There is, she says, no certain difference between the two terms - in effect, a licence gives dispensation to depart from the canon law relating to marriage by banns, and use of the term "dispensation" tends to imply further departures from the norm than simply dispensing with the calling of banns - for example, a marriage in those seasons of the church's year not normally available for marriages. But none of the suggested reasons seem to apply here. It is not even clear why a dispensation / licence would be obtained – the couple do not seem to have the time pressure of a pregnancy and a labourer seems an unlikely person to want the status of a dispensation / licence.

Jone had not been married before - neither register nor Bishop's transcript gives Thomas' marital status - instead it gives his occupation. Thomas and Jone READ were living in Sandbach, Cheshire, England from February 1744/45 to November 1767.6,7,8,9,10 He died on 5 November 1767 (estimated) (Thursday).11,12 Date of death estimated by subtracting an arbitrary 3d from date of burial. Thomas was buried on 8 November 1767 (Sunday) at St. Mary's in Sandbach.13 The register uses the spelling "Spord".

Origins of Thomas: FamilySearch has only two baptisms of a Thomas Spode or similar in Cheshire between 1600 and 1730. One in 1615 - way too early - and another in 1657 - both in Winwick (this is in Lancashire actually). Wolstanton, in Staffordshire, does have a 1719 baptism, apparently. There are then no marriages of a Cheshire Thomas Spode at all in the same time period. However, it is clear this is not the full story as baptisms are recorded in Cheshire with a Thomas Spode as a father - in 1723, a Sara is baptised to Thomas and Sara at Astbury, followed by Anna in 1729 at Church Lawton. Thomas' wife, Sarah, seems to be buried at Church Lawton in the same year. There is also a John, who is baptised in 1691 to Thomas Spode at Winwick. If there are missing baptisms and marriages, then the possible explanations would seem to be: • They were never baptised or married in the first place; • They were married or baptised in Cheshire, in the Church of England, but the records were lost; • They were married or baptised in the Church of England, but outside Cheshire – for instance, there are some interesting Thomas Spode entries in the Wolstanton registers, according to FamilySearch; • They were married or baptised in another denomination – Roman Catholic, for instance. This might explain why a dispensation was obtained for Thomas' marriage. Jone READ1,3 was living in Swettenham parish, Cheshire, England to July 1743.1,2,3 This was immediately before her wedding. Jone was living in Sandbach to February 1777.14 Presumably she never moved from Sandbach after her husband's death. Jone died on 18 February 1777 (estimated) (Tuesday).15 Date of death estimated by subtracting an arbitrary 3d from date of burial. Jone was buried on 21 February 1777 (Friday) at St. Mary's in Sandbach.14 The register uses the spelling "Spord". NAME: It is clearly "Jone Read" on the Astbury BT, not "Jane". There are other "Jone" references relating to the marriage. However, the burial is clearly "Jane". Whether this is a genuine change, the correct form, or an error, we cannot know yet.2,16 When was Jone born? She married in 1743, so if we take her age to have been at least 16 at marriage, she must be born before 1727. Her children were born about 3y apart and her last child was born in 1751 (NS). If an average age for the last plausible child were taken as 42, then Jone could have been between 38 and 42 when the last was born. This corresponds to her own birth between 1709 and 1713. There is a 1706 baptism at Astbury, though this would put her aged 45 at her last birth - possible but right on the limit. The only signs of a Spode family in Sandbach between 1720 and 1768 - apart from Thomas and Jone - are: - marriage Sarah Spode to John Deane, 29 Nov 1725 - marriage of Mary "Spodein" to Randle Barkers, 11 May 1746. Jone READ and Thomas SPODE had the following children:

Second Generation 2. Thomas SPODE,17 son of Thomas SPODE and Jone READ, was born before 1 February 1744/45.18 He was baptised on 1 February 1744/45 (Friday) at St. Mary's in Sandbach,

Cheshire, England.17 He was living in Sandbach from February 1744/45 to April 1746.7,17 He was living here with his parents. Thomas died on 22 April 1746 (estimated) (Tuesday).19 Date of death estimated by subtracting an arbitrary 3d from date of burial. Thomas was buried on 25 April 1746 (Friday) at St. Mary's in Sandbach.7

3. Thomas SPODE,8 son of Thomas SPODE and Jone READ, was born before 25 October 1747.20 He was baptised on 25 October 1747 (Sunday) at St. Mary's in Sandbach.8 He was

living in Sandbach from October 1747.8 He was living here with his parents. From 25 October 1759 Thomas was an apprentice cordwainer in Sandbach.21 Exactly 12 years after his baptism, Thomas was apprenticed to William Ryder, a cordwainer of Sandbach. The apprenticeship was to last for 6 years, taking him up to the age of 18 in 1765 and based on the records of the duty paid, Ryder was to receive £12 for taking on Thomas, with 12 shillings of that going in stamp duty. Oddly the rate of 1 shilling in the pound is double that mentioned in the guide from the UK's TNA, so maybe the rate went up.

Thomas and Martha HIGHAM had marriage banns published between 31 January 1768 and 14 February 1768.22 The banns were read on 31 January, 7 and 14 February. Thomas was living in Sandbach to February 1768.22 This was immediately before his wedding. Thomas was illiterate in February 1768.22 He married Martha HIGHAM on 14 February 1768 (Sunday) at St. Mary's in Sandbach.22 The couple were married by John Gibson, the curate, after banns, and they had two witnesses - John and Sarah Furnivall. In neither case is there any detail about the marital state or occupation of the bride and groom.

