The 257th meeting of the State Level Expert Appraisal Committee (SEAC) was held on 22nd September 2015 at Committee Room, Gujarat Pollution Control Board, Gandhinagar. Following members attended the meeting:

All 36 proposals of minor minerals which have been received by the Committee through the Office of the Commissioner, Geology and Mining, Gandhinagar were taken up in the meeting. Considering the scale of individual project, all the proposals were categorized as B2 and appraised individually based on the information furnished in the Form-1 and performa endorsed by the district Geologist / Asst. Geologists.

BLACK TRAP MINING PROJECTS – DISTRICT GIR-SOMNATH

Shri Ravi K Mistry,Geological Assistant, District Junagadh represented that all the above proposals involve open cast mechanized mining involving drilling, blasting, sizing of mineral, etc. Top soil will be stacked separately for green belt development whereas overburden will be removed, stacked and refilled in mined out pits. None of the proposal involves intersection of ground water table. No wastewater generation is envisaged from mining activities. Domestic wastewater will be disposed off through septic tank – soak pit. Arrangement will be done to prevent contamination of surface runoff. Proposed air pollution control measures include use of only controlled blasting, water sprinkling on haul roads, tree plantation in periphery and road sides, etc. It is proposed to convert mined out pits into water reservoirs. After deliberations on various aspects, considering the proposed mitigation measures by the lease holders, the committee unanimously decided to recommend the proposal at Sr. No: 7 for grant of environmental clearance to SEIAA with stipulation of standard conditions for Non sand mining as approved in 232nd SEAC meeting held on 15th April 2015.

Shri Ravi K Mistry,Geological Assistant mentioned that proposals at Sr No: 1 to 6 are located between 5 Km to 10 Km distance from the Gir Sanctuary and therefore committee decided to ask geological assistant to submit copy of application submitted for Wildlife Clearance/ Clearance from standing committee of National Board for wildlife. Upon submission of the details, it was decided to take up the aforesaid proposals for further decision in one of the upcoming SEAC meeting.

` Shri Ravi K Mistry,Geological Assistant, District Junagadh mentioned that none of the proposal include blasting and mineral will be removed only with help of cutter machine. It was also noticed that none of the projects involve intersection of ground water table. It was presented that arrangement of water sprinkling will be done during cutting for control of fugitive emission. During presentation, Shri Ravi mistry informed that proposals at Sr NO: 9,10,14 and 21 are located at 8 Km, 8 Km, 6 Km and 9 Km respectively from the Gir sanctuary and rest of the proposals are located 10 Km away from the Gir Sanctuary. . During meeting, considering the proposed mitigation measures and distance from the Gir Sanctuary, the committee unanimously decided to recommend the above proposals ( Except prpoposals at Sr NO: 9,10,14 and 21) for grant of environmental clearance to SEIAA with stipulation of standard conditions for Non sand mining as approved in 232nd SEAC meeting held on 15th April 2015. For the proposals at Sr NO:9,10,14 and 21,Committee decided to ask Geological Assistant to submit copy of application submitted for Wildlife Clearance/ Clearance from standing committee of National Board for wildlife for the said proposals.Upon submission of the details, it was decided to take up the proposals at Sr No: 9,10,14 and 21 for further decision in one of the upcoming SEAC meeting. BUILDING LIME STONE MINING PROJECTS – DISTRICT JUNAGADH

Shri K.N.Mahavadia, Assistant Geologist, District Junagadh mentioned that the above proposal does not include blasting and mineral will be removed only with help of cutter machine. It was also noticed that none of the projects involve intersection of ground water table. Shri D.B. SAND MINING PROJECTS – DISTRICT SURENDRANAGAR

Shri M.R.Vala, Assistant Geologist, District Surendranagar represented that above lease is located on river beds of Bhogavo and sand excavation will be done only from dry river bed. Bhogavo river is a seasonal river. He also informed that instream (flowing water) type of mining is not practiced in the above lease area. It was also represented that no any bridge piers / water intake wells / irrigation structures exist within 500 m distance from boundary of any of above lease area.He explained that sand excavation will be done up to maximum 3 m depth or water level, whichever is less. The committee observed that the lease holder has proposed to leave adequate setback distance from the river bank so as to avoid chances of river bank erosion. After discussion and detailed scrutiny of the proposal, considering the mitigation measures proposed by the lease holder, the committee unanimously decided to recommend the above proposal for grant of environmental clearance to SEIAA with stipulation of standard conditions for sand mining as approved in 232nd SEAC meeting held on 15th April 2015. SAND MINING PROJECTS,DISTRICT: VADODARA

Shri P.J.Bhavsar, Geologist, District Vadodara represented that above leases are located in private land and are near Narmada river.He informed that instream (flowing water) type of mining is not practiced in the above lease areas. It was also represented that no any bridge piers / water intake wells / irrigation structures exist within 500 m distance from boundary of any of above lease areas. He explained that sand excavation will be done up to maximum 3 m depth or water level, whichever is less and CRZ Notification 2011 is not applicable to the above proposals. After detailed deliberation, considering the proposed mitigation measures proposed by the lease holders, the committee unanimously decided to recommend the above

