May 5, 2010 Supervisory Committee of the Mobile County Personnel Board Mobile, Alabama Dear Members: As Chairman of the Personnel Board, it is a pleasure to submit on behalf of the entire Board the 70th Annual Report of the Mobile County Merit System as prepared by its’ Director and staff. As I reflect on seventy years of existence as a service institution, it brings me great pride to be a part of this organization. We continue to look for opportunities to partner with all our constituents as we move towards the future. There have been significant changes over the last seventy years which require a proactive look at employment practices with an eye toward efficiency and effectiveness. Currently, we are facing difficulty with our national, state, and local economies. Many of our leaders are facing critical decisions to address the rapidly changing economic landscape. The Personnel Board stands ready to partner with all our constituents to ensure a successful outcome as we work through these difficulties. The Personnel Board and Staff thank you for your continued support. Again, we ask that you constantly engage with us as we work to improve our Merit System. Chairman and Members The Personnel Board for Mobile County, Alabama Dear Members: As a community we continue to face economic uncertainties. Accordingly, our

department will make prudent spending decisions to respond to these economic challenges

faced by all of us. Our goal is one of continuous improvement as we continue to focus on our

internal processes. We have embarked on a process that will further enhance our job

classification content and testing systems. We continue to look for ways to add value to all our

customers, and welcome your suggestions.

Our training offerings continue to increase as we respond to employee and agency

training needs. We will continue to provide training offerings within our budgetary capability.

Our payroll department audited and processed in excess of $223,000,000 dollars of combined

payrolls annually.

We have experienced a significant increase (14.2%) in the number of applicants this

year {8,705 v. 7,619}. This increase may be attributed to the overall downturn in the local and

national economies resulting in increased unemployment.

There were 937 examinations (open competitive, promotion) and 1,088 tests (written,

oral, appraisal, demonstration) administered in 2009. This represents a significant amount of

activity within our department as we have taken selective opportunities to not replace attrition.

Additional areas of positive results:

• An increase in number of successful applicants – 4,840 versus 4,357 (~11% increase) • An increase in number granted veteran’s preference – 390 versus 345 (~13% increase) • An increase in number of positions filled within the merit system – 5,827 versus 5,741

PERSONNEL BOARD

At the annual meeting of the Supervisory Committee held June 9, 2009, the Committee

re-elected Ms. Annie Galloway as Board Member Number Two to represent Personnel Board

District Two.

Mr. Sydney Raine currently serves as Chairman and Mr. William Bridges serves as Vice-

Chairman of the Personnel Board.

The Board held 12 regular meetings and 18 special meetings during 2009, including 23

meetings at which public hearings were held, for a total of 30 meetings. The Board also held 26

public hearings on disciplinary matters.

HEARINGS ON APPEALS

During the year 2009 the Board held eleven hearings on appeals from dismissal. The

Appointing Authority was upheld completely in five cases. Four hearings convened and

settlement agreements were read into the record. At one hearing the employee did not appear

so the appeal was dismissed for want of prosecution. One hearing convened but was continued

until January 2010. The Board rendered two orders that carried dissenting opinions. Two

decisions were appealed to Circuit Court.

There were ten suspension hearings held by the Board. The Appointing Authority was

upheld completely in three cases and three appeals were settled during the hearings. The

suspension was set aside completely in one case, the length of the suspension was altered in

one case, and one appeal was withdrawn after the hearing convened. The Board held one

hearing for two employees whose suspensions arose out of the same incident and the period of

suspension for both employees was modified.

Two hearings held by the Board were for appeals from demotion. In one case the

Appointing Authority was upheld and in one case the employee withdrew his appeal after the

hearing convened.

The Board convened two hearings that involved both an appeal from suspension and an

appeal to step three of the grievance procedure for each employee. The Appointing Authority

was upheld in both hearings.

The Board held one hearing that was an appeal to step three of the grievance

procedure. The grievance was settled during the hearing.

GRIEVANCES

During the year 2009 there were thirty grievances filed. A total of twenty-four were

settled at the first step hearing. Of the six grievances that were taken to the second step

hearing, the grievant prevailed in one case and five were upheld in favor of the department. Of

these grievances, two were processed to the third step before the Personnel Board.

Listed below is a summary of all court cases filed or continuing in 2009. The Attorney

and Assistant Attorney for the Board also rendered legal opinions on the application of laws,

rules and regulations, and conducted hearings on appeals from dismissal, demotion,

suspension and grievances.

MARK NENO v. THE CITY OF MOBILE and MOBILE COUNTY PERSONNEL BOARD (Case No. CV-08-0435) Mark Neno filed his complaint on February 28, 2008 demanding among other claims,

declaratory judgment on whether he was entitled to seventy-five percent (75%) of his

accumulated sick leave pursuant to MCPB Rule 3.5(C)(a) after he resigned/retired from his

Merit System employment after having opted out of the City of Mobile Police and Firefighters

Pension Fund. The matter settled, and was dismissed on April 6, 2009.

