    Constitution vs. Statute

    Constitution is a legislationdirect from the people

    Statute is a legislationfrom the peoplesrepresentatives.

    - Merely states the general

    framework of the law andthe government.

    - Provides the details of

    the subject of which ittreats.

    - Is intended not to meetexisting conditions but to

    govern the future.

    - Intendedprimarily tomeet existing conditions.

    Nature of the Constitution

    -charter (formal written statement) creating thegovernment.

    It is binding on all individual citizens and all organs ofthe government.

    It is the law to which all other laws must conform.

    In accordance with it all private rights must bedetermined and all public authority administered.

    The test of the legality of all government actions

    The purpose is to prescribe the permanent framework ofthe system of governmentTo assign to the different departments or branches ofgovernment their respective powers and duties.

    Written Constitution

    -is one which is formally enacted in one written

    instrument or in several written documents.

    Unwritten Constitution

    - one which has not been reduced to a singlewritten document.* a classic example is the British Constitution, which

    is made up of: customs and traditions, parliamentarystatutes, treaties, royal grants, including the MagnaCarta and Bill of Rights, and judicial decisions andcommentaries (Zaide)
