Casual Relief Position Are you looking to be part of an innovative and dynamic team? The Shire of Cocos (Keeling) Islands is looking for dedicated and customer-focused individuals for the casual relief position of Library Service Officer on Home Island and West Island. This position has a particular emphasis on customer service and will include:

• Desk duties and assisting customers with self-serve technology

• Connecting customers with library and community resources and services

• Maintain collections using established procedures and systems Assist with other library activities and promotion

Applicants must have relevant customer service experience, although a library qualification is not required. They will have a good general knowledge with an interest in reading and current affairs. Applications are to be submitted to the below undersigned before COB Wednesday 12th December 2019. COMMUNITY FUNDING PROGRAM: Applications for the latest round of the community funding program closed on the 4th November. The Community Funding Program Committee met on the 18th November to assess the applications. Grants have been award to West Island Playgroup, Home Island Jukong and Sailing Club and West Island Sport and Recreation. The Community Funding Pro-gram is advertised twice per year so keep your eye out for the next round. PROGRAM DUIT BANTUAN MASYARAKAT: Applikasi untuk program duit bantuan masyarakat telah ditutup pada hari 4hb November. Committee progam duit bantuan masyarakat telah bertemu pada hari 14hb Novemeber untuk menimbangkan semua applikasi yang diterimah. Duit bantuan telah diberikan kepada West Island Playgroup, Home Island Jukong and Sailing Club dan West Island Sport and Recreation. Program Duit Bantuan Masyarakat di keluarkan dua kali setahun jadi tunggukanlah berikutnya yang kedua. DSR VISIT: The Department of Local Government, Sport and Cultural Industries, the Shire and Cocos Islands District High School

partner together to plan and organise several sports develop-ment opportunities each year. Last week children from both islands benefited from a number of different sessions from two athletics coaches who delivered programs directly through the school and also as after school activities. It was fantastic to see these activities so well attended. The team are current planning for the next visit and it is hoped to get a skateboard instructor who will be able to give the kids some tips and tricks on how to get the most out of the new pumptrack which will soon be installed. KUNJUNGAN DSR: Department of Local Government, Sport and Cultural Industries, Konsel dan Cocos Islands District High School telah berkerja sama untuk merancangkan dan mengadakan perkembangan untuk sport setiap tahun. Minggu lalu anak anak dari Home Island dan West Island telah mendapatkan peluang yang sanggat banyak dari dau pelatih atletik yang telah mengadahkan program melalui masa sekolah dan jugak setelah sekolah habis. M A J U P U L U K I T A MASTERPLAN - Sandy Point Functional Art: The Community Art project at Sandy Point has now been completed. The talented Steve Bose and Lisa Moser have transformed two Jukongs into beautiful functional seats at Sandy Point. They have been positioned under natural shade close to the waters edge for locals and visitors to relax in while taking in the spectacular views over the Lagoon. A big thankyou also goes to Nek Neng and his team in helping to move these beautiful art pieces into position. MAJU PULU KITA MASTERPLAN - Art Sandy Point: Community Art project telah selesai. Steve Boase dan Lisa Moser yang sangat pandai telah mengubah dua jukong untuk menjadi kursi yang sanggat indah di Sandy Point. M A J U P U L U K I T A MASTERPLAN - Shade Sails Home Island: Work has commenced on the installation of the Shade Sails over the play ground on Home Island. The posts will be erected first so that exact measurements for the sails can be obtained and the sails cut specifically. MAJU PULU KITA MASTERPLAN - Layar Lindungan Playground Home Island: Pekerjaan untuk memasang layar lindungan di playground Home Island telah mulai. Tiang untuk layar lindungan akan di pasang terlebih dulu supaya pekerja boleh mengukur layar lindungannya dan potong sesuai ukuran . MAJU PULU KITA MASTER-PLAN – Trannies Beach: The make over of Trannies beach continues with the installation of a new carpark area now complete. This area is clearly designated at the end of Heartbreak Drive on the southern side with a gabion boundary. This should help elevate the dust issue that occurs through prolonged dry spells around the new deck area and the shelters. Some play equipment for the area has just been delivered to Zentners and is hoped to arrive on Cocos on the January ship. MAJU PULU KITA MASTERPLAN - Pantai Belakang Batu Karang: Pembagusan pantai di Belakang Batu Karang di lanjutkan dengan kawasan baru untuk kereta parking yang sudah selesai. Kawasan ini di design di ujung Heartbreak Drive di sebelah selatan dengan galangan gabion. Ini akan membantu untuk mengurangkan abok di masa depan yang biasa belaku dimusim kering disekitar dek dan tempat berlindung. Ada juga berberapa peralatan playground untuk kawasan ini yang baru saja di antar ke Zentner yang kami harap akan sampai di Pulu Kokos di kapal Januari. S A N D B A G M A I N T E -NANCE: The Shire has been engaged by the Department of Infrastructure, Regional Development and Cities to perform preventative remedia-tion works on the seawall along William Keeling Cres-cent followed by the seawall at the southern end of the runway. We appreciate the communities support and understanding while these important works are being undertaken. We received our first load of the compacted cardboard bales from West Island early this week. What would nor-mally have been waste will now be used to assist getting the incinera-tor up to operating temperate, greatly reducing the amount of die-sel required. Well done and keep up the great work. Indian Ocean Territories Marine Debris Project

