1 MINISTRY OF LAW AND JUSTICE (Legislative Department) New Delhi, the 12 th August, 1996/Shravana 21, 1918 (Saka) The following Act of Parliament received the assent of the President on the 10 th August, 1996, and is hereby published for general information :- THE DEPOSITORIES ACT, 1996 No. 22 of 1996 [10 th August, 1996] An Act to provide for regulation of depositories in securities and for matters connected therewith or incidental thereto. BE it enacted by Parliament in th e Forty-seventh Year of the Republic of India as f ollows : CHAPTER I PRELIMINARY 1. (1) Th is Ac t may be ca ll ed th e De po si to ri es Ac t, 19 96 . Short Title (2) It exten ds to the whole of India. Extent and (3) It shall be deemed to hav e co me into for ce o n th e 20 th day of September, 1995. Commencement Definitions. 2. (1) In th is Act, un less the contex t ot he rwis e requ ir es - (a) “beneficial owner” means a person whose name is recorded as such with a depository; 15 of 1992 (b) “Board” means the Securities and Exchange Board of India established under section 3 of the Securities and Exchange Board of India Act, 1992; (c) “bye-laws” means bye-laws made by a depository under section 26; 1 of 1956 (d) “Company Law Board” means the Board of Company Law Administration constituted under section 10E of the Companies Act, 1956; 1 of 1956 15 of 1992 (e) “depository” means a company formed and registered under the Companies Act, 1956 and which has been granted a certificate of registration under sun-section (1A) of section 12 of the Securities and Exchange Board of India Act, 1992; (f)  “Issuer” means any person making an issue of securities; (g) “participant” means a person registered as such under sub-section (1A) of section 12 of the Securities and Exchange Board of India Act, 1992; 15 of 1992
