Definition 1.1 For the purpose of these terms and conditions, the following words and expressions shall have the meanings assigned to them except where the context otherwise requires: “Bank” refers to AmBank Berhad (Company No: 8515-D) and AmBank Islamic Berhad (Company No: 295576- U), companies incorporated in Malaysia under the Companies Act 1965 (repealed by Companies Act 2016) and having their registered address at Level 22, Bangunan AmBank Group, No. 55, Jalan Raja Chulan, 50200 Kuala Lumpur. “AmBank Group” refers to all the Related Corporations and Associate Corporations of the Bank whether incorporated inside or outside Malaysia, existing now or in the future and reference to ‘AmBank Group’ in these terms and conditions herein, shall include all or any entity within the AmBank Group. “Prior Notice” means notice by the Bank of certain facts or of a particular state of affairs of at least seven (7) business days. “CASA” refers to Current or Savings account of the Eligible Customer(s) maintained with AmBank/AmBank Islamic. 1. Definition

1.1 For the purpose of these terms and conditions, the following words and expressions shall have the meanings

assigned to them except where the context otherwise requires:

“Bank” refers to AmBank Berhad (Company No: 8515-D) and AmBank Islamic Berhad (Company No: 295576-

U), companies incorporated in Malaysia under the Companies Act 1965 (repealed by Companies Act 2016)

and having their registered address at Level 22, Bangunan AmBank Group, No. 55, Jalan Raja Chulan, 50200

Kuala Lumpur.

“AmBank Group” refers to all the Related Corporations and Associate Corporations of the Bank whether

incorporated inside or outside Malaysia, existing now or in the future and reference to ‘AmBank Group’ in

these terms and conditions herein, shall include all or any entity within the AmBank Group.

“Prior Notice” means notice by the Bank of certain facts or of a particular state of affairs of at least seven (7)

business days.

“CASA” refers to Current or Savings account of the Eligible Customer(s) maintained with AmBank/AmBank

Islamic. The products offered under this campaign includes:

(a) Basic Savings Account/-i (BSA/-i),

(b) Basic Current Account/-i (BCA/-i),

(c) TRUE Savers Account/-i,

(d) TRUE Transact Current Account,

(e) TRUE Transact Account-i,

(f) AmStar Current Account,

(g) AmStar Extreme Current Account,

(h) Everyday Savings Account,

(i) Family First Special Savings Account/-i and

(j) Family First Everyday Account/-i (Family First/-i)

“Retail Banking” in this campaign refers to consumer banking that caters for individual customers.

“Retail Individual Customers” refers to individual customers of AmBank/AmBank Islamic under Retail

Banking.

“Fresh Funds” refers to monies or funds that are:

(a) not transferred from any existing AmBank/AmBank Islamic deposit account; or

(b) transferred by way of Interbank GIRO transfer (IBG) or Instant Interbank Fund Transfer (IBFT) from

another bank/financial institution into the customer’s Bank CASA; and

(c) deposit placements made by way of cheque(s) issued by another bank(s) are subject to their clearance

and will only be considered as CASA placements by the Eligible Customers after the cheques are paid or

cleared and will only be considered good if not returned or dishonoured.

Words denoting ‘person’ shall include living persons and, if and where applicable, body or persons

incorporated or unincorporated. Words importing the singular shall also include the plural and

1.2 The term “Associate Corporations” shall have the same meaning assigned to it under Section 2(1) of the

Financial Services Act 2013 or the Islamic Financial Services Act 2013, where applicable. The term “Related

Corporations” shall have the same meaning assigned to it under Section 7 of the Companies Act 2016.

2. Campaign Period

2.1 The Campaign shall commence from 1 October 2018 and end on 31 March 2019 (both dates inclusive) or

upon reaching RM85,880.00 cash back payout for the Eligible Customers (hereinafter defined), whichever

comes first (“Campaign Period”). The Bank reserves the right to vary or amend the duration of the Campaign

Period at its sole and absolute discretion with Prior Notice.

