RESOLUTION NO. 4406

A RESOLUTION PROVIDING FOR NOTICE OF A PUBLIC HEARING CONCERNING THE CONSIDERATION OF A REDEVELOPMENT PROJECT PLAN FOR THE PROJECT AREA IN A REDEVELOPMENT DISTRICT AT THE NORTHWEST CORNER OF METCALF AVENUE AND SHAWNEE MISSION PARKWAY WITHIN THE CITY (METCALF CROSSING REDEVELOPMENT TIF PROJECT).

WHEREAS, pursuant to K.S.A. 12-1770 et seq., as amended (the “Act”) and Ordinance No. RD-3198 (the “TIF District Ordinance”) of the City of Overland Park, Kansas (the “City”), and in order to promote, stimulate and develop the general and economic welfare of the City, the Governing Body of the City has previously established a tax increment financing redevelopment district (the “Redevelopment District”), and approved the district plan (the “District Plan”), described in the TIF District Ordinance; and

WHEREAS, a TIF redevelopment project plan (the “Project Plan”) has been proposed for the redevelopment of the project area (the “Project Area”) within the Redevelopment District; and

WHEREAS, the boundaries of the Redevelopment District and the boundaries of the Project Area are described on Exhibit A hereto; and

WHEREAS, a comprehensive feasibility study has been completed which indicates that the benefits, tax increment revenue and other available revenues under K.S.A. 12-1774(a)(1) expected to be derived from the redevelopment project described in the Project Plan are expected to exceed or be sufficient to pay for the redevelopment project costs approved by the City pursuant to the District Plan and the Act; and

WHEREAS, a copy of the Project Plan for the Project Area has been delivered to the Board of County Commissioners of Johnson County, Kansas, and to the Board of Education of Unified School District No. 512, Shawnee Mission, Kansas, all in accordance with the Act; and

WHEREAS, the Planning Commission of the City has reviewed the Project Plan for the Project Area and found and determined that the Project Plan is consistent with the intent of the comprehensive plan for development of the City;

THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF OVERLAND PARK, KANSAS, AS FOLLOWS:

Section 1. A public hearing to consider adoption of the proposed Project Plan shall be held on June 4, 2018, beginning at 7:30 p.m., Central Daylight Saving Time (or as soon thereafter as is practical), at City Hall, 8500 Santa Fe Drive, Overland Park, Kansas. The date of the public hearing is not less than 30 or more than 70 days after the date of this Resolution as required by K.S.A. 12-1772(c).

Section 2. The Redevelopment District was created by the TIF District Ordinance passed by the City Council on March 19, 2018, and effective on March 27, 2018 (the publication date

for the TIF District Ordinance). The boundaries of the Redevelopment District and the boundaries of the Project Area are set forth on Exhibit A attached hereto and incorporated herein by reference. A map of the Project Area is included on Exhibit B attached hereto and incorporated herein by reference.

Section 3. The Project Plan, including a summary of the feasibility study, the relocation assistance plan, and a description and map of the area to be redeveloped, is available for inspection during regular business hours in the office of the City Clerk of the City. There are currently no financial guarantees of the prospective developer of the Project Area.

Section 4. A copy of this Resolution shall be sent by certified mail, return receipt requested, to the Board of County Commissioners of Johnson County, Kansas, and the Board of Education of Unified School District No. 512, Shawnee Mission, Kansas. Copies of this Resolution also shall be sent by certified mail, return receipt requested, to each owner and occupant of land within the Project Area not more than 10 days following the date of adoption of this Resolution. This Resolution (including Exhibits A and B) shall be published once in the official City newspaper not less than one week or more than two weeks preceding the date fixed for the public hearing.

Section 5. This Resolution shall be in full force and effect from and after its adoption.

AN ORDINANCE AMENDING ORDINANCE NO. 5473 AND ADJUSTING SPECIAL ASSESSMENTS ON CERTAIN LOTS, PIECES AND PARCELS OF LAND LIABLE FOR SUCH SPECIAL ASSESSMENTS TO PAY THE COSTS OF IMPROVEMENTS IN THE CITY OF LENEXA, KANSAS, AS AUTHORIZED BY LENEXA, KANSAS (LENEXA LOGISTICS CENTRE NORTH STORM DRAINAGE BENEFIT DISTRICT).