During SEAC meeting on 16/4/2015, proposals Sr NO: 1 TO 8, on 13.05.2015 proposals at Sr NO 9 to 12 and on 16-06-2015 proposal at Sr NO: 13 were scheduled for hearing and committee asked the asst geologist to submit details of distance of proposals from High Tide Line. Subsequently on 21/07/2015 Geologist,Dist: Porbandar submitted reply showing distance of High Tide Line from the proposed lease.Shri T.J.Patel, Geologist,Dist: Porbandar rechecked distance of the High Tide Line and stoodby the submission of information mentioning distance of HIgh Tide Line from the proposed leases as mentioned above.Considerng the reply and reaffirmation of the geologist , during SEAC meeting on 22/09/2015, committee observed that none of the proposal are located at the distance less than 500 meter from high tide line and henceforth unanimously decided to recommend the above proposals for grant of environmental clearance to SEIAA with stipulation of standard conditions for Non Sand mining as approved in 232nd SEAC meeting held on 15th April 2015. During SEAC meeting held on 23/06/2015,Shri A.D.Shah, Mine Supeviser,District Chotaudepur represented that above proposals are located on river bed of Orsang and Bharaj rivers and sand excavation will be done only from dry river bed. He informed that Orsang and Bharaj are seasonal rivers.It was also represented that no any bridge piers / water intake wells / irrigation structures exist within 500 m distance from boundary of any of above lease areas. He explained that sand excavation will be done up to maximum 3 m depth or water level, whichever is less. The committee observed that the lease holders have proposed to leave adequate setback distance from the river bank so as to avoid chances of river bank erosion. After detailed deliberation, committee asked Asst.Geologist, Dist: Chota UDepur to submit (1) Resolution of Gram Sabha for having no objection of sand mining activites in Orsang river. (2) Written Confirmation of location of the above proposals existing in dry river bed or under water.(3) Setback distance to be kept from the bank of river to prevent erosion. On 22/09/2015, Geologist, Dist:ChotaUDepur submitted the details mentioning all the above proposals are in dry river bed, and setback distance of 30m to 40 m will be maintained from the river bank. He also submitted resolution passed by Gramsabha having no objection if sand mining is done from river Bharaj and Orsang. During meeting, considering the submission of reply, Committee unanimously decided to recommend the above proposals for grant of environmental clearance to SEIAA with stipulation of standard conditions for Non Sand mining as approved in 232nd SEAC meeting held on 15th April 2015. Shri B.M. Jhalodhara, Asst Geologist, Dist: Junagadh presented the above proposal before the committee on 16/06/2015 and after presentation, committee asked district geologist to submit the nearest distance from outer periphery of the above lease from human habitation. On 20/08/2015, Geologist submitted the aforesaid details through letter dated 13/08/2015 for the above proposal. After going through details, Committee unanimously decided to recommend the above proposal for grant of environmental clearance to SEIAA with stipulation of standard conditions of Non Sand Mining as approved in 232nd SEAC meeting held on 15th April 2015.

Shri K.M. Patel, Geologist, Dist: Sabarkantha represented the aforesaid proposals in the SEAC meeting held on 13.05.2015. After presentation committee asked Geologist to submit details of approved mining plan for all the above proposals and also submit details of measures to be taken after post closure of mining along with work to be done under corporate social responsibility.

On 20.07.2015, Geologist, Dist: Sabarkantha submitted reply for the proposals mentioned above (Except proposal at Sr.No: 7). After deliberation and referring submission, Committee unanimously decided to recommend the above proposals ( Except proposal at sr. No:7) for grant of environmental clearance to SEIAA with stipulation of standard conditions of Non Sand Mining as approved in 232nd SEAC meeting held on 15th April 2015.For the proposal at Sr NO: 7, it was decided by the committee to delist from pending EC application list of SEAC.

APPRAISAL CASES 1.0 Yogita Allied & Caline Products,(Bauxite Mining Project,37.7675 Ha) Vill: Gaga,Ta: Kalyanpur, Dist: Jamnagar

Project / Activity No.: 1(a)

M/s: Yogita Allied & Caline Products,(herein after Project Proponent – PP) has submitted their for obtaining Environmental Clerance to MoEF, New Delhi for production of 75000 MTPA of Bauxite ore for captive use in their proposed calcinations plant near Jamnagar/Porbandar.

Terms of reference (TOR) from MOEF issued to PP vide letter NO: J-11015/114/2009-IA.II (M) dated June 8,2009.

Covering baseline data for the summer 2009, draft EIA report was prepared.

Public Hearing was conducted on 21.12.2010.

Consent to establish from GPCB was obtained by PP on 22/10/2010

Letter from conservator of Forests, Marine National Park was issued to PP vide letter NO: K/Land/24/T-7/30 dated 17/05/2008.

Final EIA submitted by PP on January 2011.

Proposal was appraised by EAC during meeting held on 25-27th May 2011 and additional information was sought.

