Whereas, on the basis of an indent placed by Executive Engineer,Sewerage and Drainage Division (West), Jammu vide No. SDJ/W/4754-60dated 05-10-2018, a notification under section 4(1) was issued byCollector, Land Acquisition (ACR), Udhampur vide No. ACRU/SQ/3165-74 dated 15-10-2018 for land measuring 04 Marlas, situated in VillageKarlai Suki, Tehsil and District Udhampur ;

Whereas, the Collector, Land Acquisition (ACR), Udhampur videNo. ACRU/SQ/3533-34 dated 24-11-2018 has reported that the notificationissued under section 4(1) of the J&K State Land Acquisition Act wasserved upon the interested persons for filing objections, if any, to the proposedacquisition but no objection was received from the land owners/interestedpersons in the prescribed time period as required under sections 5 & 5-A ofthe Land Acquisition Act ;

Whereas, the report furnished by Collector, Land Acquisition (ACR),Udhampur vide number referred to above, duly endorsed by the DeputyCommissioner, Udhampur vide No. DCU/SQ/3952-53 dated 29-12-2018,Divisional Commissioner, Jammu vide No. 502/3434/Karlai Suki/RiverDevika/Udhampur/18/4470-71 dated 16-01-2019 and by FinancialCommissioner, Revenue vide No. FC-LS/LA-4815/2019 dated 30-01-2019has been examined and it has been found that the land owners did not fileany objection to the proposed acquisition ;

Whereas, the Government is satified that the land particulars whereofare given above is required for public purpose viz. for construction of IPSfor the project "Pollution Abetment of River Devika and River Tawi inUdhampur Town" in Village Karlai Suki, Tehsil and District Udhampurunder NRCP.

Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that land measuring 04 Marlassituated in Village Karlai Suki, Tehsil and District Udhampur, particularswhereof are given above is required for public purpose viz. for constructionof IPS for the project "Pollution Abetment of River Devika and River Tawiin Udhampur Town" in Village Karlai Suki, Tehsil and District Udhampurunder NRCP. Further, the Collector, Land Acquisition (ACR), Udhampur isdirected under section 7 of the said Act to take order for acquisition of thesaid land after giving prescribed notice to the interested person(s) as requiredunder the Land Acquisition Act/Rules.

Now, in pursuance of section 17 of the Land Acquisition Act, Samvat1990, it is ordered that on expiry of fifteen days from the publication of thenotification under section 9(2) of the said Act, the Collector, will takepossession of the aforementioned land in Village Karlai Suki, Tehsil andDistrict Udhampur required for public purpose, subject to filfillment of thecondition prescribed under section 9(2) and section 17-A of the LandAcquisition Act and Rule 63 of the Land Acquisition Rules.

However, the Collector concerned shall be personally responsible foridentification and proper title verification of all types of land involved in thecase and apportionment of compensation amongst all the interested persons/rightful claimants in accordance with the relevant laws/rules in force, whilemaking the award.

Whereas, the land specifications whereof are given in Annexure "A"to this notification is required for establishment of BOP for defence purposeby BSF in Village Karol Krishna, Tehsil Hiranagar, District Kathua ;

Whereas, on the basis of an indent placed by Inspector General,Station Hq. FTR vide No. AXXV/BOP/K-Krishana/FTR/Engg/2012/3400-02 dated 29-03-2012, a notification under section 4(1) was issued byCollector, Land Acquisition (SDM), Hiranagar vide No. SDM/H/LHS/50-59 dated 08-11-2017 for land measuring 17 Kanals and 06 Marlas situatedin Village Karol Krishna, Tehsil Hiranagar, District Kathua ;

Whereas, the Collector, Land Acquisition (SDM), Hiranagar, Kathuavide No. SDM/H/LHS/25-28 dated 01-08-2018 has reported that thenotification issued under section 4(1) of the J&K State Land AcquisitionAct was served upon the interested persons for filing objections, if any, to

Whereas, the Government is satified that the land particulars whereofare given in Annexure "A" is required for public purpose viz. for constructionof BOP for defence purpose by BSF in Village Karol Krishna, TehsilHiranagar, District Kathua.

Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that the land measuring 17Kanals and 06 Marlas situated in Village Karol Krishna, Tehsil Hiranagar,District Kathua, particulars whereof are given in Annexure "A" is requiredfor public purposes viz. for construction of BOP for defence purpose byBSF in Village Karol Krishna, Tehsil Hiranagar, District Kathua. Whereas, the District Collector, Land Acquisition (DC), Kathua videNo. DCK/LA/2018-19/65-69 dated 07-05-2018 and DCK/LA/2018-19/615-18 dated 14-09-2018 has reported that the notification issued under section4(1) of the J&K State Land Acquisition Act by Collector, Land Acquisition(SDM), Badnota/Billawar was served upon the interested persons for filingobjections, if any, to the proposed acquisition but no objection was receivedfrom the land owners/interested persons within the prescribed period asrequired under sections 5 & 5-A of the Land Acquisition Act ;

Whereas, the report furnished by District Collector, Land Acquisition(DC), Kathua vide letter referred to above, duly endorsed by DivisionalCommissioner, Jammu vide No. 502/3195/Acq/Machhedi/PMGSY/Kathua/18/3217-19 dated 20-10-2018, and by Financial Commissioner, Revenuevide No. FC-LS/LA/4720/2018 dated 28-12-2018 has been examined andit has been found that the land owners did not file any objection to theproposed acquisition ;

Whereas, the Government is satified that the land particulars whereofare given in Annexure "A" is required for public purpose viz. for constructionof road from Machhedi to Drabbar in Village Machhedi, Tehsil Lohai-Malhar,District Kathua, PKG No. JK07-11 under PMGSY.