Thomas and Martha HIGHAM were living in Sandbach from November 1768 to November 1792.23,24,25,26,27,28,29,30,31,32,33,34,35,36 He was living at Scotch Common in Sandbach to September 1805.37 When Thomas is buried in September 1805, he is described as being of Sandbach parish, with the additional comment of "Commons". Normally this comment is used to qualify the residence - hence it is probable that he lived on or around what I refer to in 2012 as Sandbach Common, the triangular open space often used as a market and a car park. Note that the 1841 tithe map on the Cheshire Archives web-site calls it "Scotch Common" - indeed the 1909 OS map still does. The fact that "Scotch Common" is the only such area in Sandbach to be highlighted with its own name on the 1841 map, does seem significant, suggesting it is a known area of the town. Therefore I use it as the address. Thomas died on 13 September 1805 (estimated) (Friday).38,39 Date of death estimated by subtracting an arbitrary 3d from date of burial. Thomas was buried on 16 September 1805 (Monday) at St. Mary's in Sandbach.37

Martha HIGHAM22 was living in Sandbach to February 1768.22 This was immediately before her wedding. Martha was illiterate in February 1768.22 She died on 22 November 1792 (estimated) (Thursday).40 Date of death estimated by subtracting an arbitrary 3d from date of burial. Martha was buried on 25 November 1792 (Sunday) at St. Mary's in Sandbach.36 The register uses the spelling "Spord". There are no local baptisms for a Martha Higham in the era 1739-1755, which seems an appropriate range for someone who had a child in 1789 and was married in 1768. All Cheshire baptisms in those years are in Marple, Cheadle and Ince. At the moment, there is a gap between the baptisms of their sons William in May 1776 and John in August 1780. Four years is an incredible gap for this family. Is someone missing? John Spode, baptised 17 December 1791 might be their son, but I suspect not.41 Martha HIGHAM and Thomas SPODE had the following children:

One possible fate for John is that he appears as a 26y old miller of Warmingham, obtaining a licence to marry Sarah Leech of Warrington. This licence was obtained 10 December 1770. The implied birth is about 1744/45, which is rather too early for our John, plus the whole set-up is a little too up-market, perhaps?

Third Generation 5. Samuel SPODE,23 son of Thomas SPODE and Martha HIGHAM, was born before 20 November 1768.43 He was baptised on 20 November 1768 (Sunday) at St. Mary's in Sandbach,

Cheshire, England.23 He was living in Sandbach from November 1768.23 He was living here with his parents.

Samuel probably marries Sarah Dutton at Sandbach on 11 June 1790 - one of the witnesses is George Ridgway, the name of a witness at the wedding of his brother, Thomas, in July 1789. He is the only possible candidate of the Sandbach baptisms, as the other Samuels are far too young - the oldest would be 7 at the time of this wedding. Options elsewhere in Cheshire for that 1790 marriage are a 1733 baptism in Warmingham to James and Mary Spode (who would be 57) and a 1769 baptism in Wybunbury to Joseph Spode. The Wybunbury child is buried in 1770 (he is an infant and the father's name is Joseph again). There is no burial in Warmingham of a Samuel Spode (with variant names). Options for Samuel's burial are: - 1802 in Sandbach; - 1810 in Sandbach. Other Samuel Spode burials have implied years of birth and they are all 1800 or later. There are no other Samuel Spode burials in Cheshire, aside from the 1770 Wybunbury one. The 1802 burial cannot be the husband of Sarah Dutton - there is only one Samuel Spode marriage to a Sarah in Cheshire and the family have children up to 1804 - albeit with a 10y gap in the baptisms.

6. Thomas SPODE,24,44 son of Thomas SPODE and Martha HIGHAM, was born before 5 March 1770.45,46 He was baptised on 5 March 1770 (Monday) at St. Mary's in Sandbach.24 He was living in Sandbach from March 1770.24 He was living here with his parents.

Thomas and Mary LATHAM had marriage banns published between 21 June 1789 and 5 July 1789.47 The banns were called on 21 June, 28 June and 5 July. Thomas was literate in July 1789.47 He was living in Sandbach parish, Cheshire, England to July 1789.48 This was immediately before his wedding. Thomas married Mary LATHAM on 18 July 1789 (Saturday) at St. Mary's in Sandbach.48 The couple were married after banns by the curate, John Sibson. Their two witnesses were George [Ridgway] and a Thomas whose surname is illegible but looks something like "Cormack". The register says nothing of their marital status or jobs. Although the clerk has written "Spord" in the register, the groom's signature is not Spord and is probably Spode.

Thomas and Mary LATHAM were living in Sandbach from January 1790 to September 1805.49,50,51,52 In January 1797 he was a shoemaker in Sandbach.44,53 He was living in Sandbach to March 1806.54 This was immediately before his death. Thomas died on 26 March 1806 (estimated) (Wednesday).55 Date of death estimated by subtracting an arbitrary 3d from date of burial. He died some six months after his wife and father. Thomas was buried on 29 March 1806 (Saturday) at St. Mary's in Sandbach.54

Genealogical notes - Spode of Sandbach - John Spode baptised 17 December 1791. John Spode is baptised 17 December 1791 to Thomas Spode ("Spord" in the register) of Sandbach. There are only two families known in Sandbach at this time with a father of that name. If we accept that identification (as we have done elsewhere with no issues) then this child's parents are either: Thomas Spode & Martha Higham (married 14 February 1768) or Thomas Spode & Mary Latham (married 18 July 1789). The two Thomases are father and son. My belief is that John is the child of the younger couple - however I cannot claim to have "proven" this.

The last known child to Thomas Spode & Martha Higham is Martha Spode, baptised 21 Dec. 1789. Assuming baptism and birth to be at roughly the same time, then the last known children to this couple are born at intervals of 4, 3, 3 and 3 years. If John were born to this family, he would be born just 2 years after Martha. The first known child to Thomas Spode & Mary Latham is Anna, baptised 13 January 1790. She is followed by Martha baptised 23 February 1794. If John were born to this family, he would be born 2y after Anna and 2y before Martha. Without John, the known children born to Thomas and Mary are born at intervals of 6m after the marriage, 4y, 3y, 2y, 4y, 2y. The intervals therefore suggest that the younger couple is more likely, especially as the elder couple would have this child at a reduced interval. However, this cannot be regarded as proven yet. All four parents are alive at the time of John's baptism.

Mary LATHAM47,56 was born between September 1768 and September 1769.57 She was illiterate in July 1789.47 She was living in Sandbach parish to July 1789.48 This was immediately before her wedding. Mary died on 6 September 1805 (estimated) (Friday).58 Date of death estimated by subtracting an arbitrary 3d from date of burial. Mary was buried on 9 September 1805 (Monday) at St. Mary's in Sandbach.52 There are several options for her baptism, including three in nearby Warmingham. John Spode, baptised 17 December 1791 is probably their son. In addition, there must be a possibility of a missing child born about 1800.41

15. Martha SPODE,35 daughter of Thomas SPODE and Martha HIGHAM, was born before 21 December 1789.72,73 She was baptised on 21 December 1789 (Monday) at St. Mary's in Sandbach.35 The register uses the spelling "Spord". Martha was living in Sandbach from December 1789.35 She was living here with her parents.

