dated 09-12-1997 read with Government Order No. 597-GAD of 1999 dated26-05-1999 and Government Order No. 681-GAD of 2000 dated 14-06-2000shall be substituted respectively with following text :—

2. Character and antecedents verification by the appointingauthority.– The appointing authority shall issue conditionalappointment orders to the selected candidates after receipt of anAttestation Form as per Annexure-I accompanied by anundertaking prescribed in Annexure-IV on a sworn affidavit,clearly mentioning therein that the salary of the selectedcandidates shall be drawn/disbursed only after receipt ofsatisfactory character and antecedents verification report. In caseof receipt of an adverse report and on confirmation thereof bythe State/Division/District Level Screening Committee, as thecase may be, the appointment shall automatically stand cancelledwithout any notice.

3(c). A person convicted by the competent court of an offence involvingmoral turpitude, heinous offences like murder, rape, dacoity,robbery and offences under NDPS Act shall be regarded not fitfor Government Service.

It is further ordered that :—

(i) The Annexure-I to Government Order No. 1918-GAD of 1997dated 09-12-1997 shall be substituted by Annexure-I to this order.

(ii) A sworn affidavit as per Annexure-IV be obtained from theselected candidates alongwith attestation form in Annexure-I.

SRO-331.––Whereas, on 13-09-2010, during the maintenance of lawand order situation in Khanabal area, some youth including Maroof AhmadNath @ Raju while fleeing jumped into River Jehlum and the said MaroofAhmad Nath drowned in the river. The body of said person was recoveredon 18-09-2010 and was carried in the shape of a procession towardsKhanabal, then to KP Road and finally towards Delhi Darbar. stone pelting and the mob turned violent, resultantly, few shots were,reportedly, fired in air to control the mob, due to which some persons gotinjured and the procession returned towards Khanabal via Nai Basti. Outof the injured, two persons Bilal Ahmad Najar and another personNoor-ul-Amin Dagga succumbed to their injuries ; and

Whereas, with regard to the aforementioned firing incident nearDelhi Darbar, case FIR No. 355/2010 was registered in Police Station,Anantnag ; and

Whereas, subsequently father of one of the aforementioned deceasedperson approached the Hon’ble Court for registration of a separate case,with the plea that the deceased persons were injured in the firing incidentnear Ahali Hadees Masjid, Khanabal and not near Delhi Darbar ; and

Whereas, in this connection, a separate case FIR No. 361/2012, undersection 302 RPC was registered at Police Station, Anantnag, after judicialintervention with the further direction to constitute a Special InvestigationTeam, and as such investigating was initiated ; and

Whereas, during the course of investigation, conducted by SpecialInvestigation Team constituted in the matter, statement of witnesses wasrecorded and as many as 27 independent witnesses namely Dy. SP,Noor-ul-Hassan Parray as accused in the said case, highlighting his role inthe said incident that had taken place near Ahali Hadees Masjid, Khanabaland the details regarding the deployment of nafree, that was obtained fromconcerned agencies by the Investigating Officer, also corroborated the factof posting of the accused in the said area on the date of incident ; and

Whereas, during the course of investigation, on the basis of thestatements of witnesses, the seizure memos and other evidence,the Investigating Officer has established, prima facie, a case undersection 304-II of RPC against the accused ; and

Whereas, the appointing authority of Noor-ul-Hassan Parray(Dy. SP) is the Government in the Home Department and the offence hasbeen committed by the accused person while acting or purporting to act indischarge of his official duties and to prosecute him, sanction undersection 197 (1) J&K, Cr. P. C. is mandatory.

Act, 1967 was registered in Police Station, Ganderbal and investigationinitiated ; and

Whereas, during the course of investigation, one accused person

namely Mudasir Ahmad Baba S/o Ghulam Mohammad Baba R/o Saloora,

Ganderbal was apprehended, who confessed that he had pasted the posters

in the locality of the said village and on this instance, 04 posters were

recovered from his bedroom ; and

Whereas, during the course of further investigation, on the basis of

statements of witnesses, recorded under sections 161 and 164-A Cr. PC,

the seizure memo and other evidence, the Investigating Officer has

established a prima facie case against the accused person for offence

under section 13 of the Unlawful Activities (Prevention) Act, 1967, apart

from other offences ; and

Whereas, the authority appointed by the State Government under

sub-section (2) of section 45 of the Unlawful Activities (Prevention)

Act, 1967 has independently scrutinized the Case Diary file and all other

relevant documents relating to the case and has come to a definite conclusion

that this is a fit case for accord of prosecution sanction against the accused

person ; and

Whereas, after perusing the Case Diary, the relevant documents and

also taking into consideration the observation/views of the authority appointed

under sub-section (2) of section 45 of the Unlawful Activities (Prevention)

Act, 1967, the State Government is of the view that there is sufficient

material and evidence available against accused person for his prosecution

under the aforesaid provisions of law.

Now, therefore, in exercise of the powers conferred by

sub-section (1) of section 45 of the Unlawful Activities (Prevention) Act,

SRO-379.––In pursuance of section 6 of the Delhi Special PoliceEstablishment Act, 1946 (Act 25 of 1946), the Government of Jammu andKashmir hereby accords its post-facto consent to the extension of powersand jurisdiction of the Delhi Special Police Establishment to the State ofJammu and Kashmir for investigation of offences under sections 120-B,420 and 409 of RPC read with sections 5(1) (d) and 5(2) of the Jammu andKashmir Prevention of Corruption Act, Samvat 2006 and any otheroffence(s) regarding attempts, abetments and conspiracy arising out ofcase No. RC AC-1/2012/A0006 registered at Police Station, CBI, NewDelhi.
