ENVIRONMENTAL IMPACT ASSESSMENT STUDY REPORT FOR THE PROPOSED APARTMENTS DEVELOPMENT ON

PLOT L. R. NO. 1/402, ALONG KINDARUMA ROAD, KILIMANI, NAIROBI CITY COUNTY

INVITATION OF PUBLIC COMMENTS

Pursuant to regulation 21 of the Environmental Management and Co-ordination (Impact Assessment and Audit) Regulations, 2003, the National Environment Management Authority (NEMA) has received an Environmental Impact Assessment Study Report for the above proposed project.

The proponent, Ever Forgarden Company Limited, is proposing to construct four 15-storey blocks of apartments comprising of 240No. studio apartments, 660No. one bed roomed apartments (Total no.: 900No. apartments). The development will be accommodated in four 15-storey blocks. The ground floor and the two basement floors comprise of parking. The 1st to 15th floors will comprise of residential apartments. Other features will include a stone wall perimeter fence with gates (entry and exit) and a guard house and other associated facilities and amenities on Plot L.R. No. 1/402 along Kindaruma Road in Kilimani, Nairobi City County.

The following are the anticipated impacts and proposed mitigation measures:

Increased energy use • Solar energy will be used as an alternative source of energy.

• Use energy efficient appliances such as LED bulbs for lighting.

• Switch off electrical appliances when not in use.

• Regular maintenance of all the electrical components.

• Regular inspection and maintenance of the solar panels.

Noise pollution • Erect suitable barriers to control noise.

• Sensitize drivers of construction machinery on effects of noise.

• Maintain plant equipment (if present).

• Construction activities to be restricted to daytime.

• Workers in the vicinity of or involved in high-level noise to wear safety and protective gear.

• Work to be confined between 8am and 5pm weekdays and 8am to 1pm on weekends. There should be no construction works on Sundays.

Solid waste • Use of an integrated solid waste management system through a hierarchy of options: source reduction, recycling, composting and reuse, will facilitate waste handling.

• Ensure segregation of waste (organic and inorganic) at source.

• Provide clearly marked dustbins cubicles to serve the specified use.

• Ensure that wastes generated are efficiently managed through recycling, reuse and proper disposal procedures.

• Engage services of a registered NEMA waste handler to dispose the waste regularly at approved disposal points.

Oil pollution • Proper storage, handling and disposal of new oil and used oil wastes as per waste regulations.

• Maintain plant and equipment to avoid leaks.

• Maintenance of construction vehicles should be carried out in the contractors yard (off the site).

• Provide oil interceptors along the drains leading from car park and potentially oil risk areas.

Water resources • Management of water usage. Avoid unnecessary wastage.

Impacts Proposed Mitigation Measures • Recycling of water at the construction

phase where possible. Make use of roof catchments to provide water i.e for general purposes.

Public health, occupational health and safety

• Train staff/workers on occupational health hand safety.

• Provide full protective gear and workmen's compensation cover in addition to the right tools and operational instructions and manuals during construction.

• Adopt sound housekeeping practices.

• Sensitize residents on environmental management.

• Design of sewerage system should be as provided in the plans.

• Post strategically the Occupational Safety and Health Act, 2007 Abstract and provide material safety data sheets.

• Post clear warning signs e.g. “No unauthorized use of machines”, ensure there are guards on moving parts e.t.c

• Provide fully equipped First Aid kits and train staff on its use. Ensure adherence with the legal requirements -OSH Act, 2007.

Fire • Install firefighting equipment as provided elsewhere in the report. Conduct training on firefighting, evacuation and emergency response.

• Sensitize the residents on fire risks i.e. conduct regular fire drills.

• Adapt effective emergency response plan.

• Maintain service firefighting machinery regularly.

• Provide emergency numbers at strategic points.

The proponent, Jeremiah N. Kioni proposes to vary 300 acres of the Aberdare (Ndaragwa Block) Forest to allow expansion of Ndaragwa Township in Ndaragwa Sub-County, Nyandarua County.

• KFS should build capacity of CFAs to coordinate tree and shrub seedlings production for planting by the community and other groups such as Water Resources Users Associations (WRUAs), schools, religious institutions with an aim of promoting afforestation, forest protection, monitoring and management.

• Limit the proposed boundary variation to 162.52 acres (65.77ha) as per the 2007 survey plan FR 341/63.

• Mainstream biodiversity considerations into county/town policies, strategies and practices of key public and private actors that impact or rely on biodiversity, so that it is conserved sustainably.

• Consult and involve the public on the need for Payment for Ecosystem Services (PES) as a revenue mechanism to support biodiversity conservation and to compensate resource managers for off-site ecological benefits associated with land-use practices that are compatible with biodiversity conservation such as recreational parks preservation, 10% plot tree cover.

Loss of forest use for cultural site protection, educational, recreational, health or research purposes

• The currently undeveloped 19.77% of the proposed varied land should be left intact for education, research and recreation purposes and it should be linked with the proposed riverine Recreational Park Network.

• Involvement of the local community, a lot of indigenous knowledge can be documented with regard to the history, trends and use of the forest for educational, cultural, recreational, health and research purposes that will eventually contribute to both their welfare and that of the forest reserve.

• Establish a botanical garden for educational and research purposes targeting all the indigenous species found in Aberdare Forest (Ndaragwa Block).

• Promote intensive tree planting along the riparian areas and all undeveloped open spaces.

• Develop tourism circuits/link to the water fall and other sites to create additional recreational facilities i.e. nature walks, biking, hiking into the larger Aberdare Forest.

• Ensure full CFAs involvement in governance of the forest resources as well as implementation of the proposed expansion of Ndaragwa Township if approval is granted.

• County physical land use regulations should encourage densification of the urban commercial and residential developments (encourage high-rise buildings) to achieve a compact Ndaragwa Town in order to discourage urban sprawl.

• County government should prepare a comprehensive Ndaragwa Town Local Physical and Land Use Development Plan to ensure optimal land use.

(1) The Kenya Gazette contains Notices of a general nature which do not affect legislation. They are, therefore, submitted to the Government Printer directly.

(2) Legislative Supplement contains Rules and Regulations which are issued by the Central Government. Because of this, they must be submitted to the Government Printer through the office of the Attorney–General.

(3) Bill Supplement contains Bills which are for introduction in the National Assembly.

(4) Act Supplement contains Acts passed by the National Assembly. All “copy” submitted for publication should be prepared on one side of an

A4 sheet no matter how small the Notice is, each page being numbered and should be typed with double spacing. Copy should be clear, legible and contain no alterations.

Particular attention should be paid to the following points: (i) Signature must be supported by rubber–stamping or typing the name

of the signatory in capital letters. (ii) Must be correct and filled in where necessary. (iii) Care should be taken to ensure that all headings to Notices and

references to legislation are up to date and conform with the Revised Edition of the Laws of Kenya.

“D 34. (1) Communications for the Kenya Gazette should reach the Government Printer not later than 9 a.m. on Friday of the week before publication is desired. The Government Printer will not publish communications received after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the cost of advertising in it.

It is emphasized that these notes are for guidance only, but it is requested that persons submitting copy for publication first satisfy themselves that such copy is complete in every respect.
