TRUE AMERICAN PARTY MANIFESTO T.A.P.REVAMP, RETOOL, RETHINK, AND RESPOND TO THE PEOPLEWe the T.A.P., in order to reform our once more perfect Union hold these truths to be self-evident; 1. That the original plain language reading and interpretation of the United States Constitution is, will be returned as, and forever shall be the highest and all powerful law of this land. Furthermore, that the Constitution is the non-negociable contract between those American citizens whom consent to be governed and their government, which is limited in power by the United States Constitution. Moreover, that at any such time as the government of the people, for the people, and by the people ceases to be or act as anything other than a government of the people, for the people, and by the people then it is no longer the government of the people, for the people, and by the people and therefore no longer the government of the United States of America whose power is derivied only from the people of the United States of America, in the form of that non-negociable social contract the United States Constitution, forged in over two-hundred and fifty years of blood, sweat, tears, hardwork, sacrifice, and never say quit attitude! Among the numerous advantages promised by a well-constituted Union, none deserves to be more accurately developed than its tendency promote freedom and justice, ensure domestic tranquility through adherance to its Constitution, and ensure the rights of privacy, ownership of property, right to prosper, and secured liberty for all. That the current instability, injustice, lack of economic opportunities, and confusion as to the true spirit and letter of the law introduced into the public councils have been the mortal disease which caused many various governments throughout the history of mankind to pass into obscurity and nonexistance. As we are desirous and wanting of a thriving and secure nation of limited power and law, and as we are vested in the notion and idea that our government shall not fail and pass into obscurity only remembered in the halls of history, we hereby hold that no less then the following measures and actions must be taken on the behalf of those whom consent to be governed in accordance with the Constitution and the following priciples. 1. That in accordance with over two-hundred and fifty years of American juris prudence the United States Constitution be re-recognized as the supreme law of the land, and that no mere act created and voted into law by the legislature and signed by the then sitting president shall be greater force of law then the Amendments contained within the United States Constitution. Furthermore, the only manner to amend the Constitution shall remain no less then a fully recognized and instatuted Constitutional Covention called to order by both houses of the legislature. That in

accordance with the United States Constitution and the holding in Marbury v. Madison, the United States Supreme Court does have original jurisdiction, right to declare unconstitutional, right to review by trial, and ultimate authority to decide the constitutional validity and legality of any Act, Bill, or Law which has been constitutionally brought before the United States Supreme Court and challenged.

2. That the First, Forth, Sixth, and Fourteenth Amendments be reconstituted and strictly observed by all levels of government, including but not limited to the Federal, State, and Local levels of all government. That all current laws which are not recognized by T.A.P. as having any authority over the citizens of the United States of America for want of and gross lacking of observance of the US Constitution be stricken now and forever from the record.

3. That the government of the people, for the people, and by the people, must be the true motto of the United States of America again. Therefore, the right to privacy, freedom of the press, copyright, and right to profit from ones own image and information shall hereby be drafted into laws replacing the Patriot Acts and FISA. The reason for this is we believe that the Patriot Acts have fostered a culture and mind state in the citizenry that is one of surrendering ones own information with no consideration paid by those whom collect and profit from those whom are taken advantage of by those whom have perpetuated this culture and need for immediate action. If companies that data mine, collect, violate the privacy of their fellow citizens, and do so for profit, were forced to share thier profits with their victims or those whom personal information is actually collected and sold for profit then a much different, fair, responsible, and accountable culture would grow in the world of data collection and sales of private and personal information.

Furthermore, that the legislature lower the standards of the following legal doctrines via legislation in the following manner immediately:

(A) That the legal standard applicible to make a prima facie case for Intentional Infliction of Emotional Distress is an act or acts by a defendant so extreme and outrageous, or reckless so as to presume the defendant knew or should had know that their actions would result in harm, which actions or acts did cause the plaintiff to suffer a measurable and recognizable amount of emotional distress due to the defendants gross abuse of superior technological or digital, computing, communications, and/or information technology knowledge was used in a manner which caused a measurable and recognizable amount of emotional distress.

(B) That False Imprisonment be hereby expanded to include the ability to confine or restrain a person by way of threat of damage or loss to not only physical and monitory property, but a persons digital property. Furthermore, the fear proved by the threat of the loss of an individuals digital property or creations a threatened and recognized threat of force capable of restraining a plaintiff to their computer station for extreme periods of time, and only freeing the plaintiff at such time from the restraining area of their computer consol until such time as their digital property was returned or destroyed.

(C) Trespass to land shall include the nuisance of actually invading or breaking and entering into an individuals home, by any individual who does unknowing place malicious software on the physical chattel of the plaintiffs computer located with in the plaintiffs home with out permission. That the unwanted and malicious transmission and placing of electronic data onto another physical computer, when located inside the home, shall be considered the same as if the defendent through unwanted garbage and harful items into the home of the plaintiff. Therefore, being

done with intent, the defendant is fully liable for all damages which flow from the original intentional tort of tresspass to land.

Tresspass to chattel shall hereby include the act of trnsmitting, placing, or otherwaise embedding into or on the physical chattel of the plaintiff in the form of their computer. Therefore, as the digital malicious tresspass to property and constructive tresspass to both the chattel and land of the plaintiff by the defendant was done with the intent to tresspass upon and on the computer chattel of the plaintiff the defendant shall be liable for all damages and all damages that flow from the original tort.

(D) The invation of privacy and into or onto any privately owned ditigal, cloud, or electronic networks shall be felonious, and therefore a actional tort per ce.

(E) The conversion of ones personal data, shall be recognized as conversion of any other form of personally owned and privately held personal property, which when taken unlawfully and coverted for the use of another with out the owners permission shall be recognized and an actionable intentional tort.