On 19/06/2015, the proposal was transferred by MoEF&CC to MS, GPCB for further action stating that as per the amendment in EIA Notification on 25.06.2014, this project becomes under category B as proposed project is located at 6 Km distance from Gaga Sanctuary and 7 Km from the Marine national park.

Status of the Project:: For Renewal of Mining lease.

Project details:

Mining lease of Bauxite is existing over an area of 37.7675 Ha in non forest government waste land in village:gaga, Ta: Kalyanpur, Dis: Jamnagar which was granted on 7.8.1978.Production of 75000 MTPA of bauxite is proposed through open cast mining.Lease is expired on 15.01.2000 and PP has applied for renewal.Gaga sanctuary is located at 6 km and Marine National park is located at 7 Km away from the proposed lease.Mining plan is approved by IBM vide their letter No: 682 (23) (574)/2007/MCCM (N) VDA dated 15.4.2008.Manual mining will be followed for extraction of mineral. No drilling and blasting will be carried out for mining. Depth of mining will be 5 meter ( 2 benches of 2 meter and 3 meter respectively).Simultaneous backfilling of available waste will be carried out. There will be no intersection of water table. Entire Mining Lease area is non forest government waste land and no additional land is required. No rehabilitation, water drainage or other surface features in the mine lease area is envisaged. State highway is 6 Km, railway station is 6.5 Km, Air port is 70 Km away from the mine lease. There is no archeological monuments within 10 Km radius. There is no reserved forest/protected forest within 10 km radius of the ML.The proposed ML falls under Seismic zone IV.Stratigraphic Litho Units shows depth of soil 0.5m,clay 2.5 m and bauxite 4 to 5 m.Bottom layer is of siliceous bauxite/lithomarge. Geological reserves is 1.73 Million tones and recoverable is 1.53 Million tones.Water table is 20 meter below ground level. Water requirement is 14 KLPD and source is bore well. PP submits that as water consumption is 14 KLPD, they are exempted for obtaining NOC from CGWA.Man power requirement is 55 nos.baseline data considered is during Summer 2009.Five ambient air stations are used. Ambient air quality levels during study period for PM10, SO2 and NOx were observed to be well within NAAQ standards. Well Water quality for core zone area and Gaga village found to be meeting with IS:10500 however well water quality for Nandana found to have high TDS, hardness, Chlorides and Nitrates content that prescribed limit. Noise levels of day equivalent, night equivalent and day & night equivalent values were in ranges from 41.7 to 48.5 dB(A), from 37.6 to 42.4 dB(A) and from 40.7 to 47.0 dB(A) respectively and are within EPRules 1986. Soil samples are found to be normal in pH value, and containing organic matter medium in nature. Air Pollution Mitigation measures proposed by PP are (1)Water sprinkling to reduce dust emission (2) Maintenance of transport roads, vehicles (3)Avoiding overloading of vehicles (4)Covering trucks during transport outside the lease (5) Green belt development in the area. Water pollution mitigation measures are(1)Maintaining proper drainage of water on bench floors with drains (2) Construction of garland drain (3)Adoption of rain water harvesting measures (4)Domestic waste water is collected in soak pit with soak pit arrangements. During post mining period, land use pattern is (a)Overburden/ dumps : 0.9727 Ha (b)Roads: 0.6705 Ha (c)Green belt/Plantation: 1.9125 Ha (d)Back filled area: 15.6416 Ha(e)other undisturbed area: 18.5702 Ha.Top soil will be used for spreading over backfilled area and during life of mine about 75000 M3 overburden will be generated and will be simultaneously backfilled. There will not be external dump at the end of mine life. There will be direct employment of 55 persons ( mostly local) and indirect employment of 100 persons (mostly locals).Issues raised during public hearing were considered and discussed during meeting.The above proposal is a case of violation as during meeting of REAC held on May 25-27, 2011, it was observed by the committee that mine continues to operate after it fell due for renewal. It was also observed that production from the mine increased during 2006-2007. Criminal case No 83/2015 in the court of Judicial Magistrate, Kalyanpur is filed against accused by GPCB, Jamnagar.During appraisal of the project on 25-27 May 2011, REAC mentioned that a map duly authenticated by chief wildlife warden showing the location of National park,Sanctuary, Biosphere reserves, wildlife corridor,if any within 10 km of the mine lease. The exact distances may also be marked on the map. Necessary clearance,if any, as may be applicable for such projects due to their location in proximity of the ecologically sensitive areas ( national park, Sanctuary) should also be obtained from the competent authority and a copy should be furnished.It was decided by the REAC that proposal may be brought back before the Committee for making its recommendations on the project after requisite information is submitted.Then after on 19/06/2015, the proposal was transferred by MoEF&CC to MS, GPCB for further action stating that as per the amendment in EIA Notification on 25.06.2014, this project becomes under category B as proposed project is located at 6 Km distance from Gaga Sanctuary and 7 Km

from the Marine national park for further action.

Observation and Discussion:

During presentation on 22-09-2015, committee noticed that PP has submitted a map duly authenticated by Chief Conservator of Forest,Marine Natinal Park showing distance of proposed lease from marine sanctuary as 11000 meter, two locations of Gaga Sanctuary at 7375 meter and 6500 meter respectively.

