The Government of the Republic of the Union of Myanmar, the Ministry of Trade and Commerce

hereby releases this notification according to the authority given by the Export of Goods and Import of

Goods Law section 13 sub-section (b).

Allowing foreign joint venture companies to import and sell (trade) agricultural machines

1. With regard to the implementation of the industrial farming system in the country’s

agricultural sector, foreign joint venture companies are, from the date of the issuance of this

notification, allowed to import and sell (trade) agricultural machines listed in the attached HS

Code in order to enable the purchase of agricultural machines at a fair price and to increase the

productivity of agricultural products.

1. [sic] Therefore, foreign joint venture companies shall comply with the following terms and

conditions when trading agricultural machines.

(a) The foreign joint venture company must be able to engage in trading business.

[Translator’s note: Means that it has to be registered as a “trading” company with

DICA.]

(b) We will allow according to the equity ratio that was allowed when the foreign joint

venture company was registered. [Translator’s note: A bit cryptic, but it probably

means that the Ministry of Commerce accepts any foreign/local ownership ratio as

shown in “form 6” submitted to DICA at the time of company incorporation, i.e. that the

Ministry of Commerce sets no minimum local ownership.]

(c) The foreign joint venture company is allowed to engage in retail and wholesale

business of agricultural machines.

(d) Form 6/26 issued by the Directorate of Investment and Company Administration and a

bank statement have to be submitted when applying for the registration certificate as

exporter/importer.

3. The foreign joint venture companies shall import the agricultural machines for sale in

compliance with the laws, rules, regulations, orders and directives issued by the relevant

department.

4. With regard to the engagement in trading business of agricultural machines, the foreign joint

venture companies shall be allowed and permitted according to the same procedures that

apply to local companies.

5. The list of goods permitted to be traded by foreign joint venture companies may be amended

from time to time as required.
