Art. 1 Definitions a. TKD (Technische Kontaktdagen - Technical Contact Days): The Technische Kontaktdagen organised by the foundation to be held on 31 May

and 1 June and 2 June 2018 at Almere. Hereafter referred to as: TKD. b. Outdoor stand: Outdoor area where the exhibitor can display their product in the tent (4 x 4 m) provided for that

purpose. Machinery is not permitted in the tent. c. Demonstration track: Dedicated sand track for demonstrating trucks, self-propelled and trailed dumpers, etc. Use of the demonstration track leads to a surcharge on the lot price (see art. 6a subsection 1). d. Demonstrating: Displaying an operating product. e. Exhibitor: Business and/or person who has registered for the TKD in accordance with the terms and

conditions and has received a confirmation of this and who therefore uses the opportunity to present and/or demonstrate their product(s) on the TKD site.

f. Lot: Outdoor area, on sand, where the exhibitor can present and/or demonstrate their product. g. Lot contact person The lot contact person is the person the TKD organisation can contact for the regular safety

checks undertaken by the TKD organisers, and in case of an emergency at the lot, and for other questions and/or matters to be discussed.

h. Product: The item(s) including components which the exhibitor intends to present and/or demonstrate,

whether or not under a generic and/or brand name. i. Terms and conditions: The provisions defined by the TKD with respect to the TKD. j. TKD site: Site arranged for the TKD event where exhibitors can present, demonstrate and/or promote

their product. l. UC (Uitvoeringscommissie - Executive committee): The committee charged by Stichting TKD with organising and supervising the TKD (see art. 2).

m. Safety officer Recognisable person who, on behalf of the exhibitor, guides visitors when operating machinery

at the part of the lot dedicated to this.

Art. 2 Uitvoeringscommissie (UC - Executive committee) a. The UC is responsible for organising the TKD. b. The members of the UC are authorised to check compliance with these terms and conditions,

safety regulations and other regulations, and to take any action required to ensure compliance with them.

c. The members of are authorised to grant exemptions in specific cases. d. The members of the UC are authorised, at all times, to intervene and give instructions in the

event of emergencies and/or circumstances which require this. Exhibitors are required to follow these instructions. Art. 3 Registration a. Registration for the TKD is conditional on: - the Secretariat receiving a fully completed and signed registration form and

- the registration form including a list of the product(s) which the exhibitor is planning to exhibit, and

- the exhibitor with a lot being the manufacturer or importer for the Netherlands of the product *1

, or - the exhibitor with a stand being the manufacturer or importer for the Netherlands of the

product, or supplier of the service, or - the exhibitor with a lot or stand is the provider of a rental/leasing service, and

- the UC has confirmed the registration, possibly attaching conditions. b. The UC may refuse registrations without stating the reasons for this. c. A registration confirmed by the UC cannot be cancelled or refused without permission of the

UC. If the exhibitor cancels a confirmed registration the following cancellation terms shall apply:

- for cancellations before 15 January 2018 the cancellation fee shall be 25% of the exhibition fee;

- for cancellations on or after 15 January but before 15 March 2018 the cancellation fee shall be

50% of the exhibition fee; - for cancellations on or after 15 March - 1 May 2018 the cancellation fee shall be 75% of the

exhibition fee; - for cancellations after 1 May 2018 the full exhibition fee shall be due. *1)

A holding may be importer for several brands. In that case the clustering principles can be applied. See article 8 for details. Art. 4 Participation a. Participation in the TKD is only possible if all conditions of article 3a have been fulfilled and the

full exhibition fee has been paid into the TKD bank account. b. Places shall be awarded by the UC. The allocated places shall be binding. c. After consulting the exhibitor the UC may change an allocated place, without stating the reasons

for this. d. Any place indications and/or site plans provided shall not give rise to specific entitlements to

them. Art. 5 Product(s) a. Demonstrated products shall at all times comply with statutory safety requirements, both when

static and when moving/operating and exhibitors shall not give third parties access to the products without supervision and without a competent person being present.

b. Products to be demonstrated shall be listed on the registration form and be confirmed by the TKD. Exhibitors shall exhibit the specific property/properties of their operating

*2 product(s).

