The Cartagena Protocol on Biosafety to the Convention on Biological Diversity is an

international agreement which aims to ensure the safe handling, transport and use ofliving modified organisms resulting from modern biotechnology that may have adverseeffects on biological diversity, taking also into account risks to human health. It wasadopted on 29 Jan 2000 and entered into force on 11 Sep 2003. The first extraordinarymeeting of the Conference of the Parties was opened on 22 Feb 1999, in Cartagena,Colombia.

BIOSAFETY LAW

Art. 1 – This Law establishes safety norms and control mechanisms for construction, cultivation, production, manipulation, transportation, transfer, importation, exportation, storage, research, trading, consumption, liberation into the consumption, liberation into the environment and discards of genetically modified organisms – GMO and their by-products, having as landmarks the stimulus to scientific progress in the areas of biosafety and biotechnology, the protection of life and the human, animal and vegetal health, observing the precautionary principle for environmental protection.

Convention on Biological Diversity Rio de Janeiro 14/06/1992 – RIO 92

Principle 15

In order to protect the environment, the precautionary approach shall be widely applied by States, according to their capabilities.

When there are threats of serious or irreversible damage, lack of full scientific certainty shall not be used as a reason lack of full scientific certainty shall not be used as a reason for postponing cost-effective measures to prevent environmental degradation.

In other words, the Principle states that in the absence of formal scientific certainty, the existence of a serious or irreversible threat requires measures to avoid harm. Thus, the Precautionary Principle requires assurances for absolute absence of potential risks thatcannot be yet identified according to the actual state of the art.

Technical ReportsTechnical Reports• Risk assessment is made case by case: emission of

technical reports on genetically modified products isalways based on scientific knowledge.

• The definitive technical report of CTNBio contains a

summary of the technical foundations stating explicitly the safety measures and the restrictions to the GMO the safety measures and the restrictions to the GMO and by-products usage, considering the peculiarities of the different country regions, in order to assist and subsidize the inspection agencies.

• After emission of a favorable technical report for

commercial use the petition may be analyzed by a higher council of Ministers (National Council on Biosafety) to appreciate the convenience of commercial liberation on social, political and economic grounds.