(F) Serious interference of business or Consequences for interupting an individuals business through the interuption of their electronic data and electronic communications transmitting via the internet, shall result in the maximum damage award allowed for the intentional tort.

(G) Invalid use of legal authority shall be found against any company or person claiming to be or otherwise holding themselves out as being law enforcement on line, in order to be granted special priviledges or access to another persons private data, files, software, or network.

(H)INVASION OF RIGHT TO PRIVACY

The appropriation by the defendant (private or state actor) of the plaintiff's picture or name of for defendants commercial advantage.Intrusion by the defendant upon plaintiff's affairs or seclusion.

(I) Defamation

Publication of the plaintiff by the defendant of facts placing the plaintiff in false light, and the disclosure of PRIVATE FACTS about the plaintiff by the defendant.

(N) Wrongful instatution of legal proceedings and harrassment begin as soon as law enforcement manipulates or intercepts an individuals private electronic communications.

(O) Network opporators be held responsible for damages, as they owe a higher standard of professional duty as professionals who hold themselves out as having spoecial and specialized knowledge in IT, digital technology, computing, or electronic communications and storage.

Standard of Care owed by owners of a website, shall be the same duties to their guests as a storeshop owner owes visitors to their shops for safety and security. Therefore a duty to discover dangerous hazards is imposed.

　PROTOCOL AND MANUAL FOR ECO-ECONOMY

1. GENERAL ELECTRIC ALREADY HAS AVAILABLE ELECTRIC PLUG IN STATIONS, SEIMANS, WESTINGHOUSE, AND OTHER MANUFACTURES OF ELECTRIC PRODUCTS, CAN’T BE FAR BEHIND GENERAL ELECTRIC.

Best Practices Executive Logic:

What’s available? What resources are ready now, being produced in America, or by usual trading partners Europe, Japan, India, South America, other pro-western Asian and Middle Eastern Countries?

The answer is labeled number one above. America has or can quickly produce, install, distribute, and with an Act of Congress via the Interstate Commerce Act, pass into law that every gas station in the Country MUST install no less than two electric plugs in stations available on the premises. These stations are pay for plug, obviously. I would also suggest the Government attach to any new federal highway funding, all rest stops, truck stops, and national parks have installed the electric plug in stations.

IMPACT:

The spurring of American Manufacturing, by at least three major United States Companies or companies operating on United States Shore, and in so doing offer tax incentives to revamp, rebuild, or build a new these manufacturing plants in

economically depressed Cities and areas. Furthermore, the usual distribution channels will experience an uptick, and Electrical Contracting and other Construction industries will begin employing more, emptying Union Halls, and creating blue collar jobs.

　2. Through the use of the Interstate Commerce Clause, and Federal Tax right offs exempting the square footage utilized by any commercial or residential structure or land from property taxes, which install and utilize electric generating technologies the Government may lawfully employ and ensure the fastest deployment of not only electric plug in stations commercially and residentially, but create energy efficient and self-sufficient United States properties.

Engineering, smart grid technologies, solar, wind, and all electric producing industries shall be encouraged to create, discover, install, and weave into the existing grid such technologies through co-operation with existing electric municipalities which are already receiving large grants, Government favor, tax breaks, and incentives to be installing the new generation of electric technologies which are the subject of this manual. At the same time, Off-Grid technologies shall be encouraged. As an example, the roofs of gas stations can easily house solar arrays to power the mandatory plug in stations. The Government can’t force the installation of such solar, wind, geo-thermal technologies to be installed at all gas stations (Look to any octane or quality of gas regulation, standardized pump regulation, and other Federal regulations of this sort for Legal Precedent and Authority to force the Electric Plug Stations). The gas stations of course can and should charge for the use of the electric plug in stations.

The Legislature can offer large tax incentives to individuals, large companies, small businesses, and home owners which install any such solar, wind, geo-thermal, or as of yet unknown/discovered electric producing technology, so long as said electric generation system has either pay for plug or an electric car plug located in the car port. Also, building owners installing such systems shall receive the same square foot tax exemption, and may offer to the tenants of the building electricity alternative to the local municipality if possessing electric generating systems. Suggest that amendment clarification to the already Treasury Laws and Tax Codes which already allow all local power companies to enjoy this tax exemption or write off.

Treasury Law Code un-cited here, but it is already in existence and being utilized by electric power companies nationwide (For profit or not). Therefore, merely amend to state any square-foot dedicated to alternative and renewable electric energy production of any private or commercial property, shall be hence forth and annually be tax exempt both Federally and at the State levels, so long as the electric power generating system is present on the property and properly functioning whether for commercial or residential purposes.

Effect:

Instant and large scale manufacturing of the solar, wind, or geo-thermal parts and systems, made on United States soil or imported from usual trading partners. However, large penalties shall be placed on the importation of any such parts or systems. Most of our trading partners already have factories on United States soil as is, because tariffs and distribution costs make the manufacturing of parts, products, or goods on United States soil cheaper. This will raise the American

GDP, create jobs, and if done correctly as laid out below the Government can defray the costs associated with workforce retraining and/or necessary workforce skill building schools will fall upon the any for profit corporation, by creating a 501 (c )(3) educational company/institution.

This will ensure that there are again manufacturing jobs once again on United States soil, and by utilizing the parameters set forth below ensure those jobs are created where they are most needed throughout the Country. Furthermore, besides creating the initial construction jobs, building these plants, the jobs created by operating these plants, this would create more secondary jobs in the distribution and shipping businesses, as well as in the Construction field. As the tax incentive of tax exempt square-footage on any building or lands dedicated to the generation of electricity, coupled with the saving of not paying for electricity personally, and the various ways such electricity can be profited from once produced, should spark a large demand for the aforementioned electric power generating technologies and the installation of said technologies upon commercial, residential, and even Governmental buildings and lands.