A product which is not listed on the registration form shall not be exhibited unless it is a product supporting a registered product (auxiliary equipment/materials). In that case the product shall either be supplied by the relevant exhibitor, or supplied by another TKD exhibitor.

If an exhibitor which is a rental and/or leasing company participates in the TKD then it may only exhibit products whose manufacturer and/or importer also participate(s) in the TKD as an exhibitor. Furthermore, an exhibitor which is a rental and/or leasing company may place only one product of an exhibitor on its lot.

c. It may be decided by or on behalf of the UC that a product or auxiliary product which is not listed on the registration form but is exhibited on a lot shall be excluded from participation.

Such an exclusion and possible removal shall not lead to a claim for damages against the Stichting.

d. There is no restriction on the number of products exhibited on a lot, as long as: - there is no threat to safety, and - all the equipment is neatly arranged on the lot and can be demonstrated, and - digging is restricted to a depth of at most 1.0 m, and - the conditions of article 7 are observed, and - they are as new. e. If required for safe demonstrations, a suitable surface shall be provided by or on behalf of the

exhibitor. *2)

The TKD is a demonstration event. Where possible, products shall be shown while operating.

Art. 6 Exhibition fees a. 1. The exhibition fees (excluding BTW/VAT) are as follows: Outdoor stand*

100 m² € 3,750 200 m² € 4,750 400 m² € 6,000 800 m² € 7,500 1200 m² € 9,000 1600 m² € 12,750 Demonstration track € 1,500 surcharge on the lot fee.

BMWT members are eligible for a 25% discount on these fees, if their membership is confirmed by the BMWT at the time of registration.

2. Lots are unpaved, level and largely sandy. - The only facilities provided at a lot are a tent (5 x 5 m or 4 x 4 m) with a banner frame and an electrical power connection. There are no other facilities such as a water or gas supply. - The tent will be positioned such that it does not inconvenience other exhibitors. - The positioning of other tents, trucks, etc. is subject to the conditions of Appendix A.

*3) 4 x 4 m tent only. Cannot be combined with use of the demonstration track.

An outdoor stand includes a banner frame and electrical power connection. b. The fees listed under a. shall be paid within the period stated on the invoice. c. If payment is not made in accordance with article 6b then the UC may cancel the participation.

Any part payments made will not be refunded. d. Early bird discount: if your registration and validly signed contract are received before 1

January 2018 you will receive an early bird discount of 10% of the exhibition fee. This discount will be in addition to the BMWT discount, where applicable.

Art. 7 Safety a. At each lot there shall be a lot contact person to supervise compliance with the

Arbeidsomstandighedenwet (Dutch safety at work legislation) and the requirements of these terms and conditions. The exhibitor shall ensure that the signed safety document (18-011, see Appendix B) is returned to the organisation by 23 May 2018 and that the lot contact person is present and identifiable (TKD badge) at the lot. If these requirements are not fulfilled then article 13.1b shall be applicable.

b. The part of the lot where live demonstrations are given shall be closed off to visitors using portable fences, barriers, balusters or similar. There shall be an identifiable safety officer for each machine.

c. Excavators shall only dig without travelling, there shall be no other machinery, vehicles or activities within the excavator slewing circle. The maximum excavation depth is 1.0 metres.

d. Wheeled loaders may give demonstrations on a track, with the front facing the path. There shall be no other machinery, vehicles or activities on this track.

