The Waqfs Ordinance 1962

(East Pakistan Ordinance No. I Of 1962)

An Ordinance to consolidate and amend the law relating to theadministration and management of Waqf properties in

Bangladesh.1

WHEREAS it is expedient to consolidate and amend the law relating to the administration andmanagement of Waqf properties in Bangladesh;

NOW, HERE!ORE, in p"rs"ance of the #residential #roclamation of the se$enth da% of Octo&er,'()*, and ha$ing recei$ed the pre$io"s instr"ctions of the #resident, the +o$ernor is pleased, inexercise of all powers ena&ling him in that &ehalf, to mae and prom"lgate the following Ordinance,namel%-.

CHAPTER I

Short title, extent andcommencement

1. (1) This Ordinance may be called the 2[* * *]Waqfs

Ordinance, 1962.

any instit'ti"n, s'ch as m"sq'e, shrine, dar%ah, hanq'ah,

sch""l, madrasah, id%ah "r %ra0eyard entitled t" recei0e any

s'ch benefits/

and charitable 'r"ses, s'ch a #aqf shall be deemed t" be a

dministrat"r, a"int s'ch n'mber "f 4e'ty dministrat"rsand ssistant dministrat"rs as may be deemed necessary.

Remuneration of the DeputyAdministrators and Assistant

Administrators

1. The salaries, and the terms and c"nditi"ns "f ser0ice, "f

the 4e'ty dministrat"rs and ssistant dministrat"rs shall

be s'ch as may be rescribed by the r'les.

Other Officers and Servants

Stren!th and remuneration of

staff

15. The dministrat"r, #ith the re0i"'s sancti"n "f the

A"0ernment, may, fr"m time t" time, determine the n'mber,desi%nati"ns and %rades "f "ther "fficers and ser0ants #h"m

he c"nsiders necessary t" eml"y f"r the 'r"ses "f this

Ordinance and the am"'nt and nat're "f the salary, fees and

all"#ances t" be aid t" each s'ch "fficer and ser0ant.

Service condition of theofficers and servants

16. The c"nditi"ns "f ser0ice "f the "fficers and ser0ants

menti"ned in secti"n 15 shall be s'ch as may be rescribed

by the r'les.

Power of appointment, etc,

vested in the Administrator

The Committee

19. The A"0ernment shall establish a 3"mmittee t" be called

the Waqfs 3"mmittee f"r assistin% and ad0isin% the

dministrat"r in administerin% the #aqfs and their f'nds andin the e!ercise and erf"rmance "f his "#ers and d'ties in

acc"rdance #ith the r"0isi"ns "f this Ordinance.

%onstitution of %ommittee

28. (1) The 3"mmittee shall c"nsist "f the dministrat"r as

3hairman and ten members t" be a"inted by the

A"0ernment "f #h"m "ne shall be a m'ta#alli "f ?hia sect,

and three shall be m'ta#allis "f the ?'nni sect, and the

remainin% si! shall be fr"m am"n% the r"minent, resectable

and bene0"lent citiCens "f the :'slim c"mm'nity, #ell 0ersed

in :'slim ;a#.

(2) The names "f the members "f the 3"mmittee, #hen

a"inted, shall be 'blished by the A"0ernment in the

"fficial AaCette.

#erm of Office of 'em$ers

21. (1) >0ery member "f the 3"mmittee shall h"ld "ffice f"r a

term "f fi0e years, and shall, if "ther#ise q'alified, be eli%ible

f"r rea"intment "n the e!iry "f his term "f "ffice.

(2) member "f the 3"mmittee, n"t#ithstandin% the e!iry

"f his term "f "ffice, shall c"ntin'e t" h"ld "ffice 'ntil the

0acancy ca'sed by the e!iry "f the said term has been filled.

(&) f any m'ta#alli, #h" is, as s'ch, a member "f the

3"mmittee, ceases t" be a m'ta#alli, the A"0ernment shall,

by n"tificati"n in the "fficial AaCette, declare his lace t" be

0acant.

Removal of 'em$ers 22. (1) The A"0ernment may, by n"tificati"n in the "fficialAaCette, rem"0e any member "f the 3"mmittee, if he

(a) ref'ses t" act "r bec"mes incaable "f actin% as a

member "f the 3"mmittee/

(b) is declared ins"l0ent/

(c) has been "r is c"n0icted "f any s'ch "ffence "r has been

"r is s'bected by a criminal 3"'rt t" any s'ch "rder #hich, in

the "ini"n "f the A"0ernment, renders him 'nfit t" c"ntin'e

as a member "f the 3"mmittee/ "r

(d) is absent #ith"'t the ermissi"n "f the 3"mmittee fr"m

(2) The A"0ernment may fi! a eri"d d'rin% #hich any ers"n

Resi!nation of 'em$ers

2&. member "f the 3"mmittee may resi%n his "ffice by

%i0in% n"tice in #ritin% t" the A"0ernment, and, "n s'ch

resi%nati"n bein% acceted, shall be deemed t" ha0e 0acated

his "ffice.