Again, the Legislature or to the extent possible the Executive should offer tax breaks for the hiring of Veterans and for moving, revamping, or building a new these factories into economically depressed areas. Moreover, all of these for profit companies may and should create 501(c) (3) subsidiaries of education, which will teach and train the companies own employees the skills needed for their new careers and jobs. This allows any manufacturer to defray, write off, and train its own employees and workforce for almost no cost. Every dollar spent or "donated" to the companies training program, would then be a 100% tax write off as a gift to a charity or fall under the already existing 501 (c) (3) "Education" clause.

Different factors may be used to determine exactly what qualifies as an economically depressed area, for the purposes of receiving the extra-one-time tax incentive for building in a depressed area. Preferably an incentive which does help defray or greatly reduce the costs associated with the building of a factory dedicated to any of the technologies outlined in this manual. Qualifications, incentives, and possibly even low cost interest loans to build such factories should be unemployment of the local population, property values of the area, size of the local population, and other pre-determined factors. However, an economically depressed area may be no bigger than two to three miles in radius. This two or three mile radius rule, should help ensure that these manufacturing plants are actually placed in economically depressed neighborhoods, and not just economically depressed Cities.

3. Having created an infrastructure capable of supporting and making the owning of an electric plug in car, which of course utilizes some sort of alternative liquid fuel for long distance trips. The legislature should offer tax incentives and low cost loans for car manufacturing companies whom invest in, manufacture, and produce electric plug in vehicles on American soil (Regardless of the nationality of the Car Company. To qualify they must produce electric powered, plug in cars, and those cars must be built on United States soil.).

Stanford University has recently invented or discovered a battery capable of taking an instant charge and holding that charge indefinitely, liquid fuels will be quickly outdated and out mooted. Obviously, not every American will instantly and purchase Chevy Volts, an electric car capable of traveling 80 miles plus before requiring a recharge, or to shift to its back up petroleum based engine for long

distance travel. Nissan currently has an electric car on the market. These automobiles are ready for purchase now. Moreover, here in California there is an a company named Tesla Auto Manufacturing, which creates high end electric sports cars, mini-vans, and most likely working towards creating even newer and better electric cars.

By the Government giving tax incentives, low cost loans, and taking the steps to ensure there is an infrastructure in place for electric plug in vehicles, the auto-makers of America will have to either adapt or go under and out of business. However, given the amount of incentives, the opening up of a new and as yet uncharted market, American ingenuity, Capitalism, the market, and the sheer loss of potential market share US Auto Makers would begin to suffer for failing to quickly create, manufacture, and make available to the now more employed and cash flush American Consumers newer and better electric plug in vehicles. Moreover, should certain larger United States auto manufacturers decide to go the way of the dinosaurs, the Legislature does have the power to pass Legislation requiring them to produce at least one electric plug in automobile. (See the use of the Interstate Commerce clause, and Congresses ability to order certain levels of gas millage, seatbelts, air bags, and other well documented and sound Legal Precedent for the needed authority).

However, if the US Auto Manufacturer wants to stay in business, survive, profit, and ensure that their company doesn’t go bankrupt, they will quickly begin to poor massive amounts of money into Research and Development, re-tooling, and begin to offer for both the American Consumer and the possible over-seas markets cheaper, better, more luxurious, larger, faster, and other electric plug in vehicles which can travel farther and farther distances on a single charge or dedicate major resources to more efficient batteries capable of taking instant charges which can serve as the primary if not only fuel source for the automobiles they produce.

Effect:

Instant job creation and innovation through the rebuilding or retooling of the American Auto makers, and foreign auto makers whom chose to build automobiles on American soil and chose to take advantage of the tax incentives, low cost loans for retooling, and conduct their business on American soil in the manner and ways which would qualify them for the same incentives for manufacturing electric plug in cars. These policies will should at the very least make America attractive again to foreign companies, who along with many American Auto Makers have outsourced the manufacturing of automobiles to non-American soil. It behooves the American Government to create an environment which is attractive for our usual trading partners to begin to manufacture their vehicles on US soil.

These policies and steps should provide the American work force with more available employment opportunity. This will allow the American Government to earn money itself, as there would be more profitable companies and employed workers from which to collect income taxes from. Even with the tax incentives and breaks put forth in manual, the United States Government will see a larger return on its own investment. This should come about through the sheer numbers effect. Instead of bombarding the richest among us, or starving the poorest, these policies should re-expand the dwindling and almost non-existent middle class. By having a larger employed populous, the Government can better spread the burdens of taxes, while saving money through not having to pay so much money in Government programs needed to ensure the poorest amongst us don’t die or starve.

As long as through tax incentives and other policies, building on American soil, and paying American workers (American worker wages), the Government is able to create an environment where building and manufacturing on non-American soil is more costly than building on US soil businesses will return. As these tax incentives, programs, loans, and the new pro-manufacturing American business climate is strictly for the production and manufacturing of electric plug in vehicles, the United States would not be violating any current trade agreements or treaties if the Legislature were to cause there to be higher tariffs on this completely new industry and economy. Therefore, the legal and international trade agreements already in place can remain in place, while truly making the importing of electric plug in vehicles (As opposed to building them here) very costly from a business perspective.