3. Eligibility

3.1 The Campaign is offered exclusively to a selected group of existing CASA customers of the Bank, who receive

an invitation from the Bank to participate in this campaign by way of Short Message Services ("SMS"), calls

by Ambank Telesales Executive, Electronic Direct Mailer (“EDM”) or Web Banner, herein referred to as the

"Eligible Customer(s)".

3.2 Registration for participation in this Campaign can only be performed by the Eligible Customer(s) as follows:

(a) Participation via Web Banner, EDM or SMS: the Eligible Customer(s) shall, during the Campaign Period,

register his/her participation in this Campaign by replying to AmBank/AmBank Islamic via SMS to 66300

(the “SMS reply”). The Eligible Customer(s) are deemed to have agreed to accept the Terms & Conditions

of this Campaign via “the SMS reply”; or

(b) Participation via recorded call(s) with Telesales Executive appointed by AmBank/AmBank Islamic.

3.3 This campaign is applicable to CASA which is eligible for protection by Perbadanan Insurans Deposit Malaysia

(PIDM).

3.4 In relation to joint account holders, only the principal/primary account holder shall be eligible to participate

in this Campaign. The secondary joint accountholder(s) is not eligible to participate in this Campaign.

3.5 Employees of the AmBank Group and their immediate family members (spouses, children and parents) are

not eligible to participate in this Campaign.

4. Cash Back Campaign Mechanics and Fulfilment Condition

4.1 To participate in this Campaign, the Eligible Customer(s) is/are required to make a minimum amount of

Ringgit Malaysia Three Thousand (RM3,000) CASA top up into their account. The amount of CASA top up shall

be calculated based on each every multiple of RM3,000 as stipulated in Table 1 below.

4.2 Each Eligible Customer will be entitled to receive one (1) time cash back of Ringgit Malaysia Six (RM6.00) only

for every Ringgit Malaysia Three Thousand (RM3,000) fresh fund deposited, as illustrated in Table 1 above.

4.3 During “2019 New Year Promotion Period” between 1 January 2019 – 31 March 2019, one (1) time additional

Cash Back of Ringgit Malaysia Nineteen (RM19.00) will be rewarded to Eligible Customer for their CASA Top

Up of minimum every Ringgit Malaysia Twenty Four Thousand (RM24,000) per month for two (2) consecutive

months, as stipulated in Table 1(a) above.

4.4 In the event that the Eligible Customer(s) has more than one (1) CASA with AmBank/AmBank Islamic, the

combined balance of all accounts of the Primary Account Holder shall be counted for the purposes of this

Campaign, and the account with most recent transaction(s) will be used as the participating account for this

Campaign.

4.5 Eligible Customer(s) must place a "Fresh Fund" of not less than the minimum required amount (as stipulated

in Table 1), herein refer to as "Incremental CASA", and maintain in the participating account for minimum of

1 month, herein refer to as “Allocation Period”.

4.6 This Campaign is available for placement made through the below channels:

(a) Interbank GIRO transfer (IBG) or Instant Interbank Fund Transfer (IBFT);

(b) Cash Deposit Machine (CDM) of AmBank/AmBank Islamic in Malaysia;

(c) Cheques issued by another bank (subject to clearance of the cheques).

4.7 The cash back is capped at Ringgit Malaysia Forty Eight (RM48) per Eligible Customer per month during the

Campaign Period. The Bank will not be responsible in notifying Eligible Customer(s) should the cash back have

reached the maximum amount.

4.8 The Month End Balance ("MEB") of Eligible Customer(s) in the participating account will be used as the

Baseline to compute “Fresh Fund” and determine the “Incremental CASA” to ascertain the qualifying cash

back of the Eligible Customer(s). Refer to clause 1.1 for Fresh Funds definition.

4.9 The Baseline in this campaign refers to the month end balance in the CASA, prior to the month of, either by

way of SMS or Calls made to the Eligible Customers, as illustrated in Table 2 below.