Now, therefore, in pursuance of section 6 of the J&K State LandAcquisition Act, Samvat 1990, it is declared that land measuring 102 Kanalsand 14 Marlas situated in Village Machhedi, Tehsil Lohai-Malhar, DistrictKathua, particulars whereof are given in Annexure "A" is required forpublic purpose viz. for construction of road from Machhedi to Drabbar inVillage Machhedi, Tehsil Lohai-Malhar, District Kathua, PKG No. JK07-11under PMGSY. 1. In rule 41, in sub-rule (1), after the proviso, the followingexplanation shall be inserted, namely :—

“Explanation :—For the purpose of this sub-rule, it is herebyclarified that the ‘‘value of assets’’ meansthe value of the entire assets of the business,whether or not input tax credit has beenavailed thereon.’’.

2. With effect from 1st April, 2019, in rule 42 of the saidrules,—

(a) in sub-rule (1),—a. in clause (f), the following explanation shall be

inserted, namely :—‘‘Explanation :—For the purpose of this clause,

it is hereby clarified that in caseof supply of services covered byclause (b) of paragraph 5 ofSchedule-II of the said Act, valueof T4 shall be zero during theconstruction phase because inputsand input services will becommonly used for constructionof apartments booked on orbefore the date of issuance ofcompletion certificate or firstoccupation of the project,whichever is earlier, and thosewhich are not booked by the saiddate.’’

b. in clause (g), after the letter and figure“FORM GSTR-2”, the words, letters and figure‘‘and at summery level FORM GSTR-3B’’ shall beinserted ;

c. in clause (h),—

i. for the brackets and letter ‘‘(g)’’, the bracketsand letter ‘‘(g)’’ shall be substituted ;

i. before the proviso, the following proviso shallbe inserted, namely :—

‘‘Provided that in case of supply of servicescovered by clause (b) of paragraph 5,Schedule-II of the Act, the value of ‘E/F’ for atax period shall be calculated for each projectseparately, taking value of E and F as under—

E=aggregate carpet area of the apartments,construction of which is exempt from tax plusaggregate carpet area of the apartments,construction of which is not exempt from tax,but are identified by the promoter to be soldafter issue of completion certificate or firstoccupation whichever is earlier ;F=aggregate carpet area of the apartments in theproject ;

Explanation 1 :—In the tax period in whichthe issuance of completioncert ificate or firstoccupation of the projecttakes place, value of Eshall also include aggregatecarpet area of theapartments, which have notbeen booked till the date ofissuance of completioncert ificate or firstoccupation of the project,whichever is earlier ;

Explanation 2 :—Carpet area of apartments,tax on construction of whichis paid or payable at therates specified for items(i), (ia), (ib), (ic) or (id),against serial number 3 of

the Table in the SRONotification No. SRO-GST-11 dated 08-07-2017issued by FinanceDepartment, Governmentof Jammu and Kashmir, asamended, shall be takeninto account for calculationof value of ‘E’ in view ofExplanation (iv) inparagraph 4 of theSRO Notification No. SROGST-11 dated 08-07-2017issued by FinanceDepartment, Governmentof Jammu and Kashmir.

ii. in the proviso, for the word ‘‘Provided’’,the words ‘‘Provided further ’’ shall besubstituted ;

e. for the clause (1), the following clause shall besubstituted, namely :—

‘‘(1) the amount ‘C3’, ‘D1’ and ‘D2’ shall becomputed separately for input tax credit of centraltax, state tax, union territory tax and integratedtax and declared in FORM GSTR-3B or throughFORM DRC-03 ;’’

f. in the clause (m), for the words ‘‘added to theoutput tax liability of the registered person’’, thewords, letters and figures ‘‘reversed by theregistered person in FORM GSTR-3B or throughFORM DRC-03’’ shall be substituted—

(b) in sub-rule (2), for the words ‘‘The input tax credit’’,the words, figures and bracket ‘‘Except in case of

supply of services covered by clause (b) of

paragraph 5 of the schedule-II of the Act, the input

tax credit’’ shall be substituted ;

(c) In the clause (a) of sub-rule (2) for the words ‘‘added

to the output tax liability of the registered person’’,

the words letters and figures ‘‘reversed by the

registered person in FORM GSTR-3B or through

FORM DRC-03’’ shall be substituted ;

(d) after sub-rule (2), the following sub-rules shall be

inserted, namely :—

‘‘(3) In case of supply of services covered by

clause (b) of paragraph 5 of the Schedule–II of the

Act, the input tax determined under sub-rule (1) shall

be calculated finally, for each ongoing project or

project which commences on or after 1st April, 2019,

which did not undergo or did not require transition of

input tax credit consequent to change of rates of tax

on 1st April, 2019 in accordance with SRO Notification

No. SRO-GST-11 dated 08-07-2017 issued by Finance

Department, Government of Jammu and Kashmir, for

the entire period from the commencement of the

project or 1st July, 2017, whichever is later, to the

completion or first occupation of the project, whichever

is earlier, before the due date for furnishing of the

return for the month of September following the end

of financial year in which the completion certificate

is issued or first occupation takes place of the project,

in the manner prescribed in the said sub-rule, with the

modification that value of E/F shall be calculatedtaking value of E and F as under :—

E=aggregate carpet area of the apartments,construction of which is exempt from tax plusaggregate carpet area of the apartments, constructionof which is not exempt from tax, but which have notbeen booked till the date of issuance of completioncertificate or first occupation of the project, whicheveris earlier.

F=aggregate carpet area of the apartments in theproject ;

and,—

(a) where the aggregate of the amounts calculatedfinally in respect of ‘D1’ and ‘D2’ exceeds theaggregate of the amounts determined under sub-rule (1) in respect of ‘D1’ and ‘D2’, such excessshall be reversed by the registered person inFORM GSTR-3B or through FORM DRC-03 themonth not later than the month of Septemberfollowing the end of the financial year in whichthe completion certificate is issued or firstoccupation of the project takes place and the saidperson shall be liable to pay interest on the saidexcess amount at the rate specified in sub-section (1) of section 50 for the period startingfrom the first day of April of the succeedingfinancial year till the date of payment ; or

(b) where the aggregate of the amounts determinedunder sub-rule (1) in respect of ‘D1’ and ‘D2’exceeds the aggregate of the amounts calculated

finally in respect of ‘D1’ and ‘D2’, such excessamount shall be claimed as credit by the registeredperson in his return for a month not later than themonth of September following the end of thefinancial year in which the completion certificateis issued or first occupation takes place of theproject.