At the same time, America would be creating a very welcoming and profitable set of initiatives and incentives for businesses to manufacture the electric vehicles on American soil, as the United States of America has decided that solar, wind, geo-thermal, and other non-petroleum based and renewable energies and technologies are the new future of what is still the largest consumer base and economy on the face of the planet. Aside from the jobs created from manufacturing of the new electric plug in vehicles, the retooling, the distribution, the installation of the new electric plug in stations, the commercial and residential construction, and the obvious ensuing economic boom time America should experience just as it did in the 1950’s and 1960’s (The largest economic growth in the American economy of the last Century), America will have effectively cause oil to be a worthless commodity.

4. By creating a new and immediate American economy, new infrastructure, new nationwide form of energy production for homes, commercial buildings, and most importantly transportation, while using on shore and as of yet grossly under-utilized available technologies, not only will these new industries, surges in construction, science, technologies, economic reinvigoration, and re-expansion of the long forgotten middle class strengthen Americas dominance once again as the economic power house it always should be, we will render foreign oil and our dependence a thing of the past!

It is a historical fact that the economic boom time experienced by America in the 1950’s and 1960’s, the growth of the middle class, and at least the economic comfort experienced even by the poorest amongst American’s, were also the last two decades of the last Century and this one which America was absolutely Energy Independent. At present almost 95% of the fossil fuels used by the United States come from foreign countries. Foreign countries which really do not like America (They fear America), don’t really care for America, American’s, our ideals, and would love to watch our economy crumble out from under us. All one must do is look across the Atlantic, and notice there are several canaries already beginning to die off in the "Western Capitalistic Economic Model." Ireland, Greece, and now Spain is floundering. These are our allies, trading partners, and countries which like it or not look to America to show the way out of this endless money pit chasing oil.

Oil is over! It’s not a substance which can be produced, or replenished. Once it is all gone, which is going to happen much sooner than later, there will be no more. Until the oil actually runs out, it will only get more expensive, harder to obtain, and those countries which have it in abundance will attempt to jerk America around like a dog on a chain, or provoke us into wars that we neither care to fight

or can financially afford any more. In the alternative, we can do what we as a Country always do, were built to do, and practically invented the sport of. The sport I am referring to is Capitalism. Capitalism doesn’t work, without work, something to build, sell, create, innovate, or have financial undertakings to partake in.

Arguably, in the past fifty years we’ve blown up other Countries, almost just so we could rebuild them. It’s always American contractors who get those bids, and make the money by "nation building." I cast no judgment either way, merely remarking on what the National business model would appear to have been for America for longer than any American is proud to admit. However, for the first time in over sixty years, America has a nation in need of some serious "Nation Rebuilding." This time, it’s the homeland, which needs rebuilding and fast!

Since the 1960’s America has enjoyed the privilege and strength of the "Petro-Dollar." What the Petro-Dollar actually is, is an ingenious system America came up with after the 1973 Oil Embargo where by all oil through-out the world is bought and sold exclusively in United States Dollars. This means that any country wanting to buy oil, has to first trade their countries currency into United States Dollars and only then can they buy oil out of country. This has afforded the United States unprecedented influence, economic power, and advantages over other counties. This is one of the reasons America has been able to rack up incredible deficits, and other countries still would/will lend America Trillions of dollars.

5. We must render oil useless, and become energy independent once again! It is the only true way to thwart and render the impending economic attack on America, by way of China convincing OPEC or even a few oil rich countries to do away with the petro-dollar, and instead begin to use the yen as the major oil currency. Our gas prices will sky-rocket, if America first has to trade Dollars for Chinese Yen to buy oil with petro-yens.

The problem with this old model, is much of it was predicated on the strength of the American dollar, the strength of the United States economy, and of course our ability to militarily beat any other country. However, over the past couple of decades, while our leaders have been bickering amongst each other, our own countrymen and women on Wall Street nearly bankrupting the Country through the credit-default and mortgage scandal, Bush Junior printing money, like it’s going out of style, China has become a very large Quasi-Capitalistic Country. Moreover, India (Who is an ally obviously), has become a major global economic player as well. Iran is controlled by a crazy man, and America is about to implode into civil war if some really drastic and fast changes are not effectuated by those in power immediately to restore the rights of US Citizens.

As stated in the outline, those very few but powerful steps would make the United States energy independent again, create jobs, raise the national GDP to new highs, strengthen the dollar, beat the other countries to the punch, and leave them holding a bunch of yen not worth the paper they’re printed on, and a bunch of worthless oil they couldn’t get 50 cents a barrel for. The way this is done through mass production of electricity through solar, wind, geo-thermal, even nuclear power, and power our massive transportation system through electric plug in vehicles. We literally need to nation build, right here at home, mobilize our economy, mobilize businesses, have some accountability and punishments for white collar crooks that nearly bankrupt their own country out of greed, and then give themselves bonuses to boot. We need to realize we are at war, and it is not terrorism!

There is a silver bullet fix for the economy, unemployment, shrinking middle class, outsourcing, the neglect of main street, the greed of Wall Street, the deficit, energy independence, and to up the GDP! I just outlined it, in less than 10 pages. It’s the key. Capitalism works best, when it’s at work. We have plenty of work which needs to be done on American soil, and it needs to begin as of yesterday. If followed we can improve the lives and standard of living for all American’s, and give those whom thought to outsmart us little more than that old all American customary gesture of saying nice try assholes. However, no problems can or will get fixed until we win the war on Terror, which can and will not be true until America finally abolishes the Patriot Acts in their entirity.

The realization that America is no longer America, but a conquered country choking on its own fear and stupidity is also an embarrassing and demolishing state of existance for the country. The factions of civil war (If it breaks out) will be drawn against those that remember how America was and demand it must be again, and those whom feel that they nor their fellow citizens deserve their Constitutionally guarenteed rights any more. This will obviously create an oligarchy styled country that replaces the United States of America. Should those whom perpetuate and believe in the ideals of lack of personal privacy, the complete abolishment of Constitutional rights, and are pro government control over every aspect of the lives of the worker class citizens win the civil war, then the watcher class citizens shall create a new country which resembles the United States of America, but will be the ultimate expression of authboritarian dictatorship government which history has proven time and time again through-out the history of mankind that always arises any time a government and certain class of citizen are given far to great of a control over their fellow citizens.

