Happy Monday! Welcome Back! I hope everyone
enjoyed their Spring Break!
It is now Spring and the clocks have moved one hour ahead and the days are get-ting longer.
As the sun is warming up I always find this time of year the hardest to concen-trate on school.
Baseball is start-ing and March Madness is on its way. With all of these distractions it seems the club ban-quets and Barrister’s Ball are also right around the corner.
Congratulations to all those students who took the MPRE this weekend.
I wish everyone luck in remaining fo-cused this week dur-ing our first real heat wave!

Professor Jeffrey Fisher on Cunningham v. California: Criminal Sentencing in CA
The US Supreme Court just decided Cunningham v. California where California defendants’ right to a jury trial was at issue. Spe-cifically, “whether the [California’s Determinate Sentencing Law], by placing sentence-elevating factfinding within the judge’s province, violates a defendant’s right to trial by jury safeguarded by the Sixth and Fourteenth Amendments.”
A leading Supreme Court litigator and nationally recognized expert on criminal procedure, Jeffrey Fisher has argued several and worked on dozens of other cases before the U.S. Supreme Court. His successes include bringing and winning the landmark cases of Blakely v. Washington, in which the Court held the Sixth Amendment right to a jury trial applies to sentencing guidelines and Crawford v. Washington, in which he persuaded the Court to adopt a new approach to the Constitution's Confrontation Clause. In 2006, the National Law Journal named Professor Fisher one of the 100 Most Influential Lawyers in America.

The CCFAJ was created by the California State Senate to examine the causes of wrongful convictions, and to make recommendations to the Governor and Legislature to insure that the administration of criminal jus-tice in California is just, fair, and accurate. CCFAJ’s membership represent a diverse array of viewpoints, from the criminal defense community, law enforcement and prosecutors, the judiciary, victims’ rights, and the public at large. John Van de Kamp was elected California's Attorney General in 1982 and served two terms. In 2006 the California Senate Rules Committee appointed him to serve as the Chair of CCFAJ. The Commission in-cludes three members of the Santa Clara Law School community: Professor Jerry Uelmen, Executive Direc-tor; Professor Cookie Ridolfi, Commission Member; and Chris Boscia, part-time 3L and Executive Assistant. The Commission’s final report is due at the end of 2007.