‘‘(4) In case of supply of services covered byclause (b) of paragraph 5 of Schedule-II of theAct, the input tax determined under sub-rule (1)shall be calculated finally, for commercial portionin each project, other than Residential Real EstateProject (RREP), which underwent transition ofinput tax credit consequent to change of rates oftax on the 1st April, 2019 in accordance withSRO notification No. SRO-GST-11 dated08-07-2017 issued by Finance Department,Government of Jammu and Kashmir, for the entireperiod from the commencement of the project or1st July, 2017, whichever is later, to thecompletion or first occupation of the project,whichever is earlier, before the due date forfurnishing of the return for the month of Septemberfollowing the end of financial year in which thecompletion certificate is issued or firstoccupation takes place of the project, in thefollowing manner :—

(a) The aggregate amount of common credit oncommercial portion in the project(C3aggregate_comm) shall be calculated as under—

C3aggregate_comm=[aggregate of amounts of C3determined under sub-rule (1) for the taxperiods starting from 8th July, 2017 to

31st March, 2019, x (Ac/At)]+[aggregate ofamounts of C3 determined under sub-rule (1)for the tax periods starting from 1st April,2019 to the date of completion or firstoccupation of the project, whichever isearlier].

Where,—

Ac=total carpet area of the commercialapartments in the project ;

At=total carpet area of all apartments in theproject ;

(b) The amount of final eligible common crediton commercial portion in the project(C3final_comm) shall be calculated as under—

C3 final_Comm=C3 aggregate_comm x (E/F)

Where,—

E=total carpet area of commercial apartmentswhich have not been booked till the date ofissuance of completion certificate or firstoccupation of the project, whichever isearlier.

F=Ac=total carpet area of the commercialapartments in the project ;

(c) where, C3aggregate_comm exceeds C3final_comm,

such excess shall be reversed by the registeredperson in FORM GSTR-3B or throughFORM DRC-03 the month not later than themonth of September following the end of thefinancial year in which the completioncertificate is issued or first occupation takes

place of the project and the said person shallbe liable to pay interest on the said excessamount at the rate specified in sub-section (1)of section 50 for the period starting from thefirst day of April of the succeeding financialyear till the date of payment ;

(d) where, C3final_comm exceed C3aggregate_comm, suchexcess amount shall be claimed as credit bythe registered person in his return for a monthnot later than the month of Septemberfollowing the end of the financial year inwhich the completion certificate is issued orfirst occupation takes place of the project.

‘‘(5) Input tax determined under sub-rule (1)shall not be required to be calculated finallyon completion or first occupation of an RREPwhich underwent transition of input tax creditconsequent to change of rates of tax on1st April, 2019 in accordance with SRONotification No. SRO-GST-11 dated 08-07-2017issued by Finance Department, Government ofJammu and Kashmir.

(6) Where any input or input service are used formore than one project, input tax credit withrespect to such input or input service shall beassigned to each project on a reasonable basisand credit reversal pertaining to each projectshall be carried out as per sub-rule (3).’’.

3. With effect from 1st April, 2019, in Rule 43 of the saidrules,—

(i) in sub-rule (1),—

(a) in clause (a), after the words, letters and figures‘‘FORM GSTR-2’’, the words, letters and figure ‘‘andFORM GSTR-3B’’ shall be inserted ;

(b) in clause (b), after the letters and figure ‘‘FORM GSTR-2’’, the words, letters and figures ‘‘and FORM GSTR-3B’’ shall be inserted ;

(c) after clause (b), the following explanation shall beinserted, namely :—

“Explanation :—For the purpose of this clause it ishereby clarified that in case of supplyof services covered by clause (b)of paragraph 5 of the Schedule-II ofthe said Act, the amount of input taxin respect of capital goods used orintended to be used exclusively foreffecting supplies other than exemptedsupplies but including zero ratedsupplies, shall be zero during theconstruction phase because capitalgoods will be commonly used forconstruction of apartments booked onor before the date of issuance ofcompletion certificate or firstoccupation of the project, whicheveris earlier, and those which are notbooked by the said date.’’ ;

(d) in clause (g),—

(A) after the letter and words ‘‘F is the totalturnover’’, the words ‘‘in the State’’ shall beinserted ;

(B) Before the proviso the following proviso shall beinserted, namely :—

‘‘Provided that in case of supply of servicescovered by clause (b) of paragraph 5 of theSchedule-II of the Act, the value of ‘E/F’ for a taxperiod shall be calculated for each project separately,taking value of E and F as under :—

E=aggregate carpet area of the apartments,construction of which is exempt from tax plus

F=aggregate carpet area of the apartments in theproject ;

Explanation 1 :—In the tax period in which theissuance of completioncertificate or first occupationof the project takes place,value of E shall also includeaggregate carpet area of theapartments, which have notbeen booked till the date ofissuance of completioncertificate or first occupationof the project, whichever isearlier.

Explanation 2 :—Carpet area of apartments, taxon construction of which ispaid or payable at the ratesspecified for items (i), (ia),(ib), (ic) or (id), against serialnumber 3 of the Table SRONotification No. SRO-GST-11dated 08-07-2017 issued byFinance Department,Government of Jammu andKashmir, as amended, shallbe taken into account forcalculation of value of ‘E’ inview of Explanation (iv) inparagraph 4 of the SRO

(C) in the proviso, for the word ‘‘Provided’’, the words‘‘Provided further’’ shall be substituted ;

(e) after clause (h), the following clause shall be inserted,namely :—

‘‘(i) The amount Te shall be computed separatelyfor input tax credit of central tax, state tax,union territory tax and integrated tax anddeclared in FORM GSTR-3B.’’ ;

(ii) for sub-rule (2), the following sub-rules shall be substituted,namely :—

‘‘(2) In case of supply of services covered by clause (b) ofparagraph 5 of Schedule-II of the Act, the amount ofcommon credit attributable towards exempted supplies(Tefinal) shall be calculated finally for the entire period fromthe commencement of the projector 8th July, 2017,whichever is later, to the completion or first occupation ofthe project, whichever is earlier, for each project separately,before the due date for furnishing of the return for the monthof September following the end of financial year in whichthe completion certificate is issued or first occupation takesplace of the project as under :—

Tefinal=[(E1 + E2 + E3)/F] x Tcfinal,

Where,—

E1=aggregate carpet area of the apartments, constructionof which is exempt from tax.