RAYMOND J. SHELLY v. MOBILE COUNTY PERSONNEL BOARD and the CITY OF BAYOU LA BATRE POLICE DEPARTMENT On December 22, 2008 Shelley appealed the December 16, 2008 Personnel Board

Order affirming his termination as a Police Corporal with the City of Bayou La Batre Police

Department. The transcript, exhibits, and Board Order were filed with the Circuit Court. On July

24, 2009 the Honorable Charles Graddick dismissed the appeal due to Mr. Shelly's failure to

pay the filing fee to the Circuit Court.

MOBILE CITY COUNCIL v. MOBILE COUNTY PERSONNEL BOARD (Case No. CV-08-9018.70) The City Council has sued the Personnel Board over which entity has discretion to

approve the salary of the City Clerk. The case turns on construction of Personnel Board Rule

5.2(b). The case is pending and is set for bench trial June 16, 2010.

MOBILE COUNTY PERSONNEL BOARD v. WATER WORKS & SEWER BOARD OF THE CITY OF PRICHARD (Case No. CV-09-902154) This is a complaint for Declaratory and Injunctive Relief brought by the Mobile County

Personnel Board seeking a declaration that The Water Works and Sewer Board of the City of

Prichard cannot terminate or otherwise impair the civil service status of its employees by

transferring the operation and management of the utility to a private company.

The hearing on the Motion for Preliminary Injunction was heard and denied by the

Honorable John Lockett on November 25, 2009. The matter is currently pending a hearing date

on the merits.

GERALD ROBERTS v. MOBILE COUNTY PERSONNEL BOARD & THE MOBILE COUNTY SHERIFF’S OFFICE (Case No. CV-09-1590) On July 1, 2009 Gerald Roberts appealed the Board's Order of June 30, 2009 which

affirmed his termination by the Mobile County Sheriff's Office. The certified transcript of the

proceedings before the Board was filed in the Circuit Court on August 19, 2009. The matter is

pending before the Honorable Sarah Stewart for legal argument.

CHRISTOPHER BELL v. MOBILE COUNTY PERSONNEL BOARD & THE CITY OF MOBILE (Case No. CV-09-1646) On August 25, 2009 Christopher Bell appealed the Board's Order of August 11, 2009

which affirmed his termination by the City of Mobile. The certified transcript of the proceedings

before the Board was filed in the Circuit Court on September 22, 2009. Legal briefs have been

filed, and the matter is pending hearing before the Honorable Michael Youngpeter.

CLEON JONES v. MOBILE COUNTY PERSONNEL BOARD & THE CITY OF MOBILE TRAFFIC ENGINEERING DEPARTMENT On December 1, 2009 Cleon Jones appealed the Board's Order of November 23, 2009

which affirmed his termination by the City of Mobile Traffic Engineering Department. The

certified transcript of the proceedings before the Board was filed in the Circuit Court on February

11, 2010. On April 13, 2010 the Honorable Charles A. Graddick granted a Motion to Dismiss

after Jones failed to pay the filing fee for his appeal.

AMENDMENTS TO THE LAW

There were no amendments to the Law during 2009.

There were no amendments to the Rules during 2009.

PROMOTIONS

There was one promotion requested by the Appointing Authorities under Rule 9.6 in

2009. This rule provides that in a situation where there is only one employee in a department

who meets the qualifications for the promotional position, that employee may be considered for

promotion without examination.

There were 267 promotional appointments resulting from 143 promotional examinations

processed in 2009.

CLASSIFICATION AND PAY

The Personnel Board adopted specifications and salary grades for fifteen new classes in

2009. In addition, the Board approved amendments to the pay plan for already existing classes

as well as revisions to fifteen existing specifications. The City of Citronelle amended their pay

plan from Plan CB to Plan BB which represented a 2.5% increase effective November 21, 2009.

The Mobile Housing Board granted their employees a 2.5% cost of living increase effective

January 9, 2010.

VETERANS

A total of 560 employees received paid leave to participate in military training during

2009. At the beginning of the calendar year 2009, fourteen of our Merit System employees

were still on military leave and thirty-three additional employees were granted leave during the

year. Seventeen employees safely returned to their job during the year, leaving thirty

employees still out as of December 31, 2009.

Also, extra points were awarded to 390 veterans who applied for open competitive

examinations during 2009.

TRAINING The Department’s training area provides support and opportunities to the jurisdictions

and the public through its role in training system employees and recruiting new personnel. The

area is responsible for employee training, employee development incentive reviews,

recruitment, publications and typing/dictation proficiency testing. Shown below are specific

responsibilities and a summary of activity within those areas:

Conduct typing and dictation proficiency tests

Scheduled Training: Four hundred nineteen (419) employees participated in approximately 85 training programs that included both instructor-led and on-line training. Multiple enrollments brought total participation to 634. There were 139 job classes and 15 jurisdictions represented. Special Program: 141 employees participated in one or a combination of programs designed to prepare employees to attain their Commercial Drivers License. Employees from seven jurisdictions participated. Jurisdictional Training: (on-site training): 109 participants New Employee Orientation Sessions: 11 sessions / 303 participants

A combined 158 employee development incentives were reviewed and approved for employees of the City of Mobile, Mobile Public Library and the Mobile County Emergency Management Agency.