Cocos (Keeling) Islands From 14–21 June 2019, the Indian Ocean Territories Marine Debris Project (IOTMDP) undertook debris col-lections and audits on the Cocos (Keeling) Islands (CKI). Off-island volunteers were joined by community members and businesses who went to work collecting and auditing marine debris at Rumah Baru, Twiss Me-morial, Pasir Nek Ayak and Elephants Graveyard. The IOTMDP is a citizen science venture coordinated by the Western Australian Department of Water and Environmental Regulation (DWER), with support from the Keep Australia Beautiful Council WA, Tangaroa Blue Foundation and the Shires of Cocos (Keeling) Islands and Christmas Island, to gather critical data from marine debris washing up on the Shires’ shores. DWER is fully funded by the Australian Government’s De-partment of Infrastructure, Transport, Cities and Regional Development to provide services in the IOT. Cocos (Keeling) Island – Marine debris collection and analysis In 2019, members of the Cocos community joined 12 self-funded volunteers and project team leaders to col-lect and analyse debris from beaches, before entering the data into the Australian Marine Debris Initiative Da-tabase. Assistance was provided by volunteers from the local community, tourists, Indian Ocean Territories Group Training Association (IOGTA), Parks Australia, Cocos Islands District High School Sailfish students and the Shire of Cocos (Keeling) Islands.

Special thanks goes to the CKI Shire for disposing of the rubbish collected and providing heavy machinery to remove larger pieces of rope from Pasir Nek Ayak on Home Island. DWER Program Manager, IOT Tim Francis, said it was great to see such strong support from the local com-munity. “The support the project received from the local community was well received,” he said. “During our first day at Rumah Baru, 16 local community members and tourists assisted our team, while on Home Island 14 volunteers assisted, including IOGTA jobseekers and staff from Parks Australia.”

The table below provides details of the data collected and highlights specific items removed from the Islands’ beaches.

Other items found included radio trackers from weather balloons and a number of slippers from hotel chains located in Indonesia.

All data collected is entered into the Australian Marine Debris Initiative Database. The data from the first three years of the IOTMDP will be used to develop a comprehensive picture of where items are coming from, as well as to drive government policy and action on the issue of marine debris. CKI Shire CEO Andrea Selvey said that, going forward, the Shire would take responsibility and ownership of the project so it could continue to increase input and support and become one of the Islands’ primary commu-nity engagement programs. “The IOTMDP is consistent with our 2030 strategic plan and it is important for the Shire to be part of the solu-tion for marine debris,” she said. “We look forward to working with the community on this as a key CKI Shire annual environmental project.” Mr Francis said the change would fully embed the program into the local community as a true citizen science project.

