Notice of Schedule of Charges

THE following charges apply to the use of Parafield Airport:(a) Landing Charge:

(i) For each aircraft weighing more than 10 000 kg MTOW, a charge of $5.72 per 1 000 kg MTOW pro rata.(ii) For aircraft landing at Parafield Airport for the purposes of undergoing substantial maintenance or for storage within

leased premises on the airport and weighing less than 10 000 kg MTOW, a single charge of $5.34 per 1 000 kg MTOWpro rata.

(iii) For the purposes of an aircraft undergoing substantial maintenance, evidence in the form of a Substantial MaintenanceClaim Form must be submitted to the Credit Controller at PAL within 24 hours of the aircraft landing at ParafieldAirport. If PAL is not notified of an aircraft landing for substantial maintenance within 24 hours then a daily charge of$5.34 per 1 000 kg MTOW pro rata will be levied in addition to the landing charge.

(b) General Aviation Access Charge (GAAC)For each aircraft not covered by (a) above or by the discount in (c) below, GAAC charges of $5.34 per 1 000 kg MTOW prorata per day or part of a day, where payment is made in advance, charges with an effective discount rate are as follows:

PURSUANT to section 37 of the Environment Protection Act1993 (hereinafter called ‘the Act’) I, Tony Circelli, Delegate,Environment Protection Authority do hereby exempt HansenYuncken Pty Ltd (hereinafter called ‘the exemptee’) from theapplication of the Environment Protection (Industrial Noise)Policy 1994 (hereinafter called ‘the Industrial Noise Policy’) inrespect of the construction activities (hereinafter called the‘aforesaid activity/ies’) to be undertaken at the site known as TheSquare, 22 Liberman Close, Adelaide (hereinafter called the‘aforesaid site’) between the period 1 December 1998 to 31October 1999, subject to the following conditions:

1. The exemptee shall nominate to the EnvironmentProtection Agency (hereinafter called ‘the Agency’):

(a) a person (hereinafter called ‘the nominated person’)with the appropriate expertise and responsibility inrespect of the aforesaid activities, to be available forconsultation with the Agency during the above-mentioned period, at which time noise could beemitted and,

(b) a means of contacting the nominated person at allhours and at all days, to the satisfaction of theAgency.

2. The exemptee or the nominated person shall comply withall reasonable instructions in relation to the emission of noiseprovided to the exemptee or the nominated person, by anauthorised officer (for the purposes of the Act) of the Agency.

3. The exemptee shall provide free access to the aforesaidsite to all officers of the Agency for the purpose of measuringor assessing noise levels at the aforesaid site.

4. Excessive noise as a result of construction activity ispermitted only between the hours of 7 a.m. and 5 p.m.,Monday to Friday inclusive, 8 a.m. to 5 p.m. on Saturday, and9 a.m. to 4 p.m. Sunday.

5. At all other times, noise emissions from the constructionsite must comply with the Environment Protection Act andEnvironment Protection (Industrial Noise) Policy 1994.

6. The exemptee will maintain a Complaints Logbook(hereinafter called ‘the aforesaid logbook’) which will contain:

• the name and address of the complainant;• the time and the date that the complaint was received;• a description of the complaint;• the activity/ies and any associated equipment which

gave rise to the complaint; and• the action, if any, taken by the exemptee.

7. The exemptee will make freely available the aforesaidlogbook to all authorised officers of the Agency.

8. Compliance with the requirements of the above conditionswill satisfy the general environmental duty under section 25 ofthe Act in relation to the form of pollution concerned,namely, noise.

FISHERIES ACT 1982: SECTION 59TAKE notice that the notice made under the Fisheries Act 1982dated 22 January 1999 referring to the taking of pilchards andpublished in the Government Gazette of 27 January 1999 at page578 (such notice being the first notice appearing on that page) isrevoked.Dated 4 February 1999.

FISHERIES ACT 1982: SECTION 59TAKE notice that, pursuant to section 59 of the Fisheries Act1982, M. Forster, P.O. Box 154, Port Lincoln, S.A. 5606, or hisnominated replacement approved by the Director of Fisheries(hereinafter referred to as the ‘fisher’) is exempt from section 41of the Fisheries Act 1982, subject to the conditions contained inSchedule 1 to this exemption, in that they shall not be guilty ofan offence when using a fine mesh purse seine net as described inSchedule 2 for the taking of pilchards (Sardinops neopilchardus)and other species within the Families Clupeidae and Engraulididae(hereinafter referred to as the ‘permitted species’) for thepurpose of trade or business in marine waters of South Australia asdescribed in Schedule 3 as Area A and Area B (hereinafter referredto as the ‘permitted activity’).

