Record of Decision of the CABINET MEMBER FOR ENVIRONMENT

CASHLESS CAR PARKING - EVALUATION OF TRIAL SCHEME AND NEXT STEPS

Decision:

1. Following the success of the cashless parking trial a tender exercise for a permanent contractor to provide the cashless car parking service is undertaken in accordance with the Council’s Contract Procedure Rules, and

2. The trial with the current contractor is extended by six months whilst a permanent contractor can be appointed.

Reasons for Decision:

Cashless car parking provides a potential additional revenue stream for the Council at nil cost to the Council and an added convenience to visitors to the area.

Alternatives Considered and Rejected:

1) To withdraw the provision of cashless car parking

2) To extend the trial for a further six months to monitor performance further.

3) Refer the matter to full Cabinet for further discussion

It is recommended that these options are rejected as we are already providing the service without detriment to existing revenue streams and as more payments are now cashless, we will have a service which is suitable for the future. If we were to extend the trial, we will be in the same position as we are now. This is also not a contentious issue and not suitable for discussion at full cabinet.

The following is copied directly from The Planning Inspectorate’s decision notice. 3. The appeal site lies along a relatively busy main road in a predominantly

residential area. The dwelling on the appeal site is a mid-terraced property and is set back from the main road behind an area of public open space comprising of mainly grass with a few trees. A footpath runs to the front of the terrace within which the appeal site is located, between the mainly open plan front gardens of the properties and the green space. A pavement also adjoins the other side of the green, along the main road, demarcated by low timber bollards, with a bus stop / lay-by and adjoining pedestrian refuge / crossing.

Effect on character and appearance 4. The proposal involves the creation of a vehicle crossing from the main road

across the open space to the front garden of the dwelling on the appeal site. Although the crossing would be constructed using a reinforced plastic grid filled with earth and grass seed, so providing a porous surface and to retain a ‘green’ appearance within the wider open space, its use and physical appearance would, in my view, nevertheless be likely to result in a visual and functional change to the area of public open space.

5. The regular use of the access by vehicles, even of a fairly low frequency, would

to my mind spoil the use and appearance of this pleasant open space by effectively dividing it into two and introducing passing vehicles within it. This use, and the proposed timber posts to demarcate the crossover boundary, would detract from the quiet enjoyment and visual appearance of the area.

6. The proposed hardstanding of the front garden area would also result in a

visual change, through the introduction of parked vehicles. There are no existing vehicular accesses crossing the open space to the properties within the wider terrace. This and the separation afforded by the open space provides a pleasant and attractive area to the front of the terrace, the enjoyment of which is not currently compromised by the comings and goings of vehicular traffic or the presence parked cars. Therefore, whilst the creation of a ‘green’ hardsurface within the front garden would not of itself detract from this pleasant environment, the parking of cars within the front garden would.

7. I therefore find that the proposal would have a harmful effect on the character

and appearance of the area, contrary to Policy BE12 of the Basildon District Local Plan (2007) (LP) which seeks to ensure that residential development does not cause harm to the streetscene or wider area. These policies are generally consistent with the National Planning Policy Framework (the Framework) and therefore in accordance with paragraph 215, significant weight can be afforded to them. I also find conflict with the wider policies of the Framework which seek development that functions well and adds to the overall quality of an area.

Effect on highway safety 8. The entrance to the proposed vehicle driveway would be sited at one end of the

bus layby and in close proximity to an uncontrolled pedestrian refuge crossing along the main road. Although the appellant has indicated that there would be room for vehicles to turn within what appeared to be limited space at the front of the dwelling, so that they could exit the site in forward gear, the close proximity of the crossing, bus layby and bus stop, and consequent movement of pedestrians and vehicles, would in my view create the potential for conflict.

9. I note that the local highway authority has objected on the above basis and that

the creation of an access onto what is a secondary distributor road would compromise the safe and efficient use of that road. I agree with these concerns and therefore find that the proposal would conflict with LP Policy BE12 which seeks to avoid the creation of traffic danger.

Other Matters 10. The proposal would involve the removal of a double stemmed tree within the

open space but it is of limited value, as confirmed by the Council’s tree officer and provided it is suitably replaced, no objection is raised. The appellant has indicated that parking within the immediate area is very limited and he is often unable to find a parking space within nearby roads. I saw on my site visit that there were few available spaces and the main road is subject to parking restrictions. I also saw that a number of properties within the immediate area do have parking in their front gardens, but, unlike the appeal site, the majority of these have frontages directly onto the main road. I have also noted the example provided by the appellant which shows an access in close proximity to a pedestrian crossing. However, whilst noting the current parking difficulties, these factors are not sufficient to outweigh the overall harm identified.

LAND AT: 29 Farne Drive, Wickford PROPOSED DEVELOPMENT: Erect new 2 metre high fence to side close to

edge of private drive APPLICATION REFERENCE: 12/00492/FULL PINS NO.: D/12/2185136 APPELLANT'S NAME: Mr and Mrs Wood An appeal has been made to the Secretary of State in respect of the above site. The appeal follows the refusal of planning permission by the Council, for the following reasons: Government National Planning Policy Framework (NPPF) Para. 56 emphasises that good design is a key element in achieving sustainable development in the built environment and that good design is indivisible from good planning. Para 58 stresses that planning decisions should acknowledge the importance of streetscapes to create attractive and comfortable places to live, respond to local character, reflect the identity of local surroundings, materials and that developments are visually attractive as a result of the inclusion of appropriate landscaping. Para 60 includes the provision that it is proper to seek to promote or reinforce local distinctiveness. Para 61 addresses the need to accept the connections between people and places and the integration of development into the built environment. Para 64 evinces that permission should be refused for development that fails to take the opportunities available for improving the character and quality of an area and the way it functions. In addition saved policy BAS BE12 of the Basildon District Local Plan states that planning permission for new residential development, and for the alteration and extension of existing dwellings, will be refused if it causes material harm in any of the following (amongst others) ways: (i) Harm to the character of the surrounding area, including the street scene. The proposed development would result in the erection of a 2 metre fence, enclosure and domestication of an area of open space which is important to the character of Farne Drive The parcel of land to be enclosed makes a positive contribution to the appearance of Farne Drive and adjoining pedestrian access ways and abuts an important link to adjoining footways which are edged with wide grassed strips. It is integral to the general character of the area which has a pleasant cultivated, well landscaped appearance and low means of enclosure to frontages.

The proposed development would result in the enclosure and domestication of an area of open green space which forms an integral part of the character of Farne Drive and would therefore be seriously detrimental to the appearance and visual amenity of the locality detracting from the setting of the existing and adjoining dwellings and street scene causing harm to the character of the area.
