WHEREAS disputes have arisen between Officers of Customs and the several persons whose names are set out in thefirst column of the Schedule hereto, with reference to contraventions of the Customs Act 1901 alleged to have been

committed by them ; and. whereas these persons have consented, in writing, to the disputes being inquired into and determinedby ine,; and I have inquired into and determined them accordingly. Now, therefore, the orders made by me in the determinationof the disputes, which orders are set out in the Schedule, are published as directed by Section 265 of the said Act.

with the provisions of Customs Regulation No.131 :-

Drawback may be allowed in terms of the CustomsRegulations on the undermentioned imported material, usedin the manufacture of articles within the Commonwealth,upon the exportation of such manufactured articles, andsubject to the conditions specified hereunder :-

Provided that in each case before drawback be allowed,the Collector shall be absolutely satisfied that the draw-back claimed is properly due, and if he thinks necessary,may require the manufacture to take place under thesupervision of an officer.

CONVEYANCE being required for the Post OfficeMails, either by Vehicle or on Horseback, to and

from the under - mentioned places, for one, two, or threeyears from the Ist January, 1908 (with the exception ofthose lines for which a special term is named), personswilling to contract for the same are invited to transmittenders in the approved form before noon on Monday,the 19th August next.

Every tender must state the names in full and the resi-dences or business addresses and the occupations of thetenderer, and of two respectable and responsible personswilling to join with the tenderer in a bond in a formapproved by the Postmaster - General, guaranteeing thesafety of the mails and the due performance of the con-tract, the penal sum in which bond will be double theannual payment under the contract.

Tenderers must send in a separate tender for each line,as numbered in this advertisement.

Contractors who have carried out a mail contract satis-factorily will, when again tendering for a service tjiatthey are performing at the date of tendering, if all otherconditions are equal, be allowed a preference over othertenderers to the extent of 5 per cent.

Tenderers must in each case state how they propose tocarry mails, and must furnish a description of the kind ofvehicle (where such mode of conveyance is .intendedwhich they propose to use; preference: will, however, begiven to tenders to convey mails by wheeled vehiclelicensed to carry passengers.

Every tender must be signed by the tenderer andsureties, and attested by a magistrate or postmaster.

The Postmaster - General does not bind himself to ac-cept the lowest or any tender.

Tenders must be addressed to the Deputy Post-master- General, Sydney, and indorsed " Tender for Con-veyance of Mails." They may be deposited in the Tender -box at the Appointment Branch, General Post Office,Sydney ; if sent by post they must be prepaid and regis-tered.

On every tender there must be indorsed a certificate bya magistrate that the tenderer and his sureties are respect-able and responsible persons.

All tenders which do not comply with the foregoingconditions, or are not rec ived before the_ time specified,will be liable to be rejected as informal.

Tenders must be accompanied, in cases where theannual amount thereof exceeds J5o, by a deposit equalto 5 per centum of the annual amount thereof up toZ:I,000, and 4 per centum on any further amount beyond£1,000, such deposit to be in the form of amoney order or postal note, a cheque, indorsedby the Manager of the Bank upon which it isdrawn, or a Bail: draft, made payable to the Receiver,General Post Office, Sydney. The amount deposited shallbe absolutely forfeited to the Government in case theperson whose tender, shall be accepted and his suretiesshall fail to complete the bond stipulated for withinthirty days from the date of notice of the acceptance ofhis tender, and such acceptance may be thereupon can-celled.

The sum deposited by the successful tenderer in eachcase will be returned after he shall have performed theservice for one calendar month to the satisfaction of thePostmaster - General.

Unless the Contractor and his sureties sign the bondwithin twenty -one days after a notice signed by or for theDeputy Postmaster General requesting them so to do shallhave been posted to the Contractor, the Postmaster -General may cancel the acceptance of the tender.

The present hours of starting from each post - office orstage, and other particulars, may be ascertained at theGeneral Post Office, Sydney, where parties proposing totender are invited to seek information.

l'rinted forms of tender may be obtained on applicationat the General and all other post - offices throughout theState of New South Wales, and persons tendering arerequested to fill up such forms with great care.