SCHEDULE 11. The fisher may engage in the permitted activity from

28 February 1999, or until revoked by the Director of Fisheries.2. This exemption is valid only in respect of the fishing vessel

Pinta 3 (hereinafter referred to as the ‘permitted boat’) registeredon the fisher’s Marine Scalefish Fishery Licence No. M329.

3. The fisher must be on board the permitted boat at all timeswhile the boat is being used for the purpose of engaging in thepermitted activity.

4. Whilst using a nominated master to take pilchards pursuantto this notice, no other fishing activity shall be undertaken by thelicence holder pursuant to Marine Scalefish Fishery Licence No.M329.

5. Whilst engaged in the permitted activity the fisher shall notuse any of the devices registered on the fisher’s Marine ScalefishFishery Licence.

6. The fisher must not take or be in possession of any otherspecies of fish, other than the permitted species, while engagingin the permitted activity.

7. Any fish, which are not permitted species, taken as by-catchby the fisher during the permitted activity must be immediatelyreturned to the water.

8. The fisher shall not, during the period 1 January 1999 to28 February 1999, take a quantity of permitted species whichexceeds his quota of 43.45 units at 2.571 tonnes per unit (whichis equal to 111.714 tonnes).

9. The fisher may with the prior approval of the Director ofFisheries transfer uncaught units of quota during the period of thisnotice.

10. Fish taken pursuant to this notice as the result of a transferof quota must be taken in the area as described (and disposed of asdescribed) in the permit conditions of the holder of the initialallocation.

11. The fisher may transfer catch taken pursuant to this noticeto a carrier boat at sea subject to nominating the boats inadvance.

12. The fisher may nominate no more than two carrier boatsat any one time. Notification of boat name must be provided tothe person or agency responsible for conducting quota monitoringoperations.

13. Where the fisher transfers all or part of his catch to acarrier boat that portion of the catch must be accompanied by aSouth Australian Pilchard Fishery Log Book, completed asrequired by condition 16 of this notice.

14. The fisher must notify the person nominated for quotamonitoring, by telephone, of the intended place of any unloadingand the estimated weight of the catch at least one hour prior tothe unloading taking place.

15. The fisher must provide the person nominated for quotamonitoring with reasonable access to boats and vehicles for thepurpose of enabling inspection of the catch and any recordrelating to the South Australian Pilchard Fishery Log Bookrequired to be completed under this notice.

16. The fisher must complete the South Australian PilchardFishery Log Book as described below:

(a) Unloading to a shore based processing plant:(i) The fisher shall complete all columns of the South

Australian Pilchard Fishery Log Book up to but notincluding the column titled PILCHARDTONNAGE CAUGHT.

The fish can then be dispatched to the shore based processingplant. It is the responsibility of the fisher to make certain that allfish are accurately weighed within 24 hours of the consignment tothe processor:

(ii) The fisher shall upon being notified by theprocessor of the total weight of fish unloadedcomplete the columns headed, PILCHARDTONNAGE CAUGHT, OTHER SPECIES,TONNAGE CAUGHT (This refers to otherspecies) and REMARKS .

For any unloading, if fishing has taken place on more than oneday then this should be noted and the verified weight split as closeas possible to reflect the actual quantities taken on each day offishing.

(b) Unloading at sea or direct to a tuna cage:The fisher shall complete all columns of the South

Australian Pilchard Fishery Log Book immediately aftercapture and include an estimated tonnage in thecolumn marked PILCHARD TONNAGE CAUGHT.The estimated tonnage should be based on a recordednumber of boxes of a certain capacity (weight) filled.

FISHERIES ACT 1982: SECTION 59TAKE notice that, pursuant to section 59 of the Fisheries Act1982, Branko Sarunic, P.O. Box 993, Port Lincoln, S.A. 5606, orhis nominated replacement approved by the Director of Fisheries(hereinafter referred to as the ‘fisher’) is exempt from section 41of the Fisheries Act 1982, subject to the conditions contained inSchedule 1 to this exemption, in that they shall not be guilty ofan offence when using a fine mesh purse seine net as described inSchedule 2 for the taking of pilchards (Sardinops neopilchardus)and other species within the Families Clupeidae and Engraulididae(hereinafter referred to as the ‘permitted species’) for thepurpose of trade or business in marine waters of South Australia asdescribed in Schedule 3 as Area A and Area B (hereinafter referredto as the ‘permitted activity’).