After scrutiny and deliberation of reply submitted by the PP and considering the above project details, Committee unanimously decided to recommend for grant of Environmental Clearance to SEIAA including following specific conditions.

1. Project proponent shall comply all the measures suggested in final EIA report including anticipated environmental impacts and mitigation measures in a letter and spirit.

2. Project proponent shall comply all the measures, conditions suggested in the approved mining plan in a letter and spirit.

3. Project proponent shall comply all the conditions mentioned in "The Companies (Corporate Social Responsibility Policy) Rules, 2014 and its amendments from time to time vide notification of Ministry of Corporate Affairs dated 27th February, 2014 in a letter and spirit.

Project / Activity No.: 2(b) M/s: Ashapura Perfloclay Limited (herein after Project Proponent – PP) had

submitted their application to MoEF, New Delhi for this expansion project.

The proposal is for enhancement of production of bleaching clay (Mineral

beneficiation plant) from 0.072 million TPA to 0.12 million TPA. The throughput will

be 0.13 million TPA.

TOR issued by MoEF in the 13th meeting of the Reconstituted Expert Appraisal

Committee held on 12th November 2013.

MoEF&CC has transferred this case vide F.no. J-11015/91/2012-IA-II(M) dated

13/02/2015 considering category B project as per amendment to EIA Notification,

2006 vide SO 1599 (E) dated 25.06.2014. As per the said amendment of EIA

Notification 2006, Mineral beneficiation {Category 2(b)} project having production <

0.5 MTPA throughput is category ‘B’ project.

Project proponent had requested to MoEF for amendment in ToR which was

considered by MoEF in the 19th EAC meeting held during 29-30 January, 2014 and

committee recommended for the amendment in ToRs for the Bleaching clay

production from 0.072 million TPA to 0.144 million TPA and Bentonite throughput

from 0.094 million TPA to 0.156 million TPA.

Public hearing was carried out by Gujarat Pollution Control Board on 16/12/2014.

EIA Report prepared by Enkay Enviro Services Pvt. Ltd., Jaipur was submitted on

10/03/2015.

The study period considered for EIA was December 2013 & January-February 2014

Air quality monitoring was carried out at eight stations. During the study period

concentrations of PM2.5, PM10, SO2, NOx and CO were well within prescribed limit

at all locations. Seven ground water and four surface water samples from study area

were collected and analyzed. The analytical results of parameters of ground water

analysis like chloride, calcium, magnesium, alkalinity and fluoride have exceeded the

standards as per the desirable limit but within permissible limits in the absence of

alternate source. The result of surface water quality analysis indicates that the

surface water quality results are well within the limits. The soil analysis result shows

that the soils are Clay in texture and neutral in nature. The nutrient and organic

matter contents are medium and the soil is normally fertile. Estimation of emissions

from the plant has been made by Industrial Source Complex (ISC3) model developed

by USEPA. As per dispersion modeling studies, the resultant ground level

concentrations of PM10, PM 2.5, NOx and SO2 at various locations are well within

the prescribed NAAQS. During the meeting, issues raised in the public hearing /

consultation were discussed in detail. On asking by the committee, PP informed that

they have provided adequate height of stack for control of SO2 from Rotary dryer.

Committee suggested to provide CEMS (Continuous Emission Monitoring system) for

flue gas stacks. During the meeting after detailed discussion it was decided to further

appraise the project only after submission of the following:

(1) Detailed mass balance and water balance (including reuse-recycle, if any) along

with qualitative and quantitative analysis of the each waste stream to be generated

from the process.

(2) Characteristics of untreated and treated wastewater. A detailed effluent treat

ability study vis-à-vis the adequacy and efficacy of the treatment facilities proposed

for the wastewater to be generated along with adequacy and efficacy report. The

characteristic on which treatability is based shall also be stated.

(3) Treated effluent management plan during monsoon season when utilization of

treated effluent for gardening & plantation purpose is not feasible. How it will be

ensured that treated effluent/sewage won't flow outside the premises linked with

storm water during high rainy days. Detail on provision and capacity of a tank for

storage of treated effluent during high rainy days when treated effluent disposal by

irrigation is not feasible. Percolation rate of the land available for gardening &

plantation.

(4) Specific details of (i) Details of the utilities required (ii) Type and quantity of fuel to

be used for each utility (iii) Flue gas emission rate, emission from each utility (iv) Air

Pollution Control Measures proposed to each of the utility along with its adequacy.

Give complete line diagram of APCM. (v) List the sources of fugitive emission along

with its quantification and proposed measures to control it.

(5) Details regarding provision of CEMS to be provided for flue gas stacks.

(6) Compliance of ToR no. 38 i.e. Public hearing points raised and commitment of the

project proponent on the same along with time bound action plan.

(7) Compliance of ToR no. 41. i.e. Compliance report by the Regional Office of MoEF

of earlier EC accorded. (8) Certificate of accreditation issued by the NABET, QCI to

the environmental consultant for category 2(b) of EIA Notification 2006.