WHEREAS, pursuant to Resolution No. 2015-127 of the City of Lenexa, Kansas (the “City”) adopted on October 6, 2015, the Governing Body has authorized the creation of an improvement district and the construction of the following improvements:

Acquisition and construction of:

(1) an extended wetland detention basin approximately 6.8 acres in size, including BMP’s, wetlands, approximately 27,115 S.F. of modular retaining walls, containment berms, fencing, trees, shrubs and grasses, and other landscaping, related culverts and approximately 160 L.F. of associated storm drainage pipes and related structures;

(2) two turn lanes, including a westbound turn lane on College Blvd. east of Penrose St. and a westbound turn lane on College Blvd. west of Penrose St., associated utility relocation, 6’ wide concrete sidewalk/trail, and related improvements along College Blvd.;

(3) a 12” water main extension of approximately 3,547 L.F., and related structures;

(4) a 8” sanitary sewer extension of approximately 1,746 L.F., and related structures; and

(5) preliminary and final engineering, title and survey, stripping, staking, excavation, grading, irrigation and landscaping, construction supervision, staking, testing, bonds, permits and fees, inspections, financing costs such as bond counsel, financial advisor, bond and interest expenses and other related appurtenances associated with the municipal improvements.

Collectively referred to as the “Improvements”.

WHEREAS, prior to commencement of construction of the Improvements, the City determined the maximum amount of assessment (the “Special Assessment”) against each lot, piece or parcel of land deemed to be benefited (the “Property”) by the Improvements based on the approved estimated of cost of the Improvements of $4,970,000; and

WHEREAS, prior to commencement of construction of the Improvements, the owners of 100% of the Property deemed to be benefitted by the Improvements and for which the Special Assessment was to be levied (the “Property Owners”) were notified of the proposed maximum special assessments and 100% of the Property Owners (a) waived any formal notice of and the holding of a public hearing by the City for the purpose of considering the Special Assessments as required by K.S.A. 12-6a09; (b) consented to the levy of the Special Assessments in twenty (20) annual installments against the Property by appropriate proceedings of the City in the manner set forth in Resolution No. 2015-127 and in the amounts shown in Ordinance No. 5473 Levying the Special Assessments, all without formal or further notice to the Owners; (c) waived any formal additional notice of the final assessment; (d) waived the 30-day statute of limitations provided in K.S.A. 12-6a11; and (e) consented to the City proceeding to issue its general obligation bonds to include the full amount of the Special Assessments all without further delay or notice to the Property Owners; and

WHEREAS, thereafter, on October 6, 2015 the City passed Ordinance No. 5473 levying and assessing the maximum amount of Special Assessment against each lot, piece or parcel of land deemed benefited by the Improvement (the “Original Assessment Ordinance”); and

WHEREAS, the final costs of the completed Improvement is $4,445,000, which is less than the maxi-mum amount of the assessment included in the Original Assessment Ordinance and the Governing Body desires to adjust the Special Assessment previously levied.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LENEXA, KANSAS:

SECTION 1. Pursuant to K.S.A. 12-6a01 et seq., special assessments levied to pay the costs of the Improvements are hereby adjusted based on the final cost of the Improvements and are levied and assessed against the lots, pieces and parcels of land liable therefore as described on Exhibit A to this Ordinance, which is incorporated herein by reference, and in the amounts set forth on Exhibit A following the description of each lot, piece or parcel of land. All other terms and provisions of the Original Assessment Ordinance shall remain in full force and effect.

SECTION 2. The City Clerk shall mail a copy of this Ordinance to each of the Property Owners after its adoption.

SECTION 3. The City Clerk shall certify to the County Clerk, in the same manner and at the same time as other taxes are certified, for a period of twenty (20) years, all of the adjusted special assessments, together with interest on such amount thereof at a rate not exceeding the maximum rate as prescribed by the laws of the state of Kansas; and such amounts shall be placed on the tax rolls and collected as other taxes are collected, the levy for each year being a portion of the principal amount of the assessment plus one year’s interest on the amount remaining unpaid.

