or replacement – i.e. purchase of a similar or the most closely equivalent item. In the case of replacement or repair, Trygg-Hansa is entitled to determine where purchase or repair shall be made. Higher compensation than the cost of repair or replacement at the repair or replacement site indicated by Trygg-Hansa cannot be paid out. Credit cards, debit cards, etc. Checks, bank books, credit cards and similar are only compensated up to the cost that may be charged in order to close the account in question. If an authorised person uses the account and this results in a financial loss to the insured, then this loss/cost cannot be compensated through the insurance.

1.10.1 Intentionally causing an insured loss

Trygg-Hansa is not liable towards the insured for insured losses that the insured has caused deliberately or through gross negligence to any extent. Note: The insured party is equated to

another person who has acted with their consent

a person who, concerning the insured property, has a close financial association with the insured

a person who, in the place of the insured or together with them, has had supervision over insured property; however those who were in such a state of mind as that described in chapter 30, section 6 of the Swedish Penal Code or those who were under 12 years-of-age are only equated with the insured if they have acted with their consent.

1.10.2 Non-compliance with regulations

If the reasonable precautions clause is not met, then compensation may be reduced, unless the reasonable precaution has been minor or of minor significance for the insured loss. In the case of serious negligence, the deduction may be severe or zero compensation may be paid out.

1.10.3 Other compensation rules

Upon payment of compensation for damages, value added tax is offset for the person who is accountable for value added tax. Trygg-Hansa has the right to have damaged property repaired or to provide another equivalent item instead of paying out cash compensation. Trygg-Hansa is not obliged to accept damaged property, but is entitled to accept larger or smaller parts thereof following assessment. If the property for which compensation is paid out is found or restored, it will become property of Trygg-Hansa and must be put at Trygg-Hansa’s disposal as soon as possible. The insured may keep the property provided, however, that they repay the compensation received without delay.

1.10.4 Date of compensation payment and interest rate provisions Compensation shall be paid out no later than one month after the time at which the insured has fulfilled their obligations under 7.1.2.12 (Claims handling provisions). If a police investigation of significance to the insured’s right to compensation is commenced, then Trygg-Hansa is entitled to withhold payment of compensation until the investigation has been concluded. Compensation to which the insured is only entitled once the insured property has been restored or replaced shall be paid out no later than 30 days after the insured has demonstrated that such restoration or replacement has taken place. If a police investigation is pending, compensation will be paid no later than 30 days after the time at which Trygg-Hansa has received the investigation. Interest is paid for the time during which payment is delayed, in accordance with the Swedish Central Bank’s reference rate.

Page 23: Terms and conditions - Business travel insurance · for travel delays, after 4 hours the insurance amount is SEK 3,000 for travel commencement protection, the insurance amount is

General Contract Provisions If compensation is paid later than what is set out above, then default interest is paid in accordance with the Interest Rate Act (Räntelagen). Interest is not paid, however, if it is less than one per cent of the base amount. Beyond the interest established above, the policyholder is not entitled to any compensation for damages or loss related to delayed payment of compensation for damages.

1.11 Claims-handling provisions Reference: For measures that the insured is obliged to undertake when damage has occurred or when it is feared that damage may occur, see the General Contract Provisions, point 1.6 (Duty to Rescue).

in connection with missed departure coverage for flight tickets that cannot be rebooked, attach police documentation, documentation from the transport manager or a recovery services bill, depending on which mode of transport was used, which supports the cause and length of the delay

for cancellation of business travel, the original copy of the cancelled ticket should be attached, as well as a medical certificate from the attending doctor that supports the insured event. Your doctor must be competent and not disqualified. In the case of death, a death certificate must be attached to the claim form

when cancelling business travel due to a natural phenomenon, an original copy of documentation from a relevant authority should be attached.

If the person requesting compensation neglects to report an insured loss without unreasonable delay and this results in damage for Trygg-Hansa, then the compensation that should otherwise have been paid out may be fully withheld or reduced in accordance with what is reasonable under the circumstances.