Martha was living in Sandbach parish to September 1808.74,75 This was immediately before her wedding. Martha was literate in September 1808.74 Martha's signature is not sophisticated, but she can at least write her name - the only one of the bride, groom and witnesses to do so that day. Martha and William YARWOOD obtained a licence to marry on 29 September 1808 in Sandbach.75,76 The bishop's surrogate administers the request for the marriage licence. The one recorded on the bond and allegation is Charles Lockett, who would marry William and Martha in Sandbach church on the next day, so we assume that the request was made in Sandbach. The bond was an assurance that there was no reason why William and Martha should not be married. It was "signed" by William Yarwood and George Henshall, both cordwainers of Sandbach, and committed them to pay the Bishop of Chester the sum of £500 if it turned out that there was indeed an impediment to the marriage. The allegation - effectively, the application - claimed that both William and Martha were at least 21. Based on her baptism and the interval between children, it's fairly clear that Martha was only 18 or 19 at most. Martha married William YARWOOD on 30 September 1808 (Friday) at St. Mary's in Sandbach.74,75 The couple were married by licence in a ceremony conducted by Charles Lockett. Neither had been married before and their witnesses were George Henshall and J Adkins - the latter's first name is both abbreviated and unclear, the legible part being possibly "Ja". George Henshall, like William, a cordwainer of Sandbach, had been a bondsman with William on the previous day when applying for the marriage licence. (In fact, the 1841 census has George Henshall and George Atkins, both shoemakers, and both living in the same house in Sandbach, so this may be who the two witnesses were).

Martha and William YARWOOD were living in Sandbach from May 1810 to November 1814.77,78,79 She died on 12 November 1814 (estimated) (Saturday).80 Date of death estimated by subtracting an arbitrary 3d from date of burial. Martha was buried on 15 November 1814 (Tuesday) at St. Mary's in Sandbach.81 William YARWOOD74 was born before September 1787.82 He was living in Sandbach parish to September 1808.74,75 This was immediately before his wedding. William was illiterate in September 1808.74,75 From September 1808 to September 1814 he was a cordwainer in Sandbach.83,84 Given the gap between Ellen and Thomas, there is room for another child between Thomas and Martha. William YARWOOD and Martha SPODE had the following children:

Sandbach, Cheshire, England.49 The register uses the spelling "Spord". Anna was living in Sandbach from January 1790.49 She was living here with her parents. 17. Martha SPODE,50,86,87 daughter of Thomas SPODE and Mary LATHAM, was born before 23 February 1794 in Sandbach.88,89,90,91,92,93,94 She was baptised on 23 February 1794

(Sunday) at St. Mary's in Sandbach.50 The register uses the spelling "Spord", which accounts for why I couldn't find her baptism to start with! Martha was living in Sandbach from February 1794.50 She was living here with her parents.

Martha was living in Barthomley parish, Cheshire, England to September 1814.95 This was immediately before her wedding. Martha married William COOPER on 19 September 1814 (Monday) at St. Bertoline's in Barthomley, Cheshire, England.95 Neither had been married before and their witnesses were Joseph Hele and Hesther Spode. The only plausible known candidate for Joseph Hele is William's cousin of that name, born 1791 - the other cousin of that name is only 12 at this time. Hesther must be Martha's sister, often written as "Esther". Martha was living in Haslington, Cheshire, England in September 1815.96 She was living in Crewe Green, Cheshire, England from September 1821 to 1831.97,98,99,100 She was living in Haslington from April 1839 to March 1851.86,101,102 She was living in Madeley, Staffordshire, England to September 1854.103 This was immediately before her wedding to Edward Turner, but since both of then are known to live in Haslington before and after - in the previous May in Edward's case - it is clear that this is simply a temporary address of convenience. Martha was illiterate in 1854.103 She married Edward TURNER on 19 September 1854 (Tuesday) at All Saints in Madeley.104 Edward and Martha, who had both been widowed, married after banns in a ceremony conducted by H Sutcliffe. They had two witnesses - Joseph Griffiths and Charles Charity who, based on the rarity of the name, surely has to be Martha's son-in-law. Martha and Edward TURNER were living in Haslington from April 1861 to May 1873.105,106,107 At the 1861 census, Edward and Martha also have with them, 6y old Hannah Turner (described in the census as Edward's daughter) and John Miller, a 37y old boarder who is a stock-dealer ("stock" in the sense of cattle). The couple live next door to Martha's son, Uriah Cooper and his family.

At the 1871 census, the couple - now on their own - are living next door (as far as the census goes) to the Broughton Arms Inn, and also next door to Uriah. We suggest that, as Uriah is next to New St., then both Uriah and the Turners live on what is now Bradeley Road, probably between the Broughton Arms corner and New St. In fact, the 1882 OS map doesn't show much along this road - then known as Smithy Lane. Martha died on 24 March 1880 (Wednesday) in Haslington. The cause of death was natural decay.108 The cause was certified by H.E.W. Vaughan MRCS LSA and the death was reported later that day by her grandson, George Cooper, who had been present at her death. (Martha has at least two grandsons of this name). Martha was buried on 27 March 1880 (Saturday) at St. Matthew's in Haslington.109 EH Rose, the vicar of Haslington, conducted the ceremony.