SECTION 4. This Ordinance shall take effect and be in force from and after its publication once in the official City newspaper. The City Clerk is directed to file this Ordinance with the Register of Deeds of Johnson County, Kansas.

A RESOLUTION REPEALING RESOLUTION NO. 87-70 REGARDING ACCEPTANCE OF A PETITION EXTENDING A SANITARY SEWER LINE AND AUTHORIZING CONSTRUCTION OF THE SAME.

WHEREAS, in the early to mid-1980’s the City expressed a desire to own and operate a municipal golf course in the city of Lenexa; and

WHEREAS, the City negotiated with Steven and Ronald VanLerberg to potentially acquire certain property located south of 87th Street Parkway and west of the current Canyon Farms Golf Club (the “VanLerberg Property”); and

WHEREAS, the City contemplated constructing and operating a municipal golf course (the “Municipal Golf Course Project”) on the VanLerberg Property; and

WHEREAS, prior to 1993, the City owned and operated its own sanitary sewer treatment plan and on September 3, 1987, the Lenexa Governing Body passed Resolution No. 87-70 which accepted a petition (the “Petition”) to extend a sanitary sewer line (the “Sanitary Sewer Line”) across the VanLerberg Property in preparation for the Municipal Golf Course Project; and

WHEREAS, Resolution No. 87-70 authorized the Sanitary Sewer Line be constructed by special im-provement district pursuant to K.S.A. 12-6a01 et seq. at an estimated cost of $200,000 to be paid City-at-large; and

WHEREAS, the City subsequently: (1) abandoned the Municipal Golf Course Project; (2) failed to ac-quire the VanLerberg Property; and (3) never constructed the Sanitary Sewer Line and therefore never assessed the VanLerberg Property for such improvements; and

WHEREAS, Resolution No. 87-80 was recorded on September 8, 1987 with the Johnson County Register of Deeds at Book 2661, Page 499; and

WHEREAS, Resolution No. 87-80 is clouding the title to the VanLerberg Property because the resolution was never repealed or otherwise removed from the title; and

WHEREAS, Steven VanLerberg reached out to the City requesting assistance in clearing Resolution No. 87-70 from the VanLerberg Property title; and

WHEREAS, the City desires to repeal Resolution No. 87-70 as the Municipal Golf Course Project contemplated over thirty (30) years ago was never pursued and has since been abandoned.

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF LENEXA:

Section One: The City of Lenexa, a Kansas municipal corporation, does hereby repeal Resolution No. 87-70.

Section Two: This resolution shall become effective immediately upon adoption by the Lenexa City Council.

Section Three: After its adoption, the City Clerk is directed to record this resolution with the Johnson County Records & Tax Administration office.

The City of Lenexa, Kansas (the “City”), hereby provides notice that at 7:00 p.m. or as soon thereafter as the matter may be heard on Tuesday June 5, 2018, at the Council Chambers at City Hall, 17101 W. 87th Street Parkway, Lenexa, Kansas, the City will consider adopting a resolution expressing its intent to issue its industrial revenue bonds in one or more series in the aggregate approximate amount of $20,000,000 (the “Bonds”). The proceeds of the Bonds will be used to pay the cost of acquiring, constructing, and equipping a multi-phase development with approximately five retail buildings, including associated site work, utilities and parking facilities in Lenexa, Kansas (the “Project”). The Bonds are proposed to be issued under authority of K.S.A. 12-1740 to 12-1749d, as amended. Notice is given in accordance with K.S.A. 12-1744e that the City intends to issue such Bonds and lease the Project to McKeevers RJB, LLC, a Kansas limited liability corporation (the “Company”). The Company intends to lease portions of the Project to retailers as defined in K.S.A. 79-3602. The Bonds and the interest thereon will not be a debt or general obligation of the City, the state of Kansas or any municipal corporation thereof, and neither the Bonds nor the interest thereon are payable in any manner from tax revenues of any kind or character. AN ORDINANCE AMENDING ORDINANCE NO. 5531 AND ADJUSTING SPECIAL ASSESSMENTS ON CERTAIN LOTS, PIECES AND PARCELS OF LAND LIABLE FOR SUCH SPECIAL ASSESSMENTS TO PAY THE COSTS OF IMPROVEMENTS IN THE CITY OF LENEXA, KANSAS, AS AUTHORIZED BY LENEXA, KANSAS (COTTONWOOD CANYON STREET SPECIAL BENEFIT DISTRICT).