Recourse and double insurance agreement Claims from another insurance company in accordance with the recourse and double insurance agreement entered into between the insurance companies will be regulated by Trygg-Hansa without any need for a claim form from the insured.

Waivers and limitations See the General Contract Provisions, point 1.13 Waivers and Limitations

Incorrect information, etc If the person requesting compensation from Trygg-Hansa has, following an insured loss, deliberately or through gross negligence incorrectly stated, concealed or hidden anything that is of significance to an assessment of entitlement to compensation from the insurance, then the compensation that should otherwise have been paid out may be fully withheld or reduced in accordance with what is reasonable under the circumstances. This restriction on compensation also applies in relation to insured persons other than the person who has submitted the incorrect information.

1.12.5 Claims-handling provisions

1.12.5.1 Reporting damage

Insurance claim Damage that can be expected to lead a claim for damages must be reported to Trygg-Hansa as quickly as possible. If legal proceedings are taken or brought against the insured, then this must be report immediately to Trygg-Hansa. If the person requesting compensation or another form of cover neglects to report an insured loss without undue delay and this results in claims against Trygg-Hansa, then the compensation that should otherwise have been paid out may be fully withheld or reduced in accordance with what is reasonable under the circumstances.

1.12.5.1.1 Waivers and limitations

Waivers Following the amendment of the General Contract Provisions, point 1.13 regarding waivers, the following applies: Damage claims must be submitted to Trygg-Hansa as soon as possible after being received by the person looking to exercise the insurance policy. If the damage claim is not reported to Trygg-Hansa within one year from the date on which it is received by the person looking to exercise the insurance policy, then Trygg-Hansa liability to pay compensation will be void.

Limitations Questions concerning limitations of the right to insurance compensation or other cover are referred to the General Contract Provisions, point 1.13

1.12.5.2 Duty to provide information The insured is obliged, without delay, to provide Trygg-Hansa with documents and other information that may be of significance for its investigation of the claim. If the insured has deliberately or through gross negligence incorrectly stated, concealed or hidden anything that is of significance for assessment of the damage, then the compensation that should otherwise have been paid out may be reduced in accordance with what is reasonable under the circumstances.

1.12.5.3 Summons and legal representatives If the insured is summoned to appear in court or has received information that such a summons may be pending, then this must be reported immediately, whereupon Trygg-Hansa will appoint a legal representative. If the insured does not observe these obligations, then a court judgement on liability to pay compensation cannot be invoked against Trygg-Hansa, nor can legal or arbitration costs be reimbursed.

1.12.5.4 Amicable settlement If the insured, without the permission of Trygg-Hansa, concedes liability, approves a compensation claim or pays out compensation, then Trygg-Hansa is free from liability, unless there has been a clear legal basis for the claim. If Trygg-Hansa so desires, then the insured is obliged to facilitate amicable settlement with the claimant. If Trygg-Hansa has declared itself willing to settle amicably with the person requesting damages, then Trygg-Hansa is free from liability regarding costs or damages that arise subsequently and from undertaking further investigations.

1.12.5.5 Default interest Trygg-Hansa does not pay interest that is due to delays on the part of the insured to perform what is incumbent upon him/her in accordance with 1.12.5.

1. 13 Legal protection insurance for private persons

1.13.1 Insured persons

The insurance concerns disputes, lawsuits or cases (henceforth referred to as disputes) and applies to the insured as a private person in connection with business travel and applies only for disputes that are directly connected with business travel during the insurance period. Dispute refers to a submitted claim that has been rejected in full or in part. Rejected means that the party has actively dismissed the claim.

1.13.2 When the insurance applies Legal protection is provided if the insurance policy is in force whenever the dispute arises.

1.13.3 Where the insurance applies The insurance is valid worldwide.

1.13.4 Insurance amount

The maximum compensation amount per dispute is SEK 200,000. If several disputes arise, they shall be regarded as one single dispute if they are based essentially on the same events or circumstances. It is considered that a dispute exists if the insured and another insured are on the same side.

1.13.5 Excess

An excess of SEK 1,000 plus 10% of surplus costs applies for each dispute.

