2.3 When,duringthesameportcall,ashipsuccessivelydisembarksortranshipscargoorpassengersindifferentpartsoftheport,itonlypaysportduesonce,intheberthingzoneinwhichtherateisthehighest.Theshiptypeandadjustmentsandreductionstowhichitisentitledarecalculatedonthebasisofthetotaltonnageunloadedortranshippedduringtheportcall.Thesameprovisionsapplywhenduringthesameportcall,ashipsuccessivelyembarksortranshipscargoorpassengersindifferentpartsoftheport.

2.4InaccordancewithArticleR.*212-6oftheFrenchSeaportCode,duesonshipsareappliedseparatelyforvesselarrivalsanddepartures.

2.4.1Whenashipdoesnotdisembarkortranshipcargoorpassengers,theduesarecollectedonlyonceonarrival.Whenashipdoesnotembarkcargoorpassengers,theduesarecollectedonlyonceondeparture.Whenavesselonlycarriesoutbunkeringorchandleringoperations,orwhenitonlydisposesofoperationalwasteorcargoresidueswithoutcarryingoutcommercialoperations,thefeeisappliedonlyonce,ondeparture.

2.4.2Whenavesselonlycarriesoutbunkeringorchandleringoperationsorunloadingusedship-generatedliquidwaste(deballas-ting,wastewater,tankwashingwater,slops,washingwater,wasteoil,cargoresidue)whetheratdockorintheroad,theduesappliedarec 0.10percubicmetreper24hoursduringpumping.Shipsperformingshiprepairoperations,beforeoraftertheseoperations,willbebilledthereducedrateofc0.05/m3underthesametermsandconditions.Over72hours,thelay-upfeeassetdowninarticle14isapplied.

2.5PursuanttotheprovisionsofarticleR*212-5oftheFrenchSeaportCode,portduesarenotappliedtothefollowingships:vesselsdedicatedtoshipassistance,especiallypiloting,towage,mooringandsalvageservices,vesselsdedicatedtowastecollectionandpollutioncontrol,vesselsdedicatedtomaintenancedredging,maritimesignalling,fire-fightingandadministrativeservices,vesselssubjecttocompulsoryentryintotheportwhichdonotcarryoutanycommercialoperations,vesselswhichareunabletoaccessaportfacility,andwhicharethereforeobligedtocarryoutdisembarking,embarkingortranshipping

operationsoutsidetheport,forvesselsonculturalorhumanitarianmissions,orthosethatinsomewaybenefitthemaritimeheritage,theMFPAmaywaiveany

duesatitsdiscretion.

2.6PursuanttotheprovisionsofarticleR*215.-1oftheFrenchSeaportCode:Theminimumportduesapplicablearesetatc 212perdeclaration.Theportduescollectionthresholdissetatc 106perdeclaration.

2.7Vesselsthatoperateonregularlines,andwhoseloadingorunloadingoperations(inwardoroutward)consistofaminimumof90%containercargo,areeligibleforthesametariffconditionsthatapplytotype9vessels.

2.8Type8vesselsoperatedonregularlinesservingonlyportsintheEuropeanUnionwillbechargedthereducedrateofc0.0934/m3whenover50%ofthetonnageloadedorunloadediseithergoingtoorcomingfromacountryoftheEU.

2.9Shipsoftype1and2cannotbeclassifiedinanothercategorybecauseofthenatureoftheirloads.

2.10Shipsoftype3,4,5,6and9aspreviouslydefinedcannotbegrantedthereductionsforshipsoperatingonregularlineslistedinarticle4ofthistariff.

2.11Anyshipsofwhichatleast80%ofthetonnageloadedorunloadedperoperation(enteringorleaving)consistsofcars(involvedinacommercialtransaction),willbenefitfromthesametariffconditionsascar-carriers.

2.12ShippinglinesservingCorsicabenefitfromthefollowingreducedrate,dependingontypeofship,whenmorethan50%oftheloadingorunloadinghasCorsicaasitsfinaldestinationorinitialoriginrespectively:-type2ferryboats:c0.0198uponentryandexit,-type8rollon/rolloffcargoships:c0.923uponentryandexit.

2.13Vesselsforwhichthesulphurcontentofthemarinefuelusedtoproduceelectricalenergyduringthecallattheportiszerowillbeentitledareductionof20%onthePortDuesforShips.