WHEREAS, pursuant to Resolution No. 2015-158 of the City of Lenexa, Kansas (the “City”) adopted on December 15, 2015, the Governing Body has authorized the creation of an improvement district and the construction of the following improvements:

Acquisition and construction of:

(1) a collector road referred to as Mill Creek Road located running from northeast to southwest along the interior of the Improvement District starting at the termination of existing Mill Creek Road and extending northeasterly a distance of approximately 3,275 L.F. to Winchester Street. This road shall be constructed as a two lane, twenty-eight (28) foot wide street from back of curb to back of curb and including concrete curb and gutter and sidewalks, asphalt pavement, street lighting, landscaping, associated utility relocation and associated appurtenances; and.

(2) a road intersecting Mill Creek Road and extending south and southwesterly a distance of approximately 550 L.F. to and including a cul-de-sac (the “Cul-de-Sac Road”). This Cul-de-Sac Road shall be constructed as a two lane, twenty-eight (28) foot wide street from back of curb to back of curb and including concrete curb and gutter and sidewalks, asphalt pavement, street lighting, landscaping, associated utility relocation and associated appurtenances; and

(3) approximately 3,100 L.F. of storm sewer drainage pipes and related structures (manholes, inlets, detention, etc.) related to Mill Creek Road and the Cul-de-Sac Road and associated utility relocation and associated appurtenances; and

(4) preliminary and final engineering, environmental review and mitigation, title and survey, staking, geotech including subsurface mine certification associated with the Improvements and mine surveying, rock removal, retaining walls, grading, erosion control, construction supervision, testing, bonds, permits and fees, inspections, financing costs such as bond counsel, financial advisor, bond and interest expenses and other related appurtenances.

Collectively referred to as the “Improvements”.

WHEREAS, prior to commencement of construction of the Improvements, the City determined the maximum amount of assessment (the “Special Assessment”) against each lot, piece or parcel of land deemed to be benefited (the “Property”) by the Improvements based on the approved estimated of cost of the Improvements of $3,140,000; and

WHEREAS, prior to commencement of construction of the Improvements, the owners of 100% of the Property deemed to be benefitted by the Improvements and for which the Special Assessment was to be levied (the “Property Owners”) were notified of the proposed maximum special assessments and 100% of the Property Owners (a) waived any formal notice of and the holding of a public hearing by the City for the purpose of considering the Special Assessments as required by K.S.A. 12-6a09; (b) consented to the levy of the Special Assessments in fifteen (15) annual installments against the Property by appropriate proceedings of the City in the manner set forth in Resolution No. 2015-158 and in the amounts shown in Ordinance No. 5531 Levying the Special Assessments, all without formal or further notice to the Owners; (c) waived any formal additional notice of the final assessment; (d) waived the 30-day statute of limitations provided in K.S.A. 12-6a11; and (e) consented to the City proceeding to issue its general obligation bonds to include the full amount of the Special Assessments all without further delay or notice to the Property Owners; and

WHEREAS, thereafter, on May 3, 2016 the City passed Ordinance No. 5531 levying and assessing the maximum amount of Special Assessment against each lot, piece or parcel of land deemed benefited by the Improvement (the “Original Assessment Ordinance”); and

WHEREAS, the final costs of the completed Improvement is $2,145,000, which is less than the maxi-mum amount of the assessment included in the Original Assessment Ordinance and the Governing Body desires to adjust the Special Assessment previously levied.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LENEXA, KANSAS:SECTION 1. Pursuant to K.S.A. 12-6a01 et seq., special assessments levied to pay the costs of the

Improvements are hereby adjusted based on the final cost of the Improvements and are levied and assessed against the lots, pieces and parcels of land liable therefore as described on Exhibit A to this Ordinance, which is incorporated herein by reference, and in the amounts set forth on Exhibit A following the description of each lot, piece or parcel of land. All other terms and provisions of the Original Assessment Ordinance shall remain in full force and effect.