1.13.6 What the insurance applies to

1.13.6.1 The insurance company’s commitment In the following cases (1.13.6.1.1, 1.13.6.1.2, 1.13.6.1.3) relating to disputes, Trygg-Hansa covers the necessary and reasonable representation and legal expenses that the insured cannot be paid by a counterparty or another party. The insurance policy also covers costs for investigations undertaken after the dispute has arisen but before court proceedings, provided that the investigation has been ordered by the representative of the insured and approved in advance by Trygg-Hansa as necessary in order to assert the insured’s rights in the dispute.

General Contract Provisions If the insured does not hire a legal representative, the insurance does not apply. The insurance does not cover criminal proceedings, nor does it apply to disputes that can only be tried by an administrative authority, specialised court or general administrative court, e.g. county administration, insurance court, rent tribunal, administrative court, administrative court of appeal or supreme administrative court.

1.13.6.1.1 Dispute without legal proceedings The insurance covers the insured’s own representation costs for disputes that can be tried in the district court, expropriating authority, the National Water Supply and Sewage Tribunal, or water court, or which, after a trial in such a court, can be tried in the court of appeal or the supreme court. The insurance also covers disputes under 1.13.6.1, which can be tried by an equivalent court in other countries. If the dispute is such that it must first be processed and tried by another body, only costs which have arisen after such proceedings or hearings will be paid.

1.13.6.1.2 Dispute with legal proceedings The insurance covers the costs of litigation in accordance with 1.13.6.1 – both the insured’s own costs and those which he/she is obliged to pay out following the court hearing – which have been incurred at the specified courts or their higher courts. In such cases, the insurance also applies to retrials, although only if the retrial is granted, and also to rental cases heard in the Svea Court of Appeal. The insurance covers legal costs that you have committed to pay to another party in connection with judicial conciliation under court proceedings, provided that you can demonstrate it is probable that the court, due to new circumstances that have arisen during the court proceedings, would have charged you to pay higher legal costs than what you committed yourself, if the dispute had been tried in court.

1.13.6.1.3 Dispute with arbitration proceedings The insurance covers costs that shall ultimately fall to the insured for arbitration proceedings in connection with disputes in accordance with 1.13.6.1 – both own costs and those that the insured is obliged to pay out following the arbitration hearing – with the exception of remuneration for the arbitrator.

1.13.6.2 Exclusions

1.13.6.2.1 Certain disputes The insurance does not apply to disputes

• that must be handled under legal proceedings in accordance with chapter 1, section 3d, first paragraph of the Swedish Code of Civil Procedure (Rättegångsbalken). However, this exclusion shall not apply to disputes arising from the insurance contract with Trygg-Hansa

• relating to divorce or which concern other matters that arise between spouses in connection with divorce – e.g. custody, maintenance, division of property and right of property – and equivalent matters in connection with the dissolution of non-marital cohabitation.

• relating to professional or business activities or other gainful professional activities • relating to financial measures which are of an unusual nature or scope for a private individual • relating to a credit document • relating to claims that are transferred to the insured, if it is not obvious that this transfer

occurred before the events or circumstances that constitute the basis of the dispute. • relating to the insured in the capacity of owner, user or driver of a motor-driven vehicle,

caravan or other trailer, aircraft, steam, motor or sailboat. This exclusion does not apply, however, if the insured temporarily rented or hired these outside of the Nordic region.

• concerning damages or another claim that is due to an act committed by the insured and which has caused suspicion or indictment for a crime that requires intent in order to constitute a punishable offence

• if the insured does not demonstrate that they have legitimate interest in having their case tried.

General Contract Provisions

1.13.6.3 Choice of representative The insured must contract an appropriate representative with regard to the place where the dispute is being tried and with regard to the nature and scope of the dispute. If the insured contracts a representative who does not comply with the above, then the right to insurance compensation may be lost. The representative shall be a member of the Swedish Bar Association or a lawyer employed by such a member or public law service office, or another who is deemed appropriate or equivalent in the country concerned following examination by the Swedish Insurance Board (Svensk Försäkrings Nämnder).