3.3Theadjustmentsin3.1and3.2abovedonotapplytoshipscallingonlyforsuppliesandbunkersorfordischargingoperatingwasteorcargoresidues.

article4:adjustmentsaccordingtothenumberofcallsProvisionswithrespecttoadjustmentsapplicablebasedonthefrequencyofcallstotheportareprovidedforbyvirtueoftheVinArticleR.*212-7oftheFrenchSeaportCode(OptionalprovisionsatthediscretionofthePortofMarseilleAuthority).

4.1Forshipsonregularshippinglinesplacedatthepublic'sdisposalaccordingtoarouteandascheduledefinedinadvance,theratesofduesontheshiparesubjecttothefollowingreductions,accordingtothenumberofdeparturesbythelineduringthecalendaryear.

1°Type8shipsoperatedonregularlinesservingonlyportsintheEuropeanUnion,theratesofduesontheshipwillbesubjecttothefollowingreductions: for lines with more than 5 departures per week: a reduction of 50% from the first call.for lines with more than 7 departures per week: a reduction of 80% from the first call to the 500th departure, a reduction of 85% from the 500th departure.

2°Forothershipsonregularshippinglines(excepttype9vessels):

from the first to the twelfth departure inclusive: 0% from the thirteenth to the twenty-fifth departure inclusive: 15% from the twenty-sixth to the fiftieth departure inclusive: 30% from the fiftieth departure: 45%

4.2ThereductionsprovidedforinthisarticlecannotbecombinedwiththosementionedinArticle3.WhentheshipalsosatisfiestheconditionsofArticle3,itbenefitsfromthemostadvantageousreduction.

article5:FlaterateduesProvisionsrelativetoArticleR.*212-11oftheFrenchSeaportCode(Optionalprovisions).

IfnewconnectionsareopenedforshipsinvolvedintheseatransportofpassengersandcargoontrailersbetweentheMemberStatesoftheEuropeanUnionorpartiestotheEuropeanEconomicAreaagreement,theduesontheshiparereplacedforamaximumperiodofthreeyears,byaflatratefeedeterminedforthewholeoftheiractivityforagivenperiodandpaidforinproportiontothetimeinvolvedininstalmentseverythreemonthsatthemost.

Therulesforapplyingthisarticleareasfollows:Flatrateofc 1,500permonth,inaccordancewiththe1stparagraphofArticle5,for36months.NB: Eligibility for the flat rate will be studied by the Marseille Port Authority after the line is registered with Customs.

Areductioninduesisaccordedbasedontheturnovergeneratedbytheships.

FortheEasterndocksarea(ZoneA),accordingtothevolumeof(fullandempty)containertrafficandthenumberofcallsmadeduringthecalendaryearwiththeminimumtrafficthresholdsetat2,500TEU.

FortheWesterndocksarea(ZoneB),accordingtothevolumeof(fullandempty)containertrafficduringthecalendaryearwiththeminimumtrafficthresholdsetat5,250TEU.

Thiscommercialincentiveappliestoallcontainertrafficinthecalendaryear,fullandempty,atthecustomer’srequestbeforethe30thJunefollowingthereferencetrafficyear.

13.1 Foreachdeclaration,theduesshownintable1inarticle11ofthistariffshallbecollectedonthetotalweightofthecargobelongingtoasamecategory.

a)Theyarepaid:9 permetricton,whenthechargeableweightisover900kg,9 per100kg,whenthechargeableweightisequaltoorunder900kg.

Anyfractionofatonorof100kgiscountedasoneunit.Theduesfor100kgareequalto1/10thoftheduesforonemetricton.

b)Withtheexceptionofframes,containersandpallets,packagingproductsareusuallychargedaccordingtothesamerateasthecargotheycontain.However,whenacustomsdeclarationconcernscargoinseveralcategories,allthepackagingproductsareautomaticallyclassifiedintotheprevailingcategoryinweight.

1.1Duesontheshipandanylay-upduesaswellastheduesonship-generatedwastearepayablebytheshipowner.

NB: This aid for development applies only to containerised traffic. Thus, a correcting coefficient is applied for mixed transport: net tonnage of containerised cargo / overall net tonnage. Only shipping lines making calls and generating turnover for MFPA are eligible for this measure. Consequently, within the scope of alliance, each shipping line will receive the discount corresponding to the port dues concerning it, and the members of the alliance share the measure between themselves where applicable. To apply this price reduction, calculated on the basis of annual containerised traffic volumes and the number of calls to the port in the calendar year N*, must be the subject of a written claim from the customer or user, accompanied by the documents required for payment (bank account details, attestation from represented ship owners authorising the collection of the amount concerned) at the latest by 30 June of the year N+1.* The volumes are defined on the basis of the port’s Escale V2 software.

3 Dues on passengers