SECTION 2. The City Clerk shall mail a copy of this Ordinance to each of the Property Owners after its adoption.

SECTION 3. The City Clerk shall certify to the County Clerk, in the same manner and at the same time as other taxes are certified, for a period of fifteen (15) years, all of the adjusted special assessments, together with interest on such amount thereof at a rate not exceeding the maximum rate as prescribed by the laws of the state of Kansas; and such amounts shall be placed on the tax rolls and collected as other taxes are collected, the levy for each year being a portion of the principal amount of the assessment plus one year’s interest on the amount remaining unpaid.

SECTION 4. This Ordinance shall take effect and be in force from and after its publication once in the official City newspaper. The City Clerk is directed to file this Ordinance with the Register of Deeds of Johnson County, Kansas.

ORDINANCE NO. 5652

AN ORDINANCE AMENDING ORDINANCE NO. 5472 AND ADJUSTING SPECIAL ASSESSMENTS ON CERTAIN LOTS, PIECES AND PARCELS OF LAND LIABLE FOR SUCH SPECIAL ASSESSMENTS TO PAY THE COSTS OF IMPROVEMENTS IN THE CITY OF LENEXA, KANSAS, AS AUTHORIZED BY LENEXA, KANSAS (LENEXA LOGISTICS CENTRE NORTH MILL CREEK ROAD BENEFIT DISTRICT).

WHEREAS, pursuant to Resolution No. 2015-126 of the City of Lenexa, Kansas (the “City”) adopted on October 6, 2015, the Governing Body has authorized the creation of an improvement district and the construction of the following improvements:

Acquisition and construction of:

(1) a north/south road referred to as Mill Creek Road located along the eastern boundary of the Improvement District starting at College Boulevard and extending north a distance of approximately 2,375 L.F. to and including a cul-de-sac. This road shall be constructed as a three lane collector street, forty (40) foot wide from back of curb to back of curb including concrete curb and gutter and sidewalks, asphalt pavement, street lighting, landscaping, approximately 2,300 L.F. of storm sewer drainage pipes and related structures (manholes, inlets, etc.) related to the road, and associated appurtenances;

(2) a westbound turn lane approximately 450’ long including taper, associated utility relocation, 10’ wide concrete sidewalk/trail, and related improvements along College Blvd.;

(3) a traffic signal at the intersection of College Blvd. and Mill Creek Rd.;

(4) a 12” water main extension of approximately 2,262 L.F. along the west side of road, and related structures;

(5) utilities located within the Mill Creek Rd. right of way; and

(6) preliminary and final engineering, title and survey, staking, grading, construction supervision, staking, testing, bonds, permits and fees, inspections, financing costs such as bond counsel, financial advisor, bond and interest expenses and other related appurtenances associated with the municipal improvements.

Collectively referred to as the “Improvements”.

WHEREAS, prior to commencement of construction of the Improvements, the City determined the maximum amount of assessment (the “Special Assessment”) against each lot, piece or parcel of land deemed to be benefited (the “Property”) by the Improvements based on the approved estimated of cost of the Improvements of $3,460,000; and

WHEREAS, prior to commencement of construction of the Improvements, the owners of 100% of the Property deemed to be benefitted by the Improvements and for which the Special Assessment was to be levied (the “Property Owners”) were notified of the proposed maximum special assessments and 100% of the Property Owners (a) waived any formal notice of and the holding of a public hearing by the City for the purpose of considering the Special Assessments as required by K.S.A. 12-6a09; (b) consented to the levy of the Special Assessments in twenty (20) annual installments against the Property by appropriate proceedings of the City in the manner set forth in Resolution No. 2015-126 and in the amounts shown in Ordinance No. 5472 Levying the Special Assessments, all without formal or further notice to the Owners; (c) waived any formal additional notice of the final assessment; (d) waived the 30-day statute of limitations provided in K.S.A. 12-6a11; and (e) consented to the City proceeding to issue its general obligation bonds to include the full amount of the Special Assessments all without further delay or notice to the Property Owners; and