PP has submitted point wise reply of above mentioned details vide their letter dated

29/07/2015.

The project falls under Category B of project activity 2(b) as per the schedule of EIA

Notification 2006.

Plot area is approx. 149733.45 sq.m. Existing green belt area Is 36947.74 sq. m.

Unit has proposed additional 9145.88 sq. m land for green belt development. Total

green belt area after proposed expansion will be 46093.62 sq. m. Estimated cost of

proposed expansion is Rs. 60 Crores. Fresh water requirement after proposed

expansion will be increased from 650 KL/day to 838 KL/day (8 KL Domestic and 830

KL Industrial) which will be supplied by the GWIL (Gujarat Water Infrastructure Ltd.)

Wastewater generation after the expansion will be 688 KL/day (682 KL/day industrial

+ 6 KL/day domestic). Industrial effluent (683 KL from processing & reactor washing

and 5 KL from utilities) after expansion will be treated in existing ETP comprises of

primary treatment followed by Reverse Osmosis (RO) system. Treated effluent from

RO plant (330 KL/day permeate) will be reused in the process and used for

gardening. RO reject water (220 KL/day) will be discharged to the Evaporation Pond

for its solar Evaporation.

Unit has proposed one steam boiler (4 TPH) in addition to existing 3 no.s of steam

boilers. Furnace oil is used in existing steam boilers. Consumption of FO in exiting

boilers is 0.321 KL/hr. Unit has proposed to use Coal as a fuel for 4 TPH steam

Boiler to the tune of 16 MT/day and Multi Cyclone separator followed by Bag filter as

APCM. Unit has also proposed two Dryers in addition to existing 5 Dryers. At present

36 MT/day of Coal is used as fuel for Dryers & HAG. Unit has proposed to use Coal

to the tune of 24 MT/day for proposed Dryers. Total Coal consumption after

proposed expansion will be 76 MT/day. Hazardous waste to be generated after

expansion will be ETP waste 220 Kg/Annum, Evaporation residue 1 MT/Annum,

Spent Acid 5500 MT/Month, Used oil 100 Liter/Annum and Tar waste 8.5

MT/Annum. ETP waste and evaporation residue will be disposed to the TSDF. Used

oil will be reused within plant or sold only to the registered recyclers. Spent acid will

be sent to IFFCO unit for use as a raw material for SSP manufacturing. Tar waste

will be sent to cement manufacturing company M/s: Sanghi Cement for co-

processing of the waste. Gypsum (4500 MT/Month) will be generated as by product

and it will be sold to cement/brick industry.

Observations/Discussions: During the meeting, while discussing about the Sulphuric acid consumption and

generation of Spent Sulphuric acid, PP could not reply satisfactorily regarding the

source of raw material and management of spent acid. Details of Fugitive emissions

from storage and handling of Sulphuric acid & Spent sulphuric acid is not addressed

properly. On asking about CEMS, PP informed that they have worked out the CEMS

for proposed stack of coal fired steam boiler. On asking about accreditation of the

consultant, representative of environmental consultant M/s: J.M.Environet Pvt. Ltd.

has informed that they are QCI/NABET accredited consultant for category 2(b) and

they have evaluated the EIA report prepared by M/s: Enkay Enviro Services Pvt. Ltd.

(EESPL). Committee noted that EESPL is not accredited by QCI/NABET for

category 2(b) and there are no documents between EESPL and J.M.Environet Pvt.

Ltd. regarding validation of EIA report. At this, Committee asked to submit authentic

documents from the concern authority regarding validation of EIA/EMP report in such

cases. Committee also discussed regarding spent acid generation and management,

status of EC compliance report by MoEF&CC, Bhopal, CSR activities, Solar

evaporation system, utilization of treated effluent for green belt etc. While reviewing

the point wise reply, Committee noted that most of the points are not addressed

properly and after detailed deliberations the Committee sought complete reply of all

the details asked during previous SEAC meeting dated 27.05.2015 in addition to

following additional information for further consideration of the proposal:

1. An undertaking by the Project Proponent on the ownership of the EIA report as per the MoEF&CC OM dated 05/10/2011 and an undertaking by the Consultant regarding the prescribed TORs have been complied with and the data submitted is factually correct as per the MoEF&CC OM dated 04/08/2009.

2. Clarification/Justification from project proponent regarding non-compliance/partial compliance and additional remarks issued by Regional Office, MoEF&CC, Bhopal in the status report of compliance to conditions of Environmental clearance.

3. Give complete waste water management during Rainy days & Non-rainy days. Detailed study report considering Percolation rate of the land available for gardening & plantation. Ensure that land is suitable for plantation & gardening. Details of drip irrigation system for use of treated waste water. Give complete details regarding Solar evaporation system including Evaporation rate.

4. Authentic documents from the concern authority regarding validation of EIA/EMP report prepared by consultant who are not accredited by QCI/NABET.

5. Details of vehicles engaged in transportation of Hazardous waste including spent Sulfuric acid.

6. Point wise compliance of Guidelines for Gasifiers.

Proposal was considered in the 5th REAC meeting(Non-Coal) held during March 13th-15th, 2013. Terms of reference (TOR) from MOEF issued to PP vide letter NO: J-11015/21/2013-IA.II (M) dated April,2013.