E2=aggregate carpet area of the apartments, supply ofwhich is partly exempt and partly taxable, consequent to

change of rates of tax on 1st April, 2019, which shall becalculated as under,—

E2=(Carpet area of such apartments) x [V1/(V1+V2)],—

Where,—

V1 is the total value of supply of such apartments whichwas exempt from tax ; and

V2 is the total value of supply of such apartments whichwas taxable ;

E3=aggregate carpet area of the apartments, constructionof which is not exempt from tax, but have not been bookedtill the date of issuance of completion certificate or firstoccupation of the project, whichever is earlier.

F=aggregate carpet area of the apartments in the project ;

Tc final=aggregate of Afinal in respect of all capital goods

used in the project and Afinal for each capital goods shall becalculated as under :—

Afinal=A x (number of months for which capital goods isused for the project/60) ;

and,—

(a) where value of Tefinal exceeds the aggregate of amountsof Te determined for each tax period under sub-rule (1),such excess shall be reversed by the registeredperson in FORM GSTR-3B or through FORMDRC-03 the month not later than the month ofSeptember following the end of the financial year inwhich the completion certificate is issued or firstoccupation takes place of the project and the saidperson shall be liable to pay interest on the said excessamount at the rate specified in sub-section (1) ofsection 50 for the period starting from the first day ofApril of the succeeding financial year till the date ofpayment ; or

(b) where aggregate of amounts of Te determined for eachtax period under sub-rule (1) exceeds Tefinal, suchexcess amount shall be claimed as credit by theregistered person in his return for a month not laterthan the month of September following the end of thefinancial year in which the completion certificate isissued or first occupation takes place of the project.

Explanation :—For the purpose of calculation ofTcfinal, part of the month shall betreated as one complete month.

(3) The amount Tefinal and Tcfinal, all be computed separatelyfor input tax credit of Central tax, State tax, Union territorytax and integrated tax.

(4) Where any capital goods are used for more than oneproject, input tax credit with respect to such capital goodsshall be assigned to each project on a reasonable basis andcredit reversal pertaining to each project shall be carried outas per sub-rule (2).

(5) Where any capital goods used for the project have theiruseful life remaining on the completion of the project, inputtax credit attributable to the remaining life shall be availedin the project in which the capital goods is further used ;’’

(iii) the Explanation shall be numbered as ‘‘Explanation 1’’thereof and after Explanation 1 as so numbered thefollowing Explanation shall be inserted, namely :—

‘‘Explanation 2 :—For the purposes of rule 42 and thisrule,—

(i) the term ‘‘apartment’’ shall have the same meaningas assigned to in clause (e) of section 2 of the RealEstate (Regulation and Development) Act, 2016(16 of 2016) ;

(ii) the term ‘‘project’’ shall mean a real estate project ora residential real estate project ;

(iii) the term ‘‘Real Estate Project (REP)’’ shall have thesame meaning as assigned to it in clause (zn)of section 2 of the Real Estate (Regulation andDevelopment) Act, 2016 (16 of 2016) ;

(iv) the term ‘‘Residential Real Estate Project (RREP)’’shall mean a REP in which the carpet area ofthe commercial apartments is not more than 15 percent of the total carpet area of all the apartments inthe REP ;

(v) the term “promoter” shall have the same meaning asassigned to it in clause (zk) of section 2 of theReal Estate (Regulation and Development) Act, 2016(16 of 2016) ;

(vi) ‘‘Residentia l apartment’’ shall mean anapartment intended for residential use as declared to theReal Estate Regulatory Authority or to competentauthority ;

(vii) ‘‘Commercial apartment’’ shall mean an apartmentother than a residential apartment ;

(viii) the term ‘‘competent authority’’ as mentioned indefinition of ‘‘residential apartment’’, means the localauthority or any authority created or established underany law for the time being in force by the CentralGovernment or State Government or Union TerritoryGovernment, which exercises authority over landunder its jurisdiction, and has powers to give permissionfor development of such immovable property ;

(ix) the term ‘‘Real Estate Regulatory Authority’’ shallmean the Authority established under sub-section (1)of section 20 (1) of the Real Estate (Regulation andDevelopment) Act, 2016 (No. 16 of 2016) by theCentral Government or State Government ;

(x) the term ‘‘carpet area’’ shall have the same meaningassigned to it in clause (k) of section 2 of the RealEstate (Regulation and Development) Act, 2016(16 of 2016) ;

(xi) ‘‘an apartment booked on or before the date of issuanceof completion certificate or first occupation of theproject’’ shall mean an apartment which meets all thefollowing three conditions, namely :—

(a) part of supply of construction of the apartmentservice has time of supply on or before the saiddate ; and

(b) consideration equal to at least one installment hasbeen credited to the bank account of the registeredperson on or before the said date ; and

(c) an allotment letter or sale agreement or anyother similar document evidencing booking of theapartment has been issued on or before the saiddate.

(xii) The term ‘‘ongoing project’’ shall have the samemeaning as assigned to it in SRO Notification No.SRO-GST-11 dated 08-07-2017 issued by FinanceDepartment, Government of Jammu and Kashmir,as amended ;

(xiii) The term ‘‘project which commences on or after1st April, 2019’’ shall have the same meaning asassigned to tt in SRO Notification No. SRO-GST-11dated 08-07-2017 issued by Finance Department,Government of Jammu and Kashmir, as amended ;’’.

4. In the said rules, after rule 88, the following rule shall beinserted, namely :—

‘‘Rule 88A. Order of utilization of input tax credit.—Input taxcredit on account of integrated tax shall first be utilized towards

payment of integrated tax, and the amount remaining, if any, maybe utilized towards the payment of Central tax and State tax orUnion territory tax, as the case may be, in any order :

Provided that the input tax credit on account of Central tax, Statetax or Union territory tax shall be utilized towards payment ofIntegrated tax, Central tax, State tax or Union territory tax, as thecase may be, only after the input tax credit available on accountof integrated tax has first been utilized fully.’’.

