II mmCharge Against Peacock
Dismissed Because
Of Error
TIUL OF 01 HERS
AHRbSIED IS POSTPONED
HEADS OF FIRMS BROUGHT INTOCOURT ON WARRANTS 18.
8UEO AGAINST COR-PORATIONS
An error in the manner of makingout and serving tho warrant againstW. C. Peacock & Co., charging thatfirm with selling adulterated liquor re-
sulted In tho dismissal of tho chargoagainst the head of tho firm, W. C.l'eacock. In l'ollco Court tills morning.Attorneys llreckons and Ashford rep-
resented the defense In tho casesagainst Peacock, Che Hut llln andSing l.oy.
When Clio Hut Kin's case was called Ashford Immediately moved thattho defendant bo discharged from cus-tody on the. ground thcro was no wnr-ran- t
against him. Tho warrant onwhich ho was arrested was sworn outagainst tho Wing Chung Lun Co., andthe attorneys for-th- o defense claimedthat thojirrval-pron- e of-th-e supposedmembers "ofliio firm was Illegal."There Is no charge against this man,"said Ashford, and he Is not hero hyduo process of law. We demand thathe bo released,
Andrado opposed the motion on thoground that Clio Hut llln was not yetcharged before tho court. Judge Whit-ney continued tliu case until tonior-low- .
In tho casa against W. C. Peacockthe 'same arguments Nvero advanced, but with better success for the de-
fense. Dreckons argued that Peacockwas Illegally arrested since tho war-
rant was directed against tho corpora-tion ol which I'encock was supposedto be tho president. "There Is a waylu which tho corporation may bebrought Into court on such a charge,"he tald, "but a slnglu member of thefirm cannot be tried for an offuusucommitted by the firm."
Andrado did not strongly oppose thomotion for dismissal lu this case, liav.ing apparently come to the conclusionthat nothing could be gained by tryingthe case In Its present form. It isprobablo that new warrants, not opento the same objections, will be issued,
Harry Juen and Joo Clark did nothave the same excuse, of being only
In a Arm, and will piob-all- y
have to stand trial, Itoth askedfor a continuance In order to obtaincounsel, and their cases were continued. Clark a case was set for Decern- -
Ler 18 and Juon's tor tho 12th.Sing Loy, charged with tho sumo of-
fense, was also represented hy Dreck-
ons and Ashford, who entered a picaof not guilty and demanded immediatetrial, Andrado objected on the groundthat the prosecution was not ready,am) Judge Whitney set tho case furDecember 11.

The criminal calendar Is nowIn better shape than It hns been forseveral jcars. due lo hard work by theAltorncy General's department, nndthere ure very few-- old rases left to becompleted before the next report of thoGrand Jury.
In the case of I) Waiilnc, chargedwllh robbery lu the second degree, theprosecution entered a nollo prosequi, Ithaving turned out from the evidencegathered that both men, tho allegedrobber nnd his victim, were under theInfluence of liquor and tho ease beingtherefor so confused "that u convictionwus unlikely. '
A case against a Chinaman namedAh Cheong, who was Indicted by the(Irancl Jury fur larceny In the first dogree wns also nolled. The convlcllohof Ah Chong if obtained would havebeen on practically tho unsupportedtestimony of a confederate of his. When the Indictment was obtained Itwas thought that more evidence couldbe obtained.
After numerous motions to quashmid demurrers which were nil over-mle- d

111Work Of Distribution
practically Over
Yesterday
The wbrk of distributing tho Portuguese immigrants has been practically concluded, and ban been effectedwith considerably less difficulty thanwns nntltlpated. A large proportionof them wanted to go to plantationson this Island, but those In charge ofthe matter succeeded In dividing themup pretty fairly. The Helene yesterday took n large number nt the newsettlers to Maul and Hawaii planta-tions, and a special (rain carried thosewho were apportioned lo the Oaliuplantations.
For Oaliu the following distributionhas been made:
Kwn 39 men.Walpahu 40 men.Walalua 39 men.Kahuku 3S men.Immigrants have been sent to the
other Islands as follows:Maul Hawaiian Commercial: 18
families, consisting of 19 men, 19 wo-
men, 31 children, and 39 single men.Walluku: S families, consisting of S
men, C women, 2 children, and 8 singlemen. Pala: 7 families, consisting of7 men, 7 women, C children, and 'isingle men.