The track of a wheeled loader shall not overlap the slewing circle of any excavator used for demonstration.

e. Cranes and foundation rigs shall not travel when used for demonstrations. TCVT installation inspection certificates shall be available. No significant loads shall be pulled when giving demonstrations with a foundation rig.

f. Demonstrations with driving vehicles are only permitted on the demonstration track where there shall be an adequate distance between machinery/vehicles giving demonstrations and the speed shall not exceed 25 km/h. The following conditions shall also apply: - instructions given by or on behalf of the traffic marshal appointed by the TKD shall be

followed; and - there shall be a representative of the exhibitor in every product being demonstrated, and - each exhibitor shall demonstrate at most 4 products on demonstration track at any time. g. Machinery/vehicles may not be left unsupervised without the doors locked or the key in the

ignition. h. Normally demonstrations shall be given by a demonstrator appointed and instructed by the

exhibitor. Visitors may only operate machinery fitted with rollers or tracks after they have been instructed, and under direct supervision of the exhibitor's safety officer (one operating machine per safety officer).

i. Persons under the age of 16 shall never be allowed onto machinery. j. Mobile elevating work platforms and tool carriers fitted with a personnel basket may only be

demonstrated with 2 visitors in the basket and after submitting the installation inspection certificate. Mobile elevating work platforms shall not be used as attractions.

k. Only machinery, accessories and lifting accessories with the CE mark shall be exhibited at the TKD when operating. If this requirement is not fulfilled then they may only be exhibited while static.

l. The demonstrator of a machine shall hold any certificates which are legally required. m. Machinery may only be refuelled when stationary and with the engine switched off (see article

13.1h). n. Enforcement shall be on behalf of the Stichting TKD, by members of the UC TKD, the safety

committee and other persons appointed by the UC.

Art. 7A Personnel safety The exhibitor guarantees that legal duties such as those concerning workplace conditions and working times will be fulfilled. Any violation of such a duty will lead to liability of the exhibitor, and the TKD shall specifically be indemnified against any liability relating to this. The TKD and/or the TKD organisation will not undertake any work and no work shall be undertaken under the authority of and/or at the instructions of the TKD. The TKD organisation's safety policy is limited to common safety aspects such as parking, access, security, etc. Art. 7B Visitor safety The exhibitor shall guarantee the safety of visitors on the lot or stand made available to them and/or the machinery being demonstrated elsewhere on the TKD site under their authority. At all time the exhibitor shall inform visitors about viewing and/or accessing the product and will ensure the safety of those visitors.

Article 8 Registration by concerns and/or holdings a. An exhibitor is a company which presents itself as such on the market (independent unit). b. 1) A holding may be importer for several brands.

In that case registration shall be for each imported brand and these terms and conditions shall apply in full.

c. When a holding company submits registrations for several imported brands these can be placed on a single lot as long as this has a minimum size of 1200 m

2.

d. If there is no importer in the Netherlands for a product, then the representatives of this product

in the Netherlands can jointly rent a lot.

Art. 9 Build-up a. 1. Delivery:

- of large equipment, own tents, equipment to be lifted by crane: 25 - 28 May (in consultation with. the TKD)

- of equipment to the outdoor site: 28 - 30 May: 07.00 - 21.00 h. 2. Build-up/fitting out of outdoor stands: 29 and 30 May: 07.00 – 21.00 h

After these build-up periods the only options for deliveries are: Thursday 26 May: BEFORE 8.00 h and AFTER 21.00 h Friday 27 May: BEFORE 8.00 h and AFTER 18.00 h Saturday 28 May: BEFORE 7.00 h Deliveries may only be made with permission of the TKD organisation.

b. If at 8.00 h on the first day of the TKD an exhibitor is not using their lot or stand in accordance with the provisions of these terms and conditions then the UC shall be entitled to use the lot or stand while the exhibitor who the lot or stand was assigned to shall be required to meet their financial commitments in full.

c. If during the build-up an exhibitor does not comply with applicable conditions relating to safety and maintenance and/or does not comply with instructions given by the UC, safety committee, fire brigade or other public or private bodies, then the UC shall be entitled to make the provisions deemed necessary at the cost of the exhibitor or to refuse the exhibitor admission.

Art. 10 Break-down a. The break-down of the lot or stand shall start at 17.00 (not earlier!!!) on the last TKD day. During the break-down exhibitors and/or their transport companies/suppliers shall comply with

the safety instructions and instructions given by the UC, safety committee or other public or private bodies.