This will not be a civil war of race, religion, age, social class, or reagons, it will literally break down the lines of Constitutionalists and traitors to the United States Constitution and its interpritation by the plain literal meaning and application of the words. It is believed that the moral of the country to be relatively low, and trust in the Federal government by the citizenry has never been lower. Americans for the maybe the first time ever or at least since the "Red Scare" of the fifties actually fear that their own government will grab them in the middle of the night, arrest them, give them a sham trial, and lock them up and through away the key, based solely on the fact these patriots are merely utilizing their most fundlemental, American, and Constitutional right to free speech. The youngest generation of Americans now living have been so beat down and bullied and lied to, they can't even remember the rights they're supposed to have, in order to demand them. This is the closest this country has gotten to Civil War, since the 1800's.

not wanted for any crimes back in the Country they left; take and pass the naturalization and citizens test which all new Americans must pass; agree not to need, take, or draw any government handouts such as well fare, food stamps, Section 8, or any other government handout services other than the schools for their children and any low income Medicaid (Obama Care, when it all gets sorted out) for a period of another two years, then at the end of those two years (New Citizen Probation Period) they shall become fully naturalized and legal citizens with all the rights and privileges to services, voting, and the full amount of rights all American citizens enjoy.

This system program should be open and available for a two year grace period, so as to only reward and help those Latinos who are already here, employed, honest, not coming to America just to loaf around and drain our governmental handout services and programs for the spoiled people on well fare and receiving assistance who are not sick, elderly, actively seeking employment, or are employed lawfully yet due to their region of residence and the employment they are able to find as a full time employee. The Federal, State, and Local Governments are running out of money, and are having a hard time helping those whom actually need a little bit of help through a rough patch, the truly sick or elderly or unable to work due to physical or psychological conditions, and unfortunately those who have been taught and believe that well fare is actually a career and they are some how owed money by the rest of society for God only knows what reason. However, all three categories of those receiving government help are all American born (Or AT LEAST THE FREAKING OUGHT TO BE!).

Given the current state of our economy, the resources we have, and the very real fact that every one wants free rent, food, and money, I believe this program made available to all immigrants (Not just Latinos) for a two year period to enter the program and take advantage of the immigration window is both fair and will benefit America by allowing in the type of citizens we want. Therefore, the Legislature should set a start date and an end date for such a program, and then those who qualify have two wait and prove their financial independence, willingness to work, willingness to play ball and use the system, and ability to be upstanding, non-criminal, non-needy citizens who can, do, and will add to American society and her economy by remaining employed as they must already have been (With a gap in employment no greater then 120 days, and with never seeking government handouts.) and paying taxes, rent, their bills, and all the things people usually associate with "model citizens."

This would help naturalize the millions of illegal Latinos already in America, who do behave like "model citizens," work, pay rent, actually pay into the system through taxes (And never take out, as they will get caught and deported... As they should. Paying into the system, and not getting ay back is the current and rightful price for illegally coming to America in my opinion.), buy property, and are good upstanding citizens. However, they are forced to live in fear of being deported, some times eve though they're small business owners, been here for over a decade, have children who are legal Americans, and own property. When and if they are discovered, they can and often do lose their homes, businesses, jobs, and families are often broken up. Here all these sorts of people want and want from America is the same dream which caused our forefathers to immigrate to America, whenever that was for your particular family. America can not simply close our doors, and say to the res to the world "Well now that we are in, you must stay out."

At the same time, we can not, should not, and will not be the country that is made

to feed, house, and care for every person who believes that "If you go to America you get free stuff!" Absolutely not, and if any one in the program does attempt to collect well fare, government housing, or other form of government handout, then they shall and should be deported immediately. What this system is offering them and America herself "Earned and Merited Amnisty," for a very large segment of the population of America (Especially here in California) who are currently half in and half out of the county. This solves a large problem for a large segment of the country, while putting sufficient mandatory stipulations and regulations that would

(A) Ensure that the program and two year widow is used only by those already living in this country illegally, and only utilized by those living in this country illegally who we both would want here an quite honestly could afford to allow to stay here (As they only add and do not demand the government handouts that so many able bodied Americans have come to believe they are somehow owed.).

(B) Would prevent any mass migration, as three years is longer then the two year window. Therefore, no one could or should (Not that a few dummies still would.) attempt to instantly migrate to America illegally and try to establish their required three years of "illegal-employed-non-criminal residence," and join the program.

(C) The two years no government handout programs or face deportation serves as a proper deterrent against those who may seek free living from the government, and abuse a program designed help "decent hardworking folks who just happen to be illegal, but abide by our economic system and laws just the same."

(D) The mandatory requirements both ensure America is receiving the sort of citizens and people she wants and needs as new citizens, as well as ensuring that no government handout socialist program like well fare is immediately inundated and over burdened with an instant flood of people are overly eager to have their hands out to the government demanding free money, housing, food, and more.

(E) The program should serve as a fair and reasonable fix which all parties can agree will remedy a very current and urgent issue which both Republican, Democrat, Federal Government, Local Government, American Citizen, and Illegal Resident alike would like to see solved sooner rather than later.

