Terms of Reference for
Construction Supervision (NACS01)
A. Project Background
1. The Asian Development Bank (ADB) approved a loan worth 203.5 million USD on
15 December 2017 to help promote inclusive economic growth in four north central
provinces (NCPs): Nghe An, Ha Tinh, Quang Binh and Quang Tri. This support is
expected to benefit more than one million people through the implementation of locally
prioritized basic infrastructure Sub-projects, including (i) upgrading district roads; (ii)
improving productive and business infrastructure such as (a) rural domestic water supply
schemes (RDWS), (b) coastal defenses and flood protection, (c) a river port, and (d)
irrigation reservoirs; and (iii) establishing provincial public asset management systems.
The project completion date is 30 September 2023.
2. The Basic Infrastructure for Inclusive Growth in four North Central provinces
Sector Project (Project) funded by the ADB (BIIG2) is implemented in Ha Tinh, Nghe An,
Quang Binh and Quang Tri provinces (Biig2). The Project responds to the Government of
Vietnam's strategy of targeting the use of concessional ODA investment into poorer
provinces using economic sub-regions as a means of identifying interconnectivity and
synergies between provinces to accelerate economic growth in provinces that have
previously lagged in terms of economic growth.
3. The project has three outputs: Output 1: Transport infrastructure improved; Output
2: Productive infrastructure for business development improved; Output 3: Decentralized
public asset management processes established.
4. Nghe An is one of 4 provinces participating in the project. For more details, please

B. Nghe An Sub-project
5. Nghe An is one of 4 North Central provinces under BIIG2. Nghe An sub-project has
three outputs:
o Output 1: Upgrading and building the provincial and district roads that have
resistant ability to climate changes improving access to provincial transportation
networks connecting rural area and remote areas with economic growth dominant
areas;
o Output 2: Construction, upgrading and restoration or stabilization of dykes,
embankments and irrigation works;
o Output 3: Decentralization in the implementation of public asset management
procedures including procurement and operation of asset management systems for
(i) roads; (ii) irrigation systems.

C. Implementation Arrangement of Nghe An Sub-project
6. Nghe An Provincial People’s Committee is executing agency (EA). Department of
Planning and Investment (DPI) is the implementing agency (IA). BIIG2 Nghe An Project
management unit (PMU) is established under the direct guidance of Nghe An DPI. BIIG2
Nghe An PMU is responsible for managing, implementing and monitoring project
implementation on a daily basis and reporting directly to the Nghe An DPI.
7. BIIG2 Nghe An PMU will recruit a consulting firm (the consultant) to support it
with setting up a suitable and adequate contract management and construction supervision
to ensure that the works under the Contract are completed and the goods are supplied in
accordance with the Contract Documents. The expected duration of the service is 48
months and the expected commencement date is Quarter I/2020. The services shall cover
the following sub-projects:
(i) Sub-project 1 (representative sub-project ): District road 349 from Dinh Son
at Km0 + 000 to Cay Khe crossroad at Km8 + 000.71 in Anh Son district, Nghe
An province.

with Design speed V TK = 40Km / h, total length of the road: 8.0 km
- Width of roadbed: Bnền = 7,5m .

- Construction of two new bridges (01 small bridge and 01 big bridge)
- Asphalted road surface, required elastic module Eyc ≥ 100Mpa
(ii) Sub-project 2: Building and upgrading of Song Mo dyke embankment in Quynh
Luu district, Phuc Tho dyke in Nghi Loc district and Song Hieu dyke
embankment in Quy Chau district.
2.1. Phuc Tho dyke, Nghi Loc district: (i) Construction of dyke with length of
1712,0m: start point Km0+00, on the road along the Lam River near Rao
Rung Culvert, end point Km1+712 at Hai Quan Fence, dyke width
B=5,0m, Cat. IV irrigation works. (ii) Building 02 rescue roads, length of
470,0m including two roads, road 1 with length L=306,70m, road 2 with
length L=163,20m. Minimum width of road 3,5m, cement concrete
structure M250 thickness 18cm.
2.2. Hieu river dyke embankment in Quy Chau District: (i) Construction of
dyke embankment with length of 1677,0m, start from the abutment of Ke
Bon Bridge along the right bank of the Hieu River to the downstream
and end at mountain base at Hoa Hai Bridge. (ii) Embankment in
combination with road with width of 6,5m, thickness of 909,95m,
concrete road surface structure M250 with thickness of 20cm

