OBSERVATIONS OF THE HOUSTON PORT BUREAU

LAW JUDGE RULES IN FAVOR OF PORT BUREAU: Anadministrative law judge from the Interstate CommerceCommission acted on a motion filed by the Houston PortBureau, which requested the Port Bureau an otherprotestants in the Houton Switching Case be served withcopies of any exhibits or other documentary evidence offeredin rebuttal by the railroad respondents at additional hearingsheld in Washington, D.C., on December 3, 1979, at leastthree weeks in advance of that date. The Bureau alsorequested access to any and all underlying data relied on bythe respondents’ witnesses for their rebuttal testimony. As aresult of this order, the respondent rail carriers served suchcopies on the protestants, including the Houston PortBureau, by November 13, 1979, and all protestants wereallowed to have access to any underlying studies which wererelied Upon by railroad witnesses in their rebuttal testimony.

ICC ACTS ON PORT BUREAU’S PETITION: The InterstateCommerce Commission, as a result of a petition filed by theHouston Port Bureau, has decided to exempt ex-water trafficfrom the Commission’s investigation into improvement ofTOFC/COFC regulation. The Commission in Ex Parte 230(Sub. No. 5) Practices of Carriers Involved in the IntermodalMovement of Containerized Freight; Improvement ofTOFC/COFC Regulation had proposed to exempt fromregulation, either in whole or in part, all-rail transportation ofTOFC/COFC shipments in order to provide quicker andeasier procedures, allowing motor carriers to begin suchservice, including affiliations with railroads, and would set-upa "zone of reasonableness" which would allow motor carrierrates within that zone to be raised or lowered at will. TheCommission also proposed changing current interchangeregulations with rail carriers and clear up specific rules orprocedures allowing motor contract carriers to substitute railservice for all motor services. The Port Bureau urged theCommission to exempt all ex-water traffic from theproceeding as it would be detrimental to the Port of Houston’sinvestments in container facilities and would possibly lead toincreased rail rates within western territory. The Bureauclaimed also such deregulation would only increase the ratesmore and cause a greater loss of TOFC/COFC traffic to theHouston area.

Ice ISSUED WARNING AGAINST DEREGULATION: TheInterstate Commerce Commission has been warned againstadditional administrative deregulation of the trucking industryby Senator Howard W. Cannon. Senator Cannon, acting inhis capacity as chairman of the Senate Commerce Scienceand Transportation Committee, urged the Commission to notmake certain types of policy changes before Congress isallowed to act legislatively on trucking reform. SenatorCannon warned the Commission against new policies whichwould cause major changes in the trucking industry or affectcurrent interrelationships between carriers. Some examples ofsuch policies would be a major change in the rate structure

between regulated carriers. Also, the Senator urged theCommission not to make any policies which would treatvarious areas of the motor carrier industry different than otherareas unless having a very good and overwhelming reason todo so. He did state, however, that he would not wish toprejudge any policy decisions made by the Commission orwhich might be made. It is felt that current ICC Chairman, A.Daniel O’Neal, and Chairman-designate, Darius Gaskins, willfollow Senator Cannon’s advice to some degree; however, itis also expected that the Commission’s current proceeding,MC-135, Master Certificates, which is intended to ease entryinto specialized hauling fields, will continue as an information-gathering proceeding. The Port Bureau has written SenatorCannon commending him on this statement.

RAILROAD REFORM BILL INTRODUCED: SenatorHoward M. Cannon (D-Nevada) has introduced his longawaited bill on rail regulatory reform. This new Bill S-1946was introduced on October 29, and was the subject ofhearings on November 7th, 8th and 9th. This bill is entitled"The Railroad Transportation Policy Act of 1979." This billwill amend the Interstate Commerce Act, by adding a new railtransportation policy giving rail carriers additional flexibility intheir rate-making process; by having the carriers rely more oncompetitive market forces, avoid undue concentration ofmarket power, reduce problems of entry and exit, maintainfair wages and safe working conditions and encourage safetransportation operations. The policy also urges theCommission to encourage reasonable rates fortransportation, maintain the undue discrimination anddestructive competition portions of the current Act, andeliminate uncompensatory rail rates and promote energyconservation. The policy also urges the Commission to bereceptive to public needs and issue quick decisions.