We thus have 3 (the last 3 above) whose fates are unaccounted. We deem this list to be as complete as possible. Apart from a Warmingham baptism in 1737, and a Chester baptism in 1840, these are the only Martha Spode baptisms in FMP's Cheshire collection. For Martha Spode fates, there are: - An 1808 marriage at Sandbach in Sept 1808 to William Yarwood; - An 1814 marriage at Barthomley to William Cooper - this is my 4G grandmother, and we know her father is Thomas, a shoemaker (see her own 2nd marriage), and also that she is born in the 1790s. There are no other marriages and no other burials on FMP, apart from the ones mentioned above. We therefore have only 2 fates for 3 Marthas. CheshireBMD and Ancestry's censuses add nothing for the area. Can we get more data about Martha Yarwood, nee Spode? I can't see her on Ancestry in the censuses. In Sandbach PRs, we see baptism on 18 Sept 1814 of Martha Yarwood to William and Martha of Sandbach - William is a shoemaker. On 15 Nov 1814, Martha Yarwood, aged 24, is buried at Sandbach and on 27 Nov 1814, 9w old Martha Yarwood is buried. The 9w old child would match the Sept baptism. Is this our couple? How many William and Martha Yarwood marriages are there? - September 1808 at Sandbach (Martha "Spord" - with licence - the licence "confirms" William Yarwood lives in Sandbach); - Dec 1812 at Great Budworth (Martha Wood); These are the only two such marriages in FamilySearch in Chester. William and Martha Yarwood of Sandbach have children baptised in 1810 (Ellen), 1812 (Thomas), 1814 (Martha). The 1812 marriage at Great Budworth is thus both unlikely by location and too late for Ellen's baptism in 1810. Thus the Sandbach couple are deemed to be William Yarwood and Martha Spode. The Nov 1814 burial gives this Martha being born Nov 1789-90 - matching perfectly with the daughter of Thomas & Martha Spode. What are the ages given by the evidence for Martha Cooper? - Marriage in 1814 is "full age" - gives birth before Sept 1793; - 1841 census is "45" - gives June 1791-96; - 1851 census is 58 - gives March 1792-93; - 1861 census is 60 and missing birthplaces - discard; - 1871 census is 77 - gives April 1793-94; - 1880 death is 88 - gives March 1791-92. We know from her 2nd marriage that her father is a Thomas Spode. If Martha Yarwood matches the Dec 1789 baptism, then the only possibility is the Feb 1794 baptism. Are there any issues with her age? Allowing for a 'white lie' on her marriage, to avoid seeming too young, then all but the 1880 death are either correct or an approximate year out. While the ages could just as easily match the Nov 1792 baptism, that baptism has the wrong father so cannot be William Cooper's wife.

William COOPER,110,111 son of William COOPER (aft1767- ) and Ann HEALOW (aft1766-1841), was born on 19 April 1792 (Thursday) in Barthomley.110,112,113,114 He was baptised on 23 April 1792 (Monday) at St. Bertoline's in Barthomley.110 In September 1814 he was a labourer in Barthomley parish.95,111 He was living in Barthomley parish to September 1814.95 This was immediately before his wedding. William was living in Haslington in September 1815.96 In September 1815 he was a labourer in Haslington.96 He was living in Crewe Green from September 1821 to 1831.97,98,99,100 From 1821 to 1828 he was a labourer in Crewe Green.97,98,99 He was living in Haslington from April 1839 to December 1852.86,101,102,115 In April 1839 he was a labourer in Haslington.101 In June 1841 he was an agricultural labourer in Haslington.102 In December 1842 he was a labourer.116 From March 1851 to December 1852 he was a labourer.86,117 The 1851 census describers him as a "day labourer", so presumably he had no fixed employment but simply got what was going each day. William died on 20 December 1852 (Monday) in Haslington. The cause of death was being killed by a cart.117,118 Since William died in an accident, the coroner was involved. He was J Roscoe of Knutsford, and he was the informant for the issue of the death certificate. If the transcription of the certificate is correct in saying that the certificate was not issued until 31 December, then William was buried without a valid death certificate, though whether this was illegal then I do not know. Alternatively, a note from the coroner might suffice to authorise burial. William was buried on 24 December 1852 (Friday) at St. Matthew's in Haslington.115

Residences of William and Martha Cooper. When Thomas was baptised in September 1815, the family was living in Haslington. From September 1821 to 1831, the family was living at Crewe Green - note that although the source says "Crewe", at this time this would mean the township later known as "Crewe Green". Ann's baptism in 1834 does not record where the family lived. In June 1841, the census shows the family living somewhere in Haslington - probably on the side next to Bradeley, since the previous household is for a farmer at "Bradley". With them are three young children, Mary, William and Ann, plus their daughter Hannah and her husband, Charles Charity, who married earlier that year. While the baptism records suggest the family was first in Haslington, then Crewe Green and finally Haslington again, it would be unreasonable to be too dogmatic that they really moved. The exact boundary between the townships of Haslington and Crewe Green was probably not known to them. Indeed, 1841 census shows them probably near to Bradeley and this is not far from Crewe Green. At the 1851 census, the couple are still in Haslington - probably the village itself since there is no exact address quoted on their schedule. The next but one schedule is the Fox Inn, while the previous three are Grub St, Oakhanger Moss and Winterley - a bit of a mixed bag. With them are their daughter and son-in-law, Mary and Thomas Galley, with their own two young children, Elizabeth and Frederick.86,96,97,98,100,102,119,120 William COOPER and Martha SPODE had the following children:

25 Thomas COOPER (aft1812-1897). Thomas was born between April 1812 and 24 September 1815 in Crewe Green.121,122,123,124,125,126,127,128 He was baptised on 24 September 1815 (Sunday) at St. Matthew's in Haslington.96 He was living in Haslington from September 1815.96 He was living with his parents. In June 1835 Thomas was a labourer in Barthomley parish.129 He was living in Barthomley parish to June 1835.129 This was immediately before his wedding. Thomas married Elizabeth PRICE on 16 June 1835 (Tuesday) at St. Bertoline's in Barthomley.129 Neither had been married before. Their witnesses were John and Hannah Tomlinson. Thomas was living in Crewe Green in October 1835.130 He was living here with his family. In October 1835 Thomas was a labourer in Crewe Green.130 He was living in Tebay, Westmorland, England from June 1850 to September 1856.131,132 From July 1850 to September 1856 he was a railway inspector in Tebay.133,134,135 The railway line through Tebay was on that part of the Lancaster and Carlisle that had opened between Oxenholme and Carlisle in December 1846, completing the route between those two locations and had been worked from its opening by the LNWR.