2.3. Mo river dyke in Quynh Luu district: Construction of dyke embankment
with length of L=5484,9m. Embankment width 6,0m in combination
with road, concrete structure M250 thickness 20cm.
(iii) Sub-project 3: Roads for transporting and developing the material areas in
Nghia Dan district, Nghe An province.
- Construction scale: The cat V mountainous road (TCVN4054-05), design
speed 30km/h; total length of 2 roads: 11845,08 km.
- Width of road bed: Bnền = 6,5m.
- Width of Pavement: Bmặt = 2x1,75=3,50m.
- Curb width: Blề = 2x1,5m, In which strengthened curb width: Blề gia cố
= 2x1,0m.
- Construction of 3 new bridges (03 small bridges)

(iv) Sub-project 4: The road connects provincial road 533, Thanh Chuong district
with Ho Chi Minh road and western districts of Nghe An province.

D. Objectives of the Assignment
8. The primary objectives of the consulting services are to:
(i) Function as the Project Manager in administering the civil works contract
(the Contract) – refer to the Contract in the ADB/WB Harmonized Standard
Bidding Document for Works through National Competitive Bidding;
(ii) Review and advise Nghe An DPI/PMU (the Employer of the works
contracts) on approval of the construction methods and construction
implemented by the Construction Contractors;
(iii) Ensure that the permanent and temporary works have been designed and are
constructed in accordance with the provisions of the Contracts and in

accordance with the Vietnamese construction standards and legal basis (see
Appendix for Vietnamese construction standards and legal basis which the
Consultant should follow); and
(iv) Advise the Employer on all matters concerning implementation of the
Contracts including quality control, work progress, implementation issues,
and arbitration or litigation etc.
E. Scope of Work
E.1. Civil Works Contract Administration:
9. Design review. DEDs have been prepared through a firm of consultants. The design
review includes, but is not limited to, the following:
(i) Establish the schedule, methods and procedures for the review of detailed
engineering design and construction drawings of the civil works provided by
the Employer.
(ii) Review the detailed design and construction drawings in accordance with the
design standards, criteria and conceptual design provided in the Contract.
(iii) Ensure that the Technical Specifications in the Bid Documents and the
provisions of Vietnamese Design and Construction Standards have been duly
accounted for in the DED and construction drawings.
E.2. Contract Administration:
10. The construction works will be executed under the Contract following the form of
Contract provided in the ADB/WB Harmonized Standard Bidding Document for Works
through National Competitive Bidding for Works of Civil Engineering Construction.
Accordingly, Nghe An PMU will be the Employer and the consultant will function as the
Project Manager.
11. The consultant will administer the civil works contracts and ensure that the road and
water supply Sub-projects are constructed in accordance with the provision of the civil
works contracts. The consultant will be required to nominate a representative who will be a
full-time resident in the project area. The responsibility of the Project Manager includes,
but not limited to, the following tasks:
(i) Give the order to commence the works;
(ii) Review and approve contracts proposed personnel for positions nominated in
the Contract;
(iii) Inspect and approve all material sources identified by the Contractor;
(iv) Review and approve the Contractor’s implementation schedule, and
supervise the progress of construction works. The Consultant will keep the
Employer informed of any delay or potential delays in the work schedule of
the Contract, and will take all necessary actions to prevent potential delays;
(v) Review, approve and monitor the construction plan to minimize disruption to
vehicular traffic and water supply and agricultural activities during

construction, and to ensure that construction activities do not endanger safety
of the public;
(vi) Regularly monitor and inspect the contractor’s quality control and assurance
program to ensure that quality of the finished works meet the contract
standards and specifications. This includes regular checking of the materials
testing program;
(vii) Advise and assist the Employer with respect to arbitration or litigation
relating to the works, whenever required;
(viii) Monitor progress of the construction works through computer-aided project
management techniques;
(ix) Convene regular site meetings with the Contractor to discuss issues and
problems affecting the progress, and brief the Employer;
(x) Coordinate with the relevant local government authorities/agencies so as to
minimize disruption to the works program, as required by the Contractor;
(xi) Review the contractor’s insurance cover to ensure that the contractor has
provided all the insurance required by the contract and such insurance are
maintained throughout the contract period;
(xii) Prepare any required variation orders requested by the Employer and review
any variation order proposed by the contractor and provide their advice to the
Employer in accordance with the contract;
(xiii) Review all claims submitted by the Contractor and provide advice to the
Employer of the validity of the claim, the effect of such claim on the
construction schedule and the cost of the project;
(xiv) Review and comment on the monthly progress reports submitted by the
contractor detailing the work undertaken during the previous month, the
progress of the work against the approved schedule, the problems and
difficulties encountered by the contractor and other issues requested by the
Employer;
(xv) Issue completion certificate after satisfactory completion of the works in
accordance with the contract provisions;
(xvi) Supervise updating of the Resettlement Plan, if necessary, and develop
poverty monitoring impact monitoring systems;
(xvii) Review and advise the Employer whether the construction methods as
proposed by the contractor for carrying out the works are satisfactory, with
particular references to the technical requirements of sound environmental
standards on the basis of ADB’s Safeguards Policy Statement (2009),
inspection of contractor’s construction equipment, safety of the works,
property, personnel, and general public;
(xviii) Assess and check the laboratory and field tests carried out by the contractor,
and independent tests.
(xix) Issue orders to the Contractor to remove or improve any works that are not in
accordance with the drawings and/or specifications;