4.10 For clarity, please refer to Table 3 & Table 3A below which has included but not limited to the examples of

different scenarios on the basis that the Eligible Customer(s) meet the Participation Criteria and his/her cash

back entitlement as stated in Clause 4.2, 4.3 & 4.4 above

4.11 The cash back shall be credited to the Eligible Customer(s)' participating account within 3 weeks after the

“Allocation Period” (refer to clause 4.4) and upon the Bank's computation of the Eligible Customer(s)

incremental CASA to ascertain the entitlement of the Eligible customer(s) to the relevant cash back.

4.12 At the time of crediting the cash back to the participating account, the account MUST be in good standing

and MUST NOT be in breach of any of the terms and conditions of AmBank Current or Savings

Account/AmBank Islamic Current or Savings Account/-i, and/or be invalid of cancelled within the Bank’s

definition, otherwise, the cash back will be forfeited. The Bank will not entertain any request from the

Eligible Customer(s) to credit the cash back to other accounts belonging to the Eligible Customer(s).

4.13 Eligible Customer(s) may contact our Contact Centre at 03-2178 8888 for any further enquiries or

clarification about the Campaign.

4.14 If there is any dispute or non-receipt of the cash back within three (3) weeks upon the end of the

“Allocation Period”, the Eligible Customer(s) may contact 03-2178 8888 to request for an inquiry.

5 General

5.1 By participating in this Campaign, the Eligible Customer(s) and/or any party related herein consent and

agree to be bound by the terms and conditions herein, to be read together with:

(a) General Terms and Conditions for Accounts & Services and;

(b) Specific Terms and Conditions for Commodity Murabahah-Based Current Account-i/Savings Account-i

5.2 The Campaign offer is not valid with any other promotions of the Bank. No other special, additional or

preferential rates shall be given under the Promotion.

5.3 The Bank shall have, at any time, the right and absolute discretion to cancel, terminate or suspend the

Campaign with Prior Notice without assigning any reason.

5.4 The Bank shall have the right and absolute discretion to vary, amend, delete or add to any of the terms and

conditions set out herein, in whole or in any part from time to time including to vary the Promotion Period

as it deems fit, necessary and appropriate with Prior Notice.

5.5 The Bank shall have the absolute right to cancel the participation of or disqualify any Eligible Customer

from participating in the Promotion if it finds or determines that:

(a) The said Eligible Customer has provided untrue information or acted fraudulently or wrongfully in any

manner during the entry process or throughout the Campaign Period; or

(b) The Eligible Customer has breached or potentially will breach the terms and conditions herein.

5.6 Unless expressly stated otherwise, the terms and conditions herein set forth including any amendment

thereto shall prevail over any other provisions and/or representations contained in any other

notices/promotion/advertising materials for the Promotion.

5.7 The Bank’s decision on all matters relating to the eligibility of the Campaign shall be final and binding on

all the participating Eligible Customer.

5.8 Under no circumstances will the Bank be held liable for any loss or damages, including without limitation

to loss of income, profits, goodwill, direct or indirect, incidental, consequential, exemplary, punitive or

special damages of any party including third parties, howsoever arising whether in contract, tort,

negligence or otherwise, borne in connection with the Promotion or the Bank having exercised its rights

and entitlement under any of these terms and conditions, and even if the Bank having exercised its rights

and entitlement under any of these terms & conditions, and even if the Bank has been advised of the

possibility of such damages in advance, all such damages are expressly excluded.

5.9 The Bank shall not be liable for any default in respect of the Campaign due to any act of god, war, riot,

strike, lockout, industrial action, fire, flood, drought, storm, technical or system failures or any event

beyond the reasonable control of the Bank.

5.10 All terms and conditions stipulated herein shall be governed by and construed in accordance with the laws

of Malaysia.

1 Definisi

1.1 Untuk tujuan terma dan syarat ini, perkataan dan ungkapan berikut hendaklah mempunyai makna yang

ditentukan baginya, melainkan sekiranya konteks memerlukan sebaliknya:

“Bank” merujuk kepada AmBank Berhad (No Syarikat: 8515-D) dan AmBank Islamic Berhad (No. Syarikat:

295576-U), syarikat yang diperbadankan di Malaysia di bawah Akta Syarikat 1965 (dimansuhkan oleh Akta

Syarikat 2016) dan mempunyai alamat berdaftar di Tingkat 22, Bangunan AmBank Group, No. 55 Jalan Raja

Chulan, 50200 Kuala Lumpur.