WHEREAS, thereafter, on October 6, 2015 the City passed Ordinance No. 5472 levying and assessing the maximum amount of Special Assessment against each lot, piece or parcel of land deemed benefited by the Improvement (the “Original Assessment Ordinance”); and

WHEREAS, the final costs of the completed Improvement is $2,880,000, which is less than the maxi-mum amount of the assessment included in the Original Assessment Ordinance and the Governing Body desires to adjust the Special Assessment previously levied.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LENEXA, KANSAS:

SECTION 1. Pursuant to K.S.A. 12-6a01 et seq., special assessments levied to pay the costs of the Improvements are hereby adjusted based on the final cost of the Improvements and are levied and assessed against the lots, pieces and parcels of land liable therefore as described on Exhibit A to this Ordinance, which is incorporated herein by reference, and in the amounts set forth on Exhibit A following the description of each lot, piece or parcel of land. All other terms and provisions of the Original Assessment Ordinance shall remain in full force and effect.

SECTION 2. The City Clerk shall mail a copy of this Ordinance to each of the Property Owners after its adoption.

SECTION 3. The City Clerk shall certify to the County Clerk, in the same manner and at the same time as other taxes are certified, for a period of twenty (20) years, all of the adjusted special assessments, together with interest on such amount thereof at a rate not exceeding the maximum rate as prescribed by the laws of the state of Kansas; and such amounts shall be placed on the tax rolls and collected as other taxes are collected, the levy for each year being a portion of the principal amount of the assessment plus one year’s interest on the amount remaining unpaid.

SECTION 4. This Ordinance shall take effect and be in force from and after its publication once in the official City newspaper. The City Clerk is directed to file this Ordinance with the Register of Deeds of Johnson County, Kansas.

AN ORDINANCE AMENDING ORDINANCE NO. 5544 AND ADJUSTING SPECIAL ASSESSMENTS ON CERTAIN LOTS, PIECES AND PARCELS OF LAND LIABLE FOR SUCH SPECIAL ASSESSMENTS TO PAY THE COSTS OF IMPROVEMENTS IN THE CITY OF LENEXA, KANSAS, AS AUTHORIZED BY LENEXA, KANSAS (BRITTON ST. EXTENSION SPECIAL BENEFIT DISTRICT).

WHEREAS, pursuant to Resolution No. 2016-49 of the City of Lenexa, Kansas (the “City”) adopted on April 5, 2016, the Governing Body has authorized the creation of an improvement district and the construction of the following improvements:

Acquisition and construction of:

(1) an eastbound turning lane (including approximately 265’ of storage and taper) and related improvements along College Blvd.;

(2) a main loop road running north to south through the Improvement District starting at a point near the terminus of Britton Street (near current temporary cul-de-sac) and extending north and connecting to College Blvd. a distance of approximately 1,264 L.F. Such main loop road shall be constructed as a forty (40) foot wide street from back of curb to back of curb and include concrete curb and gutter and sidewalks, asphalt pavement, and related storm drainage, street lighting, and landscaping;

(3) utility relocation, preliminary and final engineering, title and survey, staking, grading, rock removal, retaining walls, erosion control, construction supervision, staking, testing, bonds, permits and fees, inspections, financing costs such as bond counsel, financial advisor, bond and interest expenses, property acquisition and other related appurtenances.

Collectively referred to as the “Improvements”.

WHEREAS, prior to commencement of construction of the Improvements, the City determined the maximum amount of assessment (the “Special Assessment”) against each lot, piece or parcel of land deemed to be benefited (the “Property”) by the Improvements based on the approved estimated of cost of the Improvements of $1,513,349; and

WHEREAS, prior to commencement of construction of the Improvements, the owners of 100% of the Property deemed to be benefitted by the Improvements and for which the Special Assessment was to be levied (the “Property Owners”) were notified of the proposed maximum special assessments and 100% of the Property Owners (a) waived any formal notice of and the holding of a public hearing by the City for the purpose of considering the Special Assessments as required by K.S.A. 12-6a09; (b) consented to the levy of the Special Assessments in twenty (20) annual installments against the Property by appropriate proceedings of the City in the manner set forth in Resolution No. 2016-49 and in the amounts shown in Ordinance No. 5544 Levying the Special Assessments, all without formal or further notice to the Owners; (c) waived any formal additional notice of the final assessment; (d) waived the 30-day statute of limitations provided in K.S.A. 12-6a11; and (e) consented to the City proceeding to issue its general obligation bonds to include the full amount of the Special Assessments all without further delay or notice to the Property Owners; and