(xx) Maintain records of all testing work, including cross-referencing of items of
work to which each test refers and location from which any samples were
obtained for testing.
(xxi) At the completion of the contract, verify the contractor’s “as-built drawings”
as a true record of the works as constructed;
(xxii) Measure the completed works and keep detailed records, including the
measurement books;
(xxiii) Prepare quarterly cash flow projections for the Employer in an acceptable
format, in which cash flow should identify budget estimates for all
outstanding works;
(xxiv) Supervise the maintenance of records for all plant, labor and materials used
in the construction of the works;
(xxv) Supervise the process of interim and final payments to the Contractor
(interim monthly payment shall be based on interim payment certificate
processed by the Consultant following claims filed by the Contractor);
(xxvi) The Consultant will be responsible for checking and monitoring the
performance requirements in the Contract and ensuring the criteria and limits
are met;
(xxvii) Maintain a day-to-day diary, which shall record all events pertaining to the
administration of the contract, request forms, and order given to the
contractor, and any other information which may at a later date be of
assistance in resolving queries which may arise connecting execution of the
works;
(xxviii) Supervise the implementation of training programs of Nghe An
DPI/PMU staff at the site on project management including quality assurance
and contract administration.
12. In addition, or as an expansion of the activities and responsibilities required of the
engineer under the civil works contracts, the consultant will:
(i) Ensure that the construction methods proposed by the contractor for carrying
out the works are satisfactory, with particular references to the technical
requirements of sound environmental standards on the basis of the ADB’s
Safeguards Policy Statement (2009);
(ii) inspection of contractor’s construction equipment; safety of the works,
property, personnel, and general public; and the recommendations of the
Environmental Management Plan (EMP);
(iii) Supervise the implementation of the environmental monitoring plan and
annual report of implementing this plan as part of project implementation
report.
(iv) Supervise the provision of environmental management seminars for
contractors and Nghe An NCP DPI/PMU staff;
(v) Supervise of resettlement plans as per ADB’s Safeguards Policy Statement
(2009);

(vi) Monitor the Construction Contractors to ensure that no child labor is used for
the execution of the civil works contracts as required by the civil works
contracts;
(vii) Monitor the implementation of the health and safety program at camp site
including the information and education campaign on sexually-transmitted
diseases and HIV/AIDS (human immunodeficiency virus/acquired
immunodeficiency syndrome) as required by the civil works contracts; and
(viii) Supervise the implementation of training programs for Nghe An NCP
DPI/PMU staff at site on project management including quality assurance,
contract administration, and water treatment system maintenance.
E.3. Actions Requiring Specific Approval of the Employer
13. The consultant will be required to obtain prior approval of the employer in the
following matters as specified in the civil works contracts:
(i) Recommending the subletting of any part of the works;
(ii) Certifying additional cost;
(iii) Determining an extension of time;
(iv) Issuing a variation having financial implications; and
(v) Fixing rates or prices.
E.4. Project Benefit Monitoring and Evaluation (BME)
14. The consultant will help the Employer establish a system for project performance
monitoring in accordance with the project framework. The consultant will:
(i) Identify, on the basis of the project framework developed during project
processing, performance indicators to be monitored during the
implementation of the Project;
(ii) Advise on the establishment of systems for collecting data and statistics for
such monitoring;
(iii) Advise on the carrying out a baseline survey on performance indicators
including on poverty, socioeconomic survey, gender development,
employment – generation amongst others to Project Affected Persons, and
other social and economic development activities;
(iv) Advise on collection of required data and undertake other relevant surveys
before construction and immediately after completion of the Project; and
(v) Incorporate findings and supporting data in the project completion report, in
accordance with a schedule and terms of reference to be mutually agreed by
Nghe An NCP DPI/PMU and ADB.
E.5. Environmental monitoring
15. In the entire construction process, the environmental monitoring
consultant will check the compliance with the environmental management plan (EMP)
developed and approved according to the items as the detailed environmental management