Nuneaton, Warwickshire, England in April 1861.136 In April 1861 he was an agricultural labourer in Nuneaton.136 He was living in Haslington from April 1871 to April 1891.137,138,139 In April 1871 he was a labourer in Haslington.137 In April 1881 he was a railway labourer in Crewe, Cheshire, England.138 While he lived in Haslington, his workplace must have been in Crewe. From April 1891 to March 1897 Thomas was an agricultural labourer in Haslington.139,140 We should not presume that he was an active labourer right up to his death in 1897 - rather, that's what he was known for. Thomas was living in Nantwich, Cheshire, England to March 1897.141 The burial record describes Thomas as living in Nantwich, so presumably he had been in the Workhouse or its hospital for some time. Thomas died on 2 March 1897 (Tuesday) at the Men's Hospital, Nantwich Union Workhouse in Nantwich. The cause of death was natural decay.142 The cause was certified by JD Munro MD, and the death registered the next day by Henry Wharton, the Master of the Workhouse. Fortunately, the certificate records that Thomas was previously from Haslington. Thomas was buried on 6 March 1897 (Saturday) at St. Matthew's in Haslington.141 After an unknown period in Nantwich up to his death, Thomas came home to Haslington to be buried.

an agricultural labourer / labourer.111,150,151,152,153,154,155,156,157,158,159,160,161 We assume John was always a labourer of some sort in this time period, but note that during some of the time, he was resident in Crewe. In 1851, we know from the census that he is working as a labourer in Crewe Works, which had opened in 1843.

The 1861 census also explicitly has him as a Railway Labourer. John was living in Haslington to February 1840.111 This was immediately before his

marriage to Eliza. John was illiterate from February 1840 to 1903.111,162 When he married, John could only make his mark in the register, and this was also how he "signed" his will. John married Eliza BEBBINGTON on 24 February 1840 (Monday) at St. Bertoline's in Barthomley.111 They were married after banns by Edward Hinchliffe, the Rector of St. Bertoline's.

Neither had been married before and the clerk noted both as being "of full age", rather than writing their actual ages - though I am doubtful that Eliza

was 21 yet. The marriage was witnessed by Hannah Cooper and Samuel Durning/Dunning. Hannah was, who marries in February of 1841, is John's sister, while

John's uncle Thomas married Mary Dunning from Wistaston, so Samuel may be related to John. Both lived in Haslington, but appear to have been married at St. Bertoline's, Barthomley, this being at a time when St. Matthew's was not holding

marriages. John was living in Haslington from 1841 to 1845.150,152,163,164 He was living in Coppenhall, Cheshire, England from 1848 to 1853.154,155,156 In March 1851 he was a railway labourer.155 He was living in Haslington from 1859 to 3 July 1905.157,158,160,162,165,166,167,168,169,170,171 In April 1861 he was a railway labourer.165 From 1871 to 1891 he was a farmer at Oakhanger Moss in Haslington.167,172,173,174 In the 1871 census, John is described as a farmer of 7 acres. We assume that he farms where he lives, at Oakhanger Moss. Ten years after, he has increased this to 14 acres. In the years from 1841 to 1864, based on evidence so far, he has always been described as a labourer. So, how did he get to become a farmer? Of course, this doesn't mean he owned the land (the implication of the 1880 electoral register is that he rents or leases the land at Oakhanger Moss), but clearly he's stepped up from those years as a labourer.

Ten years later, in the 1891 census, John is still a farmer, living out at Oakhanger Moss, though the census doesn't say how many acres he farms. He is,

however, described as working on his own account, rather than employed by someone - so he certainly is more than the labourer he was for many years. From January 1880 to December 1880 John was a registered voter in the West Cheshire Parliamentary Constituency.175 He qualified as an occupier of property with a rateable value of £12 or more per annum. In 1901 John was a retired farmer.169,170 By the time of the 1901 census, when John claimed to be 83, he had retired from farming. John made a will on 1 August 1903 in Haslington.176 John's will appointed his son, Frederick, as one executor. The other was a William Rhoden of Storrington, Sussex. This William Rhoden must be related to the two witnesses who were Ellen Rhoden, of Haslington, and Lillian Rhoden, also of Storrington. I think the Rhoden family then ran a butcher's shop on High St, Haslington. John Rhoden was the butcher, Ellen his wife and William Rhoden was their schoolmaster son, all being born in Crewe or Haslington. Maybe Lilian is William's wife.

The will bequeathed the two cottages owned by John in New Street to his wife Eliza along with all the rest of his possessions, for the rest of her life.

After her death, the two cottages and his estate were to be sold off. Two bequests then take priority - the first for a sum of money sufficient to erect a stone over the grave of John and Eliza. This bequest explains why this grave has a stone, untypically for my Haslington relatives of that era. In fact, John and Eliza were buried in the same grave as their son William, who had died just two months before John wrote his will, with the result that William appears as the third name on the stone.

The second bequest was a sum of ten pounds to be paid to Martha Cooper, William's widow, who, as indicated above, may have been in John's mind

after the recent death of his son. These two bequests were to take priority - after those, the residue was to be divided equally between Martha, his daughter-in-law and his children as

follows: - Jane [Cooks or Cocks] (but subject to a charge of £30), - Thomas Cooper, - John Cooper (subject to a charge of £27), - Robert Cooper, - Samuel Cooper, - Joseph Cooper (subject to a charge of £20), - Frederick Cooper, - George Cooper (subject to a charge of £20). The charges were presumably to reflect sums of money that John had lent them. In the event of Martha marrying again, her share was to be divided equally between the three children of William and Martha. In 1903 John owned

two cottages in New St in Haslington.176 In 1903 he owned an account in the Savings Bank of Sandbach.176 He died on 3 July 1905 (Monday) at 74 Fields Road in Haslington. The cause of death was cardiac failure.170,177 John died, according to Edward Liddle, MB, who certified the death, of senile decay, acute gastritis and cardiac failure. He died at 74 Fields Road - presumably his home since it was in that road that he was living at the 1901 census - and his son Frederick registered the death the next day.

The death certificate has John aged 89 - this is likely to be an exaggeration by perhaps 3 or 4 years. John was buried on 8 July 1905 (estimated)

(Saturday) at St. Matthew's in Haslington.171 Estimate based on adding an arbitrary 5d to date of death. The grave contains William, who died in 1903, his parents John and Eliza, who died in 1905 and 1906 respectively, and William's second wife, Martha,

who died in 1927. The stone was paid for by a bequest made for this purpose in John's will. His estate was probated on 4 December 1906 in London, England.178 Probate was granted to John's son, Frederick, one of the two Executors named in the will. The other, William Rhoden, had renounced the role of executor.