Covering baseline data for the months October-2013 to December 2013, EIA report was prepared.

Public Hearing was conducted on 05.05.2015.

Letter from Chief Wildlife Warden,Gujarat State, Gandhinagar addressed to The Director,Ministry of Environment and Forest, Government of India and copy issued to PP vide letter NO: WLP/32/A/545-47/2009-10 dated 24.08.2009 is annexed in EIA report as annexure VIII.

During REAC meeting held on June 24-26,2015, considering amendment in EIA Notification on 25.06.2014, Committee noted that the project is a Category 'B' and decided to transfer it to SEIAA, Gujarat and therefore project proponent has submitted final EIA report on May 12,2015 to MS, SEIAA,Gujarat.

Status of the Project:: Expansion from 40,000 TPA to 2,00,000 TPA of limestone Mining.

Project details:

• Dharampur Limestone mining lease, measuring 40.47 hectares (ha.), is a captive mine and is in survey no. 2/9 part, of Dharampur village in Ranavav Taluka of Porbandar district, Gujarat.

• The Mining lease was granted for 20 years w.e.f. 24.12.1959 thereafter renewed for a period of 20 years w.e.f. 24.12.1979.

• The lessee had applied for its 2nd renewal on 07.12.1998, which was under consideration of state government. Meanwhile, as per Mines & Minerals Development & Regulation Amendment Act 2015, the mining lease period is deemed to have been extended up to 31st March, 2030.

• Company is having manufacturing facilities for Soda Ash at Porbandar. The entire limestone production from the mine is proposed to be utilized for the manufacture of Soda Ash.

• Mine has already accorded Environmental Clearance (EC) dated 30.09.2009 for 40,000 TPA limestone capacity from MoEF. Now company has applied for proposed expansion in existing mine from 40,000 TPA to 2,00,000 TPA of limestone.

• The Mine is an existing mine and Highest production achieved before 1993 is 179634 Tonnes / Annum (1965).

As per authenticated map & NOC, Mine is located at a distance of 6.55 km from BWS and falling outside the eco sensitive zone of BWS.

• Mine Plan/mining scheme has been approved by the Indian Bureau of Mines, Udaipur vide letter dated: 19.11.2012.

• Undersize Limestone Selling Permission - Permission to sale undersize limestone stacked at the mine area has been given by the Government of Gujarat vide letter dated 23.09.2014.

• Clearance from the Standing Committee of the National Board of Wildlife (NBWL) has been recommended in the 32nd meeting of NBWL held on 21.01.2015 at New Delhi.

• GPCB had conducted Public Hearing on 05.05.2015 for Dharampur-Kajawadri Limestone Mine and Minutes of Meeting was sent to MoEF&CC, New Delhi for grant of EC.

• GPCB has granted CTE vide CTE No. 72050 dated: 30.07.2015 for 2,00,000 TPA for five years period.

• GPCB has granted CCA vide order no. AWH-69028, dated: 19.03.2015 for 40,000 TPA.

During presentation, it was mentioned by PP that EC had been granted earlier for the proposed mine for production capacity of 40,000 TPA of limestone. Mine had been operational since 1959. Year-wise production details since 1959 indicate highest production of 1,79,634 TPA of limestone in the year 1965.The highest production achieved after 1994 notification was 17,959 TPA in the year 1999-2000 which is less than the production achieved in 1965 and within the sanctioned limit given in EC. Dharampur-Kajawadri Limestone Mine Lease was granted to Saurashtra Chemicals, Porbandar, in the year 1959 over an area of 40.47ha, for mining of limestone near village-Dharampur, Taluka-Ranavav, District-Porbandar, State-Gujarat. Company has well laid down Policy approved by Board of directors for Safety, Health & Environment and Social accountability. Company has well established Environmental Management System which is headed by Executive Director. A well qualified and efficient environment staff has been deputed for maintenance and monitoring of pollution control system. Mining will be carried out by manual opencast method with drilling and blasting as per scheme of mining approved by Indian Bureau of Mines.Subsidence is not envisaged because there is no overburden or loose strata overlying the deposit. Limestone occurs right from surface. The average bench height will be 3m. Bench width will be 6-20m. The sides of the benches will have slopes at a safe angle of 45°to the horizontal. Bench slope will be maintained 10°from vertical to provide proper slope stability in limestone benches. The sides of excavation shall be adequately benched, sloped and secured so as to prevent danger from fall of sides as per regulation 106 of The Metalliferous Mine Regulations 1961.All safety standards/ safeguard measures will be implemented as per Guidelines prescribed by Director General of Mines Safety. The study area comprises of 10 km zone around the proposed lease periphery. Proposed mining operations will not generate any waste material as there is no overburden or waste rock in the lease area.