plan, Environmental Code of Practice (ECOPs), plans for camps management, garbage,
environmental monitoring indicators such as (water, air, organisms) on construction sites
and camps, Labor safety and society. At the same time, the environmental monitoring
consultant must update the arising impacts and propose mitigation measures for such
impacts, this proposal must be reported to the PMU and updated into the environmental
management plan (EMP) every 6 months, during the entire construction process. Specific
tasks of the environmental monitoring experts include (but are not limited to):
(i) Consult to help the PMU ensure compliance with the environmental safeguard
measures of the Government of Vietnam and ADB;
(ii) Review of all relevant documents including, Loan Agreement, Initial
Environmental Examination (IEE), Project Administration Manual (PAM) and
other relevant documents, ADB policies and Law relating to environmental
management, monitoring and protection within the project;
(iii) Preliminary screening of the environmental impact aspects, based on ADB's
environmental safeguard standards as well as those of the State, uses of the list
of completion evaluation criteria, in particular to build the list of preliminary
evaluation criteria according to the Environmental Rapid Assessment Form
regulated by ADB and the Environmental Classification Template proposed in
the project;
(iv) Assist the PMU in submitting the necessary documents to report to ADB on the
results of the preliminary screening and classification process;
(v) In the case of the project categorized C, notification to ADB of the subproject
screening and classification findings;
(vi) Identify and report to the PMU to eliminate the construction proposals that are
likely to have significant adverse impacts on the environment and be categorized
A according to ADB guidelines;
(vii) Based on ADB's confirmation on the project/subproject categorization, preparing
IEE, in both Vietnamese and English for all medium and large projects/sub-
projects, proposed as part of the project.
(viii) According to ADB's confirmation on the project/subproject categorization,
establishing IEE, including English and Vietnamese versions, for small and large

(ix) Assist the PMU in organizing meaningful consultations with all the stakeholders
for all large and medium scale projects/sub-projects as required by ADB
Safeguard Policy Statement 2009;

(xi) Organize trainings and workshops when necessary on environmental safeguards
and monitoring policies at the projects/sub-projects as required by the EMP, the
PMU's environmental experts;
(xii) Assist the PMU in environmental monitoring at the projects/sub-projects as
required. Prioritization to monitor the environment at all large and medium scale
projects/sub-projects, small scale projects may also be required for monitoring.
(xiii) Discussion with other technical experts in the group, preparation for the cost
estimates for environmental measures to minimize all adverse impacts;
(xiv) Assurance to disclose the project environmental information to the affected
people and the stakeholders as required in ADB Safety Policy Statement 2009;
(xv) Support the PMU to prepare periodic monitoring reports to submit to ADB as
required in PAM.
(xvi) According to the instructions in PAM, developing environmental reports for the
subprojects as proposed to implement in the project;
(xvii) Implementation of other requirements regarding the TOR and at the request of
the PMU Director.
E.6. Resettlement Monitoring
16. Main tasks of the resettlement supervision consultant shall comprise the following:
(i) Verify the results of internal monitoring reports prepared by the PMU and the
unit who implements the compensation and site clearance at district level;
(ii) Assess the compliance level of compensation payments and other types of
support compared to the approved Resettlement Plan.
(iii) Evaluate whether the additional support measures comply with the involuntary
resettlement policy or not and the effectiveness level in recovery of income and
living standards for severely affected households;
(iv) Evaluate the effectiveness, impacts and sustainability of the resettlement
management agencies and related procedures;
(v) Recommendations and proposals to the necessary adjustments in implementation
of the resettlement plans and IRPs to improve implementation effectiveness.
E.7. Gender Action Plan (GAP) Implementation and EMD Monitoring Support
17. The Gender and Ethnic Minority Specialist is responsible for monitoring the
implementation of the Gender Action Plan and the Ethnic Minority Development Plan in
the project. The tasks of the consultant will include (but are not limited to) the following:
(i) Monitor and evaluate the implementation of the Gender Action Plan (GAP) and
the issues on women's participation, including:

o The staff and institutional arrangements are designed to ensure women's
participation;
o Representation and participation of women in the process of implementation
and detailed planning;