5. With effect from 1st April, 2019, in the said rules, for rule 100,the following rule shall be substituted, namely :—

‘‘100. Assessment in certain cases.—(1) The order of assessmentmade under sub-section (1) of section 62 shall be issued in FORMGST ASMT-13 and a summary thereof shall be uploadedelectronically in FORM GST DRC-07.

(2) The proper officer shall issue a notice to a taxable person inaccordance with the provisions of section 63 in FORM GSTASMT-14 containing the grounds on which the assessment isproposed to be made on best judgment basis and shall also servea summary thereof electronically in FORM GST DRC-01, andafter allowing a time of fifteen days to such person to furnish hisreply, if any, pass an order in FORM GST ASMT-15 and summarythereof shall be uploaded electronically in FORM GST DRC-07.

(3) The order of assessment under sub-section (1) of section 64shall be issued in FORM GST ASMT-16 and a summary of theorder shall be uploaded electronically in FORM GST DRC-07.

(4) The person referred to in sub-section (2) of section 64 mayfile an application for withdrawal of the assessment order inFORM GST ASMT-17.

(5) The order of withdrawal or, as the case may be, rejection ofthe application under sub-section (2) of section 64 shall be issuedin FORM GST ASMT-18.’’.

6. With effect from 1st April, 2019, in the said rules, for rule 142,the following rule shall be substituted, namely :—

‘‘142. Notice and order for demand of amounts payable underthe Act.—(1) The proper officer shall serve, along with the—

(a) notice issued under section 52 or section 73 or 74 orsection 76 or section 122 or section 123 or section124 or section 125 or section 127 or section 129 or section130, a summary thereof electronically in FORM GSTDRC-01 ;

(b) statement under sub-section (3) of section 73 or sub-section (3) of section 74, a summary thereof electronicallyin FORM GST DRC-02, specifying therein the detailsof the amount payable.

(2) Where, before the service of notice or statement, the personchargeable with tax makes payment of the tax and interest inaccordance with the provisions of sub-section (5) of section 73 or,as the case may be, tax, interest and penalty in accordance withthe provisions of sub-section (5) of section 74, or where any personmakes payment of tax, interest, penalty or any other amount duein accordance with the provisions of the Act he shall inform theproper officer of such payment in FORM GST DRC-03 and theproper officer shall issue an acknowledgement, accepting thepayment made by the said person in FORM GST DRC-04.

(3) Where the person chargeable with tax makes payment of taxand interest under sub-section (8) of section 73 or, as the case maybe, tax, interest and penalty under sub-section (8) of section 74within thirty days of the service of a notice under sub-rule (1),or where the person concerned makes payment of the amountreferred to in sub-section (1) of section 129 within fourteen daysof detention or seizure of the goods and conveyance, he shallintimate the proper officer of such payment in FORM GSTDRC-03 and the proper officer shall issue an order in FORM GSTDRC-05 concluding the proceedings in respect of the said notice.

(4) The representation referred to in sub-section (9) of section 73or sub-section (9) of section 74 or sub-section (3) of section 76or the reply to any notice issued under any section whose summaryhas been uploaded electronically in FORM GST DRC-01 undersub-rule (1) shall be furnished in FORM GST DRC-06.

(5) A summary of the order issued under section 52 or section 62or section 63 or section 64 or section 73 or section 74 or section75 or section 76 or section 122 or section 123 or section 124 orsection 125 or section 127 or section 129 or section 130 shall beuploaded electronically in FORM GST DRC-07, specifyingtherein the amount of tax, interest and penalty payable by theperson chargeable with tax.

(6) The order referred to in sub-rule (5) shall be treated as thenotice for recovery.

(7) Where a rectification of the order has been passed inaccordance with the provisions of section 161 or where an orderuploaded on the system has been withdrawn, a summary of therectification order or of the withdrawal order shall be uploadedelectronically by the proper officer in FORM GST DRC-08.’’.

SRO-455.—In exercise of the powers conferred by section 32 of theJammu and Kashmir Bovine Breeding (Regulation of Production, Sale ofBovine Semen and Artificial Insemination Services) Act, 2018 , the Gov-ernment hereby makes the following Rules ; namely :—

1. Short title and Commencement.—(1) These rules may be calledthe Jammu and Kashmir Bovine Breeding (Regulation of Production, Saleof Bovine Semen and Artificial Insemination Services) Rules, 2019

(2) They shall come into force on the date of their publication in theGovernment Gazette.

2. Definitions.— In these rules, unless the context otherwiserequires :—

(1) “Act” means the Jammu and Kashmir Bovine Breeding(Regulation of Production, Sale of Bovine Semen and ArtificialInsemination Services) Act, 2018 ;

(2) “Artificial Breeding Station” means Semen Bank managed byDepartment of Animal Husbandry Jammu/Kashmir andincludes the distribution of semen/embryo/other ArtificialInsemination inputs to field AI centres/Private AI Workers/other agencies in the district ;

(3) “Artificial Insemination Worker (AI Worker)” means a personwho possesses requisite qualification, skill and experience asprescribed by the Authority to conduct Artificial Inseminationin Bovines ;

(4) “Authority” means the Bovine Breeding Authority constitutedunder section 3 of the Act ;

(5) “Minimum Standard Protocol (MSP)” means Standardsprescribed by the Authority and notified by the Governmentfrom time to time for all operations of a Semen Station ;

(6) “Member” means the member of the Bovine Breeding Authoritynotified vide Notification SRO-122 of 2019 dated 21-02-2019or any subsequent notification in this behalf ;

(7) “Rules” means the Jammu and Kashmir Bovine Breeding(Regulation of Production, Sale of Bovine Semen and ArtificialInsemination Services) Rules, 2019 ;

(8) “Standard Operating Procedures for Artificial Insemination”means the standards prescribed by the Authority and notifiedby the Government from time to time for conducting ArtificialInsemination ;

(9) Words and expressions used and not defined in these rules butdefined in the Act shall have the same meaning assigned tothem in the Act.