“The project will remain fully supported by DWER with funding from the Australian Government through the Department of Infrastructure, Transport, Cities and Regional Development,” he said. “In recognition of this change, the name of the project will become ‘Cocos (Keeling) Islands Marine Debris Project’, reflecting the transfer of ownership to the Shire and local community.”

The Cocos (Keeling) Islands Marine Debris Project is an ongoing project, owned and managed by the Shire

of Cocos (Keeling) Island. The Shire looks forward to working with the community in 2020 and beyond.

KONGSI CONNECT

Kongsi Connect is a project of the Coopera-tive which seeks to inform the community as to what is happening in the Coopera-tive’s world.

BREAKING NEWS 1. Cocos (Keeling) Islands Runway Project The latest news is that it may be Late November 2019 before the De-partment of Defence announce the successful tender for the Cocos Runway Project. 2. Christmas Island When significant events happen on Christmas Island there is a flown on effect to the Cocos (Keeling) Islands. Normally the impacts include shipping and airline services. Below is a significant development that relates to the CIP phosphate mine on Christmas Island, one of the larger employers and contributor to the Christmas Island economy. The CIP mine will have a full shutdown from mid-Dec to mid-March. This is the longest one since the mine reopened in 1987. Approxi-mately 20 redundancies will take place virtually immediately. CIP is feeling the impacts of phosphate from Morocco into its tradition-al Malaysian markets. CIP also has significant palm oil investments in Malaysia which also use phosphates from Christmas Island. The mar-ket for palm oil has been impacted by a number of factors, which in-clude issues between Malaysia and India governments (a large im-porter of palm oil from Malaysia); competition from African countries, and indirectly the swine flu issue in China. Significant issues like this will certainly have flow on effects to the Cocos (Keeling) Islands. 3. Contracts Awarded CareyMc has awarded the Cooperative a contract for sand blasting of the CKIDHS West Island Campus external shelter area and old toilets removal. Department of Infrastructure, Transport, Cities and Regional Australia extended the Cooperative’s ferry contract for another two years from November 1, 2019 with an increase in fees. 4. Indian Ocean Group Training Association (IOGTA) The General Manager of the Cooperative has been elected to be the Deputy Chair of the IOGTA. IOGTA provides a range of comprehen-sive services on Christmas Island and the Cocos (Keeling) islands.

Logistics News 1.HMAS Pirie

On Monday, October 28, 2019, the Cooperative conducted bunkering operations, with Viva Energy Australia, at the Cocos (Keeling) Islands for HMAS Pirie. This is an area of expertise that the Cooperative has developed to support Armidale class patrol boats. The Armidale class patrol boats are on border protection duties. 2. RAAF Exercises January/February 2020 will see a RAAF exercise on the Cocos (Keeling) Islands that will see 48 RAAF personnel taking part and a 10 Squadron AP3C and 37 Squadron C130J being involved. As stated in a previous issue of Kongsi Connect the last time the RAAF AP3C operated from the Cocos (Keeling) Islands was November 2018.

The Cooperative will be providing a full range of accommodation, catering and logistical services for the RAAF during this exercise. The Cooperative provided a range of logistical and hospitality services for a recent RAAF Falcon on a training exercise that operated to and from the Cocos (Keeling) Islands. 34 Squadron provides VIP transport for Australian Government ministers and senior Defence officers.

KONGSI CONNECT Kongsi Connect adalah projek Kongsi yang bertujuan untuk memberi keterangan kepada masyarakat tentang apa yang sedang berlaku di dunia Kongsi.