The document records that John's estate had, at that time, a gross value of £329 15s. In 2005, £329 15s 0d from 1905 was worth: £23,593.68 using the retail price index £125,322.55 using an average earnings index.

27 Hannah COOPER (aft1816- ). Hannah was born between June 1816 and June 1821 in Haslington.179,180,181,182,183 According to the 1861 census, she is born 1817-18 - this seems distant from her baptism and is suspiciously the same as her husband's age.

The 1861 census has her born in Haslington, the 1871 in Crewe - i.e. Crewe Green. Hannah's own baptism - in September 1821 - shows the family to

be living in Crewe Green then but earlier references have them in Haslington. Hannah was baptised on 30 September 1821 (Sunday) at St. Matthew's in Haslington.184 She was living in Crewe Green from September 1821.97 She was living with her parents. Hannah was a witness at St. Bertoline's in Barthomley on 24 February 1840.111 She is probably the Hannah Cooper who is a witness at the wedding of her probably brother John Cooper and Eliza Bebbington - there is no other person of this name in Barthomley parish in the 1841 census. Haslington to February 1841.185 This was immediately before her wedding. Hannah was illiterate from February 1841 to December 1842.116,185 She married Charles CHARITY on 9 February 1841 (Tuesday) at St. Bertoline's in Barthomley.185 The ceremony was conducted by the rector, Edward Hinchliffe, after banns. Neither had been married before and their witnesses were James Charity and Sarah Carr. Hannah was living in Haslington in June 1841.102 Recently married, she and her husband were living with her parents. Hannah was a witness at St. Michael's in Coppenhall on 22 December 1842.116 She was a witness at the wedding of her brother, Uriah, to Martha Griffiths. Hannah was a witness at St. Bertoline's in Barthomley on 14 June 1848.186 Hannah and her husband were surely the couple of that name who were witnesses at the wedding of Hannah's sister Mary to Thomas Galley on this day. Hannah was living at Bridge House in Haslington in March 1851.187 This may be what is now known as Bridge House Farm, right out on the edge of Haslington township, where the road north from Smith's Green, near Barthomley, crosses the Crewe to Stoke railway line. Hannah was living in Haslington in April 1861.188 The family was living somewhere in the village. Hannah was living in Bradwall, Cheshire, England in April 1871.189 At the 1871 census, Hannah, now widowed, lives with her daughter Mary and her husband Joseph. Also with them is Hannah's youngest daughter, Martha. In April 1871 Hannah was an annuitant in Bradwall.189

28 Uriah COOPER (aft1823- ). Uriah was born between March 1823 and March 1824 in Crewe Green.190,191,192,193,194,195,196 The preponderance of evidence says Crewe Green - the alternative is Haslington. Uriah was baptised on 29 August 1824 (Sunday) at St. Matthew's in Haslington.197 He was living in Crewe Green from August 1824.98 He was living with his parents. In December 1842 Uriah was a labourer in Coppenhall.116 He was living in Church Coppenhall, Cheshire, England to December 1842.116 This was immediately before his wedding. Uriah was illiterate in December 1842.116 He married Martha GRIFFITHS on 22 December 1842 (Thursday) at St. Michael's in Coppenhall.116 Uriah and Martha were married by their apparent namesake, John Cooper, the minister from the church. Their two witnesses were Hannah Charity, Uriah's sister, and George Sherratt.

Neither had been married before. According to the marriage, Uriah was of full age - this seems unlikely if his baptism was at all close to his birth, as seems very likely. Uriah was living

in Haslington from March 1851 to 1881.198,199,200,201 From March 1851 to 1861 he was an agricultural labourer in Haslington.198,199 As indicated on his residence, it seems very likely that Uriah and his family lived at Haslington Hall, so it is probably he worked there in 1851.

In 1861 he seems to live more to the north-west of the village. From 1865 to 1881 Uriah was a labourer in Haslington.200,201,202 He was living in

Haslington in April 1891.203 He was living with his daughter, Mary, and her family. In April 1891 Uriah was a roadman in Cheshire, England.203 29 Mary COOPER (aft1827- ). Mary was born between March 1827 and February 1828 in Crewe Green.99,204,205 While the 1851 census says she was

born in Crewe, I believe that at the time it would have meant the township of Crewe, i.e. Crewe Green, not the new town of Crewe. Mary was baptised on 24 February 1828 (Sunday) at St. Matthew's in Haslington.99 She was living in Crewe Green from February 1828.119 She was living with her parents. Mary was living in Haslington in June 1841.102 She was living with her parents. Mary was living in Haslington to June 1848.186 This was immediately before her wedding. Mary married Thomas GALLEY on 14 June 1848 (Wednesday) at St. Bertoline's in Barthomley.186 Their witnesses were Charles and Hannah Charity - these are surely Mary's sister and her husband.

Neither had been married before. Mary was living in Haslington in March 1851.86 She and her family were living with her parents.

30 William COOPER (aft1829-1844?). William was born between June 1829 and June 1830 in Cheshire.206 He was baptised on 27 February 1831 (Sunday) at St. Matthew's in Haslington.100 He was living in Crewe Green from February 1831.207 He was living with his parents. William was living in Haslington in June 1841.102 He was living with his parents. William died on 3 August 1844 (estimated) (Saturday).208 Date of death estimated by subtracting an arbitrary 3d from date of burial. William was buried on 6 August 1844 (Tuesday) at St. Matthew's in Haslington.208

31 Ann COOPER (aft1833-1841?). Ann was born between June 1833 and May 1834 in Cheshire.209,210 She was baptised on 6 May 1834 (Tuesday) at St. Matthew's in Haslington.120 She was living in Haslington in June 1841.102 She was living with her parents. Ann died on 16 September 1841

32 Daniel COOPER (1839?-1839?). Daniel was born in April 1839 (approx.) (Monday) in Crewe reg. subdistrict, Cheshire, England.212,213,214,215 He was baptised on 28 April 1839 (Sunday) at St. Matthew's in Haslington.101 He was living in Haslington from April 1839 to December 1839.101,216 He was living with his parents. Daniel died on 30 December 1839 (estimated) (Monday) in Crewe reg. subdistrict.217,218,219 Date of death estimated by subtracting an arbitrary 4d from date of burial. Note the CheshireBMD record implies he died in 1839. Daniel was buried on 3 January 1840 (Friday) at St. Matthew's in Haslington.216

Edward TURNER103 was born on 11 October 1807 (Sunday) in Balterley, Staffordshire, England.220,221,222,223,224 He was born either in Haslington (see the 1851 census) or in Balterley (1871 census). As he was resident in Balterley at his baptism, one month after his birth, we assume he was born there. Edward was baptised on 8 November 1807 (Sunday) at St. Bertoline's in Barthomley.225 He was living in Balterley from November 1807.225 He was living here with his parents.