3. Qualification and Experience of Nominated members ofAuthority.—No person shall be nominated by the Government underclauses (h) and (i) of sub-section (2) of section 5 of the Act, unless theypossesses the following qualification and experience :—

(a) The Eminent Animal breeding scientist shall be a reputed AnimalBreeder with MV Sc/Ph. D in Animal Breeding and has servednot less than 15 years in any Agriculture University/VeterinaryUniversity.

(b) The Eminent Veterinarian shall be a reputed Veterinarian, whohas served as Chief Animal Husbandry Officer, AnimalHusbandry Department or any equivalent post for not less thantwo years.

4. Membership Roll.—The Registrar of the Authority shall keep aroll of members and every member of the authority shall sign the roll andshall state herein his rank, occupation and address. The member concernedwill notify any change in his address and the same shall be recorded by theRegistrar in the roll of members.

5. Meetings of the Authority.—(1) Every meeting of the Authorityshall be presided over by the chairperson and in his absence, by the Registrarof the Authority.

(2) The Registrar of the Authority shall circulate the agenda of themeeting and shall keep a record of the proceedings of the Authority.

(3) The Authority shall meet at least once in every two months.

(4) The members shall be given at least fifteen days prior notice forholding an ordinary meeting and at least three days prior notice for holdinga special meeting specifying the purpose, time and place at which suchmeeting shall be held.

(5) The Chairperson shall upon, a written request from not less thansix members or upon a direction from Government, call a special meetingof the Authority.

(6) The quorum necessary for the transaction of business at anymeeting shall be six members.

6. Honorarium and Allowances of Members.—The members ofcommittees constituted by the Authority from the panel of experts in termsof sub-section (4) of section 3 of the Act, shall be entitled to followingHonorarium/Allowances :—

(i) The Honorarium for members of the committee constitutedfor Certification/Evaluation/Technical auditing of SemenStations, shall be Rs. 2000 each for every Certification/Evaluation/Technical auditing ;

(ii) The Honorarium for members of the committee constitutedfor Certification/Evaluation/Technical auditing of Semen Banks,shall be Rs. 750 each for every Certification/Evaluation/Technical auditing conducted ;

(iii) The Honorarium for members of the committee constitutedfor Bull Soundness Examination/ certification of bulls shall beRs. 500 each for certification of each breeding bull ;

(iv) The members of the committees, who are in service shall beentitled to TA and DA as applicable under rules to the StateCivil Service ;

(v) In case of other members the TA and DA shall be such as isadmissible to Class-II Officers of the State.

7. Registrations of Semen Stations.— (1) Registration of ExistingSemen Stations :—

(a) Any existing semen station shall apply to the Authority for grantof certificate of Registration in "Form I" along with feeprescribed at sub-rule 3) of this rule ;

(b) The semen station shall apply for ISO/HACCP certification ifnot certified and get itself certified within 6 months of issuanceof provisional registration certificate ;

(c) The semen station shall be audited/inspected within one monthby the committee for registration of semen stations after receiptof written request in this behalf ;

(d) The Authority shall thereafter issue a provisional certificate interms of sub-section 4 of section 10 of the Act ;

(e) Semen station shall be audited on yearly basis by the committeeconstituted for the purpose ;

(f) Passing of yearly audits is mandatory for renewal ofRegistration ;

(g) The semen stations shall strictly follow the guidelines ofMinimum Standard protocol issued by the Government fromtime to time for running the semen station ;

(h) The Registration certificate shall get automatically cancelled ifthe semen station fails CMU Audit by Government of India forgrading of semen stations ;

(i) If by any means registration certificate of the semen station iscancelled, the semen station may apply a fresh for newregistration along with the fee already prescribed.

( 2 ) Registration of New Semen Station :

(a) Any person/entrepreneur/NGO/Government Institution etc. whodesires to start a new semen station has to seek NOC from

the Authority and shall submit DPR to the Authority for technicalvetting before establishing it ;

(b) The Authority with prior approval of the Government shall grantNOC for establishment of semen station ;

(c) On expiration of one year from the date of establishment ofnew semen station, the semen station shall submit an applicationas per the format annexed as “Form-I” along with feeprescribed under sub-rule (3) of rule 7 ;

(d) Thereafter all the procedures, conditions, fees etc. applicableon existing semen stations shall mutandis, mutandi apply tonew semen stations, however the new semen station has tosend request to authority for CMU audit by Govt. of Indiawithin two years of its establishment failing which the semenstation is shall stop all its operations and registration certificateshall be cancelled.

(3) Fee for Registration.—Every application under sub-rule (1)and sub-rule (2) shall be accompanied by fee of Rs. 25000/- in the form ofa cheque or demand draft drawn in favour of Registrar, Jammu and KashmirBovine Breeding Authority.

(4) Grant of Registration Certificate.—The Authority on receiptof applications under sub-rule (1) and (2) and after satisfying that theconditions laid under sub-section (6) of section 10 of the Act have beencomplied with, may issue a certificate of registration for a period of twoyears in “Form-II”.

(5) Renewal.—The semen station shall make a request to theAuthority along with fee of Rs. 5000/- by way of DD/cheques/e-transfer infavour of Registrar, J&K Bovine Breeding Authority, three months beforethe expiry of Registration certificate.

8. Registration of Semen Banks.—(l) All the existing and newSemen Banks in the State shall register themselves with the Authority by

submitting an application as per the format prescribed at “Form-III” alongwith a fee of Rs 5000/- by way of DD/cheques/e-transfer in favour ofRegistrar, J&K Bovine Breeding Authority.

(2) The Authority shall provide provisional registration certificate tosemen bank which shall be valid for six months only.

(3) After Receipt of Application, the Authority shall arrange TechnicalAudit of the semen bank by the committee constituted for the purposewithin two months of the receipt of request.

(4) After Technical Auditing grace period of two months shall beprovided to semen Bank for meeting the non-compliances/observations madein the audit report.

(5) The registration certificate shall be provided to the semen bankafter successful completion of two audits within a period of 5 months.

