PURSUANT to provisions of sect^on 25 (3), the Competition

Authority of Kenya wishes to notify the public that the Institute of

Certified Public Accountants of Kenya has made an application under

section 29 (1) of the Act for exemption of their proposed Audit Fees

Guidelines from the provisions of section A of Part III of the Act for

an indefinite period.

The Institute of Certified Public Accountants of Kenya ("the

Institute") is a statutory body that is mandated under the Accountants

Act to develop and regulate the accountancy profession in Kenya , and

to issue by-laws, regulations and guidelines.

in the Guidelines, the institute intends to-

(a) prescribe factors to be considered by its members in charging

minimum professional fees;

(b)prescribe the minimum recommended fees for each category

i.e. Non Assurance Services, Company Audits, SACCOs,

Pension Schemes and Public Benefit Organizations;

(c)provided that the guidelines apply to all members of the

Institute whether in practice or not; and

(d)constantly monitor prevailing conditions and issue revised

recommended fees as and when it becomes necessary.

All interested parties may, within thirty (30) days of (he

publication of this notice, submit any written representations which

they wish to make concerning this application.

APPLICATIONS FOR GRANT OF PLANT BREEDER'S RIGHTS

PURSUANT to regulation 16 (2) of the , Seeds and Plant Varieties (Plant Breeders Rights) Regulations, 1994, the Cabinet Secretary forAgriculture, Livestock and Fisheries notifies the public of the applications for grant of Plant Breeders' Rights for the plant varieties set out in theSchedule.

INVITATION OF PUBLIC COMMENTS

PURSUANT to regulation 21 of the Environmental Managementand Co-ordination (Impact Assessment and Audit) Regulations, 2003,

the National Environment Management Authority (NEMA) has

received an Environmental Impact Assessment Study Fleport for theabove proposed project.

The proponent, Fatma Ali Haji and Amina Kassini Osman, isproposing a Residential Development within Nyali Area in MombagaCounty. The Project involves the construction, subseque,nt operation

and possible decommissioning of six typically identical residential

apartment blocks consisting of a ground, I st to 3rd floors. Every floor

of every block will constitute two household units, each featuring thefollowing; 3 Bedrooms with one being the master bedroom, living

room, dining, titchen, store, dhobi, stairwell, sanitary facilities. Other

communal features will include: - Underground water storage tanks, 57parking slots, Boundary wall, Gate house, landscaped areas and

swimming pool. The built up area of the proposed project shall cover

8328M2 and contain 48 residential units;

The following are the anticipated impacts and proposed mitigationmeasures:

Mitigation Measures

• Sheltering of the site.

• Restricting demolition to day time only,

• Using well-conditioned demolitionmachines.

Providing those working at the site with

PPE such as car muffs and earplugs to

reduce the levels of noise reaching the

inner ear.

Recover the reusable and recyclable

components of the waste either for use

in the new construction or for sale to

other constructors/ recyclers,

Contract the services of a NEMA

licensed demolition waste handier to

deal with the non-usable, non-recyclable

waste.

Procure portable toilet facilities to be

emptied regularly.

Demolition will be conducted within the

shortest time possible.

Restricting demol ition to daytime at

fimes when the wind intensity i s low,

• The site will be sfi0teted from the other

parts of the premise.

• The rubble will be sprinkled with water.

Workers on site will be provided with

the hecessary PPE such as dust masks.

NEMA accredited sewage hatidlers and

transported liffske for disposal.

• The septic tanks will be desludged and

the sludge likewise taken off site for

disposal.

• The septic tanks should first be emptied

of all residues and cleaned preferabi ' v

with lime which acts as a disinfectant.

Once soak pits are emptied, lime can

also be used as a disinfectant.

The holes should then be filled up with

either sand or gravel to ground level.

The disturbed areas once backfilled

should be properly graded and seeded/

planted ( if necessary) with appropriate

vegetation ( trees and grass).

• For the purposes of the planned new

developments the pToponent should

keep a record of the location of the

decommissioned septic tanks and soak

pits.

Change of user conflicts • Change of user to be appro ,ved by the

County Government of Motiibasa and

the Ministry of Lands.

• Proponent to co mmit to impleme,mation

of the Environmental Managemen,t Plan

at operational phase to mitigate ch,,inge

of user impacts.

• The proponent and neighbors i10

constitute a liaison team to ensure

compliance with EMP.

Sourcing of raw materials - The contractor will obtain raw materials

for the construction from sources that

are compliant with NEMA Regulations.

• The contractor will procure quantities

that are sufficient for the intended works

only and recycle as far as practical to

curtail wastage.

• The contractor will commit to extensive

use of recycled raw materials as will be

appropriate and in a manner that does

not compromise the safety of the

development.

• Obtain a permit from Kenya Forest

Service and County Government of

Mombasa prior to cutting any trees on

site.

• Compacted areas to be ripped to prevent

erosion.

• Restore degraded areas throughlandscaping using trees and sediment

binding grasses.

• The contractor will provide workers

with appropriate Personnel Protective

Equipment (PPE) and ensure their use.

• Workers to be trained on equipment use.

• First aid facilities to be available on

site.

• Contractor to comply with the

requirements of the Occupational Safety

and Health Act (OSHA) by registering

the site as a work place.

• All visitors to the site to be provided

with PPEs.

• Procure portable toilets for use by the

workforce from a NEMA licensed waste

management company.

• All recyclable materials should be

collected and sent to a licensed company

for recycling.

• Provide litter bins that encourage the

separation of wastes into paper, glass,

plastics etc for recycling.

• Contract a NEMA licensed solid waste

handler to manage wastes from the

development.

• Comply with Legal Notice No. 121 of

2006 in management of solid wastes

generated by the development.

IMPORTANT NOTICE TO SUBSCRIBERS TOTHE KENYA GAZETTE

THE following notes are for the guidance of persons submitting "copy" for

inclusion in the Kenya Gazette, Supplement, etc.:

(1) The Kenya Gazette contains Notices of a general nature which do not

affect legislation. They are, therefore, submitted to the Government

Printer directly.

(2) Legislative Supplement contains Rules and Regulations which are

issued by the Central Government. Because of this, they must besubmitted to the Government Printer through the office of the

Attorney-General.

(3) Bill Supplement contains Bills which are for introduction in the

Nat ional Assembly.

(4) Act Supplement contains Acts passed by the National Assembly.

All "copy" submitted for publication should be prepared on one side of an A4sheet no matter how small the Notice is, each page being numbered and should be

typewritten with double spacing. Copy should be clear, legible and contain no

alterations.

Particular attention should be paid to the following points:

(i) Signature must be supported by rubber-stamping or typing the name ofthe signatory in capital letters.

(iiust be correct and filled in where necessary.

(iii) Care should be taken to ensure that all headings to Notices andreferences to legislation are up to date and conform with the Revised

Edition of the Laws of Kenya.

EXTRACT FROM THE CODE OF REGULATIONS, SECTION D —

Kenya Gazette

"D 34. (1) Communications for the Kenya Gazette should reach theGovernment Printer not later than 9 a.m. on Friday of the week before publicationis desired. The Government Printer will not publish communications received

after that hour until the next subsequent issue of the Gazette.

(2) Ministries will be required to pay for the Kenya Gazette and to meet the

cost of advertising in it.

It is emphasized that these notes are for guidance only, but it is requested that

persons submitting copy for publication first satisfy themselves that such copy is.

complete in every respect.