Edward was living in Haslington to February 1849.226 This was immediately before his wedding. From February 1849 to April 1854 Edward was a bricklayer in Haslington.226,227,228,229 He was literate from 1849 to 1854.103,226 He married Jane CATERAM on 14 February 1849 (Wednesday) at St. Bertoline's in Barthomley.226 They were married by Edward Hinchliffe after banns. Neither had been married before and their two witnesses were Ralph and Sarah Jones. In March 1851 Edward was a brick maker in Haslington.227 He and Jane CATERAM were living in Haslington in March 1851.227,230 At the 1851 census, they lived with Jane's mother, Jane Caterham, who was 82y old at the 1851 census. They are probably caring for the elder Jane as in her will, made later that year, she left all her estate to her daughter "in consideration and as a compence <compensation> for her kind attention, loss of time and trouble she has had with me during my illness". Edward and Jane CATERAM were living in Haslington in April 1854.229 From May 1854 to September 1854 he was a bricklayer.103,231 He was living in Madeley to September 1854.103 This was immediately before his wedding to Martha Cooper, but since both of then are known to live in Haslington before and after - in the previous May in Edward's case - it is clear that this is simply a temporary address of convenience. From April 1861 to April 1871 Edward was a bricklayer in Haslington.103,232,233,234 He died on 14 May 1873 (Wednesday) in Haslington. The cause of death was paralysis.235,236 Curiously, the death was not registered until 29 May, when Sarah "Sopken" registered the death. The funeral had taken place nearly two weeks previously, and I thought that a death certificate had to be provided before burial! The cause of death was also not certified, but the statement is that Edward had suffered from this paralysis (probably the effects of a stroke) for two years. Sarah "Sopken" is probably Sarah Lofkin as the 1871 census has basically the same error - she may have been born Sarah Cooper, a daughter of Uriah and Mary Cooper born 1850. If so, then she was a granddaughter of Martha, Edward's wife. Whoever she was, she is described as being in attendance on Edward - which fits a child of Uriah's, as he is next door to the Turners in the 1861 and 1871 censuses. Edward's age is incorrect - the certificate gives 70, whereas he is actually only 65. Edward was buried on 17 May 1873 (Saturday) at St. Matthew's in Haslington.237 The service was conducted by the vicar of Haslington, Edward R Parr.

His father was Randle Turner, a bricklayer like his son, and his mother was Hannah. They lived in Balterley at his baptism in 1807.44,238,239 At Edward's marriage to Martha Cooper in September 1854, both give their residences as Madeley. Since both of then are known to live in Haslington before and after - in the previous May in Edward's case - it is clear that this is simply a temporary address of convenience. Why did they marry in Madeley? It is highly likely that the marriage was controversial - Edward's first wife, the former Jane Caterham, had died on 1 May 1854, shortly after giving birth to their daughter Hannah at the age of 42. Faced with a baby to look after, it is perhaps no wonder that Edward, then aged 46, looked for a new wife - but no doubt many thought that marrying the nearly 60y old Martha Cooper just four month's after Jane's death was pushing it. Hence their marriage away from Haslington - though they would return there. But there is a distinct possibility that there was another element of controversy. Edward's mother-in-law, Jane Caterham, had died in 1851 and left all her estate to her daughter Jane, Edward's first wife, in recognition "her kind attention, loss of time and trouble she has had with me during my illness". I have no precise value of this estate but it was not trivial - the upper limit given on the probate form was £200 and the figure of £200 corresponds in 2010 to either £16,900 (the worth of the money in terms of its purchasing power) or £212,000 (from the "economic status" or "prestige value" of the cash). Even if the actual amount were lower, it can be seen that a reasonable sum of money had come to Jane at the beginning of 1852 and just over two years later, whatever was left was going to Edward, to be shared with his new wife. Jane could have three sisters living at this time, Elizabeth Caterham(?), Mary Bosson and Hannah Billington, though these names have not been thoroughly checked, and it might be that any of these or, indeed any other Caterham relatives, were going to find this new marriage disagreeable.

18. Mary SPODE,51 daughter of Thomas SPODE and Mary LATHAM, was born before 1 January 1797.240 She was baptised on 1 January 1797 (Sunday) at St. Mary's in Sandbach.51 She was one of four children baptised that day. Mary was living in Sandbach from January 1797.51 She was living here with her parents.

Genealogical notes - Spode of Sandbach - Mary (various). My only two relatives (so far) named Mary Spode are - Mary Spode nee Latham (m Thomas Spode July 1789, no other vital dates known yet but her last child is born April 1804); - Their daughter, Mary Spode (bap 1 Jan 1797, Sandbach, no other vital events known). Mary Latham must be born before 1775 (one born 1775 would be 14 at her marriage) and after 1759 (one born 1759 would be 45 at her youngest's birth). Her husband was baptised 1770. What are their fates? Nobody matching the younger Mary survives in the 1841 or 1851 censuses. The only Mary Spode marriage in 1837-1851 on FreeBMD is a "Mary Crewe Spode" married Stoke on Trent 1845. With that middle name, I discard her. No Mary Spode in the 1841 or 1851 is old enough to be the elder. Conclusion - both had died or (re-)married before 1837. Mary Latham met her fate after April 1804. The younger after Jan 1797. What are the FMP marriages in Cheshire of Mary Spode (Spo*d*) prior to 1837? Post-1837 adds nothing other than someone born 1840.