The use of mobile cranes for the break-down is NOT permitted on Saturday 2 June 2018. b. The lot shall be handed over by the exhibitor in the state in which they accepted it, at the latest

on Wednesday 6 June 2018, 16.00. c. Outdoor stands and tents on the lots shall be handed over by the exhibitor in the state in which

they accepted them, at the latest on Monday 4 June 2018, 12.00. c. Environmentally-harmful materials shall be disposed of by the exhibitor, at their cost, and within

the period stated in clause b, in accordance with applicable environmental legislation. d. It is strictly prohibited to bury waste and/or to leave it on the TKD site. e. After the period stated in clause b. any remaining products, waste, rubble environmentally-

harmful materials, etc. will be removed by or on behalf of the UC, at the cost of the exhibitor. Art. 11 Facilities during the TKD a. During the TKD there will be a catering space available to exhibitors and visitors. b. There will be catering facilities on the TKD site. c. During the TKD the organisers can be reached on: 06 – 16 32 18 28. d. There will be first-aid facilities on the demonstration site from 28 May - 5 June. e. There will be free parking outside the demonstration site. f. There will be 24/7 security on the TKD site, from 25 May, 17.00 h to 6 June, 08.00 h. Art. 12 Visitors a. The TKD will be open to visitors

Thursday 10.00 – 21.00 h Friday 10.00 – 18.00 h Saturday 08.00 – 16.00 h. b Entry is free after registration in advance at www.tkd.nl.

c. The UC is authorised to change the arrangements relating to the TKD. In such cases neither the exhibitors nor the visitors shall be able to claim compensation for loss,

whatever its nature, from the Stichting. *4)

Children under 16 will only be admitted when accompanied by an adult. Dogs are not permitted. Art. 13 Prohibitions Clause 1: Exhibitors shall not do any of the following, which can result in immediate exclusion and the

imposition of a penalty of at most € 10,000. a. Renting the lot or stand allocated to them out to third parties, in part or in full, transferring it to

another exhibitor or making it available in any other way to any person or company such that the impression arises that others, in addition to the exhibitor, are presenting products.

b. Exhibiting at a lot at the fair without first signing the safety document. c. Advertising their business or products by actively handing out brochures, circulars, price lists

and/or other forms of advertising (gadgets). Merchandising by lot exhibitors is only permitted if they hire an outdoor stand.

Presenting misleading or nuisance name, brand and other indications aimed at exhibitors and visitors.

d. Admitting persons under 16 years onto machinery and/or allow them to operate products.

e. Placing too much equipment on the lot, leading to a safety hazard (see article 5d). f. Demonstrating material without providing a barrier around the lot (see also article 7). g. Digging or pushing deeper than 1.0 metres, or undertaking any other activity deeper than 1.0

metres below the surface. h. Keeping hazardous substances on the lot and/or to burn open fires. i. Refuelling products, other than by a permitted method.

Refuelling on the TKD site is only permitted if: - this is done on the lot allocated to the exhibitor and/or at the end of the demonstration track at the indicated location, and

- within 10 m of the road, and - using an appropriate absorbing blanked and/or drip tray, and - by a supplier appointed by the UC and with a record of the amount of fuel, the lot number and the time.

Article 14c shall apply in the event of a fuel spillage. j. Placing or demonstrating products and/or goods on the lot which can lead to nuisance, danger

or damage in any way. k. Placing products or goods outside their own lot or stand. l. Behaving as an individual and/or using the lot or stand such that the good reputation of the TKD

is harmed and/or the norms and care associated with normal behaviour in society are infringed. Clause 2: Additionally, without the express permission of the UC, and subject to a penalty of at most €

10,000, exhibitors are not permitted to: a. Exhibit and/or demonstrate used goods. b. Exhibit products passively on the TKD site, all products shall be shown operating, where

possible, bearing in mind safety as addressed by article 5d. c. Demonstrate or have on the lot more than one product: 1) bearing the same name and/or colour design and/or logo, or a combination of these characteristics of businesses or concerns; 2) and/or which carries clear markings from which it may be concluded that the exhibited product belongs to the same organisation; other than marks relating to the exhibitor themselves. If an exhibitor which is a rental and/or leasing company participates in the TKD then they are not

permitted to exhibit their products on other lots. d. Remove products during the TKD. e. Park products on or around the demonstration track at times they are not being demonstrated.

f. Demonstrate products without direct, active involvement of an employee of the exhibitor. g. Hand out food or drink to visitors on the lot or stand.