As per Approved Scheme of Mining including Progressive Mine Closure Plan, there is practically no overburden above chemical grade limestone. The mine lease land which will be used for limestone mining purpose is Government waste land and does not include any forest land in it. There is no forest land involved and hence no such clearance from forest department is required.  Mine Lease area is existing limestone mine lease granted by State Government. No habitation exists within core zone. As per the Socio-economic survey and census data, no scheduled tribes and other Traditional Forest Dwellers have been identified. Impact on the biological environment has been given in EIA report. Mitigation measures have been proposed in Environment Management Plan and are listed below (a) Plantation/

grass plot development to improve vegetation cover and biodiversity(b) Creation of mining pits for rain water harvesting(c) Water spray system to control fugitive dust emissions(d)Machinery/ vehicle preventive maintenance & regular checkups(e)Controlled blasting methods (f) Maintenance of road conditions(g)Covering of all loaded vehicles, visual display of sufficient traffic signs(h) About 100 locally suitable plants are proposed to be planted in next five years for green belt (i) Cost of green belt development is proposed to be Rs. 2 Lac. Barda Wildlife Sanctuary is located at a distance of 6.55km in NE direction from the mine site and standing Committee of the National Board of Wildlife (NBWL) has recommended WL Clearance in its 32nd meeting held on 21st January, 2015 at New Delhi. it is mentioned by PP that Saurashtra chemicals is proposing to spend a sum of Rs. 14,95,000 (in consultation with local forest authorities) on wild life conservation in Barda Sanctuary in consultation with Sanctuary authority in next five years in addition to Environment Management expenses in core zone area. The existing surface profile will be replaced by a depressed surface (pit) with benches of 3m depth. These pits will be utilized for rainwater harvesting. Apart from the change in landuse pattern within the lease area, there will not be any adverse impact on the landuse of the surrounding area. As per the Socio-Economic Survey, no R&R Plan is envisaged; as there is no displacement of people from their respective areas. Ground water clearance has been approved by Central Ground Water Authority vide letter no. 21-4(732)/WCR/CGWA/2010-2590 dated 24.11.2010. Groundwater withdrawal shall not exceed the proposed quantity of 94.025m3/day (28207m3/year). The total estimated area of pits will be 36.52 Hectare with ultimate depth of 8.5 meters. The shallow pits will cater rain water storage of 31,04,200 KL of water at site for green belt development and dust suppression. At the end of life of mine, excavated area will be used as a rain water pit. There will be no impact on ground water quality as mining will not intersect the groundwater table. No seasonal or permanent stream is passing through the mine lease area. The runoff from the mine follows the natural slope. 100 locally suitable plants are proposed to be planted every year in 0.10 ha for next 5 years for green belt development. Total of 3.30 ha of land will be utilized for green belt by the end of life of mine. Transportation of sized Limestone is proposed by trucks/dumpers. Existing road network will be sufficient and able to handle the increased load. Nearest highway is NH-8B with current vehicle plying capacity of 40trucks/hr. The predicted increase in traffic is 20 trucks/day or 2-3 truck/hr (max), which is expected to have an insignificant impact on the existing capacity of roadways. Facilities like Mine Office; Rest Shelter; Blasting shelter; Drinking water facilities; Workshop & Stores; First-aid station; Conservancy facilities, Sanitation facilityshall be provided for the mine workers. CSR activities like English medium school affiliated to CBSE in which students of surrounding area are getting benefit of education., Medical facility to surrounding area by way of providing ambulance and also having medical center with medical and paramedical staff round the clock, extending support during natural calamities, constructing 48 toilets in Dharampur village are performed. Issues raised during public hearing were also

considered and discussed during the meeting.During presentation it was mentioned by PP that No litigation is pending against the project and CRZ Notificationis not applicable to the project. Mining operations will generate rainwater storage pits at the end of mining. The total estimated area of pits will be 36.52 Hectare with ultimate depth of 8.5 meters (amsl). The shallow pits will cater water storage of 31,04,200 KL of water at site for green belt development and dust suppression. Project proponent mentioned the EC conditions compliance during presentation before the committee.

OBSERVATION/DISCUSSION

During meeting, after presentation committee observed that project proponent could not address process of handling explosives brought for blasting to carry out mining activities including their security during receipt, storage, handling and transpiration and asked project proponent to submit point wise details of the conditions mentioned in license issued by director of explosives. It was also observed that ambient air quality in upwind direction was not represented and committee asked PP to submit details.

Based on presentation made and discussion held, Committee sought information on the following.

1. Detailed point wise compliance report of the conditions mentioned in the License issued to the project proponent by Chief Controller of Explosive vide letter No: E/HQ/GJ/22/38(E445) dated 03/06/2014 including details of safeguards to be undertaken during receipt, unloading, storage, transfer for its use ,handling and all the precaution measures to be taken for its security and intended use.

2. Justification regarding not carrying out of baseline study of Ambient Air Quality in upwind direction and compliance of the respective TOR issued by MoEF&CC in a letter and spirit.

3. An undertaking by the project proponent on the ownership of the EIA report as per the MoEF&CC OM dated 05/10/2011 and an undertaking by the Consultant regarding the prescribed TORs have been complied with and data submitted is factually correct as per the MoEF&CC OM dated 04/08/2009.