2. Those who will come after

After the window is closed the policies and immigration laws should revert back to the way they stand currently. If you want to come to America, you must receive your green card, wait the appropriate time, a follow the procedures the every other Americans ancestor had to do when they came to this country. No one is special and gets to not pay the dues other Americans or their ancestors paid for them. The one crucial and important change however, is the very apparent need for "Seasonal Migrant Work Visas." In cooperation with Latin Countries, quick, cheap, and seasonal work visas should be obtainable so as to provide California, the South West, and other agricultural states with the seasonal cheap labor which helps drive Americas multi-billion dollar farming industries.

This has several benefits to all parties.

(1) Farmers will have the cheap seasonal labor required to help keep food production low.

(2) Migrant workers (Who usually have no desire to become American, stay in this

country, and send most of their wages to their families back home.) will be able to come across the border, find work, move about the country, use banks, and have a federally accepted and issued form of identification. They will also no longer have to play annual cat and mouse games with ICE to get to a hiring farm and not get deported before the season is over.

(3) The government and its agencies will benefit greatly by having in place a system whereby those with the visas can be tracked, identified, counted, migration patterns monitored, and the IRS can and will finally be able to properly lay payroll taxes on both employer and employee alike (As apposed to the almost strictly all cash payment systems now, caused by the workers inabilities to cash checks and lack of lawful SSN or other number used for payroll taxing purposes.

(4) Society in America benefits from low cost food production, increased revenues to the government and American banks, and finally the workers will go home the end of the season with their wages as they will finally feel secure knowing that when they leave they can co back easily and lawfully when the t picking season arrives.

If the legislature simply undertook these steps, then the immigration problem would be fixed. At least the largest issues. Then Latinos would finally have real reform on the immigration front. All the politicians could claim and point to an authentic win and push to help the Latino community, while ensuring themselves large amounts of votes in two to three years. The border issue would become easier, if not solved. Every one, on all spectrums of this issue gets a win or at least one thing they want while giving up nothing. Well the Legislature would actually have to agree on an issue for once, so they will be pissed that they had to agree with each other even if it does help America. I should run for Congress, or at least get hired by some one in the Federal government or consultant firm or hell the Republican Party to help them in their retooling efforts (Even though I am an independent, or actually registered both red and blue actually. Green party as well.).

See if you tell these parties you are on no ones side, then they don't like you and don't send you their literature on issues. However, if you tell them you are on every bodies side they send you all their literature, which works out great if you are actually an educated voter who likes to hear or read both sides of the debate or issue and then decide.

　MEDICAL

It is the position of the True American Party that a large amount of the efficiencies and frustrations experienced by Doctors and Patients alike is the complete lack of efficiency found in the medical feild. We at T.A.P. know it doesn't have to be that way, thanks to large advancements in telecommunications and IT. This is why T.A.P. hereby calls for there to be passed into law the "Medical Updating, Overhaul, and Standardization Bill." In accordance with the core values of T.A.P., the Bill shall do exactly what it purports to do via the title. Therefore, T.A.P. does demand that immediate legislation be passed which would empannel a Medical Convention of five hundred leading Medical Doctors, in a count of ten doctors from every state, to be chosen in any manner each state or the Medical Board within each state sees fit to chose their representatives to attend the national Medical Convention whereby the five-hundred Doctors will meet amongst them selves, IT professionals, telecommunications experts, ten representative from both

the House and Senate,, and most importantly a sales reps from the paper product and forms industry, and together the convention shall set the first ever standarization of minimum IT, database, telecom, and most importantly design and create a single standardized set of forms for use in billing, perscriptions, as well as any and all other necissary medical forms used through out the medical field. At such time as the convention completes its task, both houses shall vote the forms into standardization and so order the insurance companies to ciaccept the new national standard document forms.

　The logic behind this bill is as simple as it seems, which is to this date there is no national standard in the forms or how they get communicted, stored, and shared amongst different medical practitioners. The lack of standardization causes a great deal of confusion, redundant tests, and wasted time by Doctors and patients a like. In many cases the various floors of large hospitals, private practice doctors, and specialists can not read or use the forms from the last or even concurring Doctor a patient is seeing. This causes delays, redundant tests and proceedures, and lessons the amount of actual time Doctors can spend treating patients, as they spend a great deal of time dealing with paperwork. The savings in time and efficiencies will be extraordinarily large. However, only a true cost benefit analysis will produce the millions that will be saved annually, through this simple standardization alone.

　Furthermore, we call for the legislature to partically fund through tax incentives and grants to the neediest of hospital only a national standard electronic database and retrival system, to which ONLY licensed doctors may have access to by entering their medical license number into the secure private national medical cloud system. This data base shall be by patient desire only, and no doctor may enter any patients information into the data base without patient permission. Furthermore, should any doctor remove or enter any patients medical history without permission then by Federal law that Medical Doctor shall in instantly stripped of his or her license. Furthermore, the data base shall be protected by Doctor Patient Confidentiality, and by order of the legislature any non-authorized person, company, government official, or law enforcement agent caught trying to access the database or in the possession of any private information extracted from the database shall be charged with a Federal Felony with a sentence of up to three years, and the evidence extracted shall be instantly destroyed and deemed never to have came into existance as a matter of law.

　Every patients key shall be a single figure print, to be able to extract any willing patients information. This is in line with the Paper Reduction and Paperless Government Policy or Act. Once a patients information is in the database they shall become the master of that information, and that information must be destroyed in its entirity at the request of a patient. Howevr, gross amounts of cost and time savings will be instantly realized by patients and doctors alike, as the bill will shall make it illegal and a finable offense should any hospital or private practice not to have acces to the database and secure intra-net web within five years of the bills passage.