“Kumpulan AmBank” merujuk kepada semua Syarikat dan Syarikat Bersekutu yang berkaitan dengan Bank

sama ada diperbadankan di dalam atau di luar Malaysia, sudah wujud pada masa ini atau pada masa akan

datang dan rujukan terhadap ‘Kumpulan AmBank’ dalam terma dan syarat ini akan merangkumi semua atau

mana-mana entiti dalam Kumpulan AmBank.

“Notis Terdahulu” bermaksud notis oleh Bank berkenaan fakta-fakta tertentu atau berkenaan sesuatu

keadaan yang tertentu dalam tempoh sekurang-kurangnya tujuh (7) hari perniagaan.

"CASA" merujuk kepada Akaun Semasa atau Akaun Simpanan Pelanggan yang Layak dikekalkan dengan

AmBank / AmBank Islamic. Produk yang ditawarkan di bawah kempen ini termasuk:

(a) Akaun Simpanan Asas/-i (BSA/-i),

(b) Akaun Semasa Asas/-i (BCA/-i),

(c) Akaun Penyimpan/-i TRUE,

(d) Akaun Transaksi Semasa TRUE;

(e) Akaun Transaksi-i TRUE,

(f) Akaun Semasa AmStar,

(g) Akaun Semasa AmStar Extreme,

(h) Akaun Simpanan Harian,

(i) Akaun/-i Simpanan Khas Family First dan

(j) Akaun/-i Harian Family First (Family First/-i)

“Perbankan Runcit” merujuk kepada perbankan konsumer untuk pelanggan individu.

“Pelanggan Runcit Individu” merujuk kepada pelanggan individu AmBank/AmBank Islamic daripada

Perbankan Runcit.

“Dana Baharu” bermaksud wang atau dana yang:

(a) tidak dipindahkan daripada mana-mana akaun deposit AmBank/AmBank Islamic sedia ada; atau

(b) pemindahan antara bank GIRO (IBG) atau Pemindahan Wang Antara Bank (IBFT) daripada bank/institusi

kewangan yang lain ke dalam CASA Bank pelanggan; dan

(c) penempatan deposit yang dibuat melalui cek yang dikeluarkan oleh bank lain atau dikeluarkan oleh pihak

ketiga ke dalam bank akaun adalah tertakluk pada penjelasan cek dan akan hanya diterima sebagai

penempatan deposit oleh Pelanggan yang Layak selepas cek tersebut dijelaskan dan hanya akan dianggap

jelas jika tidak dikembalikan sebagai cek tak laku.

Perkataan yang menggambarkan individu adalah merangkumi mereka yang masih hidup, dan sekiranya dan

di mana berkenaan, pertubuhan atau mereka yang diperbadankan atau tidak diperbadankan. Perkataan yang

membawa maksud singular juga akan merangkumi maksud jamak dan sebaliknya. Perkataan yang membawa

maksud jantina lelaki akan merangkumi jantina perempuan dan jantina neuter.

“Kempen/Promosi” merujuk kepada “Kempen CASA Easy Cash Back” yang dianjurkan oleh Bank menurut

terma dan syarat yang ditetapkan di sini.

“Bagi Akaun Semasa-i atau Akaun Simpanan-i AmBank Islamic, pulangan tunai yang diberikan kepada

pelanggan yang layak adalah dianggap sebagai hibah (hadiah).”

1.2 Istilah “Perbadanan Bersekutu” mempunyai maksud yang sama seperti yang diperuntukkan terhadapnya di

bawah Seksyen 2(1) Akta Perkhidmatan Kewangan 2013 atau Akta Perkhidmatan Kewangan Islam 2013, yang

mana berkenaan. Istilah “Syarikat Yang Berkaitan” pula mempunyai maksud yang sama seperti yang

diperuntukkan terhadapnya di bawah Seksyen 7 Akta Syarikat 2016.