Post 1796 we have only: - Mary Spode, 1815, Middlewich, m Thomas Cardon - no sign of either in censuses; The Thomas Cardon marriage might fit either - but nothing survives later to suggest anything about who she was or how old. What are the FMP burials in Cheshire of Mary Spode (Spo*d*) prior to 1837 and 1796 on? - Mary Spode, 1785 , Warmingham - clearly not our two; - Mary Spode, 21 Feb 1799, Sandbach, BT, but is ELIZABETH Spode in the PR. Mary is the preceding entry in the PR - discard this as an error in the BT; - Mary Spode, 9 Sep 1805, Sandbach - 36y, i.e. b abt 1769; - Mary Spode, 13 May 1810, Barthomley, b abt 1753. Described as "of Haslington", so possibly the wife of Samuel Spode, joiner of Haslington, m1808. We suggest this is the same burial from 24 Feb 1810 at Alsager, who is also "of Haslington"; - Mary Spode, 1813, Warmingham, b abt 1810, so discarded; - Mary Spode, 1828, Astbury, infant dau Eliza of Congleton, so discarded; - Mary Spode 12 Nov 1832, Astbury, res. Congleton, b abt 1804 unlikely - 7y out from young Mary. - Mary Spode, 3 June 1839, widow, 68y (i.e. b abt 1770) described as late of Sandbach, living in Congleton. She is also documented in the Astbury registers. I have her DC - she is described as the widow of William Spode, silk man. So far as I can see, she is not one of ours - I cannot, incidentally, find the marriage. Reject; - Mary Spode, 26 Apr 1848, 50y (i.e. b abt 1798), Audlem, r. Hankelow. Not seen in census; - Mary Spode, 28 May 1849, 82y (i.e. b abt 1767), Audlem, r. Hankelow. Not seen in census; - Mary Spode, 20 Jan 1850, Warmingham, 61 (i.e. b abt 1789). Discard all with implied births 1807 onwards. The only likely FMP burials are - Mary Spode, 9 Sep 1805, Sandbach - 36y, i.e. b abt 1769 - she therefore cannot be the Mary bap 1797, but could be Mary Latham; - Mary Spode, 26 Apr 1848, 50y (i.e. b abt 1798), Audlem, r. Hankelow. Not seen in census; - Mary Spode, 28 May 1849, 82y (i.e. b abt 1767), Audlem, r. Hankelow. Not seen in census; - Mary Spode, 20 Jan 1850, Warmingham, 61 (i.e. b abt 1789). There are no other Mary Spo*d* baptisms in Sandbach other than the Mary above until 1827. Conclusion - it is PROBABLE that Mary Latham is buried in Sandbach 9 Sep 1805, aged 36 - that is the only option in Sandbach for her, unless the 1805 burial applies to the younger Mary. The younger Mary's fate cannot be identified - she might marry in Middlewich in 1815.

19. Esther SPODE,241 daughter of Thomas SPODE and Mary LATHAM, was born on 6 November 1798 (Tuesday).242 She was baptised on 8 June 1806 (Sunday) at St. Mary's in Sandbach.241 Esther, William and Samuel were all baptised together. Esther was living in Sandbach in June 1806.241 She was illiterate in February 1817.243 She was living in Wistaston parish, Cheshire, England to February 1817.243 This was immediately before her wedding. Esther married Peter DUNNING on 6 February 1817 (Thursday) at St. Mary the Virgin in Wistaston, Cheshire, England.243 The couple were married after banns, with the "consent of parents", by William Morgan, the rector of the small parish. Neither had been married before and their witnesses were Sarah Clarke and William Emberton. The register uses the form "Hester" for her name, though since she cannot write, it is moot how relevant this is to her.

Peter DUNNING243 was illiterate in February 1817.243 He was living in Wistaston parish to February 1817.243 This was immediately before his wedding. In February 1817 Peter was a labourer in Wistaston parish.243

20. William SPODE,241 son of Thomas SPODE and Mary LATHAM, was born in September 1802 (Wednesday).244 The exact date is not clear - it could read "Sep'r 7 1802" but this is in reverse of the normal order here, which has the day number first. It could be that the supposed "7" is actually the word "of". The Bishop's Transcript does not give the birth details at all. William was baptised on 8 June 1806 (Sunday) at St. Mary's in Sandbach.241 He was living in Sandbach in June 1806.241

21. Samuel SPODE,241 son of Thomas SPODE and Mary LATHAM, was born on 10 April 1804 (Tuesday).241 He was baptised on 8 June 1806 (Sunday) at St. Mary's in Sandbach.241

A Samuel Spode, widower, shoemaker, marries Martha Dean at Barthomley in 1825, lives in Nantwich, and moves to Chester - good confirmation of this comes from son Edwin who is baptised in Nantwich, buried in Chester at age of 7 months - everything fits. He seems to die in Chester in 1858, but with an age suggesting birth in 1800 - though the 1851 census gives a birth in Sandbach in about 1802. He may have previously married Ann Astles at Barthomley in June 1823 - someone named Ann Spode (of Haslington) dies in October 1824. Do these events belong to this Samuel (born 1804)? There are, however, others named Samuel Spode - the son of William Spode, baptised in 1783, and also a son of Samuel Spode, baptised 1794. Samuel senior may well be the son (bapt. 1768) of Thomas and Martha Spode of Sandbach - indeed, the only other baptised candidate for him is born 1733 in Warmingham. So the Chester Samuel is probably this one as he is 6 or 8y away from the 1794 baptism.

St. Mary's in Sandbach.246 Thomas was just over 1 year old when he was baptised. Thomas was living in Sandbach from December 1812.246 He was living here with his parents. Of course, he was probably here from birth.

24. Martha YARWOOD,79 daughter of William YARWOOD and Martha SPODE, was born before 18 September 1814.248 She was baptised on 18 September 1814 (Sunday) at St.

Mary's in Sandbach.79 The ceremony was carried out by R. Litler - note this is the spelling in the register. Martha was living in Sandbach from 18 September 1814 to November 1814.79,249 She was living here with her parents. Martha died on 24 November 1814 (estimated) (Thursday).250 Date of death estimated by subtracting an arbitrary 3d from date of burial. Martha was buried on 27 November 1814 (Sunday) at St. Mary's in Sandbach.249 Just 9 weeks after her baptism, and 12 days after her mother's burial, the same minister, R. Litler, carried out little Martha's burial.