BERITA BARU 1. Projek Runway Cocos (Keeling) Islands Berita terbaru adalah bahwa mungkin akhir November 2019 Department of Defence akan mengumumkan tender yang sukses untuk Projek Runway Cocos. 2. Christmas Island Ketika ada peristiwa penting terjadi di Christmas Island akan ada efek jugak kepada Pulu Kokos. Biasanya ini menglibatkan layanan penghantaran dan pernerbangan. Di bawah adalah perkembangan signifikan yang terkait dengan CIP phosphate Mine di Christmas Island, salah satu organisasi dan kontributor terbesar untuk Christmas Island ekonomi. Indiaon Ocean Group Training Association (IOGTA) Manager Kongsi telah di anggkat sebagi Deputy Chair kepada IOGTA. IOGTA menyediakan berbagai layanan komprehensif di Pulu Christmas dan Pulu Kokos.

Berita Logistics 1.HMAS Pirie

Pada hari Senin 28hb Oktober kongsi telah adakah operasi bunkering, dengan Viva Energy Australia di Kepulauan Cocos (Keeling) untuk HMAS Pirie. Ini adalah area di mana kongsi telah berkembang untuk mendukung kapal patrol kelas Armidale. Kapal patrol kelas Armidale di tugaskan boarder protection. 2. Latihan RAAF Januari / Februari 2020 akan melihat latihan RAAF di Pulu Kokos yang akan melibatkan 48 personel RAAF dan 10 Skuadron AP3C dan 37 Skadron C130J terlibat. Sebagaimana dinyatakan dalam edisi sebelumnya dari Kongsi Connect, kali terakhir RAAF AP3C beroperasi dari Kepulauan Cocos (Keeling) adalah November 2018.

Kongsi akan menyediakan akomodasi, katering dan layanan logistik untuk RAAF selama latihan ini.

The above indicates the expertise that the Cooperative has developed in hospitality , retailing, administration, WHS and logistical services to support the Department of Defence. The Cooperative provided Hospi-tality support for Air Services Australia aircraft VH- FIX on its recent visit to the Cocos (Keeling) Islands. Toll Freighter November 1, 2019 saw another heavy lift for the Cocos (Keeling) Islands. 4824 kilos were air freighted in, including 2.6 tonnes for ABFC Ocean Shield. MV Borkum MV Borkum arrived at Cocos (Keeling) Islands on November 6, 2019 with one of the heaviest container loads for a long time. 32 containers plus breakbulk were delivered and 24 containers back loaded. By contrast Christmas Island had 40 containers on the ship. The unloading of the ship was completed in approximately 1 ½ days.

VISITORS Brad Ness who lost his leg in an incident while working on the Rott-nest ferry visited the Cocos (Keeling) Islands and gave a speech on WHS.

As a member of the Australia men's national wheelchair basketball team, Ness competed at the 2000 Sydney, 2004 Athens, 2008 Beijing, and 2012 London Paralympic Games, winning a gold medal in 2008 and silver medals in 2004 and 2012. He captained the team at the 2008 and 2012 Paralympics. In 2016, he was selected for his fifth games. The criminal offence of receiving stolen property

These are short articles about legal issues that may interest you. They are not legal advice. You should always get individual legal advice for your situation. What is the criminal offence of receiving? The criminal offence of “receiving” as it is commonly called, is made up of 3 elements, or parts: • You must receive (get) the property • The property must have been stolen or obtained by way of another indictable offence (which means a serious offence that

may or must be dealt with in the District Court, rather than one that can only be dealt with in the Magistrates Court - egs of indictable offences are fraud, robbery)

• You must know it has been obtained by way of stealing or another indictable offence. An example of receiving might be where you see a neighbour with a backpack, he tells you he has stolen it, and gives it to you as a present, or you buy it from him. You have committed the offence of receiving. Receiving also includes where you have had the property (obtained by stealing or another indictable offence) in your possession but no longer do so, or where you have helped hide it, or helped get rid of it. Receiving has always generally been regarded by the Courts as being a more serious offence than stealing because it is said to encourage the offence of stealing, although it can depend on the circumstances. Penalties These penalties apply to property other than motor vehicles. Particular penalties apply in relation to receiving motor vehicles. Where the property: • Has a value greater than $50,000 OR • Was obtained by means of an offence that can only be dealt with by the District Court (called an “indictable-only” offence)

the maximum penalty is 14 years imprisonment, or the penalty prescribed for the offence by which the property was initial-ly obtained.