1.13.6.4 What costs are compensated by the insurance The insured can receive compensation for the following costs if they are necessary and reasonable and if the insured cannot have them paid by the counterparty or by the state. Among other things, this means that Trygg-Hansa will not pay if the insured, within or outside of court proceedings, abstains from their possibilities to extract compensation from the counterparty. These costs refer to:

representation fees and expenses

costs associated with presenting evidence in legal or arbitration proceedings

handling costs in court

1.13.6.4.1 Exclusions The insurance does not pay out compensation for:

own work, loss of income, travel and subsistence for the insured

enforcement of ruling, decision or agreement

additional costs which arise if the insured contracts several representatives, changes representative or contracts a representative from outside of the geographic location where the case will be tried

remuneration of arbitrators

negligent litigation.

1.13.7 Claims-handling provisions

1.13.7.1 Recovery To the extent that Trygg-Hansa has paid compensation, Trygg-Hansa assumes the insured’s right to claim compensation from the counterparty or another party. The insured shall facilitate the protection of any right to recovery.

1.13.7.2 Representation costs Trygg-Hansa is entitled to call for arbitration from the Swedish Bar Association or to order an examination of the reasonableness of the fees and costs associated with legal representation.

Reasonable precautions clause/Safety regulation Compensation can be reduced if the insured exposes him/herself to risk of injury or damage without due cause. It can also be reduced if the insured exposes him/herself to risk of injury when under the influence of alcohol, drugs or other intoxicating agents. Normally, compensation is reduced by 25% in such cases. However, compensation can nonetheless be paid out as normal if the insured can indicate that there is no likely connection between the influence of alcohol and the injury incurred. Note: The reasonable precautions clause is not applied when you are subjected to sexual offences.

General Contract Provisions If the insured has disregarded his/her obligations in accordance with this insurance contract, the insurance compensation can be reduced by a reasonable amount. The extent to which reductions may be made shall be determined in accordance with what is reasonable in light of all prevailing circumstances. Whether or not such non-compliance has been deliberate or has occurred with a degree of negligence will also be considered significant. Any mitigating circumstances or to whether the reduction may be unreasonably significant will be taken into consideration. In the event of serious offences toward the obligations of the insured, compensation may be withheld in its entirety.

Disability incurred as a result of compensable injury from assault Disability means that the injury from assault has caused permanent impairment of bodily functions (medical disability) or that future capacity to work is permanently reduced by a minimum of 50% as a result of the damage (financial disability). A distinction is made between medical and financial disability when the degree of disability is being assessed.

Medical disability The insurance covers:

Medical disability: For the future, permanent impairment of your physical or mental functional capacity that is caused by injury from assault.

Disfiguring scars or other forms of disfigurement, persistent pain, loss of sensory function or internal organs caused by injury from assault that required medical treatment.

The insurance does not pay compensation:

Injury which does not entail any measurable disability within three years from the assault.

More than 100% disability for the same case of injury from assault.

Scars or other disfiguration that did not require medical treatment.

Disability compensation in accordance with section 1.7.2 Compensation for disability and death caused by accidental injury

Other provisions regarding medical disability The degree of disability is determined with regard to the injuries and symptoms caused by the accidental injury and which can be established objectively. The determination is made independently of the degree to which the injured party’s capacity to work has been reduced as a result of the accidental injury. If a lost body part is replaced by a prosthetic, functionality of the prosthetic will be taken into consideration when the degree of disability is being determined. Determination of the degree of medical disability is made with reference to the industry-wide table framework applicable at each time of payment. Determination of scars or other forms of disfigurement is made with reference to Trygg-Hansa’s established table framework. if the same count of assault causes injury to several body parts, compensation is paid out in accordance with the calculated degree of disability, up to max 100%. If the injured body part was not completely healthy and in working order before the assault, the previous degree of disability will be deducted.