A rate flexibility zone proposed, would allow carriers toraise their rates by 4% in a year, within the zone, withoutbeing subject to Commission suspension or investigation; butwith a five year maximum of 12%. The Commission mustfind also that no rate authorized under the cost provision willexceed a reasonable maximum rate. The Commission is alsoto check the carriers overall revenue levels, and report toCongress every three years on needs to modify the rateprovision sections if necessary. Although the bill does notcontain any changes for joint rates and through rates, ananalysis of the bill had a compromise to allow a carrier topublish a surcharge which would increase earnings over anyspecific route to a level covering its variable cost of handlingtraffic under a joint-rate, without concurrence of anyconnecting carriers. The surcharge would be applied in equaldollar amounts to all of the carriers’ routes covered by therate; and to all competing single-line routes with all increasesoccurring solely to the carrier publishing the surcharge.

Before increasing the rate, however, the carrier must giveother carriers forty-five days’ notice to respond to such asurcharge and allow the other carrier to initiate its ownsurcharge, no less than twenty-five days before the effectivedate of the original rate.

Ship Wakes CauseLittle Erosion

Ship generated waves arecontributing very little, if any, toshoreline erosion in upper GalvestonBay, according to a report presented tothe Texas section of the AmericanSociety of Civil Engineers at a recentmeeting.

Prepared by Dewey H. Brunt III,Coastal and Navigation PlanningSection of the U.S. Army Corps ofEngineer’s District Office, and JerryR. Rogers, Associate Professor,Department of Civil Engineering,University of Houston, thecomprehensive report was based on astudy at Shoreacres on the Westernshore of Galveston Bay.

That particular site was selectedbecause of an erosion problem that hasbeen observed for many years. Theaverage energy arriving at the shorelineper hour was calculated for wind andship generated waves over a period offive months. Recordings were madewhen a ship passed the study site andthe Coast Guard’s Vessel TrafficService supplied information on thesize and speed of the ship.

No waves were recorded fromoutbound ships and the largest wavefrom an inbound ship was .4 of a foot.Most of the inbound readings were inthe range of .1 to .2 feet, which led tothe conclusion that erosion at that siteis mainly due to wind-generated waves.

The largest barge load of marine cargocontainers ever to sail into the Port of Houstondocked here recently. The 689 emptycontainers were brought here from Cristobal,Panama by CTI-Contoiner TransportInternational, Inc., a leasing company, in orderto meet heavy year-end market demands bysteamship lines. "This is the third time sinceJune that CTI has moved empty containers intothe Port of Houston in order to meet the needsof containership operators here," said GaryBlack, CTI’s District Manager for Houston. Henoted that a considerable amount ofcontainerized cargo is shipped into Houstonand that once this cargo is unloaded, thecontainers are available to steamship lineswith outbound traffic. This is how most of thecontainer demand is satisfied at the Port, hesaid, but sometimes the demand exceeds thesupply of containers that become available inthis way. "We will continue to reposition emptycontainers to Houston when this happens," saidMr. Black. Unloading af the barge began at 7A.M. Manday. Before unloading wascompleted at 1:30 P.M. Tuesday, more thanhalf the containers had been committed tovarious steamship lines. The barge was towedinto port by the Tugboat Drew Foss, which isowned and operated by Dillingham Maritime ofSeattle, Washington. Dillingham’s HoustonAgent is Eller Company. CTI owns and operatesthe world’s largest fleet of marine cargocontainers--250,000 20-foot equivalent units(TEU). It also operates a pool of 20-footinternational air cargo containers. Thecompany maintains offices and depots in morethan 34 countries on six continents.