SCHEDULE 11. The fisher may engage in the permitted activity from the

date of this notice until 28 February 1999, or until revoked bythe Director of Fisheries.

2. This exemption is valid only in respect of the fishing vesselNazare (hereinafter referred to as the ‘permitted boat’) registeredon the fisher’s Marine Scalefish Fishery Licence No. M354.

3. The fisher must be on board the permitted boat at all timeswhile the boat is being used for the purpose of engaging in thepermitted activity.

4. Whilst using a nominated master to take pilchards pursuantto this notice, no other fishing activity shall be undertaken by thelicence holder pursuant to Marine Scalefish Fishery Licence No.M354.

5. Whilst engaged in the permitted activity the fisher shall notuse any of the devices registered on the fisher’s Marine ScalefishFishery Licence.

6. The fisher must not take or be in possession of any otherspecies of fish, other than the permitted species, while engagingin the permitted activity.

7. Any fish, which are not permitted species, taken as by-catchby the fisher during the permitted activity must be immediatelyreturned to the water.

8. The fisher shall not, during the period 1 January 1999 to 28February 1999, take a quantity of permitted species whichexceeds his quota of 43.45 units at 2.571 tonnes per unit (whichis equal to 111.714 tonnes).

9. The fisher may with the prior approval of the Director ofFisheries transfer uncaught units of quota during the period of thisnotice.

10. Fish taken pursuant to this notice as the result of a transferof quota must be taken in the area as described (and disposed of asdescribed) in the permit conditions of the holder of the initialallocation.

11. The fisher may transfer catch taken pursuant to this noticeto a carrier boat at sea subject to nominating the boats inadvance.

12. The fisher may nominate no more than two carrier boatsat any one time. Notification of boat name must be provided tothe person or agency responsible for conducting quota monitoringoperations.

13. Where the fisher transfers all or part of his catch to acarrier boat that portion of the catch must be accompanied by aSouth Australian Pilchard Fishery Log Book, completed asrequired by condition 16 of this notice.

14. The fisher must notify the person nominated for quotamonitoring, by telephone, of the intended place of any unloadingand the estimated weight of the catch at least one hour prior tothe unloading taking place.

15. The fisher must provide the person nominated for quotamonitoring with reasonable access to boats and vehicles for thepurpose of enabling inspection of the catch and any recordrelating to the South Australian Pilchard Fishery Log Bookrequired to be completed under this notice.

16. The fisher must complete the South Australian PilchardFishery Log Book as described below:

(a) Unloading to a shore based processing plant:(i) The fisher shall complete all columns of the South

Australian Pilchard Fishery Log Book up to butnot including the column titled PILCHARDTONNAGE CAUGHT.

The fish can then be dispatched to the shore based processingplant. It is the responsibility of the fisher to make certain that allfish are accurately weighed within 24 hours of the consignment tothe processor:

(ii) The fisher shall upon being notified by theprocessor of the total weight of fish unloadedcomplete the columns headed, PILCHARDTONNAGE CAUGHT, OTHER SPECIES,TONNAGE CAUGHT (This refers to otherspecies) and REMARKS .

For any unloading, if fishing has taken place on more than oneday then this should be noted and the verified weight split as closeas possible to reflect the actual quantities taken on each day offishing.

(b) Unloading at sea or direct to a tuna cage:The fisher shall complete all columns of the South

Australian Pilchard Fishery Log Book immediately aftercapture and include an estimated tonnage in thecolumn marked PILCHARD TONNAGE CAUGHT.The estimated tonnage should be based on a recordednumber of boxes of a certain capacity (weight) filled.

I refer to your applications for authorisation of the NationalElectricity Code, as submitted to the Commission on 28 August1998 and amended on 16 September, 22 September, 2 October,6 October, 20 October, 26 October, 5 November and 20November 1998.

The Commission has been made aware that the condition C3.2imposed on the interim authorisation granted on 25 November1998 is unlikely to be met. The South Australian Government hasrequested that the condition be removed. The Commission hasagreed to remove the condition.