2 Tempoh Kempen

2.1 Kempen akan bermula pada 1 Oktober 2018 dan tamat pada 31 Mac 2019 (merangkumi kedua-dua tarikh)

atau apabila mencapai RM85,880.00 Pulangan Tunai untuk Pelanggan yang Layak dengan Bank, mengikut

mana-mana yang terdahulu (“Tempoh Kempen”). Pihak Bank berhak untuk mengubah atau meminda

Tempoh Promosi atas budi bicara mutlaknya dengan memberikan Notis Terdahulu.

3 Kelayakan

3.1 Kempen ini ditawarkan secara eksklusif kepada sekumpulan pelanggan Bank sedia ada, yang menerima

undangan dari Bank untuk mengambil bahagian dalam kempen ini melalui Perkhidmatan Pesanan Ringkas

("SMS"), panggilan oleh Eksekutif Telesales AmBank, Kiriman Langsung Elektronik ( "EDM") atau Banner Web,

di sini dirujuk sebagai ("Pelanggan yang Layak").

3.2 Pendaftaran untuk menyertai Kempen ini hanya boleh dilakukan oleh Pelanggan yang Layak seperti berikut:

(a) Penyertaan melalui SMS: selepas menerima SMS, Pelanggan yang Layak hendaklah, semasa Tempoh

Kempen, mendaftarkan penyertaan beliau untuk Kempen ini dengan membalas AmBank/AmBank

Islamic melalui SMS ke 66300 (“balasan SMS”). Pelanggan yang Layak dianggap telah bersetuju untuk

menerima terma dan syarat kempen ini melalui "balasan SMS" atau

(b) Penyertaan melalui panggilan berakam dengan Eksekutif Telesales dilantik oleh AmBank/AmBank

Islamic.

3.3 Kempen ini adalah berkenaan dengan CASA, yang layak dilindungi oleh Perbadanan Insurans Deposit

Malaysia (PIDM).

3.4 Bagi akaun bersama, hanya pemegang akaun utama/ prinsipal layak untuk menyertai dalam Kempen ini.

Pemegang akaun bersama sekunder tidak layak untuk mengambil bahagian dalam Kempen ini.

3.5 Kakitangan Kumpulan AmBank dan ahli keluarga terdekat mereka (suami, isteri, anak-anak dan ibu bapa)

tidak layak untuk menyertai dalam Kempen ini.

4 Mekanisma Kempen dan Pemenuhan

4.1 Untuk mengambil bahagian dalam Kempen ini, Pelanggan yang Layak dikehendaki menambah jumlah nilai

CASA sebanyak minimum Ringgit Malaysia Tiga Ribu (RM3,000) ke dalam akaun mereka. Jumla tambahan

nilai CASA akan dikira berdasarkan setiap gandaan RM3,000 seperti yang dinyatakan dalam Jadual 1 di

bawah.

4.2 Setiap Pelanggan yang Layak berhak menerima satu (1) kali pulangan tunai sebanyak Ringgit Malaysia

Enam (RM6.00) sahaja untuk setiap dana baharu Ringgit Malaysia Tiga Ribu (RM3,000) yang disimpan,

seperti yang ditunjukkan dalam Jadual 1 di atas.

4.3 Dalam tempoh "Tempoh Promosi Tahun Baru 2019" di antara 1 Januari 2019 – 31 Mac 2019, satu (1) kali

Pulangan Tunai tambahan sebanyak Ringgit Malaysia Sembilan belas (RM19.00) akan diberi kepada

Pelanggan yang Layak untuk setiap minimum Ringgit Malaysia Dua Puluh Empat Ribu (RM24,000) nilai

tambahan CASA sebulan untuk dua (2) bulan berturut-turut, seperti yang dinyatakan dalam Jadual 1 (a)

di atas.