2. When the lace "f a member "f the 3"mmittee is declared

0acant 'nder s'b secti"n (&) "f secti"n 21 "r bec"mes 0acant

by his rem"0al 'nder secti"n 22 "r resi%nati"n 'nder secti"n

manner r"0ided in secti"n 28 and shall h"ld "ffice s" l"n% as

25. (1) The resence "f at least f"'r members "f the

3"mmittee shall be necessary t" f"rm a q'"r'm at a meetin%

"f the 3"mmittee.

(2) The dministrat"r, "r, in his absence, a member electedby the members resent at a meetin% "f the 3"mmittee, shall

reside at e0ery meetin% "f the 3"mmittee, and shall ha0e a

sec"nd "r castin% 0"te in all cases "f eq'ality "f 0"tes.

Allowance to 'em$ers for)ourneys

26. There shall be aid t" each member "f the 3"mmittee,

all"#ances f"r "'rneys 'ndertaen in the dischar%e "f their

d'ties 'nder this Ordinance at s'ch reas"nable rates as may,

fr"m time t" time, be determined by the A"0ernment.

7r"0ided that, in f'rtherance "f the "bects "f the #aqf "r inthe interest "f the beneficiaries, the 3"mmittee may re0ise

any r"0isi"n in the #aqf deed #hich has bec"me in"erati0e

"r im"ssible "f e!ec'ti"n "#in% t" the effl'! "f time "r

chan%ed c"nditi"ns.

this Ordinance.

(&) The "#ers 0ested in the 3"mmittee 'nder this

Ordinance, shall, #hen there is n" 3"mmittee "r #hen the

3"mmittee cann"t f'ncti"n f"r any reas"n, be e!ercisable by

the dministrat"r.

(6) When a m'ta#alli c"mmits a breach "f tr'st "r d"es any

#r"n%f'l act ca'sin% l"ss t" the #aqf r"erty, he shall be

liable t" mae %""d the l"ss s'stained by the #aqf r"erty

"r its beneficiaries.

r"erty c"ncerned, the mana%er "r ?aada nashin, if there

be "ne, and the 4e'ty 3"mmissi"ner "r his reresentati0e,

shall be am"n% the members there"f/ and the 7resident and

the ?ecretary "f each s'ch c"mmittee shall be a"inted bythe dministrat"r fr"m am"n% the members "f the

c"mmittee.

(5) The "fficer "r a%ent "r "fficial m'ta#alli "r the mana%in%

c"mmittee a"inted 'nder s'b secti"n (&) f"r the

mana%ement "f any #aqf r"erty taen "0er by the

dministrat"r 'nder s'b secti"n (1), shall frame a scheme f"r

the administrati"n "f s'ch #aqf r"erty as nearly as "ssible

in c"nf"rmity #ith the #ishes "f the #aqif and the terms and

c"nditi"ns "f the #aqf and in acc"rdance #ith the r"0isi"ns

"f this Ordinance s'bect t" the ar"0al "f the dministrat"r

#h" may mae s'ch m"dificati"ns in the scheme as he

c"nsiders necessary.

(6) The dministrat"r shall maintain a c"mlete rec"rd "f all

#aqf r"erties taen "0er by him 'nder s'b secti"n (1), and

shall ee acc"'nts "f inc"me and e!endit're "f s'ch

r"erty incl'din% the e!endit'res "n the administrati"n and

his establishment f"r s'ch 'r"se, in s'ch manner as may

be rescribed/ and all m"neys recei0ed "r realised by the

dministrat"r in resect "f s'ch r"erties 'nder his c"ntr"l

and mana%ement shall be credited t" the Waqf G'nd.

&5. (1) The m'ta#alli, "r any ers"n claimin% any interest inthe r"erty in resect "f #hich a n"tificati"n has been iss'ed

'nder s'b secti"n (1) "f secti"n &, may, if a%%rie0ed by s'ch

n"tificati"n, s'bmit a etiti"n #ithin three m"nths "f the

'blicati"n "f s'ch n"tificati"n "r "f the assin% "f s'ch "rder,

t" the 4istrict E'd%e #ithin #h"se 'risdicti"n s'ch #aqf

r"erty "r a art there"f is sit'ated, f"r a declarati"n,

(a) that the r"erty is n"t a #aqf r"erty/ "r

(b) that the r"erty is #aqf r"erty #ithin the limits stated

in the etiti"n.

(2) The 4istrict E'd%e may ass s'ch "rder as he thins fit

after hearin% the arties, "r he may, f"r reas"ns t" be

rec"rded in #ritin%, ref'se t" iss'e any r"cess f"r c"mellin%

the attendance "f any #itness "r the r"d'cti"n "f any

d"c'ment, if he c"nsiders that the etiti"n has been made f"r

the 'r"se "f 0e!ati"n and delay, and dismiss the etiti"n

s'mmarily.

m"neys recei0ed "r e!ended by the m'ta#alli "n behalf "f

the #aqf d'rin% the eri"d "f t#el0e m"nths endin% "n thethirtieth day "f E'ne "r "n the last day "f the $en%ali year, "r,