In all cases: ALCOHOL IS NOT PERMITTED. h. Play music or use sound-reinforcement equipment. i. Hold a lottery during the TKD unless the UC has granted permission for this in advance. j. Perform stunts with equipment. This is strictly prohibited at all times. k. Place an advertising sign or banner which blocks the view through the lot. Dealer names may

be indicated, and the placement of signs/banners marked with a name/log used as baluster (max. height 1.20 m) is permitted.

l. Park one or more cars on the allocated lot or demonstration track. m. Drive across tent floor panels during the build-up and break-down of the TKD. n. Build scaffolds. o. Park products on or in the vicinity (in a radius of 3 km) of the TKD site which refer directly or

indirectly to participation in the TKD. Art. 14 Exclusion of liability a. The exhibitor shall bring the product to and from the lot or stand and look after it there at their

own cost and risk. b. The exhibitor shall be liable for all damage resulting from or relating to, or caused by the

products themselves, their use and/or as a consequence of an action or failure to act by the exhibitor themselves, their personnel and/or persons working at their instructions.

c. The exhibitor shall be liable for both direct and indirect consequential damage resulting from damage-causing events as referred to under clause b.

d. The exhibitor shall insure their products in relation to participation in the TKD. e. The exhibitor undertakes to take out insurance relating to any liability relating to themselves,

their personnel and persons working at their instructions. f. The TKD specifically exonerates itself and shall not be liable for the inability to fulfil the

obligations agreed with the exhibitor, including losses due to damage, contamination, theft and/or loss of goods, and damage due to ineffective operation of technical installations or defects of the lots or stands, except where this is caused intentionally.

g. The exhibitor shall indemnify the TKD against claims by third parties which entered the TKD in relation to the exhibitor and/or who were engaged by the exhibitor for their activities.

Art. 15 Default on payment a. In the event an invoice is not paid in full the TKD shall transfer it to a third party for collection

and shall recoup the resulting costs from the exhibitor. b. Exhibitors, their personnel and persons working at their instructions who fail to act in

accordance with the instructions given by the UC and/or act in contravention of the provisions of the terms and conditions shall be refused admittance and shall be instructed to leave the lot or stand.

Art. 16 Loss or damage In the event of loss or damage of items provided by or on behalf of the UC compensation equal to the loss suffered shall be owed, with a minimum of € 500. This amount shall be payable immediately, without recourse to the courts. The exhibitor agrees to this by signing the TKD registration form. Art. 17 Cancellation of the TKD If the TKD cannot be held the registrations confirmed further to article 3 shall be cancelled and similarly any right to the allocation of a lot or stand. In this case the registrants will be entitled to return of their payment, minus any costs incurred by that date. Refunds will be made within 90 days (and sooner where possible) after the announcement of the decision that the TKD will not be held.

Art. 18 Bond a. To ensure compliance with these terms and conditions each exhibitor with lot is required to

pay a bond of € 2,500. The bond for lots of 100 and 200 m² is € 500.

b. After the TKD the bond will be refunded to the exhibitor within 30 days, unless any of the articles of these terms and conditions were infringed. In that case the bond will be applied towards payment of the damage or penalty, which the exhibitor will be informed of in writing forthwith.

Any disputes between the TKD and the exhibitor shall be subject to Netherlands law and come under the jurisdiction of the court at Utrecht.

Appendix TENT ON A LOT (further to article 6 of the TKD terms and conditions)

Non-standard tent on a lot 1. Each exhibitor with a lot will be offered a 5 x 5 m tent by the TKD (exhibitors with 100 m

2 lots will

get a 4 x 4 m tent). The tent will be positioned such that it does not inconvenience other exhibitors.

