SIR—Ref rring to your communication of the i ith instant, in which you a.k to be informed whether Ellis Island is in the State of New York or New Jersey, you are informed that Ellis Island in the State of New York. In 1833 the State of New York and New Jersey appointed Boundary Commissioners. In 18J4 the Commissioners came to an agreement ant made a report, which was subsequently ratified by each State and confirmed by Congre.;s. See United States Statutes at large, Thirty-third Congress, Session t, 1334. Article first defines a line which, when laid down, would place Ellis Island in the State of New Jersey, but article second reads as follows : '' the State of New York shall retain its present jurisdiction of and over Bedlow's and Ellis Islands, and shall also retain exclusive jurisdiction of and over the other island lying in the waters above mentioned and now under the jurisdiction of that State." This article second is construed as modifying the buunclary line between the two States in question, and placing Ellis Island for all purposes whatsoever in the State of New York.