(6) If semen bank fails the technical auditing or by any means thevalidity of provisional registration certificate expires without grant ofRegistration Certificate, the semen bank shall stop its operations immediatelyand rectify the non-compliances and shall apply a fresh along with the feeapplicable for registration of semen banks.

(7) The registration certificate shall be valid for two years and shallbe renewed by sending a request of renewal three months prior to completionof two years along with a fee of Rs. 1000/- by way of DD/cheques/e-transfer in favour of Registrar, J&K Bovine Breeding Authority. Thesemen bank shall again be technically audited before issuance of renewedregistration certificate.

9. Certification of Bulls.—(1) The bulls shall be certified by theAuthority, subject to such conditions, as specified in Minimum StandardProtocol for Semen Production notified by the Government from time totime.

(2) The Authority shall request National Dairy Development Boardto generate a unique Identification No. for each certified bull compatible to

INAPH so that no other bull in the country used for semen production forArtificial insemination shall bear this number. It shall be mandatory for thesemen stations to tag this unique Identification No. securely and permanentlyto the certified bulls at all times. The Authority shall also generate a uniqueidentification No. for bull used for natural mating.

(3) The bulls of different breeds used for semen production or naturalmating shall be selected for induction as per the specifications/standardsmentioned in Minimum Standard Protocol for Semen Production notifiedby the Government from time to time and shall be examined by thecommittee for certification of bulls for Bull Soundness Examination (BSE).

(4) The AI bulls or natural service bulls shall be procured fromcertified bull production programmes approved by the Government, suchas PT/PS programmes run in the country by NDDB or Govt. of India orState Governments or from reputed Bovine breeding farms/semen stationsof the State or Country, but in accordance to the breeding policy of theState.

(5) The testing of the AI bulls/natural service bulls shall be carriedout by Semen Station/Government or private agency as per the standards/tests mentioned in Minimum Standard Protocol for Semen Production onyearly basis and in some cases on six monthly basis by the team of expertsselected by the Authority for the purpose which may include experts fromRDDL, Jalander/Institute of Animal Health & Biological Products, ZakuraAHD, Kashmir/MS IAH & BP, RS Pura, AHD, Jammu/SKUAST-K/SKUAST-J.

(6) It is mandatory to karyotype the bulls before induction in semenstation or any breeding programme.

(7) The HF breed and its crosses shall be tested against genetic diseases(recessive gene condition) as specified in Minimum Standard Protocol forsemen production from the reputed Labs of Central/State Government/NDDB.

(8) The culling of bulls shall be carried a per the provisions mentionedin Minimum Standard Protocol of Semen Production and after vetting bycommittee constituted for certification of Bulls.

(9) The Livestock Development Board shall send a request to theAuthority with proper justification. The Authority shall approve the cullingwithin 15 days after receipt of request if the bull does not qualify theprovisions of Minimum Standard Protocol and within two days if bull istested positive for any STD or communicable disease recommended inMinimum Standard Protocol.

(10) The Livestock Development Boards shall frame a cullingcommittee in advance in the month of April consisting of members fromDirectorate of Animal Husbandry not below the rank of Deputy Director,Accounts Officer of Directorate of Animal Husbandry and CEO, LivestockDevelopment Board as its Chairman, which shall carry out the culling. Theculling committee thus constituted shall be valid for one year. The cullingcommittee shall carry out the culling within 15 days after the approval ofculling by the authority or immediately after the approval of culling by theauthority if the bull is tested positive for any STD or communicable diseaseas may be recommended in Minimum Standard Protocol.

10. Registration of Bull Keepers.—(1) No Bovine bull shall be usedfor natural matting in the area where Artificial Insemination Service is easilyavailable and popular.

(2) No person can keep a bull for providing service of natural matingfor bovine breeding in a community unless it is authorized by the Authority.

(3) Any person or agency whether Government or Private who keepsthe bull and provides service of natural mating for bovine breeding in acommunity shall register itself with the Authority by submitting an applicationalong with fee of Rs. 50/-. The registration certificate shall be provide onlyafter ascertaining the bull used for natural mating is certified by the authority.

(4) The certified bulls by the authority shall only be used for anybreeding programme.

(5) The Bull Keeper shall submit month-wise details of the matingsto the nearest veterinary center manned by a Veterinarian who will inturnforward the information through reporting officer to the concerned ArtificialBreeding Station (ABS). The ABS shall submit consolidated information ofnatural mating to concerned Livestock Development Board.

(6) The registration of Bull Keepers shall be renewed annually afterproper BSE by the committee constituted for the purpose and a roaster forthe year for renewal of registration shall be issued by the Authority througha notification on 1st March every year.

(7) The bulls shall be relocated after every two years to preventinbreeding at least 15 km away from the previous location.

(8) The Livestock Development Boards shall frame a rotation scheduleon 1st March of every year and submit same to the Authority for approval.

(9) A bull shall be culled after rendering 8 years of breeding service.

(10) The bull shall be immediately isolated and shall not be used forbreeding if its tests positive for any STD or communicable disease as perthe recommendations of Minimum Standard Protocol and shall be culledimmediately.

1 1 . Certification/Registration of AI workers.—(1) The AI workersselected and trained by Livestock Development Boards/Department ofAnimal Husbandry, Jammu/Kashmir under CSS-National Programme forCattle and Buffalo Breeding/NPBB/RGM or any other scheme of the Stateor Center and are carrying out the AI work in the allotted areas shall registerthemselves with the Authority by submitting an application along with anaffidavit as per the format provided at “Form-IV” along with fee ofRs. 500/- by way of DD/cheques/e-transfer in favour of Registrar JK BovineBreeding Authority.

(2) The syllabus/module for training of AI workers shall be same asspecified by the guidelines of CSS-NPCBB/NPBB/RGM which may bemodified by the Authority as per the requirements of the State.

(3) The new AI workers who have successfully received trainingfrom Livestock Development Boards shall register themselves with theAuthority before starting AI work in allotted areas.

(4) The Livestock Development Boards shall provide list of all trainedAI workers who have been provided cryocans to the Authority and shallsubmit updated list on 1st April of every year.

