I INTRODUCTION

1.This is the twenty-fourth annual report on the operations of the Land Tribunalestablished under the Aboriginal Land Act 1991. The report covers the periodfrom 1 July 2014 to 30 June 2015.

2.The report deals with the membership of the Land Tribunal, land claimproceedings during this year, the status of all claims received by the Tribunal, anoverview of aspects of the operation of the Aboriginal Land Act 1991 and variousadministrative matters.

II THE LAND TRIBUNAL

3.The Tribunal was established on 21 December 1991, the date of commencement ofthe Aboriginal Land Act 1991.

(a) Membership

4.The Aboriginal Land Ad 1991 (the Act) provides for the establishment of a LandTribunal comprising:

(a)a Chairperson, who is appointed on a part-time or full-time basis;

(b)such number of Deputy Chairpersons as are appointed on a part-time basis;and

(c)such other Members as are appointed on a part-time basis.

5.The Chairperson and each Deputy Chairperson is a presiding Member of theTribunal. Each presiding Member is a lawyer.

6.Each non-presiding Member must:

(a) have, in the opinion of the Governor in Council, suitable knowledge ofAboriginal people or Aboriginal tradition; or

(b) have had experience, for not less than 5 years, at a high level in industry,commerce, public administration, industrial relations, the practice of aprofession or the service of a government or an authority of a government.

7.On 17 August 2014, I was reappointed as the part-time Chairperson of the LandTribunal established under the Aboriginal Land Acl 1991 for a term of two yearsfrom 17 August 2014 to 16 August 2016. I was appointed as a full-time Memberof the Land Court for a term of 15 years from 30 July 2001 and as President of theCourt from 1 August 2008 for the balance of my term as a Member.

8.Also on 17 August 2014, Mark Douglas Evans was reappointed as a part-timeDeputy Chairperson of the Land Tribunal from 17 August 2014 to 16 August2016.

9.On 29 June 2015, John William Stewart AM and Nathan Robert Jarro wereappointed as part-time Members of the Land Tribunal from 29 June 2015 to 28June 2016.

(b) Functions

10.Until 22 December 2006, the Land Tribunal received claims made by groups ofAboriginal people to areas of claimable land. No new claims have been receivedsince that date because of the operation of s 60 of the Act which provides thatclaims must be made under the Act not later than 15 years after thecommencement of the Act.

11.The only outstanding proceedings before the Tribunal are the claims toBoodjamulla (Lawn Hill) National Park. The Tribunal has an ongoing function tohear those claims and to report to the Minister for Natural Resources and Mines inrelation to them.

(c) Land claim procedures

12.Previous annual reports have discussed a number of matters relating to land claimprocedures, including parties to land claim proceedings, representation of parties,the location of land claim hearings, group evidence, restriction of evidence, andthe recording of proceedings. Further information about procedures is found inland claim reports. It is not necessary to repeat what was said in those reports.

13.The Tribunal's Practice Directions were published in the 1992 Annual Report andhave not been amended in any substantial way. They are available from theregistry upon request.

(b)Tribunal Proceedings

17.No land claim hearings have been conducted by the Tribunal in the year underreview.

18.Directions Hearings were held in relation to the outstanding land claims toBoodjamulla (Lawn Hill) National Park on 29 August 2014, 27 March 2015, 15May 2015 and 4 June 2015. The claims were listed for hearing in Brisbane on 1,2and 3 July 2015.

(c)Land claim reports

19.There have been no new publications of Aboriginal land claim reports.

22.At the date of this report, the Land Tribunal had recommended the grant offreehold title in respect of each of the claims about which it had presented reports.The Minister has accepted the Tribunal's recommendations in relation to everyreport so far provided.

IV LEGISLATION

25.As at 30 June 2015, the current reprint of the Aboriginal Land Ad 1991 includedamendments in force as at 1 January 2015.

26.During the reporting period, the Aboriginal Land Act 1991 was amended by thefollowing legislation -

(i) the Aboriginal and Torres Strait Islander Land (Providing Freehold) andOther Legislation Amendment Act 2014 (No. 45 of 2014).

The amendments effected by this Act did not affect the claims process.

V ADMINISTRATIVE MATTERS

(a) Staff

27. The part-time staff of the Land Tribunal comprises the Senior Deputy Registrar(Mr Jeff Hobson) and an Executive Assistant (Ms Glenda Jones). Those officersalso serve the Land Court. I thank them for their assistance and support.

(b) Relationship with the Land Court

28. During the year covered by this report, 1 presided over numerous hearings in theLand Court and sat as a Member of the Land Appeal Court.

(c) Administrative arrangements

29. As at 30 June 2015, the following Administrative Arrangements were in place inrespect of the Aboriginal Land Act 1991 pursuant to the AdministrativeArrangements Order (No. 2) 2015;

the Treasurer and Minister for Employment and Industrial Relations andMinister for Aboriginal and Torres Strait Islander Partnerships isresponsible for administering Part 18 of the Act to the extent that it isrelevant to royalties;

the Treasurer and Minister for Employment and Industrial Relations andMinister for Aboriginal and Torres Strait Islander Partnerships is alsoresponsible for administering the Act to the extent that it is relevant to thetransfer of land as Aboriginal land prior to the dedication of national parks(Cape York Peninsula Aboriginal land) under the Nature Conservation Act1992 and associated transfers of land as Aboriginal land;

the Attorney-General and Minister for Justice and Minister for Trainingand Skills is responsible for administering sections 62 to 73; Part 19;sections 286 and 294 as they apply to the provisions of the Actadministered by the Minister and relevant sections relating to the LandTribunal, Land Court, Land Appeal Court and Supreme Court;

the Minister for State Development and Minister for Natural Resourcesand Mines is responsible for administering the Act, except to the extentadministered by the Treasurer and Minister for Employment and IndustrialRelations and Minister for Aboriginal and Torres Strait IslanderPartnerships; and the Attorney-General and Minister for Justice andMinister for Training and Skills.

30. Pursuant to the above arrangements, the Tribunal is to report annually on itsoperations to the Attorney-General and Minister for Justice and Minister forTraining and Skills and provide reports on land claims to the Minister for StateDevelopment and Minister for Natural Resources and Mines.

(d) Budget

31. The Tribunal and the Land Court form part of the Justice Services Division of theDepartment of Justice and Attorney-General. The Tribunal and the Land Courtshare accommodation.

32. The Tribunal's costs for the financial year in question were $17,496.

(e) Accominodation

33.The registry of the Land Tribunal is located at level 8 of the Brisbane MagistratesCourt building, 363 George Street, Brisbane.