WHEREAS, the waiver and consent of MEPT College & Renner Corporate Center, LLC was contingent upon the granting of a deferral for special assessments levied on Parcel #IF241318-3001 and Parcel #IF241318-3007 until the earlier of the date each parcel was platted or ten (10) years from the date of publication of Ordinance 5544 on July 26, 2016.

WHEREAS, thereafter, on July 19, 2016 the City passed Ordinance No. 5544 levying and assessing the maximum amount of Special Assessment against each lot, piece or parcel of land deemed benefited by the Improvement (the “Original Assessment Ordinance”); and

WHEREAS, the final costs of the completed Improvement is $1,255,000, which is less than the maxi-mum amount of the assessment included in the Original Assessment Ordinance and the Governing Body desires to adjust the Special Assessment previously levied.

NOW, THEREFORE, BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF LENEXA, KANSAS:SECTION 1. Pursuant to K.S.A. 12-6a01 et seq., special assessments levied to pay the costs of the

Improvements are hereby adjusted based on the final cost of the Improvements and are levied and assessed against the lots, pieces and parcels of land liable therefore as described on Exhibit A to this Ordinance, which is incorporated herein by reference, and in the amounts set forth on Exhibit A following the description of each lot, piece or parcel of land. All other terms and provisions of the Original Assessment Ordinance shall remain in full force and effect.

SECTION 2. The City Clerk shall mail a copy of this Ordinance to each of the Property Owners after its adoption.

SECTION 3. The City Clerk shall certify to the County Clerk, in the same manner and at the same time as other taxes are certified, for a period of twenty (20) years, all of the adjusted special assessments, together with interest on such amount thereof at a rate not exceeding the maximum rate as prescribed by the laws of the state of Kansas; and such amounts shall be placed on the tax rolls and collected as other taxes are collected, the levy for each year being a portion of the principal amount of the assessment plus one year’s interest on the amount remaining unpaid. The City Clerk, when certifying such special assessments to the County Clerk for property receiving a deferral as provided in this Ordinance, shall note thereon the words “payment delayed” for any property receiving a deferral and describe the term of such deferral.

SECTION 4. Pursuant City Code Section 1-9B-4, the special assessments levied on Parcel #IF241318-3001 and Parcel #IF241318-3007 shall be deferred until the earlier of the date each parcel is platted or ten (10) years from the publication of Ordinance 5544 on July 26, 2016. Each parcel shall be required to pay a benefit fee at the time its deferment period ends and such benefit fee shall not exceed the amount of the special as-sessments, including principal and interest, which would have been levied against the parcel from the date of this Ordinance to the date the final special assessment would have been levied against such parcel if the parcels had not received a deferral. Such benefit fee shall be due and payable in one payment at the time the deferment ends. Any benefit fees paid hereunder shall be applied to the remaining principal and outstanding interest on the bonds issued to finance the improvement or, if all bonds issued to pay the cost of the improvements have been paid, to the City’s general fund.

SECTION 5. This Ordinance shall take effect and be in force from and after its publication once in the official City newspaper. The City Clerk is directed to file this Ordinance with the Register of Deeds of Johnson County, Kansas.

A RESOLUTION OF THE CITY OF OVERLAND PARK, KANSAS, PROVIDING FOR NOTICE OF A PUBLIC HEARING CONCERNING THE ADVISABILITY OF THE CREATION OF A COMMUNITY IMPROVEMENT DISTRICT AT THE NORTHWEST CORNER OF METCALF AVENUE AND SHAWNEE MISSION PARKWAY WITHIN THE CITY AND DECLARING THE INTENT OF THE CITY TO LEVY A COMMUNITY IMPROVEMENT DISTRICT SALES TAX PURSUANT TO K.S.A. 12-6a26 ET SEQ. AS AMENDED (METCALF CROSSING CID).