2. A lot will include a tent (4 x 4 m or 5 x 5 m) and banner frame and an electricity supply but will

not include any facilities such as gas and water supplies. 3. Additional tents (4 x 4 m or 5 x 5 m) may be rented through the TKD for a fee.

4. Other tents may be placed at the cost and risk of the exhibitor who shall arrange the tent, if:

- the tent covers at most 25% of the area of the lot, and - the tent is placed on the rear half of the lot and at least 25% of the width of the tent away from the side boundary of the lot, and - it does not have any levels above ground level, and - it is built-up before 27 May 2018 and broken down after 4 June 2018.

5. It is permitted to place a exhibition truck on a lot subject to approval in advance by the UC of its

position on the lot. 6. It is permitted to place one or more portable accommodation units such as Portakabins on a lot

if: - the cabin covers at most 25% of the area of the lot, and - the cabin is placed on the rear half of the lot and at least 25% of the width of the cabin away from the side boundary of the lot, and - it does not have any levels above ground level, and - it is built-up before 27 May 2018 and broken down after 4 June 2018.

Appendix B SAFETY AT THE TKD 2018 (further to article 7 of the TKD terms and

conditions)

At the TKD machinery is exhibited and demonstrated by exhibitors and/or visitors under direct supervision of the exhibitor's safety officer. The safety of all is essential. Common sense and compliance with the TKD terms and conditions should ensure safety at the TKD, but this relies on the commitment of exhibitors. We can only have a safe event by cooperating. Articles 7, 7a and 7b of the 2016 TKD terms and conditions set out the primary requirements for safety at the TKD, for exhibitors and visitors. Further to article 7a and article 13.1b this memorandum forms an integral part of the TKD terms and conditions. Exhibitors themselves are fully responsible for compliance with the requirements of the Arbeidsomstandighedenwet (Dutch safety at work legislation) with respect to their own and subcontracted personnel and the use of work equipment (machinery) on and around the TKD site. This also applies with respect to the safety of visitors when exhibiting and demonstrating machinery on the lot or stand provided and/or machinery demonstrated elsewhere on the TKD site (demonstration track) under the responsibility of the exhibitor. The exhibitor shall indemnify the TKD against all claims by the exhibitor, their personnel and/or persons working at their instructions, and shall indemnify the TKD against claims by third parties invited by the exhibitor, or who view their products, and/or have any other factual or legal relationship with the exhibitor. Where necessary the exhibitor will inform TKD visitors and/or take technical and/or organisational measures to ensure the safety of visitors. To strengthen the focus on safety during the TKD it was decided to arrange the following: * Information about visitor safety on the TKD site; * Information for exhibitors about the arrangement of the lot (see Handbook); * Each lot where machinery is demonstrated has 2 lot contact persons.

A lot contact person may also act as safety officer; * List of key points, to be signed by the lot contact persons; * Visitors may only operate machinery under the direct supervision of a safety officer at a lot. Safety meeting Exhibitors are responsible for safety at their lots. The TKD organisation can never take that responsibility over from them! The following arrangement aim to ensure the effectiveness of these matters:

The safety meeting is linked to the exhibitor meeting.

At least one of the lot contact persons of the exhibitor shall attend this meeting. During this

meeting the organisers will provide information about the safety regulations and it will be

possible to share practical tips about their implementation in practice. This includes the

arrangement of the lot and dealing with visitors.

During the build-up period (afternoon of 30 May) the organisers will inspect the lots and

release them.

The lot contact person of the exhibitor contacts the organisers and asks them to check the safety of the lot, together with them. If the inspection outcome is positive then machinery may be operated on the lot. However, this does not mean that the TKD organisation accepts responsibility for the safety of the lot.

During the TKD adherence to the safety regulations will regularly be checked by the

organisation or on its behalf. If there are any issues these will be discussed with the lot contact person to resolve them. In addition to the UC this also involves the "safety police".