LIQUOR CASES UP
(Continued from Page 1)unccs, came up for trial on the chargeof living off the earnings of Adella, one of the women of Iwilel. Morchgot himself Into trouble by thrashingAdella. His blows turned her truelove into bitterness, and she bad himarrested for living off her earnings.
Morch seemed lo have an Idea thatho had engaged, Judge clear to defendhim, but Q car's clerk stated that theJudgo had nothing to do with the case.
Morch admitted that he had beenliving with the woman for the pastnine months, but only for tho purposeof reforming her and turning her fromher evil ways, which pained hint deeply. He Indignantly dented that he liv-
ed on money earned by Adella. Hewas a working man, he said, and Informed the Court that he had workedsix days on the Manchuria and severaldays during the past nine months ontho coal wharves. Ho knew tbe kindof business lu which Adella was en-
gaged, but had never aided or abettedII.
Although Morch Is probably one ofthe parasites who Infest Iwilel. thocase against him was so weak thathad he had on attorney, It Is Im-
probable that he would have been heldan tho charge. As It was, Judgo Whitney held him over to the Orand Jury.
Mrs. Wahlue Laxarus charges herhusband Alexander with havingthrcuteued to kill her, and she askedllin Court tci put him under boudB tokeep tho peace. The case was set fortrial tomorrow. Alexander will spendDie day under the earn of Jack Molan-ph-
tu insure against his tarrying outhis alleged threat In tho meantime.
I.ucclvago Is an old East Indian whomakes a precarious living by pickingup ragB and bottles. He must havedono well recently, for he managed loaccumulate enough to get drunk on.Ills thin old legs were weak and wobbly as ho stood before Judge Whitneythis morning charged with drunken-ness. Andrade stated that It wasdoubtful If the old man could raiseenough to pay a fine, and as this was
his first appearance, ho moved that senbe suspended for 13 months,
Tho Judge, so ordered, and Lucelvago
tottered out with u grateful "thankyou"

THE SHERIFF COUNT
There Is n cry undecided nnd haryIdcn of the exncl Hindis nf the 8hcrlff
j contest case In tho Supremo Court.I Tho Chief Justice nindp nn explanationlast week, to Attorney Kinney Hint didnot explain. Ah n rule the people nreunder tho linprcasloc that this Is merely n preliminary tci to enable, the
mind to deteimliic whether, ornot. Mr Drown Is entitled to n re-count. If so then n commission willbe nppolnted to innko n legal count ofthe ballots. Others hold that this Istho final count, nnd that Mr. Drownor .Mr. Inukea will be In or out ns thopresent count mny .decide, or Hint thetwo mny have exactly the same nunvber of voles nnd a. new election bonecessary.
As the present count will probablybe finished ttxlny, It Is to be hopedHint the exact status of the case willthen ho made clear to the ordlnnry laymind. If the court will Rvo n rulingas to tho marking of a bnllot. will do- -
line n legnlly marked ballot thntshould bo (minted, nnd n ballot that
I should not bo counted, then the con- -
lest will he worth more than tho lime, troiimo and money that hawi beenspent upon It. Otherwise II will bopractically useless. There aro htmdreds of people In tho community thatdo not agree with the Judicial deci-sions ns to good anil had ballots, nndwho argue Hint somo ballots have beenwrongly counted by Hie bench, whileothers hnve been wrongly thrown out
If ft were known that the SupremoIleneh were unanimous In regnrd toIts disposition, of each and every ballot, then there would bo n more set-tled confidence In the result. Follow-ing this, n ruling from tho court withnn exnrt definition of n legal ballotwould be of benefit to Inspeclois aswell ns to tho voters. Without thisthe tendency will be to argue that theprrsent count means nothing nnd Isworth nothing, nnd thnt tho count ofthe Inspectors of the election Is prob-nbl-
the more reliable because the In-
spectors hnvo had n. previous oxpcil-enc- e

THE AMERICAN ACCENT
London. Nov. 4. The London papershave been poking fun at what they can"the American accent" of visitors fromho United States. Americans In Ixm- -

Frequentlytho Cockney accent Is so confusing thaian Interpreter Is necessary to make itIntelligible.
The Rev. O. Motl Williams. Ulshorof Marquette, Mich., retorts against thecomplaints of the American "accent'that even the1 cultured clergymen olEngland speaV 'tho language In a mat'ucr difficult to' understand.
Dlshop Williams cays:"Of course, there Is nn American ac-