WHEREAS, pursuant to K.S.A. 12-6a26 et seq., as amended (the “Act”), the City of Overland Park, Kansas (the “City”), is authorized to create a community improvement district (“CID”) as provided in the Act to provide for the acquisition, improvement, construction, demolition, removal, renovation, reconstruction, restoration, replacement, repair, furnishing and equipping buildings, structures, facilities, sidewalks, roads, parking lots, traffic signs and signals, utilities, pedestrian amenities, drainage, water, storm and sewer systems, underground gas, heating and electrical services and extensions, water mains and extensions, site improvements, street lights, lighting, street light fixtures, benches, awnings, canopies, walls, trees, landscapes and other amenities and improvements as provided in the Act (collectively, a “CID Project”); and

WHEREAS, upon proper petition, the Act further authorizes the City, in order to pay the costs of a project which is a CID Project, to impose a CID sales tax on the selling of tangible personal property at retail or rendering or furnishing services within a CID in any increment of .10% or .25% not to exceed 2.0% and to finance the costs of a CID Project pursuant to pay-as-you-go financing and/or the issuance of special obligation notes and bonds payable from such CID sales tax; and

WHEREAS, a petition (the “Petition”) has been filed with the City Clerk of the City proposing the creation of a CID, the making of CID Projects relating thereto as more particularly described on Exhibit A attached hereto (the “Project”) and the imposition of a CID sales tax in order to pay a portion of the costs of the Project; and

WHEREAS, the proposed CID is located at the northwest corner of Metcalf Avenue and Shawnee Mission Parkway in the City (the “Metcalf Crossing CID”); and

WHEREAS, the Petition was signed by the owners of record, whether resident or not, of more than 55% of assessed value of the land area contained within the proposed Metcalf Crossing CID and by more than 55% percent of all owners of real property within the boundaries of the Metcalf Crossing CID; and

WHEREAS, if the Metcalf Crossing CID is created by the City and certain further conditions are met, the City intends to impose a one percent (1%) CID sales tax within the Metcalf Crossing CID; and

WHEREAS, the Act provides that prior to creating any CID, the City shall, by resolution, direct and order a public hearing on the advisability of creating such CID and

NOW, THEREFORE, BE IT RESOLVED BY THE GOVERNING BODY OF THE CITY OF OVERLAND PARK, KANSAS, AS FOLLOWS:

1. Notice is hereby given that a public hearing to consider the advisability of the creation by the City of the Metcalf Crossing CID and the imposition by the City of a one percent (1%) CID sales tax within the Metcalf Crossing CID shall be held at the Overland Park City Hall, 8500 Santa Fe Drive, Overland Park, Kansas, on June 4, 2018 beginning at 7:30 p.m., Central Daylight Saving Time (or as soon thereafter as is practical).

2. The general nature of the proposed Project to be completed within the proposed Metcalf Crossing CID is set forth in Exhibit A attached hereto and incorporated by reference herein.

3. The estimated cost of the Project is $3,100,000

4. The Project within the proposed Metcalf Crossing CID will be financed on a pay-as-you-go basis and/or from the proceeds of special obligation notes and bonds payable from revenues received from the imposition of a one percent (1%) CID sales tax on the selling of tangible personal property at retail or rendering or furnishing of taxable services taxable pursuant to the provisions of the Kansas retailer’s sales tax act within the proposed Metcalf Crossing CID. No special assessments will be levied pursuant to the Act to finance the Project.

5. A map generally outlining the boundaries of the proposed Metcalf Crossing CID is attached hereto as Exhibit B and incorporated herein by reference. A legal description of the proposed Metcalf Crossing CID is set forth in Exhibit C attached hereto and incorporated herein by reference.

6. The City Clerk shall give notice of the public hearing in accordance with the provisions of the Act by publishing this resolution at least once each week for two consecutive weeks in the official City newspaper and sending this resolution by certified mail to all owners. The second publication of this resolution shall occur at least seven days prior to the date of hearing and the certified mailed notice shall be sent at least ten days prior to the date of hearing.
