This “Phase I report” reviews the legal opportunities and hurdles associated with the lease or purchase of water for instream benefit, specifically focusing on the adjudicated water rights in the Scott River watershed. It concludes that such instream dedication is feasible, and provides advice on how to legally accomplish instream transfers through the state water rights process. It is NOT a plan, but a review of legal options specific to the Scott River’s water diversions.

The Shasta-Scott Pilot Program portion of this State Coho Strategy addresses specific recommendations for the watershed, including a water augmentation task supporting the Scott River Water Trust -- Task # WA-1a: “Support the on-going efforts of the Scott River Water Trust as a non-permanent agent for buying water to augment instream flows.” The issue being addressed is “low instream flows limit survival and growth during some coho life stages”, while the solution is “provide a structured process for willing participants to donate, sell, or lease water or water rights to provide improved stream flow for coho salmon and habitat at critical periods.”

The EIR studied and identified all project environmental effects, and identified mitigation measures to make construction of the project feasible. The EIR was the prepared after consultation meetings with California Department of Fish and Game (DFG), Army Corps of Engineers (ACOE), National Marine Fisheries Service (NMFS), and Fish and Wildlife Service (FWS), and extensive field investigations by qualified wetland and fisheries biologists.