Pursuant to subsection 91 (2) of the Act, the Commission nowrevokes the interim authorisation dated 25 November 1998 andhereby grants interim authorisation for the applications A90671,A90672 and A90673.

This interim authorisation applies to:(a) The National Electricity Code in the form granted

interim authorisation on 25 November 1998; and(b) all conduct to be engaged in under the National

Electricity Code.These interim authorisations take effect from Wednesday, 6

January 1999 and will lapse when the Commission reaches a finaldetermination in regard to each application.

The Commission will endeavour to commence its statutorypublic consultation process regarding the applications as soon aspossible, and hopes to release its draft determination in early1999. Please note that under subsection 91 (2) of the TradePractices Act, the Commission may revoke an interimauthorisation at any time.

Creek Catchment, Pursuant to Sections 16 (1) (a) and (c) of theWater Resources Act 1997

PURSUANT to sections 16 (1) (a) and (c) of the WaterResources Act 1997, I, Dorothy Kotz, Minister for Environmentand Heritage, being of the opinion that:

• the rate at which water is being taken from watercourses inthe Greenock Creek catchment as delineated by the brokenline on G.R.O. Plan No. 1 of 1999 is such that there is a riskthat the available water will not be sufficient to meet futuredemand; and

• the rate at which surface water is being taken in theGreenock Creek catchment delineated by the broken line onG.R.O. Plan No. 1 of 1999 is having a serious effect on awatercourse (namely Greenock Creek) that depends on thesurface water for replenishment,

hereby prohibit the taking of water from watercourses and surfacewater in the Greenock Creek catchment except:

(a) by a person who takes the water for a pre-existingpurpose but only if the rate at which he or she takes thewater does not exceed the pre-existing rate; or

(b) for domestic purposes or for watering stock (other thanstock subject to intensive farming within the meaning ofthe Water Resources Act 1997); or

(c) pursuant to an authorisation granted by me or mydelegate, pursuant to this notice.

In this notice‘pre-existing purpose’ in relation to a person means a purpose

for which the person took surface water or watercourse waterin the Greenock Creek catchment during the yearimmediately preceding the date of commencement of thisnotice.

‘pre-existing rate’ means the amount of water used in the yearimmediately preceding the date of commencement of thisnotice.

‘surface water’ means naturally occurring water that is flowingover land other than in a watercourse.

This notice comes into effect at the expiration of seven daysfrom the publication of this notice in the Gazette and in anewspaper. This notice will remain in effect for 18 months unlessearlier varied or revoked.Dated 4 February 1999.

TAKE notice that I, Dorothy Kotz, Minister for Environmentand Heritage, in the State of South Australia, being of the opinionthat:

(a) the rate at which water is being taken from wells in theUpper Willunga Catchment Moratorium Area, which isthat part of the area bounded by the bold black line inG.R.O. Plan No. 497 of 1998 that does not comprisethe Hundred of Willunga and also shown bounded by thebold line in the Schedule hereto (the ‘defined area’), issuch that there is a risk that the available water will notbe sufficient to meet future demands; and

(b) the rate at which surface water is being taken from the‘defined area’ is having a serious effect on the level ofwater in an underground aquifer system (namely theWillunga Basin) that depends on the surface water forreplenishment; and

(c) the rate at which surface water is being taken fromwatercourses and lakes in the ‘defined area’ is having aserious effect on the level of water in an undergroundaquifer system (namely the Willunga Basin) thatdepends on the surface water for replenishment,

prohibit both the taking of water from any watercourse, lake orwell within the ‘defined area’ and the taking of surface waterwithin the ‘defined area’ except:

(a) for domestic purposes and/or for watering stock (otherthan stock subject to intensive farming within themeaning of the Water Resources Act 1997); or

(b) pursuant to an existing authorisation granted by me ormy delegate.

For the purposes of (a) above, a dam will be deemed to be usedfor domestic purposes and/or watering stock if its capacity doesnot exceed 5 megalitres capacity.

All authorisations currently granted in the defined area will bere-issued pursuant to this notice.

The period of this restriction will commence at the expirationof seven days from the publication of this notice in theGovernment Gazette or newspaper (whichever is the latter) andwill expire 18 calendar months after its commencement unlessearlier revoked or varied.Dated 2 February 1999.