4.4 Sekiranya Pelanggan yang Layak mempunyai lebih daripada satu (1) CASA dengan AmBank/AmBank

Islamic, baki gabungan semua akaun Pemegang akaun utama akan dikira untuk tujuan Kempen ini dan

akaun dengan paling banyak urusan yang akan digunakan sebagai akaun yang mengambil bahagian untuk

Kempen ini.

4.5 Pelanggan yang Layak mesti menempatkan "Dana Baharu" tidak kurang daripada amaun minimum yang

diperlukan (seperti yang ditetapkan dalam Jadual 1), di sini merujuk kepada sebagai " Nilai Tambahan

CASA", dan mengekalkan dalam akaun yang mengambil bahagian selama 1 bulan, di sini merujuk kepada

sebagai "Tempoh Peruntukan".

4.6 Penempatan boleh dibuat melalui saluran di bawah:

(a) pemindahan antara bank GIRO (IBG) atau Pemindahan Wang Antara Bank (IBFT);

(b) Mesin Deposit Tunai (CDM) AmBank/AmBank Islamic di Malaysia;

(c) Cek yang dikeluarkan oleh bank lain (tertakluk kepada penunaian cek).

4.7 Pulangan tunai dihadkan pada Ringgit Malaysia Empat Puluh Lapan (RM48) bagi setiap Pelanggan yang

Layak setiap bulan dalam Tempoh Kempen ini. Pihak Bank tidak akan bertanggungjawab dalam

memberitahu Pelanggan yang Layak sekiranya pulangan tunai telah mencapai jumlah maksimum.

4.8 Baki Akhir Bulan ("MEB") dalam akaun yang mengambil bahagian Pelanggan yang Layak akan digunakan

sebagai garis asas untuk mengira "Dana Baharu" dan seterusnya menentukan "Tambahan Nilai CASA"

untuk memastikan pulangan tunai yang berlayakan untuk Pelanggan yang Layak. Rujuk kepada klausa 1.1

untuk definisi Dana Baharu.

4.9 Garis Asas dalam kempen ini merujuk kepada baki pada akhir bulan dalam CASA, bulan sebelum, sama

ada melalui SMS atau Panggilan AmBank yang dibuat kepada Pelanggan yang Layak, seperti yang

ditunjukkan dalam Jadual 2 di bawah.

4.10 Untuk kejelasan, sila rujuk kepada Jadual 3 & Jadual 3A di bawah yang termasuk tetapi tidak terhad

kepada contoh-contoh senario yang berbeza atas dasar bahawa Pelanggan yang Layak memenuhi Kriteria

Penyertaan dan Kelayakan Pulangan Tunai beliau seperti yang dinyatakan dalam klausa 4.2, 4.3 dan 4.4

4.11 Pulangan tunai akan dikreditkan kepada akaun yang mengambil bahagian Pelanggan yang Layak dalam

tempoh 3 minggu selepas "Tempoh Peruntukan" (rujuk kepada klausa 4.4) dan selepas pengiraan Bank

atas tambahan nilai CASA Pelanggan yang Layak, untuk menentukan kelayakan Pelanggan yang Layak

untuk kembali tunai yang berkaitan.

4.12 Masa mengkredit pulangan wang tunai ke Akaun Pelanggan Layak, akaun tersebut MESTI berada dalam

kedudukan yang baik dan TIDAK MELANGGAR mana-mana terma dan syarat Akaun Semasa/Simpanan

AmBank / AmBank Islamic, dan / atau tidak sah dibatalkan dalam takrifan Pihak Bank, jika tidak, pulangan

tunai akan dibatalkan. Pihak Bank tidak akan melayan apa-apa permintaan daripada Pelanggan yang Layak

untuk mengkreditkan pulangan tunai ke akaun lain yang dimiliki oleh Pelanggan yang Layak.

4.13 Pelanggan yang Layak digalakkan untuk menghubungi Pusat Panggilan kami di talian 03-2178 8888 untuk

sebarang pertanyaan atau penjelasan lanjut mengenai Kempen ini.

4.14 Jika terdapat apa-apa pertikaian atau tidak menerima pulangan tunai dalam tempoh tiga (3) minggu

selepas " Tempoh Peruntukan" tamat, Pelanggan yang Layak diperlukan untuk hubungi 03- 2178 8888

untuk meminta siasatan.