THE FOLLOWING ARE THE GENERAL CONDITIONS TO BEOBSERVED BY CONTRACTORS, AND REFERRED TO IN THE FORMOF TENDER :

I. The word " Mails" in the foregoing ContractDeed and in these conditions shall include mail-boxes, mail -bags, mail- parcels, parcel post mails,letters, packets, parcels, books, or printed papers, andnewspapers, empty bags and other stores, or articles usedor to be used in carrying on the Post Office Service ; and" Postal Article " includes letters, post- cards, letter- cards,newspapers, packets or parcels, and all other articles trans-missible by post and includes a telegram when trans-initted by post ; and the expression "Postmaster-General"in these conditions shall mean the Postmaster - General forthe time being of the Commonwealth of Australia, or theOfficer for the time being having charge of the Postmas-ter- General's Department by whatsoever name he shall becalled ; and he shall have the same powers as those vestedin. the Postmaster - General by these conditions, in the samemanner as if his name had been inserted throughout theseconditions in the place and stead of the words Postmaster-General; and the word " his " shall extend to and meanher or their, as the case may be ; and the word" sublet " shall include any arrangement made by thecontractor whereby the whole, or any part of the servicesundertaken by him under his contract shall be performedfor consideration by any person not being a servant of thecontractor, within the ordinary meaning of the term " ser-vant." A person providing horses or vehicles for carryingon the contract or receiving a fixed sum for the work tobe performed not a fixed rate of wages or salary duringthe time the work is to be performed, will be deemed asub - contractor, and not a servant.

2. The Contractor will be required to find and providegood, substantial, and sufficient carriages, horses with har-ness, saddles, bridles, and other necessary accoutrements;boats or other appliances, for- crossing mails over floodedrivers or creeks, and honest, careful, and steadydrivers and postmen of certified good conduct, and toemploy only white labour in the carriage of the mails.Contractors are not expected to work their drivers formore than 8 hours a day on the average. All horsestravelling in front of a mail conveyance must be properlyharnessed, and used for the purpose of drawing suchconveyance only. In every case where wheeled vehiclesare used, breeching must be provided for the wheel horseor horses, if the Postmaster - General shall so require.

3. Such regulations with regard to rates of wages andworking conditions as may from time to time be madeby the Governor - General, in pursuance of sub- section Scf section 97 of the Post and Telegraph Act 1901, mustbe observed by the Contractor ; and until such regulationsare made, the rates and conditions shall be those recognisedin the locality in which the work is carried out.

4. If at any time during the continuance of the contractit shall be possible to forward the mails by railway bydirect route or otherwise, and whether for the whole orpart of the distance contracted for, the Postmaster- Generalmay, by giving one calendar month's notice in writing tothe Contractor, either determine the contract or permitthe services contracted for to be carried out for the residueonly of the line contracted for, and in the latter casemay deduct from the moneys to be paid to the Contractorthe sum of /12 per mile Per annum, or such other sumas may be charged by or payable to the Railway Commis-sioners for the carriage of the mails over such portion ofthe railways as the same shall be carried over.

5. If it be determined, during the currency of a contractfor carrying mails to and from a railway station and post -office, to remove the post -office to the railway station, thecontract may be discontinued on of a month's notice beinggiven to the Contractor by the Postmaster- General. .

6. The Postmaster- General may, at any time during thecontinuance of the contract, re- arrange or increase or re-duce the frequency or change the routes of the services tobe performed thereunder ; and if the distance to betravelled or the frequency be increased or reduced, a pro-portionate increase or reduction, as the case may require,shall be made in the amounts to be paid under the con-tract, computed upon the basis of the mileage rate of thecontract. The Postmaster- General may, however, contractor agree with any person other than the Contractor for anyincrease in the frequency of such services ; and the Con -tractor shall have no right to demand that any such in-creased frequency shall be carried out by him.

7. In the event of any change being made in the servicecontracted for, either in the manner indicated in the pre-ceding clause or with the concurrence of the Contractor,the Postmaster - General may require a fresh bond to beexecuted by the Contractor and his original sureties, orsuch other sureties as may be proposed by him and dulycertified to by a magistrate as being respectable and re-sponsible persons.