　

This will do away with duplicate forms, reports, and patients lack of having access to their medical histories. Furthermore, the ability of medical practitioners to be able to send, have instant access to, and convience of instant access to the full medical history of any patient who walks into their door is uncalculatable. Furthermore, as it is keyed via finger print, should a patient come into ICU unconsious the Doctors can instantly unlock that patients medical history by pressing the unconscious patients finger against the screen. This will save untold lives, and give ICU Doctors instant access to crucial medical histories when time is of the essence. Furthermore, the system can be expanded out and should be designed with telecommunications availablities in mind.

　The reason for the expandability is so hospitals and local EMT's can access the system from appropriate handheld or celular phone mobile device in the field. This way, if a EMT finds an unconscious patient they can open the system and recieve limited medical history such as "Do not administer do to allergies, or patient has asthma or other pertinant information which will help EMT's save lives as the medical first responders in the field. Furthermore, the system should be made to talk to mobile devices, so EMT's can communicate with the ICU and alert the ICU to their ETA, the condition of the patient, and alert them to the need for trauma room or surgery room preporations. This will save valuable time is life saving circustances, as when the EMT alerts the ICU to emergency situations, the ICU can prep and ensure that the proper Doctor, staff, and equipement is already preped for the arrival of any critical patient. These simple and modern measures should cause both the level of care to improve, while experiencing drastic cost reductions. Savings which should be passed on to the American citizens.

　　GAY RIGHTS

　T.A.P. hereby defines the term marraige as "A union between any two humanbeings, being of the lawful age of majority as so recognized in the state or providence where they reside. Furthermore, it is the position and view point of T.A.P. that each state in the Union afford the full faith and credit to any lawful and licensed marriages recognized and licensed by any and all states sister states in the Union, so long as that lawful and licensed marriage be between two consenting humanbeings who are of the lawful age of majority. Moreover, that all insurance, retirement, Estate Planning, Laws of Probate, Laws of inheritance, and laws concerning community property, titles in land, chattel, tiles of ownership, seperate property, property ownership, visiting rights in hospitals, benefits concerning spousal leave, and any other and all Federal or State laws or tax associated with those laws or otherwise be hereby interpretted at law so as to ensure that any and all marraiges between two humanbeings be viewed in the eyes of the law as being equal and the same as any marraige between a man and a woman.

DON'T MESS WITH RELIGION!

　

Furthermore, at no point may any Court at any time hear any cases of descrimination, prejudices, or unfair treatment by any homosexual couple against any member of the clergy or any church, synigag, mosc, or other lawful and legally recognized religious order or its leader, for refusing to preform religious wedding ceremonies for any two humanbeings in the United States of America. It is the position of T.A.P. that the First Amendment right to freedom of religion, including the right not to preform or administer the rights and ceremonies of their particular religion for whatever reason they see fit not to perform those ceremonies without need of explination, by any legally recognized religion or any lawfully ordained spiritual leader, pastor, preast, rabbi, cleric, or other, shall at all times be greater then the right of any two people to attempt to compell any lawfully recognized spiritual leader from a recognized faith to perfom wedding ceremonies. Furthermore, the right to freedom of religion is so strong and deep rooted in American law that no two people may ever attempt to bring a suit to compell any wedding ceremony inside any Court of Law.

　　ABORTION

　Abortion shall remain legal up until the third trimester, or at such time as the child can sustain its own life outside the womb of the mother. Furthermore, that the holding in Roe v. Wade shall stand, for all time under the legal doctrine of stari decisis. It is the position of T.A.P. that abortion is the chioce of the women carrying that child in her womb and her medical physician, as it is the woman who bares all the medical risks associated with child carrying and child birth.

　WAR ON DRUGS

　All drugs, accept crack-cocaine, shall be made legal and produced in this country. Furthermore, that any state wishing to allow the newly legal drugs to be sold with-in the borders of its state sovereignty, shall have the right to levy state taxes on the use, production, or distribution of those drugs, on top of any federal taxes of the same. Furthermore, that any state wishing to recieve federal highway funding from the federal coffers, shall instatute state laws prohibiting the use, possession, or distribution of the newly made lawful drugs to any person under the age of twenty-one. Furthermore, that all seperate federal drug enforcement or policies task force opporating for the various and several federal law enforcement agencies tasked with drug enforcement policies, be hereby re-grouped and folded into a singular Drug Regulation and Education Agency, tasked with the same enforcement and duties which the Alcohol, Firearms, and Tabacco Agency is tasked with as it shall apply to any and all substances made legal by law. However, the right to determine if a state or county, the times and places, the days of the week, and other regulations regarding the newly made legal drugs shall be left up to each individual state to legislate and enforce each states own criminal statues as it is with Alcohol.

　The "War on Drugs" has lasted three decades, billions of dollars, created the rise of the Mexican Cartels, and organized international criminals. Meanwhile America and American States spend billions every year on enforcing, trying, and punishing average American citizens for the victomless crimes of drug use, drug possession, drug sales, and being under the influence of a controlled substance. At the same time, billions of dollars are spent, exchange hands, and are earned or otherwise recieved by those involved at all levels of the illegal drug trade. Therefore, as it is now clear that the "War on Drugs" started by Richard Nixon during the Vietnam War, evidenced by the billions of dollars spent trying to prevent illegal drugs and drug use, as well as the billions of dollars made by illicit foriegn narco-drug trafficing cartels and mafias, and the fact that drug use has statistically stayed at approximately the same levels during the thirty year failed experiment named "The War on Drugs," T.A.P. calls on our government to take a realistic, financial, and humanistic look at the idea of drugs and drug use by making all drugs legal and taxing drugs as another United States commodity or cash crop.