(5) The AI workers who are trained in Stock Assistant Training Instituteof Department of Animal Husbandry Jammu/Kashmir or by LivestockDevelopment Boards and have not carried out the AI work for last twoyears shall send a request to Authority for refresher training and shall registerthemselves with Authority.

(6) The trained AI workers who have received cryocans and AI inputsfrom Livestock Development Boards under different Centrally sponsored/State sponsored schemes and have not carried out AI work in the allottedareas for more than one year shall immediately return the cryocans andother inputs to respective Livestock Development Boards within one monthfrom the date of issuance of these Rules, failing which the persons shall beliable to punishment under the provisions of Jammu & Kashmir BovineBreeding Act, 2018. The Livestock Development Boards shall provide listof such candidates to Authority as and when required.

(7) The retired Paravets trained in Stock Assistant Training Institutesof Animal Husbandry Department Jammu/Kashmir during their regularservice and are working as private AI workers or desire to work as AIworkers shall register themselves with the Authority.

(8) The retired Veterinarians or unemployed Vets. who are providingbreeding services through AI or desire to provide AI services shall registerthemselves with the Authority.

(9) All the AI workers shall provide the month-wise AI details as perthe format at “Form-V” to nearest veterinary centre manned by a veterinarianwho will inturn shall submit the details through concerned reporting officerto Artificial Breeding Station of concerned district. The ABS shall provideconsolidated information to the concerned Livestock Development Board.

(10) Any AI worker who fails to provide month-wise details of AI toconcerned veterinary centre for consecutive 2 months, his registration shallbe cancelled.

(11) All the AI workers Government or Private shall strictly followstate breeding policy and the Standard Operating Procedures of AI notifiedby the Government from time to time during conducting AI.

(12) The Registration of AI workers shall be valid for one year fromits date of issuance.

(13) The AI worker shall make a request for renewal one monthprior to date of expiry along with fee of Rs. 100 as DD/Cheque/e-transferin favour of Registrar of the Authority.

(14) The registration certificate shall be renewed only after NOCfrom concerned Livestock Development Board.

12. Regulation of Sale of Semen.—(1) The Livestock DevelopmentBoard Jammu/Kashmir shall be authorized by the Authority to sell/distribute/gift or transfer bovine semen/embryos among the field AI centers of theState or any other agency for upgradation of bovines. Any other agencywho wants to sell or distribute or gift or transfer bovine semen or embryofor bovine upgradation shall seek NOC from Authority by sending a formalrequest along with justification for the purpose/details of semen/embryo tothe Authority. The Authority shall grant NOC only after ascertaining thatthe sale/distribution/gift or transfer of bovine semen is in accordance to thebreeding policy of the State and directly or indirectly shall contribute to thebovine upgradation of the State.

(2) The Livestock Development Board Jammu/Kashmir shall act asa nodal agencies for import of bovine semen or embryos into the State fromany other state/agency or country. All such imports shall take place withprior approval of Authority for each consignment. The breed/otherparameters of imported semen/embryos shall be in accordance to thebreeding policy of the State.

13. Issue of Duplicate Registration Certificate.—In case a certificateof registration or a certificate of renewal issued under the Act is defaced,lost or destroyed, the Authority, may, upon satisfaction, grant a duplicatecertificate to the applicant on payment of fee, prescribed as under :—

(i) For semen station Rs. 500

(ii) For Semen Bank Rs. 100

(iii) For Bull Keeper Rs. 50

(iv) For Artificial Insemination Worker Rs. 50/-.

Provisions of J&K Bovine Breeding Act, 2018 and consider forEvaluation of Semen Stations by the Authority–regarding.

______Dear Sir,

We are pleased to inform that we have been producing frozen semendoses as per MSP/SOP notified by the Government and we believe that thesemen station/s maintained by us meet the minimum standards for semenproduction as prescribed by the Authority submitting the desired documentsfor information and necessary actions.

A fee of Rs. 25000/- (Rupees Fifty Thousand only) is deposited throughdemand draft/Cheque/e-transfer vide No.__________ dated_________in favour of Registrar, J&K Bovine Breeding Authority with request toissue Provisional Registration Certificate valid for a period of 12 monthsand arrange technical audit of our semen station for its Registration. Asrequested we would like to suggest convenient dates for Technical Audit ofsemen station/s as per details below.

2 The J&K Govt. Gazette, 14th June, 2019/24 Jyai., 1941. [No. 11-1––––––––––––––––––––––––––––––––––––––––––––––––––––––––––Corporation Act, 2000 and as approved by the Government, theCorporation hereby notifies the following Bye-Laws for the informationof general public ; namely :—

1. Short title and commencement.—(1) These Bye-Laws may becalled the Srinagar Municipal Corporation (Honorarium and OtherFacilities to Mayor and Deputy Mayor) Bye-Laws, 2019.

2. Definitions.—In these bye-laws, unless the context otherwiserequires,—

(a) ‘‘Act’’ means the Jammu and Kashmir Municipal CorporationAct, 2000 ;

(b) ‘‘Councillor’’ means the Councillor duly elected under theprovisions of the Act ;

(c) ‘‘Mayor’’ means the Mayor duly elected under theprovisions of the Act ;

(d) ‘‘Deputy Mayor’’ means the Deputy Mayor duly electedunder the provisions of the Act.

3. Honorarium to Mayor.—The Mayor shall be paid anhonorarium of Rs. 50,000/- per month besides his allowances as aCouncillor.

4. Honorarium to Deputy Mayor .—The Deputy Mayor shall bepaid an honorarium of Rs. 25,000/- per month besides his allowancesas a Councillor.

5. Other facilities to Mayor and Deputy Mayor.—

(a) The Mayor and Deputy Mayor shall be entitled to usecorporation vehicle for official purposes ;

(b) The Mayor and Deputy Mayor shall be entitled tohave landline telephone connection at office and residencebesides telephone facility subject to a monthly ceiling ofRs. 1000/- ;

6. Effect of Bye-Laws.—The Mayor and Deputy Mayor shall beentitled to the benefits under the Bye-Laws from the date they take oathof their office seats.