8. In carrying out the services contracted for, the Con-tractor must call at the sites of the various post andreceiving offices now or hereafter to be established by thePostmaster- General's Department on the line contracted

for, and must travel direct to the door of the office beforestopping at any other place whatsoever in any townshipor place where the office is situated. When the contractis for the conveyance of mails either to and from a postor receiving office situated at a railway station or plat-form, or to and from a railway station or plat-form, the Contractor must receive and deliver the mailseither at such post or receiving office, or at the door ofthe mail van, or the railway guard's van, or at both postor receiving office and the van, as may be required by thePostmaster- General. Contractor must also clear any letter-boxes on or about railway stations or platforms or brakevans, and dispose of the contents as may be required bythe Postmaster- General.

9. The Contractor must provide himself with a horn,which he must sound to give notice of the approach of themail to the different stations.

ro. The Contractor shall not be entitled to claim anyextra payment on account of the removal of any post .orreceiving office during his contract, unless such removalshall increase the distance to be travelled by siich Con-tractor on any one day to the extent of one mile.

II. In cases where more than one mode of conveyanceis specified in the tender, the Postmaster- General mayfrom time to time direct that the mode of conveyance thenin use shall be changed to another of the modes specifiedin the tender.

12. All horses used in the conveyance of the mails willbe subject to the inspection, and will be liable to the ap-proval or rejection of the Postmaster - General.

13. Postal Inspectors and Mail Guards must he carriedwithout charge whenever they demand a seat.

14. The mails are to be despatched from any post-officeon the days and at the hours to be fixed by the Postmaster -General, either according to the present arrangement or ashe may afterwards determine; and every Contractor willbe bound to travel at the tate of 8 miles an hour, includingall stoppages, if required to do so.

15. A fine of 5s. for every five minutes' delay after thespecified time of starting, and a like penalty for every tenminutes' delay after the specified time of arrival, exceptfor the first five or ten minutes respectively, will be 'im-posed by the Postmaster- General, unless he shall be satis-fied that the obstacles were insuperable.

16. A fine not exceeding Z5 may be imposed by thePostmaster - General for any other breach of contract.

17. In all instances the usual mail road or route be-tween the places mentioned is to be travelled : and whereno mail has previously run, the .route specified by theContractor in his tender, or if none is specified, suchroute as shall be approved by the Postmaster - General mustbe pursued. In times of flood, when the usual route isimpassable, the mails must be conveyed by whatever routethe Postmaster - General may direct. The Contractor mustnot deviate from the authorized route, nor accept pay-ment from residents for any service performed by himin connexion with his contract, without the consent, inwriting, of the Postmaster- General. Should they so de-sire correspondence for roadside residents must be thrownout at their gates, or placed in boxes provided by themwhen they reside at least a mile from the nearest Postor Receiving Office on condition that the boxes areso placed that the mailmen are not required to deviatefrom the road, or to dismount.

18. Should a Contractor loiter on the road, or wilfullymisspend or lose time, so as to retard the arrival of themail at its proper destination, he is liable under the IIotlisection of the Post and Telegraph Act Igoe to a penaltynot exceeding Zoo, in addition to any fine that may beimposed under these conditions.

19. No excuse for delay in carrying mails will be enter-tained, nor shall anything whatever exonerate the Contrac-tor from liability to the fines hereinbefore imposed. Buton production to the Postmaster- General of certificates orstatutory declarations by persons of known respectability orother sufficient evidence, showing that the delay in anycase was attributable to causes or events which could nothave been anticipated or provided against, the Postmaster -General may remit the fines or a part thereof. And itmust be clearly understood that in every case the pas -sengers must be a secondary consideration to the mails;and that Postal Inspectors, Country Postmasters, andMail Guards have instructions to see that this rule isobserved. '

20. The Contractor shall carry all mails delivered tohim under the authority of the Postmaster - General, or ofany of the Postmasters, and shall provide secure lockersfor the mai'.s in carriages, waterproof coverings for themails on horseback, and leather pouches for loose articles.

21. The Contractor or Mailman conveying mails onhorse -back will not be allowed to carry newspapers or par-cels in addition to the mails, without special authority.