　INSURANCE AND PAYMENT

　T.A.P. views lack of Federal regulation as one of the largest problems with insurance, and the manner in which insurance companies conduct business in this country. As more and more insurance, re-insurance, under-writing, and companies associated with the business of insuring America continuously sell insurance state to state and to American policy holders who do not have the available capital, time, or sophistication to force out of state insurance companies protected by the laws of the states which are contractually of their own design, an obvious and expensive injustice is visited upon the American insurance product purchaser with increasing frequency. This is especially true as solvency and ratings for most insurance companies are issued by state insurance commisioners or state secretaries of state, who often place insurance companies into recievership or liquidation prematurely so as to allow lesser to no values to be paid to honest American business, personal, or retirement insurance purchasers. T.A.P. believes that if there were Federal over-site and regulation of the insurance industry then insurance companies could not duck and hide behind the various, different, and confusing seperate state laws to cheat those whom have a lawful and legal right to have the claims and insured amounts paid them. Therefore, T.A.P. demands a Federal Insurance Department be created by the legislature, which does have proper investigative, enforcement, and prosecutory powers in order to stream-lline, make fair, and hold accountable all insurance companies doing business in America and insuring American citizens.

　FOREIGN POLICY

　Lead by example shall be the policy of the new America, as the oldest super-power and the beacon of democracy, the rule of law, and social justice we have a duty to the world to set an example of how best to temper that power and when it is most

appropriate to utilize both hard and soft power. As countries like China and India come into their own as the global economic and nuclear powers which shall either trade, partner, or possibly even war with America in the future, it is up to the United States and our foriegn policy, our systems of justice and economics, and most importantly the example of how we treat our own citizens which will be our greatest or worst asset. To lead by example, and walk the walk must be the credo of these United States of America. This is never more true then now as our government looks foolish on insisting that foreign powers do not spy on American citizens, when our own government will not refrain from such activities herself in violation of our own laws, beliefs, and standards of justice.

　America is in dire need of a rebranding and global Public Relations up lift, and for this reason the T.A.P. hereby calls for an immediate closure of Guantanamo Bay Prison. Furthermore, we demand that the American Standard and rule of law known as the Writ of Habeas Corpus be afforded all current detainies. The T.A.P. is not ignorant to the difficulties, predujices, or ramifications of giving trials to all prisoners. Furthermore, we are aware of exactly how hard such trials and rights will be to grant the prisoners at Guantanamo Bay, and that is exactly why T.A.P. makes the demand on this Government. We must show the world that we mean what we say, and our words like freedom, liberty, justice, democracy, and fairness are not mere shallow words of rhetorical puffery used to sell other nations on our ideals.

　We are aware of the dangers and possible humiliation which may be fall the United States of America by granting trial to men whom if not terrorists when taken and held are deservedly angered at this Country, should it be found that the evidence against them does not warrant further detention. However, we are of the opinion that on a longer time horizon and on a far more global scale that the willingness of America to show the world that even in the face of possible humiliation and danger, the one thing that is not breakable, erasable, or forgetable is the word, honor, and actions of this great country or her citizenry in regards to our most fundamental and core beliefs. Having travelled abroad and being fully aware of the awesome influence and power of the United States of America, in shaping and even directing the global opinion and attitude of our fellow and equal sister sovereign states of the United Nations and N.A.T.O. peace keeping organizations, we are of the opinion that the act of the United States of America showing a recommitment to our founding and fundamental principles and ideals will have a disrupting influence for global good that will reverberate through-out the whole of this planet. Moreover, we believe it will soften our hardest enemies positions, grant us a new and lost respect amongst the global soveriegn state community, and most importantly deny a recruiting and rhetorical tool which present and future enemies can use to gather numbers to their ranks by pointing out our inconsistancies, hypocracies, and therefore calling into question the honor and global intent of the United States of America.

　There was a time, when America enjoyed a great amount of respect and trust amongst the global community. Furthermore, this esteemed honor and influence granted the United States of America unpresidented soft-power which prevented the more recent common uses of our over-wheling hard military power. We were

seen as peace keepers and peace bringers, but more importantly as the one country which would be fair and consistant to those countries wishing to be our trading and military allies. However, our hypocracies and inabilities to follow our own laws and stated values, do leave a void and gap in the global psychy. Moreover, it is the belief of T.A.P. that should America fail to re-establish ourselves as the moral and justicious superior through the simple act of calling for a government which polices itself, respects its Constitutional limits on power, and we re-establish the prime example of what true and fair democracy actually looks like in practice and action that another world power and global philosophy shall fill the void which our governments own hypocracies and Constitutional violations have created in the global psyche. Furthermore, once that void is fully dominated by another global super power and the global philosophy of that country as it takes a hold of the influencial soft-power reigns of global influence which the current government is so desporately attempting to forfit, through its continuous acts of scandolous and hypocritical denial of the Constitutional Laws which both bind and create that government, there shall be no positive or meanful example of geo-political and economic democratized capitalist super power which may serve as a proper role model and example for other countries to emulate and mimic.

　

It is the belief of T.A.P. that while America re-establishes herself through acts of

true democracy, we must also allow both Germany and Japan the right to re-arm

themselves, and fully and forever do away with the remaining post World War II

military restrictions placed upon two of our now greatest economic and global

allies as to the amounts and sorts of military hardwares or capabilities our two

allies can posses. We believe that while peace and stability shall be and are the will

and goals of this Countries foriegn policy and geo-economic political vision for the

world, at the same time it is adventageous for the United States of America to have

allies that are capable of acting as strategic military allies which always keep the

global hardpower capabilities most in favor of America and her greatest allies.

T.A.P. believes that the re-emergence of German and Japanese global military

capabilities will serve as a strong deterent against possible future power

paradigms or undeserous foriegn alliegences between sovereign foreign states

whom may wish to do away with American influence, and her closest allies, be it

soft or hard power.