Where the property: • Has a value equal to or less than $50,000 AND • Was obtained by way of an offence that can be dealt with either by the District Court or by the Magistrates Court

(commonly called an “either way” offence) the maximum penalty is 2 years imprisonment and a fine of $24,000. Where the property: • has a value equal to or less than $1,000 • the maximum penalty is a fine of $6,000. • If you are charged with receiving, you can be convicted instead of the alternative offences of fraud, stealing or being in

possession of stolen or unlawfully obtained property. Receiving a motor vehicle – penalties It is important to note that the offence of receiving a motor vehicle can always be dealt with by either the Magistrates or District Court (so it is always an “either way” offence). It does not matter if the value of the motor vehicle is greater than $50,000 or was obtained by means of an offence that can only be dealt with by the District Court (an “indictable-only” offence). This is different to the situation for receiving other property.

If the offence is dealt with by the Magistrates Court (summarily) the maximum penalty is 2 years imprisonment and a fine of $24,000. If however the offence is dealt with by the District Court (“on indictment”) the maximum penalty is 14 years imprisonment. But where the motor vehicle: • has a value equal to or less than $1,000 • the maximum penalty is a fine of $6,000. In possession of stolen or unlawfully obtained property There is another offence similar to receiving, which is being in possession of property reasonably suspected of being stolen or obtained unlawfully. An example might be where you hear through friends that a neighbour has just had his blue Macpac backpack stolen from out-side the local shop. Two days later another friend, who also lives close by, gives you a blue second hand Macpac backpack for no reason and refuses to tell you where he got it from when you ask. You might reasonably suspect that it has been stolen from the neighbour. It is a defence if you can prove on the balance of probabilities (which means just greater than 50%) that you had no reasonable grounds for suspecting that the item had been stolen or otherwise unlawfully obtained. This offence can be dealt with by either the Magistrates or District Court (an “either way” offence). If you are dealt with summarily (by the Magistrates Court) the maximum penalty is 2 years imprisonment and a fine of $24,000. If you are dealt with “on indictment” (by the District Court) the maximum penalty is 7 years imprisonment, except in certain speci-fied cases. These include where the item is a will or an aircraft, for example (10 years maximum imprisonment). There are other specified cases. WA law requires that only licensed motor vehicle repair businesses who employ qualified and registered staff can work on your vehicle. Stiff penalties – as high as $50,000+ can be given to individuals and/or businesses who are found to be doing unauthorised motor vehicle repair work without a valid licence. On CKI an authorised repairer will have their business name and motor vehicle repair business licence on display plus they are likely to display their licensed re-pairer yellow ‘tick’ (pictured). Drugs—some fact

Australia is a drug using society. We drink alcohol or take prescription and pharmaceutical drugs for all sorts of reasons. Cigarettes are smoked by about 22 per cent of the Perth’s population. To a lesser extent, we also use drugs such as ma r i j ua na ,

amphetamines and heroin.

Facts about drugs

• Many people don’t know the fact about

drugs, such as:

• In Australia, there are far more health problems and drug related deaths from the legal drugs alcohol and tobacco than there are from

illegal drugs.

• Most people who use drugs are ordinary

people.

• The number of young p e o p l e w h o experiment with legal and illegal drugs d r a m a t i c a l l y increases between the school years 7 to

11.

• Drug use is often a health problem and drug users need our h e l p a n d

understanding.

• Very few people under 18 experiment

with heroin.

• Less than two per cent of people over 14 years have ever

tried heroin.
