Adjudication: “Innocent Until Proven Guilty”
Adjudication is a procedure for resolving disputes about resorting to lengthy and expensive court procedures.
The Process: Step 1: Notice of Adjudication- written
notice to dispute. Nature of dispute; details of dispute nature of remedy and names and addresses.
Step 2: Appoint a adjudicator- must be within 7 days. If a decision is not reached may do Adjudicator Nominating Body (ANB).
The Process: Step 3: Referral Notice- must be served
within 7 days of the Notice of Adjudification. Document setting out detail in case.
Step 4: Decision- adjudicator reaches his decision within 28 days of service. Time can be extended 14 days. If party who has referred agrees (both parties may agree).
The Significance of a Trial The right to a fair trial is a fundamental
safeguard to ensure that individuals are protected from unlawful or arbitrary deprivation of their human rights and freedoms, most importantly of the right to liberty and security of person.