Financial disability The insurance pays compensation for financial disability caused by injury from assault which occurs before the 55th birthday of the insured, provided that the following is met:

capacity for work is permanently reduced by at least 50%

the injury from assault has caused medical disability

all possibilities for work training and rehabilitation have been investigated The insurance does not pay compensation for financial disability:

in case of a reduction in capacity for work of less than 50%

as a consequence of injury from assault that takes place after the 55th birthday of the insured

after the 60th birthday of the insured

in accordance with section 1.7.2 Compensation for disability and death caused by accidental injury

Determination of compensation

Page 31: Terms and conditions - Business travel insurance · for travel delays, after 4 hours the insurance amount is SEK 3,000 for travel commencement protection, the insurance amount is

General Contract Provisions The basis for determining financial disability is comprised only of those symptoms and physical impairments caused by the assault injury that can be objectively established by Trygg-Hansa. Only the reduction in any capacity for work used immediately before the assault injury and that would probably have been used if the capacity for work had not been lost will be taken into consideration. The determination is made with consideration to the insured’s ability to carry out their daily work in spite of the injury from assault or to perform similar work that they can reasonably be expected to undertake given their existing skills and abilities, and with consideration of age, previous education and experience, training and similar measures, and the insured’s residence circumstances. Capacity for work is considered permanently reduced when all options for work, including other professions, have been considered. All options for rehabilitation must also have been investigated. If the insured was already wholly or partially unfit for work at the time of the claim, then the compensation paid will equate to the loss of remaining capacity for work. Determination of the degree of disability is undertaken with reference to the loss of capacity for work that the injury from assault has caused. Loss of capacity for work must arise subsequently to the injury from assault and within three years from the date of the incident that resulted in medical disability.

Compensation amount The compensation constitutes a part of the insurance amount that corresponds to the degree of disability. The compensation amount is determined on the basis of financial disability if such disability exists; otherwise, it is based on medical disability if this leads to a higher compensation amount. If compensation for medical disability has already been paid out, then a deduction is made for the amount paid out.

The right to compensation The following conditions must be met in order for the right to compensation for financial disability to exist:

It must be assessed that future capacity for work is permanently reduced by at least 50%

The injury from assault must have resulted in medical disability

Medical and professional rehabilitation must have been investigated and performed

The assault must have occurred before the 55th birthday of the insured. If death occurs before the right to compensation is achieved, then compensation for financial disability will not be paid out.

Common rules for medical and financial disability

Possibility for reassessment if the degree of disability increases If the injury from assault results in significant impairment of the insured’s bodily function or if the insured loses their capacity for work to a further extent after the time at which Trygg-Hansa has made its final decision on the insured’s right to compensation in connection with the assault, then the insured is entitled to have their degree of disability reassessed in light of the new circumstances. Reassessment can be granted within ten years from the date of the incident if the insured submits their request for reassessment in writing to Trygg-Hansa and simultaneously submits information about the circumstances which constitute the basis for reassessment, in line with the above.

1.14.4 Claim assessment and compensation rules

Compensation is assessed in accordance with the generally applicable rules of tort law. However, if the court

adjusts the damages due to the offenders personal circumstances (e.g. because they are a minor, suffering from a mental illness or due to financial circumstances), then Trygg-Hansa will pay the full damages without adjustment

due to consent or another reason, imposes a higher amount than what is normal practice under applicable law, then compensation shall only be paid out up to the highest amount that would be imposed in accordance with the rules of applicable law.

1. 14.5 Claims-handling provisions If the insured is injured, then the insured must submit all information and documents which demonstrate that the insured is entitled to damages and that the person responsible is unknown or unable to pay damages. In order for Trygg-Hansa to pay out compensation, the insured must demonstrate that it is unlikely compensation can be obtained from the offender. In order for Trygg-Hansa to determine whether the insured needs to take action in court or not, it is of the utmost significance that the insured provides us with all significant information as quickly as possible.

Disability Disability means that the accidental injury has caused permanent impairment of the insured’s bodily functions (medical disability) or that the insured’s capacity for work in the future is permanently reduced by a minimum of 50% as a result of the damage (financial disability). A distinction is made between medical and financial disability when the degree of disability is being assessed.

Medical disability Medical disability corresponds to physical or mental impairment which is determined independently from the insured’s profession and working conditions or leisure interests. It must be possible for the impairment to be established objectively. Medical disability can also cover permanent pain, loss of internal organs and loss of sensory function.