22. The Contractor shall convey mails from or to anyplace on the road beyond a mile from the post - office andshall deface all postage stamps on loose articles which bereceives and delivers without passing through a post-office;but he Ls bound to refuse to carry, and to prevent any of

his servants or passengers from carrying, any letter orpacket to the prejudice of the Post -office revenue, under apenalty of not less than ¿5 or more than ¿50 foreach offence. Unpaid letters and those prepaidless than twopence (or less than one penny wherethe rd. per rate is in operation) received by theContractor en route for transmission by post must be postedat the next post- office at which he arrives, whence they willbe despatched to destination charged with double theamount of the unpaid or deficient postage, to be collectedon delivery. For the guidance of the postmaster at theoffice of posting, such letters should bear an indorsementby the Contractor, indicating the particular point on theroad at which they were received.

23. The Contractor must be careful to make proper ar-rangements, in all cases, to insure the immediate closingof each gate he may pass through. (For any breach of thiscondition, or for any injury to a public gate, a penalty ofZ5 is recoverable under the Public Gates Act Igor.)

24. The Contractor will be required to complete alljourneys appointed to commence on, or immediately before,the date of termination of his contract, and he must dillyreceive and deliver all mails at the various post and re-ceiving offices and places en route.

25. The Contractor will not be allowed to assign or sub-let any portion of his contract without the consent inwriting of the Postmaster- General. For any breach ofthese conditions the Contractor will be liable to a fine ofLi oo.

26. No application for the transfer of a contract will beentertained unless accompanied by a fee of Ten shillingson a contract not exceeding L50 per annum, or Twentyshillings on a contract exceeding 50 per annum.

27. The Contractor will be answerable for any neglecton the part of his agents, mailmen, and servants, and forany breach of contract committed by them.

28. In case the Contractor shall fail to perform thecontract according to the terms thereof, or shall commitany breach of any one or more of these conditions, or shallbecome bankrupt or make any assignment of his estate intrust for creditors, or make any arrangement or compositionwith his creditors, the Postmaster- General may, by noticein writing to the Contractor, cancel the contract ; and there-upon the contract shall be cancelled, and all moneys thendue thereunder shall be forfeited without prejudice never-theless to the rights to any fines and all rghts of actionand other remedies which the Postmaster - General may havein respect of any breach of the contract.

20. In the event of the death, conviction, or bankruptcyof a surety, the Contractor will be required to name anothersurety, who must be duly certified to by a magistrate inthe prescribed form. The Contractor and both suretiesmust then execute a fresh bond.

30. All fines and penalties incurred may be deducted bythe Postmaster General from the quarterly instalments fal -ing due to the Contractor, or may be recovered by actionat law, and must be considered as over and above ?nypenalties provided by any Act of Council or Parliament.

31. The Contractor will be held responsible for the safetyof the mails while in his custody, or in the custody of hisservants, and if he, or they, allow the mails, or their con-tents, to be damaged by carelessness on the part of pas-sengers, or others, while the mails are in such custody, he(the contractor) will be held liable for full compensationfor the damage so caused. Passengers who are allowedto smoke while on a coach or conveyance carrying mailsmust be placed in such a position that mails cannot beinjured by sparks, &c.

32. Any notice to be given to the Contractor under thecontract may be given by delivering the same by letterthrough the post at or to the address of the Contractormentioned in the bond.

33 In the event of any servant of the Contractor ob-taining an order of any Competent Court against theContractor for the payment of any moneys due by theContractor to such servant, for wages or salary in respectof any work done by such servant in connexion with theconveyance of mails, which order remains unpaid and un-satisfied, then the Postmaster- General may at any time atthe request of the servant, unless the Contractor within 48hours after notice of the request proves to . the satisfactionof the Deputy Postmaster - General or officer nominatedby him, that the order has been paid, deduct the amountof any such order from all or any payments to be madeto the Contractor under and in pursuance of his contract,or out of the deposit. and may pay such amount to theservant, obtaining such order, and a receipt under theband of such servant shall be a complete discharge tothe Postmaster- General from all liability to the Contrac-tor for any amount so deducted and paid.