The gender and Ethnic Minority monitoring expert is
responsible for overseeing the implementation of the
Gender Action Plan and the Ethnic Minority
Development Plan in the project. The tasks of the
expert will include (but are not limited to) the following:
(i) Monitor and evaluate the implementation of the
Gender Action Plan (GAP) and women's
participation issues, including:
- The staff and institutional arrangements are
designed to ensure women's participation;
- Representation and participation of women in
the process of implementation and detailed
planning;
- Gender-integrated programs: such as health
programs for both men and women, technical
training programs, women's health awareness
programs and technical training for men;
- Supervise the payment of all compensation for
both husband and wife; and
- Evaluate the effectiveness of the livelihood
and resettlement program to restore and
develop income for women and consider the
improvement of living standards related to
women;

- Monitor and evaluate other issues related to
Gender and make recommendations and

(ii) Monitor and evaluate the implementation of Ethnic
Minority Development Plans (EMDP) and Ethnic
Minority participation issues include:
- Information dissemination and consultation
with ethnic minority communities;
- Monitor and assess whether the measures is
fully applied to solve the poverty and EM
issues;
- Monitor the relevance of entitlement
policies; programs and activities
and responsive approaches for different EM
HHs and requirements for adjustments or
additional support measures.
- Monitor the effectiveness of grievance redress
mechanism, complaints and how to resolve
with ethnic minorities;
- Monitor and assess effectiveness: EM people
assess their level of understanding of
communication activities, communication
documents, communication channels, and the
availability of information in the ethnic
minority languages with observation measures
to assess their acknowledgment.
- Assess the satisfaction of EM people:
Determine whether EM people are satisfied
with the policies of EMDP on restoring ethnic
minority culture (such as traditional handicraft,
supporting grave displacement, etc..)
- Monitor and evaluate other issues related to
Ethnic Minorities and make recommendations
and propose solutions to ensure effective
implementation of EMDP.

The project benefit monitoring and evaluation
(BME) expert is responsible for (but are not limited
to) the following:
(i) Assess the status of project results and how
they have been achieved with an assessment
of project’s contribution/approach
(ii) Identify factors that have facilitated and/or
impeded the achievement of objectives
(iii) Assess the relevance, efficiency,
effectiveness, and sustainability of the
project
(iv) Assess the impact of external and internal
factors on the effectiveness of the project
(v) Assess the efficiency and the adequacy of
the management arrangements of the
project
(vi) Identify lessons learned and good practices
with regards to project implementation and
beneficiaries
(vii) Assess the Monitoring and Evaluation
framework used by the project.
21. Firms are required to propose non-key experts who will comprise the team to
implement this assignment and submit their CVs with their technical proposals. Those CVs
will not be taken into account in evaluating proposals, however the non-key experts of the
first-ranked firm will be assessed on a pass-fail basis, and those non-key experts assessed
as not acceptable will be requested to be replaced by the firm.
I. CLIENTS INPUT AND COUNTERPART PERSONNEL,
IMPLEMENTATION ARRANGEMENT

(a) Services, facilities, and property to be made available to the Consultant by the Nghe
An PMU:
22. The Nghe An Biig2 PMU will provide the consultant free of charge with access to all
available data, information and internal documents relevant to the consulting services. All
reference material will be loaned to the consultant and shall be returned at the completion of
the assignment or earlier, as may be required. The consultant will undertake to keep secure all
documents transferred by PMU.
(b) Professional and support counterpart personnel to be assigned by the Nghe An PMU
to the Consultant’s team:
23. Access to the key officials of the Province, District, City, Ward and Commune
authorities and mass organizations concerned with subjects related to the assignment (if
necessary) will be arranged by the PMU.
24. The PMU will provide the consultants with counterpart organization (Counterpart
office) with sufficient capable staff to work with the consultants in Nghe An, to facilitate
contacts and relations with relevant people, district, city, and commune authorities and
other organizations.
J. Nghe An PMU will provide the following inputs, project data and reports to
facilitate preparation of the Proposals:
+ the Loan Agreement,
+ the Project Agreements,
+ the Project Administration Manual,
+ the Environmental Management Plan and
+ related studies, the Pre-feasibility and Feasibility Studies for the project and subprojects.