It was decided that proposal may be brought back before the committee for further consideration of the project after the requisite information as mentioned above is submitted.

The mine lease area is 02.99.47 Ha and proposed rate of mining is 11,340 TPA. Project proponent applied for EC on 03-01-2014. The proposal was scheduled for hearing on 03-12-2014 and 27-05-2015 and additional information was sought from the project proponent. Subsequently project proponent submitted additional information on 19-08-2015. Project proponent called for appraisal in the SEAC meeting scheduled on 22-09-2015.

Project proponent has submitted permission letter of industries, Mines & power department vide letter no. MCR 1580 (8-145) 9616-CHH.

Project proponent has submitted land use plan of mine lease area incorporating preoperational, operational and post operational phases.

Project proponent has submitted approved mining plan including progressive mine closure plan. As per the mine closure plant, it is mentioned that mining will go with drilling and blasting method. During mining plan period, no additional land will be degraded and 3975 Sq. Meter area will be backfilled. The waste generated during mining plan period will be backfilled in mined out area. The rest part of the degraded land will be used as water reservoir and also 60 number of sampling are planned, the spacing of plant is considered as 2m × 2m. The fencing around the plantation and working pit will be carried out during every year during three years mining plan. There is no permanent surface water body. The water table in the area is 12 m below the ground level as per the mining plan the working depth is 4.5 m. Water table will not be encountered during mining. Mining plan also include the environmental management plan which includes base line information, topography, existing land use pattern, water regime, flora & fauna, quality of air and ambient noise level and water, climatic condition, human settlement, environmental impact and its mitigation measures and programme for plantation.

As there is absence of any nala/river, mining process will not affect the natural drainage in the nearby area.

It is mentioned that upper layer of the mine not so hard, mining will go by hammer and excavation machine also proponent has submitted the affidavit for notarized undertaking stating that no blasting shall be carried out for entire period of mining.

For control of fugitive emission, water tanker with suitable sprinkling system will be deployed along haul roads. The vehicles used for transportation will be covered with tarpaulin and development of green belt /plantation around roads, lease area will be made.

Drinking, plantation and sprinkling water will be brought by firms own tankers. Water consumption will be 02 KLPD. The water conservation carried out by reuse of domestic water for suppression of dust and for development of

greenbelt. Project proponent has proposed periodic medical examination of workers,

temporary rest shelter for worker constructed at mine site and water tank for drinking purposes.

Project proponent has set out CSR activities which includes construction of water tank in water scarcity villages near around the lease area, arrangement of ambulance, supporting education to the underprivileged children.

Project proponent has submitted environmental management plan with likely impacts of the project activities, mitigation measures of impact and recurring cost/annum embarked for environment pollution control measures. Detailed existing green belt development plan and future green belt development plan including type of species no. of trees budgetary provision are given.

The company has not any litigation pending in court also the company has not any well laid down environment policy, not any administrative system in the company to deal with environmental issue and not any system for reporting of violence of environment.

Observations/Discussions:

Considering the above project details, committee in the 257th meeting on 22/09/2015 unanimously decide to recommend for grant of environmental clearance to SEIAA.

1. Project proponent shall comply all the measures, conditions suggested in the approved mining plan and environment management plan (EMP) in a letter and spirit.

2. Project proponent shall comply all the conditions mentioned in “The Companies (Corporate Social Responsibility Policy) Rules, 2014 and its amendments from time to time vide notification of ministry of corporate affairs dated 27th February, 2014 in a letter and spirit.

Considering the above project details, committee in the 257th meeting on 22/09/2015 unanimously decide to recommend for grant of environmental clearance to SEIAA.

1. Project proponent shall comply all the measures, conditions suggested in the approved mining plan and environment management plan in a letter and spirit.

2. Project proponent shall comply all the conditions mentioned in “The Companies (Corporate Social Responsibility Policy) Rules, 2014 and its amendments from time to time vide notification of ministry of corporate affairs dated 27th February, 2014 in a letter and spirit.

After presentation, Committee noted that proposed lease area is near to the wild ass sanctuary and exact aerial distance of the lease area from the wild life sanctuary is not given by the project proponent and therefore committee asked the Project proponent to submit a map duly authenticated by concerned authority showing location of national park, Sanctuary, Biosphere reserves, wildlife corridor if any within 10 km of the entre lease. As per Form 1,Proposed rate of mining is 250 MTPA.The proposal falls in project / activity no. 1(a) of the Schedule of the EIA Notification, 2006 and as the lease area is less than 50 Hectares, it falls under category B.

The technical presentation of the project included introduction & background of the company, Google image of project site with 1 Km radius and 5 Km radius, land use pattern, resource consumption, details of method of working, Air pollution control measures, Noise control measures, Water management, impacts on socio- Economic environment, development of green belt, occupational health and safety. It was mentioned that mining will be conducted through open cast method, blasting will be restricted to day time and negative impacts if any will be minimized by proper implementation of EMP

After detailed deliberation, considering the scale of project, it was categorized as B2 and following additional information was sought for appraisal of the project.