Safety signs Exhibitors shall place safety signs with warnings at every lot where there is operating machinery. The TKD will have portable fences and red/white ribbon for use in emergencies. Visitor information Visitors will be informed of the TKD safety regulations by signs at the entrance, catering points, on entry tickets and on e-mails sent after registration. Build-up and break-down In addition to safety at the lots, the exhibitors and the TKD organisation also attach great importance to safety during the build-up and break-down. There is a particular risk of uncoordinated activities during the break-down, which could reduce safety. The period between the end of the event and the start of removing equipment is of particular concern. The flows of leaving visitors and equipment being removed have to be separated in time and space.

From 15.30 h visitors will be asked to go to the exit over the public address system.

From 16.00 h the UC will “sweep" visitors from the paths.

Vehicles may only leave the TKD from 17.00.

Key points for lot contact persons

o. At each lot where machinery is demonstrated there shall be at least one lot contact person at all

times who monitors compliance with the Arbeidsomstandighedenwet (Dutch safety at work

legislation) and the requirements further to these terms and conditions. The exhibitor shall

ensure that the signed safety document (18-011) is returned to the TKD organisation by 28 May

2018 and that the lot person(s) are continuously and visibly present on the space (TKD badge).

If these requirements are not fulfilled then article 13.1b of the TKD terms and conditions shall be

applicable.

p. The part of the lot where products are actively demonstrated shall be adequate closed off to

visitors using portable fences, balusters, or other provisions so that visitors can not

unexpectedly enter the operating area of machinery.

There shall be an identifiable safety officer for each machine.

q. Demonstrations shall be given by the demonstrator appointed and instructed by the exhibitor.

Visitors may only operate machinery fitted with rollers or tracks after they have been instructed

by, and under direct supervision of the exhibitor's safety officer (one operating machine per

safety officer).

r. Persons under the age of 16 shall never be allowed onto machinery, even when it is not

running. However, this requirement does not apply to trucks.

s. Every lot with running machinery shall have at least two lot contact persons, at least one of

whom needs to be present on the lot for demonstrations to be permitted. Their names shall be

communicated to the organisation. At least one of them shall have attended the TKD safety

meeting on 19 April 2018.

t. The demonstrator of a machine shall hold any certificates which are legally required, e.g. a T

driving licence, TCVT certificate or vocational diploma.

u. To ensure recognition the TKD high visibility waistcoats are in one colour. If there is no lot

contact person present then it is not permitted to give demonstrations.

Key points relating to machinery

v. Excavators shall only dig without travelling, there shall be no other machinery, vehicles or

activities within the excavator operating area.

The maximum excavation depth is 1.0 metres.

w. Wheeled loaders shall give demonstrations on a track with the front facing the main path.

There shall be no other machinery, vehicles or activities on this track. The track of a wheeled loader shall not cross the operating area of any excavator used for demonstrations.

x. Cranes and foundation rigs shall not travel when used for demonstrations. TCVT installation

inspection certificates shall be available. No significant loads shall be pulled when giving

demonstrations with a foundation rig.

y. Demonstrations with driving vehicles, other than wheeled loaders, are only permitted on the

demonstration track where there shall be an adequate distance between machinery/vehicles

giving demonstrations and the speed shall not exceed 25 km/h. The following conditions shall

also apply:

- instructions given by or on behalf of the traffic marshal appointed by the TKD shall be followed, and

- there shall be a representative of the exhibitor in every product being demonstrated, and - each exhibitor may demonstrate at most 4 products on demonstration track at any time.

z. Machinery/vehicles may not be left unsupervised without the doors locked, the electrical supply

switched on or the key in the ignition.

aa. Mobile elevating work platforms and tool carriers fitted with a personnel basket may only be

demonstrated with 2 visitors in the basket and after submitting the installation inspection

certificate. The basket weight shall never exceed the maximum permitted load of the unit.

Mobile elevating work platforms shall not be used as attractions.

bb. Only machinery, accessories and lifting accessories with the CE mark shall be operated during

the TKD. If this requirement is fulfilled then they may only be exhibited while static.

cc. Machinery may only be refuelled when stationary and with the engine switched off (see article

13.1h) of the TKD terms and conditions).

Enforcement shall be on behalf of the Stichting TKD, by members of the UC TKD, the safety committee and other persons appointed by the UC.