A candidate will be eligible for appointment as Tele-graph Messenger if he passes in Handwriting and Spell-ing only ; but if he secures half marks in Arithmetic aswell (either at his entrance examination or at a subsequentexamination held annually) he will be eligible for ap-pointment to higher positions, such as Telephone Atten-dant, Indoor Messenger, &c., from which officers areselected for promotion to other and more responsiblepositions in the General Division. Telegraph Messen-gers may also be appointed as Assistants in Post Officeson passing a test in telegraphy.

On reaching the age of 21 years, and after three years'service, officers in the General Division may receive asalary of ¿no per annum.

Telegraph Messengers and other General Divisionofficers may qualify for appointment to the Clerical Divi-sion by passing Special Competitive Examinations thatare held from time to time as the requirements of theService demand.

Section io of the Post and Telegraph Act directs thatTelegraph Messengers on attaining the age of 18 yearsmust retire unless previously appointed to some other posi-tion in the Service.

If candidates be not informed to the contrary, the ex-amination will take place at the Post -office at each of theplaces above mentioned, under the supervision of the localPostmaster ; but candidates for appointment at Melbourneand Suburbs, Brisbane and Suburbs, or Adelaide andSuburbs will be subsequently notified where to attend forexamination.

officers in the State of Victoria, who are classified asperforming General Division work, and who have been atleast two years in the service, to qualify for appointmentto the position of Telegraphist in the said State.

Candidates will be required to submit themselves, in thefirst place, to tests in Practical Telegraphy, which willcomprise Sending and Receiving, for io minutes each way,at the rate of 25 words a minute (5 letters to count as oneword), special attention being given, in Sending, to thefirmness, regularity, proper formation, and spacing ofsignals, as well as immunity from "breaks "; and, inReceiving, to accurate transcription, and legible penman-ship. Only those who pass in such tests will be eligibleto sit for examination in the Educational subjects in Sep-tember.

The Education Examination will comprise Handwrit-ing, Dictation, English, Arithmetic, and Geography, asspecified in Regulation 193. Candidates who, though per-forming General Division work, are themselves classifiedas officers of the Clerical Division, or who under the lawof the State in which they were employed have qualifiedfor transfer to the Clerical Division, will not be requiredto sit for examination in the Educational subjects, butmust, in order to become eligible for appointment as Tele-graphist, pass the Telegraphic tests above specified.

Candidates who passed the practical tests at Examina-tions Nos. 26, 32, or 49 are required to state so in theirapplications.* Applications to be examined must not besent through the Department, but direct to, and will bereceived at, this office not later than 31st July, and mustcontain the following particulars, including a certificateindorsed on the application by the local Postmaster (or,in the case of officers attached to the Head Office, by theTelegraph Manager thereof) that the candidate is capableof Sending and Receiving at the rate specified.

Candidates who are to be examined in the Educationalsubjects will be required to pay an examination fee of155., in accordance with the Regulations, but such fee willnot be payable until the results of the practical Examina-tion are made known.

Unless informed to the contrary, the examination ofcandidates stationed at country offices will take place at'the local Post Office ; while those attached to the Centraland Suburban offices will, as regards the practical tests,he examined at the Central Telegraph Office, and will besubsequently informed of the place where the EducationalExamination will be held.

Where a candidate shall have been transferred to anotheroffice between the day of sending in the application to beexamined and the date of the examination, immediatenotification thereof must be sent to this office so thatarrangements may be made for his or her examination.

Copies of the papers set during the year 1906 (Examina-tion Nos. 38 to 56) may be obtained from the GovernmentPrinter, Melbourne, for rs. (including postage, rs. 1d,).

NOTIFICATION OF VACANCIES.APPLICATIONS are invited by the Public Service Com-

missioner from persons qualified for appointment to thepositions specified below.

Applicants outside the Public Service are eligible for appoint-ment to the Administrative and Professional Divisions, but arenot eligible for appointment to Clerical or General Divisionvacancies, unless they were in the service of a State on 1stJanuary, 1901, or have retired from the service of the Common-wealth or of a State.

Officers in the Commonwealth Service must apply through theChief Officer or Permanent Head, in accordance with RegulationNo. 148 (h).

Applicants who are officers of the Public Service of a Stateshould state the date of their appointment to the Service, presentposition and salary.