5 Umum

5.1 Dengan menyertai Kempen ini, Pelanggan yang Layak dan/atau mana-mana pihak yang dinyatakan di sini

memberi kebenaran dan bersetuju untuk terikat dengan terma dan syarat di dalam ini, untuk dibaca

bersama dengan:

(a) Terma dan Syarat Umum Bagi Akaun dan Servis;

(b) Terma dan Syarat Khusus Bagi Akaun Semasa-i/ Akaun Simpanan-i Berasaskan Komoditi Murabahah

5.2 Tawaran Kempen adalah tidak sah dengan mana-mana promosi lain yang ditawarkan oleh Bank. Tiada

kadar istimewa, tambahan atau keutamaan lain yang boleh diberikan di bawah Promosi ini melainkan jika

ditentukan sebaliknya oleh Bank.

5.3 Bank mempunyai hak dan budi bicara mutlak, pada bila-bila masa, untuk membatalkan, menamatkan atau

menggantung Promosi ini dengan memberikan Notis Awal tanpa perlu memberikan sebarang alasan.

5.4 Bank mempunyai hak dan budi bicara mutlak untuk mengubah, meminda, memadam atau menambah ke

atas mana-mana terma dan syarat yang dinyatakan secara khusus di dalam ini, secara keseluruhan atau

mana-mana bahagian dari semasa ke semasa termasuk mengubah Tempoh Promosi ini seperti yang

difikirkan padan, perlu dan sesuai dengan memberikan Notis Terdahulu.

5.5 Bank mempunyai hak untuk membatalkan penyertaan atau kelayakan mana-mana Pelanggan yang Layak

daripada mengambil bahagian dalam Promosi sekiranya ia mendapati atau memutuskan bahawa:

(a) Pelanggan yang Layak tersebut telah memberikan maklumat yang tidak benar atau melakukan

penipuan atau kesalahan dalam apa-apa cara semasa proses penyertaan atau di sepanjang Tempoh

Promosi; atau

(b) Pelanggan yang Layak telah melanggar atau berpotensi melanggar terma dan syarat ini.

5.6 Melainkan dinyatakan sebaliknya, terma dan syarat ini akan mengatasi mana-mana peruntukan lain

dan/atau perwakilan yang terkandung dalam mana-mana notis /promosi/bahan pengiklanan lain untuk

Kempen ini.

5.7 Keputusan Bank dalam semua perkara berkaitan dengan kelayakan Kempen ini adalah muktamad dan

mengikat semua Pelanggan yang Layak yang mengambil bahagian.

5.8 Tidak dalam mana-mana keadaan pun pihak Bank harus dipertanggungjawabkan terhadap apa-apa

kerugian atau kerosakan, termasuklah tanpa had kepada, kehilangan pendapatan, keuntungan, nama

baik, secara langsung atau tidak langsung, sampingan, turutan, teladan, kerosakan punitif atau khas bagi

mana-mana pihak termasuklah pihak ketiga, walau bagaimana cara sekalipun ia timbul sama ada dalam

kontrak, tort, kelalaian atau sebaliknya, berhubung dengan penyertaan di dalam Promosi ini atau setelah

pihak Bank melaksanakan haknya di bawah terma dan syarat ini, walaupun pihak Bank telah dinasihati

tentang kemungkinan berlakunya kerugian sedemikian terlebih dahulu, semua kerugian sedemikian

secara jelas dikecualikan.

5.9 Bank tidak akan bertanggungjawab terhadap sebarang keingkaran berkaitan dengan Kempen ini

disebabkan oleh sebarang bencana alam, peperangan, rusuhan, mogok, sekat masuk, tindakan industri,

kebakaran, banjir, kemarau, ribut, kegagalan teknikal atau sistem atau sebarang peristiwa di luar kawalan

munasabah Bank.

5.10 Semua terma dan syarat yang ditetapkan di sini akan ditadbir dan ditafsirkan menurut

undang-undang Malaysia.
